Existe-il une corrélation entre le pouvoir d’un organe et le rang hiérarchique de ses normes ? La théorie réaliste de l’interprétation pourrait sembler indiquer le contraire. En effet, si, comme elle l’enseigne, c’est l’interprète d’un énoncé qui en détermine la signification, les agents de l’administration qui mettent en œuvre les politiques publiques devraient exercer un pouvoir plus important que le législateur qui les élabore. L’auteur de l’article soutient toutefois qu’une semblable conclusion serait erronée car les organes qui produisent les énoncés (...) juridiques généraux et abstraits peuvent généralement mobiliser des ressources qui leur permettent de contraindre les organes de concrétisation à prendre leurs préférences en considération. La représentation du droit comme étant constitué d’un ensemble de normes hiérarchisées confère certaines des ressources dont ils disposent. The essay opens with some background information about the period in which J.S. Mill wrote. The discussion revolves around the concept of blasphemy which Mill considered to be highly problematic. Tagging unpopular views as ‘blasphemous’ amounted to abuse of governmental powers and infringed on the basic liberties of the out-of-favour speakers. The discussion on blasphemy sets the scene to the understanding of Mill's concerns, his priorities and consequently his emphasis on the widest possible liberty of expression. Section 2 presents the (...) Millian principles that are pertinent to his philosophy of free speech: liberty and truth. Section 3 analyzes Mill's very limited boundaries to freedom of expression, asserting that the consequentialist reasoning had led Mill to ignore present tangible harm. Philosophers use historical case studies to support wide-ranging claims about science. This practice is often criticized as problematic. In this paper we suggest that the function of case studies can be understood and justified by analogy to a well-established practice in biology: the investigation of model organisms. We argue that inferences based on case studies are no more problematic than inferences from model organisms to larger classes of organisms in biology. The German Act on Autonomous Driving constitutes the first national framework on level four autonomous vehicles and has received attention from policy makers, AI ethics scholars and legal experts in autonomous driving. Owing to Germany’s role as a global hub for car manufacturing, the following paper sheds light on the act’s position within the ethical discourse and how it reconfigures the balance between legislation and ethical frameworks. Specifically, in this paper, we highlight areas that need to be more worked out (...) in the future either through ethical conventions, corporate measures or legal measures and examine how the law can be incorporated into the existing discourse on the regulation of technologies. Based on this examination, we derive implications for future discourse and elaborate on companies’ responsibilities in developing autonomous driving technologies in an ethical sense. (shrink)

Can animals, and especially cattle, be the subject ofmoral concern? Should we care about their well-being?Two competing ethical theories have addressed suchissues so far. A utilitarian theory which, inBentham's wake, extends moral consideration to everysentient being, and a theory of the rights orinterests of animals which follows Feinberg'sconceptions. This includes various positions rangingfrom the most radical (about animal liberation) tomore moderate ones (concerned with the well-being ofanimals). Notwithstanding their diversity, theseconceptions share some common flaws. First, as anextension of primarily anthropocentric (...) theories (aboututility or rights) they still participate in the flawsof the original setting. Second, extending them tonon-human beings raises the problem of the borderwhich is to be drawn between what can be included inthe purview of moral consideration and what is leftoutside. Third, such theories are not able to distinguishbetween an ethics of wildlife and an ethics ofdomestic life, which too often leads to preposterousstatements. We would like to argue (i) that we should distinguishbetween environmental ethics (concerned withpopulations, species, biotic communities) and animalethics (where animals are taken into consideration individually);(ii) that individualist animal ethics are not relevantfor animal rearing; (iii) that animal rearing is a hierarchicalrelationship which rules are to be found in the fiction of a domesticcontract.Hence, we would like to construct a new conception ofthe ethics of the relation between men and the cattlethey breed based on the idea of a domestic contract.Our main assumption is Mary Midgleys's anthropologicalassumption, according to which human communities,since the Neolithic age, have always included variousanimals, so that relations of sociability have alwaysexisted between human beings and animals within thedomestic community (a mixed community). In order tospecify the hierarchical and non-egalitarian, butinclusive reciprocal obligations and relations insidesuch a community, we will elaborate on the notion ofa ``domestic contract'', an implicitly assumedidea traced back to Lucretius and whichwe will follow up to the physiocrats and Adam Smith.We will show that such an idea relies upon theassumption of communication between cattle farmer andanimals, of shared experience and exchanges betweenthe two parties. We will then show how modern factory,or battery animal farming, can be seen as unilaterallybreaking this domestic contract, forsaking ourduties towards domestic animals. (shrink)

