Abstractabstract:In The Trusted Doctor: Medical Ethics and Professionalism (2020), Rosamond Rhodes presents a new theory of medical ethics based on 16 duties she considers central to medical ethics and professionalism. She asserts that her theory is "bioethical heresy," as it contradicts established "principlism" and "common morality" approaches to ethics in medicine. Rhodes advocates the development of parallelism between clinical and ethical decision-making and a systematic approach that emphasizes duties over principles and rules to facilitate the development of a "doctorly character" (...) among medical decision-makers. Rhodes further asserts that her theory and approach necessitate the cultivation of virtues contained in Aristotle's Nicomachean Ethics. But Rhodes's insistence that "medical professionals," not just doctors, are covered by her theory is open to critique, as is her conflation of ethic and morals, especially around the question of the "doctorly character" upon which her duty-based theory hinges. This assessment argues that applicants to medical schools and allied health training programs be screened for specific virtues—honesty, diligence, curiosity, and compassion—to facilitate reinforcement of these pre-professionalized inclinations throughout the habituation processes of medical training. This would increase the probability of turning fear and hope to cure and care via reasoning and affective models performed within an ethical medical framework—even while what this ethical framework should reference remains under debate. Some authors have recently suggested that it is time to consider rights for robots. These suggestions are based on the claim that the question of robot rights should not depend on a standard set of conditions for ‘moral status’; but instead, the question is to be framed in a new way, by rejecting the is/ought distinction, making a relational turn, or assuming a methodological behaviourism. We try to clarify these suggestions and to show their highly problematic consequences. While we find (...) the suggestions ultimately unmotivated, the discussion shows that our epistemic condition with respect to the moral status of others does raise problems, and that the human tendency to empathise with things that do not have moral status should be taken seriously—we suggest that it produces a “derived moral status”. Finally, it turns out that there is typically no individual in real AI that could even be said to be the bearer of moral status. Overall, there is no reason to think that robot rights are an issue now. (shrink)

