Much attention has been paid to the role of the nurse in recognizing and addressing ethical dilemmas. There has been less emphasis, however, on the issue of whether or not nurses understand the ethical nature of everyday practice. Awareness of the inherently ethical nature of practice is a component of nurse ethical sensitivity, which has been identified as a component of ethical decision-making. Ethical sensitivity is generally accepted as a necessary precursor to moral agency, in that recognition of the ethical (...) content of practice is necessary before consistent action on behalf of patient interests can take place. This awareness is also compulsory in ensuring patient good by recognizing the unique interests and wishes of individuals, in line with an ethic of care. Scholarly and research literature are used to argue that bolstering ethical awareness and ensuring that nurses understand the ethical nature of the role are an obligation of the profession. Based on this line of reasoning, recommendations for education and practice, along with directions for future research, are suggested. (shrink)

Advocacy is an important concept in nursing practice; it is frequently used to describe th nurse-client relationship. The term advocacy, however, is subject to ambiguity of interpretation. Such ambiguity was evidenced recently in criticisms levelled at the nursing profession by hospital ethicist Ellen Bernal. She reproached nursing for using 'patient rights advocate' as a viable role for nurses. We maintain that, for nursing, patient advocacy may encompass, but is not limited to, patient rights advocacy. Patient advocacy is not merely the (...) defence of infringements of patient rights. Advocacy for nursing stems from a philosophy of nursing in which nursing practice is the support of an individual to promote his or her own well-being, as understood by that individual. It is an ethic of practice. La défense des malades joue un grand rôle dans la pratique des infirmiers/ères. Le terme est souvent utilisé pour définir les rapports entre malades et soignants. Le mot 'defénse' pourtant, peut être mal compris. Une ambiguïté était évidente récemment dans la critique de la profession infirmière faite par la philosophe éthique Ellen Bernal. Elle reproche à la profession d'utiliser le terme 'avocat des droits des malades' pour désigner le rôle primordial des infirmiers/ères. Nous croyons que pour les soignants, la défense des malades peut comprendre le rôle 'd'avocat des droits des malades' mais elle ne s'y borne pas. La défense n'est pas limitée à la défense des infractions des droits des malades. La défense dans la profession infirmière est basée sur une philosophie où la pratique infirmière est le soutien des malades dans leur quête de promouvoir leur propre bien-être. Der Ausdruck 'Fürsprache' kann aber auch mehrdeutig interpretiert werden. Das wurde letzthin in der Kritik der Ethikerin Ellen Bernal an der Krankenpflege sichtbar. Sie machte den Pflegenden den Vorwurf, dass sie sich die Rolle des 'Rechts-Advokat des Patienten' aneignen. Wir sind der Meinung, dass es die Aufgabe des Pflegepersonals ist, auch die Rechte der Patienten zu vertreten, aber dass das nur ein Teil der Fürsprache ist. Sie ist nicht nur Verteidignung von verletzten Patientenrechten. Die Fürsprache in der Krankenpflege stammt von einer Philosophie, deren Ausübung die Unterstützung der Patienten für ihr Wohlergehen zum Ziel hat, so wie die Patienten selbst ihr Wohlergehen verstehen. This article analyses the nature of mental imagery in metaphoric thought as envisaged by the contemporary theory of metaphor in Cognitive Linguistics (Lakoff, Cambridge University Press, 1993). Our study of metaphor in the field of marine biology draws on two crucial aspects of mental imagery, namely dynamicity and pervasiveness. Image metaphors and behaviour-based metaphors have generally been regarded as two different types of resemblance metaphor. In our view, the dynamicity of certain mental images highlights inherent similarities between these two types (...) of metaphor, and makes the differences between them more apparent than real. For this reason, we propose a more refined description of resemblance metaphors in terms of the static or dynamic nature of the mental images underlying them. Our study also underlines the fact that mental images permeate all classes of metaphor, and that the pervasiveness and dynamicity of mental images affords insights into both resemblance metaphors and non-resemblance metaphors. We examine the impact of activated versus non-activated ethical norms on the aggressiveness of accounting decisions, in the presence of self-interest favoring aggressiveness. Using a case in which the accounting rules are ambiguous, we ask professional accountants to make an accounting decision as though they were in their own organization; we measure the ethical norms of their organization at the end of the experiment. Based on the focus theory of normative conduct, we argue that the general ethical norms of the (...) participants’ organizations are activated when the decision structure is such that the participant receives a recommendation from a subordinate, whereas those norms are not activated when the participant is making the decision alone. We find that higher ethical norms decrease aggressiveness when the decision maker receives a recommendation, whereas higher ethical norms have no impact on aggressiveness when the decision maker makes the decision alone. Our results demonstrate that general ethical norms, known to impact decisions having clear ethical content, can also curb accounting aggressiveness when these norms are activated. Furthermore, firm practices such as decision structure can activate norms. These findings are of interest to practitioners and regulators who seek to temper aggressive accounting. (shrink)

