It is widely accepted that electoral representative democracy is better—along a number of different normative dimensions—than any other alternative lawmaking political arrangement. It is not typically seen as much of a competition: it is also widely accepted that the only legitimate alternative to electoral representative democracy is some form of direct democracy, but direct democracy—we are told—would lead to bad policy. This article makes the case that there is a legitimate alternative system—one that uses lotteries, not elections, to select political (...) officials— that would be better than electoral representative democracy. This paper takes on several distinct but related tasks. First, I present and discuss what I will call the “Ignorance Thesis,” which states that whenever an agent acts from ignorance, whether factual or moral, she is culpable for the act only if she is culpable for the ignorance from which she acts. Second, I offer a counterexample to the Ignorance Thesis, an example that applies most directly to the part I call the “Moral Ignorance Thesis.” Third, I argue for a (...) principle—Don’t Know, Don’t Kill—that supports the view that the purported counterexample actually is a counterexample. Finally, I suggest that my arguments in this direction can supply a novel sort of argument against many instances of killing and eating certain sorts of animals. (shrink)

The use of artificial intelligence in healthcare contexts is highly controversial for the (bio)ethical conundrums it creates. One of the main problems arising from its implementation is the lack of transparency of machine learning algorithms, which is thought to impede the patient’s autonomous choice regarding their medical decisions. If the patient is unable to clearly understand why and how an AI algorithm reached certain medical decision, their autonomy is being hovered. However, there are alternatives to prevent the negative impact of (...) AI opacity in shared (healthcare professional–patient) decision-making processes, and benefit from the high accuracy of such systems. Despite these ethical issues, this paper advocates for its usage and also defends the positive role that it could have in enhancing patients’ autonomy. I advocate for a system where the implementation of AI is only partial, and humans will remain in control of oversighting algorithm interpretation of medical images and patients’ data. (shrink)

This book examines the human ability to participate in moments of joint feeling. It presents an answer to the question concerning the nature of our faculty to share in what might be called episodes of collective affective intentionality. The proposal develops the claim that our capacity to participate in such episodes is grounded in an ability central to our human condition: our capacity to care with one another about certain things. The author provides a phenomenologically adequate account of collective affective (...) intentionality that takes seriously the idea that feelings are at the core of our emotional relation to the world. He details a form of group emotional orientation that relies on the fact that the participating individuals have come to share a number of concerns. Readers will learn that at the heart of a collective affective intentional episode, one does not merely find a set of shared concerns, but also a particular mode of caring. In the end, the argument presented in this monograph makes plausible the idea that the emotions through which humans participate in moments of affective intentional community express our nature. In addition, it shows that the debate on collective affective intentionality also permits us to better understand the relationship between two conflicting philosophical pictures of ourselves: the idea that we are essentially social beings and the claim that we are creatures for whom our personal existence is an issue. Thus, aiming at an elucidation of the nature of our ability to feel together, the book offers a detailed account of what it is to situationally express our human nature by caring about something in a properly joint manner. Abstract:There is debate about the ontological status of conventional entities in Abhidharma thought. Buddhist texts often draw a distinction between two different kinds of entities, ultimately real entities (paramārtha-sat) and conventionally real entities (saṃvṛti-sat), but are often unclear about what the distinction entails. The debate about whether past and future dharmas are ultimately real reveals that Sam.ghabhadra and Vasubandhu—two prominent Abhidharma philosophers—fundamentally disagree about whether reality consists in one or many modes of being. Saṃghabhadra's Sarvāstivāda position is best understood as (...) the ontologically pluralist view that a dharma can enjoy three distinct but equally fundamental temporal modes of being. Vasubandhu's position is that reality is univocal, that everything is real in the same sense. Because Saṃghabhadra is a pluralist and Vasubandhu is not, Saṃghabhadra affirms the reality of conventional entities whereas Vasubandhu does not. (shrink)

