En este artículo se reconstruye el vínculo sistemático entre el tratamiento aporético del conocimiento en el diálogo platónico tardío Teetetos y la definición conceptual del conocimiento en parte de la epistemología analítica contemporánea. A través de dicha vinculación se muestra, por una parte, la presencia de los problemas presentados por Platón en la epistemología actual, así como la persistencia de la aporía del dialogo en cuestión. The value of testimony as a source of knowledge has been a subject of epistemological debates. The "trust theory of testimony" suggests that human testimony is based on an affective relationship supported by social norms. However, the advent of generative artificial intelligence challenges our understanding of genuine testimony. The concept of "quasi-testimony" seeks to characterize utterances produced by non-human entities that mimic testimony but lack certain fundamental attributes. This article analyzes these issues in depth, exploring philosophical perspectives on testimony and (...) the implications of conversational AI technologies on our epistemic practices. (shrink)

En este artículo se abordan las perspectivas de David Hume y Bertrand Rus-sell en tormo dos asuntos estrechamente vinculados, a saber, el problema de la justificación de la inferencia no demostrativa y de la validez del principio de causalidad, ambos configu-ran el así llamado “problema de Hume”. Desde una perspectiva analítica y comparativa, se intenta mostrar que a pesar de la lectura fuertemente crítica que Russell adopta respecto del filósofo escocés, ambos filósofos comparten en cierta medida un programa filosófico común. The aim of this work is to analyse the effect of gender and ethical training received on the sensitivity of university teachers towards the inclusion of ethics in graduate business studies. To this end, a study has been carried out that uses four ethical sensitivity indicators for teachers: their opinion about the need to include ethics in the world of business, their opinion about the need to include ethics in University education involving business studies, the current integration of ethics by (...) teachers in the subjects they teach, and whether they intend to increase the time set aside for ethics in those subjects in the future. Results suggest that the ethical training received by teachers has a significant influence on their sensitivity towards the inclusion of ethics in graduate studies and the introduction of ethical aspects in their classes. Conversely, the results do not enable us to draw the conclusion that gender is a significant variable in terms of sensitivity towards the inclusion of ethics in the university education of business students. This work is of special relevance because it adds to the extremely limited amount of literature available on variables that may explain the attitude of teachers towards the integration of ethics in higher education, by supporting the thesis defended by many authors of the positive effect of ethical training on an improvement in sensitivity and ethical judgement. The main purpose of this article is to analyse one aspect of Spanish business ethics: the role of the transparency and quality of the economic and financial information given to meet the demands and requirements of shareholders. To that end we concentrate firstly on analysing the Spanish capital market and the situation of shareholders prior to the publication in February 1988 of the Code of Best Practice for Spanish Companies, drawn up by a Special Committee created at the request of (...) the Ministry of Economy and Finance. We analyse the importance of the behaviour and actions of three groups which are fundamental to assuring quality and transparency of information: those who prepare financial statements, the Board of Directors (particularly the Audit Committee) and the external auditors. Finally, we look at the possible consequences of the Code of Best Practice on Spanish business ethics. (shrink)