This paper delineates a postmodern discourse analysis that is positioned within a semiotic theory of language. This theory of language foregrounds the performative aspects of language usage and provides the theoretical space from which to theorize the interrelationship between social organizations or structure and social agents or individuals. Our version of discourse analysis contends that social structure is enacted (production and reproduction) through the employment of various vocabularies: social structure is not something outside of, behind, or underneath these performances, and (...) we argue that social organization is not produced by external structures operating upon or causing people to adopt certain behaviours. Rather, social structure is an effect of taking up practices and reproducing and modifying them. From this perspective, individuals are constituted by being recruited into and reproducing discursive practices. Hence, by looking at the actual employment of language – its tactical, practice dimensions – one can avoid the usual binary of seeing the person as either the autonomous origin of his or her experience or the ideological pawn of social determination. This methodology calls into question how the narratives or stories that individuals recount are imbricated within relational plays of power, and concomitantly, how subjects reauthorize their own positions. We assert that the methodological challenges of research addressing social injustice cannot be reduced to either: (i) interpersonal relationships between researcher and participants, or (ii) relegated to ‘social structures’ acting upon or outside of individuals. In this article, we will consider how the regulation of populations is not just a feature of prisons, but of all institutions and organisations that control members though hierarchies, divisions and norms. While nurses and other allied health professionals are considered to be predominantly self‐regulatory, practice is guided by a code of conduct and codes of ethics that act as rules that serve to uphold the safety of the patient, whether they are a sick person in a hospital bed or (...) an inmate in a prison. The codes of conduct espouse a number of rules that to a certain extent govern the behaviour of individual and groups of practitioners through reciprocal rewards and punishments. Supervision is one method of monitoring the effectiveness of the codes of conduct and ethics while regulating both the minimum standard of individual practice and of training organisations. It is posited that one of the possible effects of clinical supervision is to make the person effectively self‐regulatory as, an autonomous practitioner. We take the view that professional autonomy is a highly problematic concept requiring closer examination. (shrink)

Kevin McCain’s Evidentialism and Epistemic Justification is the most thorough defense of evidentialism to date. In this work, McCain proposes insightful new theses to fill in underdeveloped parts of evidentialism. One of these new theses is an explanationist account of evidential fit that appeals to dispositional properties. We argue that this explanationist account faces counterexamples, and that, more generally, explanationists should not understand evidential fit in terms of dispositional properties.

Multisensory integration (MSI) allows us to link sensory cues from multiple sources and plays a crucial role in speech development. However, it is not clear whether humans have an innate ability or whether repeated sensory input while the brain is maturing leads to efficient integration of sensory information in speech. We investigated the integration of auditory and somatosensory information in speech processing in a bimodal perceptual task in 15 young adults (age 19–30) and 14 children (age 5–6). The participants were (...) asked to identify if the perceived target was the sound /e/ or /ø/. Half of the stimuli were presented under a unimodal condition with only auditory input. The other stimuli were presented under a bimodal condition with both auditory input and somatosensory input consisting of facial skin stretches provided by a robotic device, which mimics the articulation of the vowel /e/. The results indicate that the effect of somatosensory information on sound categorization was larger in adults than in children. This suggests that integration of auditory and somatosensory information evolves throughout the course of development. (shrink)

The objective of this study is to evaluate if use of a patient decision aid, when choosing between a repeat cesarean or a trial of labor after a cesarean, reduces medical liability exposure. The authors conclude that use of a PDA conferred liability protection when potential jurors were presented with a hypothetical malpractice claim against an obstetrician following a TOLAC.

