Contemporary moral philosophy has different approaches to provide justice and equality to groups that are traditionally discriminated on the grounds of gender, religion, age, sexual orientation, etc. On the other hand, functionally diverse (disabled) people have had a parallel approach to their discrimination, excluded from mainstream diversities. Including functional diversity and the diversity model in modern recognition and redistribution theories, as another human diversity, provides an extended ethical approach: diversity ethics. This general framework also includes other fundamental ideas for equality (...) such as human fragility, social domination logics, self-respect and auto-recognition. Diversity ethics provides sound foundations to defend justice and equality for all human diversities and an alternative to other approaches that broaden the moral community, excluding some humans, like Peter Singer’s ethics. We can better understand its meaning if we compare it to the two other ideologies then competing for the Iberian peninsula, the Islamic holy war (djihad), and the Judaic eschatological hope linked to the diaspora of the Sephardim. This book treats Hannah Arendt as a distinctly political writer who attempts to carve out a way in which humanity, poised between the Holocaust and the atom bomb, might reclaim its position as the creators of a world fit for human habitation. Marilyn LaFay argues that Arendt tries to bring a humanity into modernity, rejecting the argument that Arendt is an 'antimodernist lover of the Greek polis.' Rather, Arendt tries to politically reconcile the potential of humanity with the demands of (...) the modern condition: she encourages us to locate and use the expressive element of the modern for our political ends. This work identifies the paradox of Arendt's choice of an expressive, existentialist interpretation of politics over that of a politics of vision and imagination, concluding that Arendt's politics leads to little more than political aesthetics. We study an extension of Stackelberg’s model in which many firms can produce at many different times. Demand is affine, while cost is linear. In this setting, we investigate whether Stackelberg’s results in a two-firm game are robust when the number of firms increases. We show that firms may not need to anticipate further entries, leaders might earn less than in the simultaneous game, and, whatever its cost and its time of entry, the firm’s entry always improves welfare.

Bien que ce contexte interprétatif ait évolué persiste la prévalence d’une interprétation individualiste et substantialiste du rapport à ce qui est possédé. Notre ambition sera de mettre au jour d’autres modèles interprétatifs de la propriété qui ne soient pas avant (...) tout attachés à l’individu en tant que tel, dans sa singularité, mais qui se construisent par exemple à partir de l’attribution à l’individu de droits sur les qualités des choses. Dans un premier temps, nous identifierons les éléments (tels le Code civil) et les mécanismes qui ont conduit à construire la sphère familiale comme l’espace légitime au sein duquel se réalisent la négociation des biens et la transmission du patrimoine. Il s’agira, dans un deuxième temps, de concevoir la propriété par référence à une convention plutôt qu’à un état de nature, fût-il familial, et par référence à une finalité sociale plutôt qu’à des finalités individualistes. Enfin, nous envisagerons les reformulations possibles du concept de propriété privée et de propriété sociale à partir d’un contrat social plus juste pour l’ensemble des contractants. | : The contemporary conception of private property is still nowadays based on an interpretation of it that emerged in the seventeenth century, in reference to the state of nature. Although this interpretive context has changed, the prevalence of an individualistic and substantialist interpretation of what is possessed persists. In this paper, we will highlight some interpretative models of property which are not primarily attached to the individual but which are grounded on the entitlement of rights over the qualities of things to the individual. Firstly, we will identify the elements and the mechanisms that led to build the domestic sphere as the legitimate space in which to the goods are negotiated and the property transferred. Then we will propose an interpretation of private property referring to a convention rather than to a state of nature — even a familial one —, i.e. referring to social aims rather than to individualistic goals. La réanimation néonatale donne lieu à une demande publique et institutionnelle d'élaboration de normes, appelée par les dilemmes éthiques, induits par la pratique d'arrêt de vie ou de non réanimation. Ces dilemmes sont pratiquement levés par une référence aux « grands principes » qui régissent généralement la pratique médicale (dignité humaine, droit à la vie, droit à l'autonomie, obligation de soins, principe de non nuisance) ainsi que par l'exigence de suivre, pour procéder aux arrêts de vie, une « démarche transparente (...) et progressive », incluant une dimension délibérative. Dans la mesure où, en dépit de ces conditions, des désaccords éthiques légitimes demeurent et s'avèrent à l'analyse insolubles, il paraît nécessaire d'institutionnaliser ces désaccords afin de permettre aux personnes de « vivre ensemble » et de « travailler ensemble », en dépit de leurs divergences éthiques, toutes fondées sur de « bonnes raisons » morales. Since we have learned that human organs can be used to treat severe health problems, only donation has been considered for organ procurement. Among the other possibilities that can be used after a person’s death, purchase or systematic removal have been a priori rejected. However, we will show that the appeal to individual altruism have resulted in some of the aporias of the present situation. Subsequently, we will consider how systematic organ removal from deceased persons can be made acceptable in (...) liberal and democratic societies. Finally, we will suggest that individual choices with regard to systematic organ removal could well be registered in a way that allows proper implementation of present French legislation. (shrink)

