The corpus of late antique Babylonian incantation bowls comprises a class of double-bowl sets, consisting of two bowls facing each other, fastened together with bitumen. Occasionally, such bowl sets have been found to contain inscribed egg shells or human bones. The double-bowl configuration is highly reminiscent of the double-jar burial practice attested in Mesopotamia from the second millennium to the sixth century BCE. The double-jar burial involved placing the deceased between two wide-mouthed jars, occasionally joining them with bitumen at the (...) rims. This article explores the double-bowl configuration and suggests a connection between double-jar burials and the later ritual artifacts of the Sasanian period. The double-bowl sets attached with bitumen may have originated on analogy to the ancient burial practice, intending symbolically to bury evil entities or human adversaries. (shrink)

Deepfakes are hyper-realistic but fabricated videos created with the use of artificial intelligence. In the context of psychotherapy, the first studies on using deepfake technology are emerging, with potential applications including grief counselling and treatment for sexual violence-related trauma. This paper explores these applications from the perspective of medical ethics and health law. First, we question whether deepfake therapy can truly constitute good care. Important risks are dangerous situations or ‘triggers’ to the patient during data collection for the creation of (...) a deepfake, and when deepfake therapy is started, there are risks of overattachment and blurring of reality, which can complicate the grieving process or alter perceptions of perpetrators. Therapists must mitigate these risks, but more research is needed to evaluate deepfake therapy’s efficacy before it can be used at all. Second, we address the implications for the person depicted in the deepfake. We describe how privacy and portrait law apply and argue that the legitimate interests of those receiving therapy should outweigh the interests of the depicted, as long as the therapy is an effective and ‘last resort’ treatment option, overseen by a therapist and the deepfakes are handled carefully. We suggest specific preventative measures that can be taken to protect the depicted person’s privacy. Finally, we call for qualitative research with patients and therapists to explore dependencies and other unintended consequences. In conclusion, while deepfake therapy holds promise, the competing interests and ethicolegal complexities demand careful consideration and further investigation alongside the development and implementation of this technology. Gender is one of the most researched and contentious topics in consumer ethics research. It is common for researchers of gender studies to presume that women are more ethical than men because of their reputation for having a selfless, sensitive nature. Nevertheless, we found evidence that women behaved less ethically than men in two field experiments testing a passive form of unethical behavior. Women benefited to a larger extent from a cashier miscalculating the bill in their favor than men. However, (...) in three follow-up studies, we found that women did not necessarily intend to benefit at the expense of someone else. Women are less prone to speak up to a cashier than men are, even when the mistake is made in their disfavor. These results reveal that gender differences in assertiveness affect differences in unethical behavior. (shrink)

Cavells originärer Beitrag zur praktischen Philosophie lässt sich nur durch eine Rekonstruktion des wichtigen Topos des ‘moralischen Perfektionismus’ angemessen verstehen. Er bezieht sich zum einen auf Cavells an Thoreau und Emerson orientierte dynamische Konzeption des Selbst, das sich erst in ständiger Auseinandersetzung bildet und weiterentwickelt. Er steht zum anderen für das Bild einer intern agonal verfassten Gemeinschaft, die sich nie mit dem erreichten Maß an Gerechtigkeit zufrieden gibt.

BackgroundThe diagnosis of Attention deficit hyperactivity disorder is primarily dependent on parents’ and teachers’ reports, while children’s own perspectives on their difficulties and strengths are often overlooked.GoalTo further increase our insight into children’s ability to reliably report about their ADHD-related symptoms, the current study examined the associations between children’s self-reports, parents’ and teachers’ reports, and standardized continuous performance test data. We also examined whether the addition of children’s perceptions of ADHD-symptoms to parents’ and teachers’ reports would be reflected by objective (...) and standardized data.MethodsThe study included 190 children with ADHD, aged 7–10 years, who were referred to a pediatric neurologic clinic. A retrospective analysis was conducted using records of a clinical database. Obtained data included children’s self-reports of their attention level and ADHD-related symptoms, parent, and teacher forms of the Conners ADHD rating scales, Child Behavior Checklist, Teacher’s Report Form, and CPT scores.ResultsChildren’s self-evaluations of their functioning were globally associated with their teachers’ and parents’ evaluations, but not uniquely. Children’s self-reports of ADHD symptoms were not uniquely linked to a specific CPT impairment index, but to a general likelihood of having an impaired CPT. The CPT performance successfully distinguished between the group of children who defined themselves as inattentive and those who did not.ConclusionPrimary school children with ADHD are able to identify their limitations and needs difficulties and that their perspectives should inform clinical practice and research. The clinical and ethical imperative of taking children’s perspectives into account during ADHD diagnosis and treatment is highlighted. (shrink)

