In this review, I discuss Balibar’s ‘proposition of equaliberty’ with regard to its theoretical status and contribution, its relationship to other contemporary theories of radical democracy as well as to the problematic of bourgeois versus communist emancipation in Marx. The primary interest of this essay is to develop a detailed understanding of Balibar’s analytical schema, which draws a complex picture of our contemporary ‘human condition’, and to place it within his own theoretical development since his contribution toReading Capitalin the 60s. On that basis, it will be possible to assess his contribution to thinking politics with and after Marx and place it more concretely within the generalised radical-democratic turn in post-Marxist theory. In this article, I argue that Habermas’s method of rational reconstruction faces limitations when it comes to analysing newly emerging and contested political practices. As rational reconstruction aims to criticize existing practices by determining their normative meaning as reflected in the participants’ idealizing presuppositions, it reaches its limits where emerging and contested practices make it impossible to identify a shared self-understanding and a single participants’ perspective. Using the example of membership politics, I argue that this is often the case where (...) nationally constituted forms of politics become controversial or are fundamentally questioned. Building on the work of Benhabib and Fraser, I develop an alternative reconstructive method of plural reconstruction, which modifies the basic premises of rational reconstruction, adjusting it to emerging and contested political contexts. While Specific Informed Consent has been the established standard for obtaining consent for medical research for many years, it does not appear suitable for large-scale biobank and health data research. Thus, alternative forms of consent have been suggested, based on a variety of ethical background assumptions. This article identifies five main ethical perspectives at stake. Even though Tiered Consent, Dynamic Consent and Meta Consent are designed to the demands of the self-determination perspective as well as the perspective of research as (...) a public good, they are still also criticized from both perspectives. In addition, criticisms based on concerns of justice, participation and democratic deliberation, and relational concerns have been levelled at each of the models. As all of these perspectives have valid points to make, the task at hand lies in balancing these ethical perspectives. What constitutes an adequate balancing depends on contextual factors. These factors include digital infrastructure and digital literacy, data safety regulation, good scientific and clinical practice, transparent debates on ethically relevant features of research, social inequalities, anti-discrimination laws and practices, trust in health care institutions and recognition of patient preferences, and consensus on unethical research. We argue that the role of context in determining acceptable models of consent puts the ethical importance of models of consent into perspective. Since altering contextual factors can help to live up to the ethical concerns at stake in debates about models of consent, opting for such a shift of focus comes without ethical loss. (shrink)

Conceiving legal obligations towards future generations is challenging—especially from a positivist stance and if obligations and claims are understood as being correlative in nature. Legal obligations towards future generations are often rejected from the outset if (and insofar as) there is no explicit acknowledgement or established doctrine. This neglects the power of sound legal interpretation. I argue that obligations towards future people and generations are grounded in the relational character of human rights and that their positivity is not a problem (...) in a legal order containing norm texts that can reasonably be interpreted as acknowledging human rights; no additional enactment is necessary for these obligations to be part of the positive law. This claim is based on a (novel) concept of fundamental rights which is compatible with legal positivism. (shrink)

