Some disability rights advocates criticise prenatal testing and selective abortion on the grounds that these practices express negative attitudes towards existing persons with disabilities. Disability rights advocates also commonly criticise and oppose physician-assisted suicide (PAS) and euthanasia on the same grounds. Despite the structural and motivational similarity of these two kinds of arguments, there is no literature comparing and contrasting their relative merits and the merits of responses to them with respect to each of these specific medical practices. This paper (...) undertakes such a comparison. My thesis is that a number of potentially significant weaknesses of the expressivist argument against reproductive technologies are avoided when the argument is used against PAS. In particular, I try to show that three common criticisms of the expressivist argument applied to reproductive technologies, whatever merit they have, have even less merit when they are used to reply to the expressivist argument applied to PAS. This is important because the expressivist argument applied to the end of life scenario does not get as much attention as the argument applied to the beginning of life scenario, and yet it has a relatively stronger position. Anne Maclean claims that such a proposal, far from being rational, does not qualify as a moral proposal at all since what it suggests is ‘plain murder’. I argue that she is correct to claim that the proposal is (...) not uniquely rational and that doctors could quite rationally reject it, but that she overreaches herself when she holds it not to be a moral proposal at all. the author has outlined several of the more important interpretations of measurement in quantum mechanics and discussed the problems arising from them. Particular attention was paid to the work of Bohr, Heisenberg and von Neumann and a tentative proposal was made for a possible interpretation which would mitigate some of the problems and dilemmas. This interpretation was essentially that proposed by Margenau in terms of latent variables. He defines measurement to be any operation with physical apparatus which results in a (...) number, including in this, of course, yes and no answers as well as conventional numerical answers. Further he makes the distinction between the preparation of a state and the measurement of the state. A preparation puts the quantum system into a particular state whereas the measurement frequently destroys the state in question. This paper presents several criteria to help in the evaluation of the alternatives presented in the first paper and carries further the suggested interpretation mentioned at the end of that paper. The thesis that women will be more intent on staying alive fails to take into account that current strategies are those of the winners in the evolutionary race. Moreover, because like tends to mate with like, risk taking will be averaged out between the sexes. Finally, Campbell's narrow view of parental investment fails to acknowledge the indirect contributions of males.

Pacifism, as well as just war theory, are expressions of one’s general hermeneutic of reading the Bible. In recent New Testament hermeneutics, while the so-called old perspective might have more resonance with just war theory, both the new perspective and apocalyptic open the door to a hermeneutically based pacifism. I examine the case of Dietrich Bonhoeffer’s under the category of a “Christoform hermeneutic,” namely, an approach to Christian ethics and the Christian and state that takes the suffering and cross of (...) This article examines the role of emotions during insurgent conditions by focusing on the Nicaraguan revolution, in particular the two-year period (1977–1979) leading to the overthrow of the Somoza regime. Based on an analysis of testimonial accounts from an oral history volume, ¡Y Se Armó La Runga!, and a NVivo-10 content analysis of testimonies therein, it sets out to make a case for the significance of hope as a dominant emotion during guerrilla offensives. The manuscript answers the following questions: 1) (...) What is the role of hope during guerrilla offensives?; 2) what other emotions are in play during these events?; and 3) in what ways does hope combine with other emotions to maintain insurgent activism? In addition to defining and coding eleven negative and positive emotions (analyzed as secondary emotions), it evaluates the varied relationships these have to hope. Indigenous migration from Latin America to the United States has been on the rise over the past decades. There has also been an increase in Indigenous self‐identification amongst people in the United States who previously self‐identified as Hispanic or Latina/o on census forms. Though Latin American Indigenous migration to the United States has been steadily on the rise since the 1990s, there remains a lack of resources—philosophical, political, and bureaucratic—to account for this migrant group. My goal in this article is (...) to explore in greater depth why Latin American Indigenous migration is hermeneutically marginalised. First, I argue that we problematically fail to understand settler‐state borders—particularly the Mexico‐US border—as, in part, Indigenous spaces. Second, and relatedly, I argue that our failure to understand borders as Indigenous spaces is connected to the widespread, inaccurate presumption that Indigenous peoples ‘lose their authenticity’ (and, in turn, their very Indigenous identities) upon crossing settler‐state borders. Contrary to what I describe as the dominant view of borders as de‐Indigenised or non‐Indigenous spaces, I argue in that many settler‐state borders are spaces where Indigenous peoples, including Indigenous migrants, may experience their Indigenous identities intimately, and even publicly articulate and defend them. Importantly, this does not mean that settler‐state borders do not also harm Indigenous peoples by threating Indigenous sovereignty. I end by arguing that addressing the hermeneutical marginalisation of Latin American Indigenous migration requires a rigorous reconceptualisation of borders themselves as Indigenous spaces. (shrink)

