德沃金一生的法政哲學工作，旨在發展一套「法律作為政治道德的次部門，從而也是道德的次領域」的理論。從上世紀六、七〇年代奠基於規則／原則區分而批判哈特法實證主義，堅持法律與道德之間的必然連結，到八〇年代提 出整全法（law as integrity），展開對描述主義法理學之批判之後，德沃金也漸次開展其以平等為基礎的自由主義理論，從九〇年代起不斷出版一部部重要政治哲學著作。同一期間德沃金也積極參與美國重大社會與法律議題之論辯，從 早期越戰期間拒服兵役、美國聯邦最高法院法官提名問題，到墮胎及安樂死判決、猥褻言論管制，再到本世紀的911後反恐政策、稅制與健保議題等，德沃金在各個具體問題中充分實踐了他自己的法律理論。 2008年德沃金獲邀來台擔任首屆「雷震民主人權紀念講座」。本書收錄了當時國內社群的相關研究，以及後來謝世民教授關於德沃金法政哲學的重要闡釋與分析。不僅作者在國內學界皆屬一時之選，其德沃金研究也對我們理 解德沃金思想極有助益。這些文章不僅對德沃金理論有相當深刻的掌握，也將是台灣未來研究探索法理學與政治哲學的重要指南.

Increasing gender diversity in the boardroom has been promoted as a way to enhance corporate governance and risk management. This study empirically examines whether boards with more female directors play a role in reducing R&D risk. We first show that female directors help to reduce the positive relationship between R&D investment and future performance volatility. We then report that firms with more gender-diverse boards exhibit a lower adverse effect of R&D on the cost of debt. These results are robust to (...) endogeneity analysis, alternative measures of gender diversity and risky investment, and other sensitivity tests. Overall, our results suggest that female directors improve board effectiveness in risk management with respect to R&D investment. (shrink)

This paper proposes a new Bayesian confirmation theory, according to which confirmational relations are causal relations between credences. The idea is that proposition E is evidentially relevant to proposition H relative to a credence distribution cr just in case cr(E) is a cause of cr(H), which is understood from an interventionist perspective as intervening on cr(E) would make a difference to the value of cr(H). E confirms H means that under an intervention on cr(E), cr(H) and cr(E) would covary in (...) the same direction; disconfirmation means that they would covary in the opposite direction. I argue that this causal theory explains how orthodox Bayesian theory succeeds in non-extreme credences and fails in extreme credences, the latter known as “the old evidence problem”. Furthermore, the causal theory provides a solution to the old evidence problem that avoids serious problems faced by some other solutions. Ultimately, the causal theory of confirmation subsumes orthodox Bayesian theory as a special-case application to non-extreme credences. (shrink)

Traffic congestion is a common problem in many countries, especially in big cities. At present, China’s urban road traffic accidents occur frequently, the occurrence frequency is high, the accident causes traffic congestion, and accidents cause traffic congestion and vice versa. The occurrence of traffic accidents usually leads to the reduction of road traffic capacity and the formation of traffic bottlenecks, causing the traffic congestion. In this paper, the formation and propagation of traffic congestion are simulated by using the improved medium (...) traffic model, and the control strategy of congestion dissipation is studied. From the point of view of quantitative traffic congestion, the paper provides the fact that the simulation platform of urban traffic integration is constructed, and a feasible data analysis, learning, and parameter calibration method based on RBF neural network is proposed, which is used to determine the corresponding decision support system. The simulation results prove that the control strategy proposed in this paper is effective and feasible. According to the temporal and spatial evolution of the paper, we can see that the network has been improved on the whole. (shrink)

