ABSTRACT This paper is intended to stimulate debate amongst stakeholders in the international research community on the topic of returning individual genetic research results to study participants. Pharmacogenetics and disease genetics studies are becoming increasingly prevalent, leading to a growing body of information on genetic associations for drug responsiveness and disease susceptibility with the potential to improve health care. Much of these data are presently characterized as exploratory (non‐validated or hypothesis‐generating). There is, however, a trend for research participants to be (...) permitted access to their personal data if they so choose. Researchers, sponsors, patient advocacy groups, ethics committees and regulatory authorities are consequently confronting the issue of whether, and how, study participants might receive their individual results. Noted international ethico‐legal guidelines and public policy positions in Europe and the United States are reviewed for background. The authors offer ‘Points‐to‐Consider’ regarding returning research results in the context of drug development trials based on their knowledge and experience. These considerations include: the clinical relevance of data, laboratory qualifications, informed consent procedures, confidentiality of medical information and the competency of persons providing results to participants. The discussion is framed as a benefit‐to‐risk assessment to balance the potential positive versus negative consequences to participants, while maintaining the integrity and feasibility of conducting genetic research studies. Connecting human minds to various technological devices and applications through brain-computer interfaces (BCIs) affords intriguingly novel ways for humans to engage and interact with the world. Not only do BCIs play an important role in restorative medicine, they are also increasingly used outside of medical or therapeutic contexts (e.g., gaming or mental state monitoring). A striking peculiarity of BCI technology is that the kind of actions it enables seems to differ from paradigmatic human actions, because, effects in the world are (...) brought about by devices such as robotic arms, prosthesis, or other machines, and their execution runs through a computer directed by brain signals. In contrast to usual forms of action, the sequence does not need to involve bodily or muscle movements at all. A motionless body, the epitome of inaction, might be acting. How do theories of action relate to such BCI-mediated forms of changing the world? We wish to explore this question through the lenses of three perspectives on agency: subjective experience of agency, philosophical action theory, and legal concepts of action. Our analysis pursues three aims: First, we shall discuss whether and which BCI-mediated events qualify as actions, according to the main concepts of action in philosophy and law. Secondly, en passant, we wish to highlight the ten most interesting novelties or peculiarities of BCI-mediated movements. Thirdly, we seek to explore whether these novel forms of movement may have consequences for concepts of agency. More concretely, we think that convincing assessments of BCI-movements require more fine-grained accounts of agency and a distinction between various forms of control during movements. In addition, we show that the disembodied nature of BCI-mediated events causes troubles for the standard legal account of actions as bodily movements. In an exchange with views from philosophy, we wish to propose that the law ought to reform its concept of action to include some, but not all, BCI-mediated events and sketch some of the wider implications this may have, especially for the venerable legal idea of the right to freedom of thought. In this regard, BCIs are an example of the way in which technological access to yet largely sealed-off domains of the person may necessitate adjusting normative boundaries between the personal and the social sphere. To commemorate 40 years since the founding of the Journal of Business Ethics, the editors in chief of the journal have invited the editors to provide commentaries on the future of business ethics. This essay comprises a selection of commentaries aimed at creating dialogue around the theme Ethics at the centre of global and local challenges. For much of the history of the Journal of Business Ethics, ethics was seen within the academy as a peripheral aspect of business. However, in (...) recent years, the stakes have risen dramatically, with global and local worlds destabilized by financial crisis, climate change, internet technologies and artificial intelligence, and global health crises. The authors of these commentaries address these grand challenges by placing business ethics at their centre. What if all grand challenges were framed as grand ethical challenges? Tanusree Jain, Arno Kourula and Suhaib Riaz posit that an ethical lens allows for a humble response, in which those with greater capacity take greater responsibility but remain inclusive and cognizant of different voices and experiences. Focussing on business ethics in connection to the grand challenge of environmental emergencies, Steffen Böhm introduces the deceptively simple yet radical position that business is nature, and nature is business. His quick but profound side-step from arguments against human–nature dualism to an ontological undoing of the business–nature dichotomy should have all business ethics scholars rethinking their “business and society” assumptions. Also, singularly concerned with the climate emergency, Boudewijn de Bruin posits a scenario where, 40 years from now, our field will be evaluated by its ability to have helped humanity emerge from this emergency. He contends that Milieudefensie v. Royal Dutch Shell illustrates how human rights take centre stage in climate change litigation, and how business ethics enters the courtroom. From a consumer ethics perspective, Deirdre Shaw, Michal Carrington and Louise Hassan argue that ecologically sustainable and socially just marketplace systems demand cultural change, a reconsideration of future interpretations of “consumer society”, a challenge to the dominant “growth logic” and stimulation of alternative ways to address our consumption needs. Still concerned with global issues, but turning attention to social inequalities, Nelarine Cornelius links the capability approach to global and corporate governance, arguing that CA will continue to lie at the foundation of human development policy, and, increasingly, CSR and corporate governance. Continuing debate on the grand challenges associated with justice and equality, Laurence Romani identifies a significant shift in the centrality of business ethics in debates on managing differences, positing that dialogue between diversity management and international management can ground future debate in business ethics. Finally, the essay concludes with a commentary by Charlotte Karam and Michelle Greenwood on the possibilities of feminist-inspired theories, methods, and positionality for many spheres of business ethics, not least stakeholder theory, to broaden and deepen its capacity for nuance, responsiveness, and transformation. In the words of our commentators, grand challenges must be addressed urgently, and the Journal of Business Ethics should be at the forefront of tackling them. (shrink)

