Conductive Arguments are held to be defeasible, non-conclusive, and neither inductive nor deductive (Blair and Johnson in Conductive argument: An overlooked type of defeasible reasoning. College, London, 2011). Of the different kinds of Conductive Arguments, I am concerned only with those for which it is claimed that countervailing considerations detract from the support for the conclusion, complimentary to the positive reasons increasing that support. Here’s an example from Wellman (Challenge and response: justification in ethics. Southern (...) Illinois University Press, Chicago, 1971): Although your lawn needs cutting, you ought to take your son to the movies because the picture is ideal for children and will be gone by tomorrow. This paper is to argue that conductive arguments could be understood from a rhetorical perspective. It contends that conductive arguments can be regarded as a particular mode of strategic maneuvering, rather than a new type of argument. Moreover, it demonstrates that the use of conductive arguments can be adequately analyzed and evaluated by adopting the theoretical tools developed in the extended Pragma-Dialectics.

I will demonstrate that conductive arguments are found in the inference to the best explana-tion as it is used in science. Conductive arguments, I argue, operate on two levels: the first is in the con-struction of hypotheses; the second is through the competition of hypotheses. By constructing arguments based on observations of facts, all possible factors are taken into account and a judgment is made based on our weighing of considerations: conductive argumentation.

In “Are conductive arguments possible?” Jonathan Adler argued that conductive argu-ments are not possible because they are committed to two incompatible propositions: C is reached without nullifying the counter-considerations; C is accepted is true, which issues in belief, so C is detached from these premises. This paper offers an analysis and an assessment of Adler’s case for his thesis.

Disjunctivism about sensory experience is frequently put forward in defence of a particular conception of perception and perceptual experience known as naïve realism. In this paper, I present an argument against naïve realism that proceeds through a rejection of disjunctivism. If the naïve realist must also be a disjunctivist about the phenomenal nature of experience, then naïve realism should be abandoned.

The paper aims to provide an analysis and critique of Carl Wellman’s account of conduction presented in Challenge and Response and Morals and Ethics. It considers several issues, including: reason-ing vs. argument, the definition vs. the three patterns of conduction, pro and con arguments as dialogues, their assessment, the concept of validity, applications beyond moral arguments, argument type vs. as crite-rion of evaluation.

In this paper I compare and contrast Rawls’s notion of reflective equilibrium with Wellman‘s notion of conductive argument. In the course of so doing I will address two key questions: Are conduc-tive argument and reflective equilibrium best understood as modes of reasoning or types of argument? and What relationship, if any, is there between them?

In Jonathan Adler argued that conductive arguments, as they are commonly characterized, are impossible—that no such argument can exist. This striking contention threatens to undermine a topic of argumentation theory originated by Trudy Govier based on Carl Wellman and revisited by the papers in “Conductive argument, An overlooked type of defeasible reasoning”. I here argue that Adler’s dismissal of conductive arguments relies on a misreading of the term ‘non-conclusive’ used in the characterization of this type (...) of reasoning and argument, and that as a result, his refutation fails. This book will help professions and professionals to identify their contribution to society and to understand the argument in which they must engage if they are to justify their conduct. Because of their specialized expertise and power, the task is both difficult and pressing. The work is divided into two parts. Part 1 discusses the concepts 'ethics' and 'professional conduct', indicating their dimensions and contested nature. In each case, following examination and analysis of relevant literature, a conceptual framework or model (...) is proposed for locating instances of, in turn, ethics and professional conduct. In Part 2, the model of ethical choice is used to discuss the ethical justification of professional conduct in the various forms, locations, and stages provided by its social setting. In this way, it provides grounding arguments for relevant action by professionals and others dealing with professionals. I examine a Canadian Supreme Court decision concerning the constitutionality of Canada's 1982 rape-shield legislation, and suggest how material from the decision might profitably be used in an informal-logic class in connection with the topics of relevance and conductive argument. I also consider theoretical matters related to the decision: first I develop two analyses of what I call an argument from 'unchasteness' and connect them to George Bowles's theory of propositional relevance; then I present Trudy Govier with a problem (...) in response to which she might revise her account of a conductive argument in a way I describe. Bipolar argument graphs represent the structure of complex pro and contra arguments for one or more standpoints. In this article, ampliative and exclusionary principles of evaluating argument strength in bipolar acyclic argumentation graphs are laid out and compared to each other. Argument chains, linked arguments, link attackers and supporters, and convergent arguments are discussed. The strength of conductive arguments is also addressed but it is argued that more work on this type of argument is needed (...) to properly distinguish argument strength from more general value-based components of such arguments. The overall conclusion of the article is that there is no justifiably unique solution to the problem of argument strength outside of a particular epistemological framework. (shrink)

