Free software introduces a challenge to the classical conception of individual rights. The model of software licensing given by the General Public License generates the question whether it constitutes an exercise or a wavering of copyright. It is argued in this paper that the later alternative is entrenched in the classical concept of freedom as autonomy, which, by its turn, is reflected in a classical conception of individual rights based on the model of propriety as a dominion over an exclusive (...) object (res). We provide grounds for a concept of non-exclusive individual rights, based on the notion of freedom as reciprocity, in order to obtain more solid legal foundations for the free licensing of software. The concept of freedom as reciprocity and the corresponding reconstruction of non-exclusive subjective rights achieved in this paper is an exercise in general theory of law and thus may be applied to other legal fields where the classical notion of freedom and the property of exclusivity do not fit properly. La historia constitucional brasileña apunta para una lógica liberal y una práctica autoritaria desde la Constitución del Imperio (1824). Este hibridismo constitucional explica algunas dificultades en el paso del Estado de Derecho al Estado Social y su complicada síntesis en el Estado Democrático de Derecho de la Constitución actual. El problema está en el modo como las exigencias del Estado Social se hagan dentro de la ley y no por medio de una práctica autoritaria.

Para o direito, o poder é legítimo quando se subordina às regras jurídicas em vigor. Para o poder, o direito é válido na medida em que se torna instrumento da dominação. As relações entre o direito e o poder têm sido objeto das mais diferentes abordagens na sociologia, política ou filosofia. Entre os estudiosos do direito, contudo, o assunto não tem recebido a devida atenção. Infelizmente, porque a contribuição dos juristas para a discussão é bastante peculiar e, portanto, insubstituível. Este (...) livro resulta das reflexões de um profissional do direito sobre um dos mais relevantes aspectos suscitados pelo tema. Nele, discute-se como a produção do conhecimento jurídico é influenciada pelo poder, em uma sociedade capitalista. Depois de apresentar um panorama significativo da teoria política, de Hobbes e Foucault, passando por Weber e os marxistas, o autor centra a sua análise nos fundamentos jurídicos típicos do capitalismo (igualdade, legalidade e legitimidade), para examinar a forma pela qual a doutrina do direito é instrumentalizada na reprodução do poder, e, em certa medida, reage sobre este para ampliá-lo. Com o presente trabalho, Fabio Ulhoa Coelho, professor de direito comercial e de lógica jurídica da Pontifícia Universidade Católica de São Paulo, obteve por esta instituição o título de doutor em direito. Da Banca Examinadora, que o aprovou com distinção, participaram os juristas Tércio Sampaio Ferraz Jr. (orientador), Dalmo de Abreu Dallari, Celso Bastos, Maria Helena Diniz e Eros Roberto Grau. Em razão do seu aprofundamento, abrangência e atualidade, esta obra não pode faltar na bibliografia das disciplinas de teoria geral do estado e filosofia do direito, em nível de graduação ou pós-graduação, interessando também aos estudiosos das demais áreas das ciências humanas. In earlier work, the author has studied the economic role of planning horizons in making a case for complementarity as the predominant feature of social interdependence. This paper compares the different choice strategies implied by substitution, opposition and conflicts of interest in an economics of fear with those arising from horizon effects, economic complementarity and concerts of interest in an economics based on love. The contrasting implications of a psychological literature on negative vs. positive emotions and their health effects, along (...) with the findings in neurophysiological research about how humans are hard-wired for empathy and compassion leads to some fundamental changes in how we might address and revise social problems through economic analysis. The aim of this paper is to extend a horizonal case for complementarity in the author's previous work into its psychological links to research findings on healthy cognitive function and its emotional basis. An economics of substitution yields quite different conclusions about optimal institutional forms and how we address and frame social relations than are implied by an explicitly horizonal economics of complementary social relations. Recent psychological and neurophysiological studies support a horizonal case for complementarity in social relations, showing that our orthodox substitution assumptions and models of competitive equilibrium should be rejected for a renewed economic analysis based on horizonal models of complementarity and cooperation as a means to achieve greater social well-being in a healthier and more integrative form of social organization. The issues to be explored are not entertained within the currently existing frame of orthodox economics, so we must step beyond our standard habitual assumptions. (shrink)

