We review the issues of nonseparability and seemingly acausal propagation of information in EPR, as displayed by experiments and the failure of Bell's inequalities. We show that global effects are in the very nature of the geometric structure of modern physical theories, occurring even at the classical level. The Aharonov-Bohm effect, magnetic monopoles, instantons, etc. result from the topology and homotopy features of the fiber bundle manifolds of gauge theories. The conservation of probabilities, a supposedly highly quantum effect, is also (...) achieved through global geometry equations. The EPR observables all fit in such geometries, and space-time is a truncated representation and is not the correct arena for their understanding. Relativistic quantum field theory represents the global action of the measurement operators as the zero-momentum (and therefore spatially infinitely spread) limit of their wave functions (form factors). The two significant zoonotic bacterial infections that have remained a concern due to the complex dynamics involved in transmission and global prevalence are anthrax and brucellosis. The present paper attempts to address some of the most important zoonotic pathogens, highlighting their epidemiology, clinical manifestations, diagnosis, treatment, and prevention strategies. Anthrax is largely transmitted through direct contact with the infected animals or their products resulting in cutaneous, inhalational, and gastrointestinal forms, all with specific clinical outcomes and approaches for treatment. Similarly, the (...) genus Brucella primarily transmits brucellosis to humans by occupational exposure and consumption of contaminated animal products. Its presentation may be acute, chronic, or in relapse. Diagnosis is made by a combination of serological, molecular, and culture-based techniques, while the treatment focuses on antimicrobial regimens specific to the pathogen. However, this increases the problem of antimicrobial resistance, which makes their effective management challenging, necessitating an integrated approach. Mitigating risks through biosecurity measures, vaccination, public health education, and a One Health approach that includes human, animal, and environmental health, all facilitate prevention and control of an outbreak. Advanced surveillance and diagnostic technologies further support the prompt interventions to contain outbreaks. It then goes on to highlight the importance of interdisciplinarity for decreasing the global burden of zoonotic bacterial diseases. (shrink)

The question of cosmic beginning has always attracted considerable attention from serious thinkers past and present. Among many contesting theories that have emerged, that of emanation was appropriated by Muslim philosophers like Ibn Sînâ in order to reconcile the Aristotelian doctrine of the eternity of matter with the teaching of al-Qur’ân on the One Creator-God. According to this theory, the universe, which comprises a multitude of entities, is generated from a transcendent Being, the One, that is unitary, through the (...) medium of a hierarchy of immaterial substances. While the ultimate source is undiminished, the beings which are emanated are progressively less perfect as they are further removed from the first principle. The process is conceived as being atemporal and often compared to the efflux of light from a luminous body, or to water flowing from a spring. This metaphysical theory has enabled Ibn Sînâ to solve the vexed problem: given an eternally existing world and one eternally existing God, how can the two necessarily co-exist without having the perfect, simple unity of God destroyed by contact with the multiplicity of material things? The following essay delineates and evaluates both Ibn Sînâ’s arguments as well as the counter-arguments of his critics. (shrink)

I defend the claim that Avicenna explains the creation of the universe in terms of emanation modeled on Neoplatonic emanation by exploring Avicenna’s account of creation by emanation in detail. I address what appears to be an obvious problem for the application of this model to creation—namely, that creation as emanation seems to be non-voluntary and has been understood to be non-voluntary by several prominent interpreters. I explore how Avicenna contends that God emanates voluntarily and (...) non-necessarily. Avicenna is able to make this claim because of his distinction between an action done of natural necessity, done voluntarily, and done with an intention. I then address whether this means that God creates freely—without any constraint whatsoever—and I conclude that God is not free not to create because God has an immutable will and has already acted to create. While God is not under any initial compulsion to create, from the fact that the universe now exists, God cannot act otherwise than to create. (shrink)

A recent article by Kuhn1 showcases the plethora of proposed solutions for the mind-body problem as it is understood in current ’consciousness science’. Perusing this article, philosophers will likely find it surprising to see the inclusion of for instance Indian idealism and Bhuddist thought, but neither German, nor British or US idealists, which seems especially unbalanced when instead of them theories like Kastrup’s analytical idealism (Hegel for physicists?) or Hoffmann’s interface theory (Kant for psychologists?) are included. The listings of (...) dualist, panpsychist and further theories seems equally eclectic, with for instance Descartes no more than a side-note in a number of entries, but several listings of religious ideas of body and soul. A possible problem with such omissions is of course that not taking philosophical history more seriously comes with the peril of repeating (now) avoidable errors. Nevertheless, judging from the disclaimers, Kuhn is well aware of this and most likely sees his list as more of a ’sociology of consciousness science’, i.e. a list of people and ideas that are currently circulating in this field. -/- It can in any case be taken from Kuhn’s monumental work effort, that it is often assumed that a solution to the mind-body problem would be either (in the wider sense) materialistic (including nonreductive and quantum theories), dualistic, panpsychistic (including monist theories) or idealistic. The core problems faced are then those of emergence (of consciousness), interaction (between brain and mind), de/combination (of ‘mind dust’ or a unity into proper subjects) or emanation, where the emanation problem is the problem of explaining in detail(!) how the physical world and our scientific theories arise from a given idealistic setup. To me it seems more likely that all these views have a point, but that none manages to cover the whole picture – and that it therefore might be possible to integrate these views into ’consensus models’, if we do not look at the proposed solutions, but the initial intentions and/or intuitions for setting them up (much like as if we would mediate a social conflict). The tremendous advances of research into artificial intelligence as well as neuroscience made over the last two to three decades have given further support to a renewed interest into philosophical discussions of the mind-body problem. Especially the last decade has seen a revival of panpsychist and idealist considerations, often focused on solving philosophical puzzles like the socalled hard problem of consciousness.1–9 While a number of respectable philosophers advocate some sort of panpsychistic solution to the mind-body problem now, (...) fewer advocate that idealism can contribute substantially to the debate. Interest in idealism has nevertheless risen again, as can be seen also from recent overview articles and collections of works.10–14 The working hypothesis here is that a properly formulated idealism can not only provide an alternative view of the mind/matter gap, but that this new view will also shed light on open questions in our common scientific, i.e. materialist, world view. To investigate this possibility, idealism first of all needs a model for the integration of modern science which allows for a mathematically consistent reinterpretation of the physical world as a limiting case of a both material and non-material world, which would make the outcome of idealistic considerations accessible to scientific investigation. To develop such a model I will first try to explain what I mean when I speak of a ‘scientifically tenable’ idealism, including a formulation of the emanation problem which for idealism replaces the interaction problem, then give a very brief summary of the available elements of such a theory in the philosophical literature, before sketching out some ‘design questions’ which have to be answered upon the construction of such models, and finally put forward a first model for a scientifically tenable objective idealism. In this article, the authors offer an original view on the development of the creation concepts in the Christian thought history. The article focuses on the importance of the cosmogony of Gnostic Christianity for the development of cosmogonic ideas in European philosophy. The cosmogony of the Gospel of Truth is interpreted as a serious philosophical alternative to the orthodox concept of the creation of the world from nothing and the neoplatonic concept of emanation. The authors point to the continuity (...) between the concept of creation in the texts of Gnostic Christianity and subsequent philosophical systems expressed in the texts of Origen, Evagrius of Pontus, Areopagitics, Meister Eckhart, Nicholas of Cusa, and others. Particular attention is paid to the understanding of the concept of “nothing” in the context of the development of cosmogonic systems. (shrink)

