The Anthology of the Works of Ugo Spirito captures the trajectory of Ugo Spirito's complex body of thought that spanned more than fifty years, from 1921 to 1977.

The Cyrenaic school of philosophy (named after its founder Aristippus’ native city of Cyrene in North Africa) flourished in the fifth and fourth centuries BCE. Ugo Zilioli’s book provides the first book-length introduction to the school in English. The book begins by introducing the main figures of the Cyrenaic school beginning with Aristippus and by setting them into their historical context. Once the reader is familiar with those figures and with the genealogy of the school, the book offers an overview (...) of ancient and modern interpretations of the Cyrenaics, to provide readers with alternative accounts of the doctrines they endorsed and of the role they played in the context of ancient thought. Finally, the book offers a reconstruction of Cyrenaic philosophy and shows how the ethical side of their speculation connected with the epistemology and ontology they endorsed and that, as a result, the Cyrenaics were able to offer a quite sophisticated philosophy. Indeed, Zilioli demonstrates that they represented, in ancient philosophy, an important and original metaphysical position and alternative to the kind of realism endorsed by Plato and Aristotle. This book explores how the design, construction, and use of robotics technology may affect today's legal systems and, more particularly, matters of responsibility and agency in criminal law, contractual obligations, and torts. By distinguishing between the behaviour of robots as tools of human interaction, and robots as proper agents in the legal arena, jurists will have to address a new generation of "hard cases." General disagreement may concern immunity in criminal law (e.g., the employment of robot soldiers in battle), personal (...) accountability for certain robots in contracts (e.g., robo-traders), much as clauses of strict liability and negligence-based responsibility in extra-contractual obligations (e.g., service robots in tort law). Protagoras was an important Greek thinker of the fifth century BC, the most famous of the so called Sophists, though most of what we know of him and his thought comes to us mainly through the dialogues of his strenuous opponent Plato. In this book, Ugo Zilioli offers a sustained and philosophically sophisticated examination of what is, in philosophical terms, the most interesting feature of Protagoras' thought for modern readers: his role as the first Western thinker to argue for relativism. Zilioli relates Protagoras' relativism with modern forms of relativism, in particular the 'robust relativism' of Joseph Margolis, gives an integrated account both of the perceptual relativism examined in Plato's Theaetetus and the ethical or social relativism presented in the first part of Plato's Protagoras and offers an integrated and positive analysis of Protagoras' thought, rather than focusing on ancient criticisms and responses to his thought. The paper focuses on concerns and legal challenges brought on by the use of algorithms. A particular class of algorithms that augment or replace analysis and decision-making by humans, i.e. data analytics and machine learning, is under scrutiny. Taking into account Balkin’s work on “the laws of an algorithmic society”, attention is drawn to obligations of transparency, matters of due process, and accountability. This US-centric analysis on drawbacks and loopholes of current legal systems is complemented with the analysis of norms (...) and principles of the EU data protection law, or “GDPR”. The aim is twofold. On the one hand, the intent is to shed light on some crucial differences between the US and EU law on the regulation of algorithmic operators, both public and private. Whereas, in the USA, scholars debate whether and to what extent new duties and responsibilities of algorithmic operators, e.g. information fiduciaries, have to amend the current framework of self-regulation and light government—as shown by the White House’s Office of Science and Technology Policy report from November 2016—in EU law much of the new duties and responsibilities of algorithmic operators have been passed upon them as data controllers. Whether such approaches will successfully tackle the normative challenges of the algorithmic society is, on the other hand, an open issue that will likely represent the main topic of debate over the next years. Disagreement may concern: the terms framing the legal question in e.g. statistical purposes of the data processing; how such terms are related to each other in legal reasoning ; and legal hard cases that will increasingly have to do with the principles that are at stake also but not only in data protection. By entrusting such legal hard cases to algorithms, or some sort of smart artificial agent, humans still bear full responsibility for the judgment of what is socially, ethically, and legally “plain” and “hard” in social affairs. The balance between delegation of decisions to algorithms and non-delegation will be the leitmotiv of the algorithmic society. No single moral theory can instruct us as to whether and to what extent we are confronted with legal loopholes, e.g. whether or not new legal rules should be added to the system in the criminal law field. This question on the primary rules of the law appears crucial for today’s debate on roboethics and still, goes beyond the expertise of robo-ethicists. On the other hand, attention should be drawn to the secondary rules of the law: The unpredictability of robotic (...) behaviour and the lack of data on the probability of events, their consequences and costs, make hard to determine the levels of risk and hence, the amount of insurance premiums and other mechanisms on which new forms of accountability for the behaviour of robots may hinge. By following Japanese thinking, the aim is to show why legally de-regulated, or special, zones for robotics, i.e. the secondary rules of the system, pave the way to understand what kind of