In this article, I reflect on the nature of innovation to lay the groundwork for a philosophy of innovation. First, I contrast the contemporary techno-economic paradigm of innovation with the work of Joseph Schumpeter. It becomes clear that Schumpeter’s work provides good reasons to question the techno-economic paradigm of innovation. Second, I contrast ‘innovation’ with ‘technology’ and identify five differences between the two concepts. Third, I reflect on the process-outcome dimension and the ontic-ontological dimension of innovation to develop four characteristics (...) of the phenomenon of innovation. These four characteristics move beyond the techno-economic paradigm of innovation and highlight, first, the importance of its process dimension understood as ontogenesis, second, the outcome of innovation, and third, the importance of the ontological dimension of innovation, which is considered adjacent to its fourth characteristic, i.e., the ontic level of the outcome of innovation. In this article, we critically reflect on the concept of biomimicry. On the basis of an analysis of the concept of biomimicry in the literature and its philosophical origin, we distinguish between a strong and a weaker concept of biomimicry. The strength of the strong concept of biomimicry is that nature is seen as a measure by which to judge the ethical rightness of our technological innovations, but its weakness is found in questionable presuppositions. These presuppositions are addressed by the (...) weaker concept of biomimicry, but at the price that it is no longer possible to distinguish between exploitative and ecological types of technological innovations. We move beyond the political paradigm of the conceptualization of management in order to lay the ground for a philosophy of business management. First, we open-up the self-evident conceptualization of business management in contemporary management practices by comparing ancient and contemporary definitions of management. The paper compares ontic structural realism in quantum physics with ontic structural realism about space–time. We contend that both quantum theory and general relativity theory support a common, contentful metaphysics of ontic structural realism. After recalling the main claim of ontic structural realism and its physical support, we point out that both in the domain of quantum theory and in the domain of general relativity theory, there are objects whose essential ways of being are certain relations so that these objects (...) do not possess an intrinsic identity. One of the pressing issues in philosophy of technology is the role of human creativity in human-technology relations. We first observe that a techno-centric orientation of philosophy of technology leaves open the role and contribution of human creativity in technological evolution, while an anthropocentric orientation leaves open the role of the technical milieu in technological evolution. Subsequently, we develop a concept of creation as deviation and responsiveness in response to affordances in the environment, inspired by the affordance theory by James (...) Gibson. With this concept of creation as deviative responsiveness, we articulate the human contribution to human-technology creation, namely, our intentional deviation of the inhibiting forces of the currently dominant niche or meaningful world of human-technology relations, in order to become responsive to new affordances in human-technology creation that constitute a new niche or world of human-technology relations. Much of cognitive science is committed to the modular approach to the study of cognition. The core of this approach consists of a pair of assumptions - the anatomical and the functional modularity assumptions - which motivate two kinds of inference: the anatomical and the functional modularity inferences. The legitimacy of both of these inferences has been strongly challenged, a situation that has had surprisingly little impact on most theorizing in the field. Following the introduction of an important, yet rarely (...) made, distinction between two functional concepts - the distinction between cognitive working and cognitive role - this paper analyses these kinds of inference, and refocuses the attention on new aspects of their main limitations. It is argued that both the anatomical and functional modularity inferences can, and do, operate in three distinct modes in contemporary cognitive science, and that seeing this is essential to understanding both the power and the limitations of these methodological tools. The current World Anti-doping Code can be characterised as a tough approach to doping. In this paper we investigate how the World Anti-Doping Agency justifies this tough approach. To this end, WADA advances two justificatory arguments. It maintains, first, that protection of the spirit of sport warrants tough measures and, second, that athletes have voluntarily consented to the Code. We argue that in the way they are presented by WADA, neither of these arguments can withstand scrutiny. In the second part (...) of the paper, we go on to show that these arguments are in fact ideological in nature. The specific aim of these arguments is not to be correct, but rather to distort social reality, because in this way they can be used to ward off any critical discussion of the Code. This paper pertains to research works aiming at linking ethics and automated reasoning in autonomous machines. It focuses on a formal approach that is intended to be the basis of an artificial agent’s reasoning that could be considered by a human observer as an ethical reasoning. The approach includes some formal tools to describe a situation and models of ethical principles that are designed to automatically compute a judgement on possible decisions that can be made in a given situation and (...) explain why a given decision is ethically acceptable or not. It is illustrated on three ethical frameworks—utilitarian ethics, deontological ethics and the Doctrine of Double effect whose formal models are tested on ethical dilemmas so as to examine how they respond to those dilemmas and to highlight the issues at stake when a formal approach to ethical concepts is considered. The whole approach is instantiated on the drone dilemma, a thought experiment we have designed; this allows the discrepancies that exist between the judgements of the various ethical frameworks to be shown. The final discussion allows us to highlight the different sources of subjectivity of the approach, despite the fact that concepts are expressed in a more rigorous way than in natural language: indeed, the formal approach enables subjectivity to be identified and located more precisely. In this paper, I first introduce one of the most prominent objections against the Growing Block Theory of time (GBT), the so-called ‘epistemic objection’, according to which GBT provides no way of knowing that our time is the objective present and, therefore, leads at best to absolute skepticism about our temporal location, at worst to the quasi-certainty that we are located in the objective past. Secondly, I express my dissatisfaction regarding the various traditional attempts to address this objection, especially Merricks (...) (2006), Forrest (2004) and Correia and Rosenkranz (2018). Thirdly, I show that the passage of time leads to an anti-essentialist picture of natural kinds. Finally, I develop my own solution to the epistemic objection, based on the continued existence of bare particulars. (shrink)

This essay engages with Bernard Stiegler’s discussion with Martin Heidegger in The ordeal of Truth, published in Foundations of Science 2020. It appreciates Stiegler’s progressive reading of Heidegger’s work but critically reflects on several elements in his work. A first element is the methodological aspect of Heidegger’s being historical thinking, which is missed by Stiegler and confirms the indifference towards philosophical method that can be found in the work of many contemporary philosophers. A second element concerns Heidegger’s and Stiegler’s remaining (...) humanism and the necessity to move beyond humanism and post-humanism in the era of global warming. A third element of reflection concerns Stiegler’s idea of the obligation of making our being-in-default come true, which shows a hidden metaphysical orientation in his work. (shrink)

