Effects of globalization have amplified the magnitude and frequency of corporate abuses, particularly in developing economies where weak or absent rules undermine social norms and principles. Improving multinational enterprises’ (MNEs) ethical conduct is a factor of both the ability of firms to change behaviors in the direction of the moral good, and their willingness to do so. Constraints and enablers of a firm’s ability to act ethically emanate from the external environment, including the industry environment of which the firm is (...) a resident, and the host country environment in which it operates. A firm’s willingness to engage in ethical conduct is determined by the effective bundling of internal resources and the commitment of those resources to social ends. The interaction of external and internal conditions carves out categories of expected firm behaviors and suggests interventions that would push these behaviors in a more positive ethical direction. With reference to integrative social contracts theory (ISCT), these categories of firms are examined, and a conceptual model for analysis is developed to explain the drivers of corporate choices in the adoption and implementation of codes of conduct, and the relative power of relevant communities to the process. Abstract:Analysis of ethical conduct of business organizations has hitherto placed primary emphasis on the conduct of that corporation’s managers because ethical conduct, like all conduct, must manifest itself through individual behavior. This paper argues that in the real world corporate actions are influenced, to a considerable extent, by external market-based conditions. Therefore, a more comprehensive explanation of ethical business conduct must incorporate both corporate, i.e., internal considerations, and competitive, industry structure-based, i.e., external considerations. A framework is presented that provides a (...) systematic analysis of the interactive effect between different types of external market-based competitive conditions, institutional opportunities to engage in ethical behavior, and the likelihood that corporations would do so. The analytical framework leads to recommendations as to the types of actions that might be more effective in improving business ethical conduct under varying sets of market-based competitive conditions. We discuss the rules-based and principles-based remedies that have been proposed in each region, respectively. With a focus on the U.S. Sarbanes-Oxley Act (SOA), we examine the principles forwarded by this act, and how it addresses those principles with specific rules and governance mechanisms. This paper examines the influences on differential behaviors of multinational enterprises (MNEs) with respect to the adoption and implementation of voluntary codes of conduct in their host country operating environments. Both external institutional and internal leadership and organizational culture factors are offered as those conditions that are expected to predict the respective ability and willingness of firms to conduct their operations in socially responsible ways. A framework for furthering research in this area is developed.

This paper examines the association between level of economic development and corporate social responsibility (CSR) in a country, with speculations on howadvances in economic development may alter the scope and application of CSR activities. Through the empowerment of local communities and the intersection of ethical leadership approaches of business, local governments and civil society, remedies are suggested for improved economic development management.

This paper examines the advent of the Web as a critical media tool in the promotion and sale of goods to consumers and the ethical questions it raises that are issues of public policy. We examine four traditional ethical rationales that guide organizational decision-making – utilitarianism, distributive justice, moral rights of man and relativism, further characterized as "ends-based", "equity-based", "rules-based" and "comparison-based" rationales – and we apply them to four moral dilemmas attributed to the proliferation of dot.com companies as they (...) relate to consumer welfare. We find that ethical rationale in the New Media is largely non-existent, and where it exists, it is primarily reactive and driven by utilitarian or relativistic reasoning. We attribute this condition to the newness of the industry and to its economic context, representing, as it does, many characteristics embodied in the concept of the "perfect market." Fairtrade-certified products are sold through retailers to consumers who are willing to pay a premium in exchange for assurances that products were produced under acceptable working and environmental conditions, and that farmers were paid a fair market price. While touted as a positive social innovation, the Fairtrade movement has invited critical scrutiny and in its wake, suggestions for improvements in terms of sustainability, transparency, and tangible benefits for producers subsisting in Base of Pyramid markets. In this paper, we uncover the (...) debate swirling around Fairtrade and stipulate as to the theoretical reasoning for why the system should work and why it can fail. Focusing on the coffee industry, a case study of a socially responsible coffee roaster in Kansas City illustrates one of the alternative business models we discuss that seeks to solve the same problems addressed through Fairtrade, albeit through different producer-buyer relationships. As the debate over the value of microfinance institutions intensifies, it remains apparent that microfinance may, at the very least, be considered as one tool in the arsenal of the war against poverty in base of pyramid markets. Given the variety of actors in the microfinance arena, stakeholders have placed a relatively new emphasis on performance reporting for MFIs, allowing comparisons and identifications of performance gaps. One result of this scrutiny is an increased importance placed on MFIs’ social performance, with (...) an eye to understanding measures of MFIs’ intent, process, and results in the social realm—in addition to their financial sustainability. While a number of factors may explain differences in social performance, in this paper we take a close look at a particular factor that may have a positive relationship with social performance—that of an MFI’s religious affiliation or religiosity. Using archival data, we derived three sets of randomly paired samples, pairing religious MFIs with non-religious ones, and compared social performance indicators derived from the literature across the samples. We sought to understand whether religiously-affiliated MFIs would, in fact, demonstrate stronger social performance intent, wider social performance reach via service delivery processes, and better social performance outcomes in BoP markets. Statistical analysis provided preliminary evidence that religiously-affiliated MFIs display stronger social performance, suggesting new avenues for future research. (shrink)