primary rules we may want for our robots. In the two golden centuries that followed the death of Socrates, ancient philosophy underwent a tremendous transformation that culminated in the philosophical systematizations of Plato, Aristotle and the Hellenistic schools. Fundamental figures other than Plato were active after the death of Socrates; his immediate pupils, the Socratics, took over his legacy and developed it in a variety of ways. This rich philosophical territory has however been left largely underexplored in the scholarship. Ugo Spirito's Memoirs of the Twentieth Century is the intellectual autobiography of one of the most original and anticonformist contemporary Italian philosophers. In it, Spirito makes an evaluation of his long career (spanning from the decade of the 20's to that of the 70's of the twentieth century) as a thinker who was never satisfied with any theoretical or philosophical system, while constantly aiming at finding a definitive truth: the "incontrovertible" or absolute. The various stages of his search deal with (...) different philosophical and scientific systems - from positivism to actual idealism, from problematicism to omnicentrism, from scientism to neoproblematicism - revealing at the same time an inherent antinomic procedure that does not permit him to take any truth for granted. At the end of his life, Spirito realized that he could only be sure of his present state of "unawareness," thus challenging the validity of his lifelong investigative activity. "Man cannot know himself," Spirito wrote. Confronted with the manifestations of life and universe, he could not help but feel a sense of "surprise and astonishment." Throughout his life, he was only a spectator of his destiny, not the conscious creator of it, as he believed in the early stage of his career. Consequently, he reached a position of negating any value system, bordering on skepticism and nihilism. Within this context, he offered a post-modern interpretation of life. This interpretation was also Spirito's conclusion, and as such, implied a rethinking about other faiths, both political and ideological, that for more than fifty years would develop parallel to philosophical faith. Consequently, he revisited some of the most important philosophical and political personalities who interpreted or materialized those faiths, from Benedetto Croce to Gentile, from Benito Mussolini to Giovanni Bottai, from Togliatti to Pope Paul VI. Spirito was not a thinker who remained secluded within the ivory tower of pure investigation, but in an effort to modify society according to principle of the identification of philosophy with life, he tried to act upon it by following thoughts with action. Memoirs of the Twentieth Century is divided in two parts: one purely autobiographical and theoretical, and the other more historical, where Spirito narrates his relationship with the above-mentioned personalities, as a way of testing the validity of his beliefs. Indeed, one can perceive his moment of adherence to each of the different approaches expounded, only to subsequently detach himself from them. For the English-speaking reader, the second part will appear more interesting and poignant, since Spirito's involvement with history foretells the intellectual fate of a nation. Memoirs of the Twentieth Century is a reflection on life, in which personal history serves as a vehicle for judgment upon an entire century. (shrink)

In order to present a hopefully comprehensive framework of what is the stake of the growing use of robot soldiers, the paper focuses on: the different impact of robots on legal systems, e.g., contractual obligations and tort liability; how robots affect crucial notions as causality, predictability and human culpability in criminal law and, finally, specific hypotheses of robots employed in “just wars.” By using the traditional distinction between causes that make wars just and conduct admissible on the battlefield, the aim (...) is to clarify how advancement of military robotics technology is transforming a 2,000-year-old legal debate on the concept of “just war.” For the first time, legal systems will hold political authorities and military commissioners responsible for what an artificial soldier autonomously decides to do. In this contribution, I explore the treatment that Plato devotes to Protagoras’ relativism in the first section of the Theaetetus (151 E 1–186 E 12) where, among other things, the definition that knowledge is perception is put under scrutiny. What I aim to do is to understand the subtlety of Plato’s argument about Protagorean relativism and, at the same time, to assess its philosophical significance by revealing the inextric¬ability of ontological and epistemological aspects on which it is built (for this (...) latter aspect, I refer to contemporary discussions of relativism, mainly to Margolis’ robust relativism). I then turn to Aristotle’s treatment of Protagoras’ relativism in Metaphysics Γ, sections 5 and 6, in order to show that Plato and Aristotle surprisingly share the same view as regards the philosophical content of Protagoras’ relativism (in doing so, I take position against the standard opinion among scholars that Plato and Aristotle understand Protagoras’ relativism in different, even incompatible, ways). What I ultimately aim to demonstrate is that Protagoras’ relativism, as understood by both Plato and Aristotle, is a coherent, even attractive, philosophical position. (shrink)