On a souvent considéré qu'une philosophie de l'esprit devait choisir parmi les traits distinctifs du mental celui qu'elle retiendrait pour le mettre en relief. Il ne serait pas possible de faire place dans une même philosophie aux trois faits majeurs : l'intentionnalité du mental (on discerne les pensées de quelqu'un en disant à quoi il pense), le holisme du mental (impossible de concevoir un état d'esprit isolé du tout d'une vie mentale), la part impersonnelle du mental (les acteurs ne manifestent (...) pas seulement des capacités mentales attachées à leurs personnes respectives, mais aussi des manières de penser communes, des institutions de sens formant ce qu'on appelle un esprit objectif). Ainsi, les théories intentionalistes de l'esprit ont généralement exalté le sujet aux dépens des totalités symboliques, tandis que les théories des structures de l'esprit ont paru faire de l'acteur un simple figurant sur la scène du signifiant. De tels partis pris signalent l'échec de bien des philosophes à concevoir clairement les conditions d'une analyse holiste des phénomènes de l'esprit. Ce livre utilise les ressources analytiques de la logique des relations de C.S. Peirce pour développer une conception holiste de l'intentionnalité de l'esprit (tant subjectif qu'objectif). The author was able to present in parallel way three different perspectives under which the issues discussed in the book might be approached.

In this article, we philosophically reflect on the nature of corporate governance. We raise the question whether control is still a feasible ideal of corporate governance and reflect on the implications of the epistemic insufficiency of economic institutions with regard to grand challenges like of global warming for our conceptualization of corporate governance. We first introduce the concept of corporate governance from the perspective of economics and politics. We then trace the genealogy of the concept of governance based on a (...) selective reading of Giorgio Agamben’s work, who has pointed at two interdependent paradigms of governance in the Christian tradition, and apply his categories in the context of corporate governance. We finally engage in a critical reflection on the concept of corporate governance and develop four characteristics of corporate governance that can guide future conceptual as well as empirical research in the field of corporate social responsibility of economic institutions. Recent studies have shown that self‐explanation is an effective metacognitive strategy, but how can it be leveraged to improve students' learning in actual classrooms? How do instructional treatments that emphasizes self‐explanation affect students' learning, as compared to other instructional treatments? We investigated whether self‐explanation can be scaffolded effectively in a classroom environment using a Cognitive Tutor, which is intelligent instructional software that supports guided learning by doing. In two classroom experiments, we found that students who explained their steps during problem‐solving (...) practice with a Cognitive Tutor learned with greater understanding compared to students who did not explain steps. The explainers better explained their solutions steps and were more successful on transfer problems. We interpret these results as follows: By engaging in explanation, students acquired better‐integrated visual and verbal declarative knowledge and acquired less shallow procedural knowledge. The research demonstrates that the benefits of self‐explanation can be achieved in a relatively simple computer‐based approach that scales well for classroom use. (shrink)

Quentin Meillassoux’s call for realism is a call for a new interest in the Earth as un-correlated being in philosophy. Unlike Meillassoux, Martin Heidegger has not been criticized for being a correlationist. To the contrary, his concept of the Earth has to be understood as un-correlated being, as it is opposed to the world as correlated being. First, this interpreta­tion of Heidegger’s concept of the Earth solves various problems of interpretation that are present in the secondary literature. Second, Heidegger’s characterization (...) of the Earth in the end remains unthought in his work. Third, in the age of global warming Meillassoux’s call for realism can help to conceive planet Earth as the ontic-ontological origin of the Heideggerian strife between Earth and world. (shrink)

Kit Fine’s logic of essence and his reduction of modality crucially rely on a principle called the ‘monotonicity of essence’. This principle says that for all pluralities, xx and yy, if some xx belong to some yy, then if it is essential to xx that p, it is also essential to yy that p. I argue that on the constitutive notion of essence, this principle is false. In particular, I show that this principle is false because it says that some (...) propositions are essential to yy even though those propositions are only about some of its members. Digital ethics, also known as computer ethics or information ethics, is now a lively field that draws a lot of attention, but how did it come about and what were the developments that lead to its existence? What are the traditions, the concerns, the technological and social developments that pushed digital ethics? How did ethical issues change with digitalisation of human life? How did the traditional discipline of philosophy respond? The article provides an overview, proposing historical epochs: ‘pre-modernity’ prior to (...) digital computation over data, via the ‘modernity’ of digital data processing to our present ‘post-modernity’ when not only the data is digital, but our lives themselves are largely digital. This article discusses the peculiar features of quantum entanglement and quantum non-locality within the algebraic approach to relativistic quantum field theory (RQFT). The debate on the ontology of RQFT is considered in the light of these well-known but little discussed features. In particular, this article examines the ontic structural realist understanding of quantum entanglement and quantum non-locality and its contribution to this debate.