This paper examines arguments that take counter- considerations into account, and it does so from a dialogical point of view. According to my account, a counterconsideration is part of a critical reaction from a real or imagined opponent, and an arguer may take it into account in his argument in at least six fully responsive ways. This paper analyzes and evaluates the 2007 majority opinion of the German National Ethics Council which seeks to establish new information (as to the inferior quality of legally procurable human embryonic stem cells) as a sufficient reason for a relaxation of the 2002 Stem Cell Law. A micro-level analysis of the opinion’s central section is conducted and evaluated vis à vis the strongest known opponent position in the national debate at that time. The argumentation is claimed to rely on an (...) unsupported semantic assumption regarding the parthood relation of the 2002 compromise and to misconstrue the strongest known opponent position. In a recent article, Marilyn Baffoe-Bonnie offers three arguments for conducting CRISPR/Cas9 biotechnology research to cure sickle-cell disease (SCD) based on addressing historical and current injustices in SCD research and care. I show that her second and third arguments suffer from roughly the same defect, which is that they really argue for something else rather than for conducting CRISPR/Cas9 research in particular. For instance, the second argument argues that conducting this gene therapy research would improve the relationship between (...) SCD sufferers (who are mostly of African descent) and health care providers. But really what is essential in improving this relationship is for those providers to genuinely care and be concerned, and this could be lacking even with the CRISPR research being done. Indeed, this relationship could be improved even without that research being done, as long as there is genuine concern. Thus, this argument actually argues for the need for genuine concern. As for the third argument, one (of two) problems arises because it claims that CRISPR research for SCD should be pursued because the benefits would be shared by even non-research-participants, as non-participants would be encouraged. However, this argues for any research for SCD, not for CRISPR research in particular. I conclude that a better justice-based argument will use only Baffoe-Bonnie’s first argument, which is based on historic neglect of an actual cure for SCD (going beyond merely management or transplant therapies). We often say things like “Even though X, Y” or “In spite of Y, X”. What do we mean when we say things like this? What does it imply about the reasons involved? I will argue that there are at least some cases, namely when they are used in the conclusions of conductive arguments, where it should be seen as modifying our expression of X and indicating a certain kind of affect towards X, and this is characteristic of (...) (the most interesting class of) conductive arguments. Showing that there are such uses thus shows that there are conductive arguments, or at least arguments with this characteristic feature, and, conversely, it will be shown that it is by taking the reasoning to be conductive that we can best make sense of these uses. I do not intend a comprehensive survey of all possible uses of “even though” or of all accounts of conductive arguments that have been given. (shrink)

