Elqayam & Evans (E&E) drive a wedge between Bayesianism and instrumental rationality that most decision scientists will not recognize. Their analogy from linguistics to judgment and decision making is inapt. Normative models remain extremely useful in the progressive research programs of the judgment and decision making field.

I suggest that the post-Hegelian tradition presents us with three contrasting normative models of work. According to the first model, the core norms of work are those of means-ends rationality. In this model, the modern world of work is constitutively a matter of deploying the most effective means to bring about given ends. The rational kernel of modern work, the core norm that has shaped its development, is on this view instrumental reason, and this very same (...) class='Hi'>normative core, in the shape of advanced technology and more efficient, time-saving production, can help to liberate it. The second model, by contrast, takes the core norms of work to be internal to working activity. Rather than work gaining its normativity from something external to it, from ends to which the work is a contingent means, on this second view the core norms of work are expressions of values or meanings that are immanent to working practices themselves. The expressive model of work regards the actual world of work to be constituted historically by work-specific norms, norms which working subjects themselves have invoked and mobilised around in the course of their struggles for emancipation. According to the third model, the core norms of work have to do neither with instrumental rationality nor authentic self-expression. Rather they concern norms that relate either to individual achievement or contribution through work (in the form of esteem) or to the conditions that must in place for individuals to participate in the exchange of services by which market societies reproduce themselves (in the form of mutual respect). Much of cognitive science seeks to provide principled descriptions of various kinds and aspects of rational behaviour, especially in beings like us or AI simulacra of beings like us. For the most part, these investigators presuppose an unarticulated common sense appreciation of the rationality that such behaviour consists in. On those occasions when they undertake to bring the relevant norms to the surface and to give an account of that to which they owe their legitimacy, these investigators tend to favour (...) one or other of three approaches to the normativity question. They are the analyticity or truth-in-a-model approach; the pluralism approach; and the reffective equilibrium approach.All three of these approaches to the normativity question are seriously flawed, never mind that the first two have some substantial provenance among logicians and the third has enjoyed a flourishing philosophical career.Against these views, we propose a strong version of what might be called normatively immanent descriptivism. We attempt to elucidate its virtues and to deal with what appears to be its most central vulnerability, embodied in the plain fact that actual human behaviour is sometimes irrational. (shrink)

In this paper, we explore an under-investigated question concerning the class of formal models that aim at providing normative guidance. We call such models normative models. In particular, we examine the question of how normative models can successfully exert normative guidance. First, we highlight the absence of a discussion of this question – which is surprising given the extensive debate about the success conditions of descriptive models – and motivate its importance. In this paper I discuss the kinds of idealisations invoked in normative theories—logic, epistemology, and decision theory. I argue that very often the so-called norms of rationality are in fact mere idealisations invoked to make life easier. As such, these idealisations are not too different from various idealisations employed in scientific modelling. Examples of the latter include: fluids are incompressible (in fluid mechanics), growth rates are constant (in population ecology), and the gravitational influence of distant bodies can be ignored (...) (in celestial mechanics). Thinking of logic, epistemology, and decision theory as normative models employing various idealisations of these kinds, changes the way we approach the justification of the models in question. Ethics commissions are government advisory commissions mandated to give expert advice on contentious moral issues. As this requires making explicit value judgments, members with expert knowledge of ethics have a natural place as members of such commissions. Apart from these commissions being widespread, their recommendations assume a special normative authority within the legislative process. This raises many fundamental questions concerning the nature of moral expertise and how such commissions should deal with the political contexts in which they operate. Through (...) a reading of the relevant discussions in the literature in which the underlying normative ideals are located, this article reconstructs four normative models of the proper role of ethics commissions. This reconstruction seeks to contribute to analytical clarity and to elucidate the underlying disagreements concerning our expectations of ethics commissions. The four models, labeled ‘commission consensus model’, ‘society-proxy model’, ‘correctness model’, and ‘deep pluralism model’, differ from one another in terms of two main dimensions: the expertise and the public/political dimensions. After describing the models, giving examples from the literature on how they can be explicated, and describing an empirical example of a commission that has