The present research examined whether Asian-American (AA) versus European-American (EA) women differed in experiential, expressive, or autonomic physiological responding to a laboratory anger provocation and assessed the mediating role of values about emotional control. Results indicate that AA participants reported and behaviourally displayed less anger than EA participants, while there were no group differences in physiological responses. Observed differences in emotional responses were partially mediated by emotion control values, suggesting a potential mechanism for effects of cultural background on anger responding.

In June 21, 1990, the Joneses, an African-American family living in the mainly white and working-class neighbourhood of St. Paul in Minnesota, saw a small white cross burning in their yard. By placing the burning cross on the yard, the Minnesota Supreme Court argued that one of the accused, Robert A Viktora, had engaged in ‘fighting words’. However, the US Supreme Court reversed this decision, arguing that the local authority in St Paul only legally banned certain ‘fighting words’, but (...) not others. Judith Butler explores this legal case, R.A.V. v. St. Paul. Judith Butler argues in her earlier work that the Supreme Court in effect represented the burning cross as being non-performative and simply a vehicle of expression rather than a historical symbol of hate speech towards African-Americans. In this paper, I look again at the R.A.V. case. But I do so by both drawing on what Butler explicitly says about the case in her early work and integrating this with her later work on the ethics of grief, state hegemony and public assemblies. Furthermore, I also incorporate some of the insights of the Bakhtin Circle into Butler’s work to strengthen her arguments. The paper then revisits R.A.V. v. St. Paul and shows how Reaganite state hegemony effectively transformed issues of racism surrounding this free speech case into ‘monologic’ and ‘ungrievable’ public matters of concern. The paper concludes by briefly discussing counter-hegemonic politics of free speech. (shrink)

It is widely thought among philosophers that Joseph Butler's criticism of psychological egoism in his Sermons is, in the words of A.E. Duncan-Jones, 'the classic refutation of it.' Indeed, no less a philosopher than David Hume restated and put forth Butler's central argument against hedonistic egoism - without due credit - as part of his own critique. Yet recent commentators have begun to question Butler's arguments, albeit usually with sympathy and in the hope of saving what they (...) take to be his insights. I propose to focus on Butler's main objection to hedonistic psychological egoism, to show how and why it fails to refute plausible forms of the thesis, and briefly to indicate why philosophical attempts to disprove this theory of motivation are misguided. This article for the first time seeks to bring together theoretical insights from Judith Butler and Mikhail Bakhtin in order to strengthen their respective understanding of ethics. First, the article suggests that Bakhtin’s theory of dialogic events and the ‘multiaccentuality’ and thematic nature of everyday utterances can help Butler address criticisms that suggest her work concentrates too heavily on invariant meanings in utterances. Second, Butler’s theory of coalitions can usefully politicise Bakhtin’s ideas on utterances, while her ethics (...) of grief is a crucial way to think about how we forge bonds with the ‘Other’. Correspondingly, Bakhtin’s theory of the ethical ‘I’ adds an important moment of ‘empathy’ to Butler’s account of grief and the ‘Other’. Third, Butler’s theory of state hegemony and counter-hegemonic assemblies can provide an important addition to Bakhtin’s theory, while Bakhtin’s theory of carnivalesque democracy strengthens Butler’s insights on equality in assemblies and occupying a liveable life. The paper explores the extent to which self-love, as understood by Bishop Butler, may be in harmony with altruistic virtue. Whereas Butler was primarily concerned to rebut suspicions directed against altruism, the suspicions principally addressed by the present writer are directed against self-love. It is argued that the main vices of self-preference---particularly selfishness, self-centeredness, and arrogance---are not essentially excesses of self-love and, indeed, do not necessarily involve self-love. lt is argued further that self-love is something one is typically (...) taught as a child, for socially compelling reasons. This suggests how a healthy self-love and a healthy commitment to the common good can be integrated and will normally be in harmony. (shrink)

