The use of smart mouthguards in contact sports like rugby aims to enhance player safety by providing real-time data on head impacts. These devices, equipped with sensors, measure collision force and frequency, potentially identifying concussions that might go unnoticed during gameplay. The idea is that such enhanced monitoring will enable teams, physicians and other stakeholders to better protect players from the effects of on-pitch injury through immediate detection of head trauma and the long-term provision of player data. While we welcome (...) the move towards a better understanding of the potential harm that contact sports athletes may experience, introducing a new avenue through which information about player performance and health can be collected brings several areas of ethical concern absent from traditional mouthguards. In this paper, we consider four noteworthy areas: device and data efficacy, player choice, the inherent issues of such data’s existence and the harmful consequences of this data’s usage and exposure. We argue that failing to identify and address the risks associated with smart mouthguards’ employment in the elite sporting sphere not only risks the mistreatment and misapplication of player data but may also jeopardise the acceptability of a novel health monitoring method that has the potential to prevent long-term debilitating diseases. Esta posição partilhada e a procura de uma maior compreensão dos seus objetos de estudo específicos, criou nos profissionais de Arqueologia uma necessidade de recorrerem a várias metodologias (e tecnologias) originárias de outras disciplinas. De forma similar a outras ciências, a Arqueologia é uma área permeável à experimentação e aplicação de conceitos teórico-práticos exógenos que levou, inclusive, à formação de diversas especialidades que unem (...) a Arqueologia e outras áreas, como a Zooarqueologia. Como aconteceu ao longo da sua história, o meio académico está perante um momento de mudança na forma como se processa a aquisição de conhecimento. O fato de estarmos na Era Digital da globalização faz com que a adaptação do meio académico a esta realidade seja mais continuada, não sendo a Arqueologia alheia a esta transformação. Após uma breve introdução ao novo "paradigma digital" das humanidades, revemos alguns dos principais usos de tecnologias relacionadas com o uso da Internet no apoio à investigação em Arqueologia (e.g., bases de dados enriquecidas), e descrevemos algumas questões relacionadas com o uso de novas ferramentas e técnicas, seus principais obstáculos e tendências. BackgroundThe return of genetics and genomics research results has been a subject of ongoing global debate. Such feedback is ethically desirable to update participants on research findings particularly those deemed clinically significant. Although there is limited literature, debate continues in African on what constitutes appropriate practice regarding the return of results for genetics and genomics research. This study explored perspectives and ethical considerations of Ugandan genomics researchers regarding the return of genetics and genomics research results.MethodsThis was a qualitative study that (...) employed in-depth interviews. Thirty participants were purposively selected based on their expertise as genomics researchers in Uganda. Data were analysed through content analysis along the main themes of the study using a comprehensive thematic matrix, to identify common patterns arising from the narratives. NVivo software 12 was used to support data analysis.ResultsThe return of genetics and genomics research results was generally acceptable to researchers, and some indicated that they had previously returned individual or aggregate results to participants and communities. The main reasons cited for sharing research results with participants included their clinical utility, actionability and overall benefit to society. Ethical considerations for appropriate return of results included a need for effective community engagement, genetic counselling prior to disclosure of the results, adequate informed consent, and proper assessment of the implications of, or consequences of returning of results. However, the approaches to return of results were perceived as unstandardized due to the lack of appropriate regulatory frameworks.ConclusionsThe return of genetic and genomic research results is generally acceptable to researchers despite the lack of appropriate regulatory frameworks. Ethical considerations for return of genetics and genomics research results are highly divergent, hence the need for national ethical guidelines to appropriately regulate the practice. (shrink)

