Can appealing to children’s rights help to solve the non-identity problem in cases of procreation? A number of philosophers have answered affirmatively, arguing that even if children cannot be harmed by being born into disadvantaged conditions, they may nevertheless be wronged if those conditions fail to meet a minimal standard of decency to which all children are putatively entitled. This paper defends the tenability of this view by outlining and responding to five prominent objections that have been raised against it (...) in the contemporary literature: the identifiability objection; the non-existence objection; the waiving of rights objection, the lack of legitimate complaint objection; and the unfairness objection. On the face of it, conflicting constraints are placed on agents' knowledge of their own action: it is demanded that that which is known is an event happening in the “outside world”, but that the way in which it is known is “from the inside”. I propose to look at the way in which Anscombe sets up this epistemological puzzle and attempts to solve it. I discuss two ways in which Anscombe proposes to dissolve the paradox of agents' knowledge, whereof (...) the first one is rejected. Finally, I discuss different problems for the second way and suggest that we can save the Anscombian framework by rethinking the role of perception in action. (shrink)

In this article I reconsider David Benatar's primary argument for anti‐natalism—the asymmetry argument—and outline a three‐step process for rejecting it. I begin in Part 2 by reconstructing the asymmetry argument into three main premises. I then turn in Parts 3–5 to explain how each of these premises is in fact false. Finally, I conclude in Part 6 by considering the relationship between the asymmetry argument and the quality of life argument in Benatar's overall case for anti‐natalism and argue that it (...) is the latter argument that is actually doing the work. In this sense, the asymmetry argument is not only unsuccessful in generating Benatar's anti‐natalist conclusion, it is also unnecessary as well. (shrink)

Sensation of Movement explores the role of sensation in motor control, bodily self-recognition and sense of agency. The sensation of movement is dependent on a range of information received by the brain, from signalling in the peripheral sensory organs to the establishment of higher order goals. Through the integration of neuroscientific knowledge with psychological and philosophical perspectives, this book questions whether one type of information is more relevant for the ability to sense and control movement. Health professionals do not always have the luxury of making “right” choices. This article introduces the “devil's choice” as a metaphor to describe medical choices that arise in circumstances where all the available options are both unwanted and perverse. Using the devil's choice, the paper criticizes the principle of double effect and provides a re-interpretation of the conventional legal and ethical account of symptom relief in palliative care.

When a person decides to do something in the future, she forms an intention and her intention persists. Philosophers have thought about the rational requirement that an agent’s intention persists until its execution. But philosophers have neglected to think about the causal memory mechanisms that could enable this kind of persistence and its role in rational long-term agency. Our aim of this paper is to fill this gap by arguing that memory for intention is a specific kind of memory. We (...) do this by evaluating and rejecting standard declarative accounts of memory for intention and arguing for the plausibility of an alternative model of memory for intention. We argue for the alternative by spelling out a number of computational principles that could enable retaining and retrieving intentions from long-term memory. The key to the euthanasia debate lies in how best to regulate what doctors do. Opponents of euthanasia frequently warn of the possible negative consequences of legalising physician assisted suicide and active euthanasia while ignoring the covert practice of PAS/AE by doctors and other health professionals. Against the background of survey studies suggesting that anything from 4% to 10% of doctors have intentionally assisted a patient to die, and interview evidence of the unregulated, idiosyncratic nature of underground PAS/AE, this paper (...) assesses three alternatives to the current policy of prohibition. It argues that although legalisation may never succeed in making euthanasia perfectly safe, legalising PAS/AE may nevertheless be safer, and therefore a preferable policy alternative, to prohibition. At a minimum, debate about harm minimisation and the regulation of euthanasia needs to take account of PAS/AE wherever it is practised, both above and below ground. (shrink)

This paper proposes a new framework for investigating neural signals sufficient for a conscious sensation of movement and their role in motor control. We focus on signals sufficient for proprioceptive awareness, particularly from muscle spindle activation and from primary motor cortex (M1). Our review of muscle vibration studies reveals that afferent signals alone can induce conscious sensations of movement. Similarly, studies employing peripheral nerve blocks suggest that efferent signals from M1 are sufficient for sensations of movement. On this basis, we (...) show that competing theories of motor control assign different roles to sensation of movement. According to motor command theories, sensation of movement corresponds to an estimation of the current state based on afferent signals, efferent signals, and predictions. In contrast, within active inference architectures, sensations correspond to proprioceptive predictions driven by efferent signals from M1. The focus on sensation of movement provides a way to critically compare and evaluate the two theories. Our analysis offers new insights into the functional roles of movement sensations in motor control and consciousness. (shrink)

