  1. Addressing implicit bias: A theoretical model for promoting integrative reflective practice in live-client law clinics.Marc Johnson & Omar Madhloom - 2024 - European Journal of Legal Education 5 (1):55-87.
Clinical Legal Education programmes now take place in most law schools in England and Wales. However, legal education continues to be predominantly focused on the analysis and application of rules, doctrines, and theories to hypothetical scenarios or essay questions. This form of pedagogy either minimises or ignores the role of the client in terms of supplying lawyers with knowledge pertinent to their case. In other words, it overlooks the fact that the lawyer’s acquisition of knowledge is not confined to technical (...)

A rights‐based proposal for managing faith‐based values and expectations of migrants at end‐of‐life illustrated by an empirical study involving South Asians in the UK.Jo Samanta, Ash Samanta & Omar Madhloom - 2018 - Bioethics 32 (6):368-377.
International migration is an important issue for many high‐income countries and is accompanied by opportunities as well as challenges. South Asians are the largest minority ethnic group in the United Kingdom, and this diaspora is reflective of the growing diversity of British society. An empirical study was performed to ascertain the faith‐based values, beliefs, views and attitudes of participants in relation to their perception of issues pertaining to end‐of‐life care. Empirical observations from this study, as well as the extant knowledge‐base (...)

Andean aesthetics and anticolonial resistance: a cosmology of unsociable bodies.Omar Rivera - 2022 - New York: Bloomsbury Academic.
Informed by Gloria Anzaldúa's and José Carlos Mariátegui's work, as well as by Andean cosmology, Omar Rivera turns to Inka stonework and architecture as an example of a "Cosmological Aesthetics." He articulates ways of sensing, feeling and remembering that are attuned to an aesthetic of water, earth and light. On this basis, Rivera brings forth a corporeal orientation that can be inhabited by the oppressed, one that withdraws from predominant modern/Western conceptions of the human. By providing an aesthetic analysis (...)

The Foundation of Norms in Islamic Jurisprudence and Theology.Omar Farahat - 2019 - Cambridge University Press.
In this book, Omar Farahat presents a new way of understanding the work of classical Islamic theologians and legal theorists who maintained that divine revelation is necessary for the knowledge of the norms and values of human actions. Through a reconstruction of classical Ashʿarī-Muʿtazilī debates on the nature and implications of divine speech, Farahat argues that the Ashʿarī attachment to revelation was not a purely traditionalist position. Rather, it was a rational philosophical commitment emerging from debates in epistemology and (...)

Achieving Top Performance While Building Collegiality in Sales: It All Starts with Ethics.Omar S. Itani, Fernando Jaramillo & Larry Chonko - 2019 - Journal of Business Ethics 156 (2):417-438.
While previous literature provides evidence of the positive relationship between ethical climate and job satisfaction, the possible mechanisms of this relationship are still underexplored. This study aims to enhance scholars’ and practitioners’ understanding of the ethical climate–job satisfaction relationship by identifying and testing two of the possible mechanisms. More specifically, this study fills an existing research gap by examining social and interpersonal mechanisms, referred to in this study as workplace isolation of colleagues and salesperson’s teamwork, of the ethical climate–job satisfaction (...)

    Stillness, Aesthesis, Resistance.Omar Rivera - 2020 - Critical Philosophy of Race 8 (1-2):84-101.
Emphasizing the embodied, physical aspect of María Lugones's decolonial feminism, this article elucidates ways in which the oppressed appears to colonizing gazes and beyond them in order to explore possibilities of resistance. It proposes “stillness” as a sentient physicality that can transgress the hold of racist/colonizing gazes and sense a multiplicity of worlds from a limen. In order to do this, it focuses on the temporality of “stillness” and on modes of appearing of resistant praxis.

When must a patient seek healthcare? Bringing the perspectives of islamic jurists and clinicians into dialogue.Omar Qureshi & Aasim I. Padela - 2016 - Zygon 51 (3):592-625.
Muslim physicians and Islamic jurists analyze the moral dimensions of biomedicine using different tools and processes. While the deliberations of these two classes of experts involve judgments about the deliverables of the other's respective fields, Islamic jurists and Muslim physicians rarely engage in discussions about the constructs and epistemic frameworks that motivate their analyses. The lack of dialogue creates gaps in knowledge and leads to imprecise guidance. In order to address these discursive and conceptual gaps we describe the sources of (...)

This article is an interpretation of Alejandro Vallega’s “decolonial aesthetics,” focusing on his book Latin American Philosophy: From Identity to Radical Exteriority. This interpretation situates decolonial aesthetics in relation to figures in the history of Latin American Philosophy, and the work of Aníbal Quijano, Enrique Dussel, Linda Martín Alcoff, and Gloria Anzaldúa. It also explores the determination of decolonial aesthetics as an aesthetics of liberation.

