In this article, we develop a concept of stakeholder dialogue in responsible innovation (RI) processes. The problem with most concepts of communication is that they rely on ideals of openness, alignment and harmony, even while these ideals are rarely realized in practice. Based on the work of Burke, Habermas, Deetz and Levinas, we develop a concept of stakeholder dialogue that is able to deal with fundamentally different interests and value frames of actors involved in RI processes. We distinguish four main (...) characteristics of stakeholder dialogue. Dialogical responsiveness (1) enhances self-criticism, (2) is characterized by the constitution and the destruction of the self or identity of the actors involved, (3) consists only in the actual enactment of the dialogue and (4) is primarily responsive to the grand challenges of our time. This paper aims to contribute to the ongoing conceptual debate on responsible innovation, and provides innovation practices and processes that can help to implement responsible innovation in the business context. Based on a systematic literature review of 72 empirical scholarly articles, it was possible to identify, analyse and synthesise empirical findings reported in studies on social, sustainable and responsible innovation practices in the business context. The synthesis of the included articles resulted in a refined framework for responsible innovation in the (...) business context. This framework includes an overview of innovation practices and processes that can enhance the dimensions of responsible innovation: anticipation, reflexivity, inclusion, deliberation, responsiveness and knowledge management. Additionally, knowledge gaps are identified and a research agenda for responsible innovation is proposed. This review can therefore serve as a next step in the theoretical and practical development of responsible innovation in general, and in the business context in particular. (shrink)

In this paper it is argued that existing ‘self-representational’ theories of phenomenal consciousness do not adequately address the problem of higher-order misrepresentation. Drawing a page from the phenomenal concepts literature, a novel self-representational account is introduced that does. This is the quotational theory of phenomenal consciousness, according to which the higher-order component of a conscious state is constituted by the quotational component of a quotational phenomenal concept. According to the quotational theory of consciousness, phenomenal concepts help to account for the (...) very nature of phenomenally conscious states. Thus, the paper integrates two largely distinct explanatory projects in the field of consciousness studies: (i) the project of explaining how we think about our phenomenally conscious states, and (ii) the project of explaining what phenomenally conscious states are in the first place. Sufficientarian theories of distributive justice are often considered to be vulnerable to the ‘blindness to inequality and other values objection’. This objection targets their commitment to holding the moral irrelevance of requirements of justice above absolute thresholds of advantage, making them insufficiently sensitive to egalitarian moral concerns that do have relevance for justice. This paper explores how sufficientarians could reply to this objection. Particularly, I claim that, if we accept that the force of the aforementioned objection comes from relational, and (...) not distributive, inequalities, different strategies are open for sufficientarians in order to be sensitive to these concerns. Drawing on recent literature about the relation between distributive and relational egalitarianism, and the possibility of reducing one to the other, strategies of ‘internalizing’ and ‘externalizing’ relational egalitarian concerns to a distributive sufficientarian framework are explored. In turn, I suggest that both strategies fail in their standard versions, but argue that a particular ‘hybrid view’ about justice is an attractive candidate for the sufficientarian theorist. (shrink)

This paper investigates the prospects of Rodney Brooks’ proposal for AI without representation. It turns out that the supposedly characteristic features of “new AI” (embodiment, situatedness, absence of reasoning, and absence of representation) are all present in conventional systems: “New AI” is just like old AI. Brooks proposal boils down to the architectural rejection of central control in intelligent agents—Which, however, turns out to be crucial. Some of more recent cognitive science suggests that we might do well to dispose of (...) the image of intelligent agents as central representation processors. If this paradigm shift is achieved, Brooks’ proposal for cognition without representation appears promising for full-blown intelligent agents—Though not for conscious agents. (shrink)

