Benjamin Libet's celebrated experiments concerning freedom elicited numerous attempts of _philosophical_ repudiation. Ten years ago, however, Judy Trevena and Jeff Miller published a _technical_ objection; they claim to have detected a,,smearing artifact" in Libet's calculations. This rests on a misunderstanding of Libet's methodology. In my reconstruction of Libet's argument, he draws an abductive inference to the best explanation. Now, Trevena's and Miller's objection does indeed lead to alternative explanations of Libet's measurements. These alternatives are _ad hoc_ and extremely improbable. They (...) constitute worse explanations than the explanation offered by Libet. _German_ Benjamin Libets bahnbrechende Experimente zur Willensfreiheit aus den Achtziger Jahren des vorigen Jahrhunderts gehören längst zu den Klassikern der Experimentalkunst. Aus _philosophischer_ Perspektive sind sie oft kritisiert worden; unabhängig davon ist zu Beginn des neuen Jahrtausends ein _technischer_ Einwand gegen Libet prominent geworden, der von Freiheitsfreunden gerne zitiert wird. Er geht auf Judy Trevena und Jeff Miller zurück und besteht in dem Vorwurf, dass Libet mit seiner Berechnung der _gemittelten_ Bereitschaftspotential-Kurven die wahren Verhältnisse verschmiere und dabei aus mathematischen Gründen den Anstiegs-Zeitpunkt des Bereitschaftspotentials künstlich nach vorne verschiebe – das ist der Vorwurf des sog. Verschmierungsartefakts. Ich zeige, dass der Vorwurf nicht sticht. Er beruht auf einem Missverständnis der Schlussmethode Libets. Laut meiner wissenschaftstheoretischen Rekonstruktion zieht Libet weder deduktive noch induktive Schlüsse aus seinen Einzelbeobachtungen; er schließt abduktiv, d.h. er schließt auf die beste Erklärung seiner Einzelbeobachtungen. Wie eine genaue arithmetische Analyse zeigt, bieten die Alternativ-Erklärungen, unter denen sich das Verschmierungsartefakt bewahrheiten würde, schlechtere Erklärungen als Libets Erklärung – sie sind an den Haaren herbeigezogen und extrem unwahrscheinlich. A particularly significant criticism of utilitarian and consequentialist moral theories is that they are overly demanding. According to the epistemic variant of this critique, it is overly demanding to have to determine which of one's possible actions would promote the good in the best possible way. A particularly striking articulation of this concern was put forward by James Lenman, who argued that not only is it difficult to predict the consequences of actions, but it is often outright impossible. The reason, (...) according to Lenman, is that we are simply ignorant of what the consequences of an action will be—especially in the distant future, after long and highly complex causal chains. In From Value to Rightness, Vuko Andrić defends an act-consequentialism with a subjective decision criterion designed to avoid these objections. According to this position, agents should decide based on the outcomes they can reasonably expect to occur, rather than the outcomes that actually occur. -/- ----- Eine besonders einschlägige Kritik an utilitaristischen und konsequentialistischen Moraltheorien besagt, dass sie überfordernd sind. Der epistemischen Variante dieser Kritik zufolge ist es überfordernd, wenn man grundsätzlich herausfinden muss, welche der eigenen Handlungsmöglichkeiten das Gute auf die bestmögliche Weise befördern würde. In From Value to Rightness verteidigt Vuko Andrić einen Handlungskonsequentialismus mit subjektivem Entscheidungskriterium, der diesen Vorwürfen entgehen soll. Dieser Position zufolge sollen Handelnde auf Grundlage derjenigen Handlungsfolgen entscheiden, mit deren Eintreten sie vernünftigerweise rechnen können und nicht auf Grundlage der tatsächlich eintretenden Folgen. ZUSAMMENFASSUNGHegelsche Philosophie wird oft als eine metaphysische Konstruktion angesehen.Demgegenüber wird in dem Beitrag eine Position eingenommen, laut der Hegel,innerhalb seines holistischen philosophischen Rahmens, eine perspektivistischeVorgehensweise verwendet, um immer neue, immer konkretere, weil begrifflichimmer mehr vermittelte, Einsichten zu erreichen. Die perspektivistische Methode Hegels wird anhand des Phänomens des freien Willens gezeigt. Hegel glaubt, dass es sich nicht auf einen Schlag erklären lässt, ob und in welchem Sinne der Wille frei ist. Der Beweis, der diese Versicherung begründen soll, wird erst auf (...) dem Weg der vielschichtigen philosophischen Deduktion geliefert. Einer neuen Auffassung des Trägers der Willensfreiheit entspricht dabei immer ein neues Konzept des Gegenstandbereiches. So impliziert etwa das moralische Konzept des Willens eine völlig neue begriffliche Konstellation, mit welcher der Wille und seine Welt aufgefasst wird, als das rechtliche Konzept des Willens. Im letzten Teil des Beitrags wird analysiert, welche Schlüsse aus Hegelscher Rekonstruktion des freien Willens für heutige Debatten zu ziehen wären. Demgemäß sollte ein hegelianisch gesinnter Denker nicht das von dem Naturalisten entworfene Bild des empirisch determinierten Willens, sondern