Cognition is commonly taken to be computational manipulation of representations. These representations are assumed to be digital, but it is not usually specified what that means and what relevance it has for the theory. I propose a specification for being a digital state in a digital system, especially a digital computational system. The specification shows that identification of digital states requires functional directedness, either for someone or for the system of which it is a part. Background: Dementia care at home often involves decisions in which the caregiver must weigh safety concerns with respect for autonomy. These dilemmas can lead to situations where caregivers provide care against the will of persons living with dementia, referred to as involuntary treatment. To prevent this, insight is needed into how family caregivers of persons living with dementia deal with care situations that can lead to involuntary treatment. Objective: To identify and describe family caregivers’ experiences regarding care decisions for situations (...) that can lead to involuntary treatment use in persons living with dementia at home. Research design: A qualitative descriptive interview design. Data were analysed using the Qualitative Analysis Guide of Leuven. Participants and research context: A total of 10 family caregivers providing care for 13 persons living with dementia participated in in-depth semi-structured interviews. Participants were recruited by registered nurses via purposive sampling. Ethical consideration: The study protocol was approved by the Ethics Committee of the University Hospitals Leuven and the Medical Ethical Test Committee Zuyderland. Findings: Family caregivers experience the decision-making process concerning care dilemmas that can lead to involuntary treatment as complicated, stressful and exhausting. Although they consider safety and autonomy as important values, they struggle with finding the right balance between them. Due to the progressive and unpredictable nature of dementia, they are constantly seeking solutions while they adapt to new situations. Family caregivers feel responsible and experience social pressure for the safety of persons living with dementia. They may be blamed if something adverse happens to the persons living with dementia, which increases an already stressful situation. Their experience is influenced by characteristics of the care triad (persons living with dementia, professional and family caregivers) such as practical and emotional support, knowledge, and previous experiences. Discussion and conclusion: To prevent involuntary treatment, professionals need to proactively inform family caregivers, and they need to support each other in dealing with complex care situations. Through a better understanding of these topics, the philosophy of AI contributes to our understanding of the nature, prospects, and value of AI. Western democracies experience profound conflicts that induce concerns about polarization and social cohesion. Yet although conflicts are a core feature of democracies, the forms, functions, and dynamics of democratic conflicts have rarely been subject of political theory. This paper aims at furthering our understanding of democratic conflicts. It analyzes the theory of conflict in Mouffe's agonistic pluralism, confronts it with sociological conflict theory, and presents concrete points of departure for a more comprehensive theory of democratic conflicts. The paper, thus, contributes (...) to two lines of research: (1) Regarding agonistic theories, the paper shows that agonistic pluralism fails to provide a convincing theory of conflict since it underestimates the mechanisms and effects of conflict dynamics (e.g. intergroup cohesion, intragroup conflict, domination, and escalation) and fails to account for the variety of conflict interactions. Proponents of agonistic pluralism should therefore invest more into clarifying their core concept. (2) For a general account of democratic conflicts, the paper proposes to pursue interdisciplinary research on the cognitive concepts shaping conflict interactions, the linked practices of conflict regulation, and the processual dynamics of conflicts. Athenians of the fifth and fourth centuries claimed with pride that their ancestors had always lived in Attica, a claim which they expressed by describing themselves as Related to this Athenian belief that they had always lived in Attica was a second, that, as a people, they were literally ‘sprung from the earth’. It is generally assumed that both beliefs developed at a very early date, but this is merely an assumption, and in the course of this paper we will (...) see evidence suggesting, to the contrary, that both ideas were relatively late developments. This paper focuses on the development of the concept of autochthony, as far as our sources allow, in an effort to understand better what autochthony meant to the Athenians. In particular it considers how the Athenians came to think of themselves as ‘born from the earth’. It then suggests how, through the medium of the word the idea of being ‘born from the earth’ came to symbolize ‘living in a place from time immemorial’. Finally it examines how the concept of autochthony was used in contexts which relate it to the ideology of Athenian democracy. (shrink)