Philosophical defenses of cognitive/evolutionary psychological accounts of racialism claim that classification based on phenotypical features of humans was common historically and is evidence for a species-typical, cognitive mechanism for essentializing. They conclude that social constructionist accounts of racialism must be supplemented by cognitive/evolutionary psychology. This article argues that phenotypical classifications were uncommon historically until such classifications were socially constructed. Moreover, some philosophers equivocate between two different meanings of “racial thinking.” The article concludes that social constructionist accounts are far more robust (...) than psychological accounts for the origins of racialism. Deleuze (1925–1995), in the early 1980s, adopts Peirce’s (1839–1914) semiotics in order to classify the signs that the images of the cinema display. Aiming at insufflating the Peircean principles with the movement that animates the images of cinema, he provides Peirce’s triadic logic with a new category – Zeroness – which stands for the semiotic movement of cinematic images. Deleuze’s new category has impacts on the main domains of Peirce’s philosophy. Accordingly, our inquiry will focus on the irradiation of Zeroness (...) over the (a) system of categories, the (b) Peircean phenomenology (phaneroscopy), the (c) generative categorial role, the (d) semiotic effectiveness, the (e) doctrine of continuity, and the (f) logic of relatives. This article will show that for Deleuze nearly like more recent Peircean scholarship: (a) zeroth state holds a categorial status, (b) some phenomenon instantiates zeroth state, (c) zeroth state plays a generative role regarding Peirce's categories, (d) zeroth state as a phenomenological category is semiotically effective, (e) zeroth state and the doctrine of continuity, and (f) zeroth state is a “medad.” In order to assess these topics, we recover Deleuze’s advances on Peirce’s philosophy and confront them with the Peircean studies on the zeroth state. Finally, we will see that Deleuze, far from being a Peircean scholar, developed the importance of the zeroth state for Peirce’s semiotics in advance to the subsequent Peircean scholarship. Reciprocally, most of Deleuzian scholars understimate the importance of Peirce for Deleuze’s semiotics. (shrink)

This paper shows how Oresme guides the reader of his "Treatise" to a thought in order to connect the organization of political life in the historical process of the 14th Century based on the study on the change in money.

The State of Emergency declaration in Japan due to the COVID-19 pandemic affected many aspects of society in the country, much like the rest of the world. One sector that felt its disruptive impact was education. As educational institutions raced to implement emergency remote teaching (ERT) to continue providing the learning needs of students, some have opened to innovative interventions. This paper describes a case of ERT where Filipino vocabulary was taught to a class of Japanese students taking Philippine Studies (...) in a Japanese university using a cognitive innovation based on virtual reality, an immersive technology often researched for immersion and presence. Students were divided into three groups to experience six lessons designed around virtual reality photo-based tours at different immersion levels. While the effect of immersion on satisfaction was not found to be statistically significant, presence and satisfaction were found to be correlated. Despite challenges that were encountered, benefits like enjoyment, increased engagement, and perceived learning were reported by the students. Our findings exemplify how emerging multisensory technologies can be used to enhance affective and cognitive dimensions of human experience while responding to gaps created by the spatial limitations of remote learning. The main goal of this work is to place the Regional History of Education into the broader context of general history and to create a theoretical structure that includes its main approaches and characteristics while avoiding the frequent confusions and oversights with which it is often associated. Our outline of regional history alludes to its conceptual foundations, defines the object of its analysis and also identifies the convergence of factors that shape this area of study, such as genealogy, multicentrism, comparison (...) and social synthesis. Once these different aspects have been described it will be easier to understand that the past is not only a dependent variable of time but also, to a great degree, of space. (shrink)

QUEM É MESMO EMPREGADO? DILEMAS DA SUBORDINAÇÃO JURÍDICA E O RETORNO DA DEPENDÊNCIA.