In the team context, leaders usually develop differentiated leader-member exchange relationships with employees, resulting in some employees having relatively inferior relationships with the leader than others. Nevertheless, how and when employees with low relative leader-member exchange (RLMX) relationships react toward the leader have been rarely considered in empirical research. Drawing upon social comparison theory, we develop a cross-level moderated mediation model to examine how and when RLMX may lead to employee’s unethical pro-leader behavior (UPLB). We propose that employees with low (...) RLMX would feel envy which in turn motivates them to engage in UPLB in order to gain the rewards and resources that are distributed by the leader. Further, we argue that envy is less likely to motivate low RLMX employees to engage in UPLB when distributive justice climate is high, because high distributive justice indicates that rewards and resources are distributed fairly (based on work contribution rather than engaging in unethical behaviors that please the leader). Data were obtained from 504 employees in 102 divisional teams in a large retail corporation at three time points. Results of the multilevel moderated mediation analysis show that envy mediates the effect of RLMX on UPLB and that the indirect relationship is moderated by team-level distributive justice climate. These findings suggest the importance of adopting a social comparison perspective to understand the negative consequences of RLMX via emotional mechanisms. (shrink)

The disposition effect refers to the tendency of investors to sell winners too early and hold on to losers too long, which is one of the most documented and robust decision biases. However, few studies have looked beyond demographic and social factors on the disposition effect. The current study investigated the association between financial self-efficacy (one’s belief about their personal capability in ultimate financial goals achieving), versatile cognitive style (an individual’s capability in deploying the experiential or rational mode in ways (...) that are contextually appropriate), and the disposition effect. A total of 285 employees from finance-related business completed anonymous questionnaires regarding financial self-efficacy, rational-experiential inventory, and the disposition effect. Our findings revealed that financial self-efficacy was significantly and positively associated with versatile cognitive style and the disposition effect. Further, versatile cognitive style partially mediated the relationship between financial self-efficacy and the disposition effect. Our findings provide valuable guidance for individual investors to make financial decisions based on their characteristics. (shrink)

Irresponsible research practices damaging the value of science has been an increasing concern among researchers, but previous work failed to estimate the prevalence of all forms of irresponsible research behavior. Additionally, these analyses have not included articles published in the last decade from 2011 to 2020. This meta-analysis provides an updated meta-analysis that calculates the pooled estimates of research misconduct and questionable research practices, and explores the factors associated with the prevalence of these issues. The estimates, committing RM concern at (...) least 1 of FFP and QRPs concern 1 or more QRPs, were 2.9% and 12.5%, respectively. In addition, 15.5% of researchers witnessed others who had committed at least 1 RM, while 39.7% were aware of others who had used at least 1 QRP. The results document that response proportion, limited recall period, career level, disciplinary background and locations all affect significantly the prevalence of these issues. This meta-analysis addresses a gap in existing meta-analyses and estimates the prevalence of all forms of RM and QRPs, thus providing a better understanding of irresponsible research behaviors. China has a longstanding tradition of stressing the values of harmony and coherence, and Chinese society has often been portrayed as a culture in which conflict avoidance is viewed more positively than direct confrontation and argumentation. In order to evaluate the validity of this claim, this paper sketches Chinese people’s feelings and understandings about interpersonal arguing by reporting results of a data collection in China, using measures of argumentativeness, verbal aggressiveness, argument frames, and personalization of conflict. These results were compared (...) to those from a US sample. Chinese and US data differed in complex ways, but did not show Chinese respondents to be more avoidant. The Chinese correlations among variables were a reasonable match to expectations based on Western argumentation theories, although they did not replicate the US results precisely. The paper offers evidence that Chinese respondents had a more sophisticated understanding of interpersonal arguing than their US counterparts, and were more sensitive to the constructive possibilities of face-to-face disagreement. This study examines the role of responsible entrepreneurship among female entrepreneurs by examining how and when responsible entrepreneurship may exert a positive influence on female entrepreneurial success. Using the data collected from 337 Chinese female entrepreneurs, and by integrating responsible entrepreneurship research with a dynamic capability framework, our findings show, firstly, that responsible entrepreneurship is positively correlated to female entrepreneurial success; secondly, this relationship is mediated by female entrepreneurs’ opportunity recognition; and thirdly, the indirect effect of responsible entrepreneurship on female (...) entrepreneurial success through opportunity recognition is weaker when women entrepreneurs perceive more gender discrimination. Furthermore, using a post hoc analysis, we find that responsible entrepreneurship has a positive impact on entrepreneurial success for both male and female entrepreneurs, but that this impact is more significant for female entrepreneurs than for their male counterparts. With the contextual factor of traditional female social stereotypes inadvertently contributing to greater gender discrimination in the field of entrepreneurship, our results underscore the importance of both responsible entrepreneurship and opportunity recognition in promoting female entrepreneurial success. The extent to which we generalize a novel property from a sample of familiar instances to novel instances depends on the sample composition. Previous property induction experiments have only used samples consisting of novel types (unique entities). Because real‐world evidence samples often contain redundant tokens (repetitions of the same entity), we studied the effects on property induction of adding types and tokens to an observed sample. In Experiments 1–3, we presented participants with a sample of birds or flowers known to (...) have a novel property and probed whether this property generalized to novel items varying in similarity to the initial sample. Increasing the number of novel types (e.g., new birds with the target property) in a sample produced tightening, promoting property generalization to highly similar stimuli but decreasing generalization to less similar stimuli. On the other hand, increasing the number of tokens (e.g., repeated presentations of the same bird with the target property) had little effect on generalization. Experiment 4 showed that repeated tokens are encoded and can benefit recognition, but appear to be given little weight when inferring property generalization. We modified an existing Bayesian model of induction (Navarro, Dry, & Lee, 2012) to account for both the information added by new types and the discounting of information conveyed by tokens. (shrink)