Political Ontology (and Representative Politics), Agamben, Dussel... Subcomandante Marcos.Omar Rivera - 2011 - Epoché: A Journal for the History of Philosophy 16 (1):125-138.
This paper articulates a ‘political ontology’ by orienting Agamben’s inquiries toward the autonomy of the constituting power. In relation to Agamben’s thought, it (1) clarifies it by drawing a categorical distinction between zōē and bare life, (2) departs from it by using Agamben’s analysis of potentiality to understand the paralysis of the constituting power and (3) develops it by unfolding the category of ‘exigency.’ The paper also sets into play a brief encounter between political ontology and representative politics (in Dussel).

Resistant Epistemologies from the Andes.Omar Rivera - 2020 - Journal of World Philosophies 5 (1):76-88.
This paper adds to the epistemological contributions of Latin American philosophy. In particular, I propose a “resistant epistemology” informed by contemporary indigenous Andean philosophies and cosmologies. Focusing on the work of María Lugones, Rodolfo Kusch, and Silvia Rivera Cusicanqui, I explore ways in which communities are made and remade on the basis of knowledges from below, surviving political and ecological crises, including colonialism and modern development. These kinds of resistive knowledges draw from rituals, quotidian and cosmic rhythms, and affective withdrawals (...)

The publication of Gillian Brock's Global Justice: A Cosmopolitan Account in 2009 and of Richard Miller's Globalizing Justice: The Ethics of Poverty and Power in 2010 have created an important occasion for reassessing the discourse about global justice that has arisen in the last decade. Above all, these books have moved the debate about what constitutes global justice in an exciting new direction by introducing important considerations previously lacking. But most essentially, these books give us an opportunity to assess whether (...)

Over the past two decades, we have seen an increase in the use of medical-legal partnerships in health-care and/or legal settings to address health disparities affecting vulnerable populations. MLPs increase medical teams' capacity to address social and environmental threats to patients' health, such as unsafe housing conditions, through partnership with legal professionals. Following the Preferred Reporting Items for Systematic Review and Meta-Analyses guidelines, we systematically reviewed observational studies published from January 1993-January 2016 to investigate the capacity of MLPs to address (...)

This paper aims to balance the conceptual reception of Bourdieu's sociology in the United States through a conceptual re-examination of the concept of Habitus. I retrace the intellectual lineage of the Habitus idea, showing it to have roots in Claude Levi-Strauss structural anthropology and in the developmental psychology of Jean Piaget, especially the latter's generalization of the idea of operations from mathematics to the study of practical, bodily-mediated cognition. One important payoff of this exercise is that the common misinterpretation of (...)

In this paper, I critically examine Stephen Turner's critique of practice theory in light of recent neurophysiological discoveries regarding the “mirror neuron system” in the pre-frontal mo-tor cortex of humans and other primates. I argue that two of Turner's strongest objections against the sociological version of the practice-theoretical account, the problem of transmission and the problem of sameness, are substantially undermined when examined from the perspective of re-cently systematized accounts of embodied learning and intersubjective action understanding in-spired by these developments. On one classical conception of God, God has no parts, not even metaphysical parts. God is not composed of form and matter, act and potency, and he is not composed of existence and essence. God is absolutely simple. This is the doctrine of Absolute Divine Simplicity. It is claimed that ADS implies a modal collapse, i.e. that God’s creation is absolutely necessary. I argue that a proper way of understanding the modal collapse argument naturally leads the proponent of ADS to (...)

The construction industry is typically characterized as a fragmented, multi-organizational setting in which members from different technical backgrounds and moral values join together to develop a particular business or project. The most challenging obstacle in the construction process is to achieve a successful practice and to identify and apply an ethical framework to manage the behavior of involved specialists and contractors and to ensure the quality of all completed construction activities. The framework should reflect a common moral ground for myriad (...)

Self-Determination Without Nationalism: A Theory of Postnational Sovereignty.Omar Dahbour - 2012 - Temple University Press.
How do groups—be they religious or ethnic—achieve sovereignty in a postnationalist world? In Self-Determination without Nationalism, noted philosopher Omar Dahbour insists that the existing ethics of international relations, dominated by the rival notions of liberal nationalism and political cosmopolitanism, no longer suffice. Dahbour notes that political communities are an ethically desirable and historically inevitable feature of collective life. The ethical principles that govern them, however—especially self-determination and sovereignty—require reformulation in light of globalization and the economic and environmental challenges of (...)

Abstract:This article discusses Hegel's claim that nature is the idea (Idee) having become external (äußerlich) to itself. Usually taken to signal a type of limitation in Hegel's philosophy, the author argues that recent interpretations of nature's externality are not entirely successfully because they reconstruct nature by either looking back to logic or forward to spirit. Instead, the article offers an interpretation that starts off from Hegel's argument that nature is "weak" (ohnmächtig) as it is not, nor can become, thoroughly rational. (...)

It is the purpose of this paper to show that this avoidance reaction is neither necessary nor desirable as a means for advancing social science. In order that this be made clear, an analysis of an important term will be presented. First, however, a few preparatory questions about the technique of defining must be asked and (...)

Even though the Islamic legal tradition advanced its own set of conceptions of time, modern scholarship on Islamic law has not paid much attention to these conceptions.
