The Post-Vatican revision of moral theology aimed to reduce legalism and take better account of the subjective factors in moral decision. Karl Rahner contributed to this effort by his “formal existential ethics” which featured a replacement of the classical “ultimate end” by the concept of the “fundamental ultimate option” as an exercise of transcendental freedom through concrete categorical acts. Diverse interpretations of this principle resulted in the system of “proportionalism” and the thesis of a category of “serious” sins (...) intermediate between mortal and venial has been rejected in Veritatis splendor. Rahner himself seems to have held neither of these positions. The wide acceptance of the “fundamental option” (often with little acquaintance with its philosophical basis) is probably due to its supposed pastoral advantages. I argue that a proper application of the classical notions of ultimate end and the distinction between objective and subjective morality are pastorally more practical and avoids the many philosophical obscurities connected with the idealism of transcendental Thomism. Jean Porter, a noted moral theologian, has argued that Karl Rahner’s influential theory of the fundamental option is of little practical use in actually attempting to live a holy and virtuous life. Thomas Aquinas’ account of the infused virtue of charity, she claims, offers a richer account of the Christian moral life and so is of greater practical use. This essay challenges this assertion by placing Rahner’s notion of fundamental option into dialogue with Thomistic caritas. It (...) argues that the actions that Porter takes to be characteristic of charity—itself a controversial proposition—are themselves in need of greater specification and so not as “concrete” as Porter would have one believe. Beneficence, almsgiving, and fraternal correction must be interpreted in light of diverse historical and cultural circumstances. Rahner recognizes this problem and so is legitimately hesitant to over-specify the demands of neighbor love. Further the Thomistic account of virtues with its commitment to the unity of the virtues is not able to resolve the problem of the “flawed saint” or the virtuous non-believer’s prospects for salvation in the way Rahner’s account can. Thus the Thomistic program is far less detailed than Porter suggests and it involves considerable theological and pastoral costs. (shrink)

The Harvard Report, published in April 1999 for public consultation in Hong Kong, proposed a fundamental restructuring in its health care delivery and financing systems. The Report claims to be evidence-based in its approach (Hsiao et al., 1999a). While 'evidence' has been widely collected by the consultancy team through surveys, consultations and focus groups, the recommendations put forth are not value-free. They carry clear ideological preferences. The value assumptions and ethical presuppositions underlying the report are discussed in this paper. (...) The Harvard consultancy study is in favor of a positive government role in regulation and control, a single central body to administer compulsory health insurance for all citizens, and a purchaser-provider split to induce competition. Such preference is based on pre-existing ideology and generic health care management concepts, which are still in the experimental phase internationally. While value and ideology are inevitable factors in any policy choice, the challenge is to lay these values open for reflection and public debate. For Hong Kong, the challenge is also to take on local substantive issues in health care and deal with them head-on, rather than putting hope in a universal, generic solution. (shrink)

Recent scandals at Enron, WorldCom and Global Crossing have put the ethical spotlight on corporate malfeasance as never before. However, these are the situations in which management knew that they made the wrong choice. As professor Joseph Badaracco of Harvard Business School points out, the real ethical dilemmas arise when people must choose between right and right — where both choices can be justified, yet one must be chosen over the other. Whether or not to reprice stock options represents one (...) such ethical dilemma. Repricing can help exodus of talented employees and motivate them to improve firm performance. However, it alienates shareholders and other workers of the company who are left unprotected from the adverse economic consequences of a stock price decline.In this paper we examine the ethics and the economics of stock option repricing. We find that repricing runs counter to two key tenets of business ethics — distributive justice and ordinary decency. To examine the economics of repricing, we draw upon agency theory to identify situations where repricing has the potential to benefit shareholders. However, a survey of empirical research reveals that these benefits do not translate into reality. Repricing does not improve employee retention or firm performance. In addition, managers benefit by opportunistically timing the repricing. Due to weaknesses in corporate governance such as lack of independence and conflicts of interest, the current repricing practice seems to be at odds with the objective of shareholder wealth maximization, and at a more fundamental level, a violation of board's fiduciary duty to shareholders. We offer suggestions that mitigate the ethically undesirable effects of repricing in the wider context of prevailing corporate governance and regulatory environment. We believe that these suggestions, if properly implemented, can transform repricing from a greed-inspired evil to a valuable compensation tool to retain employees, boost their morale, and enhance stockholder wealth. Dispositional essentialism is the view that all or many fundamental properties are essentially dispositional, orpowers. The literature on the dispositional essence of powers is abundant. In contrast, the question of how to understand the fundamentality of fundamental powers has received scarce interest. Therefore, the fundamentality of powers stands in need of clarification. There are four main conceptions of the fundamental, namely as that which is (i)metaphysically independent; or (ii)belonging to a minimally complete basis; or (iii)perfectly natural; or (...) (iv)metaphysically primitive. Here, I present and discuss each of these approaches from the viewpoint of dispositional essentialism. I show that (i) is incompatible with the metaphysics of powers and (ii)–(iv) have more drawbacks than merits. Therefore, my conclusion is that the dispositional essentialist should seek an alternative. Although I offer no positive account, I pave the way to more fruitful views by identifying the shortcoming of these unpromising options. (shrink)

