How can one distinguish the concept of second modernity from the concept of postmodernity? Postmodernists are interested in deconstruction without reconstruction, second modernity is about deconstruction and reconstruction. Social sciences need to construct new concepts to understand the world dynamics at the beginning of the 21st century.Modernity has not vanished, we are not post it. Radical social change has always been part of modernity. What is new is that modernity has begun to modernize its own foundations. This is what it (...) means to say modernity has become reflexive. It has become directed at itself. This causes huge new problems both in reality and in theory. There has been a pluralization of the boundaries within and between societies, between society and nature, between Us and Other, between life and death. This pluralization also changes the inherent nature of boundaries. They become not so much boundaries as a variety of attempts to draw of boundaries. Border conflicts become transformed into conflicts over the drawing of boundaries. Where postmodernism simply celebrates this multiplication of boundaries, the theory of second modernity starts with the problem this new reality poses for individual and collective decisions, and with the problem that the continued existence of such decisions poses for theory. Institutions that are capable of such conscious boundary drawing are enabled in a way that those of the first modernity were not. But this process also generates qualitatively new kinds of trouble and crises. To investigate those troubles is to unveil the emergence of the second modernity. (shrink)

The discourse on climate politics so far is an expert and elitist discourse in which peoples, societies, citizens, workers, voters and their interests, views and voices are very much neglected. So, in order to turn climate change politics from its head onto its feet you have to take sociology into account. There is an important background assumption which shares in the general ignorance concerning environmental issues and, paradoxically, this is in corporated in the specialism of environmental sociology itself — this (...) is the category of ‘the environment’. If ‘the environment’ only includes everything which is not human, not social, then the concept is sociologically empty. In the evolving landscape of legal information systems, ChatGPT-4 and other advanced conversational agents (CAs) offer the potential to disruptively transform the law industry. This study evaluates commercially available CAs within the German legal context, thereby assessing the generalizability of previous U.S.-based findings. Employing a unique corpus of 200 distinct legal tasks, ChatGPT-4 was benchmarked against Google Bard, Google Gemini, and its predecessor, ChatGPT-3.5. Human-expert and automated assessments of 4000 CA-generated responses reveal ChatGPT-4 to be the first CA to surpass (...) the threshold of solving realistic legal tasks and passing a German business law exam. While ChatGPT-4 outperforms ChatGPT-3.5, Google Bard, and Google Gemini in both consistency and quality, the results demonstrate a considerable degree of variability, especially in complex cases with no predefined response options. Based on these findings, legal professionals should manually verify all texts produced by CAs before use. Novices must exercise caution with CA-generated legal advice, given the expertise needed for its assessment. (shrink)

Systems biology is largely tributary to genomics and other “omic” disciplines that generate vast amounts of structural data. “Omics”, however, lack a theoretical framework that would allow using these data sets as such (rather than just tiny bits that are extracted by advanced data-mining techniques) to build explanatory models that help understand physiological processes. Systems biology provides such a framework by adding a dynamic dimension to merely structural “omics”. It makes use of bottom-up and top-down models. The former are based (...) on data about systems components, the latter on systems-level data. We trace back both modeling strategies (which are often used to delineate two branches of the field) to the modeling of metabolic and signaling pathways in the bottom-up case, and to biological cybernetics and systems theory in the top-down case. We then argue that three roots of systems biology must be discerned to account adequately for the structure of the field: pathway modeling, biological cybernetics, and “omics”. We regard systems biology as merging modeling strategies (supplemented by new mathematical procedures) from data-poor fields with data supply from a field that is quite deficient in explanatory modeling. After characterizing the structure of the field, we address some epistemological and ontological issues regarding concepts on which the top-down approach relies and that seem to us to require clarification. This includes the consequences of identifying modules in large networks without relying on functional considerations, the question of the “holism” of systems biology, and the epistemic value of the “systeome” project that aspires to become the cutting edge of the field. Looking for an adequate explication of the concept of a biological function, several authors have proposed to link function to design. Unfortunately, known explications of biological design in turn refer to functions. The concept of general design I will introduce here breaks up this circle. I specify design with respect to its ontogenetic role. This allows function to be based on design without making reference to the history of the design, or to the phylogeny of an organism, while retaining the (...) normative aspect of function ascriptions. The concept is applicable to the function and design of technical artifacts as well. Several problems well known with other definitions can be overcome by this approach. (shrink)