: In this paper, I consider some issues concerning Hume’s epistemology of testimony. I’ll particularly focus on the accusation of reductivism and individualism brought by scholars against Hume’s view on testimonial evidence, based on the tenth section of his An enquiry concerning human understanding. I first explain the arguments against Hume’s position, and address some replies in the literature in order to offer an alternative interpretation concerning the way such a defense should go. My strategy is closely connected with Hume’s (...) notion of virtue and the role it plays in his epistemology, mainly as presented in his A treatise of human nature. I address the problem of how the section “Of miracles” in the Enquiry must be properly understood, as several misunderstandings of Hume’s epistemology of testimony emerge partially from the particular character and aim of that section. Resumen: En este artículo, considero algunas cuestiones relacionadas con la epistemología del testimonio de David Hume. El eje central será la acusación de reductivismo e individualismo de los estudiosos en contra de la opinión de Hume sobre la evidencia testimonial. Dicha acusación se basa en su tratamiento de los reportes sobre hechos milagrosos, presente en la sección X de su Investigación sobre el entendimiento humano. En primer lugar, se abordan los argumentos en contra de la posición de Hume y algunas respuestas en la literatura reciente, para luego ofrecer una interpretación alternativa con respecto a la forma en que debería articularse esa defensa. Mi estrategia está estrechamente relacionada con la noción de virtud de Hume y el papel que desempeña en su epistemología, principalmente como se presenta en su Tratado de la naturaleza humana. Finalmente, abordaré el problema relacionado con la forma en que debe entenderse correctamente la sección “Of miracles” de la Investigación, ya que varios malentendidos sobre la epistemología del testimonio de Hume emergen parcialmente del carácter particular y el objetivo de dicho ensayo. Ethical climate in organisations has been studied widely and its influence on ethical behaviour has been documented. However, little is known about the ethical climate at university context and about its antecedents. Universities are social change institutions and their ethical climate could influence the ethical behaviour of future economic, social and political leaders. The current study analyses the perceived ethical climate in Business Studies Higher Education Institutions in Spain and whether university’s ownership, size and signing up for international initiatives influence (...) it. The study is based on survey responses of 385 lecturers of Spanish Business Studies Faculties to an ethical climate questionnaire and on survey responses of 33 Business Studies Deans to a questionnaire related to the commitment to ethics and social responsibility in each Faculty. An exploratory factor analysis has been used as well as ANOVA tests and lineal regressions. The results reveal the predominance of an instrumental ethical climate in Spanish Business Faculties, an ethical climate that does not promote ethical behaviour or organisational commitment among its members. The results also confirm the significant influence of university’s ownership and signing up for Principles for Responsible Management Education on the ethical climate in Business Higher Education institutions. This study advances the understanding of the ethical climate in Business Studies institutions, and suggests measures to be taken by university managers in order to improve ethical judgment and behaviour of the university community. Ao projetar esse objetivo, procuramos trazer elementos que favoreçam análises da compreensão escolar como espaço de potencialização. Defendemos como considerações finais do estudo que essa perspectiva e entendimento são nucleares para o debate e compreensão da dinâmica dos afetos no processo de humanização.

‘Normative powers’ are capacities to create normative reasons by our willing or say-so. They are significant, because if we have them and exercise them, then sometimes the reasons we have are ‘up to us’. But such powers seem mysterious. How can we, by willing, create reasons? In this paper, I examine whether normative powers can be adequately explained normatively, by appeal to norms of a practice, normative principles, human interests, or values. Can normative explanations of normative powers explain how an (...) exercise of the will can afford us special freedom in determining our reasons? I argue that normative approaches to answering this question prove to be inadequate. To vindicate the thought that normative powers can make our reasons ‘up to us’, we need an altogether different approach to understanding them, one that is located not in the normative but in the metaphysical. I end the paper by sketching a metaphysical explanation of normative powers. This metaphysical defence of normative powers provides a window into a different, more agent-centered way of thinking about rational agency. (shrink)

This paper proposes a way to understand transformative choices, choices that change ‘who you are.’ First, it distinguishes two broad models of transformative choice: 1) ‘event-based’ transformative choices in which some event—perhaps an experience—downstream from a choice transforms you, and 2) ‘choice-based’ transformative choices in which the choice itself—and not something downstream from the choice—transforms you. Transformative choices are of interest primarily because they purport to pose a challenge to standard approaches to rational choice. An examination of the event-based transformative (...) choices of L. A. Paul and Edna Ullman-Margalit, however, suggests that event-based transformative choices don’t raise any difficulties for standard approaches to rational choice. An account of choice-based transformative choices—and what it is to be transformed—is then proposed. Transformative choices so understood not only capture paradigmatic cases of transformative choice but also point the way to a different way of thinking about rational choice and agency. (shrink)

In this article, I identify and critically examine 3 dogmas of normativity that support a commonly accepted ‘Passivist View' of rational agency. I raise some questions about these dogmas, suggest what we should believe in their place, and moot an alternative ‘Activist View' of what it is to be a rational agent that grows out of rejection of the 3 dogmas. Underwriting the dogmas and the Passivist View, I suggest, is a deeply held but mistaken assumption that the normative domain (...) is fundamentally akin to the nonnormative domain. Once we allow that the normative may be fundamentally unlike the nonnormative in certain key ways, a shift in our thinking about what it is to be rational becomes possible. I end by considering some implications of this paradigm shift in rationality from the passive to the active for various applied matters. (shrink)

Catharine Trotter Cockburn challenges voluntarist views held by British moral philosophers during the first half of the eighteenth century. After introducing her metaphysics of morality, namely, her account of human nature, and her account of moral motivation, which for her is a matter concerning the practice of morality, I analyze her arguments against theological voluntarism. I examine, first, how Cockburn rejects the view that God can by an arbitrary act of will change what is good or evil; second, how she (...) challenges views that understand the initial creation of the world solely in terms of divine will and draws attention to the role that the divine understanding plays in God’s creation; and third, how she argues that moral obligation does not require a superior lawmaker. I conclude by highlighting how Cockburn’s arguments not only challenge voluntarist views, but also offer support for her moral fitness theory. (shrink)