Is it wrong to bring new children into existence when there are so many existing children in need of parental care? Several philosophers have defended the view that prospective parents have a pro tanto​ duty to adopt rather than procreate as a means of fulfilling their interest in parenting. The most prominent argument for this view in the existing literature is the rescue-based argument, which derives an individual duty to adopt rather than procreate from a more general duty to rescue (...) or assist those in need. In this paper, I critically examine the rescue-based argument and explain why it fails. First, I argue that we do not necessarily have a duty to rescue in cases that resemble the global orphan crisis, where one’s intervention is merely sufficient to prevent serious harm to a potential victim. Second, I argue that even if we had such a duty, it would not necessarily generate a duty to adopt rather than procreate given the significant financial, emotional, and agency-related costs of adoption, particularly in current, non-ideal conditions. The upshot of these arguments is that the rescue-based argument can only generate a duty to adopt rather than procreate with respect to a relatively small constituency of orphaned children, many of whom are likely to be adopted anyway by willing volunteers. In the vast majority of cases, then, the rescue-based argument does not entail that it is wrong to create new children when there are already existing children in need of parental care. (shrink)

This chapter argues that explicit self-conscious thinking is founded on an implicit form of self-awareness built into the very structure of phenomenal consciousness. In broad strokes, the argument is that a theory denying the existence of pre-reflective or minimal self-awareness has difficulties explaining a number of essential features of explicit first-person self-reference, and that this will impede a proper understanding of certain types of psychopathology. The chapter proceeds by discussion of a number of prominent theories of self-knowledge and self-reference relating (...) them to forms of self-consciousness. It is then argued that getting these various relations right is important to a proper understanding of a number of psychopathological phenomena. (shrink)

This paper concerns local yet systematic problems of contrastive underdetermination of model choice in cognitive neuroscience debates about the so-called two visual systems hypothesis. The underdetermination problem is systematically generated by the way certain assumptions about the representationalist nature of computation are translated into experimental practice. The problem is that behavioural data underdetermine the choice between competing representational models. In this paper, I diagnose how these assumptions generate underdetermination problems in the choice between competing functional models of perception–action. Using the (...) tools of philosophy of science, I describe the type of underdetermination and sketch a possible cure. (shrink)

Phenomenology of illness has grown increasingly popular in recent times. However, the most prominent phenomenologists of illness defend a psychologizing notion of phenomenology, which argues that illness is primarily constituted by embodied experiences, feelings, and emotions of suffering, alienation etc. The article argues that this gives rise to three issues that need to be addressed. (1) How is the theory of embodiment compatible with the strong distinction between disease and illness? (2) What is the difference between problematic embodiment and illness? (...) (3) How is existential edification, that illness can give rise to according to the phenomenologists, to be understood? The article then engages in an analysis of Heidegger’s and Waldenfels’ phenomenology with the ambition of developing a notion of existence, which can transgress the psychologization of illness. Rather than arguing that illness is constituted by experiences of suffering and alienation, it emphasizes that broaches upon conatively guided activities constitute illness. (shrink)

In this paper, I explore the prospects for risk-based arguments in favour of anti-natalism, which explain the wrongness of procreation in terms of wrongful risk-imposition on the resultant child. After considering and rejecting two risk-based arguments from the existing literature - David Benatar's and Matti Häyry's - I propose a more promising version that focuses on the lack of appropriate justification for imposing the risks of existence, namely, one that refers to the essential interests of the child on whom those (...) risks are imposed. The paper proceeds in four parts. In Part 2, I set the stage for my discussion by clarifying the basic structure of risk-based arguments and identifying some of their important features. In Parts 3-5, I consider three distinct risk-based arguments for anti-natalism and argue that only the third, justificatory argument has the potential to be successful. (shrink)