The article discusses the impact different concepts of solidarity can have on debates on models of consent for non-interventional research. It introduces three concepts of solidarity that have been referenced in bioethical debates: a purely descriptive concept, a concept that claims some derivative value for most but not all practices of solidarity, as well as a clearly normative concept where solidarity is tied to justice and taken to ground moral duties. It shows that regarding the rivalling models of study-specific consent, (...) tiered consent and broad consent, the first two concepts can be taken to favour tiered consent while only normative solidarity supports a model of broad consent—or an argument to allow non-interventional research without requiring consent at all. As normative solidarity is tied to considerations of justice, however, the argument appears less straightforward than one might expect: It presupposes that the research contributes to overcoming existing social injustices. While questions about the environmental sustainability of contemporary farming practices and the socioeconomic viability of rural communities are attracting increasing attention throughout the US, these two issues are rarely considered together. This paper explores the current and potential connections between these two aspects of sustainability, using data on community members’ and farmers’ views of agricultural issues in California’s Central Valley. These views were collected from a series of individual and group interviews with biologically oriented and conventional farmers as well as (...) community stakeholders. Local marketing, farmland preservation, and perceptions of sustainable agriculture comprised the primary topics of discussion. The mixed results indicate that, while many farmers and community members have a strong interest in these topics, sustainable community development and the use of sustainable farming practices are seldom explicitly linked. On the other hand, many separate efforts around the Valley to increase local marketing and agritourism, improve public education about agriculture, and organize grassroots farmland preservation initiatives were documented. We conclude that linking these efforts more explicitly to sustainable agriculture and promoting more engagement between ecologically oriented farmers and their communities could engender more economic and political support for these farmers, helping them and their communities to achieve greater sustainability in the long run. Questions of political membership belong to the most controversial issues in political theory today. Most of the contributions to these debates, however, leave aside the procedural question of how and by whom membership boundaries can be legitimately redrawn. In this article, I argue that membership theory should move from dealing with legitimate boundaries to legitimate boundary-making. Highlighting the limits of two normative models – sovereign and cosmopolitan membership politics – and building on a new interpretation of Seyla Benhabib’s concept of (...) ‘democratic iterations’, I develop an alternative approach, which I describe as post-sovereign membership politics. Post-sovereign membership politics envisages differentiated participatory entitlements for members and non-members in boundary-making and aims to realize both members’ and non-members’ autonomy in decisions on controversial issues such as citizenship tests, prisoner disenfranchisement, or the selling of passports. Der Beitrag befasst sich mit der Frage, ob eine Verantwortung ggü. zukünftigen Grundrechtsträgern/Generationen nicht nur moralisch, sondern auch rechtlich begründbar ist. Dazu wird auf ein grundrechtstheoretisches Konzept zurückgegriffen, das mit einem positivistischen Verständnis des Rechts kompatibel ist. Der Beitrag führt zu dem Ergebnis, dass eine Rechtfertigungslast gegenüber künftigen Grundrechtsträgern grundrechtlich begründbar ist und angesichts der positivrechtlichen Anerkennung von Menschenrechten auch bereits besteht. Die Pflichten der jeweils gegenwärtig Lebenden zugunsten künftiger Grundrechtsträger besteht allerdings grundrechtstheoretisch nicht in die ganz ferne Zukunft; hier (...) gibt es konzeptionelle Grenzen. Der Beitrag zeigt, dass sich die ontologische Ebene und die damit zusammenhängende normative Ebene konzeptionell von der epistemischen Problematik und dessen normativer Bewältigung trennen lässt. This study critiques the idea of a “Western science -- indigenous knowledge” dichotomy in agricultural knowledge by examining the hybrid nature of knowledge use and incorporation by villagers in Madhya Pradesh, India. By analyzing knowledge systems as multi-leveled structures consisting of concrete practices linked to more abstract, explanatory concepts, this paper illustrates how information from multiple sources is integrated into local bodies of knowledge about tree management. Practices such as urea fertilization from formal global science might be explained by concepts (...) such as that of a hot/cold duality from informal folk science. Similarly, other pieces of knowledge stemming from diverse knowledge systems are shown to become mixed and matched on practical and conceptual levels. Additionally, several knowledge elements used locally appear to be held in common by many knowledge systems around the world, rendering the determination of their origins in one system or another nearly impossible. These observations lead to the conclusion that local knowledge systems of tree management are better characterized as “open” systems rather than distinct, “closed” systems. Furthermore, the constant exchange of material between formal and informal, local and global systems renders untenable any strict dichotomy of knowledge systems. (shrink)

This paper examines the influence of service learning as a pragmatic skills-based teaching intervention. Conceptually, it builds on literature, legitimizing servicelearning in terms of four educational logics– civic engagement, practical relevance, skill development, and responsibility. We investigate whether service learning can always achieve this broad range of educational objectives, in view of students being increasingly exposed to a logic of ‘educational performance’, which they may perceive to be in conflict with the logics of 'civic engagement' and ‘responsibility’. The theoretical part (...) of this paper reviews the evolution of service learning literature and summarizes insights from experiential learning literature. We also report findings from a controlled field experiment with postgraduate management students. We find that service learning influences students’ self-assessment of management skills and awareness stakeholder needs. Surprisingly, our findings provide no evidence for its influence on attitudes to responsibility. (shrink)

Although convergence in emotion expressions within small groups is well documented, the motives that explain why members converge are rarely explicated. We approach expressive convergence from a conformity perspective and introduce the Emotional Conformity Framework, in which we posit that members match their groupmates’ emotion expressions because they are motivated to gain an accurate understanding of reality (informational conformity motive) or to form and maintain social relationships (normative conformity motive). These motives determine members’ standards for correctness, social responses, and plausible (...) convergence mechanisms, while members’ personalities and situational properties shape the relative strength of the two motives. By explicating these motivational underpinnings, the Framework improves our capacity to understand, predict, and regulate expressive convergence and emphasizes its functionality. (shrink)