Linguistic interventions aim to change our linguistic practices. A commonly discussed type of linguistic intervention is meaning revision, which seeks to associate existing words with new or revised meanings. But why does retaining old words matter so much? Why not instead introduce new words to express the newly defined meanings? Drawing on relevant psycholinguistic research, this paper develops an empirically motivated, general, and practically useful pro tanto reason to retain rather than replace the original word during the process of conceptual (...) improvement. In this article, we draw on established views of CSR dysfunctionalities to show how and why CSR is regularly observed to be both shaped by and supportive of capitalism. We proceed to show that these dysfunctionalities are maintained by both the pro- and anticapitalist approaches to CSR, both of which imply an ill-defined separation of the economy and society as well an overly strong problem or solution focus on political and economic issues. Finally, we present a post-capitalist approach to CSR (...) that overcomes (1) the ill-defined separation of the economy and society, (2) the capitalist bias towards economic rationalities, and (3) the overidentification of society with its political system; this approach thus helps to manage the abovementioned CSR dysfunctionalities. Self-Deception and the Common Life investigates the topic of self-deception from three points of view: philosophical psychology, ethics, and theology. Empirical evidence and an -ordinary language- analysis support the case that the linguistic expression 'self-deception' is literally meaningful and that the language of the common life can be trusted. After critically analyzing the cognition, translation, and action accounts, along with the contributions of Freud and Sartre, Steffen proposes a new synthetic -emotional perception- account, one that avoids paradox. Giving attention (...) to relevant moral issues, he argues that self-deception is not immoral, but represents a peculiar form of akrasia. Finally, because theologians employ 'self-deception' to describe the cognitive component of sin, Steffen considers the logic of theological self-deception. His study seeks an -intimate acquaintance- with self-deception and exemplifies a method of analysis relevant to constructive theological inquiry.". (shrink)

Multi-stakeholder initiatives have become a vital part of the organizational landscape for corporate social responsibility. Recent debates have explored whether these initiatives represent opportunities for the “democratization” of transnational corporations, facilitating civic participation in the extension of corporate responsibility, or whether they constitute new arenas for the expansion of corporate influence and the private capture of regulatory power. In this article, we explore the political dynamics of these new governance initiatives by presenting an in-depth case study of an organization often (...) heralded as a model MSI: the Forest Stewardship Council. An effort to address global deforestation in the wake of failed efforts to agree a multilateral convention on forests at the Rio Summit in 1992, the FSC was launched in 1993 as a non-state regulatory experiment: a transnational MSI, administering a global eco-labeling scheme for timber and forest products. We trace the scheme’s evolution over the past two decades, showing that while the FSC has successfully facilitated multi-sectoral determination of new standards for forestry, it has nevertheless failed to transform commercial forestry practices or stem the tide of tropical deforestation. Applying a neo-Gramscian analysis to the organizational evolution of the FSC, we examine how broader market forces and resource imbalances between non-governmental and market actors can serve to limit the effectiveness of MSIs in the current neo-liberal environment. This presents dilemmas for NGOs which can lead to their defection, ultimately undermining the organizational legitimacy of MSIs. (shrink)

Ethical issues concerning brain–computer interfaces have already received a considerable amount of attention. However, one particular form of BCI has not received the attention that it deserves: Affective BCIs that allow for the detection and stimulation of affective states. This paper brings the ethical issues of affective BCIs in sharper focus. The paper briefly reviews recent applications of affective BCIs and considers ethical issues that arise from these applications. Is the endeavour to restore perceptive brain functions by electronic implants the first step on the way to create bionic cyborgs? Can we augment or multiply our senses by directly contacting computer chips to the brain? Will bio-implants influence and permanently change human psyche?