The paper examines some aspects of today’s debate on trust and e-trust and, more specifically, issues of legal responsibility for the production and use of robots. Their impact on human-to-human interaction has produced new problems both in the fields of contractual and extra-contractual liability in that robots negotiate, enter into contracts, establish rights and obligations between humans, while reshaping matters of responsibility and risk in trust relations. Whether or not robotrust concerns human-to-robot or even robot-to-robot relations, there is a new (...) generation of cases involving human-to-human contractual and extra-contractual liability for robots’ behaviour because, for the first time, legal systems hold you responsible for what an artificial system autonomously decides to do. This paper starts with an examination of the terms use d to designate the face in different languages, in particular in Italian, comparing these with the definitions provided by some authoritative dictionaries as well as with their etymology. This exploration yields some remarkable results: firstly, it appears that the face is indeed a term that has a material meaning, but at the same time it is a social object; secondly, the importance of the communicative function emerges, which makes the face (...) similar to the mask and in some ways to the arbitrariness of language. All this suggests that the philosophical status of the face is that of ‘transcendence’ which is a condition of that state of freedom that we attribute to ourselves and that can be defined as ‘human exception’. The paper examines today’s debate on the new responsibilities of Internet service providers in connection with legal problems concerning jurisdiction, data processing, people’s privacy and education. The focus is foremost on the default rules and safe harbour clauses for ISPs liability, set up by the US and European legal systems. This framework is deepened in light of the different functions of the services provided on the Internet so as to highlight multiple levels of control over information and, correspondingly, different types (...) of liability. This article examines some of the most relevant issues concerning P2P systems so as to take sides in today's strongly polarized debate. The idea is to integrate a context-based perspective with an ontological representation of informational norms; thanks to a procedural outlook which is presented in terms of burden of proof More particularly, we examine three ''roads." First, the topological approach to complex social networks allows us to comprehend the laws according to which information is distributed through P2P systems and (...) how a "short route" has joined, and sometimes replaced, the traditional "long route" between creator, business, and the public. The second road is the context-based perspective elaborated by Helen Nissenbaum, and developed by Francis Grodzinsky and Herman Tavani: The goal is to determine the norms that govern such an informational flow as norms of appropriateness and distribution. The final road is the informational viewpoint on ethics proposed by Luciano Floridi with the idea that standard ethical theories cannot easily be adapted to deal with the new informational issues emerging with digital technology. While empirical evidence on the impact of P2P systems is still quite controversial, it is crucial to determine on whom the burden of proof falls in a given context, on censors or advocates, by singling out both the default norms and exceptions in the use and development of P2P software. The contribution describes the legal phenomenon as a playing field characterized by a progressive regression of the law, understood as a sovereign will from top to bottom, both in the vision of formalist legal positivisms in continental Europe and in realist terms, in the United States. Soft law represents the main strategy to subordinate the law to the interests of the economy, elasticizing environmental law, making it favorable to the market, reducing ecology to the simplistic metric of CO2 emissions. The (...) consequence is a retreat of the statist vertical normativity of law which is not replaced by a de facto power granted to those who control the technology, built by design to close spaces for pluralism and democratic action, in the interest of surveillance and concentrated power in private and government oligopolies. The author concludes by advocating the urgency for genuinely innovative categories, particularly in the legal education, such as the commons, capable of including sustainability into a “new ecological jurisprudence committed to inclusion and solidarity rather than exclusion and struggle”. In this contribution, I aim to show how locating the Platonic dialogues in the intellectual context of their own time can illuminate their philosophical content. I seek to show, with reference to a specific dialogue (the Theaetetus), how Plato responds to other thinkers of his time, and also to bring out how, by reconstructing Plato’s response, we can gain deeper insight into the way that Plato shapes the structure and form of his argument in the dialogue. In particular, I argue (...) that the subtler thinkers (hoi kompsoteroi) discussed by Plato’s Socrates at Tht. 156a3 are Aristippus and the early Cyrenaics. (Recent scholars, such as Giannantoni and Tsouna, have rejected this identification, which was earlier defended by Schleiermacher, Grote, Zeller and Mondolfo.) Further, I claim that, once we recognise that the subtler thinkers are most likely to be the early Cyrenaics, we can make better sense of the scope and content of the arguments Plato puts forward at Tht. 156a - 160e (especially 156a - 157c). Also, I suggest that this identification helps us to understand a crucial part of Tht. 184b - 186e. Here Plato, in exploring the account of perception offered at 156a - 157c, uses the metaphor of the Wooden Horse to illustrate the conception of perception that he attributes to thinkers such as Protagoras and, in my view, the early Cyrenaics, who maintain that knowledge is a form of perception. Cet article s’attache à comprendre si les cyrénaïques étaient susceptibles d’être attaqués moyennant l’objection d’inactivité et, si oui, comment ils auraient pu essayer d’y répondre et quel type de vision morale ils auraient pu essayer de défendre. En traitant de ces questions, j’évaluerai la légitimité de l’interprétation du scepticisme cyrénaïque offerte par Jules Vuillemin. Je confirmerai ainsi la plausibilité de son interprétation et développerai en même temps l’exploration de la nature et de la portée de la philosophie cyrénaïque.