Zusammenfassung Im Jahr 2003 gingen Jürgen Baur und Ulrike Burrmann der Frage nach, inwieweit sich Sportengagements von Jugendlichen individualisiert haben. Die meisten Annahmen mussten verworfen werden. Vor dem Hintergrund aktueller gesellschaftlicher Entwicklungen wird im vorliegenden Beitrag anhand von Zeitreihendaten dieser Frage erneut nachgegangen. Hinterfragt wird aber auch, ob sich der Einfluss vertikaler sozialstruktureller Merkmale auf die Beteiligung am Sport seit den 1970er Jahren abgeschwächt hat und ob dieser Zusammenhang in den letzten Jahren wieder enger geworden ist. Zusammenfassung Die informierte Einwilligung von Teilnehmer:innen gilt in vielen Fällen als Voraussetzung auch für die rein datenbasierte medizinische Forschung. In diesem Kontext wird ein Modell der breiten Einwilligung (_Broad Consent_) diskutiert. In Deutschland hat die Medizininformatik-Initiative einen konkreten Vorschlag für deutsche Kliniken ausgearbeitet, der eine Gültigkeit der Einwilligung für einen Zeitraum von 30 Jahren vorsieht. Der vorliegende Artikel diskutiert vor diesem Hintergrund die Frage, wie der Anspruch der Informiertheit in dieser zeitlichen Perspektive einzuordnen ist. Die Praxis der Einwilligung wird dabei (...) so verstanden, dass sie auf die Verwirklichung von Wohlergehen, persönlicher Souveränität und Vertrauen ausgerichtet ist. Eine anzunehmende Informationsasymmetrie zwischen Forschungsteilnehmenden, Forschenden, und datenspeichernden Institutionen wird dabei als spezifisches Kontextmerkmal herausgestellt. Um dieser Informationsasymmetrie in angemessener Weise zu begegnen, so die These, ist eine kontinuierliche Weitergabe von verständlich aufbereiteten Informationen an Forschungsteilnehmende notwendig, um die Wahrnehmung persönlicher Souveränität zu ermöglichen. In Probabilistic Knowledge Sarah Moss proposes that our credences and subjective probability judgments (SPJs) can constitute knowledge. Mossean probabilistic knowledge is grounded in probabilistic beliefs that are justified, true, and unGettiered. In this paper I aim to address and solve two challenges that arise in the vicinity of the factivity condition for probabilistic knowledge: the factivity challenge and the challenge from probabilistic arguments from ignorance (probabilistic AIs). I argue that while Moss's deflationary solution to the factivity challenge formally works, it (...) leaves us ill-equipped to handle probabilistic AIs. An account of probabilistic knowledge that cannot overcome probabilistic AIs makes knowledge of thoroughly probabilistic contents a rare and unstable phenomenon, at best, or, at worst, impossible. I hold that establishing a metaphysically enriched account of probabilistic truth is therefore mandatory. I go on to develop a truth-conditional approach on probabilistic factivity that is relativistic in its nature and centers on objective chances. I show that while the approach is still compatible with Moss's overall semantics for probabilistic knowledge, it provides us with a simple but forceful answer to probabilistic AIs. (shrink)