approximated the ideals, the strengths and weaknesses of the four models are discussed before the article concludes by asking whether there is one correct model of ethics commissions. What is pedagogy, exactly? Merriam-Webster defines it simply as “the art, science, or profession of teaching.” In contemporary academic discourse, however, pedagogy is generally left undefined — with its apparent implicit meanings ranging anywhere from a specific “model for teaching” (e.g., behaviorist or progressivist instruction) to a broadly political philosophy of education in general (most famously, a “pedagogy of the oppressed”). In this paper, Norm Friesen and Hanno Su follow the Continental pedagogical tradition in giving pedagogy a general but (...) explicit definition. They do so by looking at how pedagogy arises both in everyday life and in school as unavoidably ethical activity undertaken primarily for the sake of the young person or child. Such activities, the authors maintain, are structured not so much by processes, methods, and outcomes, but by irresolvable oppositions and the tensions between them. They illustrate this inductively through a series of images and examples — moving gradually from ones involving parenting and early childhood to ones from elementary and secondary schooling. In this way, Friesen and Su show that pedagogy is not so much one or more ideologically focused or evidence-based instructional or psychological approaches to be mastered by a professional or teaching specialist. It is instead an independent but ethically informed practical perspective — one that can (and has) been extended to form a distinctively pedagogical theory and discipline. Let me begin by admitting that I am wary of any comprehensive definition of consent. This bias stems from my professional concentration on criminal law, in which nouons of freedom and responsibility play vital roles in a wide range of contexts. In each context, however, one discovers that freedom means something different. A voluntary act is any bodily movement not caused by external force or nervous disorder. On the other hand, a voluntary act, however horrific its results, ordinarily may be (...) punished only if the actor was subjectively aware that the act was wrong. In any event, a voluntary act may be excused as the product of duress if another person procures the actor's cooperation in the crime by an illegal threat that would overcome the resistance of a person of ordinary firmness. The Emergence of Word-Meaning in Early China makes an innovative contribution to studies of language by historicizing the Chinese notion that words have "meaning" (content independent of instances of use). Rather than presuming that the concept of word-meaning had always existed, Jane Geaney explains how and why it arose in China. To account for why a normative term (yi, "duty, morality, appropriateness") came to be used for "meanings" found in dictionaries, Geaney examines interrelated patterns of word usage threading through (...) and across a wide range of genres. These patterns show that by the first millennium, as textual production exploded—and as radically different writing forms (in Buddhist sutras) were encountered—yi already functioned as an externally accessible "model" for semantic interpretation of texts and sayings. The book has far-reaching implications. Because the idea of word-meaning is fundamental to theorizing, the book illuminates not only semantic ideas and the normativity of language in Early China, but also aspects of early Chinese philosophy and intellectual history. As the internet supplants one form of media (print), thereby reducing knowledge to vast digital databases, so too, this book explains, two thousand years ago a culture that prized oral and visual balance became an "empire of the text.". In many studies, human reasoning has been depicted as “biased” or deviating from normative models in both areas of deductive and inductive reasoning. Two criteria for evaluation of reasoning studies are proposed in this paper. The first criterion concerns the selection and application of normative models against which human performance is assessed. The second criterion concerns the role of conversational factors in the differential selection of information used in the subsequent judgment. These two criteria were applied to studies (...) on two tasks from the fields of deductive and inductive reasoning, the Wason selection task and the base rate fallacy. In view of alternative normative systems, control of the application of the normative models used and the perceived conversational relevance of the information presented in the experimental tasks, the alleged biases have been demonstrated to be largely unsupported. The analysis is consistent with the notion that human reasoning is optimal and rational. The implications of the present account for reasoning experiments are discussed. (shrink)