본 논고는 조선 후기 정제두와 그 친우들이 나눈 지행논변의 쟁점과 함의를 고찰한 것이다. 당시 지행논변의 쟁점은 선지후행(先知後行)과 지행병진(知行竝進)의 문제에 있었다. 정제두의 친우들인 박심, 민이승, 최석정은 도덕활동의 주체는 심(心)이지만 궁리(窮理)와 함양(涵養)을 통해 객관 도리와 내면의 도리가 조응하도록 해야 하며, 이는 견문지의 습득에서 출발한다고 보았다. 이들은 주희와 마찬가지로 선지후행(先知後行), 궁리(窮理)와 함양(涵養)의 상수(相須)라는 측면에서 지행병진(知行竝進)을 견지했고 이에 근거해서 양명학을 비판했다. 그러나 정제두는 궁리(窮理)여부와 관계없이도 이미 주체적이고 능동적으로 도덕활동을 해나가고 있는 양지(良知)에 주목하여, 지행(知行)이란 양지의 체용(體用)이므로 합일(合一)이라고 주장했다. 정제두와 그 친우들의 지행논변은 양명학의 지행합일과 주자학의 (...) 지행병진이 지니는 차이를 그대로 반영한 것이었다. 이들 논쟁의 함의는 도덕의 근본 동력을 무엇으로 보는가 하는 관점의 차이에 따라 각 지행론이 다르게 정립된다는 것이다. 따라서 단순 개념비교는 불가능하다. 정제두의 친우들은 주희의 입론에 근거해서 도덕활동의 관건을 심의 궁리와 함양에 두었지만 정제두는 왕수인의 입론에 근거해서 양지본체의 실현이 관건이며 양지가 곧 도덕활동의 근본 동력이 된다고 본 것이다. When Carl Wellman introduced the reasoning-type conduction, he endorsed a dialectical view on natural language argumentation. Contemporary scholarship, by contrast, treats conductive argument predominantly on a product view. Not only did Wellman’s reasons for a dialectical view thus fall into disregard; a product-treatment of conduction also flouts the standard semantics of ‘argument’. Attempting to resolve these difficulties, our paper traces Wellman’s preference for a dialectical view to the role of defeasible warrants. These act as stand-ins for value hierarchies that (...) arguers of normal suasory inclination find acceptable. This volume comprises a selection of contributions to the theorizing about argumentation that have been presented at the 9th conference of the International Society for the Study of Argumentation, held in Amsterdam in July 2018. The chapters included provide a general theoretical perspective on central topics in argumentation theory, such as argument schemes and the fallacies. Some contributions concentrate on the treatment of the concept of conductive argument. Other contributions are dedicated to specific issues such as the justification of (...) questions, the occurrence of mining relations, the role of exclamatives, argumentative abduction, eudaimonistic argumentation and a typology of logical ways to counter an argument. In a number of cases the theoretical problems addressed are related to a specific type of context, such as the burden of proof in philosophical argumentation, the charge of committing a genetic fallacy in strategic manoeuvring in philosophy, the necessity of community argument, and connection adequacy for arguments with institutional warrants. T. Govier's description of ‘conductive argument’ and 'A priori analogy' is taken as a start to investigate non-deductive argumentation. It is here argued, that the nature of those types can be better understood when taking up a dynamic view (in addition to the usual structural view). The concepts of ‘frame’ and ‘position’ are constructed in order to establish such a twofold approach.

Drawing on Merleau-Ponty, I contend that emotions should be regarded as emerging from our “vital communication” with the solicitations of our physical and social surroundings. My intention is to present emotions as unitary phenomena arising from an incessant flow of motivations that can be later articulated in terms of reasons (in cognitive theories of emotions) or in terms of causes (in affective neuroscience). I further suggest that emotions should be considered a specific kind of conducts, since the way in which (...) a person acts out her emotions shapes their content, regulates their intensity and transforms the amorphous flow of felt motivations into a recognizable emotional stance for which she is held accountable. In conclusion, I put forward a series of arguments explaining why emotion tends toward its expression in conduct as if towards its completion. (shrink)