Multinational corporations' international staffing policies have been evaluated in terms of cost and efficiency arguments. Research has not addressed, however, the ethical impact of these policies on diverse stakeholder groups. This paper presents a conceptual framework by which ethnocentric, polycentric and geocentric staffing policies are theoretically linked to underlying decision-making modes of instrumentality, bounded rationality and economic rationality, respectively. It goes on to describe the ethical rationales associated with each policy type, namely, distributive justice, moral rights of man, and utilitarianism. (...) An investigation of resulting ethical dilemmas affecting relevant MNC stakeholder groups is incorporated and offered as a tool for analyzing the true and full costs of trade-offs when choosing one policy over another. This article draws on resource‐based theory and the literature on strategic intent to develop a theoretical model that explains the concept of mission drift in microfinance institutions . We argue that the differential strategic intents of commercially oriented, for‐profit, and socially oriented nonprofit organizations drive the acquisition of disparate resources and capabilities, which in turn drives distinct performance outcomes, including a focus on different markets within the overall base of the pyramid . The article suggests that it is the dynamic (...) aspects of changing strategic intent and the consequent timing delays in the development of associated resources and capabilities that lead to various issues of mission drift. Finally, we suggest that cross‐sector alliances between for‐profit and nonprofit MFIs may benefit from the unique capabilities of both types of organizations and deliver the most and broadest impact on poverty alleviation in BOP markets. Africa, before European colonization, knew no other form of legal system outside customary arrangements. Based on secondary sources and a primary survey conducted between 2009 and 2010 on the situation of women and land rights in anglophone Cameroon, this paper examines the grounds for discrimination in customary laws against women's rights to land in the context of legal pluralism, and discusses the implications of this custom of gender discrimination. In drawing from Cameroon as an exemplar, it concludes that the strong (...) influence and impact of customs on current land tenure systems have global implications on women's land rights, food security and sustainable development, and that gender equality in land matters can be possible only where the critical role of ethics is recognized in pursuit of the economic motive of land rights. Este artículo aborda la cuestión de la visibilidad del samā‘ en la literatura de los manāqib, los diccionarios biográficos, los manuales de sufismo y la producción jurídica del Magreb de los siglos VII/XIII a X/XVI. Se examinan las formas atestiguadas de esta práctica, en los madyanī, šāḏilī, rifā‘ī y los ‘Arūsiyya-Salāmiyya, en los círculos literarios de Túnez, Qairawān, el litoral de Ifrīqiya y el área tripolitana. Se explora la gran variedad de posicionamientos de los juristas magrebíes con respecto a esta (...) práctica, así como los intentos de dilucidar, por parte de las autoridades sufíes, los fundamentos escriturales, doctrinales y éticos del ḏikr y el samā‘ que han jalonado los procesos de codificación de estas dos prácticas. A pesar de la desconfianza generada por las «innovaciones», consideradas blasfemas y estigmatizadas por algunos šayjs que recomendaban la supresión de estas prácticas, percibimos más bien una intención de regular, de prevenir, más que de prohibir dichas prácticas. El samā‘, más allá de las palabras utilizadas para designarlo, parece ser una práctica dotada de una gran capacidad de resistencia; su importancia atestigua su resonancia en las experiencias de santidad en el Magreb a lo largo de la Edad Media. All individual terms listed as jāti-s (sophisticated ripostes) in Nyāyasūtra V a 1 have the peculiar uniform ending -sama. The interpretation of this ending here reveals a greater nuance of meaning than the hitherto customary understanding of it. It will be demonstrated that the observable semantic difference is due to a historical shift of signification as a result of an enlarging and systematizing of the thematic group of jāti-s. In this paper, I examine relevant text material, including two very important (...) manuscripts of the Nyāyabhṣya to show this semantic difference. The understanding gained by this analysis will help to trace the historical development of the complex of jāti-s within the larger context of the ancient Indian tradition of debate. (shrink)