The article, authored by Ukrainian and Polish social researchers, analyses normative approaches towards understanding models of democracy and their relation to civic space. Despite the existence of multiple models of democracy, they can largely be reduced to two main forms: direct and representative democracy.Deliberative democracy is posited as a third form, which, according to some scientists, combines elements of representative, direct, and participatory democracy. The analysis is based on the assessment of democracy and civic space in Ukraine, utilising data (...) from six applied international social studies, as well as the evaluation of the modern characteristics of some components of Ukrainian civic space. According to the rating of CIVICUS Monitor, Ukraine has been classified in the category of countries where the civic space is «obstructed» from 2019 to the present time (Autumn 2023). Currently, the advancement of civic space in Ukraine towards more favourable forms of freedom of association, peaceful assembly, and expression of opinion in the country are threatened by several factors simultaneously, with the dominant role being Russia's full-scale war against Ukraine.During the martial law and in the post-war context of Ukraine, civil society acts as an indispensable ally of the authorities in the process of democratic reconstruction. Civil society organizations (CSOs) represent a wide range of social interests, ensuring that the voices of different groups and segments of thepopulation are heard and taken into account. Their broad base allows them to bridge the gap between government and citizens, helping to build trust and ensuring transparency. CSOs have a proven track record of institutional monitoring, which is a critical factor in preserving and strengthening democratic values in a post-conflict environment.The article also uses the results of the authors' previous and current academic research*, as well as the results of twenty years of advocacy and analytical work as public experts in Ukraine and Europe. ==== *Remark. Soft regulatory measures are often promoted as an alternative for existing regulatory regimes for nanotechnologies. The call for new regulatory approaches stems from several challenges that traditional approaches have difficulties dealing with. These challenges relate to general problems of governability, tensions between public interests, but also (and maybe particularly) to almost complete lack of certainty about the implications of nanotechnologies. At the same time, the field of nanotechnology can be characterized by a high level of diversity. In this paper, we (...) discuss and compare two models for framing public policy in relation to technology regulation: the first is a deliberative model based on foresight knowledge and the second the wide reflective equilibrium model, developed by political philosopher John Rawls. In both models, the aim is to find consensus on (a framework for) policy measures and regulation. On the basis of a critical discussion of the strengths and weaknesses of both models, some tentative conclusions are drawn for effective policy making and implementation based on soft law. (shrink)

Michael Tomasello ( 2016 ) prominently defends the view that there are uniquely human capacities required for shared intentions, therefore great apes do not share intentions. I show that these uniquely human capacities for abstraction are not necessary for shared intentionality. Excluding great apes from shared intentions because they lack certain capacities for abstraction assumes a specific interpretation of shared intentionality, which I call the Roleplaying Model. I undermine the necessity of abstraction for shared intentionality by presenting an alternative (...) model of shared intentionality, which I call the Normative Model. It is a modification of Margaret Gilbert’s ( 2013 ) Plural Subject theory, which I modify such that it is, in principle, compatible with nonhuman shared intentionality. To do this, I substitute Gilbert’s account of obligation for Kristin Andrews’ ( 2020 ) account of animal social norms. In this Normative Model, uniquely human capacities for abstraction are not required for shared intentionality. By undermining the necessity of uniquely human abstraction, I make cases of prima-facie cooperation in chimpanzees plausible instances of shared intentionality. The Roleplaying Model’s denial of nonhuman shared intentionality creates a problem insofar as apparent shared intentional activity cannot be fully analyzed. The Normative Model resolves this problem. I argue that normative formal epistemology (NFE) is best understood as modelling, in the sense that this is the reconstruction of its methodology on which NFE is doing best. I focus on Bayesianism and show that it has the characteristics of modelling. But modelling is a scientific enterprise, while NFE is normative. I thus develop an account of normative models on which they are idealised representations put to normative purposes. Normative assumptions, such as the transitivity (...) of comparative credence, are characterised as modelling idealisations motivated normatively. I then survey the landscape of methodological options: what might formal epistemologists be up to? I argue the choice is essentially binary: modelling or theorising. If NFE is theorising it is doing very poorly: generating false claims with no clear methodology for separating out what is to be taken seriously. Modelling, by contrast, is a successful methodology precisely suited to the management of useful falsehoods. Regarding NFE as modelling is not costless, however. First, our normative inferences are less direct and are muddied by the presence of descriptive idealisations. Second, our models are purpose-specific and limited in their scope. It begins by analyzing what normative claim of morality and law consists of before presenting and criticizing the Social Intuitionist Model of normative judgement developed by Jonathan Haidt. The model poses serious challenges for well-established normative concepts, and the concept of normativity as objective reason for action in particular. Članek se ukvarja s pojmom uklonljivosti, s posebnim ozirom na uklonljivost moralnih in pravnih norm. Na začetku začrtamo grob oris pojava uklonljivosti, ki je zahteven izziv tako za moralno kot tudi za pravno teorijo. Opozorimo na pogoje in primerjalne prednosti, ki naj bi jih izpolnjeval oz. imel model uklonljivosti. Nadalje se v članku osredotočimo na svojstven model uklonljivosti, ki uporablja pojem normalnih pogojev da bi zajel omenjeni pojem uklonljivosti norm. Trdimo, da temu modelu pri tem spodleti, posebej z (...) vidika predpostavke nadaljnjih pomembnih norm, za katere imamo upravičene razloge za dvom, da so prav tako uklonljive. Tako ta model ne dopušča, da bi uklonljivost segala do samih temeljev zadevnega normativnega področja in omeji značilnost uklonljivosti na norme na srednji ravni. V zaključku poudarimo nekaj naukov te razprave in jih umestimo v širše polje pluralističnega pristopa k normam. (shrink)