Next topics will be discussed: reflexive structure of consciousness as genetic problem, Ego as an emanate cen-ter of time construction, possibility of the achievement of hyletical, non-reflexive consciousness structure.

We discuss the bearing of Daniel Kahneman and Amos Tversky's Prospect Theory on some central issues in ethics. It has been argued that the theory provides a better explanation of our intuitive responses to some important ethical decision cases—like some famous cases put by Philippa Foot and others—than traditional and widely acknowledged ethical principles do. In this way, Prospect Theory contributes to the new wave of skepticism, emanating from the social sciences, about the role of intuitive judgments in ethical theory (...) and philosophy more generally. We focus on Kahneman and Tversky's famous Asian Disease Problem. We show that the case fails to support Prospect Theory over traditional ethical theory as an explanation of the most common intuitive responses to the case, and, moreover, fails as an account of the most common intuitive responses to Foot's famous trolley case and related cases. We maintain that careful critical attention to all these cases shows that Prospect Theory has not made a successful incursion into ethics, whatever it may have established about non-ethical decision-making. Biomimicry can serve as a design template for an ecological civilisation by showing how cyclical, no-waste, mutually adaptive production systems designed ‘after nature’ could render human industry fully ‘sustainable’. However, unless the modes of praxis involved in such a reformed industrial base are also redesigned, the value orientation fostered by the new order would remain anthropocentric. Biomimicry would accordingly result in an eco-modernist-type scenario in which society was ‘decoupled’ from nature, with dystopian consequences for the larger community of life. Drawing (...) on Indigenous modalities, I explore ways in which modern industrial systems could include participatory modes of praxis that would emanate in genuinely bio-inclusive forms of consciousness and hence lay the ethical foundations for an ecological civilisation. This book illuminates the problem of women in Chinese philosophy through the lens of the lives and work of two contemporary Taiwanese female philosophers. It takes two approaches that have been relegated, quite unfairly, to the margins of dominant discourses. The first is concerned with the work of women philosophical theorists who are still overshadowed by their male colleagues, regardless of where they live, their theoretical potential, and the value of their research. The second approach is related to the (...) question of the role of Taiwanese philosophy in maintaining the continuity of the Chinese intellectual tradition in the second half of the twentieth century. The book thus connects these two issues and provides a bridge linking them. Although discrimination against female philosophical theorists, on the one hand, and the failure to recognize the important contribution of Taiwanese philosophy to the development of modern Chinese philosophy, on the other, seem, at first glance, to have little in common, both harbor a problem that has its roots in discourses of exclusion emanating from the political, historical, and social inequalities associated with power structures. This article examines the nonhistoricist higher-order compatibilist theory of moral responsibility devised and defended by Harry G. Frankfurt. Intuitions about certain kinds of cases of moral responsibility cast significant doubt on the wide irrelevancy clause of the nonhistoricist feature of Frankfurt’s theory. It will be argued that, while the questions of the nature and ascription of moral responsibility must be separated in doing moral responsibility theory, the questions of whether or not and the extent to which an agent is morally (...) responsible for performing certain kinds of actions cannot be settled without also answering the question of the history of that agent’s attitudes, preferences, etc. which may have contributed to the agent’s performing such actions. Thus Frankfurt’s repeated claim that the history of an agent’s action is “irrelevant” to the question of that agent’s moral responsibility for it is rendered dubious, thereby rendering problematic the strongly nonhistoricist component of his theory. The methodological difference between my challenge to Frankfurt’s nonhistoricism and those of others is that, while others have challenged Frankfurt’s nonhistoriciams by way of thought experiments involving hyper-manipulation, mine presents a set of counter-examples to his nonhistoricism which emanate from morality and the law. Indeed, if my counter-example is plausible, then Frankfurt’s nonhistoricism cannot make good sense of some standard instances of racism. Furthermore, while many believe that racist hate crimes ought to be punished more heavily than crimes committed absent hate, the argument herein provides reasons for mitigating, rather than increasing, the responsibility and punishments of many such crimes. What matters in such cases is the extent to which the hatred accompanying said crimes has a history in the agent’s life, one which makes it significantly difficult for her to do other than what she did in committing the racist crime. Performance appraisal interviews are carried out on the basis of known-in-advance written materials such as preparation forms and interview guides. This article demonstrates how participants manage interviews by following a question–answer–response format fit to address interview guide entries one at a time. Two recurring supervisor responses to employees’ talk about problems in work are investigated: positive prediction and advice. It is suggested that these responses serve to establish supervisor authority and deter participants from discussing issues raised in employee answers and (...) thus go against norms emanating from literature on management communication. Results obtained in interviews are put down in writing along the way and subsequently summarized in documents to be signed by both participants, that is, employee and supervisor. The article demonstrates how participants use positive prediction and advice to coordinate talk-in-interaction with handling written materials and note taking, as well as formulating conclusions suitable for writing. The analyses shed light on how talk in an institutional context becomes a middle-medium, that is, a bridge between writings, and how this process is accomplished in turn-taking procedures. (shrink)

The religious inquirer is, however, in a tough spot, for she is subject to norms that it appears she cannot jointly satisfy. On the one hand, there are norms for the conduct of one's doxastic life, which do not emanate from any particular religious tradition, that enjoin us to be conscientious in our believings. In her view, conforming to these norms does not license having religious beliefs: there are simply too many evidential impediments to having such beliefs, ranging from deep (...) theoretical challenges to the fundamental religious claims to questions about the reliability of the fundamental religious texts and traditions. Call these norms, which the religious inquirer holds that religious belief does not satisfy, external epistemic norms. On the other hand, there are norms that emanate from within the religious traditions themselves that speak against engaging in a religious way of life in order to enjoy its considerable goods by doing such things as playing the role of a believer or going through the ritualistic motions. Instead, these norms seem to call for genuine faith, which is understood to be something approximating what the true believer has. Call these norms, which place restrictions on how one could legitimately engage in a religious way of life, the internal religious norms. (shrink)