In this essay, I shall show that the so-called inferential (Suárez 2003 and 2004 ) and interpretational (Contessa 2007 ) accounts of scientific representation are respectively unsatisfactory and too weak to account for scientific representation ( pars destruens ). Along the way, I shall also argue that the pragmatic similarity (Giere 2004 and Giere 2010 ) and the partial isomorphism (da Costa and French 2003 and French 2003 ) accounts are unable to single out scientific representation. In the pars construens (...) I spell out a limiting case account which has explanatory surplus vis à vis the approaches which I have previously reviewed. My account offers an adequate treatment of scientific representation, or so I shall try to argue. Central to my account is the notion of a pragmatic limiting case, which will be characterized in due course. (shrink)

Leben, Werk und Persönlichkeit des grossen Philosophen (1724-1804).

The Anthropocene concept arose within the Earth System science (ESS) community, albeit explicitly as a geological (stratigraphical) time term. Its current analysis by the stratigraphical community, as a potential formal addition to the Geological Time Scale, necessitates comparison of the methodologies and patterns of enquiry of these two communities. One means of comparison is to consider some of the most widely used results of the ESS, the ‘planetary boundaries’ concept of Rockström and colleagues, and the ‘Great Acceleration’ graphs of (...) class='Hi'>Steffen and colleagues, in terms of their stratigraphical expression. This expression varies from virtually non-existent (stratospheric ozone depletion) to pronounced and many-faceted (primary energy use), while in some cases stratigraphical proxies may help constrain anthropogenic process (atmospheric aerosol loading). The Anthropocene concepts of the ESS and stratigraphy emerge as complementary, and effective stratigraphic definition should facilitate wider transdisciplinary communication. (shrink)

We develop an extension of the familiar linear mixed logit model to allow for the direct estimation of parametric non-linear functions defined over structural parameters. Classic applications include the estimation of coefficients of utility functions to characterize risk attitudes and discounting functions to characterize impatience. There are several unexpected benefits of this extension, apart from the ability to directly estimate structural parameters of theoretical interest.

Er knüpft zum Einstieg bei einem für dieses Vorhaben geeigneten Advents- und Weihnachtslied an: bei Alle Jahre wieder. Das Gedicht, das diesem populären Lied zugrunde liegt, entpuppt sich im Gegenlicht der religionsphilosophischen Einlassungen von Jean-Luc Nancy und Giorgio Agamben als kompaktes poetisches Pendant zu einer Theologie des Advents, die getragen wird von der Struktur eines dem Erscheinen zuvorkommenden (Heran-)Kommens und die in dieser prozessierenden Präsenz (man könnte auch sagen: dieser (...) Bayesian approaches for estimating multilevel latent variable models can be beneficial in small samples. Prior distributions can be used to overcome small sample problems, for example, when priors that increase the accuracy of estimation are chosen. This article discusses two different but not mutually exclusive approaches for specifying priors. Both approaches aim at stabilizing estimators in such a way that the Mean Squared Error of the estimator of the between-group slope will be small. In the first approach, the MSE is (...) decreased by specifying a slightly informative prior for the group-level variance of the predictor variable, whereas in the second approach, the decrease is achieved directly by using a slightly informative prior for the slope. Mathematical and graphical inspections suggest that both approaches can be effective for reducing the MSE in small samples, thus rendering them attractive in these situations. Using 2015 International Social Survey Program (ISSP) data on 38,179 individuals from 36 countries in 9 relatively homogeneous global regions, we analyze the gender differences and the gender gap in perceived workplace harassment (PWH) with particular attention to gender equality's and gender egalitarianism's roles in molding these differences. We find that despite large regional differences, women in most countries are more likely than men to perceive workplace harassment, although this likelihood is higher in countries that score favorably on our gender (...) equality measures. Hence, political empowerment and better economic opportunities alter women's perceptions of workplace harassment, increasing the probability of their experiencing it. Our results also underscore the important roles of values and gender egalitarian practices. Whereas enhanced gender egalitarianism values increase women's perceptions of workplace harassment, concrete practices tend to reduce them. Especially for management, this result highlights the importance of actually implementing gender equality policies at a corporate level, because a discrepancy between corporate values and practices on this issue will only accentuate the perception of harassment. This paper deals with the question of whether nature sports are to be counted among the (traditional) sports and Kevin Krein’s recent argument, based on sporting excellence, as to why they should. Krein argues that sports as such are ultimately about sporting excellence and because both so-called traditional sports and nature sports fulfil that criterion, nature sports belong in the sport domain. Here, I show that Krein’s argument rests on an equivocation between two concepts of sporting excellence. Sporting excellence in (...) traditional sports is connected to sporting success. Here agon (contest or competition) dictates or frames areté (striving for excellence). This is not the case for sporting excellence in nature sports, as these are not competitions. We are dealing with two different concepts of sporting excellence and Krein’s argument, based on sporting excellence, must be rejected. It gives no basis for including nature sports in the sport domain. (shrink)