This paper connects the question of the rationality of voting to the question of what it is morally permissible for elected representatives to do. In particular, the paper argues that it is rational to vote to increase the strength of the manifest normative mandate of one's favored candidate. I argue that, due to norms of political legitimacy, how representatives ought to act while in office is tied to how much support they have from their constituents, where a representative’s “support” is (...) a function of the percentage of adults living in the political jurisdiction who voted for her. In a representative system, whether a particular law or policy is legitimate is in part a function of how much support the particular representative government has, rather than simply being a function of the governmental structure or the normative content of the law or policy. Representatives with more support can permissibly act more like trustees (doing what they think is best) and less like delegates (doing what their constituents presently prefer). I argue that this fact provides a reason for individuals to vote, even given the incredibly small chance an individual voter has of casting a pivotal vote. (shrink)

Buddhist philosophers draw a distinction between two kinds of entities: ultimately real entities and conventionally real entities. Among Abhidharma Buddhist philosophers, who accept the fundamental existence of ultimately real entities, there is a debate over the existential status of conventionally real entities. The most prevalent interpretation of the general Abhidharma position is an anti-realist one: conventionally real entities do not exist. Here, however, I will argue that there is at least one Abhidharma philosopher who is not an anti-realist about conventionally (...) real entities. Saṅghabhadra, a fifth-century CE Indian Buddhist philosopher belonging to the Vaibhāṣika-Sarvāstivāda tradition of Abhidharma Buddhism, offers an account of conventionally real entities that takes them to be real. According to him, conventional entities exist, although in a derivative and degenerate way—a way that is supervenient on and grounded in what is ultimately real. Saṅghabhadra’s view substantiates, in his specific case, Kris McDaniel’s argument that Abhidharma accounts of conventional reality are profitably interpreted as the view that conventional entities exist but enjoy a mode of being that is distinct from the fundamental mode of being enjoyed by ultimately real entities. In what follows, I will argue that the pluralist framework that McDaniel lays out for understanding the mode of being that non-fundamental entities enjoy fits well with and makes the most sense of, the account of conventional entities offered by Saṅghabhadra. This paper examines the most influential naturalist theory of health, Christopher Boorse’s ‘biostatistical theory’ . I argue that the BST is an unsuitable candidate for the rôle that Boorse has cast it to play, namely, to underpin medicine with a theoretical, value-free science of health and disease. Following the literature, I distinguish between “real” changes and “mere Cambridge changes” in terms of the difference between an individual’s intrinsic and relational properties and argue that the framework of the BST essentially implies (...) a Cambridge-change criterion. The examination reveals that this implicit criterion commits the BST to the troubling view that an individual could go from being diseased to healthy, or vice versa, without any physiological change in that individual. Two problems follow: the current framework of the BST is ill-equipped to formally embrace Cambridge changes and it is theoretically dubious. The arguments advanced here are not limited to the BST; I suggest they extend to any naturalist claim to underpin medical practice with a value-free theory of health and disease defined in terms of an evolutionary view of biological fitness. No es éste, por otra parte, un asunto de mi especialidad. Dentro del plan de nuestro curso colectivo, mi tarea es más modesta y aparece bien circunscripta. Me debo ocupar del sentido histórico (...) del siglo XVIII, para poder dilucidar si la voluntad revolucionaria de los hombres de 1789 proviene de la concepción de la vida histórica forjada por los pensadores de esa época o si, por el contrario, la niega o la transforma. En otras palabras, he de enfocar aquellos problemas que nos permitirán intentar, en último término, un análisis de las relaciones entre la conciencia histórica y la conciencia revolucionaria del siglo XVIII. Healthcare is one of the domains in which artificial intelligence (AI) is already having a major impact. Of interest is the idea of the digital twin (DT), an AI-powered technology that generates a real-time representation of the patient’s body, offering the