First I argue that the prohibition of linguistic self-reference as a solution to the antinomy problem contains a pragmatic contradiction and is thus not only too restrictive, but just inconsistent (chap.1). Furthermore, the possibilities of non-restrictive strategies for antinomy avoidance are discussed, whereby the explicit inclusion of the – pragmatically presuposed – consistency requirement proves to be the optimal strategy (chap.2). The central question here is that about the actual reason for antinomic structures. It turns out to be a (...) form of negative self-conditioning (chap.3). This makes it necessary to clarify the status of negative concepts (chap.4). The generalization of these considerations (chap.5) leads to the actual analysis of the antinomic basic structure (chap.6): Decisively for the pragmatics of the concept is that it positively owns a meaning, so that positivity is always constituted by the concept qua concept. Thus a negative concept is characterized by a fundamental ambivalence: From a semantic point of view it has negative character, in its pragmatic status as a concept, however, it has positive character. If the meaning is especially that of a negative self-reference, the ambivalence leads to the antinomic constellation of a negative self-condition – that is the crux of the matter here! The concept thus possesses the property defined by it exactly when it does not possess it and vice versa. A closer analysis shows that the function of reflective structures for the occurrence of antinomies has to be judged much more differentiated than previous opinions suggest. Not only are four forms of reflectivity to be distinguished in this context – ontic, semantic, pragmatic reflectivity, and especially the form of negative self-condition; but it is also apparent that these are intertwined with each other in a way that is difficult to be understood. The astonishing variety of relationships associated with this makes the irritation that has always emanated from the antinomy problem appear more comprehensible. In the developed pragmatic perspective furtheron parallels to the structure of self-consciousness become visible (chap.7). I conclude with considerations about the significance of the antinomic structure for the problem of dialectics, especially for the synthesis formation of mutually exclusive terms (chap.8). ---------- Zunächst wird gezeigt, dass das Verbot sprachlicher Selbstreferenz als Lösung des Antinomienproblems einen pragmatischen Widerspruch enthält und damit nicht nur zu restriktiv, sondern geradezu inkonsistent ist (Kap.1). Ferner werden Möglichkeiten nicht-restriktiver Strategien zur Antinomienvermeidung diskutiert, wobei sich die explizite Einbindung der – pragmatisch präsupponierten – Konsistenzforderung als optimale Strategie erweist (Kap.2). Zentral ist hier die Frage nach dem eigentlichen Grund antinomischer Strukturen. Er erweist sich als eine Form von negativer Selbst-Bedingung (Kap.3). Dies nötigt zu einer Klärung des Status negativer Begriffe (Kap.4). Die Verallgemeinerung dieser Überlegungen (Kap.5) leitet über zur eigentlichen Analyse der antinomischen Grundstruktur (Kap.6): Entscheidend zur Pragmatik des Begriffs gehört, dass ihm eine Bedeutung positiv zukommt, sodass durch den Begriff qua Begriff stets auch Positivität konstituiert ist. Dadurch ist ein negativer Begriff durch eine prinzipielle Ambivalenz gekennzeichnet: In semantischer Hinsicht hat er negativen Charakter, in seinem pragmatischen Status als Begriff hingegen positiven Charakter. Ist die Bedeutung insbesondere die eines negativen Selbstbezugs, führt die Ambivalenz zur antinomischen Konstellation einer negativen Selbst-Bedingung – das ist hier der springende Punkt! Der Begriff besitzt so die durch ihn definierte Eigenschaft genau dann, wenn er sie nicht besitzt und umgekehrt. Die nähere Analyse zeigt, dass hierbei die Funktion reflexiver Strukturen für das Auftreten von Antinomien weitaus differenzierter zu beurteilen ist, als bisherige Auffassungen nahelegen. Nicht nur dass in diesem Kontext vier Formen von Reflexivität – ontische, semantische, pragmatische Reflexivität und insbesondere auch die Form negativer Selbstbedingung – unterschieden werden müssen; es zeigt sich auch, dass diese in schwer durchschaubarer Weise ineinander verschränkt sind. Die damit verbundene erstaunliche Beziehungsvielfalt läßt die Irritation, die seit je vom Antinomienproblem ausging, begreiflicher erscheinen. In der entwickelten pragmatischen Perspektive werden ferner Parallelen zur Struktur von Selbstbewußtsein sichtbar (Kap.7). There is no paradox in the well-known historical fact that the bourgeoisie, in the period when the capitalist mode of production was coming into being, declaimed against the idea of instituting the kingdom of reason on earth, and converted from Catholicism to the Protestant religion. For Catholicism had asserted that the world was rationally organized in accordance with higher divine intent and that religious belief was in harmony with human reason, although superior thereto inasmuch as the source of faith was (...) revelation or emanation from divine reason. Protestantism, on the other hand, counterposed to this a religion that appealed to common sense, the irrationalist teaching that revived Tertulian's famous proposition Credo quia absurdum. (shrink)

Why are computers so smart these days? And why are humans apparently still a bit smarter? Does this have something to do with the difference between data and meaning? Does this in turn mean that at least some abstract entities, such as numbers, exist independently of human thought? Wouldn’t that require an expansion of our scientific world view? And would that at all be compatible with what we know about our world from physics and chemistry, philosophy, psychology, neuroscience and the (...) theory of evolution? Finally, what would this tell us about ethical and aesthetic value theories? These and related questions will be discussed in this book. We will find that the difference between data and meaning, i.e. quantitative and qualitative information, does indeed appear to be of central importance for understanding both artificial and natural intelligence. And then the independent existence of abstract entities not only appears to be a particularly promising hypothesis, but also one that is entirely compatible with the sum of our scientific knowledge, especially with regard to value theories. The book thus arrives at the exploration of a scientifically tenable, panpsychistically inspired, objective idealism that can be derived from our most fundamental intuitions as subjects that perceive qualities, but that can also take into account the structuring of the world already at the micro-scale, found in the modern natural sciences. The result is a Platonic, but in a second step also a scientific realism and a naturalism in the sense that it is informed by the natural sciences in terms of an inductive metaphysics. An objective idealism, not in a rationalistic maximum form, but in a pragmatic minimum form; without eternal truths, but dependent on the continued philosophical-scientific and also philosophicalsocial dialog. The proposed model could offer interesting solutions to a number of problems at and near the mind/matter boundary: Proposals are being considered for the interpretation of quantum mechanics, the problem of molecular symmetry, the neuronal code and the binding problem in neuroscience, mental causation, a more holistic understanding of mental processes, and so on and so forth. However, the extent to which the model threatens to promise far too much is also being discussed. In sum, the core question is how we can imagine human thinking beyond physically conceived information processing. An alternative model of human thinking is then put up for discussion, for which not only machine-like cognitive performance, but above all the intentional perception of qualitative information, i.e. of abstract entities, would be central, as well as the free, ultimately creative linking of patterns of quantitative information (signals, data) with such qualities (meanings). Pico’s view on emanationism is ambiguous. Moreover, his position viz. emanation seems to change at times. He made his emanationism more elaborate and complex by incorporating in it Neoplatonic ideas and the Kabbalistic hierarchy. He attempted a reconciliation of emanatio and creatio ex nihilo, as certain Christian Neoplatonists like Augustine did before, but Pico’s main intention was not the defense of the Christian dogma. To illustrate this point, I note that he did not hesitate to interpret even the book (...) of Genesis through Neoplatonism and Kabbalah, despite the resistance of the Roman Church. Philosophical accuracy and integrity was not always Pico’s main concern since he intended to prove the concordia of all the major previous philosophies and theologies. Furthermore, he disagreed with Aquinas’ solution for the problem of emanatio and creatio ex nihilo. He went on defending emanationism by relying on scholastics like Albertus Magnus. The aim of this paper is to explore Pico’s dependence on Proclus concerning the relation of emanatio and creatio ex nihilo. (shrink)