Riesige Bibliotheken und Kunstkammern sowie voluminöse Abhandlungen, Geschichtswerke und Enzyklopädien geben noch heute eindrucksvoll Rechenschaft von dieser Leidenschaft. Doch wächst mit der Größe jeder Sammlung auch die Notwendigkeit ihrer Ordnung. Es ist daher kein Zufall, dass ›Ordnung‹ zum Schlüsselbegriff des humanistischen Enzyklopädismus aufgestiegen und zum Gegenstand hartnäckiger Auseinandersetzungen unter den Gelehrten geworden ist. In Steffen Siegels Untersuchung werden die vielfältigen philosophischen Versuche, (...) die Fülle des Wissens systematisch zu ordnen, nicht allein anhand der Überlieferung von Texten rekonstruiert. Im Zentrum dieser reich illustrierten Studie, die bei mittelalterlichen Wissenspraktiken ihren Ausgang nimmt, sich insbesondere den vielschichtigen Bildkulturen des 16. und 17. Das Tafelwerk steht daher im Mittelpunkt der Untersuchungen zu den Figuren enzyklopädischer Wissensordnungen. Erstmals seit seiner Publikation vor über fünfhundert Jahren wird dieses sehr selten gewordene, für die Gelehrtenkultur des 16. Jahrhunderts äußerst repräsentative Werk hier vollständig und in einer farbigen Reproduktion wieder zum Druck gebracht. Die komplexen Strategien, mit Hilfe von Bildern, Diagrammen und Texten für eine bestimmte Wissensordnung zu argumentieren, lassen sich auf diese Weise an einer bedeutenden Quelle der vormodernen Gelehrtengeschichte minutiös nachvollziehen. According to Steven Pinker and his associates the cooperative model of human communication fails, because evolutionary biology teaches us that most social relationships, including talk-exchange, involve combinations of cooperation and conflict. In particular, the phenomenon of the strategic speaker who uses indirect speech in order to be able to deny what he meant by a speech act (deniability of conversational implicatures) challenges the model. In reply I point out that interlocutors can aim at understanding each other (cooperation), while being in (...) conflict. Furthermore, Pinker’s strategic speaker relies on the Cooperative Principle when conveying a conversational implicature, and so non-cooperative behaviour (denial) only emerges as a response to a negative reaction from the audience. It is also doubtful in the cases Pinker presents whether a denial will successfully cancel the conversational implicature –change the audience’s interpretation of speaker’s meaning. I also argue that a strategic speaker might choose indirect speech due to the ignorability of conversational implicatures, in which case the strategic speaker can be highly cooperative. (shrink)

First concerns about the use of nanosilver were raised almost a decade ago, but assessing the risks has been extremely challenging scientifically, and regulation to protect environmental and human health remains controversial. In order to understand the known risks and issues associated with the use of nanosilver, we carried out a DPSIR analysis and analysed drivers, pressures, state, impacts and potential policy responses. We found that most concerns relate to the potential development of multi-resistant bacteria and the environmental impacts of (...) nanosilver. From the DPSIR analysis, we found that new legislation for nanomaterials in general and nanosilver-specific changes in the current European chemical, biocide and medical legislation were the optimal policy responses, along with limiting the overall use of nanosilver. In order to qualify the identified potential policy responses, we carried out a stakeholder analysis, in order to explore possibilities for reaching consensus amongst stakeholders. Through the stakeholder analysis, the interests, views, power and influence of the identified stakeholders were mapped. Overall, the policy options identified in the DPSIR analysis were deemed not to be implementable, as industry and NGOs seem to have fundamentally conflicting views and interests. The use of the combination of DPSIR and stakeholder analysis proved valuable for use in cases of complexity, as they compensate for each other’s limitations and open up for a discussion what can be done to reduce risks. In this discussion paper, I seek to challenge Hylarie Kochiras’ recent claims on Newton’s attitude towards action at a distance, which will be presented in Section 1. In doing so, I shall include the positions of Andrew Janiak and John Henry in my discussion and present my own tackle on the matter . Additionally, I seek to strengthen Kochiras’ argument that Newton sought to explain the cause of gravity in terms of secondary causation . I also provide some specification on (...) what Kochiras calls ‘Newton’s substance counting problem’ . To understand how small business entrepreneurs respond to government policy one has to know their risk and time preferences. Are they risk averse, or have high discount rates, such that they are hard to motivate? We have conducted a set of field experiments in Denmark that will allow a direct characterization of small business entrepreneurs in terms of these traits. We build on experimental tasks that are well established in the literature. The results do not suggest that small business entrepreneurs (...) are more or less risk averse than the general population under the assumption of Expected Utility Theory. However, we generally find an S-shaped probability weighting function for both small business entrepreneurs and non-entrepreneurs, with entrepreneurs being more optimistic about the chance of occurrence for the best outcome in lotteries with real monetary outcomes. The results also point to a significant difference in individual discount rates between entrepreneurs and non-entrepreneurs: entrepreneurs are willing to wait longer for certain rewards than the general population.