possibility of more personalised care. Our main thesis in this paper is that the DT does not merely represent the patient’s body but produces a specific body. We argue, from a philosophical perspective and an ethical-phenomenological approach, that the virtual (...) body created by the DT has a major impact on one’s self-understanding, having consequences for gender expression and identification, and for health. This has deep implications for people who do not conform to gender normativity, for example, trans individuals. We advocate that, with thoughtful development, DT technology can and should be empowering, contributing to better addressing the diversity of bodies and facilitating trans people’s experience in healthcare contexts. Para comprender la visión peirceana acerca de la subjetividad semiótica es necesario establecer antes tres referentes. Cada uno de estos referentes tiene un constructo teórico efectuado por otra serie de nociones, que en este momento no me detendré a explicar, sin embargo, será necesario más adelante acudir a varias de estas nociones para intentar exponer mi tema de investigación. La filosofía peirceana es un sistema amplio y complejo, va madurando en el tiempo. Peirce va definiendo y redefiniendo sus conceptos, hasta (...) cierto punto lo realiza de una manera imbricada, este es su método. Se presenta la dificultad de que la construcción teórica peirceana depende de conceptos que se explican entre sí, lo que hace la labor de investigación y exposición difícil, pues para fin de exponer una idea se requiere acceder a diferentes referentes conceptuales simultáneamente hasta llegar a una noción central. The COVID-19 pandemic has impacted medical care in many ways; previously, a patient would enter a hospital and had an approximate idea of what would happen upon his admission, the physician informed them about it, but in the last two years this scenario has changed. Therefore, our aim was to identify if bioethical principles are present in the physician–patient relationship and the effect of these in the health care provided, through an observational and descriptive study where patients answered the validated (...) ReMePaB questionnaire that measures the presence of bioethical principles in the physician–patient relationship, on the seventh day of their hospital stay and 24 h after discharge, during the period from 1 August to 5 November 2020. In autonomy, an improvement in the score was observed in the second application compared to the first measurement; in the principle of non-vulnerability, the same scenario was observed for the first and second measurements, respectively. In the principles of beneficence, dignity, and justice, no statistically significant differences were observed. Considering the presence or absence of bioethical aspects in health care in this pandemic creates an area of opportunity to know the feelings of the patient during the care received and to maintain what is done well and improve those aspects that can be improved. Euthanasia and the duty to die have both been thoroughly discussed in the field of bioethics as morally justifiable practices within medical healthcare contexts. The existence of a narrow connection between both could also be established, for people having a duty to die should be allowed to actively hasten their death by the active means offered by euthanasia. Choosing the right time to end one’s own life is a decisive factor to retain autonomy at the end of our lives. However, (...) there is no definitive consensus on why physicians should be the ones performing the medical procedure to end a person’s life. The moral problems arising from such assertion are not to be taken lightly, for medical tradition has long regarded the duty not to kill, not to actively end a patient’s life, as the core moral obligation that gives meaning to the medical profession. Our concern is to question the moral justifiability of the arguments offered by physicians not to actively help patients die. (shrink)

Una idea casi universalmente aceptada es que es que la filosofía y la ciencia por naturaleza buscan la verdad. No obstante, para que alcancen la Verdad requieren a fortiori de la fe. A partir de estas ideas, nuestra reflexión está organizada en tres apartados: en el primero abordamos la necesidad de la metafísica como disciplina que encuentra los principios en la naturaleza. Así como, la ciencia gracias a la metafísica encuentra las leyes de esta, pero sólo con ayuda de la (...) fe; en la segunda idea nos centramos en explicar el método de la ciencia y nos preguntamos sí sus formas y metodologías van de acuerdo con la fe. La última idea, trata la dimensión de las ciencias sociales cara al Desarrollo Humano (DH). El argumento que se desarrolla en este apartado sostiene que, el motivo por el cual el hombre, con su razón, busca la verdad; es para dar sentido a su existencia. No obstante, hay que reflexionar sobre el devenir de las Ciencias Sociales puesto que ante el establecimiento de linderos, la inflexión de métodos y metodologías se ha desdibujado e incomprendido de los hechos presentes en la realidad y no se ha tendido a la búsqueda de la verdad. Finalmente, se presentan nuestras conclusiones que ahondan en la propuesta del DH y la bibliografía utilizada para elaborar este trabajo. (shrink)