This chapter considers eternity, duration, time, and their interrelations, and aims to resolve a paradox in Spinoza's theory of the mind's eternity. Spinoza's metaphysics of time includes an endless series of virtuous regresses. Spinoza characterizes duratio as a “magnitude. Spinoza says that duratio is “conceived as being greater or lesser, and as composed of parts”. Spinoza addresses time and its relation to duratio in the Metaphysical Thoughts. Spinoza accepts Suarez's view that “duratio and existence are only rationally distinct”. Spinoza holds, (...) with some of the Scholastic philosophers, that extrinsic denominations are mind‐made. Spinoza also uses geometrical construction as a model for thinking about the relationship between eternity and time. Framing effects occur when different descriptions of the same decision problem give rise to divergent decisions. They can be seen as a violation of the decisiontheoretic version of the principle of extensionality (PE). The PE in logic means that two logically equivalent sentences can be substituted salva veritate. We explore what this notion of extensionality becomes in decision contexts. Violations of extensionality may have rational grounds. Based on some ideas proposed by the psychologist Craig McKenzie and colleagues, we contend that (...) framing effects are justified when the selection of one particular frame conveys choice relevant information. We first discuss this idea from a philosophical point of view, and proceed next to formalize it first in the context of the Bolker–Jeffrey decision theory. Finally, we extend the previous analysis to non-expected utility theories using the Biseparable Preference model introduced by Ghirardato and Marinacci (2001) and therefore show that the analysis is independent of the assumptions of Bayesian decision theory. This article reviews the history of press self-regulation in Britain, from the 1947 Ross Commission to the 2012 Leveson Inquiry Commission. It considers the history of the Press Council and the Press Complaints Commission, analysing the ways they developed, their work, and how they have reached their current non-status. It is argued that the existing situation in Britain is far from satisfactory, and that the press should advance more elaborate mechanisms of self-control, establishing a new regulatory body called the Public (...) and Press Council that will be anchored in law, empowering the new regulator with greater and unprecedented authority, and equipping it with substantive sanctioning abilities. The Public and Press Council should be independent and effective, with transparent policies, processes and responsibilities. Its adjudication should be made in accordance with a written, detailed Code of Practice. (shrink)

Flawed clinical practice guidelines may compromise patient care. Commercial conflicts of interest on panels that write treatment guidelines are particularly problematic, because panelists may have conflicting agendas that influence guideline recommendations. Historically, there has been no legal remedy for conflicts of interest on guidelines panels. However, in May 2008, the Attorney General of Connecticut concluded a ground-breaking antitrust investigation into the development of Lyme disease treatment guidelines by one of the largest medical societies in the United States, the Infectious Diseases (...) Society of America (IDSA). Although the investigation found significant flaws in the IDSA guidelines development process, the subsequent review of the guidelines mandated by the settlement was compromised by a lack of impartiality at various stages of the IDSA review process. This article will examine the interplay between the recent calls for guidelines reform, the ethical canons of medicine, and due process considerations under antitrust laws as they apply to the formulation of the IDSA Lyme disease treatment guidelines. The article will also discuss pitfalls in the implementation of the IDSA antitrust settlement that should be avoided in the future. (shrink)

This paper addresses the concepts of moral and social responsibility on the Internet in considering the most troubling phenomenon of cyberbullying that results in loss of life. Specifically, I probe the moral and social responsibilities of Internet users (agents), of the education system in fighting cyberbullying, and of Internet intermediaries. Balance needs to be struck between freedom of expression and social responsibility. The tragic story of Megan Meier serves as an illustrative example and some further incidents in which this ugly (...) phenomenon of cyberbullying had cost young life are mentioned. It is argued that all relevant stakeholders need to think of the consequences of their conduct, that Internet abusers should be accountable for their wrongdoing, and that people who have the ability to stop or at least reduce the risk of cyberbullying should take proactive steps, exhibiting zero tolerance to cyberbullying. SC was an 80-year-old Israeli woman. She suffered from multiple chronic conditions, including heart disease, pulmonary congestion, chronic leukemia, diabetes, and high blood pressure. The lexical–semantic organization of the mental lexicon is bound to change across the lifespan. Nevertheless, the effects of lexical–semantic factors on word processing are usually based on studies enrolling young adult cohorts. The current study aims to investigate to what extent age‐specific semantic organization predicts performance in referential word production over the lifespan, from school‐age children to older adults. In Study 1, we conducted a free semantic association task with participants from six age‐groups (ranging from 10 to 80 years old) (...) to compute measures that capture age‐specific properties of the mental lexicon across the lifespan. These measures relate to lifespan changes in the Available Richness of the mental lexicon and in the lexical–semantic Network Prototypicality of concrete words. In Study 2, we used the collected data to predict performance in a picture‐naming task on a new group of participants within the same age‐groups as for Study 1. The results show that age‐specific semantic Available Richness and Network Prototypicality affect word production speed while the semantic variables collected only in young adults do not. A richer and more prototypical semantic network across subjects from a given age‐group is associated with faster word production speed. The current results indicate that age‐specific semantic organization is crucial to predict lexical–semantic behaviors across the lifespan. Similarly, these results also provide cues to the understanding of the lexical–semantic properties of the mental lexicon and to lexical selection in referential tasks. (shrink)