Direct brain intervention based mental capacity restoration techniques-for instance, psycho-active drugs-are sometimes used in criminal cases to promote the aims of justice. For instance, they might be used to restore a person's competence to stand trial in order to assess the degree of their responsibility for what they did, or to restore their competence for punishment so that we can hold them responsible for it. Some also suggest that such interventions might be used for therapy or reform in criminal legal (...) contexts-i.e. to make non-responsible and irresponsible people more responsible. However, I argue that such interventions may at least sometimes fail to promote these responsibility-related legal aims. This is because responsibility hinges on other factors than just what mental capacities a person has-in particular, it also hinges on such things as authenticity, personal identity, and mental capacity ownership-and some ways of restoring mental capacity may adversely affect these other factors. Put one way, my claim is that what might suffice for the restoration of competence need not necessarily suffice for the restoration of responsibility, or, put another way, that although responsibility indeed tracks mental capacity it may not always track restored mental capacities. Political theorists concerned with ways to counteract the oligarchic tendencies of representative government have recently paid more attention to the employment of “class-specific institutions” (CSIs)—that is, political institutions that formally exclude wealthy elites from decision-making power. This article disputes a general objection levelled against the justifiability of CSIs, according to which their democratic credentials are outweighed by their explicit transgression of formal political equality—what I call the political equality objection. I claim that, although CSIs do not satisfy political equality fully, (...) their exclusionary thrust is inter alia justified in virtue of the fact that they unfold against the background of badly ordered, class-divided societies. Parallel to recent arguments in nonideal theory arguing for the priority of the right to resist economic oppression over the protection of private property rights, access to the empowering properties of CSIs should take priority over the full satisfaction of formal political equality. Yet, I also claim that the justification of CSIs depends on their orientation toward overcoming class divisions because, otherwise, we might end up wrongly naturalizing those divisions—a conclusion that needs to be avoided to reply to the political equality objection. The result is, I believe, a convincing egalitarian case for the democratic justifiability of CSIs. (shrink)

Between 1869 and 1871, D. I. Mendeleev, a teacher at the University at St Petersburg published a textbook of general chemistry intended for his students. The title, Principles of Chemistry was typical for the time: it meant that chemistry was no longer an inquiry on the ultimate principles of matter but had become a science firmly established on a few principles derived from experiment.

Kit Fine’s logic of essence and his reduction of modality crucially rely on a principle called the ‘monotonicity of essence’. This principle says that for all pluralities, xx and yy, if some xx belong to some yy, then if it is essential to xx that p, it is also essential to yy that p. I argue that on the constitutive notion of essence, this principle is false. In particular, I show that this principle is false because it says that some (...) propositions are essential to yy even though those propositions are only about some of its members. Apart from the basic concepts of intelligence and computation, the main topics of artificial cognition are perception, action, meaning, rational choice, free will, consciousness, and normativity. Through a better understanding of these topics, the philosophy of AI contributes to our understanding of the nature, prospects, and value of AI. Western democracies experience profound conflicts that induce concerns about polarization and social cohesion. Yet although conflicts are a core feature of democracies, the forms, functions, and dynamics of democratic conflicts have rarely been subject of political theory. This paper aims at furthering our understanding of democratic conflicts. It analyzes the theory of conflict in Mouffe's agonistic pluralism, confronts it with sociological conflict theory, and presents concrete points of departure for a more comprehensive theory of democratic conflicts. The paper, thus, contributes (...) to two lines of research: (1) Regarding agonistic theories, the paper shows that agonistic pluralism fails to provide a convincing theory of conflict since it underestimates the mechanisms and effects of conflict dynamics (e.g. intergroup cohesion, intragroup conflict, domination, and escalation) and fails to account for the variety of conflict interactions. Proponents of agonistic pluralism should therefore invest more into clarifying their core concept. (2) For a general account of democratic conflicts, the paper proposes to pursue interdisciplinary research on the cognitive concepts shaping conflict interactions, the linked practices of conflict regulation, and the processual dynamics of conflicts. A-theorists and B-theorists debate whether the "Now" is metaphysically distinguished from other time slices. Analogously, one may ask whether the "I" is metaphysically distinguished from other perspectives. Few philosophers would answer the second question in the affirmative. An exception is Caspar Hare, who has devoted two papers and a book to arguing for such a positive answer. In this paper, I argue that those who answer the first question in the affirmative---A-theorists---should also answer the second question in the affirmative. This (...) is because key arguments in favor of the A-theory are more effective asarguments in favor of the resulting combined position, and key arguments against the A-theory are ineffective against the combined position. In the context of the Sleeping Beauty problem, it has been argued that so-called “halfers” can avoid Dutch book arguments by adopting evidential decision theory. I introduce a Dutch book for a variant of the Sleeping Beauty problem and argue that evidential decision theorists fall prey to it, whether they are halfers or thirders. The argument crucially requires that an action can provide evidence for what the agent would do not only at other decision points where she has exactly the (...) same information, but also at decision points where she has different but “symmetric” information. According to the standard argument from targetless higher-order representations, the possibility of such representations presents a dilemma for higher-order theorists. In this article I argue that there are two theoretically well-motivated replies to the standard argument. Consequently, the standard argument against higher-order theories fails. I then go on to argue that while certain versions of higher-order theory can adequately respond to the standard argument, they both, nevertheless, fail to explain the fineness-of-grain that phenomenally conscious experience appears to have.