O objetivo deste artigo é defender uma leitura “inclusiva” da Scala Amoris (210a-212b) presente no Banquete de Platão, na qual o amante, em sua ascensão, incorpora um número cada vez maior de objetos belos em sua esfera de preocupação erótica. Neste sentido, posiciono-me de forma contrária à leitura “exclusiva”, na qual tal ascensão implicaria o abandono do que fora anteriormente desejado.

It has been argued that neural data are an especially sensitive kind of personal information that could be used to undermine the control we should have over access to our mental states, and therefore need a stronger legal protection than other kinds of personal data. The Morningside Group, a global consortium of interdisciplinary experts advocating for the ethical use of neurotechnology, suggests achieving this by treating legally ND as a body organ. Although the proposal is currently shaping ND-related policies, it (...) is not clear what its conceptual and legal basis is. Treating legally something as something else requires some kind of analogical reasoning, which is not provided by the authors of the proposal. In this paper, I will try to fill this gap by addressing ontological issues related to neurocognitive processes. The substantial differences between ND and body organs or organic tissue cast doubt on the idea that the former should be covered by bodily integrity. Crucially, ND are not constituted by organic material. Nevertheless, I argue that the ND of a subject s are analogous to neurocognitive properties of her brain. I claim that s’ ND are a ‘medium independent’ property that can be characterized as natural semantic personal information about her brain and that s’ brain not only instantiates this property but also has an exclusive ontological relationship with it: This information constitutes a domain that is unique to her neurocognitive architecture. It is not evident in what sense philosophy relates to its own time and present. From the history of philosophical thought, several models have been suggested, ranging from a strong reliance on tradition to the wholesale rejection of the present and demand for a ‘philosophy of the future,’ from the suspicion that philosophy is nothing but one ideology among others to the demand that philosophy should engage in the struggles and conflicts of its time in order to prepare for a (...) better future. The essay presents an assessment and problematization of these approaches and argues for a point of view that starts from philosophy’s precarious, ambivalent and contingent relation to its time and contemporaneity. Neither wholly independent of nor entirely subjected to its own time, philosophy can inhabit a shifting position from which critique and resistance are possible even if not ultimately guaranteed. The extent to which English law remedies injury to autonomy as a stand-alone actionable damage in negligence is disputed. In this article I argue that the remedy available is not only partial and inconsistent but also gendered and discriminatory against women. I first situate the argument within the broader feminist critique of tort law as failing to appropriately remedy gendered harms, and of law more broadly as undervaluing women’s interest in reproductive autonomy. I then show by reference to English remedies (...) law’s first principles how imposed motherhood cases—Rees v Darlington and its predecessor McFarlane v Tayside Health Board—result in gender injustice when compared with other autonomy cases such as Chester v Afshar and Yearworth v North Bristol NHS Trust: A minor gender-neutral ITA is better remedied than the significant gendered harm of imposing motherhood on the claimant; men’s reproductive autonomy is protected to a greater extent than women’s; women’s reproductive autonomy is protected by an exceptional, derisory award. Worst of all, courts refuse to recognise imposed motherhood as detriment; and the deemed, mansplained, nonpecuniary joys of motherhood are used to offset pecuniary upkeep costs, forcing the claimant into a position she sought to avoid and thus further undermining her autonomy. The recent Singaporean case ACB v Thomson Medical Pte Ltd, awarding compensation for undermining the claimant’s genetic affinity in an IVF wrong-sperm-mix-up demonstrates some improvement in comparison to English law, and some shared gender injustices in the context of reproductive autonomy. ACB’s analysis is oblivious to the nature of reproductive autonomy harm as gendered; and prioritises the father’s interest in having genetic affinity with the baby over a woman’s interest in not having motherhood imposed upon her. One of the most prominent ethical concerns regarding emerging neurotechnologies is mental privacy. This is the idea that we should have control over access to our neural data and to the information about our mental processes and states that can be obtained by analyzing it. A key issue is whether this information needs more stringent protection than other kinds of personal information. I will articulate and support the view, underlying recent regulatory frameworks, that mental privacy requires a special treatment because (...) of its relation to relevant aspects of personal identity. It has been suggested that this approach could be supported by the idea that mental privacy constitutes a fundamental psychological dimension of privacy. The connection between this psychological view of privacy and identity can be traced back to Irwin Altman’s idea that privacy is an interpersonal boundary regulation process. However, it is not clear whether this notion of privacy can be associated with a conception of identity that is relevant in contemporary neuroethics. I will suggest that the narrative and relational approach to identity, a prominent view in recent ethical discussions of neurotechnology, lines up with key aspects of Altman’s proposal. I suggest that if mental privacy is an essential component of identity, the latter could be affected by technological mind-reading. (shrink)