Reflecting on a moment when a vegan meal was presented to him as “lesbian food,” McKay’s essay critiques the concept of “species,” drawing on Judith Butler’s deconstruction of the sex/gender opposition. Social life, he argues, is shaped by “compulsory humanity,” a disposition in which species functions as a regulatory ideal rather than a biological essence. McKay works this critical stance into a positive description of being vegan by turning to Wittgenstein’s concept of the “form of life,” and the way (...) his thought has been developed in relation to animal ethics. McKay’s claim is that thinking of veganism as a form of life allows for making sense of the profound form of identification with others that it expresses, evading and challenging the very notion of being human. Modern literature, films, theater, theology and philosophy focus their attention increasingly on the meaning of person. The current interests of philosophers can activate and direct their reading of the history of philosophy. The rereading of the history of philosophy with a new interest can lead to new insights and discoveries. Through these insights and discoveries, philosophies of the past come to life in the present and influence the (...) future. One of the tasks of contemporary philosophers is to read and examine philosophies of the past under the light of the current interest in person so that errors of previous philosophers might be avoided and insights of previous philosophers might be assimilated. The rereading, examination and exposition of past philosophers is and must be a community project. Both the vastness of philosophical literature and importance of dialogue, if progress is to be made, necessitate that the project be undertaken by many. This exposition of William Torrey Harris’ philosophy is offered as part of the project. Though Harris’ philosophy has been identified as a personalism, it has not received adequate study as a personalism nor has Harris’ concept of person been sufficiently examined. In the aftermath of the financial crisis, and regular corporate scandals, there has been a growing concern with the moral and ethical foundations of business. Often these concerns are limited to narrow accounts of governance codes, regulatory procedures or behaviour incentives, which are often characterized by neo-liberal bias underpinned by western masculine logics. This book challenges these limited accounts of ethics and responsibility. It looks at the writing of Gayatri C. Spivak who takes globally networked markets, people, and ideas and (...) provides tools to rethink subjectivity, ethics, and corporate governance. Eschewing strict hierarchical notions of authority and identity, Spivak's work invites us to consider who speaks for whom and for what in organizational contexts. Relationality is also to be found in the radical politics and feminist ethics of Judith Butler who continues to draw on and develop her account of performativity to interpret contemporary organizations, management and work. While popular accounts of corporate ethics often concern themselves with the aims and actions of those at the top of organisations, Lauren Berlant focuses on the struggles of those at the bottom of the new social structures created by contemporary forms of capital. Finally, the book also considers ecological challenges through the work of Val Plumwood, who spent a lifetime considering the threats and responsibilities we face in environmental terms, and developed a feminist ecological philosophy for understanding social and species differences. This book will be relevant to students and researchers across business and management, organizational studies, critical management studies, gender studies and sociology. (shrink)

Thinkers heavily indebted to Foucault—such as Wendy Brown, Judith Butler, Jodi Melamed and Jasbir Puar—are at the fore of a contemporary interrogation of queerness and racialized empire. This paper critically surveys this terrain, differentiates several strands of it, and attempts a theoretical reframing such that we may be better equipped to gain new vantage on the central problematic. I argue that the current conviviality of queerness and empire is best understood not only through a univocal ‘homonationist’ lens, but also (...) requires situating in the context of multiple languages of civilizational superiority and liberal tolerance. In particular, it requires the deployment of arguments about the ‘benchmark of civilization,’ in which whole societies are ranked along a unilinear trajectory of development according to standards set by the most powerful among them. One relatively recent addition to the criteria of civilizational adjudication is the capacity of societies to ‘tolerate’ new forms of societal difference. In this case, I argue, the most important of these are the strange pairing of sexual and religious dispositifs. (shrink)