While committed to the view that Buddhist Reductionism offers the best account of the Abhidharma distinction of the two truths, Siderits (2009) argues that Buddhist Reductionism has the surprising consequence of making itself inexpressible. This inexpressibility follows from the semantic insulation between conventional and ultimate discourses that Siderits argues is required in order to preserve classical logic for both types of discourse, avoiding contradiction and bivalence failure. The concept of psychological trauma is polysemous and remains a subject of ongoing debate among scholars and researchers. One of the most significant discussions surrounding the definition of trauma is the relationship between traumatic events (TE), traumatic memory (TM) and trauma response (TR). Several definitions of trauma provided by world-renowned organizations present the TE as the primary element, suggesting a necessary causal relationship in which the TE is antecedent, and the TM and TR are consequent. I call this the _strong (...) causal view_. In this article, I argue that the strong causal view is problematic as it does not sufficiently account for important trauma-related effects that pose anomalies for the causal position. I argue in favor of two claims. First, in defining psychological trauma, we must move beyond the need for a strong TE-dependent causal relationship and instead adopt a _weak causal view_. To support this, I review the discussion of causation in philosophy of memory that pits causal theories against postcausal theories, and propose two principles that can aid this transition. Second, I propose that among the three elements, TR should be the most critical in defining trauma. My aim is to support those definitions of psychological trauma that focus on TR, as I believe they offer greater explanatory power —especially regarding anomalies that challenge the strong causal view— and are more centered on the survivors' experience than those focused on TE. En este trabajo nos enfocamos fundamentalmente en responder dos interrogantes: (a) ¿Pueden las mujeres ser sujetos ilustrados desde la perspectiva de Hume? y en caso de responder afirmativamente, (b) ¿resulta esta ilustración emancipatoria en términos feministas? En primer lugar, reconstruimos las principales líneas de interpretación feministas de la obra de Hume para ubicar nuestra propuesta dentro de una corriente interpretativa poco explorada aún. En segundo lugar, precisamos el sentido que puede adoptar la noción de “ilustración” en la filosofía de Hume, (...) en discusión con debates de la literatura secundaria contemporánea. En tercer lugar, orientamos nuestra reflexión a responder el primero de los interrogantes e indagamos si las mujeres están incluidas dentro de los rasgos ilustrados que podemos reconocer en el pensamiento de Hume y en qué condiciones. En cuarto y último lugar, ensayamos una respuesta al segundo interrogante: si aquello que podemos interpretar como ilustración femenina en clave humeana constituye una vía para la emancipación de la dominación patriarcal o si, por el contrario, refuerza el sometimiento de las mujeres. Tailoring assistive systems for guiding and monitoring an individual in daily living activities is a complex task. This paper presents ALI, an assistive system combining a formal possibilistic argumentation system and an informal model of human activity: the Cultural-Historic Activity Theory, facilitating the delivery of tailored advices to a human actor. We follow an activity-centric approach, taking into consideration the human’s motives, goals and prioritized actions. ALI tracks a person in order to I) determine what activities were performed over a (...) period of time (activity recognition tracking), and II) send personalized notifications suggesting the most suitable activities to perform (decision-making monitoring). The ALI system was evaluated in a formative pilot study related to promote social activities and physical exercise. (shrink)

In two studies, children's concepts of various types of ordinarily unobservable entities were examined. Study 1 confirmed earlier findings in showing that children aged 4–9 years are confident of the existence of scientific entities such as germs as well as religious beings such as God. At the same time, both age groups are skeptical of the existence of various mythical beings such as mermaids. In Study 2, older children aged 10–12 years were probed for their concepts of religious as compared (...) to scientific phenomena. Despite considerable confidence in each type, older children differentiated between them, both with respect to their level of confidence and their pattern of justification. (shrink)