One of the main problems of Plato's unwritten doctrine has to do with whether his theory of principles has a strictly dualistic or rather a more monistic character. The thesis of this essay is that Plato combines monism and dualism in a particular fashion. Both the dialogues and the testimony of the unwritten doctrine reveal that in Plato's metaphysics the One is the genuinely absolute principle; Plato's second principle, the Many, is not a second absolute - otherwise it would dissolve (...) the very concept of the absolute. Instead, Plato conceives the principle of multiplicity itself as a unity, therefore as in some - in any event ineffable - way as being derived or having emanated from the absolute One. The One itself is wholly transcendent and thus ineffable, knowable neither by reason nor by intellective intuition. Nonetheless, being and knowledge are constituted by the coordination of the One and the Many, for which reason the latter is a principle. Hence, Plato's metaphysics combine a monistic ascent to the absolute with a dualistic derivation of being, a combination made necessary because the One transcends not only all being, but also all knowledge. Despite its historical importance, no study has been devoted specifically to the treatment that this problem has received on the part of those who were at the forefront of the reception of the Graeco-Arabic Peripatetic Corpus in the Latin West, namely the philosophers who taught at the Parisian Faculty of arts between 1230 and 1260. This article intends to fill this gap by offering the first translation into French — translation made mainly from manuscripts of the original Latin texts — of relevant excerpts from Isagoge Commentaries written by significant masters belonging to that milieu. A study of problems, all revolving around the subject of intellect in the philosophies of Alfarabi, Avicenna, and Averroes, this book starts by reviewing discussions in Greek and early Arabic philosophy which served as the background for the three Arabic thinkers. Davidson examines the cosmologies and theories of human and active intellect in the three philosophers and covers such subjects as: the emanation of the supernal realm from the First Cause; the emanation of the lower world from the (...) transcendent active intellect; stages of human intellect; illumination of the human intellect by the transcendent active intellect; conjunction of the human intellect with the transcendent active intellect; prophecy; and human immortality. Davidson shows that medieval Jewish philosophers and the Latin Scholastics had differing perceptions of Averroes because they happened to use works belonging to different periods of his philosophic career. We present a new approach to the old problem of how to incorporate the role of the observer in statistics. We show classical probability theory to be inadequate for this task and take refuge in the epsilon-model, which is the only model known to us caapble of handling situations between quantum and classical statistics. An example is worked out and some problems are discussed as to the new viewpoint that emanates from our approach.