Although argumentation plays an essential role in our lives, there is no integrated area of research on the psychology of argumentation. Instead research on argumentation is conducted in a number of separate research communities that are spread across disciplines and have only limited interaction. With a view to bridging these different strands, we first distinguish between three meanings of the word ?argument?: argument as a reason, argument as a structured sequence of reasons and claims, and argument as a social exchange. (...) All three meanings are integral to a complete understanding of human reasoning and cognition. Cognitive psychological research on argumentation has focused mostly on the first and second of these meanings, so we present perspectives on argumentation from outside of cognitive psychology, which focus on the second and third. Specifically, we give anoverview of the methods, goals, and disciplinary backgrounds of research on the production, the analysis, and the evaluation of arguments. Finally, inintroducing the experimental studies included in this special issue, which were conducted by researchers from a range of theoretical backgrounds, weunderline the breadth of argumentation research as well as stress opportunities for mutual awareness and integration. Some conspicuous characteristics of argumentation as we all know this phenomenon from our shared everyday experiences are in my view vital to its theoretical treatment because they should have methodological consequences for the way in which argumentation research is conducted. To start with, argumentation is in the first place a communicative act complex, which is realized by making functional verbal communicative moves.

I argue that conductions are a special type of inference indeed, but that this does not mean that we need to develop novel standards of inference goodness or specific argument schemes for properly assessing them. Following LNMA’s theoretical framework, I provide a semantic account of conductions and explain the interesting pragmatic properties of a certain type of conductions in terms of the rhetorical dimension of the speech-act of arguing.

In this paper, a case study is conducted to test the capability of the Carneades Argumentation System to model the argumentation in a case where forensic evidence was collected in an investigation triggered by a conflict among art experts on the attribution of a painting to Leonardo da Vinci. A claim that a portrait of a young woman in a Renaissance dress could be attributed to da Vinci was initially dismissed by art experts. Forensic investigations were carried out, and evidence (...) was collected by art history experts and scientific experts. The expert opinions were initially in conflict, but new evidence shifted the burden of proof onto the side of the skeptics. Debates over the relative priority of experience and language have been among some of the most vexed, but also generative, disputes in pragmatist philosophy over the past few decades. These debates have, however, run into the ground such that both positions find themselves at a definitive standstill. I argue for a rejuvenation of pragmatism by way of moving beyond both the experience option (here represented by Dewey) and the linguistic turn in pragmatism (here represented by Brandom). We can move beyond (...) these two categories, I argue, by resuscitating the categorical conception that has always been at the heart of pragmatism all along: action or, as I prefer to put it, conduct. In this paper, I develop an argument for “conduct pragmatism” on the basis of a return to William James’s earliest statements of pragmatism, statements that indeed occur prior to the official announcement of “pragmatism” in 1898. I draw on a dispute with Charles Sanders Peirce over the best interpretation of pragmatism as well as on a number of James’s early psychological writings from the 1880s leading up to the Principles of Psychology of 1890. These texts definitively establish that the early James was what I call a “conduct pragmatist” well before his radical empiricism facilitated what was only a late turn toward the “experience pragmatism” that would come to impress Dewey and later scholars of classicopragmatism. The early James thus represents, I argue, a promising seed for a new third generation of pragmatism that may find its way beyond the endings of both experientialism and lingualism, as well as their impasses with one another. In this paper, we study conditional preferences in abstract argumentation by introducing a new generalization of Dung-style argumentation frameworks (AFs) called Conditional Preference-based AFs (CPAFs). Each subset of arguments in a CPAF can be associated with its own preference relation. This generalizes existing approaches for preference-handling in abstract argumentation, and allows us to reason about conditional preferences in a general way. We conduct a principle-based analysis of CPAFs and compare them to related generalizations of AFs. Specifically, we highlight similarities (...) and differences to Modgil’s Extended AFs and show that our formalism can capture Value-based AFs. Moreover, we show that in some cases the introduction of conditional preferences leads to an increase in computational complexity. (shrink)