Screening for prostate cancer with the prostate-specific antigen blood test is controversial, as evidence to date has not demonstrated such screening does more good than harm. While the potential benefit of PSA screening on reducing prostate cancer mortality has not been documented in randomized trials, many risks of PSA screening have been well documented. These risks include a substantially higher risk of a prostate cancer diagnosis over a screenee’s lifetime, false-positive and false-negative test results, possible complications from biopsies done in (...) response to suspicious test results, and substantial risks of side effects from subsequent prostate cancer treatments. Nevertheless, PSA screening is widespread in the United States, and many physicians in a national survey reported supporting routine PSA screening as well as getting PSA tests themselves, despite the lack of evidence. We refer to hospitalized convicted hunger strikers in Padua Hospital who decided to fast for specific reasons, often demanding, to be heard by the judge, to complain about the existing custodial situation or to claim unjust treatment. The medical ethics of hunger strikers are debated because the use of force feeding by physicians is widely condemned as unethical, but courts, in Italy, sometimes order to transfer the convicted person to hospital and oblige healthcare practitioners to perform forcible feeding. This can (...) engender a profound insecurity for the physicians taking action on the one hand, while preventing patients from fully availing themselves of this principle of self-determination on the other. Physicians are mainly concerned about how to manage this situation and they may request ethical consultation. When it comes to managing hospitalized hunger strikers, the ethics consultant may be able to facilitate the relationship between physicians and hunger strikers, enhance the latter’s trust in the former, ensuring that strikers are aware of the risks associated with their fasting, and helping them to arrive of their own free will at the right decision concerning their behavior and their demands. The field of social entrepreneurship, a domain focused on implementing solutions to social, cultural and environmental issues, remains highly male-dominated. Research continues to emphasise that women social entrepreneurs are often expected to behave in masculine ways in order to become successful. The study presented in this article explored the perceptions and experiences of thirty-three women living in the United Kingdom who were developing their skills in social entrepreneurship. Documenting their experiences, we sought to understand how women work in a male-dominated (...) field. Our analysis primarily builds on a Bourdieusian-revisionist approach of emotional capital to advance understandings of how women’s networks with other women allow them to navigate social entrepreneurship. Drawing on emotional capital, as a theory, we examine the ways in which these women find these spaces generative and how it contributes to their problematising of masculine orthodoxies. (shrink)

Por (...) último, en la conclusión, sistematizamos las contribuciones de Butler, destacando fundamentalmente tres: la significación particular que le otorga al deseo en su momento de emergencia; el modo de abordaje de esta problemática que se detiene en el estudio del tercer capítulo de la Fenomenología del espíritu; y la perspectiva retórica desde la que explica el deseo. ABSTRACT This paper aims to analyze Judith Butler's contributions to the recent interpretations of the introduction of desire in Hegel's Phenomenology of Spirit, proposed by American scholars. In order to achieve this goal, we situate the appearance of desire in Hegel's Phenomenology of Spirit. Then, we reconstruct the main recent American readings. Finally, we examine Butler's interpretation. In the conclusion of this paper, we systematize the most important features of Butler's reading: the meaning of desire in the context of its moment of emergency; the way in which Butler studies this issue, which consist in a thorough reading of chapter III ofHegel's Phenomenology of Spirit; and Butler's rhetorical perspective of desire. What is cognition? Despite the existence of a science of cognition there is no clear agreement on what makes certain phenomena cognitive, and others not. Within cognitivism the issue was neglected. Human intelligence was used as a standard, and any process—natural or artificial—that fitted this standard sufficiently could be considered ‘cognitive’. For post-cognitivist psychology the situation is different. It cannot rely on the ‘human standard’ in the same way. One might even say that the need for a post-cognitivist psychology arose (...) because cognitivism began with this most complex of all cognitive systems without a good understanding and appreciation of more basic, biological cases. Embodied cognition approaches remedy this anthropocentric bias by addressing a more varied set of processes that are not strictly limited to humans. Under these circumstances the question what we take cognition to be is more urgent. Are phenomena like insect walking (Brooks) and goal-seeking missiles (O’Regan and Noë) examples of cognition or not? What criteria do we use to answer such questions? Given this problem, the notion of perception-action coupling (or sensorimotor contingencies) becomes an important and fairly obvious option to provide a foundation for the notion of cognition. However, and intriguingly, the same problem occurs again: What are perception-action couplings? What would make something an example of perception-action coupling? Where are we to draw a line, if anywhere? It is self-evident that O’Regan and Noë’s (2001) example of a goal-seeking missile is controversial, but why exactly? What is missing? Can we ever do more than making intuitive judgments here? A way out of this dilemma may be found by developing the claim that perception-action coupling must be grounded in a biological context (Keijzer, 2001), and following what Lyon (2005) calls a biogenic approach. This option raises a whole new field of issues and topics that is of central concern for a postcognitivist psychology. (shrink)