The Theory of Planned Behavior predicts that a combination of attitudes, perceived norms, and perceived behavioral control predict intentions, and that intentions ultimately predict behavior. Previous studies have found that the TPB can predict students’ engagement in plagiarism. Furthermore, the General Theory of Crime suggests that self-control is particularly important in predicting engagement in unethical behavior such as plagiarism. In Study 1, we incorporated self-control in a TPB model and tested whether norms, attitudes, and self-control predicted intention to plagiarize (...) and plagiarism behavior. The best statistical fit for the path-analytic model was achieved when a direct path from self-control to plagiarism engagement was specified. In Study 2, we added a measure of perceived behavioral control and split the measurement of norms into descriptive and injunctive components. This study found that both self-control and perceived-behavioral control additively contributed to the prediction of plagiarism and the path-analytic model achieved its best fit when direct paths from perceived norms to plagiarism behavior were specified. These studies suggest that setting strong anti-plagiarism norms, such as by the use of honor codes, and seeking to enhance students’ self-control may reduce engagement in plagiarism. (shrink)

This paper applies Bayesian theories to critically analyse and offer reforms of intelligence analysis, collection, analysis, and decision making on the basis of Human Intelligence, Signals Intelligence, and Communication Intelligence. The article criticises the reliabilities of existing intelligence methodologies to demonstrate the need for Bayesian reforms. The proposed epistemic reform program for intelligence analysis should generate more reliable inferences. It distinguishes the transmission of knowledge from its generation, and consists of Bayesian three stages modular model for the generation of (...) reliable intelligence from multiple coherent and independent testimonial sources, and for the tracing and analysis of intelligence failures. The paper concludes with suggestions for further research, the development of artificial intellignce that may measure coherence and reliability of HUMINT sources and infer intelligence following the outlined general modular model. This is a paper about the methodology of normative ethics. I claim that much work in normative ethics can be interpreted as modelling, the form of inquiry familiar from science, involving idealised representations. I begin with the anti-theory debate in ethics, and note that the debate utilises the vocabulary of scientific theories without recognising the role models play in science. I characterise modelling, and show that work with these characteristics is common in ethics. This establishes the plausibility of (...) my interpretation. Taking methodological inspiration from modelling in science gives us new tools for managing idealisations, and a new perspective on pluralism. I demonstrate why this interpretation is a fruitful way of interpreting ethics, by looking at three case studies. First, I return to the anti-theory debate and argue that modelling opens up a new middle ground. Second, I argue that a modelling lens offers a new way of understanding impossibility theorems in population ethics, and their bearing on ethics as a whole. Finally, I show how viewing our work as modelling can be deployed in debates within ethics, using the debate over prioritarianism as an example. I close with further methodological suggestions for those who choose to see themselves as modellers. I discuss the role of counterexamples, our responses to moral disagreement, and the training of new ethicists. (shrink)

The paper presents a novel view of social norms that reflects the importance of different agent types, their specific motivations and roles. How one identifies with a role and behavioral options available to the agent is crucial for the sustainability of the social norms. The analysis of a simple case of social norm is suggested as a default model for analysis, and then the classification of subjects, enforcers, and audience is introduced. This triangular typology of agents is extended by (...) introducing a network of interlocking patterns underlying social behavior. The paper discusses the notion of defeasibility and focuses specifically on defeasible norms. First, it delineates a robust notion of the phenomenon of defeasibility, which poses a serious problem for both moral and legal theory. It does this by laying out the conditions and desiderata that a model of defeasibility should be able to meet. It further focuses on a specific model of defeasibility that utilises the notion of normal conditions to expound the robust notion of defeasibility. It (...) argues that this model fails in its attempt to do this, particularly since it presupposes further pertinent norms and we have reasons to doubt if these are defeasible. It thus does not allow defeasibility to go “all the way down” in the normative domain and limits it merely to a feature of some sort of mid-level norm. In conclusion, it draws lessons from this and positions defeasibility models within a more general pluralistic approach to norms. (shrink)