Medicine is facing wide-ranging challenges concerning the so-called medically unexplained disorders. The epidemiology is confusing, different medical specialties claim ownership of their unexplained territory and the unexplained conditions are themselves promoted through a highly complicated and sophisticated use of language. Confronting the outcome, i.e. numerous medical acronyms, we reflect upon principles of systematizing, contextual and social considerations and ways of thinking about these phenomena. Finally we address what we consider to be crucial dimensions concerning the landscape of unexplained “matters”; fatigued (...) being, pain-full being and dys-ordered being, all expressive momentums of an aesthetic of resistance. There is one concept in medicine which is prominent, the symptom. The omnipresence of the symptom seems, however, not to be reflected by an equally prominent curiosity aimed at investigating this concept as a phenomenon. In classic, traditional or conventional medical diagnostics and treatment, the lack of distinction with respect to the symptom represents a minor problem. Faced with enigmatic conditions and their accompanying labels such as chronic fatigue syndrome, fibromyalgia, medically unexplained symptoms, and functional somatic syndromes, the contestation of (...) the symptom and its origin is immediate and obvious and calls for further exploration. Based on a description of the diagnostic framework encompassing medically unexplained conditions and a brief introduction to how such symptoms are managed both within and outside of the medical clinic, we argue on one hand how unexplained conditions invite us to reconsider and re-think the concept we call a “symptom” and on the other hand how the concept “symptom” is no longer an adequate and necessary fulcrum and must be enriched by socio-cultural, phenomenological and existential dimensions. Consequently, our main aim is to expand both our interpretative horizon and the linguistic repertoire in the face of those appearances we label medically unexplained symptoms. (shrink)

This article is about how to describe an agent’s awareness of her bodily movements when she is aware of executing an action for a reason. Against current orthodoxy, I want to defend the claim that the agent’s experience of moving has an epistemic place in the agent’s awareness of her own intentional action. In “The problem,” I describe why this should be thought to be problematic. In “Motives for denying epistemic role,” I state some of the main motives for denying (...) that bodily awareness has any epistemic role to play in the content of the agent’s awareness of her own action. In “Kinaesthetic awareness and control,” I sketch how I think the experience of moving and the bodily sense of agency or control are best described. On this background, I move on to present, in “Arguments for epistemic role,” three arguments in favour of the claim that normally the experience of moving is epistemically important to one’s awareness of acting intentionally. In the final “Concluding remarks,” I round off by raising some of the worries that motivated the denial of my claim in the first place. (shrink)

In this paper, we propose a new mathematical model of retrieval of intentions from long-term memory. We model retrieval as a stochastic race between a plurality of potentially relevant intentions stored in long-term memory. Psychological theories are dominated by two opposing conceptions of the role of memory in temporally extended agency – as when a person has to remember to make a phone call in the afternoon because, in the morning, she promised she would do so. According to the Working (...) Memory conception, remembering to make the phone call is explained in terms of the construction and maintenance of intentions in working-memory. According to the Long-Term Memory conception, we should explain the episode in terms of an ability to store intentions in long-term memory. The two conceptions predict different processing profiles. The aim of this paper is to present a new mathematical model of the type of memory mechanism that could realise the long-term memory representations of intentions necessary for the Long-Term Memory conception. We present and illustrate the formal model and propose a new type of experimental paradigm that could allow us to test which of the two conceptions provides the best explanation of the role of memory in temporally extended agency. The following article presents preliminary reflections on a processual theory of health and disease. It does this by steering the discussion more toward an ontology of organisms rather than conceptual analysis of the semantic content of the terms “health” and “disease.” In the first section, four meta-theoretical assumptions of the traditional debate are identified and alternative approaches to the problems are presented. Afterwards, the view that health and disease are constituted by a dynamic relation between demands imposed on an organism (...) and individual presuppositions for adequate response is developed. In the last section, the paper takes stock of three possible objections to and clarifies some implications of this approach to the notions of health and disease. (shrink)

Young citizens are increasingly being invited to take part in participatory democracy meetings as joint decision-making has grown popular in public administration. The backbone of participatory democracy is that some authority is granted to the citizenry and by drawing on video data from a year-long participatory project, this conversation analytic study shows that the adolescents are instructed to a deontic role rooted in epistemics, benefactive considerations, as well as temporal aspects relating to future citizenship and hope. The institutional representatives perform (...) actions that determine how the adolescents should, in their turn, perform actions of influence. In this way, authority is ascribed through an ambivalent configuration in which compliance with the directives is supposed to establish a strengthened deontic position. (shrink)

To a large extent liability for ICT perils is still a grey area, even though an increasing number of information security researchers adopt economic approaches to highlight market mechanisms and externalities. That is why this article focuses on the need for increased awareness of externalities and liability among ICT professionals and their customers. This is critical to achieve in order to promote appropriate ICT technologies and services with comprehensible privacy and security protection. What is needed is a better understanding of (...) the consequences of externalities from ICT perils. This would benefit customers and increase trust in ICT products and services which in turn may even increase suppliers' profit margin; customers would be prepared to buy more services and products if contracts and service level agreements would accept more liability. Moreover, suppliers could sell guaranties and insurances on top of their products and services. The result would be a win-win situation and would benefit society at large. (shrink)