This paper deals with an important strand of nihilistic arguments to be found in the works of two philosophers who have so far never been studied comparatively: the sophist Gorgias and the Buddhist monk Nāgārjuna. After having reconstructed Gorgias' moves in the first section of On What is Not (Sections 1-4), the paper shows how the nihilist arguments Gorgias uses mostly feature, under a new light, in the philosophy of emptiness developed by Nāgārjuna (Sections 5-8). The paper ends with a (...) hermeneutical suggestion: that is, to replace traditional ‘sceptical’ interpretations of Gorgias and Nāgārjuna with an alternative one, which takes them as possibly committed to nihilism. Il n’hésite pas d’ailleurs à voir derrière ce silence pesant le signe d’une cabale menée par les plus médiocres philosophes, c’est-à-dire ceux qui ne vivent pas, comme lui, pour la philosophie mais de la philosophie....

The use of cyber force can be as severe and disruptive as traditional armed attacks are. Cyber attacks may neither provoke physical injuries nor cause property damages and still, they can affect essential functions of today’s societies, such as governmental services, business processes or communication systems that progressively depend on information as a vital resource. Whereas several scholars claim that an international treaty, much as new forms of international cooperation, are necessary, a further challenge should be stressed: authors of cyber (...) attacks can be non-state actors, and identifying the party responsible for such a use of force, whether non-state actors or national sovereign states, is often impossible. Accordingly, several programmes on online security and national defence have been developed by sovereign states to tackle this menace and yet, the endurance of Western democracies and their aim to protect basic rights have already been tested by such programmes over the past years. The new scenarios of cyber force do not only concern the field of international law, since they may represent the main threat in the fields of national and constitutional law as well. (shrink)

The paper examines the open problems that experts of space law shall increasingly address over the next few years, according to four different sets of legal issues. Such differentiation sheds light on what is old and what is new with today’s troubles of space law, e.g., the privatization of space, vis-à-vis the challenges that AI raises in this field. Some AI challenges depend on its unique features, e.g., autonomy and opacity, and how they affect pillars of the law, whether on (...) Earth or in space missions. The paper insists on a further class of legal issues that AI systems raise, however, only in outer space. We shall never overlook the constraints of a hazardous and hostile environment, such as on a mission between Mars and the Moon. The aim of this paper is to illustrate what is still mostly unexplored or in its infancy in this kind of research, namely, the fourfold ways in which the uniqueness of AI and that of outer space impact both ethical and legal standards. Such standards shall provide for thresholds of evaluation according to which courts and legislators evaluate the pros and cons of technology. Our claim is that a new generation of sui generis standards of space law, stricter or more flexible standards for AI systems in outer space, down to the “principle of equality” between human standards and robotic standards, will follow as a result of this twofold uniqueness of AI and of outer space. The aim of this paper is to assess the evidence on Cyrenaic solipsism and show how and why some views endorsed by the Cyrenaics appear to be committing them to solipsism. After evaluating the fascinating case for Cyrenaic solipsism, the paper shall deal with an (often) underestimated argument on language attributed to the Cyrenaics, whose logic – if I reconstruct it well – implies that after all the Cyrenaics cannot have endorsed a radical solipsism. Yet, by drawing an illuminating parallel (...) with Wittgenstein’s argument on private language and inner sensations, a case is to be made for the Cyrenaics to have subscribed to a sort of ‘residual solipsism’, which in turn helps us to understand the notion of Cyrenaic privacy at a fuller extent. The Jewish Law (Halakahh) is probably the older legal system working in our time. It is established on a hierarchy of different texts. The oldest and more authoritative is the Torah (the five books of Moshe), then come the Mishnah, the Talmud, the compilation as Maimonide’s Mishne Torah and Caro’s Shulchan Arukh, then the responsa of the rabbis. While the authorship of the later texts is more or less clear, the one of the Torah is highly problematic, also in the (...) self-understanding of Jewish hermeneutics. This question is discussed in the present paper not from a philological-historical point of view, but from a semiotic one, trying to understand what devices and regimes of enunciation are enacted by the text in order to establish its semiotic-juridical effects. A special double enunciation frame is proposed as the mark of the legislative power in the text, in correlation with another textual device, a sort of divine “signature”. The further evolution of the authorship of the Jewish Law is discussed in its relation with the question of the autonomy in the interpretation of the sacred text. (shrink)