In the methodology of theory construction, the concept of "intuitions" is commonly assigned a central role. This is especially true of philosophical and social scientific theories or rational human agency. An equally important trait of such accounts is the theorist's employment of "ideal models" or rational agency. It is frequently supposed that the concept of intuitions and the concept of ideal models link in such a way as to give rise to a coherent and load-bearing notion of "objective normativity." Asimismo, se detalla cómo la medicalización de las identidades por parte del Derecho contradice la evolución del concepto de género. The author analyzes the transformation of norms and values in France and England during the preindustrial period (1500-1760). The relationship between religion and reason, the nature of popular fears, witchcraft, marriage, attitudes toward death, and persecution of confessional minorities are singled out for closer examination. The interplay between the two national traditions and the Catholic and Protestant ways remains under constant focus. The new norms and models for behavior that arose in each country in this period, besides being different, were (...) also articulated, communicated, and enforced differently, even though there is a broad family resemblance between the changes in France and in England that led to modernization. It is argued that the general concepts used in comparative religious ethics should always be suspect and may be of questionable applicability outside the historical wholes which gave them birth. To enhance the applicability of these concepts, it is proposed that the work adopt the more limited ambition of comparing cultural wholes that are geographically close and culturally permeable. The notion of normativity has been key to an actualizing reading of the subjective universality that for Kant characterizes the aesthetic judgment. However, in the scholarly literature little discussion is made, somehow unsurprisingly, of what exactly we should understand by normativity when it comes to Kant’s aesthetics. Recent trends show indeed the tendency to take normativity very broadly to the point of nuancing most of its core meaning. Based on how we speak about normativity in aesthetics, we seem indeed to (...) have accepted that every kind of evaluative process is normative. I will argue that the sentimentalist elements of Kant's account call for a revision of its normative interpretations, for a better framing of its subjective universalism, and finally for a reconsideration of aesthetic normativity in favour of regulativity. Management of the renewable natural resources in Madagascar is gradually being transferred to the local communities, particularly that of forest resources. However, these local communities are struggling to assess the consequences of management plans that they themselves must develop and implement on ecologically, economically and socially sustainable grounds. In order to highlight key aspects of different management options beforehand, we have developed MIRANA, a computer model to simulate various scenarios of management plan implementation. MIRANA differs from other simulation models (...) by not only taking into account individual practices and economic exchanges, but also by accounting for the applicable regulations. These regulations are taken into consideration by means of a multiplicity of normative structures within a spatial context. The objective of this paper is to describe the representations of institutions, norms and territories proposed by MIRANA and to discuss these representations in relation to the state of the art in the field of normative multi-agent systems. The key advantage of our ‘connectedness’ model is that it explains how subjects can share the same normative concepts despite radical divergences in the descriptive or motivational commitments they associate with them. People who work and live in a certain moral practice usually possess a specific form of moral wisdom. If we manage to incorporate their moral intuitions in ethical reasoning, we can arrive at judgements and theories that grasp a moral experience that generally cannot be found outside the said practice. To achieve this goal, we need a legitimate way to balance moral intuitions, ethical principles and general theories. In the present contribution, we describe a version of the model of (...) Reflective Equilibrium, which we call the Normative-Empirical Reflective Equilibrium . RE provides a framework for ethical thinking that includes both moral experience and normative theory.After an outline of the model, we focus on the role of empirical research and illustrate how empirical data on moral intuitions can add to the comprehensiveness of the set of moral beliefs in NE-RE. Subsequently, we describe how coherence among the elements of an NE-RE can be understood and measured. Finally, we address an important question for any method of moral reasoning: what is the status of the outcome of the reasoning process? This is a matter of justification. We argue for a so-called good reasoning-justified outcome strategy in NE-RE. This strategy is built on a reasoning process in which the reason-giving force of each element is tested and weighed. The thinker has to work towards a coherent view in which only the elements with sufficient justificatory power are retained. If the thinker decides that the elements fit together into a coherent view, a reflective equilibrium is reached. NE-RE is an attempt to describe a model for moral reasoning that can profit from the moral wisdom present among experienced agents through the use of empirical research. (shrink)