This project presents a comparative philosophical approach to understanding key elements in the philosophy of Søren Kierkegaard by juxtaposing his works with the philosophy and theology of the Eastern Orthodox Church.. The primary aim of the project is to look at three key areas of Kierkegaard’s philosophy that have been either underrepresented or misunderstood in the literature. These three areas are: Kierkegaard’s views on sin and salvation, Kierkegaard’s epistemology, and Kierkegaard’s philosophy of personhood. The dissertation ends with an epilogue that (...) briefly explores a further area where this comparative approach might provide fruitful results, namely Kierkegaard’s views on collective worship. I argue that the revolutionary nature of Kierkegaard’s break with prevalent views in the Western Christian traditions (Protestantism and Roman Catholicism) have not always been fully appreciated due to the fact that he is most often read through the lens of either Western Christianity or the Western philosophical traditions that he came to influence (e.g. existentialism and post-modernism). Viewing Kierkegaard in light of the Eastern Christian tradition offers a new interpretive lens that highlights the extent to which Kierkegaard aimed to break free from standard Western accounts of sin and salvation, knowledge of God, and human personhood. The contributions of Professor Bernard Dickens to health law and bioethics span the era in which these fields have emerged as distinct domains of teaching, scholarship and professional and public conversation. Neither field exists in a vacuum. The concerns of bioethics, like the content of health law, are a product of social forces. The bureaucratization of medical care, the possibilities and uncertainties created by developments in medical technology, not to mention glaring health inequalities, have been destabilizing forces in medicine. Writing (...) in 1974, American sociologist Renée Fox noted that medicine had reached “a stage of development characterized by diffuse ethical and existential self-consciousness.” This new medical introspection was evidenced by intense engagement with issues of biomedical regulation, and with the growth of professional codes and processes for resolving value-laden issues within clinical settings.While sometimes described as a process or site for discussion and “engagement,” bioethics evolved rapidly into a domain of governance, with direct implications for clinical practice. As the suspect interview is one of the key elements of a police investigation, it has received a great deal of merited attention from the scientific community. However, suspect interviews in child sexual abuse (CSA) investigations is an understudied research area. In the present mixed-methods study, we examine Swedish (n= 126) and Norwegian (n= 52) police interviewers' self-reported goals, tactics, and emotional experiences when conducting interviews with suspected CSA offenders. The quantitative analyses found associations between the interviewers' self-reported goals, tactics, (...) and emotions during these types of suspect interviews. Interviewers who reported experiencing more negative emotions were more likely to employ confrontational tactics. Specifically, anger was positively associated with the goal of obtaining a confession and with aggressive tactics like raising one's voice and emphasizing the seriousness of the crime. Frustration and disgust displayed similar patterns. Somewhat contrasting these quantitative results, the thematic analysis identified a strong consensus that emotions should not and do not affect the police interviewers' work. Furthermore, the police interviewers described a range of strategies for managing emotions during the interview and for processing their emotional reactions afterwards. The present findings highlight the relevance of emotional processes in CSA suspect interviews and provide an initial exploration of the potentially complex relationship between the goals, tactics, and emotional experiences of police interviewers who question CSA suspects. In law and common-sense morality, it is generally assumed that adults who meet a minimum threshold of parental competency have a presumptive right to parent their biological children. But what is the basis of this right? According to one prominent account, the right to parent one’s biological child is best understood as being grounded in an intimate relationship that develops between babies and their birth parents during the process of gestation. This paper identifies three major problems facing this view—the explanatory, (...) adjudicatory, and theoretical problems—and explains how an alternative autonomy-based account is capable of avoiding them. Medically unexplained symptoms (MUS) remain recalcitrant to the medical profession, proving less suitable for homogenic treatment with respect to their aetiology, taxonomy and diagnosis. While the majority of existing medical research methods are designed for large scale population data and sufficiently homogenous groups, MUS are characterised by their heterogenic and complex nature. As a result, MUS seem to resist medical scrutiny in a way that other conditions do not. This paper approaches the problem of MUS from a philosophical point of (...) view. The aim is to first consider the epistemological problem of MUS in a wider ontological and phenomenological context, particularly in relation to causation. Second, the paper links current medical practice to certain ontological assumptions. Finally, the outlines of an alternative ontology of causation are offered which place characteristic features of MUS, such as genuine complexity, context-sensitivity, holism and medical uniqueness at the centre of any causal set-up, and not only for MUS. This alternative ontology provides a framework in which to better understand complex medical conditions in relation to both their nature and their associated research activity. (shrink)