How do managers think about the relationship between the pursuit of economic success and ethical demands? This paper presents the main results of a qualitative-empirical study (Ulrich and Thielemann, 1992). The range of thinking patterns displayed by Swiss managers in this field of tension is elucidated and typologized. The results are then compared with those yielded by other studies on managerial ethics. Although the comparisons reveal essential parallels, the findings of previous investigations are interpreted in a considerably different manner. (...) In particular it is shown that, on the strength of a systematic conception of the fundamental problem of business ethics, the frequently heard assertion that the vast majority of managers are ethical opportunists must be revised. The internationally prevailing thinking pattern among managers does not prove to be ethical opportunism or even cynicism buteconomism, i.e. theethical conviction that economically appropriate actionin itself is ethically good as such. Successful transitions to a sustainable bioeconomy require novel technologies, processes, and practices as well as a general agreement about the overarching normative direction of innovation. Both requirements necessarily involve collective action by those individuals who purchase, use, and co-produce novelties: the consumers. Based on theoretical considerations borrowed from evolutionary innovation economics and consumer social responsibility, we explore to what extent consumers’ scope of action is addressed in the scientific bioeconomy literature. We do so by systematically reviewing bioeconomy-related publications according to (...) the extent to which consumers are regarded as passive vs. active, and different domains of consumer responsibility. We find all aspects of active consumption considered to varying degrees but observe little interconnection between domains. In sum, our paper contributes to the bioeconomy literature by developing a novel coding scheme that allows us to pinpoint different aspects of consumer activity, which have been considered in a rather isolated and undifferentiated manner. Combined with our theoretical considerations, the results of our review reveal a central research gap which should be taken up in future empirical and conceptual bioeconomy research. The system-spanning nature of a sustainable bioeconomy demands an equally holistic exploration of the consumers’ prospective and shared responsibility for contributing to its coming of age, ranging from the procurement of information on bio-based products and services to their disposal. Fara and Williamson (Mind, 2005) argue that counterpart theory is unable to account for modal claims that use an actuality operator. This paper argues otherwise. Rather than provide a different counterpart translation of the actuality operator itself, the solution presented here starts out with a quantified modal logic in which the actuality operator is redundant, and then translates the sentences of this logic into claims of counterpart theory.

Importance Informed consent is essential to ethical, rigorous research and is important to recruitment and retention in cancer trials.Objective To examine cancer clinical trial (CCT) participants’ perceptions of informed consent processes and variations in perceptions by cancer type.Design and Setting and Participants Cross-sectional survey from mixed-methods study at National Cancer Institute–designated Northeast comprehensive cancer center. Open-ended and forced-choice items addressed: (1) enrollment and informed consent experiences and (2) decision-making processes, including risk-benefit assessment. Eligibility: CCT participant with gastro-intestinal or genitourinary, hematologic-lymphatic (...) malignancies, lung cancer, and breast or gynecological cancer (N = 334).Main Outcome Measures Percentages satisfied with consent process and information provided; and assessing participation’s perceptions of risks/benefits. Multivariable logistic or ordinal regression examined differences by cancer type.Results Most patient-participants felt well informed by the consent process (more than 90% overall and by cancer type) and. most (87.4%) reported that the consent form provided all the information they wanted, although nearly half (44.8%) reported that they read the form somewhat carefully or less. More than half (57.9%) said that talking to research staff (i.e., the consent process) had a greater impact on participation decisions than reading the consent form (2.1%). A third (31.1%) were very sure of joining in research studies before the informed consent process (almost half of lung cancer patients did—47.1%). Most patients personally assessed the risks and benefits before consenting. However, trust in physicians played an important role in the decision to enroll in CCT.Conclusions and Relevance Cancer patients rely less on written features of the informed consent process than on information obtained from the research staff and their own physicians. Research should focus on information and communication strategies that support informed consent from referring physicians, researchers, and others to improve patient risk-benefit assessment and decision-making. This chapter reviews past and present debates about the therapeutic relationship in order to draw out the ethical implications of relational practices in psychotherapy. The therapeutic relationship has been understood differently across psychotherapeutic approaches, with each tradition responding to the attendant ethical challenges in distinctive ways. Aside from practitioners’ theoretical and practical commitments, the therapeutic relationship has also been, and continues to be, shaped by broader societal influences. The chapter discusses the shifting ethical implications of relational practices, then, as situated (...) in their theoretical and historical contexts. The variability of concerns raised by the therapeutic relationship requires continued ethical analysis in order to confront the diversity and complexity of contemporary clinical practice. (shrink)

The paper offers an analysis of Plato’s conception of the care of the self in his Gorgias. There are two components of the self-care: self-knowledge and self-control. The first part deals with self-knowledge. The second part asks the question, wether there can be a fixed model of the individual soul’s order. The third part of the paper deals with Plato’s conception of self-control. The last part is concerned with the problem of a self-control training.