dessen absoluten Anspruch auf Erklärung desavouieren. Es wird klar, dass empiristische Vorgehensweise im Fall der Willensfreiheit einen gewaltigen Teil unserer sozialen Erfahrung und unseres Diskurses gar nicht erklären kann. Contrary to that, the author of the paper tries to show that Hegel uses - in the context of his holistic philosophy - a perspectivist strategy which allows him to present newer and more and more detailed insights, which are conceptually richer. This perspectivist strategy of Hegel is demonstrated using the example of the problem of the freedom of will. According to Hegel there is no possibility to show at one blow that, and in what sense, the will is free. The argument that vindicates this assumption can only be given in the context of multi-layered philosophical deduction. A new concept of the subject of the free will always implicates a new concept of the objective sphere. For example, the moral understanding of the will implies a wholly new configuration of concepts to grasp the will and its world than the legal understanding of it. At the end of the paper an analysis is given of what kind of conclusions may be drawn from Hegel's reconstruction of the free will that could bring new insights in the actual debates on the free will. According to this analysis a hegelian thinker should not disavow the naturalist’s picture of the empirically determined will, but should instead disavow the claim of this picture to have an absolute explanatory status. It is suggested that the empirical strategy of the denial of the free will is not able to explain a huge range of our social experience and our social discourse. Die vorliegende Arbeit besteht, von Beigaben wie Indizes und Bibliographie abgesehen, aus einer 124 Seiten umfassenden Einleitung und einer 328 Seiten umfassenden vollständigen Werkausgabe des bisher wenig bekannten Antipalamiten Theodoros Dexios. Seine Schriften, eine von POLEMIS (P.) als „Appellatio“ bezeichnete Beschwerde über die Voreingenommenheit des Ioannes Kantakuzenos auf dem Konzil von 1351, zwei Briefe und ein von P. so genannter „Tractatus brevis de Christo ipso splendente in Transfiguratione“ sind anonym überliefert, zudem auch ohne Überschriften. Zu Beginn der Einleitung wird G. (...) MERCATIs Annahme, daß die Schriften von Dexios verfaßt wurden, gegen J. MEYENDORFF, der sie dem Arsenios von Tyros zuwies, überzeugend verteidigt. Der Autor des 1. Briefes vertrat die merkwürdige Meinung, daß das Thaborlicht mit dem menschlichen Körper Christi identisch gewesen sei (XVI). Diese Ansicht kritisierte Isaak Argyros in seinem Brief an Gedeon unter Namensnennung des Dexios, wie Mercati bereits feststellte (XXIII f.). Daß die genannten Schriften, die teils in Vat. Gr. 1111, teils in Vat. Gr. 1823 überliefert sind (XIII), auf denselben Autor zurückgehen, ist daraus zu erschließen, daß der Schreiber von Vat. Gr. 1823 in Vat. Gr. 1111 Autorenkorrekturen vornahm (XV f.). Ein wichtiger Punkt der Widerlegung Meyendorffs besteht auch darin, daß dieser die Worte des Dexios, die sich auf den Schluß des vom „seligen Gregoras“ inspirierten Glaubensbekenntnisses der Antipalamiten im Jahr 1351 beziehen, nämlich „an letzter Stelle war in ihm (dem Bekenntnis) folgendes zu lesen: ‚Hinsichtlich des Kalabrers Barlaam und des Akindynos sagen wir, daß wir damit einverstanden sind, was die heilige Kirche Gottes entschieden und festgelegt hat‘ (220), indem wir auf unseren Patriarchen verwiesen“, auf Ignatios von Antiochien, den Vorgesetzten des Arsenios, bezog, dieser schmähliche, wenn auch wohl postume Verrat an Akindynos (so unsere Meinung) aber laut P. eine Anerkennung des Tomos von 1341 bedeutet, mit dem Patriarchen demnach Kalekas gemeint ist (XX f.). P. weist nach, daß der Brief des Dexios, auf den sich Argyros in seinem Brief an Gedeon bezieht, trotz gleicher Thematik nicht mit dem von ihm herausgegeben Brief I identisch ist, sondern etwas früher (XXVI versehentlich „later“) geschrieben wurde (XXVI–XXVIII). Die Datierung der „Appellatio“ auf die Zeit zwischen 1351 und 1354 (Sturz des Kantakuzenos) ist sicherlich richtig. Da Gregoras in seinen zweiten „Antirrhetikoi“ wie Dexios von der Nichtveröffentlichung des Tomos von 1351, der Unvollständigkeit der erworbenen Abschrift wie auch von der Gefahr spricht, durch den Herrscher ermordet zu werden (s. JÖB 36, 1986, 263 f. 276), ist laut meiner Datierung (s. JÖB 27, 1978, 146, Nr. 70) 1353 als wahrscheinliches Datum der Abfassung anzusehen. P. verfaßte eine bemerkenswerte Anmerkung zu Georgios von Pelagonia (XXXI f., A. 65). Die Identifizierung des Georgios Gabrielopulos mit Georgios, dem Philosophen, geht auf R.-J. LOENERTZ und F. TINNEFELD zurück, die mögliche Identifizierung des Georgios von Pelagonia mit Gabrielopulos auf mich (s. PLP II, Nr. 3433 und Talbot in ODB II 838 f., die PLP ausschreibt). Inzwischen bin ich zu dem Schluß gekommen, daß Georgios von Pelagonia, der an Akindynos Kritik übt, auf Grund seiner guten Informiertheit kein anderer sein kann als Akindynos, der wegen seiner Voreingenommenheit gegen Barlaam im Jahr 1341 Selbstkritik übt. Akindynos stammte aus der Region von Pelagonia. Möglicherweise ist er nach seiner Flucht aus Konstantinopel 1347 mit Hilfe Stefan Dušans sogar Bischof von Pelagonia geworden. (shrink)