The aim of this paper is to discuss popular conceptions of business ethics and their relationship to the problem of racial injustice by way of reviewing Spike Lee’s (1989) _Do the Right Thing_. Taking place on one day in late 80’s Bedford-Stuyvesant, and set against a tense decade of racial conflict in New York City, Spike Lee’s masterpiece has deeply influenced American discourse on race, capturing many of the complex interpersonal dynamics that are both constitutive and consequence of American (...) racial hierarchies. Instead of focusing on shareholders and stakeholders, I argue that _Do The Right Thing_ suggests a more political understanding of business’s ethical obligations: a business’s ethical obligations don’t emanate from internal relations but from its social and political position. I conclude by discussing a more recent film, Steve McQueen’s (2020) _Mangrove_. Like _Do the Right Thing_, _Mangrove_ also focuses on a business that is at the center of an urban racial conflict, but which stands in a very different relationship to this tension, providing an alternative illustration of business ethics informed by political and social positioning. The silencing of the epistemologies, theories, principles, values, concepts and experiences of the global South constitutes a particularly egregious epistemic injustice in bioethics. Our shared responsibility to rectify that injustice should be at the top of the ethics agenda. That it is not, or only is in part, is deeply problematic and endangers the credibility of the entire field. As a first step towards reorienting the field, this paper offers a comprehensive account of epistemic justice for global health ethics. We (...) first introduce several different conceptions of justice and decolonisation in relation to knowledge, purposefully drawing on work emanating from the global South as well as the global North. We then apply those conceptions to the global health ethics context to generate a tripartite account of the layers of epistemic justice in the field: who is producing ethics knowledge; what theories and concepts are being applied to produce ethics knowledge; and whose voices are sought, recorded and used to generate ethics knowledge. These layers reflect that the field spans conceptual and empirical research. We conclude by proposing that, going forward, three avenues are key to achieve greater epistemic justice at each layer and to help decolonise global health ethics: namely, understanding the problem, dialogue and structural change. The main theme of the meeting was the "Possibility of Religious Philosophy." The meeting consisted of four sessions, one research presentation, and a general overview on the final day.Two sessions were staged on the (...) first day. They dealt with a reconsideration of the religious philosophy of Jan Van Bragt (1928–2007), following the meeting in 2007, which generally covered his academic contributions. First, Keta Masako (Kyoto University) read a paper titled "A Configuration in the Contemporary World: A Response to Jan Van Bragt's Expectation and Disappointment at the Kyoto School of Philosophy." (Unfortunately I was unable to attend this session, so I am not able to summarize the presentation.) Next, Hanaoka Eiko (Nara University of Industry) presented a paper titled "In Search of the New Possibility of Religious Philosophy: Fundamental Experience and a Turning Point for Philosophy." She insisted that we need to keep in mind an overview of the religious philosophies of Nishida Kitaro, Tanabe Hajime, and Nishitani Keiji in order to understand Van Bragt's criticism of the Kyoto school. Nishida's ideas of the "logic of the place of nothingness" and the "unity of mind and body" work together, she suggested; this polarity was "one," in accordance with the idea of the "self-identity of absolute contradictions." But in Hanaoka's opinion, Van Bragt sometimes placed a disproportionate emphasis on one side of the polarity. Hanaoka identified ten polarities in Nishida's absolute nothingness: (1) philosophy of self-awareness and philosophy of existence, (2) substantial philosophy and non-substantial philosophy, (3) experience and rationality, (4) plurality and unity, (5) continuity and discontinuity, (6) temporality and eternity, (7) matter and spirit, (8) process and reality, (9) true self and ego, and (10) philosophy and the philosophy of philosophy. Hanaoka argued that Van Bragt's doubts would have disappeared if he had fully experienced love as that which emanates from the "oneness" of the polarity of absolute nothingness.On the second day of the meeting, Peter Baekelmans gave a presentation titled "The Faith of The Awakening Faith in Mahayana." The deeper that belief becomes, he said, the less important the difference between belief and practice becomes. Some textual scholars in the audience objected to that line of thought, suggesting that we needed more circumspect analysis in order to accept such a perspective.At the third session, Kim Seung-Chul (Kinjōgakuin University) read a paper on "Christian Theology Facing Religion and Science." He called the relation of religion and science a "double reflection," referring to theories by sociobiologist Edward O. Wilson and philosopher of science Ian Barbour. Kim interpreted religion and science in Nishitani as a "superposition" of existential order. Kim focused on two meanings of nondiscrimination according to Nishitani: "nondiscrimination in nature," found in science, and "nondiscrimination in love," found in religion. The former was symbolized by matter and the latter by life. The place where these two nondiscriminations coincide, he said, is exactly the "standpoint of emptiness." This article deals with the links between the enaction paradigm and artificial intelligence. Enaction is considered a metaphor for artificial intelligence, as a number of the notions which it deals with are deemed incompatible with the phenomenal field of the virtual. After explaining this stance, we shall review previous works regarding this issue in terms of artificial life and robotics. We shall focus on the lack of recognition of co-evolution at the heart of these approaches. We propose to explicitly integrate (...) the evolution of the environment into our approach in order to refine the ontogenesis of the artificial system, and to compare it with the enaction paradigm. The growing complexity of the ontogenetic mechanisms to be activated can therefore be compensated by an interactive guidance system emanating from the environment. This proposition does not however, resolve that of the relevance of the meaning created by the machine (sense-making). Such reflections lead us to integrate human interaction into this environment in order to construct relevant meaning in terms of participative artificial intelligence. This raises a number of questions with regards to setting up an enactive interaction. The article concludes by exploring a number of issues, thereby enabling us to associate current approaches with the principles of morphogenesis, guidance, the phenomenology of interactions and the use of minimal enactive interfaces in setting up experiments which will deal with the problem of artificial intelligence in a variety of enaction-based ways. Presented is a discourse on the contextual nature of physical qualities. The realistic and observational contexts in which a system exists are demonstrated as equally involved in defining its qualities. Each quality could be consequently considered as natural and experiential at the same time. The subsequently proposed thesis of the contextual co-definition of natural/experiential qualities in the relationship between the human mind and Nature is shown to possess numerous favorable ethical and aesthetical implications. The contextual nature of experiential qualities is (...) further correlated with the holistic character of natural systems and events, which is illustrated by several real-life examples. A systemic approach to knowledge is shown to naturally emanate from the acceptance of the contextual definition of physical qualities and the holistic nature of experiences. Methodological problems of the standard, reductionist explanatory frameworks are additionally discussed with an emphasis on the major descriptive flaws of quantificational approaches and in respect to cybernetic and autopoietic organization of physical and biological systems. This article addresses the art of living in a technological culture as the active engagement with technomoral change. It argues that this engagement does not just take the form of overt deliberation. It shows in more modest ways as reflection-in-action, an experimental process in which new technology is fitted into existing practices. In this process challenged values are re-articulated in pragmatic solutions to the problem of working with new technology. This art of working with technology is also modest in (...) the sense that it is not oriented to shaping one’s own subjectivity in relation to technology. It emanates from human existence as relational and aims at securing good relationships. The argument will be developed in relation to a case study of the ways in which homecare workers engaged with the value of privacy, challenged by tele-monitoring technology that was newly introduced into their work. The policy changes governing the relations between the pharmaceutical, medical device and service industries and academic clinical research physicians, recommended by the Institute of Medicine,1 the American Academy of Medical Colleges,2 and much discussed in the media and on our campuses, aim to create some protective ethical firewalls. However, some potentially critical consequences of these steps are missed if we do not acknowledge what else is on the table, and who is sitting at it. By only reacting defensively to the (...) juggernaut of righteous indignation over the loss of purity in a faculty physician's approach to medical problem solving, we are allowing the process to blind us to the difficulties in establishing fair and equitable management of all of the potential conflicts of commitment and conflicts of interest we incur, not only as faculty members, but also as departments and academic medical centres . Critically, this involves all sources of revenue—private, commercial and public—that support our professional and institutional commitments as well as our personal finances.i To counter the present crackdown on inappropriate financial relationships effectively, we will need to reframe the questions, and convince all stakeholders to the process that there is more to this crisis than can be resolved through our public confessions of commercial largesse obliged. The Phrma Code guidelines3 have resulted in what is believed to be a defensible, if as yet legally untested, compartmentalisation of the commercial sector's marketing, medical education and research sponsorship activities. We at the AMC are a long way from understanding how those same missions, as they emanate from our multifarious commitments, can be isolated and individually managed. The Cambridge Analytica–Facebook scandal led to widespread concern over the methods deployed by Cambridge Analytica to target voters through psychographic profiling algorithms, built upon Facebook user data. The scandal ultimately led to a record-breaking $5 billion penalty imposed upon Facebook by the Federal Trade Commission in July 2019. The FTC action, however, has been criticized as failing to adequately address the privacy and other harms emanating from Facebook’s release of approximately 87 million Facebook users’ data, which was exploited without user (...) authorization. This Essay summarizes the FTC’s response to the Cambridge Analytica–Facebook scandal. It concludes that the scandal focuses attention on the need to explore the potential for embedding due process-type inquiries and protections within the enforcement actions by regulatory agencies such as the FTC. These protections are increasingly important in addressing the problem of “black boxing the voter” that is now presented by data- and algorithmic-driven companies such as Cambridge Analytica and Facebook. The foundations of research ethics are riven with fault lines emanating from a fear that if research is too closely connected to weighty social purposes an imperative to advance the common good through research will justify abrogating the rights and welfare of study participants. The result is an impoverished conception of the nature of research, an incomplete focus on actors who bear important moral responsibilities, and a system of ethics and oversight highly attuned to the dangers of research but largely (...) silent about threats of ineffective, inefficient, and inequitable medical practices and health systems. -/- In For the Common Good: Philosophical Foundations of Research Ethics, Alex John London defends a conception of the common good that grounds a moral imperative with two requirements. The first is to promote research that generates the information necessary to enable key social institutions to effectively, efficiently, and equitably safeguard the basic interests of individuals. The second is to ensure that research is organized as a voluntary scheme of social cooperation that respects its various contributors' moral claims to be treated as free and equal. Connecting research to the goals of a just social order grounds a framework for assessing and managing research risk that reconciles these requirements and justifies key oversight practices in non-paternalistic terms. Following in the footsteps of the author's well-received first book1 and his magisterial contribution to the Cambridge History of Ancient China,2Writing and Authority establishes Lewis as the premier Western historian of the crucial centuries surrounding the unification of China under a centrally administered empire in 221 B.C. The book's complex, comprehensive, and coherent argument is informed by a variety of Western theoretical approaches, but it principally emanates from a close reading of the full record of transmitted texts and recently excavated manuscripts on [End Page 127] bamboo or wooden slips. The inclusion of the latter class of sources, beset with treacherous problems of decipherment, is still unusual in mainstream sinological scholarship and indicates the author's supreme confidence in his philological skills. With a firm hand, undaunted by the multifarious nature of his materials, Lewis guides the reader to some fundamental themes in recent sinology, opening manifold novel perspectives along the way. Even when dealing with well-known texts, he often proposes striking reinterpretations.In his Introduction, Lewis enumerates six main functions of writing in ancient China: enforcing state authority; creating text-based communities and "public spheres"; transcending the confines of space, time, and human mortality; fashioning figures of authority in the past; standardizing specialized technical terminology; and encrypting secret meanings. In Lewis' own words, "the culminating role of writing in the period, and the key to its importance in imperial China, was the creation of parallel realities within texts that claimed to depict the entire world" (p. 4). This ultimately led to the formation of the Confucian canon as a "textual double of the polity" that could survive cataclysmic changes of regimes.In chapter 1, "Writing the State," Lewis points out that before the Warring States period Chinese writing occurred exclusively in religious contexts. After circa 500 B.C., written documents gradually came to be used in the administration of government and trade. Both in their details of formulation and in the implication that anything committed to writing was thereby supernaturally validated, these new types of documents exhibit pervasive continuity with the earlier kinds of texts used in ritual communication with the ancestral spirits. Such continuity is also reflected in the rise of religious beliefs in a netherworld governed by a bureaucratic hierarchy and administrative processes parallel to those of the world of the living. According to Lewis, "the most important modification in the shift to an administrative polity [in the Warring States] was the extension of writing to new elements of the population. The attributes of the Zhou nobility... were transferred to the common people in the administrative documents of the new state. This widening range of inscription into the state order altered the social meaning of being recorded from a sign of power to one of subjection" (p. 13).Warring States rulers were cast in the role not of the authors of texts but of the authority behind them. Administrative and legal texts were concerned, ultimately, with the proper naming of phenomena, a process that had to adapt itself continually to the changes of the times. The authority of rulers came to encompass both human society and the natural world. Genetic and other biotechnologies are starting to impact significantly upon society and individuals within it. Rose and Novas draw on an analysis of many patient groups to sketch out the broad notion of biocitizenship as a device for describing how the empowered and informed individual, group or network can engage with bioscience. In this paper, we examine critically the notion of biocitizenship, drawing on both sociological fieldwork that grounds the debate in the views of a large and varied group of (...) concerned actors. Using work within green politics, we identify shortcomings in the concept of biocitizenship as it has so far been explicated. The value assumptions lying behind an account of biocitizenship, and its tendency to see issues through a reductive lens, are examined. Alternative views of values and goals, which may undermine any alleged rights and duties, are explored using interviews and other ethnographic data that illustrates the complexity of the terrain. The reductive lens of biocitizenship is explored through contrast with the wider scope of concerns emanating from various sources, including many within green politics. If such complexities are not recognised, there is a danger that a concept of biocitizenship may serve to create and amplify inequalities. Problems with identity issues are key: the construction of identity is complex and many groups are explicitly rejecting the ‘biological’ label. We discuss the multiple relations of citizens with the biotech and pharmaceutical industries. Arguably, existing inequalities in power relationships, exploitation, commodification and ownership patterns are being perpetuated in novel ways through the new biosciences. We pose the question of whether it is possible to construct a concept of biocitizenship that overcomes these problems. (shrink)