Deception is common in the marketplace where individuals pursue self-interests from their perspectives. Extant research suggests that perspective-taking, a cognitive process of putting oneself in other’s situation, increases consumers’ ethical tolerance for marketers’ deceptive behaviors. By contrast, the current research demonstrates that consumers who take the dishonest marketers’ perspective become less tolerant of deception when consumers’ moral self-awareness is high. This effect is driven by moral self-other differentiation as consumers contemplate deception from the marketers’ perspective: high awareness of the “moral (...) self” motivates consumers to distance themselves from the “immoral other.” The findings shed new light on how self-morality can vicariously shape social consideration in ethical judgments. Objective: Work stress is one of the urgent public health problems, which has aroused wide attention. In addition, work stress also has a negative impact on the development of enterprises. This study has three purposes: to understand the current status of working stress among couriers, to examine the association between work stress, job satisfaction and sleep quality of Chinese couriers, and to verify the mediating role of psychological capital.Methods: A cross-sectional survey was conducted among 3000 couriers in Beijing of China (...) from January to December 2019 using cluster stratified random sampling. Descriptive statistical analysis was used to describe demographic characteristics of respondents. Pearson correlation analysis was used to analyze the correlation among work stress, job satisfaction, sleep quality, and psychological capital. The mediating analysis was calculated role of psychological capital.Results: A total of 2831 participants were included in this study. The average score of work stress was 2.49 ± 0.76. Work stress was negatively correlated with job satisfaction, sleep quality, and psychological capital, respectively. The direct effect of work stress on job satisfaction is –0.223, and the total effect of work stress on job satisfaction is –0.267. The a*b*c’ is positive, indicating the mediating role psychological capital has in explaining the relationship between couriers’ work stress and job satisfaction. Moreover, psychological capital plays a mediating role between work stress and sleep quality among couriers.Conclusion: Couriers face certain work stress and should be paid attention to and psychological capital can effectively alleviate the work stress of couriers, so measures can be taken to improve it, promoting healthy development of employees and organizations. In the last 20 years, amid extensive social and economic reforms, China’s social structure and community life have changed considerably. A large number of social workers are needed to provide many more social services to community residents. The central government has issued many policies to rapidly develop human service organizations and increase the number of social workers. Thus, by the end of 2019, the number of social workers has reached more than 1.5 million in China. At the same time, local (...) governments have issued many policies to promote an increase in the number of social workers. According to statistics from the Chengdu Civil Affairs Bureau, from 2010 to 2021, the number of social workers in Chengdu City increased, remarkably, from 553 to 17,622. Although the number of social workers has increased rapidly, some problems still exist. According to a survey by the Chengdu Social Workers Association, the turnover rate of social workers has reached approximately 20% in Chengdu City in 2018. Therefore, we aim to determine what influences social workers’ job burnout. Through regression analysis and mediation effect tests, we found the following: First, when controlling for gender, age, education, and workday, social support of social workers had a significant negative impact on job burnout. Second, the mindfulness of social workers had a significant negative impact on job burnout. Third, the mindfulness of social workers played a mediating role between social support and job burnout. The mediating effect was −0.116. Fourth, among the three dimensions of social support, mindfulness played a partially mediating role in family support and other support. The mediating effect between other support, which is the support from leaders and colleagues, and job burnout was the strongest, with a mediating effect of −0.109. In other words, the support provided by agency leaders and colleagues can maximize the level of mindfulness of social workers, thereby reducing social workers’ job burnout most effectively. We can thus reduce social workers’ job burnout by improving their level of mindfulness and the social support for them in China. (shrink)