Martin Heidegger’s existential account of care in _Being and Time_ (2010) provides us with an opportunity to reimagine what the proper theoretical grounding of an ethic of care might be. Heidegger’s account of care serves to deconstruct the two primary foundations that an ethic of care is often based upon. Namely, that we are inevitably interdependent upon one another and/or possess an innate disposition to care for fellow humans in need. Heidegger’s account reveals that both positions are founded upon an (...) ontic (meaning factual existence), as opposed to an ontological (which refers to the nature of being), understanding of care. The distinctions between an ontic and ontological understanding of care are significant. Yet, I maintain that they are not completely incompatible. Both Heidegger and care ethicists contend that our existence with others is understood through a relational ontology. Furthermore, there are certain ontological structures from Heidegger which resonate with an ethic of care. Two key existential structures are leaping-ahead and being-guilty. These existential structures are latent in care ethics, and by explicitly revealing them I reinforce the connection between Heidegger’s account and care theory. Lastly, I develop the theoretical foundations of care ethics by proposing an existential ethic of care. (shrink)

People are unable to report how they decide whether to move backwards or forwards to catch a ball. When asked to imagine how their angle of elevation of gaze would change when they caught a ball, most people are unable to describe what happens although their interception strategy is based on controlling changes in this angle. Just after catching a ball, many people are unable to recognise a description of how their angle of gaze changed during the catch. Some people (...) confidently choose incorrect descriptions that would guarantee failure of interception demonstrating unconscious knowledge co-existing with systematically different conscious beliefs. Value pluralism does not imply relativism or subjectivism about values. What it does is allow respect for an at least limited toleration of values with which one may profoundly disagree. Thus a doctor can respect the autonomy of a patient whose values he does not share.

Donald Davidson is probably the most eminent living analytic philosopher, and his writings in philosophy of language and philosophy of action have shaped much of the recent work in both these fields. However, despite the obvious shared concerns of literary theory and these aspects of philosophy, up to this point literary theorists have not paid much attention to Davidson's ideas or have only known about them through the interpretations of other philosophers like Richard Rorty. Literary theorists have seen more relevance (...) to their concerns in Continental philosophy and, among analytic philosophers, in the essentially anti-analytic work of J. L. Austin and Ludwig Wittgenstein than in the harder tradition of analytic philosophy—more concerned with logic and philosophy of science—represented by the work of Donald Davidson. _Literary Theory after Davidson _challenges both views, stressing the variety of ways in which Davidson's thought can contribute to the development of literary theory. But the study of detection need not be restricted to the generic as familiarly construed. 1 Our interest in detection is transgeneric, which is why we speak in terms of “detection narratives” rather than the detective genre. (...) We are as interested in detection narratives that exploit the generic tendencies of suspense or comedy as we are in nongeneric narratives that feature an investigation of some mystery or crime. While what we have to say about detection, interpretation, and narrative explanation is generally applicable to both literary and non-literary detection narratives, our five main examples are all unapologetically taken from cinema. We have selected these five just because they are unlikely to strike anyone as an intuitively obvious group of films. They are The Thin Man (W. S. Van Dyke, 1934), a mystery/comedy; The Maltese Falcon (John Huston, 1941), standardly cited as the earliest film noir and a paradigm of the cinematic hard-boiled detective genre; All The President’s Men (Alan J. Pakula, 1976), a political thriller based on Bernstein and Woodward’s nonfictional investigation of the Watergate break-in; Nicholas Roeg’s 1980 Bad Timing, a nongeneric film about sensual obsession; and Woody Allen’s 1993 comedy of manners, Manhattan Murder Mystery.Whether focusing on the investigation of a crime, the unraveling of a puzzle, or the solution of a mystery, detection narratives exhibit what Frank Kermode calls “a specialized ‘hermeneutic’ organization.” 2 As such, they call for a particular sort of investigation: namely, a hermeneutical one. Novitz’s position is that interpretation only occurs when one confronts a specific puzzle or problem. What we understand directly is not, on this account, interpreted; interpretation is required only where we do not understand. The consideration of detection narratives suggests that understanding and interpretation are more closely related than Novitz seems to allow.In our attempts to make sense of the course of action of any detection narrative, there is always the question whether we have understood a given situation, event, action or statement correctly. It is always a question whether we have correctly distinguished between clues and red herrings. Detection narratives operate on the basis of a continual questioning—both for the detective and for the reader or viewer—as to whether we do, in fact, understand what is happening.This questioning attitude is keyed to the uncertainty as to whether we have correctly recognized what information is salient, which characters’ testimony is trustworthy. At various moments in any detection narrative, the detective (or reader/viewer) will have reason to question the reliability of their own assessment of what is going on. There is the risk of being mistaken, but also the risk of being deceived. In a world where economies have no moral conscience, biblical theologians can challenge local cultures with ancient wisdom about generosity and equity. Systemic solutions require changes in the habits of virtue, and this study focuses on the habit of generosity. Building on the work of Stephan Joubert’s Paul as Benefactor, this study concentrates on Paul’s collection in one notable instance: what he says about generosity in 2 Corinthians 8-9 and, in particular, what he means by isotēs in 2 Cor 8:13–15. (...) Does it mean “equality” or “equity”? Beginning with a reinvigorated interest in the economic vision of the apostle Paul about what is meant by “weak” and “good works” and what the Pastoral Epistles communicate with eusebeia (not “godliness” but “social respectability and civility”), we reconsider the collection as an act on the part of the Pauline mission churches to express more than ecclesial unity. This act embodied a theology of grace in mutual reciprocity and in equitable provision on the part of the wealthy for the poor, not least and not limited to those in their own Christian assemblies. The term isotēs is too easily glossed over when translated as “fair balance”, “fairness”, and so the translation of the term with “equity” or “equality” comes closest to the vision of the apostle. Too few studies on this term baptize it sufficiently in the economics of the ancient world and the early Christian radical vision of siblingship and family. Contribution: From the perspective of the Historical Thought and Source Interpretation of the work of Paul, the question of systemic equality or equity is as crucial to navigating the current economic climate as it has ever been. The cultural invasion of Yuin Country in Australia not only colonized the Yuin people and Yuin Country itself, but also contributed to non-Aboriginal people’s continual colonized journey of disconnecting self from Mother Earth. Cultural awareness is a process driven by Western theories informed by the colonial dualism that functions on separation and differences. Tripartation means assisting in a decolonization and more importantly a reculturalization process to place Yuin Country and align stories back into focus for all peoples attached to Yuin (...) Country. Tripartation challenges Western dualities to create a philosophical space, place and reality in Aboriginal dualities for non-Aboriginal people to find similarities and connections through stories in order to build respectful relationships with Aboriginal people, Yuin Country and importantly the self. Mingadhuga Mingayung focuses on identifying similarities through stories to guide non-Aboriginal people in Yuin ways of knowing, learning and behaving with Country. (shrink)