For well over two decades, Andy Clark has been gleaning theoretical lessons from the leading edge of cognitive science, applying a combination of empirical savvy and philosophical instinct that few can match. Clark’s most recent book, Supersizing the Mind: Embodiment, Action, and Cognitive Extension, brilliantly expands his oeuvre. It offers a well-informed and focused survey of research in the burgeoning field of situated cognition, a field that emphasizes the contribution of environmental and non-neural bodily structures to the production of intelligent (...) behavior. The situated research program, fledgling though it may be in some respects, has reached an age at which its philosophical stock can reasonably be taken; and Clark is just the person to take it. Supersizing the Mind consists of three main divisions. The first develops the case for the distinctively extended view of cognition, according to which the human mind or cognitive system literally comprises elements beyond the boundary of the human organism. The second responds to critics of the extended outlook: Frederick Adams, Kenneth Aizawa, Keith Butler, Brie Gertler, Rick Grush, and me, among others. The third major division evaluates nonextended strands in the situated program, in particular, those that emphasize the role of the non-neural body in cognition. (shrink)

Sport continues to be one of the primary means through which notions of Englishness and Britishness are constructed, contested, and resisted. The legacy of the role of sport in the colonial project of the British Empire, combined with more recent connections between sport and far right fascist/nationalist politics, has made the association between Britishness, Englishness, and ethnic identity(ies) particularly intriguing. In this paper, these intersections are explored through British media coverage of the Canadian‐born, British tennis player, Greg Rusedski. This coverage (...) is examined through the lens of ‘performativity,’ as articulated by Judith Butler. Through a critical application of Butler's ideas, the ways in which the media seek to recognise and normalise certain identities, while problematising and excluding others, can be more fully appreciated. Thus, it was within newspaper framings of Rusedski that hegemonic notions of White Englishness could be performed, maintained, and embedded. (shrink)

Julia Kristeva attempts to expose the limits of Lacan's theory of language by revealing the semiotic dimension of language that it excludes. She argues that the semiotic potential of language is subversive, and describes the semiotic as a poetic-maternal linguistic practice that disrupts the symbolic, understood as culturally intelligible rule-governed speech. In the course of arguing that the semiotic contests the universality of the Symbolic, Kristeva makes several theoretical moves which end up consolidating the power of the Symbolic and paternal (...) authority generally. She defends a maternal instinct as a pre-discursive biological necessity, thereby naturalizing a specific cultural configuration of maternity. In her use of psychoanalytic theory, she ends up claiming the cultural unintelligibility of lesbianism. Her distinction between the semiotic and the Symbolic operates to foreclose a cultural investigation into the genesis of precisely those feminine principles for which she claims a pre-discursive, naturalistic ontology. Although she claims that the maternal aspects of language are repressed in Symbolic speech and provide a critical possibility of displacing the hegemony of the paternal/symbolic, her very descriptions of the maternal appear to accept rather than contest the inevitable hegemony of the Symbolic. In conclusion, this essay offers a genealogical critique of the maternal discourse in Kristeva and suggests that recourse to the maternal does not constitute a subversive strategy as Kristeva appears to assume. Inattentional blindness is described as the failure to perceive a supra-threshold stimulus when attention is directed away from that stimulus. Based on performance on an explicit recognition memory test and concurrent functional imaging data Rees, Russell, Frith, and Driver [Rees, G., Russell, C., Frith, C. D., & Driver, J. . Inattentional blindness versus inattentional amnesia for fixated but ignored words. Science, 286, 2504–2507] reported inattentional blindness for word stimuli that were fixated but ignored. The present study examined both explicit and (...) implicit memory for fixated but ignored words using a selective-attention task in which overlapping picture/word stimuli were presented at fixation. No explicit awareness of the unattended words was apparent on a recognition memory test. Analysis of an implicit memory task, however, indicated that unattended words were perceived at a perceptual level. Thus, the selective-attention task did not result in perfect filtering as suggested by Rees et al. While there was no evidence of conscious perception, subjects were not blind to the implicit perceptual properties of fixated but ignored words. (shrink)