O presente estudo tem por objetivo discutir a recepção do platonismo na produção lírica de Raul de Leoni (1895-1926). Atualmente, o nome de Leoni é majoritariamente ausente da matriz curricular do ensino de poesia brasileira; sua figura foi praticamente esquecida nos círculos acadêmicos. Não obstante essa lacuna, seu único livro publicado, intitulado Luz mediterrânea (1922), gozou de grande reconhecimento e prestígio entre poetas e críticos do período, dentre eles Alceu Amoroso Lima, Ribeiro Couto e Múcio Leão. A fim de melhor (...) explorar sua obra, o artigo se divide em dois momentos: na primeira seção, aborda-se o lugar da poesia de Leoni e suas peculiaridades; enquanto, na segunda seção, analisam-se os elementos clássicos constituintes de sua produção, demonstrando de que modo o poeta faz uso habilidoso de concepções geralmente atribuídas a Platão. É relativamente recente a perspectiva revisionista dos intentos filosóficos de Platão. Apesar disso, a ideia de um filósofo preocupado apenas em construir um edifício sistemático e hermético tem se mostrado cada vez menos sustentável, principalmente quando se observam as diversas fontes que apontam para interesses que não se restringem à filosofia, bem como para o desenvolvimento dos aspectos dramáticos presentes no corpus platônico como um todo. A ideia de que a literatura tem uma influência na obra platônica parece clara e (...) um consenso entre os estudiosos, visto as inúmeras referências que Platão faz, por exemplo, à poesia épica nas figuras de Homero e Hesíodo. Mas pouco parece ter sido dito a respeito do inverso: da influência que Platão poderia ter exercido na literatura posterior. Visando lidar com esse obscurecimento, o presente estudo tem como intento primordial identificar e analisar a possível existência de elementos platônicos em dois romances do período imperial grego, a saber, em Quéreas e Calírroe de Cáriton de Afrodísias e em Dáfnis e Cloé de Longo. Em seguida, intenta demonstrar de que modo Platão, ao exercer uma clara influência na literatura posterior, deixou atrás de si não somente o já reconhecido legado filosófico, mas contribuiu substancialmente para o desenvolvimento da atividade literária, efetuando uma síntese complexa entre filosofia e literatura, ao mesmo tempo em que nos leva a questionar a suposta rigidez inflexível que as distinguem. The aim of this article is to clarify the relation between genealogy and history and to suggest a methodological reading of Nietzsche's Genealogy of Morals. I try to determine genealogy's specific range of objects, specific mode of explication, and specific textual form. Genealogies in general can be thought of as drastic narratives of the emergence and transformations of forms of subjectivity related to power, told with the intention to induce doubt and self-reflection in exactly those readers whose (collective) history is (...) narrated. The main interest in understanding the concept of genealogy and revisiting Nietzsche's introduction of it into philosophy lies in understanding how a certain way of writing and a certain textual practice function that successfully call into question current judgments, institutions and practices. Nietzsche's example, I argue, can provide a paradigm for a critical practice that accounts for historical processes of subject formation in terms of power and turns them against given forms of subjectivity. What might a contemporary philosophical practice after and following Foucault look like? After briefly analyzing Foucault’s rather ambiguous stance towards academic philosophy in his posthumously published Le discours philosophique, we argue for continuing his historico-philosophical practice of diagnosing the present. This means taking up his analytic heuristic (with its three dimensions of power, knowledge and subjectivity) rather than his more concrete diagnostic concepts and the specific historical results they yield. We argue that the common methodological operation on each of the (...) three axis is to shift the perspective from the given legitimacies, norms, identities and selves to their historical, conflict-ridden emergence. Practicing philosophy in this way allows developing Foucauldian contributions in two contemporary philosophical debates: critical ontology and political epistemology. While ontology and epistemology might seem surprising fields to work in for philosophers inspired by and critically loyal to Foucault, we attempt to dispel these reservations and illustrate the stakes in both debates, pointing to the urgent issues of ecological questions and of the problematization of untruths in politics respectively. The density of states of a rectangular billiard with an Aharonov–Bohm flux line in its center was calculated in the semiclassical approximation and was used for the calculation of the form factor in the diagonal approximation. The distribution of nearest level spacings and the form factor were calculated also numerically. For some values of the flux these were found to be close to the ones of the semi-Poisson statistics. The difference between the numerical results and the semiclassical ones were found (...) to be much larger than for chaotic and for integrable systems within similar approximations. The following paper offers a study on how contestation over the meaning of language forged the political ideology present in the second of the Epistulae ad Caesarem. ‘Ideology’ being a notoriously malleable concept, Michael Freeden’s theoretical approach is used to focus what it means, how it is manifested in the sources, and how it can be located and analysed. The political thought of the Late Republic is studied by examining the vocabulary contained in one of the disputed letters that Sallust (...) addressed to Julius Caesar. Taking libertas as a case study of an ‘essentially contested concept’, the relation between language, meaning and ideology is dissected, outlining the morphological configuration that underlies the second Epistula. It is argued that the resulting array of political arguments is one iteration of what has been called popularis ideology. (shrink)