Subsequently, we describe how coherence among the elements of an NE-RE can be understood and measured. Finally, we address an important question for any method of moral reasoning: what is the status of the outcome of the reasoning process? This is a matter of justification. We argue for a so-called good reasoning-justified outcome strategy in NE-RE. This strategy is built on a reasoning process in which the reason-giving force of each element is tested and weighed. The thinker has to work towards a coherent view in which only the elements with sufficient justificatory power are retained. If the thinker decides that the elements fit together into a coherent view, a reflective equilibrium is reached. NE-RE is an attempt to describe a model for moral reasoning that can profit from the moral wisdom present among experienced agents through the use of empirical research. (shrink)

Many have expected that understanding the evolution of norms should, in some way, bear on our first-order normative outlook: How norms evolve should shape which norms we accept. But recent philosophy has not done much to shore up this expectation. Most existing discussions of evolution and norms either jump headlong into the is/ought gap or else target meta-ethical issues, such as the objectivity of norms. My aim in this paper is to sketch a different way in which evolutionary considerations (...) can feed into normative thinking—focusing on stability. I will discuss two forms of argument that utilize information about social stability drawn from evolutionary models, and employs it to assess claims in political philosophy. One such argument treats stability as feature of social states that may be taken into account alongside other features. The other uses stability as a constraint on the realization of social ideals, via a version of the ought-implies-can maxim. These forms of argument are not new; indeed they have a history going back at least to early modern philosophy. But their marriage with evolutionary information is relatively recent, has a significantly novel character, and has received little attention in recent moral and political philosophy. (shrink)

A key assumption fuelling optimism about the progress of Large Language Models (LLMs) in modelling the world is that the truth is systematic: true statements about the world form a whole that is not just consistent, in that it contains no contradictions, but coherent, in that the truths are inferentially interlinked. This holds out the prospect that LLMs might in principle rely on that systematicity to fill in gaps and correct inaccuracies in the training data: consistency and coherence promise to (...) facilitate progress towards comprehensiveness in an LLM’s representation of the world. However, philosophers have identified compelling reasons to doubt that the truth is systematic across all domains of thought, arguing that in normative domains, in particular, the truth is largely asystematic. I argue that insofar as the truth in normative domains is asystematic, this renders it correspondingly harder for LLMs to make progress towards comprehensiveness, because they cannot leverage the consistency and coherence of truths. And the less LLMs can rely on the systematicity of truth, the less we can rely on them to do our practical deliberation for us, because the very asystematicity of normative domains requires human agency to play a greater role in practical thought. Beginning with the initial premise that as the Internet has a global character, the paper will argue that the normative evaluation of digital information on the Internet necessitates an evaluative model that is itself universal and global in character. The paper will show that information has a dual normative structure that commits all disseminators of information to both epistemological and ethical norms that are in principle universal and thus global in application. Based on this dual normative (...) characterization of information the paper will seek to demonstrate: that information and internet information specifically, as a process and product of communication, has an inherent normative structure that commits its producers, disseminators, communicators and users, everyone in fact that deals with information, to certain mandatory epistemological and ethical commitments; and that the negligent or purposeful abuse of information in violation of the epistemological and ethical commitments to which its inherent normative structure gives rise is also a violation of universal rights to freedom and wellbeing to which all agents are entitled by virtue of being agents, and in particular informational agents. There has, in recent decades, been considerable scholarship regarding the moral aspects of corporate governance, and differences in corporate governance practices around the world have been widely documented and investigated. In such a context, the claims associated with moral relativism are relevant. The purpose of this paper is to provide a detailed consideration of how the metaethical and normative claims of moral relativism in particular can be applied to corporate governance. This objective is achieved, firstly, by reviewing what is (...) meant by metaethical moral relativism and identifying two ways in which the metaethical claim can be assessed. The possibility of a single, morally superior model of corporate governance is subsequently considered through an analysis of prominent works justifying the shareholder and stakeholder approaches, together with a consideration of academic agreement in this area. The paper then draws on the work of Wong, firstly in providing an argument supporting metaethical moral relativism and secondly regarding values of tolerance and/or