There is substantial support for the general idea that a formalization of comprehenders' expectations about the likely next word in a sentence helps explaining data related to online sentence processing. While much research has focused on syntactic, semantic, and discourse expectations, the present event‐related potentials (ERPs) study investigates neurolinguistic correlates of pragmatic expectations, which arise when comprehenders expect a sentence to conform to Gricean Maxims of Conversation. For predicting brain responses associated with pragmatic processing, we introduce a formal model of (...) such Gricean pragmatic expectations, using an idealized incremental interpreter. We examine whether pragmatic expectancies derived from this model modulate the amplitude of the N400, a component that has been associated with predictive processing. As part of its parameterization, the model distinguishes genuine pragmatic interpreters, who expect maximally informative true utterances, from literal interpreters, who only expect truthfulness. We explore the model's non‐trivial predictions for an experimental setup which uses picture‐sentence verification with ERPs recorded at several critical positions in sentences containing the scalar implicature trigger some. We find that Gricean expectations indeed affect the N400, largely in line with the predictions of our model, but also discuss discrepancies between model predictions and observations critically. The article critically analyses the gaps and the analytical potential in Jürgen Habermas’s The Structural Transformation of the Public Sphere concerning corporate discourses and debates. It is shown that Habermas only analyses the field of work in abstract terms, neglecting in particular corporate public spheres. In contrast, corporate public spheres are developed as an analytical concept, expressed by companies in the form of institutionalized co-determination, situationally granted opportunities for participation and self-willed public spheres of workers. These three fields are discussed (...) using empirical examples. It is shown that corporate public spheres are eroded by precarization and instrumentalized by management. Furthermore, digitalization is working towards a comprehensive algorithmic control of corporate public spheres by companies, but also towards new autonomous communication networks that establish proletarian public spheres, so that both refeudalization and revitalization of corporate public spheres can be observed. Instead of accepting instants of time as metaphysically basic entities, many philosophers regard them as abstractions from something else. There is the Russell-Whitehead view that times are maximal classes of simultaneous events; the linguistic ersatzer's proposal that times are maximally consistent sets of sentences or propositions; and the view that times are made up of temporal parts of material objects. This paper discusses the advantages and disadvantages of these various proposals and concludes in favor of a particular version of linguistic (...) ersatzism about time. (shrink)

Darwin’s claim about natural selection is reconstructed as an empirical claim about a causal connection leading from the match of the physiology of an individual and its environment to leaving surviving progeny. Variations in this match, Darwin claims, cause differences in the survival of the progeny. Modern concepts of fitness focus the survival side of this chain. Therefore, the assumption that evolutionary theory wants to explain reproductive success in terms of a modern concept of fitness has given rise to the (...) so-called tautology problem. It is shown that the tautology problem reappears in the treatment of fitness proxies in today’s experimental evolutionary biology when these proxies are considered to indicate fitness only. Taking Darwin’s empirical claim seriously suggests, by contrast, that fitness proxies are first of all measures of the match between organism and environment, which I call the organism’s ‘fittedness’. At the same time, they are indeed related to reproductive success. Thus looking in both directions, at fitness and at fittedness, they are janiform. Acknowledging this situation not only allows for rejection of the tautology objection, but also for integration of Darwin’s argument into current evolutionary biology. It is suggested that this helps reframe and alleviate the dispute between the Modern Synthesis and the Extended Evolutionary Synthesis. (shrink)

At the same time, however, historians of philosophy are discovering that eclecticism was a distinct and important feature of European intellectual history. In particular eclecticism can be recognized within early modern thinking especially at the end of the seventeenth and the beginning of the eighteenth century, and in France the philosophy of the nineteenth century can be seen as essentially eclectic until the revolution of 1848.Whatever the significance of the postmodern state of mind, recent views concerning philosophical eclecticism are largely the product of researches into the history of philosophy. There is an obvious inclination of today’s intellectual historians to investigate background figures of European modernity. Broadly speaking, philosophical eclecticism turns out to be in general just a claim. It was used by those who did not want to be regarded as dogmatic, sectarian, or systematic thinkers. In resisting attempts to explain the unity of a whole in terms of a multiplicity of interacting parts, quantum mechanics calls for an explanatory concept that proceeds in the opposite direction: from unity to multiplicity. Being part of the Scientific Image of the world, the theory concerns the process by which (the physical aspect of) what Sellars called the Manifest Image of the world comes into being. This process consists in the progressive differentiation of an intrinsically undifferentiated entity. By entering (...) into reflexive spatial relations, this entity gives rise to (i) what looks like a multiplicity of relata if the reflexive quality of the relations is not taken into account, and (ii) what looks like a substantial expanse if the spatial quality of the relations is reified. If there is a distinctly quantum domain, it is a non-spatial and non-temporal dimension across which the transition from the unity of this entity to the multiplicity of the world takes place. Instead of being constituents of the physical world, subatomic particles, atoms, and molecules are instrumental in its manifestation. These conclusions are based on the following interpretive principle and its more direct consequences: whenever the calculation of probabilities calls for the addition of amplitudes, the distinctions we make between the alternatives lack objective reality. Applied to alternatives involving distinctions between regions of space, this principle implies that, owing to the indefiniteness of positions, the spatiotemporal differentiation of the physical world is incomplete: the existence of a real-valued spatiotemporal background is an unrealistic idealization. This guarantees the existence of observables whose values are real per se, as against “real by virtue of being indicated by the values of observables that are real per se.” Applied to alternatives involving distinctions between things, it implies that, intrinsically, all fundamental particles are numerically identical and thus identifiable with the aforementioned undifferentiated entity.