Conducting qualitative research, especially in areas considered ‘sensitive’, presents many challenges. The processes involved in such research often expose both participants and the research team to a vast array of risks, which may cause damage to their personal, professional, social and cultural worlds. Historically, these risks have been considered independent of each other, with most studies exploring only the risks to participants or only risks to researchers. Additionally, most researchers only consider risks during data collection, frequently overlooking risks that might (...) be present during other phases of the research project. We aim, therefore, to bring together this fractured literature to enable an integrated exploration of the current academic discourse relating to risks to participants with the literature exploring risks to researchers across all phases of the research process. This article draws on personal experiences to highlight ethical issues and risks encountered by both participants and researchers throughout all phases of a research project. Beginning in recruitment, we discuss the risk of secondary distress in participants arising from researcher contact and then explore the concept of informed consent during grief and bereavement research. We then focus on risks present during data collection, examining risks for participants, such as emotional distress, and potential safety risks for the research team. Finally, we consider the risks which arise in data analysis, including both confidentiality and the possibility of researcher burnout. Previous recommendations are summarised, with new management strategies suggested based on lessons learned along the way. (shrink)

Parts I through III of this paper will examine several, increasingly comprehensive forms of aggregation, ranging from insurance reimbursement “lock-in” programs to PDMPs to completely unified electronic medical records. Each part will advocate for the adoption of these aggregation systems and provide suggestions for effective implementation in the fight against opioid misuse. All PDMPs are not made equal, however, and Part II will, therefore, focus on several elements — mandating prescriber usage, streamlining the user interface, ensuring timely data uploads, creating (...) a national data repository, mitigating privacy concerns, and training doctors on how to respond to perceived doctor-shopping — that can make these systems more effective. In each part, we will also discuss the privacy concerns of aggregating data, ranging from minimal to significant, and highlight the unique role of stigma in motivating these concerns. In Part IV, we will conclude by suggesting remedial steps to offset this loss of privacy and to combat the stigma around SUDs and mental health disorders in general. (shrink)

As an intellectual, economic, political and legal project, neoliberalism is not directed towards the rolling back of the state as an aim in itself. While its deregulatory tendencies, its commodification of public services and the undermining of systems of social welfare superficially suggest a generalised reduction in state power, it has been clear from the early 1980s that one of neoliberalism’s primary concerns has been the authoritarian reshaping of state power to engineer particular social outcomes, whether in criminal justice, the (...) disciplining of organised labour, the militarisation of national territory and migration, or the extension and deepening of regimes of austerity. This article introduces the recent work of Maurizio Lazzarato, who has argued that the asymmetrical creditor-debtor relationship is now the archetype of contemporary, neoliberal social relations. Ultimately, Lazzarato’s perspective tends to exaggerate the totalising powers of finance capital and leads him to endorse a form of political voluntarism, which fails to address the role of the neoliberal state as a site for forms of authoritarianism which are not solely generated by the debt relation. As a response, it will be suggested that aspects of Nicos Poulantzas’s concept of ‘authoritarian statism’ can be used to both strengthen our understanding of the authoritarian characteristics of the neoliberal state, and to imagine possibilities for resisting its expressions of power. Husserl's proposed method for knowing the essences of universals, which he calls “free variation,” has been widely criticized for involving viciously circular reasoning. In this paper, I review existing attempts to resolve this problem, and I argue that they all fail. I then show that extant accounts are all guilty of a common mistake: they assume that circularity is inevitable as long as the exercise of free variation presupposes the ability to identify the universal whose essence is in question, that (...) is, the ability to recognize entities as instances of it. I reject this assumption: I argue on both Husserlian and independent philosophical grounds that knowledge of a universal's essence is not required for identifying it, but only for re‐identifying it at every possible world in which it is instantiated. I then defend a reading on which free variation's purpose is to move its practitioner from non‐essentialistic knowledge of a universal's identity (its actual instantiation‐pattern) to essentialistic knowledge of its transworld identity (its instantiation‐pattern in every possible world in which it is present). And I show that such a transformation is a non‐circular progression from non‐modal to modal knowledge. (shrink)