The fundamental principle of practical reasoning (if there is such a thing) must be a rule which we ought to follow in all our practical reasoning, and which cannot lead to irrational decisions. It must be a rule that it is possible for us to follow directly - that is, without having to follow any other rule of practical reasoning in order to do so. And it must be a basic principle, in the sense that the explanation of why (...) we rationally ought to follow this rule lies purely in the structure of our rational capacities themselves (and not, for example, in empirical evidence that we merely happen to have). This fundamental principle, it is argued, requires that you decide to do something only if the basis of your decision is such that (i) it is rational for you to believe that you have given the matter enough thought, and (ii) your actual deliberation does not warrant the conclusion that the chosen option is definitely worse than some other option that you have considered. A decision formed through reasoning is rational if and only if the agent followed this rule in making the decision. The claim that this is the fundamental principle of practical reasoning conflicts with Hobbesian approaches because it implies that practical reasoning aims not only at satisfying desires, but at forming beliefs about which options are better than others. It conflicts with Kantian approaches because it implies that to think of something as a good thing to do is not just to think of it as a rational thing to choose. This account also shows how to solve some famous controversies surrounding practical reason: the key is to understand how the rationality of concluding that one option is better than another is affected by our desires, our estimates of probabilities, and our moral judgments. This is perhaps the most fundamental and least controversial of all normative principles concerning action. Yet, it is not, I believe, well understood. For even setting aside questions about what our options are and what our reasons are, there are prior questions concerning how best to formulate the principle. In this paper, I address these questions. One of (...) the more interesting upshots of this inquiry is that the deontic statuses (e.g., obligatory, optional, and impermissible) of individual actions are determined by the deontic statuses of the larger sets of actions of which they are a part. The status of fundamental laws is an important issue when deciding between the three broad ontological options of fundamentalism (of which the thesis that physics is complete is typically a sub-type), emergentism, and disorder or promiscuous realism. Cartwright’s assault on fundamental laws which argues that such laws do not, and cannot, typically state the facts, and hence cannot be used to support belief in a fundamental ontological order, is discussed in this context. A case is made in (...) defence of a moderate form of fundamentalism, which leaves open the possibility of emergentism, but sets itself against the view that our best ontology is disordered. The argument, taking its cue from Bhaskar, relies on a consideration of the epistemic status of experiments, and the question of the possible generality of knowledge gained in unusual or controlled environments. Reform of the federal income tax system has become a perennial item on the domestic policy agenda of the United States, although there is considerable uncertainty over specifics. Indeed the recent report of the President's Advisory Panel on Federal Tax Reform recommended not one but two divergent policy directions. In Fundamental Tax Reform, top experts in tax policy discuss a wide range of issues raised by the prospect of significant tax reform, identifying the most critical questions and considering whether (...) the answers are known, unknown--or unknowable. The structure of our ethical experience depends, crucially, on a fundamental distinction between what we are responsible for doing or deciding and what is given to us. As such, the boundary between chance and choice is the spine of our conventional morality, and any serious shift in that boundary is thoroughly dislocating. Against this background, I analyze the way in which techniques of prenatal genetic diagnosis (PGD) pose such a fundamental challenge to our conventional ideas of justice and (...) moral responsibility. After a short description of the situation, I first examine the influential luck egalitarian theory of justice, which is based on the distinction between choice and luck or, more specifically, between option luck and brute luck, and the way in which it would approach PGD (section II), followed by an analysis of the conceptual incoherencies (in section III) and moral problems (in section IV) that come with such an approach. Put shortly, the case of PGD shows that the luck egalitarian approach fails to express equal respect for the individual choices of people. The paradox of the matter is that by overemphasizing the fact of choice as such, without regard for the social framework in which they are being made, or for the fundamental and existential nature of particular choices—like choosing to have children and not to undergo PGD or not to abort a handicapped fetus—such choices actually become impossible. We set out a fundamental ontology of atomism in terms of matter points. While being most parsimonious, this ontology is able to match both classical and quantum mechanics, and it remains a viable option for any future theory of cosmology that goes beyond current quantum physics. The matter points are structurally individuated: all there is to them are the spatial relations in