Simpson’s paradox (SP) is a statistical phenomenon where the association between two variables reverses, disappears, or emerges, after conditioning on a third variable. It has been proposed (by, e.g., Judea Pearl) that SP should be analyzed using the framework of graphical causal models (i.e., causal DAGs) in which SP is diagnosed as a symptom of confounding bias. This paper contends that this confounding-based analysis cannot fully capture SP: there are cases of SP that cannot be explained away in terms of (...) confounding. Previous works have argued that some cases of SP do not require causal analysis at all. Despite being a logically valid counterexample, we argue that this type of cases poses only a limited challenge to Pearl’s analysis of SP. In our view, a more powerful challenge to Pearl comes from cases of SP that do require causal analysis but can arise without confounding. We demonstrate with examples that accidental associations due to genetic drift, the use of inappropriate aggregate variables as causes, and interactions between units (i.e., inter-unit causation) can all give rise to SP of this type. The discussion is also extended to the amalgamation paradox (of which SP is a special form) which can occur due to the use of non-collapsible association measures, in the absence of confounding. This paper is to argue that conductive arguments could be understood from a rhetorical perspective. It contends that conductive arguments can be regarded as a particular mode of strategic maneuvering, rather than a new type of argument. Moreover, it demonstrates that the use of conductive arguments can be adequately analyzed and evaluated by adopting the theoretical tools developed in the extended Pragma-Dialectics.

Argument by analogy has long been regarded as the characteristic way of arguing in ancient Chinese culture. Classic Chinese philosophers not only prefer to use analogy to argue for their own views, but also take efforts to theorize it in a systematic way. This paper aims to provide a careful study on the relevant ideas in ancient China in order to reconstruct the ancient Chinese theory of argument by analogy, and then to reveal some of its distinctive features through a (...) comparison with the Western counterpart account as developed by Aristotle. It is indicated that in ancient China analogical argument was conceived primarily as a way of arguing based on classification, with a unique mechanism of taking and giving according to kind. On that basis, it is argued that although such a characterization captures the logical structure of analogical argument in a similar way to Aristotle, the ancient Chinese theory stresses the foundational role of a particular notion of kind, thus makes the construction and application of analogical arguments become highly flexible and context-sensitive. Moreover, it is also contended that in ancient China the rationale of analogical arguments is explained from a general perspective of kind, relying upon the universal knowledge pertaining to the forming of kinds. Then it is further revealed that, unlike Aristotle who emphasizes the causal links between attributes in the physical world, ancient Chinese thinkers justify analogical argument by appealing to some normative metaphysical and epistemological principles. However, in recent years, with the rapid development of emerging industries and industry changes, the turnover rate of employees in the whole enterprise has been greatly improved. Frequent turnover of personnel will have a great impact on the stability of the company, the competitiveness of the enterprise, and the operating cost. Employee loyalty (...) and corporate culture satisfaction assessment is the core of sustainable corporate development, but most of the traditional analysis studies are based on the performance approach, using employee overtime, employee achievement, and company effectiveness as data sources, the former performance data is only a side view of the company’s situation, the latter as the data source of this study is a one-sided and involute form, and the data is not stable. Therefore, this paper proposes an analysis of employee loyalty and corporate culture satisfaction assessment based on sentiment analysis, using association rules and sentiment lexicons from anonymous employee evaluations to analyze the actual data. Corruption as a non-market strategy for firms has gained increasing attention in the field of strategy management. However, the effect of corruption on innovation is unclear, especially in the context of transition economies. Using institutional theory, we examine the relationship between corruption and new product innovation and identify the contextual conditions of the relationship. Using the World Bank Enterprise Survey data from China, our empirical results show that corruption has a positive effect on firms’ new product innovation. Moreover, we find (...) that policy instability and competitive threats from the informal sector positively moderate the relationship between corruption and new product innovation. Using post hoc analysis, we find that the potentially positive effect of corruption on new product innovation is the consequence of inherent institutional weaknesses in transition economies; as the level of institutional development increases, the effect of corruption on firms’ new product innovation will gradually decrease. Overall, our findings provide new insights into understanding corrupt behaviors in transition economies and present managerial implications for firms’ ethical dilemmas in a transition economy context. We argue that the key to overcoming these ethical dilemmas lies in promoting pro-market institutional reform to reduce the potential benefits of corruption. (shrink)

