This volume, along with Volume V, completes the edition of the long English Wycliffite sermon cycle and two related tracts; the first three volumes, published in 1983, 1987 and 1990, contained the texts of the 294 sermons, together with variants and some introductory material. This volume contains a review of the evidence concerning the date, authorship and audience of the sermons, followed by a survey of the main polemical issues repeatedly under discussion in the sermons and by a commentary on (...) the text, which is continued in Volume V. The material here, along with the introductions to the three text volumes, will enable scholars to assess the background and importance of this extensive body of vernacular preaching. In particular, the discussion traces the large debt of the sermons to a wide range of Wyclif's own Latin works, and shows their relationship to other works of the Wycliffite movement. (shrink)

In this paper I distinguish two kinds of predictivism, 'timeless' and 'historicized'. The former is the conventional understanding of predictivism. However, I argue that its defense in the works of John Worrall and Patrick Maher is wanting. Alternatively, I promote an historicized predictivism, and briefly defend such a predictivism at the end of the paper.

In this paper, we argue that, omissions are not events or actions, but rather fact-like entities, and that, insofar as only events and actions can be causes, omissions cannot be causes. Nevertheless, since omissions can, and often do, play a role in the explanations of events, their place in such explanations must be found; and an attempt to find such a place is made.

The aim of this paper is to propose that the common horizon of the reflections of political philosophy in Latin America is the debate that has taken place to defend liberalism or go against it. The background of this is the reference to the social collective forms. In this context, Marxism has tried to respond from heterodox visions that recover the Latin American experience. We have focused this debate on three authors, Chauí, Fernández and Echeverría, who do not exhaust the (...) problem but keep open the paths that enhance the local experience. (shrink)

New discoveries in neuroscience challenge our understanding of human responsibility and justice. Recent studies suggest that psychopaths not only exhibit specific behavioral patterns but may also have a distinct neuroanatomical blueprint. Scientists have shown that a significant number of individuals who have demonstrated psychopathic behaviors have reduced volume and other anatomical changes in various regions of the cerebral cortex as well as decreased functional connectivity between different brain areas (i.e., smaller dysfunctional amygdalae). These findings raise ethical questions about how our (...) criminal system deals with these individuals. Should dysfunctional anatomical or diseased features exonerate affected individuals from any responsibility for their criminal activity or the suffering they have caused to their victims? It is estimated that individuals with the signs and symptoms of antisocial personality disorder make up 25% of inmates. Should individuals classified with this disorder be incarcerated with other criminals? In this paper, we summarize the results of the latest brain imaging studies performed on individuals with antisocial personality traits, referred to as psychopaths or sociopaths, and we explore some of the ethical issues concerning psychopathy and the law. El análisis propuesto confronta los imaginarios hegemónicos instituidos en la postdictadura con los imaginarios instituyentes que (...) emergen de los movimientos secundarios por la defensa de la educación pública en la ciudad de Valparaíso. Estos imaginarios se expresan en formas de organización en la esfera pública, por medio de la función que ejerce el imaginario radical, que impugnan la construcción de una ciudadanía capturada y una democracia tutelada. The purpose of this article is to explore the law related to identity theft, to review corresponding rights, and responsibilities of stakeholders involved in identity theft and to formulate a system of best practices businesses could engage in to prevent or reduce identity theft threats. Utilizing two ethical frameworks based on deontological approaches, the authors conclude that there should be a well-defined management scheme to prevent identity theft, which is easy to comprehend and comply with for all stakeholders. Our proposed (...) management scheme incorporates both legal and ethical elements such that identity theft will be more difficult. Further, our proposal would also address business entities’ practices that are so careless that identity theft is made possible at all or made easier: ethical business practice can do much to reduce or eliminate identity theft. The objective of this study is to evaluate if use of a patient decision aid, when choosing between a repeat cesarean or a trial of labor after a cesarean, reduces medical liability exposure. The authors conclude that use of a PDA conferred liability protection when potential jurors were presented with a hypothetical malpractice claim against an obstetrician following a TOLAC.

