Kit Fine’s logic of essence and his reduction of modality crucially rely on a principle called the ‘monotonicity of essence’. This principle says that for all pluralities, xx and yy, if some xx belong to some yy, then if it is essential to xx that p, it is also essential to yy that p. I argue that on the constitutive notion of essence, this principle is false. In particular, I show that this principle is false because it says that some (...) propositions are essential to yy even though those propositions are only about some of its members. A central question that arises when interpreting the U.S. Constitution is which theory of interpretation is the best? In his recent book, “How to Interpret the Constitution,” Cass Sunstein reviews various theories of constitutional interpretation currently in vogue and then offers what he believes would be the best approach going forward. In this Article, I want to take up a more basic question presupposed by the very idea of a theory of interpretation. That is, whether it is even possible to (...) arrive at more than a provisional understanding of what would be the best interpretation in any given area of study, including constitutional law. That said, I do believe some of the interpretations suggested by Cass Sunstein and elsewhere by myself and others to be more persuasive than most others, even if only partially so. For, as Sunstein himself points out, no theory seems perfect to figure out the Constitution’s meaning in every possible world in which we could imagine it to exist. So, we best just focus on our own world or what we take to matter in our world. In keeping with this idea, I plan to begin by looking first at how we might interpret the world around us based on our past experiences by considering a somewhat imaginative recent experience of my own. Next, I consider some recent studies in the neurosciences and a previous but highly influential article by the philosopher Donald Davidson concerning conceptual schemes and whether we could ever hope to make any sense of a scheme radically different from our own. Here it should be pointed out that I will use the word “scheme” when referring to a very broad system of thought for which there may not be much outside, versus when I use the word “framework,” as referencing something far narrower than a whole system of thought, even if what is referenced might purport to be a significant part of a still larger system. My goal is to eventually adopt John Rawls’ public reason method to separate out non-workable systems of thought as might be part of a particular religious or philosophical tradition that cannot be easily tied to any other system of thought easily imagined within a pluralistic society. I plan to do this by relating how Rawls’ public reason might allow for the creation of a moral interpretation of the Constitution adopting the moral theory of Alan Gewirth. The latter I adopt because its grounding does not presuppose any prior moral or religious framework. I then apply that interpretative method to five cases Sunstein believes are fixed points in our current constitutional understanding. In short, I plan to isolate out an area of human rights where even very different understandings of the world might be able to meet, while acknowledging that there will still be other areas that simply evade any common connection. I hope what I offer here to be of help for a theory of constitutional interpretation that focuses on morality, without having to compete with various religious frameworks going forward. (shrink)