accommodation that can contribute to the normative claim. The paper concludes by proposing an argument that it is morally wrong to impose a model of corporate governance where there are differences in moral judgements relevant to corporate governance, or to interfere with a model in similar circumstances, and closes with consideration of the argument’s implications. This paper investigates the relationship between generic statements and the expression, transmission and persistence of social norms. The author presents the concept of normativity and its importance in the decision-making process in the context of social reality and social norms that comprise it (Bicchieri, 2006, 2016; Bicchieri et al., 2018). The paper analyses the idea of “what is normal” (Haslanger, 2014) to show how social norms are triggered by particular generic constructions relating to “social kinds”, represented by noun phrases denoting (...) “dual character concepts” (Knobe et al., 2013; Prasada et al., 2013; Leslie, 2015). DCCs are shown as effectively serving their persuasive and explanatory function due to their polysemous nature (Leslie, 2015) rather than to different pragmatics (Leslie, forthcoming). Special focus is placed on gender terms as particularly salient social kinds; this salience can be explained by a culturally pivotal role of social constructs of manhood and womanhood and by linguistic potential of generics in the development of social beliefs and legitimizing norm-driven behaviours. There exists a widespread consensus amongst contemporary jurisprudents, positivists and non-positivists alike, that the meaning of ‘obligation’ should not radically shift from law to morality, or any of the other domains of practical reason. Yet there is limited effort in contemporary discussions of legal obligation to engage with the metaphysics of normativity with an eye to a well-founded account of those elements that deliver its non-conditional character. On a recent occasion I discussed the shortcomings of a prominent positivist account of (...) legal obligation, that of Jules Coleman. In this chapter I turn to a prominent non-positivist account, the model of principle, and argue that, even though it identifies key elements or conditions of normativity simpliciter, it stops short of delivering a conclusive account of unconditional legal obligation, an account that would place legal obligation in the same continuum with all other types of obligation. Taking up from where the model of principle halts, I propose a complementary—if more fundamental—account of normativity simpliciter, which I dub the model of norms. I make a case for it, by looking into universal conditions of normativity and, in conclusion, offer some more specific remarks about the advantages of the model of norms over other competing models. Part 2 looks into the account of legal obligation tendered by the model of principle. According to it, law is an instance of action-directing action or action that purports to get other agents to comply with the ends it sets out to attain. The idea here is that the very logic of action-direction draws moral reasons—principles—into the picture of legal obligation, as the one item that can explain how and whether the facts of a social practice, which purports to direct action, come to acquire the status of reasons for action for the subjects of law. Subsequently, this model is contrasted with an alternative model of obligation that takes facts of authority to constitute reasons of action in virtue solely of their structure. In conclusion it is argued that, in contrast to the second model, the model of principle manages to capture what is distinctive about action-directing action in the domain of law—that is, the special normative significance of the possibility to coerce others under a scheme of public institutions. Part 3 opens by pointing to a more widespread worry that needs to be addressed before the model of principle can be deemed fit for the role it is employed—the worry relates to the ability of principles to constitute genuine reasons for action. In particular, the enquiry investigates the nature of principles and their ability to avoid certain flaws that might pertain to reasons for action in general. In taking up this line of enquiry the paper looks into the more general debate on normativity with a view to specifying requirements that anything which purports to be a reason ought to meet. I employ a rationalist analysis of normativity, which brings the idea that intentional thought is normative to bear on the analysis of the meaning of normative terms, such as ‘ought’, ‘obligation’, ‘duty’. In conclusion, I argue that the content of normativity consists in normative facts—ie norms—which purport to model the content of ideal—or counterfactual—states of the will. Such norms give exhaustively the content of normativity. In light of the above, part 4 advances a two-layered model of norms, with the higher level being populated by norms simpliciter, and the lower by norms in a domain. When considered jointly the two layers ground the possibility of non-conditional obligation without evoking moral realism and the concomitant suspicion of scepticism. On the face of it some key advantages of the model of norms are discussed over the two other models of legal obligation, that of principle and that of authority. On the one hand norms resist the ‘talking past each other objection’ which is commonly levelled against principles. On the other, norms are much better suited to account for the moral limits of action-directing action than either principles or facts of authority, for they illustrate cogently that the grounds of any reason for action already include a concern for others’ autonomy.