De plus, le processus de dialogue réserve un rôle important à des « Grands témoins » choisis qui utilisent leur expertise pour délimiter les interprétations tolérables des principes de référence et les occasions de procéder à des compromis acceptables. Cela produit une configuration de la discussion dans laquelle l’expertise empirique spécialisée et l’expérience personnelle, non moins que les attitudes épistémologiques et les représentations du « naturel », jouent un rôle crucial. Plato’s constant reservations concerning art from the moral and political point of view have to some extent concealed the aesthetic dimension of his analyses of art and helped to consolidate the idea that there is, strictly speaking, no such thing as a Platonic aesthetics. We wish to contest the latter view and to show that Plato, without considering aesthetics as an autonomous philosophical sphere, does develop a theory of sensibility and recognizes the specificity of aesthetic pleasure and judgement as well (...) as the specificity of the relation between art and reality. Both in the U.S. and in France, inheritance is probably the main factor of wealth concentration among the richest part of the population, and of its intergenerational reproduction. In so far as wealth is an opportunity, a reform of inheritance tax could be a mean to ensure a fairer distribution of opportunities in the society. Many reforms of inheritance systems have been conceived at least since Bentham. The identification and the analysis of ethical properties of reforms as the ones designed (...) by Mill, Rignano, Solvay, Huet and Haslett show that the latter is certainly the one which most satisfies the requirements of an ethics of inheritance. The identification of a post-modern art requires the determination of its implicit patterns of signification, as is the case with the modern art’s patterns of signification. In fact, the mere formal and stylistic analyses are not able to distinguish the post-modern art from the modern art. Actually, the specificity of minimalist and post-minimalist sculpture is founded on a phenomenological interpretation of subjective aesthetic experience and on a phenomenological interpretation of significance. This paper studies the entry strategies of firms on risky markets. We focus on markets where demand is affine and cost is linear; moreover, the demand includes a normally distributed random variable. In such a model, we show that the leader’s strategy changes with the level of market risk even when firms are risk neutral. Therefore, the availability of future information for a Stackelberg follower has a feedback effect on the leader’s strategy. We also show that compared with traditional markets (...) with no risk, the basic trade-off between flexibility and pre-commitment is only slightly changed in the qualitative game where firms are free to choose when to enter the market. The chronic worldwide lack of organs for transplantation and the continuing improvement of strategies for in situ organ preservation have led to renewed interest in elective non-therapeutic ventilation of potential organ donors. Two types of situation may be eligible for elective intensive care: patients definitely evolving towards brain death and patients suitable as controlled non-heart beating organ donors after life-supporting therapies have been assessed as futile and withdrawn. Assessment of the ethical acceptability and the risks of these strategies is essential. (...) We here offer such an ethical assessment using the four principles of medical ethics of Beauchamp and Childress applying them in their broadest sense so as to include patients and their families, their caregivers, other potential recipients of intensive care, and indeed society as a whole. The main ethical problems emerging are the definition of beneficence for the potential organ donor, the dilemma between the duty to respect a dying patient's autonomy and the duty not to harm him/her, and the possible psychological and social harm for families, caregivers other potential recipients of therapeutic intensive care, and society more generally. Caution is expressed about the ethical acceptability of elective non-therapeutic ventilation, along with some proposals for precautionary measures to be taken if it is to be implemented. (shrink)