In this article, we draw upon the notion that employees’ work characteristics are an important pathway through which leaders influence employee well-being and propose a theoretical framework that integrates perspectives on leadership, occupational stress, and job design. Based on this integrative approach, we developed the health- and development-promoting leadership behavior questionnaire (HDLBQ) for assessing job demands emanating from and job resources provided through the leader. Validation of the measure in German, French, and English using an overall sample of 2,934 employees (...) demonstrated adequate psychometric properties. An examination of the factorial structure revealed three higher-order factors: demanding, development-oriented, and support-oriented leadership. Multigroup confirmatory factor analysis indicated structural equivalence across the three language versions of the HDLBQ. Correlations with employee well-being were moderate, and the HDLBQ explained unique variance in employee well-being beyond that explained by transformational leadership. Suggestions for applications of the HDLBQ and approaches to enhance employee well-being at the workplace are discussed. (shrink)

Although many active scientists deplore the publicity about Drexler's futuristic scenario, I will argue that the controversies it has generated are very useful, at least in one respect. They help clarify the metaphysical assumptions underlying nanotechnologies, which may prove very helpful for understanding their public and cultural impact. Both Drexler and his opponents take inspiration from living systems, which they both describe as machines. However there is a striking contrast in their respective views of molecular machineries. This paper based on (...) semipopular publications is an attempt to characterize the rival models of nanomachines and to disentangle the worldviews underpinning the uses of biological reference on both sides. Finally, in an effort to point out the historical roots of the contrast in the concepts of nanomachines, I raise the question of a divide between two cultures of nanotechnology. (shrink)

In this article, we reflect critically on how moral actions are categorised in some recent studies on moral spillovers. Based on classic concepts from moral philosophy, we present a framework to categorise moral actions. We argue that with a finer classification of moral values, associated behaviour is better understood, and this understanding helps to identify the conditions under which moral licensing takes place. We illustrate our argument with examples from the literature on pro-environmental behaviours. Moral spillovers are frequently studied in (...) this behavioural domain and to understand what causes their occurrence is highly (policy) relevant if we wish to promote sustainable behaviour. A central question that arises when interpreting the U.S. Constitution is which theory of interpretation is the best? In his recent book, “How to Interpret the Constitution,” Cass Sunstein reviews various theories of constitutional interpretation currently in vogue and then offers what he believes would be the best approach going forward. In this Article, I want to take up a more basic question presupposed by the very idea of a theory of interpretation. That is, whether it is even possible to (...) arrive at more than a provisional understanding of what would be the best interpretation in any given area of study, including constitutional law. That said, I do believe some of the interpretations suggested by Cass Sunstein and elsewhere by myself and others to be more persuasive than most others, even if only partially so. For, as Sunstein himself points out, no theory seems perfect to figure out the Constitution’s meaning in every possible world in which we could imagine it to exist. So, we best just focus on our own world or what we take to matter in our world. In keeping with this idea, I plan to begin by looking first at how we might interpret the world around us based on our past experiences by considering a somewhat imaginative recent experience of my own. Next, I consider some recent studies in the neurosciences and a previous but highly influential article by the philosopher Donald Davidson concerning conceptual schemes and whether we could ever hope to make any sense of a scheme radically different from our own. Here it should be pointed out that I will use the word “scheme” when referring to a very broad system of thought for which there may not be much outside, versus when I use the word “framework,” as referencing something far narrower than a whole system of thought, even if what is referenced might purport to be a significant part of a still larger system. My goal is to eventually adopt John Rawls’ public reason method to separate out non-workable systems of thought as might be part of a particular religious or philosophical tradition that cannot be easily tied to any other system of thought easily imagined within a pluralistic society. I plan to do this by relating how Rawls’ public reason might allow for the creation of a moral interpretation of the Constitution adopting the moral theory of Alan Gewirth. The latter I adopt because its grounding does not presuppose any prior moral or religious framework. I then apply that interpretative method to five cases Sunstein believes are fixed points in our current constitutional understanding. In short, I plan to isolate out an area of human rights where even very different understandings of the world might be able to meet, while acknowledging that there will still be other areas that simply evade any common connection. I hope what I offer here to be of help for a theory of constitutional interpretation that focuses on morality, without having to compete with various religious frameworks going forward. (shrink)