which they stand; neither a commitment to intrinsic properties nor to an absolute space is required. What do we owe participants in collective pension plans in terms of socially responsible investment (SRI)? This paper draws into question current conventional wisdom on SRI, which considers investor engagement a more effective strategy than divestment to change morally problematic corporate behaviour. More fundamentally, in light of reasonable disagreement about the objective of SRI, the paper argues that participants in collective pension plans are owed some kind of control over their investments. Maurice Blondel's later works address the problem of the relationship between the Catholic Church and tradition and modernity. This dissertation situates Blondel's developed position between the analyses of modern philosophy and culture developed in the encyclicals Pascendi Dominicus Gregis and Fides et Ratio. Modernism in Catholic circles bears implications for philosophy in general, since modernism has its source in modern philosophy and the culture it gives rise to and reinforces. Three key concepts operating in Blondel's later works are the concrete (...) logic, the philosophy of insufficiency, and the option between egoism and charity. The concrete logic is a logic of the moral life, a logic in which opposition is fundamentally on the basis of hexis and steresis instead of the apophasis and kataphasis , equivalent to the inclusion and exclusion of abstract logic. Use of a logic in philosophy is unavoidable, and inadequate philosophical positions are the result of reliance on abstract logic where a concrete logic is both required and secretly relied upon. The philosophy of insufficiency works within the concrete logic. It has a critical function of assessing and uncovering the insufficiency of the claims made by other philosophical systems, and it has a reconstructive function of leading the human subject towards what could allow it to be rendered sufficient, a supernatural order. This supernatural order imposes a requirement for the human subject to make an option either for egoism of for charity. Modernism represents one modality of the option for egoism, and the option for charity can lead not only to the supernatural order but also to recognition of the continued importance of the Catholic tradition in supporting and keeping intelligible the option for charity. The entry of Ukraine into a new period of formation of all spheres of social, economic, political, and spiritual development, when the statehood is restored, the multifaceted revival of the Ukrainian people, the problem of national, spiritual and moral and ethical education of student youth is activated. Spiritually - the moral crisis of Ukrainian society needs urgent return to spiritual sources. Ukraine has historically been a Christian state, and a return to Christian norms of morality and ethics will help it (...) to re-emerge and take its place among European countries. The revival of Christian morality can change society and, above all, young people need it. Therefore, we see as one of the means of spiritual revival of the nation, the introduction of an optional elective course "Fundamentals of Christian Ethics" in Ukrainian secondary schools. The discipline discussed in the article as an example of using CLIL methodology is “The Fundamentals of Psychology and Pedagogy” and it is in the list of optional humanities subjects for the first-year students of Alfred Nobel (...) University in Dnipro, Ukraine. However, unlike the other optional humanities disciplines, the methodology underlying this course is based on teaching the subject in English, instead of Ukrainian, following the CLIL approach widely used in the European education but still little known in Ukraine. The purpose of the paper is to expose and analyze the original methodology developed that conditioned the specific structure of the relevant course, and the specific learning activities used in it. The essence of the developed CLIL theory-based methodology and its practical application are manifested through learning activities that include students’ mini-lectures/workshop-type presentations, brainstorming, case-studies, discussions, and a learning project with its results summarized in students’ essays, abstracts, and summaries written in English. The students collect the information required for completing their tasks not only from the teacher’s lectures and the recommended literature but also by way of doing extensive Internet-search on psychological and pedagogical sites in English. All this makes CLIL in the case under discussion experiential-interactive, blended, autonomous, and cooperative. As the result, students mostly self-construct their knowledge of the discipline by way of using the target language as the tool for such self-construction. Abstract:The distinction between brute luck and option luck is fundamental for luck egalitarianism. Many luck egalitarians write as if it could be used to specify which outcomes people should be held responsible for. In this paper, I argue that the distinction can’t be used this way. In fact, luck egalitarians tend to rely instead on rough intuitive judgements about individual responsibility. This makes their view vulnerable to what’s known as theneutrality objection. I show that attempts to avoid this (...) objection are unsuccessful. I conclude that until it provides a better account of attributing responsibility, luck egalitarianism remains incomplete. What grounds human rights? How do we determine that something is a genuine human right? This chapter offers a new answer: human beings have human rights to the fundamental conditions for pursuing a good life. The fundamental conditions for pursuing a good life are certain goods, capacities, and options that human beings qua human beings need whatever else they qua individuals might need in order to pursue a characteristically good human life. This chapter explains how this Fundamental (...) Conditions Approach is better than James Griffin’s Agency Approach as well as Martha Nussbaum’s Central Capabilities Approach. Bovine tuberculosis is an important and controversial animal health policy issue in England, which