Discourse connection is a challenging aspect of writing in a second language. This study seeks to investigate the effects of two classroom instructions on discourse connection in writing for EFL college students, focusing on their argumentative writing. Three classes were exposed to different pre-task conditions: receiving reading materials that provide content support for the writing, receiving planning instructions on effective outlining, and receiving no resources. The results showed that the instructions helped students attain better overall coherence in writing. However, noticeable (...) differences between the two experimental groups emerged in terms of cohesion features. The reading group was found to employ more lexical cohesion devices in writing than the outline group, which indicated a heightened genre awareness. This inquiry helped us identify the reading group’s alignment with content support materials, particularly the change in stance as a factor that contributes to a higher level of lexical cohesion in writing. This study examines the spontaneous use of embodied egocentric transformation in understanding false beliefs in the minds of others. EET involves the participants mentally transforming or rotating themselves into the orientation of an agent when trying to adopt his or her visuospatial perspective. We argue that psychological perspective taking such as false belief reasoning may also involve EET because of what has been widely reported in the embodied cognition literature, showing that our processing of abstract, propositional information is often grounded (...) in concrete bodily sensations which are not apparently linked to higher cognition. In Experiment 1, an agent placed a ball into one of two boxes and left. The ball then rolled out and moved either into the other box or back into the original one. The participants were to decide from which box they themselves or the agent would try to recover the ball. Results showed that false belief performance was affected by increased orientation disparity between the participants and the agent, suggesting involvement of embodied transformation. In Experiment 2, false belief was similarly induced and the participants were to decide if the agent would try to recover the ball in one specific box. Orientation disparity was again found to affect false belief performance. The present results extend previous findings on EET in visuospatial perspective taking and suggest that false belief reasoning, which is a kind of psychological perspective taking, can also involve embodied rotation, consistent with the embodied cognition view. In recent years, due to factors such as rising sea levels, several island nations such as Maldives, Tuvalu, Kiribati, and the Marshall Islands are in danger of disappearing completely. When the land of an island country disappeared, the human rights protection of Environmentally Displaced Persons in the migration process and the possible loss of their unique culture, language, and lifestyle have aroused great concern. We call such Environmentally Displaced Persons as EDPs. This study selects the EDPs’ data of 241 countries (...) or regions from 2008 to 2018, establishes an ARIMA model, and predicts the future population of EDPs. By combining the influencing factors of cultural loss, the risk assessment model of cultural loss is established to evaluate the possibility of cultural loss during the migration process of EDPs. We have established a Bayesian Network and a Fault Tree Model to demonstrate the improvement brought about by the implementation of policy recommendations from both qualitative and quantitative perspectives and use the method of fault tree analysis to illustrate the importance of policies from the degree of probability reduction after policy changes. Finally, based on the above model establishment and data analysis, corresponding countermeasures are proposed to protect EDPs’ human rights from being violated and their culture will not be lost. Demnach wird die Hauptfrage der kantischen Metaphysik als die Frage nach der Möglichkeit der Erkenntnis von den übersinnlichen Prinzipien der Natur bestimmt. Die Grundmethode zur Kants Antwort auf diese Frage bezeichnet der Autor als „praktische Regulation der Natur“, in der die reine praktische Vernunft ihrem notwendigen Bedürfnis gemäß die reflektierende Urteilskraft dazu leitet, nach (...) dem System der praktisch postulierten Prinzipien (Gott, Freiheit und Unsterblichkeit) eine moralisch-zweckmäßigen Natur zu regulieren. Durch dieses methodische Verfahren zeichnet sich die kantische Metaphysikkonzeption aus, die ihrerseits aber auch auf die aristotelische Tradition zurückbezogen ist. Yuwei Xie promovierte in Philosophie an der Universität Heidelberg und arbeitet derzeit am Philosophischen Seminar der Sun Yat-sen Universität in Guangzhou, China. There are generally two controversial issues over Kant's solution to the free will problem. One is over whether he is a compatibilist or an incompatibilist and the other is over whether his solution is a success. In this paper, I will argue, regarding the first controversy, that “compatibilist” and “incompatibilist” are not the right terms to describe Kant for his unique views on freedom and determinism; but that of the two, incompatibilist is the more accurate description. Regarding the second controversy, (...) I will argue that Kant's solution to the free will problem is not a success because his effort in making the effects of freedom part of the field of appearance has made his solution incoherent and ambiguous. Despite this, I argue that Kant's attempt to solve the free will problem is groundbreaking because he at least has separated freedom from the dominance of determinism. (shrink)