We review the psychological literature on the organization of valence, discussing theoretical perspectives that favor a single dimension of valence, multiple valence dimensions, and positivity and negativity as dynamic and flexible properties of mental experience that are contingent upon context. Turning to the neuroscience literature that spans three levels of analysis, we discuss how positivity and negativity can be represented in the brain. We show that the evidence points toward both separable and overlapping brain systems that support affective processes depending (...) on the level of resolution studied. We move from large-scale brain networks that underlie generalized processing, to functionally specific subcircuits, finally to intraregional neuronal distributions, where the organization and interaction across levels allow for multiple types of valence and mixed evaluations. In this article, we critically discuss the ideal of alignment, unity and harmony in cross-sector partnerships for wicked problems like sustainable development. We explore four characteristics of the concepts of identity, unity and difference which are presupposed in the partnership and collaboration literature, and point at their metaphysical origin. Based on our analysis of these four characteristics, we show the limitations of the metaphysical concepts of identity and difference in the case of CSPs for wicked problems like sustainable development.

In this chapter, I philosophically reflect on the management of corporate responsibility in the case of innovation. I first set the scene by contrasting responsibility in corporate social responsibility and innovation ethics, and arguing that classical conceptualizations of backward and forward looking responsibility are inappropriate in the case of innovation. Next, I introduce the concept of responsible innovation as a lens to understand the management of corporate responsibility in the case of innovation and show that the notions of virtue ethics (...) and practical wisdom are inappropriate for understanding what is at stake in innovation ethics, because the notion of practical wisdom is at odds with the nature of innovation. I conclude this chapter by proposing a concept of action-based responsible management of corporate innovation, which will be framed in terms of innovation as ethos. (shrink)