impacts humans, cattle and badgers. The government policy of badger culling has led to widespread opposition, in part due to the conclusions of a large field trial recommending against culling, and in part because badgers are a cherished wildlife species. Animal rights theorists argue that sentient nonhumans should be accorded fundamental rights against killing and suffering. In bovine TB policy, however, pro-culling actors claim that badgers (...) must be culled to avoid the slaughter of cattle. The first part of the paper compares AR theories of Regan, Francione, Cochrane, Garner and Donaldson and Kymlicka in the context of wildlife species. The second part of the paper applies these AR theories to bovine TB and badger control. AR theories are applied to badger control policy options of do nothing, badger culling, and badger vaccination. We conclude that AR theories are strongly opposed to badger culling. In general, culling is prohibited due to a badger’s right to life and its rights against suffering. The AR theories support a do-nothing, i.e. non-culling, non-vaccination approach to badger control. In the case of the AR theories of Regan and Francione, this is based on abolitionist positions with respect to farming. For Cochrane, Garner, and Donaldson and Kymlicka, the do-nothing policy option is preferred because badger vaccination causes a degree of suffering which generally is not for the individual’s benefit. Limited capability of the existing international environment funds in financing of sustainable low-carbon development is considered in this article. The reasons are given that those limitations are introduced to the funds’ statutory instruments, including newly established Green Climate Fund. It is proved in the article that optional participation of countries and companies in those funds, voluntary character of contributions, lack of income consistency doesn’t allow to fill the funds with sufficient resources necessary to finance anti-carbon measures. The scientific novelty of (...) this article consists in developing special global anti-carbon fund concept. This concept implies inclusion of all carbon emissions1 producers, binding character and regularity of contributions to the fund basing on the principle “if you pollute more, you pay more”, organization of systematic financing by fund of anti-carbon activities using principle “If you clean more and clean cheap, you receive more money”. The practical meaning of this article consists in substantiation of principles and priorities of the global anti-carbon fund. (shrink)

Just about everyone sees freedom, or liberty, as having huge importance. After all, our freedoms are a foundation that political authority is built on. But if you ask what freedom is, there can be very different answers about how it is defined. So, what is freedom? When can we said to be free or unfree? Is freedom about having options or achieving goals? How, if at all, can we justify limits on freedom? This chapter discusses these questions. We will begin (...) by considering the foundational issue of how we might understand ourselves as "free." This is followed by examining the relevance of having choice and options. The chapter then surveys three broad theories of freedom called negative freedom, positive freedom and republican freedom. We next consider the importance of convictions for any theory about freedom. Panpsychism is the doctrine that mind is a fundamental feature of the world existing throughout the universe. One problem with panpsychism is that it is a purely theoretical concept so far. For progress towards an operationalization of the idea, this paper suggests to make use of an ontological difference involved in the mind-matter distinction. The mode in which mental phenomena exist is called presence. The mode in which matter and radiation exist is called reality Physical theory disregards presence in (...) both the form of mental presence and the form of the temporal present In contrast to mental presence the temporal present is objective in the perspective of the third person. This relative kind of objectivity waits to be utilized for a hypothesis of how the mental and the physical are interrelated In order to do so this paper translates the mind-matter distinction into the distinction between mental and physical time and addresses the problem that panpsychism tries to attack head-on in these temporal terms. During the current financial crisis, the need for an alternative to a laissez-faire ethics of capitalism (the Milton Friedman view) becomes clear. I argue that we need an order ethics which employs economics as a key theoretical resource and which focuses on institutions for implementing moral norms. -/- I will point to some aspects of order ethics which highlight the importance of rules, e.g. global rules for the financial markets. In this regard, order ethics (“Ordnungsethik”) is the complement of the (...) German conception of “Ordnungspolitik” which also stresses the importance of a regulatory framework. This framework is needed not to tame the market, but to make it more profitable in the long run. -/- The conception of order ethics relies heavily on contractarianism, especially on James Buchanan’s work. Unlike many other conceptions of ethics, it does not start with an aim to achieve, but rather with an account of what the social world – in which ethical norms have to be implemented – is like. Our social world is different from the pre-modern one. Pre-modern societies played zero-sum games in which people could only gain significantly at the expense of others. And the types of ethics that we are still used to today have been developed within these pre-modern societies. -/- Modern societies, by contrast, can be characterised – by economists and other social theorists alike – as societies with continuous growth. This growth has only been made possible by the modern competitive market economy which enables everyone to pursue his own interests within a carefully devised institutional system. In this system, positive sum games are played, which makes it in principle possible to improve the position of every individual at the same time. Most kinds of