There has been a great deal of philosophical discussion about using people, using people intentionally, using people as a means to some end, and using people merely as a means to some end. In this paper, I defend the following claim about using people: NOT ALWAYS WRONG: using people—even merely as a means—is not always morally objectionable. Having defended that claim, I suggest that the following claim is also correct: NO ONE FEATURE: when it is morally objectionable to use people, (...) this is for many different kinds of reasons—there is no one wrong-making feature that every morally objectionable using has in common. After discussing these claims, I use them to present and motivate what I call the “precaution” theory of norms against using people. I conclude by considering a few cases from the criminal law context—cases that are naturally described as using people—to assess the moral appropriateness of this kind of use in these cases, and to demonstrate how the theory applies to the real world. Something dramatic, revolutionary, is required. You have ideas. You might have a plan. But although you are certain of the wrong around you, you are not certain of the path forward. You have some doubt about the plan, whether it will work, its moral costs, and whether there are problems you cannot yet see. (...) You have revolutionary doubt. That is good. We need revolutions. But revolutions should not be only conducted by the certain. This article will help you to nourish that doubt, to see why it is almost always epistemically appropriate if also almost always difficult to maintain, to learn how to live and act with it, and to give it its due without it leading to paralysis and inaction. Conventional truth describes things as delivered by ordinary experience; ultimate truth captures the way that things are independent of our interests, practices, and cognitive faculties. It is notoriously difficult to provide an adequate analysis of either conventional or ultimate truth, however. This chapter develops a previous scholarly suggestion to understand conventional truth in Madhyamaka as deflationary truth. It points out that this suggestion is a good one only if a supplementary theory of meaning, which the deflationary theory of truth presupposes, (...) can be given in a way that is consistent with both the limitations of the deflationary theory of truth and with Madhyamaka antirealist metaphysics. It then offers a presentation of Dharmakīrti’s theory of apoha in order to argue that the resources necessary to give the required account of meaning can be found in Dharmakīrti’s account of intentional mental content. Maybe you only have 1000 units of some resource, but 10,000 people need the resource or would benefit from it. One question: why do you control the resource? Leave that aside for now. A second question: how should you allocate the resource? If you are a decision-maker in a health system, and if the resource has to do with medicine or public health, we are in the world of the ethics of scarce resource allocation decisions in healthcare. Munthe et al (...) 1 note that the ‘operational norms that guide actual decision making in this area tend to be similar across health systems’ and include principles concerning need, prognosis, equal treatment and cost-effectiveness. Even with just these principles, there are hard questions of how they ought to be specified, operationalised and balanced against each other when they conflict. They do not focus on this. Instead, they identify a concern: paying attention only to these principles in making allocation decisions may lead decision-makers to miss ‘negative dynamics’ that result from their decisions. They aim to rectify this by suggesting a ‘sustainability’ principle that would sit alongside these other ethical principles, serving as a side-constraint that rules out certain allocation choices or as a distinct reason to be weighed in the decision-making calculus (or a reason to save or insure against negative dynamics). Even good lawyers get a bad rap. One explanation for this is that the professional rules governing lawyers permit and even require behavior that strikes many as immoral. The standard accounts of legal ethics that seek to defend these professional rules do little to dispel this air of immorality. The revisionary accounts of legal ethics that criticize the professional rules inject a hearty dose of morality, but at the cost of leaving lawyers unrecognizable as lawyers. This article suggests that the (...) problem with both the professional rules and the extant accounts of legal ethics is that they treat the role of lawyer as largely uniform, whereas lawyers actually serve several importantly different roles in different contexts. The central insight of the article is that legal ethics must be fundamentally context-sensitive: what lawyers are morally permitted