The aim of these two studies was to test to what extent television advertisements reflect gender-role differentiation in two countries: Poland and Britain. British and Polish samples of television advertisements were analyzed and compared with previous studies. The results show slightly more gender-role stereotyping in Polish television advertisements, and a slight decline of stereotyping in Britain. The second study was conducted on children's advertisements following Furnham, Abramsky, and Gunter's content analytic study. In general, there were more advertisements oriented towards both (...) girls and boys, and there were more males as central figures. The differences between two countries were not major, suggesting that levels of gender-stereotyping in Poland and Britain are similar, with slightly more stereotyping present in Polish advertisements. The topic of this paper is the foundation for individual rights proposed by David Gauthier in his seminal 1986 book Morals by Agreement, and particularly the role of conception of rationality in this foundation. The foundation of rights is a part of Gauthier’s broader enterprise: to ground morals in rationality – more specifically, in the economic conception of rationality. Because of the importance of this conception for the whole of Gauthier’s project, we reconstruct first the conception of rationality which can (...) be found in decision theory and game theory, presenting simultaneously in a relatively non-technical way some basic concepts of the aforementioned disciplines. We proceed then to reconstruction of the foundation of rights itself – it turns on Gauthier’s interpretation of the so-called “Lockean proviso.” Lastly, we turn to the connection between rationality and foundation of rights. It is to be found in the narrow compliance – the disposition to enter only into cooperation which satisfies conditions of fairness set out in part by the Lockean proviso. (shrink)