ethics, however, resulting from the conditions of pre-modern societies, ignore the possibility of win-win-situations and instead require us to be moderate, to share, to sacrifice, as this would have been functional in zero-sum games. These conceptions distinguish – in more or less strict ways – between self-interest and altruistic motivation. Self-interest, more often than not, is ultimately seen as something evil. -/- Such an ethics cannot be functional in modern societies. Ethical concepts lag behind. Within zero-sum games, it was necessary to call for temperance, for moderate profits, or for a condemnation of lending money at interest. Within positive-sum games, however, the morally desired result of a social process cannot be brought about by changes in motivation, by switching from ‘egoistic’ to ‘altruistic’ motivation. The second theoretical element introduced by order ethics is the distinction between actions and rules, which was already mentioned. Traditional ethics concerns actions: It calls directly for changes in behaviour. This is a consequence of pre-modern conditions as reconstructed before: People in the pre-modern world were only able to control their actions, not so much however the conditions of their actions. In particular, rules like laws, constitutions, social structures, the market order, and also ethical norms have remained stable for centuries. In modern societies, this situation has changed entirely. The rules governing our actions have increasingly come under our control. -/- In this situation, ethics has to focus on rules. Morality must be incorporated in incentive-compatible rules. Direct calls for changes in behaviour without changes in the rules lead only to an erosion of compliance with moral norms. Individuals that continue to behave ‘morally’ will be singled out, because the incentives have not been changed. Moral norms which are to be justified cannot require people to abstain from pursuing their own advantage. People abstain from taking ‘immoral’ advantages only if adherence to ethical norms yields greater benefits over the planned sequence of actions than defection in the single case. Thus ‘abstaining’ is not abstaining in the long run, it is rather an investment in expectations of long-term benefits. By adhering to ethical norms, I become a reliable partner for interactions. The norms do indeed constrain my actions, but they simultaneously expand my options in interactions. And people consent to rules only if these rules hold greater advantages for them, at least in the long run. -/- In general, ethics cannot require people to abandon their individual calculation of advantages. However, it may suggest improving one’s calculation, by calculating in the long run rather than in the short run, and by taking into account the interests of our fellows, as we depend on their acceptance for reaching an optimal level of well-being, especially in a globalized world full of interdependence. -/- The problem of implementation can now be placed at the beginning of a conception of order ethics, justified with reference to the conditions of modern societies I have sketched. Under the conditions of pre-modern societies, an ethics of temperance had evolved that posed simultaneously the problems of implementation and justification. The implementation of well-justified norms or standards could then be regarded as unproblematic, because the social structures allowed for a direct face-to-face enforcement of norms. Pre-modern societies not only favored an ethics of temperance, they also had the instrument of face-to-face-sanctions within their smaller and non-anonymous communities. This instrument is no longer functional in modern anonymous societies, and so we have to face up to the problem of implementation right at the start of our ethical conception. Simultaneously, an order ethics relies on the implementation of sanctions for enforcing incentive-compatible rules. In modern societies, rules and institutions, to a large extent, must fulfil the tasks that were, in pre-modern times, fulfilled by moral norms, which in turn were sanctioned by face-to-face sanctions. Norm implementation in modern societies thus works by setting adequate incentives in order to prevent the erosion of moral norms, which would happen if ‘moral’ actors were systematically threatened with exploitation by other, less ‘moral’ actors. -/- This conception of order ethics is then elaborated further in the area of business ethics. -/- . This paper is an attempt to lay out a meta‐ethical position that is inspired by the framework of Wittgenstein's later philosophy. To achieve this goal, this paper is divided into two parts. First, I explore recent attempts to tie Wittgenstein's epistemology in On Certainty to moral epistemology. I argue that there can be a meaningful parallel drawn between the epistemic certainties discussed in On Certainty and what I consider to be moral certainties. These moral certainties are unjustified fundamental moral (...) attitudes that underlie our moral practices. Then, I show how the debate over moral certainty has branched into two directions. One direction presents the concept of moral certainty as a naturalistic concept. On this reading, moral certainties transcend time and place since they are rooted in our natural tendencies to act or not act in certain ways. The other direction presents moral certainty as a distinctly relativistic concept. On this reading, we have our moral certainties because we belong to communities that agree on these certainties. In the second section, I argue that we have both natural, universal certainties and localized, relative certainties. I also argue that our localized certainties are constrained by non‐moral facts about ourselves and about the world. To make this argument, I rely on Wittgenstein's concept of “general facts of nature.” The result of the paper is a meta‐ethical position that can be located in between moral relativism and moral realism. The paucity of research data to guide current paediatric practice has led to children being termed therapeutic orphans. This difficulty is especially pertinent to research in emergency situations, such as acute resuscitation or critical care, where