There is much discussion about whether the human mind is a computer, whether the human brain could be emulated on a computer, and whether at all physical entities are computers (pancomputationalism). These discussions, and others, require criteria for what is digital. I propose that a state is digital if and only if it is a token of a type that serves a particular function - typically a representational function for the system. This proposal is made on a syntactic level, assuming (...) three levels of description (physical, syntactic, semantic). It suggests that being digital is a matter of discovery or rather a matter of how we wish to describe the world, if a functional description can be assumed. Given the criterion provided and the necessary empirical research, we should be in a position to decide on a given system (e.g. the human brain) whether it is a digital system and can thus be reproduced in a different digital system (since digital systems allow multiple realization). In this paper, we propose a Simondonian interpretation of quantum mechanics taking as a standpoint his “preindividual hypothesis” in order to consider the problem of contextuality. We will examine whether the epistemological obstacle produced by the notion of entity can be bypassed by specifying, according to Simondon and the Kochen-Specker Theorem, the mode of existence of quantum potentialities.

The paper presents a paradoxical feature of computational systems that suggests that computationalism cannot explain symbol grounding. If the mind is a digital computer, as computationalism claims, then it can be computing either over meaningful symbols or over meaningless symbols. If it is computing over meaningful symbols its functioning presupposes the existence of meaningful symbols in the system, i.e. it implies semantic nativism. If the mind is computing over meaningless symbols, no intentional cognitive processes are available prior to symbol grounding. (...) In this case, no symbol grounding could take place since any grounding presupposes intentional cognitive processes. So, whether computing in the mind is over meaningless or over meaningful symbols, computationalism implies semantic nativism. (shrink)

The aim of this thematically unified anthology is to track the history of epistemic logic, to consider some important applications of these logics of knowledge and belief in a variety of fields, and finally to discuss future directions of research with particular emphasis on 'active agenthood' and multi-modal systems. It is accessible to researchers and graduate students in philosophy, computer science, game theory, economics and related disciplines utilizing the means and methods of epistemic logic.

In this article I review the Supreme Court’s current use of its major questions doctrine to see if the justifications commonly offered for its existence can explain its current use. In the process of doing so, I examine what the doctrine is about, how it came into existence and how the Court has applied it, especially in context to two recent cases, West Virginia v. EPA and Biden v. Nebraska. As both of these cases implicate the regulatory state, I place (...) the primary focus of this article on how the doctrine should apply in context to judicial evaluation of the regulatory state. In so doing, I discover that the Court’s current reliance on constitutional separation of powers and checks and balances analyses seem too narrow both with respect to the concerns of the founding generation but also, and perhaps more importantly, to the Constitution’s goals for the kind of government it sought to establish going into the future. Qu’est-ce que ce silence, ce mépris ou cette méconnaissance nous enseignent sur le régime du savoir en chimie? En abordant les problématiques posées par les théories de la matière et en étudiant la question du corps du chimiste et de son statut social, ce volume s’interroge aussi sur l’image de la chimie et sur le rejet du « chimique » au profit du « naturel » très en vogue aujourd’hui. " Où placez-vous l'esprit? " demandons-nous aux philosophes qui nous parlent du mental. Or il y a deux réponses qui s'offrent à nous dedans, selon les héritiers mentalistes de Descartes, de Locke, de Hume et de Maine de Biran, héritiers parmi lesquels on peut compter les phénoménologues et les cognitivistes ; dehors, selon les philosophes de l'esprit objectif et de l'usage public des signes, comme l'ont soutenu par exemple Peirce et Wittgenstein. Mon propos dans ce livre est double. Il est (...) d'abord de soutenir la thèse de l'extériorité de l'esprit : l'esprit doit être placé dehors, dans les échanges entre les personnes, plutôt que dedans, dans un flux interne de représentations. Il est ensuite d'apprécier la différence entre ces deux réponses du point de vue des sciences morales, ou " sciences de l'esprit ". Cela permet de considérer dans des termes nouveaux la controverse sur les sciences humaines qui n'a pas cessé pendant tout ce siècle : herméneutique contre positivisme, philosophie du sujet contre structuralisme, individualisme méthodologique contre holisme du mental.