We consider the problem of learning argumentation frameworks from a given set of labelings such that every input is a σ-labeling of these argumentation frameworks. Our new algorithm takes labelings and computes attack constraints for each argument that represent the restrictions on argumentation frameworks that are consistent with the input labelings. Having constraints on the level of arguments allows for a very effective parallelization of all computations. An important element of this approach is maintaining a representation of all argumentation (...) frameworks that satisfy the input labelings instead of simply finding any suitable argumentation framework. This is especially important, for example, if we receive additional labelings at a later time and want to refine our result without having to start all over again. The developed algorithm is compared to previous works and an evaluation of its performance has been conducted. (shrink)

In this article we present a training program based on the empirical research conducted in the project 'argumentational integrity'. After a brief sketch of the problem dimensions concerning unfair argumentation we give an overview of the training concept and the underlying empirical research. Exemplification of the instructional design is given for the second and the fifth training dimension (standards of argumentational integrity and reactions to unfair contributions). Finally we indicate how the training is to be evaluated and present initial results (...) demonstrating that in comparison with an untrained control group participants in the training significantly improve their skills in identifying and naming argumentative rule violations. The burgeoning field of biomedical research involving the mixture of human and animal materials has attracted significant ethical controversy. Due to the many dimensions of potential ethical conflict involved in this type of research, and the wide variety of research projects under discussion, it is difficult to obtain an overview of the ethical debate. This paper attempts to remedy this by providing a systematic review of ethical reasons in academic publications on human-animal chimera research. We conducted a systematic review of (...) the ethical literature concerning human-animal chimeras based on the research question: “What ethical reasons have been given for or against conducting human-animal chimera research, and how have these reasons been treated in the ongoing debate?” Our search extends until the end of the year 2017, including MEDLINE, Embase, PhilPapers and EthxWeb databases, restricted to peer-reviewed journal publications in English. Papers containing ethical reasons were analyzed, and the reasons were coded according to whether they were endorsed, mentioned or rejected. Four hundred and thirty-one articles were retrieved by our search, and 88 were ultimately included and analyzed. Within these articles, we found 464 passages containing reasons for and against conducting human-animal chimera research. We classified these reasons into five categories and, within these, identified 12 broad and 31 narrow reason types.15% of the retrieved passages contained reasons in favor of conducting chimera research, while 85% of the passages contained reasons against it. The reasons against conducting chimera research fell into four further categories: reasons concerning the creation of a chimera, its treatment, reasons referring to metaphysical or social issues resulting from its existence and to potential downstream effects of chimera research. A significant proportion of identified passages fell under Category C. We hope that our results, in revealing the conceptual and argumentative structure of the debate and highlighting some its most notable tendencies and prominent positions, will facilitate continued discussion and provide a basis for the development of relevant policy and legislation. There has been increasing use of argument-based approaches in the development of safety-critical systems. Within this approach, a safety case plays a key role in the system development life cycle. The key components in a safety case are safety arguments, which are designated to demonstrate that the system is acceptably safe. Inappropriate reasoning in safety arguments could undermine a system's safety claims which in turn contribute to safety-related failures of the system. The review of safety arguments is (...) therefore a crucial step in the development of safety-critical systems. Reviews are conducted using dialogues where elements of the argument and their relations are proposed and scrutinised. Meta-arguments are arguments about one or more arguments, or argumentation in general. They contrast to ground-level arguments, which are about natural phenomena, historical events, human actions, abstract entities, etc. Although meta-arguments are common in all areas of human cognitive practice, and although implicit studies of them are found in many works, and although a few explicit scholarly contributions exist, meta-argumentation has never been examined explicitly, directly, and systematically in book-length treatment. This lacuna is especially unfortunate (...) because such treatment can offer not only an understanding of a special class of arguments, but also a promising way of doing logic and argumentation theory. This is the first book that attempts a systematic treatment of meta-arguments, providing both an illustration of the meta-argumentational approach to logical theory, and an analysis of an especially rich collection of meta-arguments. First, it elaborates an empirical methodology derived partly from a critical appreciation of Stephen Toulmin's applied-logic approach, and partly from a novel application of the author's historical-textual approach. Then it examines theoretical meta-arguments, by such scholars as Tony Blair, Robert Fogelin, Alvin Goldman, Trudy Govier, David Hitchcock, Ralph Johnson, Henry Johnstone, Erik Krabbe, Frans van Eemeren, Carl Wellman, and John Woods, on such topics as defining argument, methods of criticism, deep disagreements, and conductive or pro-and-con arguments. In her account of scientific objectivity, feminist philosopher of science Helen Longino shows how scientific objectivity is not so much of individual practice, but rather a social commitment practiced by a scientific community, provided by the necessary accommodations for critical discourse. However, is this conception of scientific objectivity truly capable of living up to the social realities of critical discourse and deliberation within a scientific community? Drawing from Dutilh Novaes’ social epistemological account of argumentation, this paper highlights the challenges Longino’s (...) scientific objectivity faces on a prescriptive and descriptive level, specifically in overcoming the various epistemic injustices Longino’s proposed structural accommodations for objectivity are still sensitive to. Dutilh Novaes’ social epistemological model of argumentation illustrates how the realities of critical debate too often don’t consist of true epistemic or knowledge exchange, even though such exchanges are essential to achieve Longino’s primary goal when redefining scientific objectivity: to wield out and address idiosyncratic background assumptions and individual bigotry that possibly influence a researcher’s scientific conduct. Virtue theories of argumentation (VTA) emphasize the roles arguers play in the conduct and evaluation of arguments, and lay particular stress on arguers’ acquired dispositions of character, that is, virtues and vices. The inspiration for VTA lies in virtue epistemology and virtue ethics, the latter being a modern revival of Aristotle’s ethics. Aristotle is also, of course, the father of Western logic and argumentation. This paper asks to what degree Aristotle may thereby be claimed as a forefather by VTA.