O presente artigo busca articular reflexões a partir da teoria da interseccionalidade. Nesse campo, a questão da liberdade é um ponto importante e é antípoda do racismo. A forma pela qual as mulheres negras afirmam a liberdade, individual ou coletivamente, produz resultados políticos e sociais. Neste artigo buscamos analisar a percepção da liberdade no cotidiano. Foram entrevistadas mulheres negras de diferentes níveis de escolaridade, em idade reprodutiva, residentes do sudoeste baiano. A liberdade se apresenta como uma possibilidade que advém de (...) conquistas econômicas e sociais. É, nesse sentido, resultante de lutas coletivas e sociais. O racismo é, então, uma barreira importante a ser considerada a partir da teoria da interseccionalidade. A estruturação de sentidos e significados construídos nas narrativas do cotidiano pode auxiliar na compreensão das condições sociais e de vida das mulheres negras e orientar hipóteses de pesquisa e de ação política. Garrett Sullivan explores the changing impact of Aristotelian conceptions of vitality and humanness on sixteenth- and seventeenth-century literature before and after the rise of Descartes. Aristotle's tripartite soul is usually considered in relation to concepts of psychology and physiology. However, Sullivan argues that its significance is much greater, constituting a theory of vitality that simultaneously distinguishes man from, and connects him to, other forms of life. He contends that, in works such as Sidney's Old Arcadia, Shakespeare's Henry IV and Henry (...) V, Spenser's Faerie Queene, Milton's Paradise Lost and Dryden's All for Love, the genres of epic and romance, whose operations are informed by Aristotle's theory, provide the raw materials for exploring different models of humanness; and that sleep is the vehicle for such exploration as it blurs distinctions among man, plant and animal. O presente texto parte de um diálogo com um artigo publicado recentemente na revista HOPOS (Journal of the International Society for the History of Philosophy of Science), de autoria dos pesquisadores Fons Dewulf e Massimiliano Simons, intitulado “Positivism in Action: The case of Louis Rougier” (2020). No artigo, os pesquisadores abordam a trajetória pouco frequentada de Louis Rougier, filósofo francês cuja fortuna crítica associou-se à sua participação na rede de intelectuais liberais do pós-guerra e a sua função central na organização (...) do Colóquio Walter Lippmann, ainda em 1938. Os autores abordam a trajetória de Rougier de maneira disciplinarmente inusual: procuram interpretar suas teorias filosóficas à luz de seus comprometimentos políticos, defendendo uma imbricação entre ambas as facetas do pensamento de Rougier. Quero sugerir que uma abordagem disposta a compreender as relações dinâmicas entre uma trajetória intelectual e seu entorno social se beneficia de uma abordagem como essa, às quais pode ser acrescida uma dimensão propriamente institucional das trajetórias intelectuais. Para observá-la, proponho acionar o debate sobre virtudes epistêmicas tal como tem sido pensado por autores como Herman Paul, Lorraine Daston e J. Dongen, com o objetivo de investigar se o debate sobre as non-textual things da atividade intelectual podem ser um caminho para transitar de forma profícua entre texto e contexto. Este artigo propõe uma discussão sobre jornalismo e subjetividade a partir de uma argumentação que considera que, embora o discurso hegemônico sobre a instituição se construa a partir do ideal da objetividade, de um texto constituído apenas pelos fatos e cujo autor deixa de ser sujeito para assumir a identidade de jornalista, a subjetividade foi sempre constituidora do texto jornalístico. Assim, pensando a partir dos estudos culturais o jornalismo como uma instituição social com formas, valores e funções conformados historicamente, e (...) os sujeitos como indivíduos que se reconhecem a partir de uma ampla rede de relações de poder, de tradições culturais, de representações de identidades, argumentamos que, em um contexto cada vez maior de centralidade dos sujeitos na cultura contemporânea, os discursos sobre si tem sido uma forte tendência também no jornalismo. This study was a preliminary exploration of the value changes taking place in the United States since the September 11, 2001 terrorist attack on the World Trade Center in New York, which was a significant emotional event or cultural upheaval. Rokeach told us that "a person's total value system may undergo change as a result of socialization, therapy, or cultural upheaval..." (Rokeach, The Nature of Human Values, 1973, p. 37). The researchers explored the value changes of 500 aviation industry employees (...) before the attack and 500 after the attack. The statistically significant research results showed a total of twenty-seven of thirty-six values changed. Before the attack respondents valued much higher self-esteem and self-actualization values like A Sense of Accomplishment and Self-Respect. After the attack respondents placed a much higher value importance on survival, safety and security values like A World at Peace, Freedom, Family Security, National Security, Mature Love, Salvation, and True Friendship.