This article considers two questions: Do democratic states have the right to deport non-citizens present or residing on their territory? And, if so, what principles should guide deportation in democratic states? The overall objective is to offer an account of what deportation should look like in a liberal democratic state. I begin by situating the practice of deportation in larger discussions of the extent of state discretion in controlling both borders and membership; here, I will argue that potential deportees occupy (...) an awkward middle space, i.e. it is not clear whether they should be treated according to the principles that regulate discretion at the border or discretion in admitting migrants to membership. I then consider more deeply whether deportation can be rendered non-arbitrary, or whether it is bound to remain unjustly applied; where it cannot be rendered non-arbitrary, it must be rejected, or so I shall argue. To be non-arbitrary, the practice of deportation must meet three criteria: a publicity criterion, a justification criterion, and a collective interest criterion. In the final section of the article, I disentangle deportation into its component parts – I distinguish just cause for deportation from just action in deportation – and consider how the criteria that stem from a commitment to non-arbitrariness constrain its application to non-citizen residents. The consequence of requiring deportation to be applied, if at all, in a non-arbitrary way is that there will certainly be cases where liberal democracies find themselves unable to deport those who might otherwise be thought eligible for deportation. Ultimately, I conclude that deportation from liberal democratic states can be fair only in a small number of cases. (shrink)

Hegel remarked in his discussion of the nothing in the Science of Logic that: “It is well known that in oriental systems, and essentially in Buddhism, nothing, or the void, is the absolute principle.” Schopenhauer commented in a discussion of the joy of death in The World as Will and Representation: “The existence which we know he willingly gives up: what he gets instead of it is in our eyes nothing, because our existence is, with reference to that, nothing. The (...) Buddhist faith calls it Nirvana, i.e., extinction.” It is striking how nineteenth-century German philosophical discourses (from Hegel and Schopenhauer to Mainländer, von Hartmann, and Nietzsche) concerning negativity, nihility, and nothingness explicitly refer to Buddhism, which was initially conceived by Christian missionaries as a “cult of nothingness” and became entangled with European debates concerning pessimism (the Pessimismusstreit) and nihilism. In this article, I reconsider how the interpretation of negativity and nothingness in Schopenhauer and nineteenth-century German thought informed the reception of Buddhism as a philosophical and religious discourse, and trace the ways in which Buddhist emptiness was reinterpreted in the context of the Western problematic of being and nothingness. Physicalists about the mind are committed to claims about property identities. Following Kripke's well-known discussion, modal arguments have emerged as major threats to such claims. This paper argues that modal arguments can be resisted by adopting a counterpart theoretic account of modal claims, and in particular modal claims involving properties. Thus physicalists have a powerful motive to adopt non-Kripkean accounts of the metaphysics of modality and the semantics of modal expressions.

The “testing effect” refers to the finding that after an initial study opportunity, testing is more effective for long‐term retention than restudying. The testing effect seems robust and is a finding from the field of cognitive science that has important implications for education. However, it is unclear whether this effect also applies to the acquisition of problem‐solving skills, which is important to establish given the key role problem solving plays in, for instance, math and science education. Worked examples are an (...) effective and efficient way of acquiring problem‐solving skills. Forty students either only studied worked examples (SSSS) or engaged in testing after studying an example by solving an isomorphic problem (STST). Surprisingly, results showed equal performance in both conditions on an immediate retention test after 5 min, but the SSSS condition outperformed the STST condition on a delayed retention test after 1 week. These findings suggest the testing effect might not apply to acquiring problem‐solving skills from worked examples. (shrink)