As a means to challenge and diminish the hold of mainstream curriculum's claim of being a colorblind, politically neutral text, we will address two particular features that partially, though significantly, constitute the hidden curriculum in the United States—race and class—historically studied as separate social issues. Race and class have been embedded within the institutional curriculum from the beginning in the US; though rarely acknowledged as intertwined issues. We illustrate how the theoretical and interpretive structure of French philosopher and sociologist Pierre (...) Bourdieu can productively subsume the insights of critical race theory into its framework in a way that provides a more robust understanding of how race and class continue to be socially reproduced in schools. To perform this task we examine, through Bourdieu's constructs of habitus, field, capital, symbolic violence and misrecognition, the ways in which race, in general, and whiteness, specifically, influences pedagogical and curricular existence within the institutional superstructure of school. The literary scene of Kant’s day goes unmentioned by philosophical commentators. Yet some of its salient features have a clear relation to his problems and positions, not demonstrably causal in every detail, but too close overall to be coincidence in the random sense. Kant’s critical view of society and his establishing of an independent aesthetic realm parallel the themes, and the arguments in self-defence, of contemporaneous radical writing; his discussion of how to exemplify ethical arguments bears on the general Enlightenment (...) problem of how to embody abstractions persuasively, while his theoretical and practical difficulties over written style have consequences for the reception of his own work, and were responsible for divisions among writers of the day who might otherwise have made common cause. All this adds a valuable dimension to our understanding of both Kant’s aesthetics and his time. (shrink)

This paper looks at a dispute decision theory about how best to characterize expected utility maximization and express the logic of rational choice. Where A1, … , An are actions open to some particular agent, and S1, … , Sn are mutually exclusive states of the world such that the agent knows at least one of which obtains, does the logic of rational choice require an agent to consider the conditional probability of choice Ai given that some state Si obtains, (...) Prob(Ai/Si). Or, is the logic of choice better represented by considering the probability of the counterfactual if Ai then Si, Prob(Ai ⟥-> Si). Causal decision theory, developed by Allan Gibbard, William Harper, and David Lewis defend the counterfactual analysis; whereas, Richard Jeffrey and others defend the conditional probability analysis, evidential decision theory. I argue that the problems posed by cases of decision instability favor evidential decision theory. (shrink)

In this paper, I argue that the doctrine of double effect is disposed toward abuse. I try to identify two distinct sources of abuse of double effect: the conditions associated with standard formulations of double effect and the difficulty of fully understanding one’s own intentions in action. Both of these sources of abuse are exacerbated in complex circumstances, where double effect is most often employed. I raise this concern about abuse not as a criticism of double effect but rather as (...) a problem that defenders should observe and try to prevent. I go on to suggest certain methods for avoiding the abuse of double effect such as hesitating to use it, applying it only with other agents, and selectively and carefully propagating it. (shrink)

This paper uses the language of formal dialectics to explore how argumentation schemes and their critical questions can be characterized as an extension to traditional dialectical systems. The aim is to construct a dialectical system in which the set of locutions is extended to include scheme-based moves the set of structural rules describes the roles that critical questioning can play; and the set of commitment rules distinguishes between exceptions and assumptions.

The purpose of this paper is to identify a kind of discrimination that has hitherto gone unrecognised. ‘Terminalism’ is discrimination against the dying, or treating the terminally ill worse than they would expect to be treated if they were not dying. I provide four examples from healthcare settings of this kind of discrimination: hospice eligibility requirements, allocation protocols for scarce medical resources, right to try laws and right to die laws. I conclude by offering some reflections on why discrimination against (...) the dying has been hard to identify, how it differs from ageism and ableism, and its significance for end-of-life care.