My chapter examines Isaac Watts’s and Catharine Trotter Cockburn’s views concerning the metaphysics of the mind and their underlying accounts of powers and substances. In Philosophical Essays on Various Subjects Watts criticizes Locke’s account of substances and argues for his own preferred account of substance. Watts argues that there is no need to postulate an unknown substratum, as Locke does. Instead, Watts searches for a better explanation of what substances are. His proposal is that bodily substance just is solid extension (...) and that mental substance is identical with the power of thinking. This means that Watts believes that some powers can be substances. I will show how Watts defends his account of substances against various objections. Cockburn was not satisfied by Watts’s account of substance and disagrees with Watts’s understanding of powers. She believes that Watts is too quick to draw metaphysical conclusions. Cockburn takes seriously the limitations of human understanding and emphasizes that humans are ignorant about many metaphysical truths. I end by assessing the strengths and weaknesses of Watts’s and Cockburn’s accounts of powers and substances. (shrink)

Heidegger argues that modern technology is quantifiably different from all earlier periods because of a shift in ethos from in situ craftwork to globalised production and storage at the behest of consumerism. He argues that this shift in technology has fundamentally shaped our epistemology, and it is almost impossible to comprehend anything outside the technological enframing of knowledge. The exception is when something breaks down, and the fault ‘shows up’ in fresh ways. Stiegler has several important addendums to Heidegger’s thesis. (...) Firstly, that Heidegger fails to fully appreciate the early Greek myth of Prometheus, and the technological depth that fire offers all human societies. Secondly, the fall, or failure, which is doubled in the myth of Prometheus, and shows up in epistemology accordingly. Thirdly the acceleration of technology since the onset of Information Technology, and the way this is disorientating our Being. I argue the fall in both Heidegger and early Stiegler has encaptured their imagination. In later work, Stiegler argues that acceleration is fused with algorithmic pretensions, that are distorting and undermining the creative political imaginary, and making it difficult to revalue the values that underpin the nihilist Anthropocene. The overcoming of the Anthropocene engages politics, economics, power, physics, and ecology. (shrink)

John Locke accepts that every perception gives me immediate and intuitive knowledge of my own existence. However, this knowledge is limited to the present moment when I have the perception. If I want to understand the necessary and sufficient conditions of my continued existence over time, Locke argues that it is important to clarify what ‘I’ refers to. While we often do not distinguish the concept of a person from that of a human being in ordinary language, Locke emphasizes that (...) this distinction is important if we want to engage with questions of identity over time. According to Locke, persons are thinking intelligent beings who can consider themselves as extended into the past and future and who are concerned for their happiness and accountable for their actions. Moreover, for Locke a self is a person, considered from a first-personal point of view. I show that the concept of self that he develops in the context of his discussion of persons and personal identity is richer and more complex than the I-concept that he invokes in his version of the cogito. I further argue that Locke’s moral and religious views explain why he emphasizes the need for a conceptual distinction between persons and human beings. In the final section I turn to the reception of Locke’s view by some of his early critics and defenders, including Elizabeth Berkeley Burnet, an anonymous author, and Catharine Trotter Cockburn. Why does #RepealedThe8th matter for feminist legal studies? The answers seem obvious in one sense. Feminism has long constituted itself through the struggle for sexual and reproductive justice, and Irish feminism has contributed a significant ‘legal win’ with the landslide vote of approval for lifting abortion restrictions in the referendum on the 25th May 2018. That win comes at a global moment when populist legal engagement is doing significant damage in countries that regard themselves as world leaders, and beyond. #RepealedThe8th (...) offers Ireland, and the world, the actuality that the popular vote, and everything that contributes to it, could be something else. Repeal shows how legal tools like the vote may be made into an expression of care for reproductive lives. This expression is important in recognizing pregnant people as knowing agents who are best placed to decide, and in seeking to do justice to those who contribute to everyday reproductive life. But repeal, like the many who brought it into being, has multiple meanings. #RepealedThe8th matters because it is a moving process of socio-legal translation, which draws on a collective energy, ‘repeal energy’, to turn the travesty that was the Eighth Amendment and all it represents into a search for the rest of reproductive life. In opening up the meaning of the vote, much like feminists elsewhere have opened up the meaning of the strike, Irish feminists have turned public mourning over past mistreatment into a series of reproductive connections. This is not a strategy that can be rolled out. Figuring out #RepealedThe8th will take many tellings. Rather we need to give repeal, and repealers, room to breathe and rest. We need to feel our way through repeal’s production of legal change so that this success is not reduced to some generic transferable set of legal instructions. I begin by reflecting on repeal as a process of feminist socio-legal translation, which shows us how legal change comes about through the motivation of collective joy, the mourning of damaged and lost lives, the sharing of legal knowledge, and the claiming of the rest of reproductive life. In this interview, Ruth Klüger, writer and survivor of Auschwitz, speaks of the wound of who, once alive outside the lager, has felt a “feeling of rejection” by the world that she thought it would have accepted her – as if the fault of the executioners had contaminated the victims. A separation that the survivor will live for all her life, both because, as a matter of fact, she feels to have a “double citizenship” between the alive and the (...) dead – such that all in a sudden the normality breaks down and it gives way to the “old world” and the sensation that anything can be subtracted away – and because the witnesses, after having been rejected, they have turned into a generation of martyrs, object of a worship that can easily turn into nausea. However, the reflection on the human conditions cannot do away with the identification with what is acknowledged as similar, and for that reason a proximity is necessary. (shrink)