Servant leadership and other ethical and moral approaches to leadership have been criticized for focusing on followers to the potential detriment of other stakeholders, specifically shareholders. With individual data collected from 485 respondents nested in 55 similar stores in a single company, within a large metropolitan area in France, we tested a multilevel model whereby servant leadership relates positively to business-unit performance measured by profit growth—a key indicator for shareholders—through the mediation of employee flourishing and revenue growth. With financial performance (...) data collected approximately 15 months after servant leadership was measured, results supported the hypothesized relationships. At the individual level, this study also showed the association of servant leadership and employee flourishing to be negatively moderated by individual perceptions of power distance orientation: the weaker the power distance orientation, the stronger the influence of servant leadership on employee flourishing. Improving on prior studies that relied on data aggregated at the group level and proximal indicators of performance, this multilevel study sheds light on how servant leadership, a prominent form of ethically conscious leadership, may resolve the fundamental tension leaders face vis-à-vis the potentially diverging interests of their stakeholders. A central question that arises when interpreting the U.S. Constitution is which theory of interpretation is the best? In his recent book, “How to Interpret the Constitution,” Cass Sunstein reviews various theories of constitutional interpretation currently in vogue and then offers what he believes would be the best approach going forward. In this Article, I want to take up a more basic question presupposed by the very idea of a theory of interpretation. That is, whether it is even possible to (...) arrive at more than a provisional understanding of what would be the best interpretation in any given area of study, including constitutional law. That said, I do believe some of the interpretations suggested by Cass Sunstein and elsewhere by myself and others to be more persuasive than most others, even if only partially so. For, as Sunstein himself points out, no theory seems perfect to figure out the Constitution’s meaning in every possible world in which we could imagine it to exist. So, we best just focus on our own world or what we take to matter in our world. In keeping with this idea, I plan to begin by looking first at how we might interpret the world around us based on our past experiences by considering a somewhat imaginative recent experience of my own. Next, I consider some recent studies in the neurosciences and a previous but highly influential article by the philosopher Donald Davidson concerning conceptual schemes and whether we could ever hope to make any sense of a scheme radically different from our own. Here it should be pointed out that I will use the word “scheme” when referring to a very broad system of thought for which there may not be much outside, versus when I use the word “framework,” as referencing something far narrower than a whole system of thought, even if what is referenced might purport to be a significant part of a still larger system. My goal is to eventually adopt John Rawls’ public reason method to separate out non-workable systems of thought as might be part of a particular religious or philosophical tradition that cannot be easily tied to any other system of thought easily imagined within a pluralistic society. I plan to do this by relating how Rawls’ public reason might allow for the creation of a moral interpretation of the Constitution adopting the moral theory of Alan Gewirth. The latter I adopt because its grounding does not presuppose any prior moral or religious framework. I then apply that interpretative method to five cases Sunstein believes are fixed points in our current constitutional understanding. In short, I plan to isolate out an area of human rights where even very different understandings of the world might be able to meet, while acknowledging that there will still be other areas that simply evade any common connection. I hope what I offer here to be of help for a theory of constitutional interpretation that focuses on morality, without having to compete with various religious frameworks going forward. (shrink)

In this article I review the Supreme Court’s current use of its major questions doctrine to see if the justifications commonly offered for its existence can explain its current use. In the process of doing so, I examine what the doctrine is about, how it came into existence and how the Court has applied it, especially in context to two recent cases, West Virginia v. EPA and Biden v. Nebraska. As both of these cases implicate the regulatory state, I place (...) the primary focus of this article on how the doctrine should apply in context to judicial evaluation of the regulatory state. In so doing, I discover that the Court’s current reliance on constitutional separation of powers and checks and balances analyses seem too narrow both with respect to the concerns of the founding generation but also, and perhaps more importantly, to the Constitution’s goals for the kind of government it sought to establish going into the future. The emerging concern about software piracy and illegal or unauthorized use of information technology and software has been evident in the media and open literature for the last few years. In the course of conducting their academic assignments, the authors began to compare observations from classroom experiences related to ethics in the use of software and information technology and systems. Qualitatively and anecdotally, it appeared that many if not most, students had misconceptions about what represented ethical and unethical behaviors in (...) these realms. Clearly, one can argue that if college students are uncertain about what constitutes appropriate and inappropriate behavior then this uncertainty will be carried forward into their workplaces upon graduation. Furthermore, if their workplaces don't provide ethics training as a component of a new employee orientation program, one can project a potential for unintentional violations and infringements of copyrights and law in the field. This study was conducted among graduate and undergraduate students to gain insight into their attitudes, perceptions and understanding of some of the relevant ethics issues. A questionnaire of 11 statements was employed that described ubiquitous but most likely unethical (or surely dubious) behaviors in the prevailing business and academic environments. Each respondent was asked to evaluate each statement twice (once for “self” and once for “colleague”) on a five-option highly ethical (5) to neutral (3) to highly unethical (1) scale. The statements were worded such that lower instrument score was associated with higher ethical responses. The questionnaire's two-part structure was designed to solicit honest answers. The encouraging learning from this study was that the overall sample and its various sub-samples did not consider any of the eleven behaviors to be “ethical” or “highly ethical.” It was also encouraging to note that the overall sample and all sub-samples considered “highly unethical” those behaviors associated with personal privacy or property or outright theft. This indicated that moral judgment and probity prevail. The discouraging learning was that behaviors associated with the use of enterprise property were viewed as “neutral” i.e., neither “ethical” nor “unethical.” These findings suggested confusion and lack of clarity and definition around workplace deportment as it regards ethics in software and information technology use. The current study suggests that additional research needs to be conducted to define and clarify the issues, which in turn can form the basis for programs to rectify or at least ameliorate the situation. In metaphysics, there are a number of distinct but related questions about the existence of “further facts”—facts that are contingent relative to the physical structure of the universe. These include further facts about qualia, personal identity, and time. In this article I provide a sequence of examples involving computer simulations, ranging from one in which the protagonist can clearly conclude such further facts exist to one that describes our own condition. This raises the question of where along the sequence the (...) protagonist stops being able to soundly conclude that further facts exist. (shrink)