Aspásia de Mileto (470?-400?) é uma figura cuja história nos é nebulosa e ao mesmo tempo muito clara. Nebulosa pois, como sugere Marta Andrade (2022, p. 24), trata-se de uma existência, como muitas outras, cuja memória a posteridade raramente se ocupou ou simplesmente esqueceu. Mas também clara pois Aspásia possui uma persona constituída no que chamamos de "tradição". A amante de Péricles. A professora de Sócrates. A esposa de Lísicles. Sua figura é frequentemente resgatada à sombra das figuras masculinas com (...) as quais se envolveu. Em grande medida porque as fontes que a resgatam trazem seu nome à margem, mas também em parte devido a uma postura metodológica que, por vezes, ignora nomes de mulheres. Neste artigo, viso recorrer às fontes para trazer à tona o protagonismo de Aspásia no que tange à educação e seu pioneirismo no pensamento retórico. Na primeira seção, desenvolverei uma breve biografia de Aspásia, sua possível influência política e suas habilidades pedagógicas. Na segunda seção, tratarei especialmente de suas contribuições para a retórica, abordando o discurso atribuído a si no Menêxeno de Platão e a Oração Fúnebre atribuída a Péricles por Tucídides. Por fim, na conclusão, diante das teses desenvolvidas, chegaremos a uma imagem mais digna de Aspásia, vislumbrando o retrato de uma mulher que dirige um elogio à coragem e cuja opinião incide diretamente em seu corpo social e político. Desse modo, compreenderemos melhor seus avanços nos âmbitos pedagógicos e retóricos, tidos como cruciais para o desenvolvimento dos cidadãos gregos. (shrink)

O presente artigo tem como objetivo principal esclarecer a concepção da tradição megárica acerca do conceito de capacidade (δύναμις), tal como apresentada no livro Theta da Metafísica de Aristóteles. A análise se faz necessária devido à falta de atenção aristotélica na formulação da tese adversária dos megáricos, pois em nenhum momento Aristóteles parece nos oferecer argumentos plausíveis que justifiquem de maneira adequada a tese de seus oponentes. Partindo desta dificuldade de reconstrução do argumento megárico e visando lhe oferecer uma maior (...) dignidade, o estudo irá, em primeiro lugar, destrinchar possíveis argumentos que sustentem a tese no contexto da referida obra. Em seguida, irá provar que, mesmo a tese megárica não sendo tão facilmente refutável como uma primeira leitura poderia sugerir, há em sua estrutura problemas graves, que se evidenciam diante da concepção aristotélica da capacidade. O objetivo deste estudo é propor um modelo explicativo ao problema da beleza desenvolvido no diálogo Hípias Maior de Platão. É um lugar-comum entre os estudiosos defender o senso aporético do diálogo, ressaltando como todas as hipóteses formuladas são descartadas pelos interlocutores, tese que é geralmente endossada pela afirmação final de que as coisas belas são difíceis (304e8). No entanto, no epicentro deste emaranhado de hipóteses, algumas conclusões importantes surgem e serão, conforme se espera demonstrar, fortemente incorporadas em outros lugares (...) daquilo que chamamos de corpus platônico. Assim, a partir desta condição fragmentária, inerente ao próprio texto, e através dela mesma, a presente dissertação visa propor um senso de unidade ao diálogo. Para cumprir tal intento, defende-se que a estrutura do diálogo repousa em três características centrais, sendo estas responsáveis por qualificar o belo em si, são elas: a ordem (kalós é identificado com o kósmos, a ordem, à medida em que estabelece um principio estético de organização, garantindo a ordem harmônica dos seres); a admiração (isto é, o objeto perseguido tem uma validade permanente e universal de estima e, neste sentido, aparece conectado àquilo que é genuinamente bom (agathós), embora a ele não se limite); e, por fim, o comum (kalós é identificado com o koinós, o comum, pois é apresentado como aquilo que é compartilhado pelas coisas belas). A partir destas atribuições, espera-se alcançar uma designação apropriada do belo, de modo a conferir uma certa dignidade e prestígio a um diálogo pouco abordado nos estudos platônicos. (shrink)