This essay examines Locke’s chapter “Of Identity and Diversity” (Essay 2.27) in the context of the series of chapters on ideas of relations (Essay 2.25–28) that precede and follow it. I begin by introducing Locke’s account of how we acquire ideas of relations. Next, I consider Locke’s general approach to individuation and identity over time before I show how he applies his general account of identity over time to persons and personal identity. I draw attention to Locke’s claim that “person” (...) is a forensic term and analyse his arguments for why the sameness of a human being and the sameness of a substance or soul are neither necessary nor sufficient for personal identity. Instead, Locke argues that personal identity consists in sameness of consciousness. Locke regards persons as moral agents who are accountable for their actions. If a person now is held accountable for a past action it is important that the person now is the same person as the person who did the action. This means that moral accountability presupposes personal identity. Additionally, it will be important to consider whether the person deserves reward or punishment for the action. Locke’s account of moral relations, which he develops in Essay 2.28, addresses this issue and I show how it supplements his account of persons and personal identity. (shrink)

This editorial explains the themes of the forthcoming FLaK seminar and how those themes draw on the collective and individual contributions of the articles, interviews and commentaries presented in this issue. At FLaK, we propose to think with others about the kind of ‘kitchen table’ that FLS might provide into the future. How might feminist legal studies—the approach and the journal—best use its food, equipment, techniques, time, space, mood, energy and commitment? How shall FLS scholars and associates make the most (...) of what we have in a room that can sometimes be confining and confusing, yet also exciting and sustaining? How do others engage with the processes and products of our kitchen table? In considering these issues and more, we propose to draw reflexively on feminist legacies of praxis, internationalism and openness, as we stock up and critically reflect on decolonizing techniques, legal know-how, protest and publishing practices. William Molyneux (1656–1698) was an Irish experimental philosopher and politician, who played a major role in the intellectual life in seventeenth-century Dublin. He became Locke’s friend and correspondent in 1692 and was probably Locke’s philosophically most significant correspondent. Locke approached Molyneux for advice for revising his Essay concerning Human Understanding as he was preparing the second and subsequent editions. Locke made several changes in response to Molyneux’s suggestions; they include major revisions of the chapter ‘Of Power’ (2.21), the addition of (...) the chapter ‘Of Identity and Diversity’ (2.27), and the addition of the so-called Molyneux Problem (2.9.8). Molyneux repeatedly requested that Locke develops his views on morality. Additionally, their correspondence turned to questions concerning education and Molyneux’s keen interest in the topic likely prompted Locke to publish Some Thoughts Concerning Education in 1693. Moreover, Molyneux drew on Locke’s anonymously published Two Treatises of Government in his The Case of Ireland’s Being Bound by Acts of Parliament in England, Stated, which was first published in the spring of 1698. Molyneux revealed Locke’s authorship of Two Treatises against Locke’s will, yet their friendship continued until Molyneux’s untimely death in October 1698. (shrink)

This quotation from the London Review of Books is an example of a turn—a different way of looking at things that involves a redefinition of the kind of thing higher education is and how it should be provided. It is a turn away from a public good perspective—the opposite, it might be said, of the kind of turn addressed in this article.