This article discusses Leibniz’s claim that every substance is endowed with the property of perception in connection with Platonism, rationalism and the problem of substance monism. It is argued that Leibniz’s ascription of perception to every substance relies on his Platonic conception of finite things as imitations of God, in whom there is ‘infinite perception’. Leibniz’s Platonism, however, goes beyond the notion of imitation, including also the emanative causal relation and the logical (i.e. definitional) priority of the absolute over (...) the limited. It is proposed that Leibniz’s endorsement of Platonism, in conjunction with some rationalist elements of his philosophy, implies a monistic conception of particulars as modifications of a single substance. Following some scholars and opposing others, the article offers evidence that Leibniz accepted this implication during the last years of his Paris period. However, it is further argued that it was precisely the idea of perception as a property of every substance that allowed Leibniz to find a way out of monism after that period. More specifically, the article defends the view that what made room for ontological pluralism within Leibniz’s rationalist and Platonic outlook was the idea that perception is the property which constitutes the very being of substances: substances are their perceptions. The executed study focuses its attention on the phenomenon of the language as the legitimation factor of cultural narratives and the space of metaphysics bases creation as the Western way of thinking grandnarrative. It scrutinizes the language role and status in the works by L. Wittgenstein and J. Derrida whose worldview systems differ greatly from the preceding metaphysic tradition and simultaneously preserve and inherit the classical principles of philosophizing. It has been proved that both philosophers have closeness of views in (...) the matter of Western Philosophy genesis. The article emphasizes that L. Wittgenstein and J. Derrida have the same object of cognition, which is the postulate that there exist inviolable universals in a language structure: general rationalistic principles on the bases of which the whole system of Western Metaphysics is created. It has been demonstrated that within deconstructionism, as well as within L. Wittgenstein philosophy, different ways are used to confirm a language role as the specific instrument for expressing senses, which in the process of reality acquisition forwards semantic violence over it. The author considers that the main objective of the publication is to demonstrate the critical direction of the two conceptions concerning the language nature as the actual space for cultural narratives formation and the centerpiece for the creation of main metaphysical Western way of thinking senses. L. Wittgenstein and J. Derrida experience has great potential for understanding and solving contemporary humanitaristics key transformational problems. The article states that the tradition of own principles "revision", characteristic of the ХХ century philosophy, has different worldview grounds in different conceptions. But their common item is the recognition of the fact that these general universal principles are rooted, in the best part, in a language as a social way of thinking abstract model. In point of fact, in deconstructionism we deal not with basic ideas borrowings in a creative search of overcoming metaphysics, but with the so-called emanation of senses. At the advanced historical stage this phenomenon of emanation includes the actual experience of "overcoming" in the traditions set up by M. Heidegger, R. Karnap, L. Wittgenstein and acquires its utmost presentation in the works by J. Derrida. (shrink)