Si la question de juste répartition des ressources traverse les sociétés depuis même l’Antiquité, celle de la répartition équitable des ressources médicales prend de nos jours une toute autre ampleur dans le contexte de pandémie mondiale actuelle. Cette table ronde tente d’analyser et de comprendre comment concilier les principes de justice distributive dans des conditions de ressources limitées. Elle permet d’ouvrir plus largement la réflexion sur la différence fondamentale qui se trouve entre la prise de décision éthique ou politique auprès (...) du patient, et à l’échelle macroscopique. Enfin, une discussion ouvrira la réflexion sur l’autonomie des patients et la légitimité de la réanimation – pour ceux qui ne souhaitent pas continuer à vivre – sur la valeur du « sauver à tout prix » et de la place du triage dans la pratique de la médecine. For over 20 years, the Schmid Training Course (STC) has offered unique opportunities for marine biology students from European universities to learn about marine model organisms. While the topics of the course have continuously changed over the years with the advent of new research techniques and discoveries, the pedagogical approach has remained largely the same – a combination of lectures, lab practicals, and field excursions. Several life science researchers, who have taught in the STC for many years, sought to bring (...) the course's pedagogical approach into the 21st century, and with the support of Erasmus+ Programme of the European Community funding, the Digital Marine project was developed. Digital Marine began in 2018 as an international partnership between the six research centers from which the STC instructors hail, and its main objective was to introduce a flipped, blended approach to learning and teaching with respect to established and emerging marine biological model systems. The Digital Marine platform, which covers 12 marine model organisms, is now publicly available. (shrink)

Metabolism is a set of chemical reactions, used by living organisms to process chemical compounds in order to take energy and eliminate toxic compounds, for example. Its processes are referred as metabolic pathways. Understanding metabolism is imperative to biology, toxicology and medicine, but the number and complexity of metabolic pathways makes this a difficult task. In our paper, we investigate the use of causal Bayesian networks to model the pathways of yeast saccharomyces cerevisiae metabolism: such a network can be used (...) to draw predictions about the levels of metabolites and enzymes in a particular specimen. We propose a two-stage methodology for causal networks, as follows. First construct a causal network from the network of metabolic pathways. The viability of this causal network depends on the validity of the causal Markov condition. If this condition fails, however, the principle of the common cause motivates the addition of a new causal arrow or a new `hidden' common cause to the network (stage 2 of the model formation process). Algorithms for adding arrows or hidden nodes have been developed separately in a number of papers, and in this paper we combine them, showing how the resulting procedure can be applied to the metabolic pathway problem. Our general approach was tested on neural cell morphology data and demonstrated noticeable improvements in both prediction and network accuracy. (shrink)

La présente étude entend tracer et analyser le déploiement de « la Vérité de l’Etre » afin de montrer en quoi celui-ci est indissociable, pour Heidegger, de ce qu’il appelle, dans un passage tardif des Cahiers Noirs, l’« auto-annihilation ( Selbstvernichtung ) » du judaïsme. Nous montrerons en quoi et pourquoi, chez Heidegger, l’« Histoire » de la « Vérité de l’Etre », en se déployant elle-même, produit aussi un antijudaïsme, indissociable d’un antisémitisme, sans précédent dans l’histoire de la philosophie (...) occidentale. En effet, le judaïsme, pour Heidegger, se voit brutalement exproprié de toute possibilité d’être, et, par conséquent, demeure résolument forclos de l’« Histoire » gréco-allemande de la « Vérité de l’Etre » pour ne séjourner que dans l’« inessentielle » machination et exploitation « indéterminée » du monde. Il nous appartiendra de souligner, depuis le « dispositif » heideggérien de la « Vérité de l’Etre » – un dispositif, contrairement à ce qu’en dit Heidegger, dès plus technique – en quoi le judaïsme se voit condamné à son « auto-annihilation ». C’est ainsi que l’antijudaïsme de Heidegger, inséparable d’un antisémitisme catégorique, est à comprendre depuis sa pensée philosophique elle-même. Ce qui exige de nous une relecture dès plus vigilante, dès plus intransigeante et un questionnement critique circonstancié de cette œuvre et du rapport qu’elle détermine entre l’« Histoire » de la « Vérité de l’Etre » et l’« auto-annihilation » du judaïsme. Ainsi, à aucun moment ne s’agira-t-il, pour nous, de rejeter purement et simplement la pensée philosophique de Heidegger. Car, c’est aussi par une relecture critique de cette même pensée, par une confrontation incessante envers ce qui s’y cache dans ses plis les plus obscurs et douteux, que peuvent aussi se révéler d’inédites possibilités de repenser notre tradition philosophique tout entière en l’ouvrant vers une tout autre histoire de la philosophie – tout autre que celle qui se sera consacrée et déterminée dans et par le « dispositif » heideggérien. L'obiettivo del presente articolo è l'osservazione storica delle politiche della memoria nel Brasile contemporaneo, con particolare attenzione al periodo tra il 2019 e il 2022 (governo Bolsonaro). Dall'analisi delle azioni giudiziarie proposte da diversi attori sociali e politici, l'articolo propone una riflessione sulle temporalità coinvolte nelle politiche della memoria nel contesto post-dittatoriale, soprattutto dalla prospettiva delle vittime del regime.