accepted ethical standards for overall research, have historically created practical difficulties for researchers. The welcome establishment of organisations to support UK paediatric research is helping to ensure safer and more effective medications for children, however as the balance between protection and access at the heart (...) of the paediatric research ethical debate shifts to ever increasing access for researchers to children, it remains crucial to ensure the protection for these vulnerable participants. The fundamental protection for research subjects, namely their full informed consent before any recruitment, is not tenable in true emergency situations and so other approaches are warranted if standards are to be improved by human subjects research in such areas. Proxy, deferred and retrospective consent have all been advocated as solutions to this difficulty and this paper explores the ethical justification for these approaches and their utility in safeguarding children and families in emergency situations when traditional informed consent, as currently defined, cannot be obtained in the necessary time frame to enable research. In this paper, I examine a case for fundamental indeterminacy (FI) by Elizabeth Barnes and offer my counterarguments. Barnes' account of FI includes both the characterization of FI and why we need to accept it. I argue that her reasons for accepting FI can be challenged even when we accept her characterization of FI. Her main claim is that finding a fundamental proposition that our fundamental theory is indeterminate about (FPF) gives us a reason to accept FI (...) in metaphysics. I challenge her claim by pointing out more plausible options to address FPFs. An FPF may either indicate that the theory is nonfundamental or lead us to accept the antirealist view; there is no room for FI in either option. One may insist on accepting FI, but I argue that it is not theoretically rewarding enough. Hence, Barnes' case for FI can be contested. (shrink)

In the preface to the Yale edition of Samuel Johnson’s poems, the editors remark that “for a modern reader who can recreate the situation in which [“London”] was written, it may still be exciting enough. But to one with less imaginative capacity or historical knowledge, its appeal lies in Johnson’s skillful handling of the couplet.”2 To assist us in re-creating the milieu of 1738, the editors supply the usual notes identifying various historical personages and events which are no longer in (...) the domain of common knowledge. In this respect they follow Johnson’s lead. “London” is manifestly an occasional poem; and its occasion—in part, Walpole’s timidity abroad and corruption at home—like all occasions, passed.3 Indeed it passed so quickly that Johnson himself felt called upon in the fifth edition to annotate, for instance, his mention of “the Gazetteer”: “the paper which at that time contained apologies for the Court.” By 1750 Walpole was long out of court, the Gazetteer extinct, and “London” as outdated as yesterday’s newspaper.For poems like “London” whose contents are neither au courant nor immortal but rather historical or simply dead, the Yale editors suggest two avenues of resuscitation: the reader may either restore the background by means of historical imagination or, failing that, admire Johnson’s couplet art, which perhaps has a better chance at perennial appeal. Either content or form, either history or art—both options require a sacrifice on our part, and that sacrifice is our occasion, our need. Even assuming that the poem’s context could be exhumed and that we could participate once again in all the rage of the “patriot” opposition to Walpole, Why would we want to? The problem is that not only “London” but the Walpole regime itself is now defunct. Yet the same question must be asked of the poem’s art, even and especially if it is eternal. Why are we interested in the aesthetic knowledge of couplets that have been drained of all substance? Is understanding “London” in either case an end in itself? The pure content of the poem is too concrete, its pure form too abstract, to answer our occasions. Thus to understand the poem as either history or art demands a leisure that has no exigencies and is therefore free for the bygone and ethereal.42. E.L. Gustavo Gutiérrez develops an account of human action or praxis that I--borrowing the language of Charles Taylor--label expressivist. Human action must be understood as expressing an underlying potential or impulse that only becomes real through expression in action. Gutiérrez's expressivism is fundamental to his view of the relationship between faith and love, his notion of three dimensions of liberation/salvation, and his understanding of the fundamental option as a yes or no in response to grace. Moreover, it supports (...) a valuable approach to community as defined more by shared actions than a shared tradition or narrative. The final section briefly indicates two limitations to Gutiérrez's vision--especially with regard to the conception of community--and suggests the direction that a constructive appropriation of his thought might take. Panpsychism, the view that consciousness is present everywhere at the fundamental level of reality, has established itself as an increasingly popular option in the philosophy of mind. Situated between substance dualism and reductive physicalism, panpsychism aims to capture the intuitions behind both, integrating consciousness into the physical world without explaining it in terms of purely physical facts. In this thesis, I offer a defence of panpsychism. -/- First, I examine influential arguments against physicalism, such as Thomas Nagel’s (1974, (...) 