Physicians and other health care providers owe ethical and legal duties to patients to maintain the secrecy of the information learned during the course of patient care. This obligation is fulfilled by limiting access to such information to only those involved in the patient's care-that is, to those within the “circle of confidentiality.” As a general rule, providers may only disclose to others with the written prior consent of the patient. Exceptions may be “ethically and legally justified because of overriding (...) social considerations,” when permitted or compelled by law. For example, eleven states permit providers to disclose identified records to approved researchers.’ Many states compel disclosure in cases where a patient threatens serious bodily harm to another; require reporting to health or law enforcement authorities of communicable diseases, gunshot or knife wounds, or child abuse; and mandate reporting of cancer or other health care cases to state registries. We suggest that mammalian endothermy was established amongst Middle Jurassic crown mammals, through reviewing state‐of‐the‐art fossil and living mammal studies. This is considerably later than the prevailing paradigm, and has important ramifications for the causes, pattern, and pace of physiological evolution amongst synapsids. Most hypotheses argue that selection for either enhanced aerobic activity, or thermoregulation was the primary driver for synapsid physiological evolution, based on a range of fossil characters that have been linked to endothermy. We argue that, rather than (...) either alternative being the primary selective force for the entirety of endothermic evolution, these characters evolved quite independently through time, and across the mammal family tree, principally as a response to shifting environmental pressures and ecological opportunities. Our interpretations can be tested using closely linked proxies for both factors, derived from study of fossils of a range of Jurassic and Cretaceous mammaliaforms and early mammals. (shrink)

Dalton, the successful pursuit of this mission demanded that Dewey become more than just a philosopher; it compelled him to become thoroughly familiar with the theories and methods of physics, psychology, and neurosciences, as well as become engaged in educational and social reform. Tapping archival sources and Dewey’s extensive correspondence, (...) class='Hi'>Dalton reveals that Dewey had close personal and intellectual ties to scientists and scholars who helped form the mature expression of his thought. Dewey’s relationships with F. M. Alexander, Henri Matisse, Niels Bohr, Myrtle McGraw, and Lawrence K. Frank, among others, show how Dewey dispersed pragmatism throughout American thought and culture. After a general discussion of recent medical AI innovations, and a more analytic look at related ethical issues such as data privacy, physician dependency on poorly understood AI helpware, bias in data used to create algorithms post-GDPR, and changes to the patient–physician relationship, the article examines the issue of so-called robot doctors. Whereas the so-called democratization of healthcare due to health wearables and increased access to medical information might suggest a (...) positive shift in the patient-physician relationship, the physician’s ‘need to care’ might be irreplaceable, and robot healthcare workers might be seen as contributing to dehumanized healthcare practices. We discuss the important, but greatly under-researched, topic of the social aspects of human wayfinding during navigation. Wayfinding represents the planning and decision-making component of navigation and is arguably among the most common, real-world domains of both individual and group-level decision making. We highlight the myriad ways that wayfinding by people is not a solitary psychological process but is influenced by the actions of other people, even by their mere presence. We also present a novel and comprehensive framework for classifying (...) wayfinding in complex environments that incorporates the influence of other people. This classification builds upon the premises of previous wayfinding taxonomies and is further structured into four parts based upon (1) the nature of the interaction between the actors and (2) the time frame in which the interaction takes place. We highlight gaps in our current understanding of social wayfinding and outline future research opportunities. (shrink)

