The challenge that confronts corporate decision-makers in connection with global labor conditions is often in identifying the standardsby which they should govern themselves. In an effort to provide greater direction in the face of possible global cultural conflicts, ethicistsThomas Donaldson and Thomas Dunfee draw on social contract theory to develop a method for identifying basic human rights: Integrated Social Contract Theory (ISCT). In this paper, we apply ISCT to the challenge of global labor standards, attempting to identify labor rights that (...) could serve as guides for corporations producing or outsourcing outside of their home country. In addition to identifying areas of universal agreement, we also examine whether ISCT is, in fact, a sufficient basis for determining worker rights; we seek to define the parameters of the “sweatshop” problem; we include the application and results of our ISCT analysis as applied to labor standards: the global labor rights hypernorms; and conclude that ISCT is sufficient only for rights that are universal. We also discuss whether market-driven decisions can identify the boundaries of labor rights, or at least assure that market outcomes are compatible with maintaining labor rights, in order to respond to the shortcomings of ISCT. We conclude with some comments on directions of analysis for labor rights determination. (shrink)

Anthony Ellis attempts to offer a deterrence theory of punishment that overcomes a number of common criticisms of deterrence theories in general. While his discussion does suggest many interesting responses that proponents of deterrence theories might use, the theory he defends is problematic for several reasons.

This paper takes up the question of the place of martial arts in a Christian response to violence. In light of René Girard’s mimetic theory, how can, or should a person of faith consider the practice of martial arts for the purposes of self-protection? This paper will respond to the question by showing that, Girard’s theory situates humanity in the realm of an intermediary process awaiting the consummation of the kingdom of God. We shall discover that we are ‘on the (...) horn of a dilemma’ in having to contend with the excesses of unremitting violence and the deficiencies of cowardice. A surprising compliment to Christian ethical behaviour can be found in the Eastern martial arts, which will be more closely observed through the traditions of Japanese samurai culture. We shall discover that virtue can be found in self-defence through a balance of Christian principle and martial art practice, which promotes peace and harmony in a sin-riddled world. (shrink)

The metaphors by which we live, derivative of religious perspectives, shape the ways in which we are engaged with the world around us. This is particularly evident in matters pertaining to consumption and population, factors in the calculus of global sustainability. Increasing concern over the past quarter century with environmental degradation has been paralleled by interest in the relation of religion to a developing environmental ethic. Such interest has called for sensitivity to the religious perspectives of all people, an interest (...) that is promoting involvement in inter-religious dialogue. The significance of this for public policy comes in three areas: growing interest in patterns of social relationships, ecojustice or the way in which we live out social relationships, and growing reflection on the essential nature of religion for value formation in public life. Sticking to the point is thought to be a good thing. Changing the subject, by contrast, is regarded as a sign of a wandering mind if it is unintentional and as a sign of duplicity if it is intentional. Yet, as I shall show, interpreters regularly replace an initial object of interpretation with a new object, thus “changing the subject.” They do so in one of four ways: idealization, resegmentation, reconception, and recovery. Far from being symptomatic of either intellectual weakness (...) or a desire to hide something, however, these processes are an intrinsic part of that most central of human intellectual endeavors, interpretation, and they contribute to its positive value. Artificial intelligence research has foundered on the issue of representation. When intelligence is approached in an incremental manner, with strict reliance on interfacing to the real world through perception and action, reliance on representation disappears. In this paper we outline our approach to incrementally building complete intelligent Creatures. The fundamental decomposition of the intelligent system is not into independent information processing units which must interface with each other via representations. Instead, the intelligent system is decomposed into independent and parallel activity (...) producers which all interface directly to the world through perception and action, rather than interface to each other particularly much. The notions of central and peripheral systems evaporateeverything is both central and peripheral. Based on these principles we have built a very successful series of mobile robots which operate without supervision as Creatures in standard office environments. (shrink)

Syme, Rodney Palliative care, founded by Cicely Saunders, a devout Christian, has grown from a single London hospice to a world-wide specialty with strong government support. It is one of the most important developments in modern medicine. It aims to provide compassionate and holistic care for the terminally ill. Nevertheless opposition on religious grounds to assisted-dying or hastening of death has been a core principle of palliative care from its origin, and persists today.