or required to do depends on the background context in which they are working. Additionally, by taking context into account, this article is the first to present a theory of legal ethics as appropriately shaped and constrained by normative political philosophy and norms of political legitimacy. -/- Specifically, the article argues that people act as lawyers in three different contexts: State v. Individual (situations in which the State seeks to apply some general law to a particular individual), Individual v. Individual (situations in which private individuals are engaged in a dispute), and Individual v. State (situations in which individuals object to State conduct on constitutional or other grounds unrelated to the question of whether a general law applies to their particular case); that the value of lawyers, qua lawyers, stems from a different source in each of these contexts; and that a theory of legal ethics must take into account both of these first two claims. This article develops one such theory - the Multi-Context View. To demonstrate how the theory applies in practice, the article applies the Multi-Context View to two significant issues in legal ethics: the ethical issues involved in deciding whether to represent a client and the moral permissibility of the use of tactical delay. This paper aims to explore and offer different hypotheses that could account for an adequate understanding of the duty to die and its relation to biopolitics from two neglected approaches. First, death will be analysed from a biopolitical perspective to understand the crucial role it has in biopower. Second, the focus lies on the two-folded implication that death has in biopower, for it could be either a defiance of it or the final sublimation of its control. Similarly, the next section (...) addresses the relations between death and neoliberalism from a biopolitical perspective, exploring the possibility of understanding the duty to die as resistance to economic mandates or, on the contrary, as the fulfilment of neoliberal interests. Finally, as a continuation of the relations between the duty to die and neo-liberalism, the paper analyses a similar two-folded view of the former from a psychopolitical perspective. (shrink)

How does age matter to moral responsibility and criminal liability? Almost no one thinks that a 3-year old is morally responsible for what she does. No one would think an 8-year old should be held criminally liable for engaging in illegal criminal action—even for something seriously harmful such as intentionally setting fire to a building or badly harming another child. Something else should happen, certainly, but not criminal prosecution and conviction and State punishment. And that’s true even if we might (...) start to think that the 8-year old can be morally responsible, or at least somewhat morally responsible, for what she does. Disagreement might start to enter in as the age increases. What do we think of a 12-year old? A 15-year old? A 17-year old? Gideon Yaffe’s excellent book, The Age of Culpability, is focused on the question of why children—for these purposes, all people under the chronological age of 18—should be given a break, legally speaking, and why this should be done categorically. Yaffe argues that the fact that no one under 18 is eligible to vote is a key part of the explanation. In this paper, I raise two objections to Yaffe’s account. In particular, I raise several questions about the details of Yaffe’s account regarding what it is to “have a say over the law” and the way in which this makes a difference to criminal culpability. Las generaciones que hemos vivido los últimos años del siglo XX y los comienzos de esta nueva centuria solemos pensar que cuando este mundo sea realmente perfecto, entonces nadie tendrá que trabajar, pues es común creer que el trabajo es una de las múltiples imperfecciones de esta existencia. Ahora bien, como se sabe el hombre se encuentra arrojado al trabajo, y al ser éste un quehacer de desdicha y cansancio para él, se toman entonces dos posturas ante su “reivindicación”: la (...) primera apunta a la obtención en mayor grado de beneficios externos y riquezas y, la segunda se encamina por la trasmutación del hombre a la máquina. De manera que, la búsqueda de la retribución y la abolición del esfuerzo marcan las pautas del entendimiento sobre el trabajo en este principio del siglo XXI. La retribución es el fin del trabajo y para generar la mayor posible, no se ve como necesario el sudor de la frente. (shrink)