While critics have relied upon bibliographical data and his translation of Thucydides to establish the early Thomas Hobbes as a humanist, this essay argues that substantive evidence to support this conclusion can be found in the comparatively neglected discourses of the Horae Subsecivae. Reading Hobbe's contribution to the Horae alongside his translation of Thucydides reveals a consistent concern with the political potential of both verbal and visual images and with the dangers rhetorical manipulation could pose to individual and sovereign authority. 1. Ontological Historical Materialism. The Hegel-Marx relationship remains an issue both for Hegel scholars aware of underlying world historical causes of the recent Hegel Renaissance and Marx scholars attentive to the philosophical roots of Marxism. It may be questioned, however, whether the relation is merely historical and circumstantial or necessary and internal as well. Marx claimed to have overturned the Hegelian system. Yet the classical formula, according to which Marxism shares with Hegelianism its method but not its system, that the (...) Hegelian system contradicts the dialectical methodology it shares with Marxism has exercised wide influence. On numerous issues, e.g., the state, the universal class, the alienation of labor, Hegelian and Marxist doctrines are admittedly not only different but contradictory. To this extent Engels’s classical formula is correct. But surely the more important consideration is method, though doctrine has so overshadowed methodological considerations in both Marxism and Hegelianism that it has been rare to define either school except in terms of specific tenets. Doctrinal definition of any movement resembles a death warrant. If either Marxism or Hegelianism is scientific and thus capable of breaking loose from nineteenth-century chains, it must be defined methodologically, programmatically. Contrary to Engels’s formula, I shall distinguish between Marxist and Hegelian methods, but shall argue that the methods are not only compatible but complementary. (shrink)

I argue, contrary to wide-spread opinion, that belief-desire psychology is likely to reduce smoothly to neuroscientific theory. I therefore reject P.M. Churchland's eliminativism and Fodor's nonreductive materialism. The case for this claim consists in an example reduction of the desire construct to a suitable construct in neuroscience. A brief account of the standard view of intertheoretic reduction is provided at the outset. An analysis of the desire construct in belief-desire psychology is then undertaken. Armed with these tools, the paper moves (...) to an examination of the neural structures responsible for the production of motor behavior. This examination provides the basis for a theory of the neurophysiology of desire. A neurophysiological state is isolated and claimed to be type-identical to the state of desiring. (shrink)