The presentation delivered by Georges Canguilhem in 1956 at the Philosophical College of Jean Wahl, “What is psychology?”, was praised by Jacques Lacan as a defense of psychoanalysis against the hegemonic claims of psychology. Is psychoanalysis, however, whose own birth is after all included in the genealogy sketched by Canguilhem, really safe from his criticism of psychology? The following contribution takes up the question of the constitutive instrumentalism of psychology mainly with view to three aspects: the relationship between science and (...) truth, the reduction by Gassendi and the Aristotelian tradition of the primal and speculative level of the Cartesian cogito to the specular level of the physical knowledge of the soul by itself, and the Freudian and Lacanian choice of a being-for-death against any philosophy of life. In light of the scientism of psychoanalysis and its relation to myth and to the sacred, which Lacan no better manages to overcome than Freud, a link is finally established both to the archeology of psychoanalysis as developed in The Birth of the Clinic and later in The Will to Knowledge, and to the privilege among the human sciences that Foucault ascribed to psychoanalysis and ethnology in The Order of Things. The present study examined whether emotional text content influences cognitive engagement and transportation during listening (Experiment 1) and reading (Experiment 2) of neutral, horror and erotic stories. In Experiment 1, fluctuation in arousal and cognitive engagement were measured by continuous arousal judgments and head movement recordings during story listening. Participants rated experienced transportation and emotional valence after each story. The results showed that emotional texts were more arousing and induced more transportation than neutral stories. There was less head motion overall (...) and a steeper decrease in head motion across time for erotic than neutral or horror stories. In Experiment 2, participants’ head movements and reading times were recorded during reading, and participants rated experienced transportation, arousal, and valence after each text. The results showed that emotional texts were more arousing and induced higher transportation than neutral stories. There was less head motion during reading of erotic than neutral or horror texts. Horror texts were read slower and recalled better than neutral or erotic texts. The present results show that emotional text content impacts cognitive engagement during listening and reading of literary texts and demonstrates the importance of methodological triangulation when examining cognitive engagement. Studies on the 1616 and 1633 actions brought against Galilei by the Index and the Inquisition generally presumed that part of the documentation was still to be unveiled. This assumption was frequently accompanied by the hypothesis that some available documents were forgeries, merely composed to justify the 1633 condemnation. New documents from the Archive of the Roman Inquisition, including a censure of Saggiatore, official acts concerning the public dissemination of the verdict, and applications for permission to read Galilei¹s works, show (...) that the 1984 edition of his trial was not exhaustive. It is argued, however, that these documents were not concealed intentionally by the Holy Office and their not being found so far has been mainly due to the poor organisation of the Archive. Una presa di posizione, questa, che, già sviluppata in altri precedenti lavori, viene qui riproposta relativamente a H. Gouhier, lo studioso che più di ogni altro, con ricchezza di documenti e sottigliezza di analisi interpretative, ha sostenuto la tesi del “malinteso” e ha individuato nella dottrina della terza nozione primitiva la spiegazione autenticamente cartesiana del rapporto sussistente tra anima e corpo. Una interpretazione di cui nel presentge studio si mostra tutta la debolezza, soprattutto se la si considera alla luce dell’altra dottrina, anch’essa cartesiana, ma di gran lunga più articolata, che fa del rapporto tra anima e corpo un nesso da spiegarsi in analogia al rapporto che nel linguaggio intercorre tra il segno e il suo significato. Often perceived by its contradictors as the main fragility of its system, analogy constitutes however a driving element of the development of Schopenhauerian metaphysics, and makes it possible to avoid the pitfall of theoretical egoism in which any idealistic philosophy can sink. We will try to show, in accordance with the indications of paragraph 19 of The World as Will and Representation, how Schopenhauer understands the totality of the phenomena "by analogy with our body" and establishes the structure of his (...) masterpiece from this analogical dynamic that puts in motion the primitive intuition of his thought.
