The attitudes of patients' to consent have changed over the years, but there has been little systematic study of the attitudes of anaesthetists and surgeons in this process. We aimed to describe observations made on the attitudes of medical professionals working in the UK to issues surrounding informed consent.

Many philosophers suggest (1) that our emotional engagement with fiction involves participation in a game of make-believe, and (2) that what distinguishes an emotional game from a dispassionate game is the fact that the former activity alone involves sensations of physiological and visceral disturbances caused by our participation in the game. In this paper I argue that philosophers who accept (1) should reject (2). I then illustrate how this conclusion illuminates various puzzles in aesthetics and the philosophy of mind.

Scare Tactics, the first book on the subject, provides a theory of the structure of reasoning used in fear and threat appeal argumentation. Such arguments come under the heading of the argumentum ad baculum, the `argument to the stick/club', traditionally treated as a fallacy in the logic textbooks. The new dialectical theory is based on case studies of many interesting examples of the use of these arguments in advertising, public relations, politics, international negotiations, and everyday argumentation on all kinds of (...) subjects. Many of these arguments are amusing, once you see the clever tactic used; others are scary. Some of the arguments appear to be quite reasonable, while others are highly suspicious, or even outrageously fraudulent. In addition to the examples taken from logic textbooks, other cases treated come from a variety of sources, including political debates, legal arguments, and arguments from media sources, like magazine articles and television ads. The purpose of this book is to explain how such arguments work as devices of persuasion, and to develop a method for analyzing and evaluating their reasonable and fallacious uses in particular cases. The book shows how such arguments share a common structure, revealing several distinctive forms of argument nested within each other. Based on its account of this cognitive structure, the new dialectical theory presents methods for identifying, analyzing, and evaluating these arguments, as they are used in specific cases. The book is a scholarly contribution to argumentation theory. It is written in an accessible style, and uses many colorful and provocative examples of fear and threat appeal arguments that are suitable for classroom discussions. The matters treated will be of interest to professionals and students in law, critical thinking, advertising, speech communication, informal logic, cognitive science, rhetoric, and media studies. In redefining logic, philosophers need to go back to the Aristotelian roots of the subject, to expand the boundaries of the subject to include informal logic and to give up false oppositions between informal and formal logic.

This book examines the concept of post-truth and the impact it is having on contemporary life, bringing out both its philosophical and political dimensions. Post-truth is contextualised within the philosophical discourse of truth, with particular reference to theories of scepticism and relativism, to explore whether it can take advantage of these to claim any intellectual credibility. Sim argues that post-truth cannot be defended on either sceptical or relativistic grounds – even those provided by recent iconoclastic philosophical movements such as poststructuralism (...) and postmodernism. The affinity between post-truth and conspiracy theory is emphasised, and the extent to which post-truth plays a role in religious doctrine is also considered. Post-truth is seen to constitute a threat to liberal democratic ideals and our Enlightenment heritage, raising the question of whether we are moving into a post-liberal age where the far right would hold power. To prevent this, post-truth urgently needs to be countered. (shrink)