This article engages in a dialogue between the African philosophy of Ubuntu (humanity bound up in the other) and the Korean philosophy of Samae (love bound up in the other) to advocate for the emergence of a philosophy of agapeic humanism. Some structures (laws, standards, conventions, protocol and institutions), ideologies, ethics and socio-cultural practices of indigenous African communities have particularistic, exclusive, egocentric and discriminatory strains that are in contradiction to communalism and its principles upon which the traditional African world-view (...) is claimed to be founded. For instance, in indigenous Igbo communities in Africa, double standards are applied in their treatment of in-groups and out-groups, and their religious and moral codes cannot be invoked for an offence committed by an in-group member against an outsider (an out-group member), thus making such ethics and practices trans-communally/racially inapplicable and therefore non-universalisable. The article employs analytical, critical and comparative fusion methods to approach particularism in traditional Africa communities. While the analytical method facilitates the theorisation of Ubuntu and Samae, the critical approach critiques prevailing, narrowly defined conceptions of humanism prevalent among the Igbo people of Nigeria. Through the method of comparative fusion, the article integrates elements of Ubuntu and Samae to propose the concept of agapeic humanism. It concludes that the interchange between African and Asian philosophies holds the promise of transcending particularistic limitations within the current humanistic paradigm, thereby fostering new perspectives on shared humanity rooted in practical agape love. Focusing on changes in the notion of ‘dance’ or physical motion as a consequence of contemplation and ecstasy, it also examines its quality as a means to obtain this state. This is preceded by some remarks on the terms ‘dance’ in Arabic, Persian and Turkish, and a brief discussion of the difficulties (...) of research dealing with medieval dance, primarily in the Turkish context. Many contemporary philosophers, especially the \"post-modern ones,\" claim that analytical philosophy has committed self-destruction by undermining the position of cognitive realism and questioning its main pillars: theory of objective reference of expressions and correspondential theory of truth. One of such philosophers is Rorty, an indefatigable critic of the conception of \"right representations,\" a concept that - according to him - is \"an empty compliment which we pay to helpful beliefs while realising our intentions.\" In order to support his nihilistic position, (...) Rorty many times refers to Quine. In my paper I seek to answer the question whether Rorty\'s and the views of other post-modern philosophers can be supported by Quine\'s philosophical conceptions. Analysing some selected trends of his philosophy, in particular the thesis about indeterminacy of reference (ontological relativity), I seek to prove that - contrary to Rorty\'s claim - Quine did not devalue the idea of objective reference. I also prove that the semantic concept of truth as relativised to the model of language plays in Quine\'s epistemology an equally essential role to the role of the immanent concept of truth as \"disquotational.\" The former is closer to the correspondential conception of truth. The conclusions which Rorty draws from the conception of Quine are rash, and sometimes they are an outcome of biased interpretation. (shrink)

Die Begriffe "Erscheinung" und "Ding an sich" wurden im Laufe der Zeit vielmals interpretiert und wohl so oft mißinterpretiert. Der Hauptgrund der falschen Interpretationen von den obiegen Begriffen scheint ihr platonischer oder eher von Plato inspirierter Charakter za sein. Darunter verstehe ich eine solche Auslegung der Beziehung "Erscheinung" – "Ding an sich", in der sie als der Schein und die reale Wirklichkeit im Gegensatz zueinander stehen. Zu den wichtigsten und gleichzeitig konfusesten Texten von Kant, die er dem Problem gewidmet hat, (...) gehört der Kapitel von der "Kritik der reinen Vernunft": "Phaenomena und Noumena". Meine Arbeit ist ein solcher Analyse – und Interpretationsversuch von diesem Fragment, der einerseits den für die beiden Redaktionen (von der A und B Kritikausgabe) gemeinsamen und gleichzeitig den fundamentalen Sinn der Kantschen Lehre über "Erscheinung" und "Ding an sich" hervorhebt und vorstellt, andrereseits andere von Plato inspiriete Auffassungen dieses Problems als unberechtigt ablehnt.