1979) perspective-based proposal, Frank Jackson’s (1982) knowledge argument, David Chalmers’ (1996, 2010) conceivability argument, as well as vagueness arguments (Antony 2006a; Tye 1996). I argue that none of them offers a knockdown case against physicalism, particularly because of the threat presented by the phenomenal concept strategy (Chalmers 2007; Papineau 2007a), though they suggest panpsychism as a promising alternative that avoids many common objections. -/- Second, I discuss independent arguments for panpsychism, including the Russellian monist view (Goff 2017; Russell 1927/1992), the intrinsic nature argument (Seager 2006; Strawson 2006), recent developments in the literature as presented by Hedda Hassel Mørch (2018, 2020) and Luca Dondoni (2022), Tye’s (2021b) representational panpsychism based on the vagueness argument, as well as cosmopsychism (Nagasawa & Wager 2016; Shani 2015) – an alternative to panpsychism that shares its aims whilst claiming to avoid its shortcomings. -/- Third, I address the most pressing objection to panpsychism: the combination problem or the question of how fundamental consciousness can combine to lead to complex consciousness (James 1890). Focusing especially on the subject-summing version of the combination problem or the issue of how small subjects can combine to form complex subjects, I go over various proposals for either solving or avoiding it, such as Philip Goff’s (2016) phenomenal bonding relation and William Seager’s (2010) combinatorial infusion proposal, arguing against both and agreeing at the end with Sam Coleman (2014), who advocates that subject-summing is demonstrably incoherent. -/- However, as I argue in the fourth and final chapter, the panpsychist still has an option that avoids the subject-summing problem, while also circumventing the objections faced by the alternative view of cosmopsychism. Inspired though not reliant on the philosophy of Gottfried Wilhelm Leibniz (1902/2005), I introduce what I call monadic panpsychism, the view that the phenomenal character of any given consciousness-bearing physical ultimate is determined by its relations to other such ultimates featuring in the relevant causal structure. -/- The theory consists of two key claims. The first is that phenomenal qualities are relational rather than intrinsic. This view has precedent in literature on the philosophy of mind, such as in Rudolf Carnap (1928), Gottlob Frege (1956), Moritz Schlick (1959), as well as more recently in David Hilbert and Mark Kalderon (2000) and Austen Clark (2000), though not in the context of panpsychism. -/- The second claim is that physical ultimates only possess a very basic form of consciousness necessary for experiencing as such. There are many ways to conceptualise this basic consciousness: non-relational or intrinsic, rudimentary and non-specific, a point of view without experiences, the minimal subject, a mere conduit for experience, phenomenal space, etc. Russellian panpsychists offer a more detailed proposal in which every physical ultimate has an appropriate associated type of experience. For example, all quarks have the same quark-type of experience, assuming for the sake of discussion that quarks are ultimates. Still, arguing for a more minimal notion, as I do, requires making less claims and should not be controversial to any panpsychist. -/- So, what follows from these two claims? I propose that the relational constitution of phenomenal qualities has its endpoint at the fundamental level rather than at the level of a combined complex or emergent subject. Put simply, physical ultimates guarantee the basic consciousness or the point of view that I occupy, while the relational structure constitutes my rich and full human experience. So to speak, relationally constituted phenomenal qualities ‘anchor’ themselves in physical ultimates. As long as these relations result in a phenomenally unified experience, which is an uncontroversial thesis, then no matter where that process reaches the end of its causal chain, it will necessarily be experienced from a subjective point of view. -/- Since only qualities but not subjects need to combine, my proposal avoids the subject-summing version of the combination problem, which is arguably an insurmountable challenge to other forms of panpsychism. Because of this, I conclude that my theory contributes to the field, serving as a good starting point for further developments of neither combinatory nor emergent panpsychism with regard to subjects. En revanche, ce concept manifeste une puissance latente que le travail de Gian-Carlo Rota permet d’exalter. Entre les mains du mathématicienphilosophe, la Fundierung devient l’un des piliers fondamentaux d’une logique phénoménologique encore in fieri. Une logique qui voudrait prendre ses distances tant avec la « logique philosophique » traditionnelle qu’avec la « (...) logique mathématique » qui s’est désormais imposée en tant que standard de la rigueur et fascine souvent les philosophes. Cet article se propose de décrire comment l’interprétation de Rota enrichit le concept originel de Husserl et de quelle manière sa démarche ouvre la possibilité d’une évolution.The concept of Fundierung introduced by Husserl in his III Logic Research, notwithstanding its seemingly logical functionality, very rarely appears in his subsequent works. Yet this concept shows a latent power that Gian-Carlo Rota’s work succeeds in exalting. In the hands of the mathematician-philosopher, Fundierung becomes one of the fundamental pillars of a phenomenological logic still in embryo, a logic the aim of which is to distance itself from both the traditional ‘philosophical logic’ and the ‘mathematical logic’, the latter having by now become a standard of rigour by which the philosophers are often bewitched. This paper aims to describe how Rota’s interpretation has enhanced Husserl’s original concept and how this can foster a likely great evolution in the future. Il concetto di Fundierung appare nella IIIe Ricerca Logica di Husserl e, malgrado l’apparente funzionalità logica, appare molto raramente nel seguito della sua opera. Tuttavia tale concetto manifesta una potenza latente che il lavoro di Gian-Carlo Rota riesce ad esaltare. Nelle mani del matematico-filosofo, laFundierung diventa uno dei pilastri fondamentali di una logica fenomenologica ancora in fieri. Una logica che vorrebbe distanziarsi tanto dalla “logica filosofica” tradizionale quanto dalla “logica matematica” che ormai si è imposta come standard di rigore e di cui i filosofi subiscono spesso la fascinazione. Only a negative fundamental option, that is, the engagement of man's core awareness and freedom, can bring about the reality known as mortal sin.