This paper argues that Leif Wenar's theory of reparations is not purely forward-looking and that backward-looking considerations play an important role: if there had never been a past injustice, then reparations for the future cannot be acceptable. Past injustice compose the first part of a two-tiered theory of reparations. We must first discover a past injustice has taken place: reparations are for the repair of previous damage. However, for Wenar, not all past injustices warrant reparations. Once we have first passed (...) the initial test of demonstrating a past injustice has taken place, we then determine whether or not to finally accept reparations based upon forward-looking considerations. What is important to note is that this decision to award reparations is based upon forward-looking considerations, but only after first satisfying the test of a past injustice. Thus, backward-looking considerations make up an important first part of Wenar's two-tiered theory of reparations. It is not my argument that this theory is unsafe and I find Wenar's arguments both novel and highly compelling. However, the view that this theory is forward-looking -- and not backward-looking -- is not entirely accurate. My brief reply corrects this part of an important new theory of reparations in the hope of strengthening its persuasive power. (shrink)

The universe appears fine-tuned for life. Bayesian confirmation theory is utilized to examine two competing explanations for this fine-tuning, namely design (theism) and the existence of many universes, in comparison with the ’null’ hypothesis that just one universe exists as a brute fact. Some authors have invoked the so-called ’inverse gambler’s fallacy’ to argue that the many-universes hypothesis does not explain the fine-tuning of ’this’ universe, but flaws in this argument are exposed. Nevertheless, the hypothesis of design, being simpler, is (...) arguably of higher prior probability and, therefore, to be preferred. The hypothesis of the single brute-fact universe is disconfirmed. Most animals have significant behavioral expertise built in without having to explicitly learn it all from scratch. This expertise is a product of evolution of the organism; it can be viewed as a very long term form of learning which provides a structured system within which individuals might learn more specialized skills or abilities. This paper suggests one possible mechanism for analagous robot evolution by describing a carefully designed series of networks, each one being a strict augmentation of the previous (...) one, which control a six legged walking machine capable of walking over rough terrain and following a person passively sensed in the infrared spectrum. As the completely decentralized networks are augmented. the robot’s performance and behavior repetoire demonstrably improve. The rationale for such demonstrations is that they may provide a hint as to the requirements for automatically building massive networks to carry out complex sensory-motor tasks. The experiments with an actual robot ensure that an essence of reality is maintained and that no critical disabling problems have been ignored. (shrink)

This manuscript reports on a landmark symposium on the ethical, legal and technical challenges of xenotransplantation in the UK. King’s College London, with endorsement from the British Transplantation Society (BTS), and the European Society of Organ Transplantation (ESOT), brought together a group of experts in xenotransplantation science, ethics and law to discuss the ethical, regulatory and technical challenges surrounding translating xenotransplantation into the clinical setting. The symposium was the first of its kind in the UK for 20 years. This paper (...) summarises the content of the expert lectures showcasing the progress which has been made in xenotransplantation including—the history of xenotransplantation, advances in gene edited animals and progress towards clinical xenotransplantation. We then set out the ethical and legal issues still to be resolved. Finally, we report the themes of the roundtable discussion highlighting areas of consensus and controversy. While the detail of the legal discussion was directed towards the UK, the principles and summary reported here are intended to be applicable to any jurisdiction seeking to implement clinical xenotransplantation. The first brief description is given of a project aimed at searching for the neural correlates of consciousness through computer simulation. The underlying model is based on the known circuitry of the mammalian nervous system, the neuronal groups of which are approximated as binary composite units. The simulated nervous system includes just two senses - hearing and touch - and it drives a set of muscles that serve vocalisation, feeding and bladder control. These functions were chosen because of their relevance (...) to the earliest stages of human life, and the simulation has been given the name CyberChild. The system's pain receptors respond to a sufficiently low milk level in the stomach, if there is simultaneously a low level of blood sugar, and also to a full bladder and an unchanged diaper. It is believed that it may be possible to infer the presence of consciousness in the simulation through observations of CyberChild's behaviour, and from the monitoring of its ability to ontogenetically acquire novel reflexes. The author has suggested that this ability is the crucial evolutionary advantage of possessing consciousness. The project is still in its very early stages, and although no suggestion of consciousness has yet emerged, there appears to be no fundamental reason why consciousness could not ultimately develop and be observed. “Daddy, is God real or is he a part of people's imagination?” The brain constructs reality by bottom‐up, genetically programmed mechanisms. Nature selected the human holistic, symbolically thinking, aesthetic brain using a mechanism of brain‐language coevolution. Our religious nature and moral capabilities are rooted in this brain, and in the real images it constructs.

In order to build autonomous robots that can carry out useful work in unstructured environments new approaches have been developed to building intelligent systems. The relationship to traditional academic robotics and traditional artificial intelligence is examined. In the new approaches a tight coupling of sensing to action produces architectures for intelligence that are networks of simple computational elements which are quite broad, but not very deep. Recent work within this approach has demonstrated the use of representations, expectations, plans, goals, and (...) learning, but without resorting to the traditional uses, of central, abstractly manipulable or symbolic representations. Perception within these systems is often an active process, and the dynamics of the interactions with the world are extremely important. The question of how to evaluate and compare the new to traditional work still provokes vigorous discussion. (shrink)