One of the issues with introducing animal rights law is whether the problem is quantitative or qualitative, whether it can be achieved by working within existing legal paradigms or whether it requires a new set of paradigms. The answer is fundamental: a quantitative problem can be solved by applying more of the same solutions, while a qualitative problem requires completely different solutions. The qualitative camp can be represented by, say, Professor Gary Francione, demanding not only rights for animals but that (...) they have personhood and are no longer considered “property.” The quantitative approach can be finely represented by Professor David Favre, who has argued for many years that we can make progress by developing existing legal principles to give some rights to some animals, and he does so eloquently in his new book. He is clear in his view that progress is, and can continue to be, made with a series of steps, as he puts it, “climbing the slippery slope toward personhood” (p. viii).His case is supported by looking backward—progress made in establishing the rules governing humans in their relationships with animals—as well as forward to developments that will support continuing improvement in the lives of animals, not least the potential for technology (for example, through cell- and plant-based meat). At the same time, he also rightly rejects the concepts of animal welfare and animal rights being at odds, let alone either of them being a panacea for better lives for animals.One aspect of animal law that Favre believes does need to change is that of property status. As he says, the status of animals as personal property is “critical to the future of animal law” (p. 25). In general, the solutions have been largely binary—that animals simply cannot be property for them to have meaningful rights or that animals can be property and still have rights. The former makes intuitive good sense (and is consistent with the objectives of the human abolitionist movements) but would have enormous effects on economic activity throughout the world. The latter is appealing because it does not change the current paradigm, so can be developed more easily.Favre's premise is that we are moving toward rights for animals, so we need to find a way of integrating animals into the current legal system rather than having to destroy and reconstruct the legal system. His ingenious solution is to propose a fourth category of property, alongside real, personal, and intellectual property: “living property.”Within this category, he envisages using the common law concept of the trust to provide equitable “self-ownership,” where an animal has equitable “ownership” while a human retains legal “ownership.” He then connects this concept to adaptations in other aspects of law that start to recognize the selfhood of animals, creating a platform onto which broader and deeper rights for animals can develop, such as the status of “animalhood” (p. 72) and the corresponding legal right of consideration before decisions are made by the state affecting an animal's fundamental interests (such as continuing to be alive). By putting animals in a separate class—rather than uncomfortably leaving them in personal property—he creates a possible route for animal rights that seems less paradigm-busting than removing them from being property altogether.Drawing on evidence from criminal law, tort law, equity (trusts), property law, and family law, he shows how in many places—with a focus on states in the United States—existing laws are being adapted (“green shoots” p. 81) to recognize that animals are more than personal property, in ways that cannot be explained simply through the growth of regulations. For example, family law is starting to recognize that in the division of matrimonial assets, companion animals cannot be treated simply like any other personal property such as a table or a car based on who paid for them. Because animals are “living property,” the courts should take account of other aspects, such as who cared for the animals and who looked after them. Similarly, the concept of extending trust law so that an animal can be the beneficiary of a trust—in the same way as a human can be but inanimate personal property cannot—shows that the law can understand that companion animals can play a large emotional role in our lives (as well as we in theirs), such that we want to ensure proper care for them after we die.The book raises important issues. First, it is intentionally about domestic animals, with their close links with humans, so the potential for laws to engage is much easier than with, say, farmed animals. The danger with solutions that focus on domestic or charismatic animals (e.g., dogs, chimpanzees, elephants) is that the arguments may be pertinent essentially only to those species and therefore hard to apply to animals of less charismatic species, say in a factory farm (but who are present in much greater numbers and generally badly treated in comparison). He “leaves for another day” (p. 32) the discussion about other animals. Hopefully that day will come, as it would be interesting to see how Favre could extend his concept to animals for whom the public has less affection and less appreciation of their capacities (and for whom the prospect of death is much more real and imminent).Secondly, public support for these ideas about living property may simply not be present. If there is not a sufficient groundswell of support for changing the status of animals, then whether one proposes changing it to not-property or “self-owned” property doesn't matter (if someone doesn't like needles, it doesn't matter whether the needle you propose to use is big or small). This may be too pessimistic, of course (people can be helped to overcome a fear of needles, and one way to start is with small needles). Perhaps the law should start with small changes to recognize at least a few animals—their sentience, their capacities for pleasure and pain, their emotions and preferences, their potential for autonomy—and build public support from there.There is also the underlying and more radical point about whether these ideas—the trust for a beloved companion set up by the human, the divorce settlement that doesn't just give the companion to the party who paid for them—are actually bringing about changes for animals as such or are simply adapting laws to help humans, recognizing human needs, and do not actually change the status of animals. The ends are still humans, and the means are still animals.This is not intended to paint a bleak picture: The more bluntand uncompromising part of the animal rights movement that has been focused on the qualitative problem has hardly been successful at getting animal rights laws passed anywhere in the world, so everything that moves us closer to a better, richer, more thoughtful view of animals will help. Favre's approach has ingenuity, shows good sense, and has the potential to bring about real animal rights. The themes and cases in this book that show how courts and legislatures are becoming more aware of the sentience of at least some animals, as well as proposing a middle path in the debate about animals as property, are important in the journey toward recognition of animal rights. In this article my aim is to see Karl Llewellyn as a member of the central pragmatist canon. Further, I see Llewellyn not only as a “Legal Pragmatist,” but also as developing a full pragmatist philosophy of law. Reading Llewellyn as a pragmatist would greatly add to an extended understanding of early pragmatism. This would show a strong influence of pragmatic thought within the legal academy.. Second, adding Llewellyn to the pragmatist canon would help show pragmatism in action in the (...) world. Llewellyn might be the central theoretical pragmatist of modern US Law. If, as I believe, pragmatism is a philosophy that depends upon an underlying experimentalist attitude towards philosophizing, given his great influence on US law adding Llewellyn brings a large amount of experimentalist data to the tradition. Skeptical readers might observe that the focus in the Phaedo is much more on the forms than on defining accounts of them. This essay explicates the Proclean doctrine of the three forms of time in its context within his system and its wider implications, with particular reference to the form of temporality associated with the heroes. An abiding puzzle in the Phaedo is the transition in the text from initial pessimism about the possibility of wisdom during human life to a more optimistic view. Prominent interpretations posit different kinds or degrees of wisdom at issue in the two sets of passages. By contrast, I argue that the pessimistic view rests on the implicit premise that the soul cannot be completely purified during human life—a premise which arises from an initial conception of impurity and its cause. In (...) developing his eschatology, Socrates refines this conception and rejects the implicit premise. Because the embodied soul can be completely purified, it can achieve philosophical wisdom as well. (shrink)