Recent works in Explainable AI mostly address the transparency issue of black-box models or create explanations for any kind of models (i.e., they are model-agnostic), while leaving explanations of interpretable models largely underexplored. In this paper, we fill this gap by focusing on explanations for a specific interpretable model, namely pattern-based logistic regression (PLR) for binary text classification. We do so because, albeit interpretable, PLR is challenging when it comes to explanations. In particular, we found that a standard way to (...) extract explanations from this model does not consider relations among the features, making the explanations hardly plausible to humans. Hence, we propose AXPLR, a novel explanation method using (forms of) computational argumentation to generate explanations (for outputs computed by PLR) which unearth model agreements and disagreements among the features. Specifically, we use computational argumentation as follows: we see features (patterns) in PLR as arguments in a form of quantified bipolar argumentation frameworks (QBAFs) and extract attacks and supports between arguments based on specificity of the arguments; we understand logistic regression as a gradual semantics for these QBAFs, used to determine the arguments’ dialectic strength; and we study standard properties of gradual semantics for QBAFs in the context of our argumentative re-interpretation of PLR, sanctioning its suitability for explanatory purposes. We then show how to extract intuitive explanations (for outputs computed by PLR) from the constructed QBAFs. Finally, we conduct an empirical evaluation and two experiments in the context of human-AI collaboration to demonstrate the advantages of our resulting AXPLR method. (shrink)