This paper straightforwardly addresses one of the strongest, from an ethical perspective, objections presented to the duty to die, the one concerned with the lack of a normative theory to support it, offered by Seay in his paper Can there be a “duty to die” without a normative theory? The aim of the paper is to provide strong metaethical grounds to support the duty to die without the need of a moral normative theory. First, the definition and main argument for (...) the duty to die will be presented. Second, Seay’s objection will be described and clearly explained. Third, our metaphysical assumptions and a preliminary metaethical discussion will be offered to situate and understand the context. Finally, we will show how the duty to die can be integrated within the metaethical approach previously presented, defending that there is no need of a normative theory to provide good justification and strong ethical grounds for the duty to die, because they will have already been provided by our metaethical argument. This research delved into the analysis of the role of institutional entrepreneurship within the Colombian business context, focusing on the process of divergent change promoted by entrepreneurs. Following the theory of institutional entrepreneurship, it examined how entrepreneurs operating in non-privileged positions within highly regulated industries challenge established conventions by developing new ventures. The study was underpinned by qualitative research of a descriptive nature, implementing a design based on a review of existing literature. The results of this analysis revealed that the (...) integration of traditional entrepreneurial skills with supplementary and complementary competencies, oriented towards new institutional logics, can constitute an effective strategy for entrepreneurial development in Colombia. Consequently, it is concluded that institutional entrepreneurship exerts a significant influence on entrepreneurial change within Colombia. This finding provides valuable insights for future research and for the design of policies to promote innovation and entrepreneurial development in the country. (shrink)

Desde ines del siglo XX, el Desarrollo Humano (DH) ha planteado la necesidad de un cambio de paradigma que centre su atención en la mejora de la condición de vida de las personas —no únicamente desde la perspectiva de un aumento de ingreso— sino en torno al desarrollo de las capacidades fundamentales o esenciales pertenecientes al ser humano. Esta postura parte de la crítica al utilitarismo y sostiene que el DH tiene que partir de una comprensión profunda del ser humano. (...) Hasta entonces, la pregunta central del desarrollo había sido sobre la capacidad de producción de una nación. Pero, el nuevo planteamiento se preocupa por el estatus de las personas no en cuanto a la felicidad entendida como el poder de generar bienestar en función de obtener placer y evitar el dolor, sino cómo está la gente en sí misma. Entonces, el DH se reiere a un proceso y a un in en sí mismo, mediante el cual la gente accede a oportunidades para ampliar sus capacidades y funcionamientos, puesto que el sujeto de éstas es el hombre mismo. El DH como paradigma tiene que desarrollar un cuerpo teórico de carácter interdisciplinar y, en este punto, la incorporación de la ilosofía se hace urgente. Es necesario incorporar la metafísica del hombre dentro de la antropología social (AS) a la metodología de investigación del DH, a in de responder ¿Cuáles son las capacidades esenciales que le competen a los seres humanos? In his dissent in the Abrams case (November 1919), U.S. Supreme Court Justice Oliver W. Holmes coined the metaphor of a “free trade in ideas” to justify stronger free speech guarantees. This epistemic argument for free speech, later turned into the notion of a “marketplace of ideas,” became a powerful normative and interpretive rationale of expressive freedoms. However, before the Abrams dissent, Holmes was far from being a champion of free speech. As late as the spring of 1919, he had (...) upheld the constitutionality of repressive wartime legislation. Thus, the summer of 1919 is a major turning point in Holmes's views. This article focuses on the role of the young Harold Laski during these months, examining his book recommendations to the Justice. Insisting on the truth-seeking functions of expressive freedoms, Laski's books pointed argument which is found in the Abrams dissent. I also consider additional reasons for Holmes's change of mind, particularly how the “First Red Scare” affected Laski and other civil rights activists. Lastly, the article reflects on what the Laski-Holmes relationship may tell us regarding the later assimilation of the Abrams dissent and the “marketplace of ideas” as core elements of a long-term libertarian tradition of free speech. Although the individual mandate was upheld and the Commerce Clause may have been cabined, the decision to strike down a significant element of the “Medicaid expansion” may prove to be the most significant aspect of the Supreme Court’s decision in NFIB v. Sebelius. Under the Affordable Care Act (ACA), States were required to extend Medicaid coverage to all individuals under the age of 65 with incomes below 133 percent of the poverty line, a new “essential health benefits” package was required (...) for all new Medicaid recipients, and the increased costs due to the