Given the importance of the Machiavellianism construct on informing a wide range of ethics research, we focus on gaining a better understanding of Machiavellianism within the whistle-blower context. In this regard, we examine the effect of Machiavellianism on whistle-blowing, focusing on the underlying mechanisms through which Machiavellianism affects whistle-blowing. Further, because individuals who are higher in Machiavellianism (high Machs) are expected to be less likely to report wrongdoing, we examine the ability of an organization’s ethical environment to increase whistle-blowing intentions (...) of high Machs. Results from a sample of 116 MBA students support our premise that Machiavellianism is negatively related to whistle-blowing. Further, we find that Machiavellianism has an indirect effect on whistle-blowing through perceived benefits and perceived responsibility. Finally, we find that a strong ethical environment, relative to a weak ethical environment, increases whistle-blowing intentions incrementally more for individuals who are higher in Machiavellianism. Taken together, these findings extend our understanding of how Machiavellianism and an organization’s ethical environment impact whistle-blowing. (shrink)

One of the most persistent and poignant human experiences is the sensation of longing--a restlessness perhaps best described as the unspoken conviction that something is missing from our lives. In this study, Drew M. Dalton attempts to illuminate this experience by examining the philosophical thought of Emmanuel Levinas on longing, or what Levinas terms "metaphysical desire." Metaphysical desire, according to Levinas, does not stem from any determinate lack within us, nor does it aim at a particular object beyond us, (...) much less promise any eventual satisfaction. Rather, it functions in the realm of the infinite where such distinctions as inside and outside or one and the other are indistinguishable, perhaps even eliminated. As Levinas conceives such longing, it becomes a mediator in our relation to the other--both the human other and the divine Other. -/- Dalton follows the meandering trail of Levinas's thought along a series of dialogues with some of the philosophers within the history of the Western tradition who have most influenced his corpus. By tracing the genealogy of Levinas's notion of metaphysical desire--namely in the works of Plato, Heidegger, Fichte, Schelling, and Otto--the nature of this Levinasian theme is elucidated to reveal that it is not simply an idealism, a "hagiography of desire" detached from actual experience and resulting in a disconnect between his phenomenological account and our own lives. Rather, Levinas's account of metaphysical desire points to a phenomenology of human longing that is both an ethical and religious phenomenon. In the end, human longing is revealed to be one of the most profound ways in which a subject becomes a subject, arising to its "true self," and hearing the call to responsibility placed upon it by the Other. -/- Throughout, Dalton explicates the nuance of a number of key Levinasian terms, many of which have been taken from the Western philosophical tradition and reinscribed with a new meaning. Eros, the "Good beyond being," shame, responsibility, creation, the trace, the il y a, and the holy are discovered to be deeply tied to Levinas's account of metaphysical desire, resulting in a conclusion regarding longing's role in the relationship between the finite and the Infinite.". Abstract:This paper examines two recent trends relative to boards of directors’ compensation, and their potential incompatibility. There has been some progress in increasing board diversity, specifically the inclusion of women and minorities on boards. The increasing trend requiring directors to hold/purchase equity as a requirement of board membership may seriously compromise further improvements in diversifying boards. Also, an increasing number of companies compensate directors partially or fully in stock grants and options. These compensation policies may be exclusionary, especially for women (...) and minorities, impacting the quality of boardroom discussions and decisions. This study systematically examines whether corporations requiring director equity are exclusionary toward women and minority directors. Contrary to being exclusionary, companies with director stock requirements and annual stock awards have greater representation by women and minorities on their board. Moreover, larger companies are both more likely to have such policies and have higher proportions of women and minorities on the board. (shrink)

Much has been made of the so-called “empirical turn” of “speculative materialism” with thinkers like Quentin Meillassoux championing the material sciences as a new route to absolute reality. According to Meillassoux, the material sciences “provide philosophers access once again to the great outdoors, the absolute outside,” of reality in-itself. One might expect from such encomia the attempt to engage with the products of contemporary science in order to develop a new metaphysics; but, Meillassoux spends almost no time in this way, (...) focusing instead on the form and methods of the material sciences over their actual accomplishments. As a result, his praise rings hollow and his metaphysics remains undeveloped. This paper examines what would happen if we were to take seriously his claims that a new metaphysics be developed from a scientific accounting of material reality by surveying the conclusions of contemporary physics. The paper ends by contrasting such a new speculative and materialistic metaphysics with the speculative nihilism of Ray Brassier. (shrink)