Women’s entry into the legal academy in significant numbers—first as students, then as faculty—was a 1970s and 1980s phenomenon. During those decades, women in law schools struggled: first, for admission and inclusion as individual students on a formally equal footing with male students; then for parity in their numbers in classes and on faculties; and, eventually, for some measure of substantive equality across various parameters, including their performance and evaluation both in and in front of the classroom, as well as (...) in the quality of their experiences as students and faculty members and in the benefits to be reaped from their tenure. This part of the story of women’s entry into the legal academy in the 1970s and 1980s—a story of attempted admission, then inclusion, then integration and assimilation, and then, finally, equality—is now a familiar one, at least in broad outline. It is not, in its entirety, an uplifting story. According to a raft of articles produced by women law students in the 1980s, 1990s, and 2000s, women law students during those decades participated less in the classroom, were called on and responded to differently when they did participate, suffered from more law-school-induced anxiety disorders and other mental health issues, graduated with lower GPAs and less law review experience, published fewer notes and filled fewer editorial positions on those journals, held fewer leadership positions overall while in law school, and had far more difficulties connecting with mentors, teachers, and would-be recommenders among the faculty than male students. Women law professors during those decades were tenured at significantly lower rates than men and, particularly at high prestige schools and at schools with fewer female faculty among the tenured ranks, were hired at lower rates that did not reflect their number in the pool of qualified applicants, had trouble asserting or maintaining authority in the classroom or being perceived as having authority, taught lower-prestige courses and received low teaching evaluations, and, like their students, were published far less frequently in the major and most prestigious law reviews. Much of this, albeit not all, has not changed much for either students or faculty. As women in law schools enter the posttenure and midcareer phase, many of the old problems persist while new ones appear: women faculty are invited to participate on panels less often than men, and both women students and faculty are underrepresented as authors in law reviews. Although gender-neutral parental leave is now available to faculty at most law schools, many such policies are still ad hoc. There is considerable worry, although no hard evidence, over whether men disproportionately use the time off to write rather than care for children. Women are still disproportionately overrepresented in some fields and underrepresented or unrepresented in others, and those fields correlate in unsurprising ways with levels of prestige: the more women in a field, the less prestigious. As elsewhere in the workforce, women faculty in legal education suffer from sexual harassment, most of which is unremedied. Women still suffer a pay gap in law schools that remains unaddressed at most universities, as it does elsewhere in academia. There is a sizeable literature on these depressing phenomena that stubbornly do not seem to abate. In these comments, however, I want to focus on another, less appreciated, part of the story of women’s entry into the legal academy in the 1970s and 1980s: the emergence of a body of scholarship—sometimes called feminist legal theory—produced by some of these women legal scholars over the same time period. The story I want to focus on, in other words, is not that of second- or third-wave women’s struggles within the academy, either for admission, acceptance, assimilation, or equality in law schools. Rather, this Article focuses on the story of the scholarship some of those second-wave assimilated women produced once they got there. Feminist jurisprudence, understood largely as scholarship on issues pertaining to gender equality, was launched in the 1970s, endures today, and continues to shape debates. Feminist legal theory, however, was in effect a subfield within feminist jurisprudence and, as its name implies, was an attempt to fashion a broad- based theoretical account of the relationship of law in liberal legal regimes to women’s subordination, patriarchy, and gender and sexual inequality— particularly in a post–civil rights era, when women enjoyed broad access to rights of formal equality, reproductive liberty, and liberal antidiscrimination law. Feminist legal theory so understood—a body of scholarship in search of a theoretical understanding of the relation of law to women’s subordination or, more simply, of law and patriarchy—was birthed in the 1970s, nurtured in the 1980s, and matured in the 1990s. I suggest in this Article that it is now seemingly in decline, and may soon disappear altogether. The reasons for this trajectory, I believe, are to date unexplored. Some reasons are fairly self-evident. Feminist legal theory was a product of three time-specific factors peculiar to the 1970s and 1980s: it reflected the political and the legal struggles of second-wave feminism. The critical theory schools were, to varying degrees, present or thriving in the academy in the 1970s and 1980s, within which feminist legal theory was birthed, grew, and then coexisted with critical theory, albeit at times very uneasily; and this feminist theory reflected second-wave women faculty and students’ mixed experiences of assimilation, success, and alienation in law schools themselves, as briefly recited above. Those three factors—the background politics, the presence of critical theory in law schools, and the differences in women’s experience of those schools—are all themselves either disappearing or dissipating in felt urgency, albeit in different ways and at different speeds, and that dissipation clearly is a part of the story of feminist legal theory’s decline. There are other reasons for its decline as well, however. Some are internal to feminism and feminist theory, and some pertain to the changing nature of legal scholarship from the 1980s to the present. I explore these reasons in Part II below. The story of the development of a distinctively feminist legal theory during the 1970s through the 1990s, and the story of its decline in the 2000s, is of obvious relevance to the history of second- and third-wave feminism. It should also be of interest for what it reveals about the nature of legal scholarship as it was understood, received, and produced in those decades. Its decline likewise reveals something about the changing nature of legal scholarship and the legal academy today. Thus, one conclusion I draw is that the feminist legal theory of the 1970s through the 1990s—regardless of the truth or lasting power of its claims—stands as an example of a type of legal scholarship that was somewhat distinctive to those decades. That form of legal scholarship, furthermore, likely can only emanate from the legal academy. For a host of reasons, we are currently in danger of losing this entire genre of intellectual work, which would be the polity’s loss, not just feminism’s or the legal academy’s. (shrink)