In this article I review the Supreme Court’s current use of its major questions doctrine to see if the justifications commonly offered for its existence can explain its current use. In the process of doing so, I examine what the doctrine is about, how it came into existence and how the Court has applied it, especially in context to two recent cases, West Virginia v. EPA and Biden v. Nebraska. As both of these cases implicate the regulatory state, I place (...) the primary focus of this article on how the doctrine should apply in context to judicial evaluation of the regulatory state. In so doing, I discover that the Court’s current reliance on constitutional separation of powers and checks and balances analyses seem too narrow both with respect to the concerns of the founding generation but also, and perhaps more importantly, to the Constitution’s goals for the kind of government it sought to establish going into the future. Ontic structuralism or ontic structural realism in the philosophy of physics can be broadly considered as an interpretative strategy providing a set of conceptual and metaphysical tools—or, more ambitiously, an ontological framework—in order to account for central features of current fundamental physics. This article aims to review the main structuralist interpretative moves in the context of our two best fundamental physical theories of matter and spacetime, namely, quantum theory and general relativity. We highlight in particular the structuralist understanding of permutation (...) invariance, entanglement and nonlocality in quantum theory, and of the dynamical features of spacetime, diffeomorphism invariance and background independence in general relativity. This paper critically discusses recent objections that have been raised against the contextual understanding of fundamental physical objects advocated by non-eliminative ontic structural realism. One of these recent objections claims that such a purely relational understanding of objects cannot account for there being a determinate number of them. A more general objection concerns a well-known circularity threat: relations presuppose the objects they relate and so cannot account for them. A similar circularity objection has also been raised within the framework of (...) the weak discernibility claims made in the last few years about quantum particles. We argue that these objections rely either on mere metaphysical prejudice or on confusing the logico-mathematical formalism within which a physical theory is formulated with the physical theory itself. This discussion paper proposes that a meaningful distinction between science and technoscience can be found at the level of the objects of research. Both notions intermingle in the attitudes, intentions, programs and projects of researchers and research institutions – that is, on the side of the subjects of research. But the difference between science and technoscience becomes more explicit when research results are presented in particular settings and when the objects of research are exhibited for the specific interest they hold. (...) When an experiment is presented as scientific evidence, which confirms or disconfirms a hypothesis, this agrees with traditional conceptions of science. When organic molecules are presented for their capacity to serve individually as electric wires that carry surprisingly large currents, this would be a hallmark of technoscience. When engineering science was under philosophical scrutiny it often just involved the question of whether engineering is a spin-off of pure and applied science and their methods. Legal philosophers often ask whether a person has a reason to obey the law simply because it is the law. We ask the contrary question: does a person have a reason to disobey the law simply because it is the law? Many philosophers who have considered the question of disobedience have focused on injustice; others have defended disobedience on libertarian or anarchist grounds. In contrast, we argue that there is a content-independent reason to disobey the law even when it is (...) not unjust, illegitimate, or otherwise undesirable. Legal philosophers generally agree that law claims peremptory authority, but they also generally agree that any duty to obey the law is substantially more limited. We argue that insofar as the law makes inflated claims to authority, it generates a content-independent reason to disobey. This anti-authoritarian principle is grounded in the virtue of clearly communicating one’s political commitments to others within a democratic society. By disobeying, one communicates one’s conviction that the law makes inflated claims to authority. We show how our account of disobedience as such is distinct from more familiar theories of anarchism and civil disobedience and argue that it is applicable whether one lives under conditions of justice or injustice. ABSTRACT This article offers a critique of a deeply engrained tendency to narrate the story of American pragmatism exclusively or primarily in terms of modern European philosophy. While it suggests alternative stories, it is principally a metanarrative, an intentionally polemical story about our entrenched habits of philosophical storytelling. Indeed, the pragmatics of storytelling merits, especially in reference to historical accounts of American pragmatism, critical attention. The seemingly simple question, “What are we doing when we tell the story of this movement (...) in this manner rather than that?” is a truly important one. It is also an avowedly pragmatic question. Climate modelling plays a crucial role for understanding and addressing the climate challenge, in terms of both mitigation and adaptation. It is therefore of central importance to understand to what extent climate models are adequate for relevant purposes, such as providing certain kinds of climate change projections in view of decision-making. In this perspective, the issue of the stability of climate models under small relevant perturbations in their structure seems particularly important. Within this framework, a debate has emerged in the (...) philosophy of science literature about the relevance for climate modelling of the mathematical notion of structural stability. This paper adresses several important foundational and epistemological questions that arise in this context, in particular about the the role of abstract mathematical considerations of a qualitative nature for concrete modelling projects with mainly quantitative purposes. This paper centres on the question as to whether human rights can be reconciled with patriotism. It lays out the more conventional arguments which perceive them as incommensurable concepts. A central aspect of this incommensurability relates to the close historical tie between patriotism and the state. One further dimension of this argument is then articulated, namely, the contention that patriotism is an explicitly political concept. The implicit antagonism between, on the one hand, the state, politics and patriotism, and, on the (...) other hand, human rights, is illustrated via the work of Carl Schmitt. However, in the last few decades there has been a resurgence of interest in patriotism and an attempt to formulate a more moderate form, which tries to reconcile itself with universal ethical themes. Some of these arguments are briefly summarised; the discussion then focuses on Jürgen Habermas’s understanding of constitutional patriotism. This is seen to provide an effective response to Schmitt’s arguments. There are weaknesses in the constitutional patriotic argument which relate to its limited understanding of both the state and politics. This leads me to formulate my own argument for “unpatriotic patriotism.” The discussion then examines and responds to certain potential criticisms of this argument. (shrink)