This book analyses the problems of current just war theory, and offers a more stable justificatory framework for non-intervention in international relations. The primary purpose of just war theory is to provide a language and a framework by which decision makers and citizens can organize and articulate arguments about the justice of particular wars. Given that the majority of conflicts that threaten human security are now intra-state conflicts, just war theory is often called on to make judgments about wars of (...) intervention. This book aims to critically examine the tenets of just war theory in light of these changes, and formulate a new theory of intervention and just cause. For Michael Walzer, the leading scholar of just war theory, armed humanitarian intervention is permissible only in cases of genocide, ethnic cleansing, widespread massacres, or enslavement. This book shows why this threshold is too restrictive in light of the progressive shift away from interstate conflict as well as the emerging norms of 'sovereignty as responsibility' and the 'responsibility to protect'. _Justice, Intervention and Force in International Relations_ aims to establish a new, stable foundation for non-intervention and a revised threshold for 'just cause'. In addition, this book demonstrates that over-reliance on the just cause category distorts understanding, analysis, and public discussion of the justice or injustice of resorting to war. This new book will be of much interest to students of ethics, security studies, international relations and international law. Academic conferences had begun two years earlier: in June 2016, the Brocher Foundation hosted one of the first international meetings to examine the importance of the novel for our time. According to HealthCare.gov, by improving access to quality health for all Americans, the Affordable Care Act (ACA) will reduce disparities in health insurance coverage. One way this will happen under the provisions of the ACA is by creating a new health insurance marketplace (a health insurance exchange) by 2014 in which “all people will have a choice for quality, affordable health insurance even if a job loss, job switch, move or illness occurs”. This does not mean that everyone will have (...) whatever insurance coverage he or she wants. The provisions of the ACA require that each of the four benefit categories of plans (known as bronze, silver, gold and platinum) provides no less than the benefits available in an “essential health benefits package”. However, without a clear understanding of what criteria must be satisfied for health care to be essential, the ACA’s requirement is much too vague and open to multiple, potentially conflicting interpretations. Indeed, without such understanding, in the rush to provide health insurance coverage to as many people as is economically feasible, we may replace one kind of disparity (lack of health insurance) with another kind of disparity (lack of adequate health insurance). Thus, this paper explores the concept of “essential benefits”, arguing that the “essential health benefits package” in the ACA should be one that optimally satisfies the basic needs of the people covered. Artificially intelligent systems will be used to make increasingly important decisions about us. Many of these decisions will have to be made without universal agreement about the relevant moral facts. For other kinds of disagreement, it is at least usually obvious what kind of solution is called for. What makes moral disagreement especially challenging is that there are three different ways of handling it. _Moral solutions_ apply a moral theory or related principles and largely ignore the details of the disagreement. (...) _Compromise solutions_ apply a method of finding a compromise and taking information about the disagreement as input. _Epistemic solutions_ apply an evidential rule that treats the details of the disagreement as evidence of moral truth. Proposals for all three kinds of solutions can be found in the AI ethics and value alignment literature, but little has been said to justify choosing one over the other. I argue that the choice is best framed in terms of _moral risk_. (shrink)

A common line of thought claims that we are responsible for ourselves and our actions, while less sophisticated creatures are not, because we are, and they are not, self-aware. Our self-awareness is thought to provide us with a kind of control over ourselves that they lack: we can reflect upon ourselves, upon our thoughts and actions, and so ensure that they are as we would have them to be. Thus, our capacity for reflection provides us with the control over ourselves (...) that grounds our responsibility. I argue that this thought is subtly, but badly, confused. It uses, as its model for the control that grounds our responsibility, the kind of control we exercise over ordinary objects and over our own voluntary actions: we represent to ourselves what to do or how to change things, and then we bring about that which we represent. But we cannot use this model to explain our responsibility for ourselves and our actions: if there is a question about why or how we are responsible for ourselves and our actions, it cannot be answered by appeal to a sophisticated, self-directed action. There must be some more fundamental account of how or why we are responsible. I replace the usual account with a novel but natural view: responsible mental activity can be modeled, not as an ordinary action, but as the settling of a question. This shift will require abandoning the tempting but troublesome thought that responsible activity involves discretion and awareness—which, I argue, we must abandon in any case. (shrink)

Institutional investors, policy makers, and researchers have advocated for greater director independence in hopes of improving corporate governance and discouraging unethical behaviors such as corporate frauds, accounting irregularities, and other organizational failures. However, increasing demands upon directors and sitting CEOs, as well as constraints on the number of boards on which they can serve, has resulted in a dramatic increase in the use of retired independent directors. Compared to other directors with full-time job demands, we argue that RIDs have lesser (...) time constraints and greater attentional capacities with which to discharge their responsibilities, thereby improving overall board “bandwidth.” Using S&P 1500 firms for the period of 2000–2012, we find that enhanced board bandwidth associated with an increased proportion of RIDs on the board relates to greater resource provisioning through reducing costs of capital, improved monitoring through reducing disclosure-related weaknesses, and better accounting and market performance. We thereby advance traditional board bandwidth research by contemplating the available time that independent directors would have by virtue of being retired and relating this to board effectiveness. A good number of people currently thinking and writing about reasons identify a reason as a consideration that counts in favor of an action or attitude.1 I will argue that using this as our fundamental account of what a reason is generates a fairly deep and recalcitrant ambiguity; this account fails to distinguish between two quite different sets of considerations that count in favor of certain attitudes, only one of which are the “proper” or “appropriate” kind of reason for them. This ambiguity has been the topic of recent discussion, under the head “the wrong kind of reasons problem.”2 I will suggest that confusion about “the wrong kind of reason” will be dispelled by changing our account of what a reason is. Many assume that we can be responsible only what is voluntary. This leads to puzzlement about our responsibility for our beliefs, since beliefs seem not to be voluntary. I argue against the initial assumption, presenting an account of responsibility and of voluntariness according to which, not only is voluntariness not required for responsibility, but the feature which renders an attitude a fundamental object of responsibility (that the attitude embodies one’s take on the world and one’s place in it) also guarantees (...) that it could not be voluntary. It turns out, then, that, for failing to be voluntary, beliefs are a central example of the sort of thing for which we are most fundamentally responsible. (shrink)