Summary Research consists of choosing a problem, proposing and testing problem solutions, and presenting the results. In its central moment — conjectures and testing — science must be autonomous in order to be successful. Securing this autonomy by organizational means is one of the tasks of research policy. Research needs to justify itself only when the researcher makes a claim to the resources of others. To discuss problems of justification of governmental support, it is imperative to distinguish between (...) basic and applied research. In basic research the problem choice is guided only by considerations of scientific interest , while in applied research the problems emanate from extra-scientific concerns since applied research is by definition a means for tackling concrete practical problems. Deciding on external criteria (e.g. deciding whether to support more energy research or more cancer research) is a genuine political problem rather than a problem of research policy. Thus applied research can be justified by referring to the benefit the expected results will yield, but basic research requires a completely different justification. One such justification is the argument that applied research requires a certain overhead in basic research. Securing an adequate balance between funding basic and applied research within the problem area concerned is another task of research policy. (E.g. in the area of cancer whether to support more molecular biology research or more clinical research.) When the overhead argument is not applicable, there still remain several possible justifications for basic research. These are examined in the paper. When setting priorities for basic research within a certain discipline, one apparently must turn to the scientific community itself. It may well be that the researches, who constitute the only expertise available for this task, have to rely on tacit knowledge . If so, this remains afaute de mieux procedure since articulated criteria would be preferable to intuitive procedures. The purpose of methodological reflection on research policy making is to supply intellectual instruments for making the discussion about substantive problems more rational. The substantive problems can be tackled only through the close cooperation of research policy makers and researchers. Thus methodology should not limit the degrees of freedom of either but increase them. (shrink)

This study is based on the many cosmological problems in Islam as aspects of thought that receive serious attention. In fact, there are also many polemics of thought that occur amongst Muslim scholars, which can be divided into two main groups: traditionalists and rationalists. The traditionalists, represented by Al-Ghazali and the Ash’ariyah theologians, put forward their cosmological thinking on the principle of God’s absolute will, while the rationalists, especially those represented by Avicenna, proposed their cosmological thinking based on the theory (...) of emanation from Plotinus in terms of its creation and the concept of a geocentric Ptolameus in terms of its structure. In this conflict of thought between the two groups, Averroes proposed a cosmological thought different from the two. This study seeks to elaborate on the thought of Ibn Rushd’s cosmology which is different from that of Ibn Sina and Al-Ghazali.Contribution: This research provides a clear understanding of the cosmological thoughts put forward by earlier Muslim thinkers. In particular, it wants to bridge the differences regarding the concept of cosmology as put forward by Ibn Sina and Al-Ghazali and how Ibn Rushd bridges the two. (shrink)

This essay will consider the dispute between Charles Sanders Peirce and John Dewey on the nature and validity of the theory/practice distinction. Their dispute concerns whether a strong affirmation of this distinction enables scientific inquiry or disables it. Inherent in this issue are two related questions, namely whether tmth can be pursued for its own sake, and, as a subset of this question, whether there is an evidence proper to the consideration of pure possibilities. I will argue that there is (...) a common ground between the logic of inquiry which Dewey is determined will have practical effect, and the logic of inquiry which Peirce is concemed will discover the truth promised by correct investigation. This compromise is found in the philosophy of Bemard Lonergan, whose critical realism includes an account of concrete judgement strikingly similar to that of John Dewey, but whose account of the normative stmcture of cognition, emanating from the individual's radical desire to know, also incorporates Peirce's emphasis on the pursuit of truth and on the validity of the scientist's consideration of pure logical possibilities. I will present these similarities, and will consider the stmcture of Einstein's 1905 paper, "On The Electrodynamics of Moving Bodies," as a case study which supports Lonergan's (and Peirce's) account of cognitional stmcture, but which poses problems for Dewe/s instrumentalism. The essay concludes that Lonergan offers a critical realism which successfully renounces the 'spectator' theory of knowledge without underestimating the importance of the normative element of understanding in the human desire to know. I propose three new curved spacetime versions of the Dirac Equation. These equations have been developed mainly to try and account in a natural way for the observed anomalous gyromagnetic ratio of Fermions. The derived equations suggest that particles including the Electron which is thought to be a point particle do have a finite spatial size which is the reason for the observed anomalous gyromagnetic ratio. A serendipitous result of the theory, is that, to of the equation exhibits an asymmetry (...) in their positive and negative energy solutions the first suggestion of which is clear that a solution to the problem as to why the Electron and Moun—despite their acute similarities—exhibit an asymmetry in their mass is possible. The Moun is often thought as an Electron in a higher energy state. Another of the consequences of three equations emanating from the asymmetric serendipity of the energy solutions of two of these equations, is that, an explanation as to why Leptons exhibit a three stage mass hierarchy is possible. Bioethics became applied ethics when it was assimilated to moral philosophy. Because deduction is the rationality of moral philosophy, subsuming facts under moral principles to deduce conclusions about what ought to be done became the prescribed reasoning of bioethics, and bioethics became a theory comprised of moral principles. Bioethicists now realize that applied ethics is too abstract and spare to apprehend the specificity, particularity, complexity and contingency of real moral issues. Empirical ethics and contextual ethics are needed to incorporate these (...) features into morality, not just bioethics. The relevant facts and features of problems have to be identified, investigated and framed coherently, and potential resolutions have to be constructed and assessed. Moreover, these tasks are pursued and melded within manifold contexts, for example, families, work and health care systems, as well as societal, economic, legal and political backgrounds and encompassing worldviews. This naturalist orientation and both empirical ethics and contextual ethics require judgment, but how can judgment be rational? Rationality, fortunately, is more expansive than deductive reasoning. Judgment is rational when it emanates from a rational process of deliberation, and a process of deliberation is rational when it uses the resources of non-formal reason: observation, creative construction, formal and informal reasoning methods and systematic critical assessment. Empirical ethics and contextual ethics recognize that finite, fallible human beings live in complex, dynamic, contingent worlds, and they foster creative, critical deliberation and employ non-formal reason to make rational moral judgments. There is widespread agreement that the most serious and debilitating contemporary social problem in the developed capitalist world is the problem of enforced or involuntary unemployment. The growth in mass unemployment in the 1970s and 80s has produced a renewal of the demand by the labour and trade union movement1 for the implementation of a ‘right to work’; presumably in the belief that the official recognition and legal enforcement of such a right would lead to the increased availability (...) of jobs. This campaigning slogan has sometimes emanated from the most unlikely sources. In his introduction to a published account of the 1971 Upper Clyde Shipbuilders occupation and work-in, entitledThe Right to Work, Mr Harold Wilson (then, significantly, in opposition) declared that ‘what the men of the Clyde proclaimed, and what I went to Clydeside to assert, was “the right to work”.