Technoscience is often perceived as an expression of the primacy of utilitarian values that would take over the field of pure and disinterested science. A number of scientists deplore that the age of science for its own sake is coming to an end, that technologyhas overtaken science. This common view expressed by active scientists is shared by cultural historians. In a paper describing technoscience as a cultural phenomenon, Paul Forman comes to a similar conclusion. He argues that technoscience is a (...) reversal of the values attached to science. Whereas modernity was characterized by the high cultural rank of science and scientists, postmodernity is characterized the loss of confidence and tustworthiness of scientists. Modernity, accroding to Forman rested on the primacy of science to and for technology, post-modernity is characterized by the the primacy of technology over science. The modern assumption that scientfic research would bring about not only knowledge but technological applications in addition, has been superseded in the 1980s according to Formann, and basic research is no longer considered as a key source of technologial innovation. Forman also points to this technological turn is the science studies which more and more identified science and technology. I would like to discuss this interpretation from the case study of converging technologies. By converging technologies I first refer to the current research programs launched in various countries. More precisely I refer to the US program entitled Converging technologies for improving human performances launched in 2002 and the European program CTEKS (Converging technologies for the European Society) launched in 2004. They are especially relevant because science is not even mentioned as they seem to focus exclusively on technology. Should we consider these programmes as the confirmation of Forman's claim about the primacy of technology over science? In a preliminary conceptual analysis I will try to disentangle the notion of technoscience from the vague connotation of utilitarianism. Then I will consider to what extent the views and values attached to converging technologies express a prinacy of technology over science. For this purpose it is useful to distinguish between converging technologies as national research programs and the daily practices of research in which technologies converge. I will argue that the views and values that active scientists attach to their research can deeply differ from that of policy makers. However in no case can technosccience be described as a primacy of technology over science. (shrink)

The emergence of social norms would have been dependent on the evolution of the cognitive capacity for mentalising to multiple orders of intentionality. Common knowledge is a related phenomenon that can solve coordination problems. That the same cognitive and social mechanisms should facilitate both peace and war is resonant with Girard's scapegoat hypothesis on the relationship between violence and religion.

ABSTRACTEven though Émile Meyerson is rightly seen as an opponent of Comte's positivism, analyzing passages of his works with the help of his correspondence shows the ambiguity of his relation to Comte's philosophy. Drawing on Meyerson's remarks about his relation to Comte's philosophy, this article offers a new perspective on the notion of influence, which is too often perceived as passive or unassimilated reception of a stream of ideas. And what makes a philosopher more qualified than anyone else to editorialize in the daily paper? In this book, Descombes's intention is not to offer his own reading of the signs of the times, but to interrogate modern philosophers about how they come up with the barometers they use to tell us about modern reason and the spirit of the (...) times. This text is a translation of two extracts from Vincent Descombes' 2014 book Le parler de soi. The majority of the translation consists of the chapter that Descombes dedicates to discussing Descartes extensively. In this text, Descombes analyzes “egotistical sentences,” or I-statements, beginning with the infamous example from Descartes. From here, he develops a substantial meditation on the nature of the self and its inherent philosophical paradoxes. The “radical question” guiding Descombes is whether or not an egotistical sentence has (...) or implies a subject in the metaphysical sense. The conclusion, ultimately supported in part by Anscombe’s work on “I-thoughts,” explains how it could be that a subject is not implied by an egotistical sentence. (shrink)

The temporal logic KtT4 is the modal logic obtained from the minimal temporal logic Kt by requiring the accessibility relation to be reflexive and transitive. This article aims, firstly, at providing both a model-theoretic and a proof-theoretic characterisation of a four-valued extension of the temporal logic KtT4 and, secondly, at identifying some of the most useful properties of this extension in the context of partial and paraconsistent logics.

Although capital punishment has been gradually disappearing from liberal democracies, philosophers remain divided as to its permissibility. The first part of this chapter considers arguments in favor of retention and abolition, with particular attention to recent contractualist arguments. I then consider the United States Supreme Court’s incrementalist approach, under the rubric of “evolving standards of decency.” On this view, the Constitution is limited to sweeping up stragglers; like Minerva’s owl, the Constitution announces a philosophy of punishment only in hindsight. The (...) final section draws on Feinberg’s suggestion that punishment reflects a society’s particular “symbols of infamy.” A society may come to rethink its symbols of infamy, such as capital punishment, but that is unlikely to be because philosophical argument has silenced all reasonable doubt. Three recent attempts to draw resources for theology from the work of philosopher and social theorist Gillian Rose are examined. Although her work has received little attention, it has been influential in the development of ‘Radical Orthodoxy’. Yet her dense style has led to many misunderstandings of her work. Each of the three attempts to draw theological resources from her work examined is problematic, either because it misrepresents Rose's work or because it reads Rose too narrowly. The outline of a (...) positive account of Rose's philosophy is developed through critical engagements with these three readers. I suggest that an alternative theological appropriation of Rose that focuses on her account of the theological virtues, particularly faith and love, might be possible. (shrink)