In this paper, close attention is paid to the argumentative patterns resulting from combining pragmatic argumentation in which a recommendation is made with arguments in which the majority is invoked. I focus on such argumentative patterns as employed by European parliamentary committees of inquiry conducting inquiries into the activity of the Equitable Life Assurance Society. By incorporating legal and political insights about the activity of these parliamentary committees of inquiry into a pragma-dialectical argumentative approach, an analysis will be given (...) of the selected argumentative pattern. This analysis will reveal which standpoints are supported by which arguments and how these arguments relate to each other to increase the acceptability of the recommendation made. The restructured globalized economy has provided women with employment opportunities. Globalisation has also meant a shift towards self-regulation of multinationals as part of the restructuring of the world economy that increases among others things, flexible employment practices, worsening of labour conditions and lower wages for many women workers around the world. In this context, as part of the global trend emphasising Corporate Social Responsibility (CSR) in the 1980s, one important development has been the growth of voluntary Corporate Codes of Conduct (...) to improve labour conditions. This article reviews from a feminist interdisciplinary perspective the broad academic literature on women workers, covering the more classical debate on women workers in the industrialization process and entering into women workers in the global supply chains and women workers and corporate codes of conduct. The main argument is that this research on women workers is crucial to frame the issues of business ethics and in particular CSR and Codes of Conduct in the context of women in the global political economy. When this crucial knowledge is ignored, then the ethical policies of the companies also ignore the real situation of the women workers at the bottom of their supply chains. (shrink)

In public and political practice, argumentation involves verbal manipulations, which have not been sufficiently studied in modern argumentation theory. This paper proposes to analyse such manipulations as speech acts, by means of the pragmadialectical theory of argumentation.

The high prevalence of brain injury incidents in adolescence and adulthood demands effective models for re-learning lost cognitive abilities. Impairment in brain injury survivors’ higher-level cognitive functions is common and a negative predictor for long-term outcome. We conducted two small-scale interventions (N = 12; 33.33% female) with persons with acquired brain injuries in two municipalities in Sweden. Age ranged from 17 to 65 years (M = 51.17, SD = 14.53). The interventions were dialogic, inquiry-based, and inspired by the Philosophy for (...) Children Programme, a participatory thinking skills approach with documented higher-order cognitive outcomes, such as developed argumentation skills, in other target groups. Philosophical dialogues were conducted once a week in the two groups, totalling 12 dialogues per group. Group argumentation development was measured through compared scores from structured observations of filmed dialogues early and late in the intervention. Large positive changes in mean scores from early to late in the intervention, together with constantly high facilitator quality, suggest argumentation development in the sample due to the intervention. This book concentrates on argumentation as it emerges in ordinary discourse, whether the discourse is institutionalized or strictly informal. This volume focuses on the role language plays at all levels of the argumentation process. It explores the effects that specific linguistic choices may have in the production and the reception of arguments and in doing so, it moves beyond the first, necessary, descriptive stance provided by current literature on the topic. Each chapter provides an original take illuminating one or more of the following three issues: the range of linguistic resources language users draw on as they argue; how (...) cognitive processes of meaning construction may influence argumentative practices; and which discursive devices can be used to fulfil a number of argumentative goals. The volume includes theoretical and empirical or applied stances, providing the reader both with state-of-the-art reflections on the relationship between argumentation and language, and with concrete examples of how this relationship plays out in naturally occurring argumentative practices, such as classroom interaction, and political, parliamentary or journalistic discourse. Codes of conduct are the main tools to privately regulate worker rights in global value chains. Scholars have shown that while codes may improve outcome standards (such as occupational health and safety), they have had limited impact on process rights (such as freedom of association and collective bargaining). Scholars have, though, only provided vague or general explanations for this empirical finding. We address this shortcoming by providing a holistic and detailed explanation, and argue that codes, in their current form, have (...) limited impact on trade union rights due to (i) buyers paying lip service to trade union rights, (ii) workers being treated as passive objects of regulation in codes of conduct, (iii) auditing being unable to detect and remediate violations of trade union rights, (iv) codes emphasizing parallel means of organizing, (v) suppliers having limited incentives for compliance, and (vi) codes being unable to open up space for union organizing when leveraged in grassroots struggles. Our arguments suggest that there is no quick fix for codes’ limited impact on trade union rights, and that codes, in their current form, have limited potential to improve trade union rights. We conclude by discussing ways in which codes of conduct, and private regulation of worker rights more generally, could be transformed to more effectively address trade union rights. (shrink)