Pregnancy-based employment discrimination has long been a topic of interest for gender inequality scholars and civil rights agencies. Prior work suggests that employer stereotypes and financial interests leave pregnant women vulnerable to being fired. We still know little, however, about women’s interpretations of their terminations and how employers justify such decisions in the face of arguably protective laws. This article provides much needed, in-depth analyses of such dynamics and a relational account of pregnancy-based employment discrimination claims. Elaborating on theoretical expositions (...) of power and research surrounding the patriarchal character of organizational life, we draw on unique quantitative and qualitative data from verified cases of pregnancy-based firing discrimination. Our analyses reveal a two-pronged legitimation process where employers symbolically vilified pregnant workers while simultaneously amplifying ostensibly meritocratic organizational procedures and concerns. Pregnancy discrimination plaintiffs attempted to counter employer arguments. Yet, their limited power within the organizational hierarchy along with the culturally resonant nature of employer logics—logics that seem gender-neutral but that reify gendered assumptions and prioritize business profit—place pregnant women at a considerable disadvantage. Without attending to such cultural and structural power imbalances and the relational processes that undergird them, pregnancy discrimination will remain a significant problem. (shrink)

A resurgence of interest in virtue ethics has engendered new insight into the fundamental link between selfhood and morality. In contradistinction to the currently ascendant justice-reasoning research paradigm, it appears that a virtue ethics approach to moral psychology provides a theoretical framework which is amenable to the empirical investigation of the nature and formation of the moral self. Six primary features of virtue ethics are delineated with a unifying emphasis throughout on the inextricable link between virtue and moral selfhood. Emerging technologies are increasingly used in an attempt to “enhance the human body and/or mind” beyond the contemporary standards that characterize human beings. Yet, such standards are deeply controversial and it is not an easy task to determine whether the application of a given technology to an individual and its outcome can be defined as a human enhancement or not. Despite much debate on its potential or actual ethical and social impacts, human enhancement is not subject to any consensual definition. (...) This paper proposes a timely and much needed examination of the various definitions found in the literature. We classify these definitions into four main categories: the implicit approach, the therapy-enhancement distinction, the improvement of general human capacities and the increase of well-being. After commenting on these different approaches and their limitations, we propose a definition of human enhancement that focuses on individual perceptions. While acknowledging that a definition that mainly depends on personal and subjective individual perceptions raises many challenges, we suggest that a comprehensive approach to define human enhancement could constitute a useful premise to appropriately address the complexity of the ethical and social issues it generates. Abstract: Pluralistic ignorance is a nasty informational phenomenon widely studied in social psychology and theoretical economics. It revolves around conditions under which it is "legitimate" for everyone to remain ignorant. In formal epistemology there is enough machinery to model and resolve situations in which pluralistic ignorance may arise. Here is a simple first stab at recovering from pluralistic ignorance by means of knowledge transmissibility.