The aim of this paper is to make it clear how and why begging the question should be seen as a pragmatic fallacy which can only be properly evaluated in a context of dialogue. Included in the paper is a review of the contemporary literature on begging the question that shows the gradual emergence over the past twenty years or so of the dialectical conception of this fallacy. In this paper it is shown how tools developed in argumentation theory and artificial intelligence can be applied to the development of a new dialectical analysis of the speech act of making a proposal in a deliberation dialogue. These tools are developed, modified and used to formulate dialogue pre-conditions, defining conditions and post-conditions for the speech act of making a proposal in a deliberation dialogue. The defining conditions set out what is required for a move in a dialogue to count (...) as the making of a proposal by one of the parties. What is required are the conditions that (1) the move fit the requirements of the argumentation scheme for practical reasoning, and (2) the premises are propositions describing common goals of both parties or propositions that they reasonably consider means to achieve these goals. The analysis goes beyond the standard speech act approach by specifying not only the normative requirements for making a well-formed proposal, but also the requirements for responding to it by questioning or criticizing it, and the requirements for defending it. Use of argumentation methods applied to legal reasoning is a relatively new field of study. The book provides a survey of the leading problems, and outlines how future research using argumentation-based methods show great promise of leading to useful solutions. The problems studied include not only these of argument evaluation and argument invention, but also analysis of specific kinds of evidence commonly used in law, like witness testimony, circumstantial evidence, forensic evidence and character evidence. The reader's access to the fictional world of a novel is mediated by the narrator, when there is one; the fictional world is presented from the narrator's perspective. do depictions ever have anything comparable to narrators? apparent artists sometimes have a certain perspective on the fictional world. but they don't mediate our access to it; the fictional world is presented independently of their perspective on it. depictions do present fictional worlds from certain perspectives, but not usually the perspectives of any (...) fictional characters. however, there are characters in some special depictions, especially certain films, who function very much like narrators. Unlike many major figures in Western intellectual history, Hobbes has refused to become dated and quietly take his appointed place in the museum of historical scholarship. Whether by way of adoption or reaction, his ideas have remained vibrant forces in mankind's attempts to understand the problems and dilemmas of living peaceably with one another. As Richard Ashcraft said a few years ago: One of the standards by which the greatness of political theorists is measured, is their ability to evoke in (...) us new insights into 'the human condition'. Only a few political writers have risen Dionysus-like from the titanic assaults of their critics to become even more formidable forces in the shaping of our destiny. One of these giants is surely the irascible l and irrepressible Thomas Hobbes . Given the power of Hobbes's thought, it is not then perhaps surprising to find that his writings have generated seemingly endless scholarly controversy and an astonishing range of imcompatible interpretations. Among other things, he has been interpreted as a theist and an atheist, as a utilitarian and a deontologist, a humanist and a scientist, as a traditional natural law theorist and a legal positivist, a contractualist and an absolutist - indeed, as Professor Morris notes in his contribution to the present volume, 'as almost any kind of philosophical 'ist except Platonist or Aristotelist'. En el curso de 1934/35 Heidegger se refiere a cuatro momentos esenciales del temple fundamental: desplazamiento hacia los límites del ente, inserción en la existencia histórica y arraigo en la tierra y el suelo natal, apertura del ente en conjunto como la unidad de un mundo, y fundación del ser. El artículo explora el vínculo de los cuatro momentos con las siguientes oposiciones: indigencia/disponibilidad, no-hogareño/hogareño, duelo/alegría, lejanía/cercanía y condición-de-oculto/condición-de-no-oculto. Se analiza esta quinta oposición en relación con las diversas modalidades en (...) que se manifiesta el ánimo. Las oposiciones pueden ser consideradas también rasgos distintivos del temple fundamental. Se interrelacionan, y, además, se despliegan siempre a partir de una intimidad fundamental que opera como un nexo en medio de los antagonismos. This article assesses what standards of safety and certainty of diagnosis need to be met in the determination of brain death. Recent medical, legal, and philosophical developments on brain death are summarized. It is argued that epistemologically adequate standards require the finding of whole-brain death rather than destruction of the cortex. Because of the possibility of positive error in misdiagnosing death, a tutioristic approach of being on the safe side is advocated. Given uncertainties in diagnosis of so-called vegetative states like (...) the apallic syndrome, anything less than whole-brain death, especially given the present state of diagnostic capability, should not qualify as an argument for removing therapy specifically on grounds that the patient is dead. The cinematographic successes of Craig Brewer’s Black Snake Moan and Lars Von Trier's Manderlay are contingent upon the palpability of tension and attraction created by their respective, many racial and sexual relations, thus both films aggressively bring them to the fore by excessively rehearsing old stereotypes and taboos, and inverting the expected agents therein, to reveal their persistent, still-relevant power. Both films similarly test our convictions and squeamishness, but do so from entirely different moral stances. Brewer explores how an act (...) of charity and humanitarian openness can save lives, literally and spiritually. Von Trier explores how similar acts of openness can smother appreciation of the other and reenact the worst oppression. The former tells a persuasive story with wide appeal, while the latter tells a story that will make even the most desensitized viewers cringe. Using these pictures as paradigms, is either approach better for bringing prejudice into the light for thought and film? (shrink)

You may challenge this. You may say that after all scientists need gadgets. They need cyclotrons and space probes, telescopes and microscopes. They need the mechanical skills to make them work. The other day I heard a talk by a novelist who remarked that maybe you don't need to have a poignant love affair to be a writer, but it helps. I take this to mean that writers as well as scientists need data, which implies the equipment and skills for (...) its perception; but this need imply no more than the very basic human endowment. I happen to be a geologist and get a good deal of my data wandering "... lonely as a cloud o'er vales and hills," which also appears to have some poetic value. Still, there seems to be a difference. Are poignant love affairs, which inform the poetic imagination, merely disturbing to scientists? (shrink)