-/- Policy regulations of ethically controversial genetic technologies should, on the one hand, be based on ethical principles. On the other hand, they should be socially acceptable to ensure implementation. In addition, they should align with ethical theory. Yet to date we lack a reliable and valid scale to measure the relevant ethical judgements in laypeople. We target this lacuna. -/- We developed a scale based on ethical principles to elicit lay judgments: the Genetic Technologies Questionnaire (GTQ). In two pilot (...) studies and a pre-registered main study, we validated the scale in a representative sample of the US population. -/- The final version of the scale contains 20 items but remains highly reliable even when reduced to five. It also predicts behaviour; for example, ethical judgments as measured by the GTQ predicted hypothetical donations and grocery shopping. In addition, the GTQ may be of interest to policymakers and ethicists because it reveals coherent and ethically justified judgments in laypeople. For instance, the GTQ indicates that ethical judgments are sensitive to possible benefits and harms (in line with utilitarian ethics), but also to ethical principles such as the value of consent-autonomy. -/- In conclusion, the GTQ can be recommended for research in both experimental psychology and applied ethics, as well as a tool for ethically and empirically informed policymaking. The Tongan language has honorific registers, called a ‘language of respect’ (Churchward 1953). These are two limited sets of lexemes used to refer to people of chiefly and kingly rank and thus honour the societal stratification. Anthropological-linguistic research reveals that these honorifics are atapu-motivated linguistic practice. The Polynesian concept oftapu(source of the loanwordtaboo) means that entities with moremana(‘supernatural power’) such as persons of higher rank and their personal belongings are ‘sacred’, and it is ‘forbidden’ to get in physical touch with (...) them. The respectful terminology (hou‘eikiandtu‘i) is restricted to suchtapuentities (signifiers), and its generic character shows that direct verbal contact with the commonkakaisignifier is avoided. In this paper we examine the concept of waiting from a phenomenological point of view. In order to do so, we start with a definition from Andreas Göttlich and contextualize it within the theoretical framework provided by Alfred Schutz, Thomas Luckmann and Peter L. Berger. Additionally, we discuss waiting on the basis of our previous research, specifically within the context of a field extract from an earlier life-world analytical ethnography on the parents of pre-adolescent, non-professional soccer players. The field vignette (...) depicts a mother who has problematic possibilities of conflicting preferences due to the apperception of her soccer playing child, who was injured during the match. This negotiation within projects of action will be outlined as a specific facet of waiting. (shrink)

A layoff is a threatening yet common event which employees might face at some point in their working lives. In two scenario-based experiments, we investigated which actions of a layoff agent during a dismissal notification meeting may contribute to laid-off employees’ fairness judgments and negative attitudes toward the employer. In general, the extent to which layoff victims were treated with respect was consistently found to increase perceptions of interpersonal and procedural fairness and to mitigate negative attitudes toward the employer. Further (...) results showed that layoff victims preferred to be given an adequate explanation of the reasons for the layoff and to receive notice from the direct supervisor. Relationships between the layoff agent’s actions and layoff victims’ negative attitudes toward the employer were mediated by perceptions of procedural fairness. In addition, delegating the layoff agent’s task to an external consultant increased perceived psychological contract breach. Our findings have important implications for organizational justice research and for the managerial practice of implementing fair layoffs. In particular, small actions, such as treating employees with respect, might be of benefit both to humans and organizations. (shrink)

Primary and secondary processes are the foundational axes of the Freudian mental apparatus: one horizontally as a tendency to associate, the primary process, and one vertically as the ability for perspective taking, the secondary process. Primary process mentation is not only supposed to be dominant in the unconscious but also, for example, in dreams. The present study tests the hypothesis that the mental activity during REM-sleep has more characteristics of the primary process, while during non-REM-sleep more secondary process operations take (...) place. Because the solving of a rebus requires the ability to non-contexually condensate the literal reading of single stimuli into a new one, rebus solving is a primary process operation by excellence. In a replication of the dream-rebus study of Shevrin and Fisher (1967), a rebus, which consisted of an image of a comb (German: “Kamm”) and an image of a raft (German: “Floß”), resulting in the German rebus word “kampflos” (Engl.: without a struggle), was flashed subliminally (at 1 ms) to 20 participants before going to sleep. Upon consecutive awakenings participants were asked for a dream report, free associations and an image description. Based on objective association norms, there were significantly more conceptual associations referring to Kamm and Floß indexing secondary process mentation when subjects were awakened from non-REM sleep as compared to REM-awakenings. There were not significantly more rebus associations referring to kampflos indexing primary process mentation when awakened from REM-sleep as compared to non-REM awakenings. However, when the associations were scored on the basis of each subject’s individual norms, there was a rebus effect with more idiosyncratic rebus associations in awakenings after REM than after non-REM-sleep. Our results support the general idea that REM-sleep is characterized by primary process thinking, while non-REM-sleep mentation follows the rules of the secondary process. (shrink)