In contextual cueing, previously encountered context tends to facilitate the detection of the target embedded in it than when the target appears in a novel context. In this study, we investigated whether the contextual cueing could develop at early time when the search display was presented briefly. In four experiments, participants searched for a target T in an array of distractor Ls. The results showed that with a rather short presentation time of the search display, participants were able to learn (...) the spatial context and speeded up their response time overall, with the learning effect lasting for a long period. Specifically, the contextual cueing effect was observed either with or without a mask after a duration of 300-ms presentation of the search display. Such a context learning under rapid presentation could not operate only with the local context information repeated, thus suggesting that a global context was required to guide spatial attention when the viewing time of the search display was limited. Overall, these findings indicate that contextual cueing might arise at an “early,” target selection stage and that the global context is necessary for the context learning under rapid presentation to function. An enormous challenge facing China is how to provide sustainable care for its rapidly-increasing elderly population. Its recent policy directives include three medical forms—the institution-cooperation-form, the institution-medical-form, and the family-physician-form—to integrate medical care into ordinary care for the elderly. This essay indicates that China will not be able to maintain sustainable elderly care unless it places emphasis on the family-physician-form that focuses on family physicians and the use of primary care services. I distinguish two types of ethical efforts. One of them can be called ideological efforts in morality, which begins with the quest for truth. Once in possession of the truth, people can make moral laws and apply them to a society, demanding that all members of the society abide by them. The other may be called sentimental education, which depicts the formation of morality as being based on sentiments in this way: people live in an intimate relationship to foster a (...) sentiment of trust, develop their propriety sense in regard to a certain relationship, and formulate it as a moral law. In the context of global ethics, I hold that the fundamental momentum in morality is driven by sentimental education, while ideological efforts in morality can only play a complementary role. The globalization in business and tourism becomes crucial more and more for the economical sustainability of local communities. In the presence of an epidemic outbreak, there must be such a decision on the policy by the host community as whether to accept visitors or not, the number of acceptable visitors, or the condition for acceptable visitors. Making use of an SIRI type of mathematical model, we consider the influence of visitors on the spread of a reinfectious disease in a community, (...) especially assuming that a certain proportion of accepted visitors are immune. The reinfectivity of disease here means that the immunity gained by either vaccination or recovery is imperfect. With the mathematical results obtained by our analysis on the model for such an epidemic dynamics of resident and visitor populations, we find that the acceptance of visitors could have a significant influence on the disease’s endemicity in the community, either suppressive or supportive.