The statement in the second-and-third edition of Sommer's excellent Handbuch der lateinischen Laut- und Formenlehre , p. 462, that the oldest scansion is diūtius, to say nothing of the unqualified assertion in our current grammars and dictionaries that the u in it and in diutissime is long or the regrettable silence of the principal editors of Plautus upon the subject, is of itself sufficient warrant for a brief discussion. The relevant facts are these:1. In diesem Artikel wird beabsichtigt, den Verusch Gianni Vattimos zur Überwindung der ästhetisch-literischen Sicht, die heurzutage in der französischen Deutung Nietzsches vorherrscht, zu eruiern. Auf der Such nach einer renovierten Synthese dieses Bildes mid dem eines politischeren Nietzsches sucht der Autor in Batailles Denken etwas vom heidegerschen Nietzsche retten zu können, der die französische Lektüre Nietzsches bis zu den siebziger Jahren zutiefst kennzeichnet. In Batailles Begriff der Gabe findet der Kenker aus Turin eine Möglichkeit der Annäheurung an die heideggersche Geschichte (...) des Seins aus nihilistischer Sicht, als Aufwand, der zum Nichts tendiert. Diese Logik öffnet laut Vattimo auch eine Hoffnung für die menschlichen Beziehungen in einer Welt, die ihren Sinn verloren hat.The purpose of this article is to reconstruct Gianni Vattimos's attempt to overcome the aesthetic-literary view of Nietzsche that dominates current scholarship in France. Synthesizing this literary-aesthetic approach with a more political Nietzsche, the author examines Bataille's thinking in order to rescue part of the legacy of the Heideggerian Nietzsche that influence French readings until the 1970s. In his concept of Gabe, Bataille fines a way to approach the Heideggerian history of Being from the nihilistic perspective of the dépense that tends to nothingness. According to Vattimo, this logic opens up hope for human relations in a world that has lost its sense. (shrink)

Professor Bergmann is an original thinker who has for many years wrestled with some of the most important and difficult problems of philosophy. Although at first mainly interested in epistemology, he has gradually come to the conclusion that the fundamental questions of philosophy are ontological and that even epistemology is in the last analysis “the ontology of the knowing process.” He holds that by neglecting the explicit formulation of his ontology, a philosopher courts intellectual disaster because the inadequacies of the (...) ontological foundation are likely to affect all philosophical superstructures built on it. In his last book [1], Bergmann explains some of the main features of his ontology in systematic form and criticizes competing systems, especially those of Brentano and Meinong, by comparing them with his own. In the critical parts of his work he tries to show that the competing ontologies are not adequate to the tasks for which they are intended and why this is so. The constructive and the critical parts supplement each other very well, since Brentano's and Meinong's questions and emphases are similar to Bergmann's. Broadly speaking, he regards his own ontology as a phase in a development of ontological insight which consists, at least negatively, in the gradual elimination of three major errors: nominalism, reism, and representationalism. This paper gives an ethical argument for temporarily waiving intellectual property protections for COVID-19 vaccines. It examines two proposals under discussion at the World Trade Organization : the India/South Africa proposal and the WTO Director General proposal. Section I explains the background leading up to the WTO debate. Section II rebuts ethical arguments for retaining current IP protections, which appeal to benefiting society by spurring innovation and protecting rightful ownership. It sets forth positive ethical arguments for a temporary waiver that (...) appeal to standing in solidarity and holding companies accountable. After examining built-in exceptions to existing agreements and finding them inadequate, the paper replies to objections to a temporary waiver and concludes, in section III, that the ethical argument for temporarily waiving IP protection for COVID-19 vaccines is strong. This paper is a technical study of the systematic observations and computations made by Muḥyī al-Dīn al-Maghribī (d. 1283) at the Maragha observatory (north-western Iran, c. 1259–1320) in order to newly determine the parameters of the Ptolemaic lunar model, as explained in his Talkhīṣ al-majisṭī, “Compendium of the Almagest.” He used three lunar eclipses on March 7, 1262, April 7, 1270, and January 24, 1274, in order to measure the lunar epicycle radius and mean motions; an observation on April 20, (...) 