The aim of this study was to identify and analyse ethical decision making in the home care of persons with long-term mental illness. A focus was placed on how health care workers interpret and deal with the principle of autonomy in actual situations. Three focus groups involving mental health nurses who were experienced in the home care of persons with chronic mental illness were conducted in order to stimulate an interactive dialogue on this topic. A constant comparative analysis of the (...) transcribed audiotaped sessions identified a central theme that concerned the moral symbolic meaning of ‘home’. This reflected the health care workers’ conflict between their professional role and their moral role, which they perceived as unclear. (shrink)

The two questions, “What is public health law?” and “How can law improve the public’s health?”, are perennial ones for public health law scholars. They are ideological questions because perceptions about the proper boundaries of law’s role will shape perceptions of what law can do, in an operational sense, to improve health outcomes. They are also theoretical questions, in the sense that, without closing down debate about the limits of public health law, these questions can be addressed by mapping the (...) range of perspectives on how law might “go to work” for the public’s health. Finally, these are immensely practical questions. On our ability to understand the roles that law can play in public health improvement rests our capacity, as a society, to use law strategically as a policy tool. (shrink)

In a just society, who should be liable for the significant costs associated with creating and raising children? Patrick Tomlin has recently argued that children themselves may be liable on the grounds that they benefit from being raised into independent adults. This view, which Tomlin calls ‘Kids Pay’, depends on the more general principle that a beneficiary can incur an obligation to share in the cost of an essential benefit that the benefactor is responsible for her requiring. I argue in (...) this paper that this principle is both generally false and particularly suspect in the kinds of cases that Tomlin needs it to be true, namely, cases in which a benefactor has created the need to be benefitted to satisfy a self-regarding interest in providing the benefit. In a nutshell, I argue that because parents electively put their children into a needy circumstance for the purpose of satisfying a self-regarding interest in meeting their children’s needs, they lack a legitimate claim against their children to share in its associated costs. The sense of agency is typically defined as the experience of controlling one’s own actions, and through them, changes in the external environment. It is often assumed that this experience is a single, unified construct that can be experimentally manipulated and measured in a variety of ways. In this article, we challenge this assumption. We argue that we should acknowledge four possible agency-related psychological constructs. Having a clear grasp of the possible constructs is important since experimental procedures are only able (...) to target some but not all the possible constructs. The unacknowledged misalignment of the possible constructs of a sense of agency and the experimental procedures is a major theoretical and methodological obstacle to studying the sense of agency. Only if we recognize the nature of this obstacle will we be able to design the experimental paradigms that would enable us to study the responsible computational mechanisms. (shrink)

A dominant view in contemporary cognitive neuroscience is that low-level, comparator-based mechanisms of motor control produce a distinctive experience often called the feeling of agency . An opposing view is that comparator-based motor control is largely non-conscious and not associated with any particular type of distinctive phenomenology . In this paper, I critically evaluate the nature of the empirical evidence researchers commonly take to support FoA-hypothesis. The aim of this paper is not only to scrutinize the FoA-hypothesis and data supposed (...) to support it; it is equally to argue that experimentalists supporting the FoA-hypothesis fail to establish that the experimental outcomes are more probable given the FoA-hypothesis than given the simpler hypothesis. The aim of this article is to describe the synthesis of the concept of moral stress and to attempt to identify its preconditions. Qualitative data from two independent studies on professional issues in nursing were analysed from a hypothetical-deductive approach. The findings indicate that moral stress is independent of context-given specific preconditions: (1) nurses are morally sensitive to the patient’s vulnerability; (2) nurses experience external factors preventing them from doing what is best for the patient; and (3) nurses feel that (...) they have no control over the specific situation. The findings from this analysis are supported by recent research on stress in the workplace but differ in that the imperatives directing work are moral in nature. Stress researchers have found that persons who experience that they have no control over their work situation and at the same time experience high demands may be prone to cardiovascular diseases. An important question raised by this study is whether moral stress should be recognized as a health risk in nursing. Further research is required in order to generate intervention models to prevent or deal with moral stress. (shrink)