Il faut pour le comprendre s'intéresser d'abord à l'ancrage de la pensée du droit dans la théorie kantienne de la raison pratique et aux problèmes que pose le statut kantien d'une raison normative dans les deux champs coordonnés de l'éthique et du droit. L'articulation entre droit privé et droit public, entre droit et politique dans la Métaphysique des moeurs doit être considérée en relation avec l'exigence d'une fondation (...) unitaire du système des normes pratiques. La philosophie politique de Kant peut dès lors être envisagée dans le prolongement de sa théorie du droit international, avec l'ouverture d'une perspective cosmopolitique qu'il importe de définir avec précision. Professor Solmsen's interpretation is orthodox; his comprehensive account builds on recent more specialized studies, including his own, and those of Jaeger, Ross, and Cherniss. If in some ways the book contains no large surprises, it nevertheless makes a major contribution by its treatment of Plato. The author has skillfully disengaged Plato's observations about nature from the customary ethical, epistemic, or, as the case may be, metaphysical contexts. He demonstrates that Plato was toward the end of his career a more serious (...) investigator of physical phenomena than is commonly supposed. The purpose of the present study was to address the shortcomings of Cronbach’s alpha concerning the semantic overlap between items. Using an example from a motivational measure, the correction of Cronbach’s alpha was applied by partialing out the effects due to conceptual overlap. The significance of Cronbach’s alpha was tested using simulated random data derived from the measure and by estimating the confidence intervals with known and unknown distributions. The results indicated that the uncorrected conceptual overlap coefficient alpha was equal (...) to 0.89 and 0.66 following the correction. After simulating the corrected statistical results, the distribution of alpha with random numbers had an estimate of 95%, equal to 0.41. The lower bound of the corrected alpha distribution was equal to 0.41, suggesting that the corrected alpha could easily belong to the distribution of alpha developed from simulated random numbers. Thus, the semantic overlap between items on a measure represents a significant threat to the validity of the alpha coefficient. (shrink)

Part of the accepted scholarly lore about Kierkegaard is that he holds that “existence”—human existence—and “the System” are mutually incompatible. For Kierkegaard, human being cannot be understood in terms of a nice, neat, complete systematic package; he shows, on this view, that the Hegelian attempt to grasp all of reality in terms of a philosophical system will always fail to grasp the reality of at least one thing: the concrete, living, existing individual human being.

This article delineates the core concerns and motivations of the ontological work of Gilles Deleuze, and is intended as a programmatic statement for a general philosophical audience. The article consists of two main parts. In the first, two early writings by Deleuze are analysed in order to clarify his understanding of ontology broadly, and to specify the precise aim of his understanding of being in terms of difference. The second part of the article looks at the work of Heidegger and (...) Derrida in order to distinguish Deleuze's conceptions of ontology and difference from theirs. A final section clarifies Deleuze's efforts to undertake the construction of an ontology divergent from the dominant tradition and in contrast to the emphasis on the closure of metaphysics in the thought of Heidegger and Derrida. Augustine’s thoughts on human salvation not only influenced early Protestant theology but also dominated the conceptualisation of the missio Dei from the perspective of the 1952 Willingen Conference. His doctrine of synergism arguably only manifested much later in the conception of the missio Dei, which anticipated human obedience or active participation in the mission to attain the goal of human salvation. The idea of synergism in this regard, or in the context of the missio Dei, is that while salvation remains (...) an unmerited gift of grace through faith in Jesus Christ, God prescribes human cooperative involvement in its attainment. In this way people do not become unresponsive recipients of God’s grace, but active and willing participants in a mission of salvation. With this in mind, this article examined the available literature on the topic of synergism in order to provide further insights into the conceptualisation of the missio Dei. The account of Noah in Genesis 5:32–10:1 and the Great Commission in Matthew 28:16–20 were used to redefine the doctrine of synergism or its relevance in the context of the missio Dei.