The hard problem of consciousness is to explain why certain physical states are conscious: why do they feel the way they do, rather than some other way or no way at all? Arthur Reber claims to solve the hard problem. But he does not: even if we grant that amoebae are conscious, we can ask why such organisms feel the way they do, and Reber’s theory provides no answer. Still, Reber’s theory may be methodologically useful: we do not yet have (...) a satisfactory theory of consciousness, but perhaps the study of simple minds is a way to go about finding one. Temporary labour migration programs are often proposed as a way to provide the benefits of migration in general, while mitigating the allegedly problematic effects of permanent migration. Here I propose that the arguments deployed in favour of temporary labour migration over permanent migration are flawed, normatively, and that empirically temporary labour migration programs produce effects in receiving states that are even worse than those (allegedly) produced by permanent migration. As a result, I shall argue that, for reasons of consistency, advocates (...) of restricting permanent migration should support restricting temporary labour migration programs as well. I conclude not by arguing that temporary labour migration programs should be abandoned, but rather that we must focus more seriously on re-constructing temporary labour migration programs that do not produce these dilemmas, as well as on generating policies that alleviate the challenges they often pose in receiving societies. In this paper, I outline a theory of social kinds. A general theory of social kinds has to set out at least three conditions: existence conditions, persistence conditions, and identity conditions. For the sake of expediency, I focus on the existence and persistence conditions. The paper is organized just as life: first with existence, then persistence. I argue that anti-realism is more attractive than realism as an account of the existence conditions, despite the fact that realism has been under-appreciated. Then (...) I argue for a particular theory of the persistence conditions, which I call the basic overlapping traits theory (BOTT), based on an analogy to an approach to personal identity. The upshot of the argument is that from an anti-realist metaphysics we have the capacity to discuss a wider diversity of social phenomena. (shrink)

The very idea of promulgation has been given little to no treatment in the philosophy of law. In this exploratory essay, I introduce three possible theories of promulgation: the ‘no-theory theory’ (which treats promulgation as a matter of particular contexts), the ‘conveyance theory’ (which treats promulgation as a function of intellectual good faith interpreters), and ‘agonistic theory’ (which treats promulgation as indistinguishable from propaganda). I suggest that (at least) three kinds of models are consistent with the theories, and can potentially (...) help us understand when law is successfully promulgated in particular legal contexts: the spread model, the chain model, and the memetic model. I end the paper by comparing the two theories with respect to a case study. Throughout I will show that the conveyance and agonistic theories have a serious advantage over the no-theory theory, in that they allow us to comparatively examine the epistemic weaknesses of diverse theories about the grounding of law on the basis of their contents. Wirth's Nietzsche and Other Buddhas is a thought-provoking work that lucidly engages elements of the philosophy of Friedrich Nietzsche in relation to Buddhist, Kyōto School, and other philosophical sources.This book offers innovative and suggestive strategies for addressing questions of inter- and cross-cultural philosophy in a situation "after comparative philosophy" without an underlying fixed grounding to engage in comparison. The overlap and differences between the parallel regulatory systems for research create ample room for confusion and missteps, as discussed by Barbara Bierer and Mark Barnes in their report in this supplement. This article theorises the relationship between 1970s US Third World queer and feminist movements and Latin American anti-imperialist revolutions of the late twentieth century. I focus upon the historically occluded relationships between Third World feminists and queers in Chile and the United States throughout the transition to neoliberalism. My archive includes June Jordan’s little-known writings on Chile, the writings of Audre Lorde, and, primarily, a 1973 Third World feminist poetry reading staged in San Francisco shortly after the Pinochet coup. By (...) assembling this unconventional archive, I intervene into the domestication of US anti-racist queer, black and feminist of colour politics. I argue for the profoundly internationalist foundation of these formations. I work to re-animate a moment when the affective economies of anti-colonial ‘global revolution’ opened up space for the imagination of joint struggle – allowing a visceral sense of struggle’s urgency and vitality in ways that have since been partially eclipsed. There is little debate that there are important ethical questions that we must answer as we increase our reliance on social networking technologies such as Facebook, Instagram, Twitter and YouTube for our communications, interactions and connections. Social media is at the center of many of our greatest public policy challenges but the moral (or immoral) role it plays in relation to human behavior is far from settled. Part of the difficulty we face in addressing the unique challenges of social networking (...) technologies is discerning the significance of social networking on us. This is because we often begin with an erroneous assumption. The moral significance of technologies generally—not only social networking technologies—is hampered by the insistence that technologies are typically considered objects and we are human, and the province of morality has long been ours. Postphenomenological inquiries can help to fashion technological development in pursuit of understanding how our moral behavior takes shape, but we can also take a critical perspective on who we are and what we are becoming in light of what social networking technologies reveal about the state of our ontological Being.