1264, to determine the lunar eccentricity; an observation on August 29, 1264, to test the model; and another on March 15, 1262, for measuring the lunar parallax. In the second period of activity at the Maragha observatory, Shams al-Dīn Muḥammad al-Wābkanawī (c. 1254–1320) adopted all of al-Maghribī’s parameter values in his Zīj, but decreased his value for the mean longitude of the moon at epoch by 0;13,11∘\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$^{\circ }$$\end{document}. By comparing the times of the new moons and lunar eclipses in the period of 1270–1320 as computed from the astronomical tables of the Maragha tradition with the true modern ones, it is argued that this correction was very probably the result of actual observations. In Amartya Sen’s The Idea of Justice, democracy is necessary for the reconciliation of plural justice claims. Sen’s treatment of democracy is however incomplete and inadequate: democracy is under-specified, there are unrecognized difficulties in any context featuring deep moral disagreement or deep division and a conceptualization of public reason in the singular erodes his pluralism. These faults undermine Sen’s account of justice. Developments in the theory of deliberative democracy can be deployed to remedy these deficiencies. This deployment points to a (...) deliberative system encompassing those affected by collective decisions, with places for non-partisan forums and discursive representatives, conditionally open to multiple forms of communication, and geared to the production of workable agreements under normative and discursive meta-consensus. Democracy does not guarantee justice, but in a plural world it is essential to the pursuit of justice. (shrink)

If one holds that an engagement with tragedy is to some extent pleasurable, then one ought to recognize two distinct problems of tragedy. First, given the grim subject matter, what is the source of the pleasure in engaging with works of this genre? Second, is there some sort of affective irrationality involved in the experience? In this paper I reconsider Schopenhauer's theory of tragedy and offer a fuller reconstruction of his complex solution to these problems than has hitherto been given (...) by commentators. Next, I draw out Schopenhauer's distinctive contribution to thinking about these problems, in contrast to contemporary, more univocal solutions. Finally, I argue that the strength of Schopenhauer's complex solution lies in its recognition that our serious engagement with tragedy is a cognitively rich oscillation between feelings of humility and pride. This paper describes how some aspects of Martin Heidegger’s philosophy resonate strongly with an engineering outlook. He argued that practice was more “primordial” than theory, though preserving an important role for theoretical understanding as well, thus speaking to the gap between engineering education (highly theoretical) and engineering practice (mostly empirical). He also underlined the reality of “average” practices into which we are socialized, though affirming the potential for original work and action too, thus providing the grounds for self-actualization whether within (...) the routine or in transcending it. His notion of “thrownness” emphasizes the importance of context, with which engineers are constantly engaged. While all this relates to the idea of our “being”, Heidegger also dealt with the influence of time on our practices. Future death could be seen as spurring innovation, cultural history as a source for critiquing current practice and the present “situation” as the immediate context for corrective action. His major book is appropriately called “Being and Time”.1. (shrink)

Hegel’s basic position so far on the various meanings of evil as necessary and thereby intelligible directly in the development of spirit might be summed up as follows. Evil is always a necessary moment of instability which gives impetus in the movement from various meanings of particularity to various meanings of universality; from the more abstract expression of potential unity and truth to the more actualized notion and unity.

David Gauthier in his article, Maximization constrained: the rationality of cooperation, tries to defend of the joint strategy in situations which no outcome is both equilibrium and optimal. Prisoner’s Dilemma is the most familiar example of these situations. He first starts with some quotes by Hobbes in Leviathan; Hobbes, in chapter 15 discusses an objection by someone is called Foole, and then will reject his view. In response to Foole, Hobbes presents two strategies (i.e. joint and individual) and two kinds (...) of agents in such problems including Prisoner’s Dilemma – i.e. straightforward maximizer (SM) and constrained maximizer(CM). Then he considers two arguments respectively for SM and CM, and he will show that why in an ideal and transparent situation, the first argument fails and the second one would be the only valid argument. likewise, in the following part of his article, he considers more realistic situations with translucency and he concludes that under some conditions, joint strategy would be still the rational decision.