After a period in which Responsible Research and Innovation (RRI) stood as a cross-cutting issue under the Eigth European Union Framework Programme for Research and Innovation (R & I), Horizon 2020, its further development and implementation has reached a crossroad. It turned out that there is a lack of consistent integration of RRI in Europe’s R & I practices (Novitzky et al. 2020), and dedicated funding for RRI is almost entirely absent in the Ninth European Union Framework Programme for R (...) & I, Horizon Europe. At the same time, global challenges like climate change become increasingly more urgent and thus continue to call for collective efforts of scientific research and industry, policy makers and civil society. Further, the emergence of disruptive technologies like synthetic biology, artificial intelligence and robotics raises several new societal concerns. Finally, the growing disbelief in science, as shown during the Corona pandemic, demonstrates the importance of aligning R & I policy and societal values all the more. For reasons as these, the disinvestment in a dedicated Science With and For Society programme line for RRI in Horizon Europe did not result in decreased academic attention for embedding science in society. On the contrary, a dedicated research community emerged that engages in the academic discourse of RRI and tries to contribute to projects on topics such as responsible data governance, responsible AI, and responsible agroecology within the Horizon Europe framework programme, sometimes even without the use of the frame RRI. Cross-border reproductive care (CBRC) can be defined as the movement from one jurisdiction to another for medically assisted reproduction (MAR). CBRC raises many ethical concerns that have been addressed extensively. However, the conclusions are still based on scarce evidence even considering the global scale of CBRC. Empirical ethics appears as a way to foster this ethical reflection on CBRC while attuning it with the experiences of its main actors. To better understand the ‘in and out’ situation of CBRC in Canada, (...) we conducted an ethnographic study taking a ‘critically applied ethics’ approach. This article presents a part of the findings of this research, obtained by data triangulation from qualitative analysis of pertinent literature, participant observation in two Canadian fertility clinics and 40 semidirected interviews. Based on participants’ perceptions, four themes emerged: (1) inconsistencies of the Canadian legal framework; (2) autonomy and the necessity to resort to CBRC; (3) safety and the management of CBRC individual risks; and (4) justice and solidarity. The interaction between these four themes highlights the problematic of ‘reproductive outsourcing’ that characterised the Canadian situation, a system where the controversial aspects of MAR are knowingly pushed outside the borders. How should we update de dicto beliefs in the face of de se evidence? The Sleeping Beauty problem divides philosophers into two camps, halfers and thirders. But there is some disagreement among halfers about how their position should generalize to other examples. A full generalization is not always given; one notable exception is the Halfer Rule, under which the agent updates her uncentered beliefs based on only the uncentered part of her evidence. In this brief article, I provide a simple (...) example for which the Halfer Rule prescribes credences that, I argue, cannot be reasonably held by anyone. In particular, these credences constitute an egregious violation of the Reflection Principle. I then discuss the consequences for halfing in general. (shrink)

Both Dewey and Bourdieu emphasize the extent to which human practices are inherited practices, and the extent to which inheritance is a function of imitation. Affinities between Dewey's concept of habit and Bourdieu's notion of habitus are explored. This essay focuses on four variations on the theme of doing the done thing: philosophers doing philosophy in a recognizable form , nations perpetuating war as the unwitting enactment of a repetition compulsion, cultures fostering such democratic practices as communal deliberation, and simply (...) the done thing as an integral part of human practices. To locate these papers' topic within a broader context, I begin with an overview of some prominent topics in the field of neurolaw, where possible providing some references to relevant literature. The specific questions asked by the three authors, as well as their answers and central claims, (...) are then sketched out, and I end with a brief comment to explain why this particular topic can be expected to gain more prominence in coming years. This chapter considers whether any of the inner sense mechanisms that have been postulated to detect and represent some of our own mental states should qualify as sensory modalities. We first review and reject the four standard views of the senses, and then propose a set of properties that would be possessed by a prototypical sensory system.