The recent Minnesota case of In re Emergency Guardianship of Albert Barnes illustrates an emerging class of cases where a dispute between a family proxy and a hospital over “medical futility” requires legal resolution. The case was further complicated by the patient’s spouse who fraudulently claimed to be the patient’s designated health care proxy and who misrepresented the patient’s previously expressed treatment preferences. Barnes demonstrates the degree of significant administrative and institutional support to the health care team, ethics consultants, and (...) futility committees that is required when a futility dispute escalates to the need for judicial resolution. An institutional futility policy, especially one that is endorsed by other regional medical centers and organizations, is an important foundation for a hospital that seeks judicial support in a dispute over medical futility in end of life care. This article discusses work on implementing emotional and cultural models into synthetic graphical characters. An architecture, FAtiMA, implemented first in the antibullying application FearNot! and then extended as FAtiMA-PSI in the cultural-sensitivity application ORIENT, is discussed. We discuss the modelling relationships between culture, social interaction, and cognitive appraisal. Integrating a lower level homeostatically based model is also considered as a means of handling some of the limitations of a purely symbolic approach. Evaluation to date is summarised and future directions discussed.

Since the last issue of Feminist Legal Studies, we editorial board members have had lots of conversations about comfort, displacement and alienation. As we developed the programme for #FLaK2016 we thought about it as a kind of pulling ourselves out of our comfort zone, if academic events and journals ever have a comfort zone. Drawing on a mix of feminist live performance methods and a science and technology studies-type curiosity for objects of experimentation, we tried out a kitchen table method (...) of hosting a live research conversation with activists, artists and academics over two days. But we had not fully anticipated the way that the Brexit result would contribute to and complicate discomfort. A fuller analysis of FLaK awaits a later moment, but here we pick out this one aspect of our gathering—feelings of discomfort – as they animate the contributions to this issue in interesting ways. The study draws attention to the transfer of management theories and practices from traditional capitalist countries such as the USA and UK to post-socialist countries that are currently experiencing radical change as they seek to introduce market reforms. It is highlighted that the efficacy of this transfer of management theories and practices is, in part, dependent upon the extent to which work-related attitudes and values vary between traditional capitalist and former socialist contexts. We highlight that practices such as Human Resource (...) Management (HRM) and Organization Development (OD) are inextricably associated with conceptions surrounding culture and society, as well as to variables such as job satisfaction and organisational commitment. The main aim of this study is to compare various attitudes and values of employees in traditional capitalist countries and post-socialist countries. On the basis of the findings of an attitudinal survey of (N = 5914) workers in 15 countries we conclude that certain aspects of the attitudes and values of workers in post-socialist countries and traditional capitalist countries differ significantly. Specifically, these differences were found in respect of context-related and job-related attitudes, and also in relation to the importance that the respondents attached to the subject of ethics more generally. The implications of the study are discussed particularly in relation to the transfer of management theory and practices between traditional capitalist and post-socialist contexts. (shrink)

In this chapter, I discuss Locke’s contributions to moral psychology. I begin by examining how we acquire moral ideas, according to Locke. Next, I ask what explains why we act morally. I address this question by showing how Locke reconciles hedonist views concerning moral motivation with his commitment to divine law theory. Then I turn to Shaftesbury’s criticism that Locke’s moral view is a self-interested moral theory that undermines virtue. Feminists witness legal worlds as they observe, document and share nothing less than the reproduction of life itself. The world of the abortion trail, where people and things move across borders to change life’s reproduction, has generated a rich variety of legal sources, figures and objects for feminist witnessing. In watching how feminist activists improvise with sources, figures and objects of legal consciousness on the abortion trail, this article seeks to contribute to critical understanding of a plurality of witnessing practice, (...) particularly as it emerges in diaspora space. Focusing on Murphy’s concept of immodest witnessing, with its attention to bodies, protocols and apparatuses as constituents of knowledge, the article thinks with the diasporic feminist performance group, Speaking of I.M.E.L.D.A., about how they used self-examination, collaboration and knowledge-sharing on the trail to repeal Ireland’s 8th Amendment. The article argues that their improvisation with legal consciousness of reproductive choice enacts ‘cheeky witnessing’. Cheeky witnessing has three dynamics as a method of observation. First, it is messy and irreverent in innovating with names to display the mixed genealogies of feminist knowledge. Second, cheeky witnessing generates novel subject-figures who make connections between different reproductive labourers as observers of the trail in diaspora space. Third, cheeky witnessing places funny objects, knickers in this instance, so as to join up particular public locations and make them more, if unevenly, comfortable for sexual and reproductive bodies. Cheeky witnessing shows us how committed and partial practices play a role in speaking across interests and experiences, in stretching the legal imagination and in sustaining the everyday grind of making a better world.