The story of American intellectual history's decline, fall, and phoenix-like rebirth in recent decades has become trite with the retelling: knocked from its position of prominence by the new social history and plunged into the chastened soul-searching of the famed Wingspread Conference of 1977, only to find itself rescued in part by the linguistic and cultural “turns” that swept the entire discipline of American history in the 1980s and 1990s. Like many a narrative, this one undoubtedly imposes too clear a (...) pattern of meaning on a messier reality, but also like many a narrative, it has powerfully shaped the professional identities of American intellectual historians by giving them a sense of where they have been and how they arrived at their current place. That current place is a hospitable one, in many ways, for in the last couple of decades American historians seem to have grown increasingly receptive to the notion that ideas have mattered in history. The purpose of this book is to advance responsible rehabilitation of the speculative philosophy of history. It challenges the idea popularized by thinkers such as and Claude Lévi-Strauss and Jean-François Lyotard that historical meta-mythology and meta-narrative are philosophically obsolete. As long as humanity, viewed anthropologically, lives by over-arching narrative, the quest for a version that survives rational criticism remains vital. Here human rights serve as the key to unlock such a version. Despite the fact that the Hegelian philosophy of history (...) has often been derided, something very similar currently functions as the official ideology of the world community: the idea of history as the story of freedom. This book does not retell the world-historical story of freedom. Rather, it uncovers it, beginning with the current age of human rights and working backward through the great role-model civilizations of history. Its conclusion is that a forward retelling of the story of freedom as the story of human rights can be justified by dewesternizing the story. The book contains critical responses from specialized scholars and re-presentative of selected world cultures. The volume includes illustrations, and a guest Afterword by Donald Phillip Verene. In this chapter Alessandro Capone’s claim as the intimate relationship between legal reasoning and indirect reports is investigated through looking at legal citation practices, use of case law, and statutory and constitutional interpretation. Capone’s thought is informed in the chapter through a reference to the work of Ronald Dworkin and Edward H. Levi. The conclusion of the chapter is that Capone is correct that use of indirect reporting in law is ubiquitous and therefore warrants careful study. Further, and opposite of (...) Dworkin’s hope for a univocal use of indirect reports, Levi’s analysis emphasizes the bottom-up, conversational and polyvocal aspects of legal reasoning as is noted by Capone. This in turn requires eliminating the hope for finding or imposing a determinate and univocal meaning on legal citation, case law, and statutory and constitutional interpretation. Instead, continuing dialogue is required. Indeed, legal process should try to include as many voices in the construction of meaning as possible. (shrink)

An appendices section, incorporating a bibliography, is also included. This book will be of value to anyone with an interest in the history of education and the development of athletics.

I have recently been appointed Coeditor of a journal published on my campus, CLIO: An Interdisciplinary Journal of Literature, History and the Philosophy of History, with a view to expanding the journal’s philosophy offerings. It is a position I accepted only on the understanding that I would be free to develop the journal as an English-language forum for the study, indisciplinary application and critical evaluation of the Hegelian philosophy.

Failure to fully disclose material personal life events can impact the decision-making actions of the CEO, causing the stock price of the firm to vacillate as a result (...) of rumors and other informational uncertainties. These vacillations in stock price may impact a firm’s liquidity, increase the cost of capital, and affect long term returns to shareholders. We draw upon the ethical leadership and signaling theory literatures to demonstrate how a firm can reduce stock price volatility through a CEO making non-required disclosures that reduce information asymmetry.