expansion would be entirely covered by the Federal government through 2016, with the Federal payment gradually decreasing to a minimum of 90 percent of the total cost from the expanded coverage. The element found to be unconstitutional was §1396c of the ACA, which permitted the withdrawal of all Federal Medicaid funds from those States that did not comply with the ACA’s requirements for Medicaid expansion. The effect on access to health care may be significant: roughly half of those expected to gain coverage under the ACA were going to gain it through the Medicaid expansion; it is unclear how many States will choose to opt into that expansion in the absence of §1396c.1 Additionally, the argument offered by the Court to strike down that provision might be used to attack other federal programs—concerning transportation, social services, environmental protection, and others—that have a similar structure. This paper will demonstrate that the argument rests on a theoretical mistake concerning the relationships between coercion, compulsion, and political accountability and that, further, this mistake is not one legally forced upon the Court. In ‘Excusing Mistakes of Law’, Gideon Yaffe sets out to ‘vindicate’ the claim ‘that mistakes of law never excuse’ by ‘identifying the truth that is groped for but not grasped by those who assert that ignorance of law is no excuse’. Yaffe does not offer a defence of the claim that mistakes of law never excuse. That claim, Yaffe argues, is false. Yaffe’s article is, rather, an effort to assess what plausible thought might be behind the idea that mistakes of (...) law often should not excuse. (Yaffe is interested in more than just the descriptive claim that in Anglo-American legal jurisdictions mistakes of law routinely do not, in fact, excuse.) More particularly, Yaffe is interested in what plausible normative justification there might be for this asymmetric pattern: -/- Asymmetry: False beliefs about non-legal facts often excuse, but false beliefs about the law rarely excuse. -/- Yaffe offers a complex argument in support of Asymmetry. This paper is organised around my reconstruction of Yaffe’s argument. I argue that Yaffe’s argument does not succeed, but that his argument provides a template for an argument that could succeed. This study explores how the integration of environmental practices in gastronomic tourism can increase the competitiveness of tourist destinations in Latin America. Through the analysis of cases in Mexico, Peru and Colombia, sustainable strategies are identified, such as the use of local products and the reduction of waste, which not only contribute to sustainable tourism development, but also improve the image and attractiveness of destinations. The results show that destinations that implement sustainable environmental practices are perceived as more attractive and (...) competitive in a tourism market that is increasingly aware of ecological impacts. Some Buddhists claim that all phenomena are empty of inherent existence and thereby endorse a kind of global anti‐realism. Buddhist global fictionalists argue that for these Buddhists, ordinary discourse is best understood in global fictionalist terms. I argue here that these attempts fail because the types of fictionalism that these accounts are modeled after structurally rely on a non‐fictionalist domain of discourse to establish normative constraints within the target fictionalist domain. If the goal of appealing to fictionalism is to help (...) explain how discourse involving reference to entities that are unreal can still be governed by non‐arbitrary norms of acceptance, such that some conventional claims can be meaningfully described as conventionally true in contrast to other such claims that are conventionally false, then Buddhist global fictionalism undermines its own goals. It does so by eliminating the very feature of a fictionalist account – the ability to appeal to a non‐fictionalist domain – that makes possible the norms that fictionalism is invoked to explain in the first place. Este trabajo parte de la noción filosófica de alteridad, que se puede complementar con las aportaciones de la teoría feminista y su reflexión sobre la diferencia sexual. Hay, al menos, tres aspectos del pensamiento feminista que interesa destacar a propósito de la alteridad: en primer lugar, la crítica a la construcción de lo femenino como alteridad con respecto a lo masculino; en segundo lugar, y de la mano del feminismo de la diferencia, es interesante reflexionar sobre las experiencias físicas y (...) simbólicas de la maternidad, que proporcionan un nuevo modelo de ‘alteridad irreductible’ y nuevos contenidos para una ética del cuidado; en tercer lugar, y partiendo de las consideraciones de Ricoeur sobre la dialéctica entre identidad y mismidad, la alteridad sexual puede ser reformulada como una construcción dinámica articulada a partir de la tensión entre las dimensiones discursivas y performativas.