We propose a novel type of low distortion radial embedding which focuses on one specific entity and its closest neighbors. Our embedding preserves near-exact distances to the focus entity and aims to minimize distortion between the other entities. We present an interactive exploration tool SolarView which places the focus entity at the center of a "solar system" and embeds its neighbors guided by concentric circles. SolarView provides an implementation of our novel embedding and several state-of-the-art dimensionality reduction and embedding techniques, (...) which we adapted to our setting in various ways. We experimentally evaluated our embedding and compared it to these state-of-the-art techniques. The results show that our embedding competes with these techniques and achieves low distortion in practice. Our method performs particularly well when the visualization, and hence the embedding, adheres to the solar system design principle of our application. Nonetheless - as with all dimensionality reduction techniques - the distortion may be high. We leverage interaction techniques to give clear visual cues that allow users to accurately judge distortion. We illustrate the use of SolarView by exploring the high-dimensional metric space of bibliographic entity similarities. (shrink)

Rupturing along part the Hope Fault during a large earthquake in 1888, North Canterbury region, South Island of New Zealand, caused fence lines that crossed the fault to be laterally displaced by 1.5–2.6 m. The offset fence lines were documented (photographed, mapped, and published on) by the Government geologist, Alexander McKay, and forgotten. In the same year, observations of another fault line, the Awatere Fault, in the Marlborough area, South Island, led McKay to propose large-scale lateral displacement of ∼ 29–33 (...) km of geological formations along the fault, the result of cumulative movement of many earthquakes over millions of years (ca. 7 Ma). This ‘revolutionary’ idea was never published. The significance of McKay’s observations/deductions of small- and large-scale lateral displacement on faults was not fully appreciated in New Zealand until 1955 when aerial photography revealed that displacement of geomorphic features intersecting fault lines is dominantly horizontal rather than vertical. The idea of large-scale horizontal movement of the Earth’s crust, for example 483 km of lateral displacement of geological formations along the Alpine Fault in New Zealand first proposed in 1949, is now an integral part of the reigning paradigm of plate tectonics theory that explains the dynamics of movement of the Earth’s crust. In this dissertation I argue for a theory of rectificatory justice, and apply that theory to circumstances involving two social groups generally thought to have been historically wronged, viz., Native Americans and African Americans. ;Development of a conception of rectificatory justice is begun in Chapter 1 by examining the distinction between distributive justice and rectificatory justice, and by suggesting a theory of compensation. It is argued that the notion of compensation cannot provide an adequate ground for a species of justice. (...) ;I argue in Chapter 2 that a taxonomy of justice ought to consist of only two species, viz., distributive justice and rectificatory justice. In addition to compensation, the view of rectification argued for includes accounts of restoration, apology, and punishment. Some theories of so-called corrective justice are examined, and are found to be morally inadequate. ;In Chapter 3, I examine several views of a right to compensation, including those of Joel Feinberg and Judith Jarvis Thomson. Jules Coleman's claim that a requirement in justice for compensation can arise without the transgression of rights is examined and then rejected. ;After suggesting a theory of social groups, and adopting Allen Buchanan's account of groups rights, I argue in Chapter 4 that rectification rights can be legitimately ascribed to social groups. I assess the practical implications of my theory of rectificatory justice by applying it to two cases. In the first case, I argue that the fishing rights that were restored to Native American tribes of the Northwest as a result of U.S. v. Washington are justified when grounded on their right to rectification; hence, the claim that the restoration of these rights constituted an injustice to non-Native American fishing interests is mistaken. In the second case, I show how a right to rectification can legitimately be ascribed to African Americans as a group. ;The dissertation concludes with Chapter 5, where I consider several justificatory arguments for a moral statute of limitations on injustice. I conclude that a significant part of any such argument must ultimately rest on our judgements about competing claims. (shrink)

The late eleventh and twelfth centuries were Europe's first age of pamphlet warfare, of invective and satire. The perceived failure, or at least hypocrisy, of its new institutions-the new monastic orders and the reformed papacy-gave rise to the phenomenon, and it was shaped by the study of grammar and rhetoric in the new Schools. The central figures in the texts in the present book are Bernard of Clairvaux, the powerful ostensible founder of the Cistercian order, and the popular and influential (...) teacher Peter Abelard, leader of the radical faction in the Schools of Paris. The event which sparked this controversy was the Church council at Sens in 1141 which had led to the condemnation of Abelard's doctrines. Abelard proposed to use reason to explain the mysteries of faith, and this had led him into all kinds of difficulties with established church doctrine. The leading light in the atttack on his ideas was Bernard, the famous abbot of Clairvaux, a group of whose letters, written to gather support for it before and after the Council, are presented here. A little while later Abelard was defended by the vituperative but otherwise unknown Berengar, who wrote an outrageous Apology attacking Bernard; we also edit his remaining polemical works: his Letter to the Carthusians, and his Letter to the Bishop of Mende. None of Berengar's works has been translated before. An extensive introductory essay describes the course of the debate and the personnel, and analyses the invective employed by both Bernard and Berengar.