Lonely students typically underperform academically. According to several studies, the COVID-19 pandemic is an important risk factor for increases in loneliness, as the contact restrictions and the switch to mainly online classes potentially burden the students. The previously familiar academic environment, as well as the exchange with peers and lecturers on site, were no longer made available. In our cross-sectional study, we examine factors that could potentially counteract the development of higher education student loneliness during the COVID-19 pandemic from a (...) social network perspective. During the semester, N = 283 students from across all institutional faculties of a German comprehensive university took part in an online survey. We surveyed their social and emotional experiences of loneliness, their self-reported digital information-sharing behavior, and their current egocentric networks. Here, we distinguished between close online contacts and close offline contacts. In addition, we derived the interconnectedness and heterogeneity of students’ contacts. To obtain the latter, we used a novel two-step method combining t-distributed stochastic neighbor embedding and cluster analysis. We explored the associations of the aforementioned predictors on social and emotional loneliness separately using two hierarchical multiple linear regression models. Our results suggest that social loneliness is strongly related to digital information-sharing behavior and the network structure of close contacts. In particular, high information-sharing behavior, high number of close contacts, a highly interconnected network, and a homogeneous structure of close contacts were associated with low social loneliness. Emotional loneliness, on the other hand, was mainly related to network homogeneity, in the sense that students with homogeneous close contacts networks experienced low emotional loneliness. Overall, our study highlights the central role of students’ close social network on feelings of loneliness in the context of COVID-19 restrictions. Limitations and implications are discussed. Cross-sectional studies indicate that normal aging is accompanied by decreases in brain structure. Longitudinal studies, however, are relatively rare and inconsistent regarding their outcomes. Particularly the heterogeneity of methods, sample characteristics and the high inter-individual variability in older adults prevent the deduction of general trends. Therefore, the current study aimed to compare longitudinal age-related changes in brain structure in two large independent samples of healthy older adults ; the Longitudinal Healthy Aging Brain database project at the University of Zurich, Switzerland, (...) and 1000BRAINS at the Research Center Juelich, Germany. Annual percentage changes in the two samples revealed stable to slight decreases in cortical thickness over time. After correction for major covariates, i.e., baseline age, sex, education, and image quality, sample differences were only marginally present. Results suggest that general trends across time might be generalizable over independent samples, assuming the same methodology is used, and similar sample characteristics are present. (shrink)

Integrating artificial intelligence (AI) into critical domains such as healthcare holds immense promise. Nevertheless, significant challenges must be addressed to avoid harm, promote the well-being of individuals and societies, and ensure ethically sound and socially just technology development. Innovative approaches like Embedded Ethics, which refers to integrating ethics and social science into technology development based on interdisciplinary collaboration, are emerging to address issues of bias, transparency, misrepresentation, and more. This paper aims to develop this approach further to enable future projects (...) to effectively deploy it. Based on the practical experience of using ethics and social science methodology in interdisciplinary AI-related healthcare consortia, this paper presents several methods that have proven helpful for embedding ethical and social science analysis and inquiry. They include (1) stakeholder analyses, (2) literature reviews, (3) ethnographic approaches, (4) peer-to-peer interviews, (5) focus groups, (6) interviews with affected groups and external stakeholders, (7) bias analyses, (8) workshops, and (9) interdisciplinary results dissemination. We believe that applying Embedded Ethics offers a pathway to stimulate reflexivity, proactively anticipate social and ethical concerns, and foster interdisciplinary inquiry into such concerns at every stage of technology development. Bioethics has developed approaches to address ethical issues in health care, similar to how technology ethics provides guidelines for ethical research on artificial intelligence, big data, and robotic applications. As these digital technologies are increasingly used in medicine, health care and public health, thus, it is plausible that the approaches of technology ethics have influenced bioethical research. Similar to the “empirical turn” in bioethics, which led to intense debates about appropriate moral theories, ethical frameworks and meta-ethics due to the increased (...) use of empirical methodologies from social sciences, the proliferation of health-related subtypes of technology ethics might have a comparable impact on current bioethical research. This systematic journal review analyses the reporting of ethical frameworks and non-empirical methods in argument-based research articles on digital technologies in medicine, health care and public health that have been published in high-impact bioethics journals. We focus on articles reporting non-empirical research in original contributions. Our aim is to describe currently used methods for the ethical analysis of ethical issues regarding the application of digital technologies in medicine, health care and public health. We confine our analysis to non-empirical methods because empirical methods have been well-researched elsewhere. Finally, we discuss our findings against the background of established methods for health technology assessment, the lack of a typology for non-empirical methods as well as conceptual and methodical change in bioethics. Our descriptive results may serve as a starting point for reflecting on whether current ethical frameworks and non-empirical methods are appropriate to research ethical issues deriving from the application of digital technologies in medicine, health care and public health.