In this essay, I build on the article by Soulé that established the foundation for the field of conservation biology. I analyze the presuppositions that have guided the discipline’s ethics in the 30 years since that article first appeared. I argue that conservation biology’s normative postulates introduced a paradigm shift that placed the diversity of the biota instead of the biota itself at the center of its ethics. I show that the ensuing priorities in the valuation of nature entail several (...) contradictions at the ethical level and are justifiable only through scientific postulates. Identifying potential revisions and latent ideological issues in science, I defend the position that such scientific legitimization of conservation measures becomes disputable when this option undermines the ethical status of non-human life. Furthermore, I explain the absence of social feedback regarding conservation measures from the perspective of this shift. I conclude with an invitation to critically rethink the ethical basis of conservation sciences so that these fields may achieve their intention of playing a key role in halting the destruction of nature and in encouraging society’s support. From the standpoint of the moral theologian, perhaps the most influential aspect of Karl Rahner’s theology is the thesis of the fundamental option, that is, the claim that the individual’s status before God is determined by a basic, freely chosen and prethematic orientation of openness towards, or rejection of God which takes place at the level of core or transcendental freedom. This paper argues that this notion of the fundamental option is problematic because it is not (...) concrete enough to provide an adequate interpretation of our actual experience. Yet this problem cannot be addressed through reviving the traditional account of mortal and venial sins, which are equally problematic, albeit in a somewhat different way. The second half of the paper explores the alternative offered by Aquinas’s account of charity, which, it is argued, does provide us with an account of grace sufficiently rich and concrete to illuminate human experience. However, this alternative is likewise problematic, most notably in its commitment to the view that charity is lost through one mortal sin. Yet Aquinas’s account of charity provides resources for an internal critique and revision on this point, as can be seen through a consideration of cases of “sinful saints.”. (shrink)

ABSTRACT:Like most egalitarian political philosophers, John Rawls believes that a just society will rely on markets and business firms for much of its economic activity—despite acknowledging that market systems will tend to create very unequal distributions of goods, opportunities, power, and status. Rawls himself remains one of the few contemporary political philosophers to explore at any length the way an egalitarian theory of justice might deal with fundamental options in political economy. This article examines his arguments and conclusions on (...) these topics. It argues that contemporary Rawlsians will reach different conclusions if they take more seriously than Rawls himself did: (1) the implications, for the political culture and the democratic regulatory state, of large firms competing in adversarial markets characterized by the inevitable “fact of market failure,” and (2) the relevance of ownership and governance relationships involving different kinds of business firms. And with respect to the second point, Rawlsians and other egalitarians have much to learn from contemporary economic, legal, and sociological theories of the firm, and the role of these theories in the structure of and rationale for corporate law. This is the kind of social theory that Rawls believes is relevant to the justification and application of theories of justice, but he himself did not appeal to it in his writings on political economy. Contemporary egalitarians can and should appeal to it now, and in doing so correct errors and omissions in Rawls’s analysis. But taking seriously the two points mentioned above will also force egalitarians who support efficient markets to face difficult dilemmas or compromises of their own. (shrink)

What does religion contribute to business ethics? Related to the practical, religion applies theological concepts to business situations; namely, vocation, stewardship, human dignity, co-creation, co-conservation, sharing in God's power, servant leadership, encounter with the Incarnation, sacramental sign and justice (divine and human). These concepts suggest the threefold component of religion: doctrine (creed), worship (cult) and values governing behavior (code). A principle taken from religious practice illustrates its unique contribution to business ethics. The principle of proportionality (or double effect) exemplifies code (...) in its balancing of good and evil outcomes. The more contemporary principle called the fundamental option identifies the role of vocation and calling in the notion of creed. The component cult might be reflected in the insistence on human dignity which is highlighted in papal social teaching. (shrink)

This article examines and seeks to define Karl Rahner’s distinctive view of human dignity. Despite the relative infrequency of the words “dignity” or “image of God” in Rahner’s work, the inherent and realized worth of the individual holds a central place in his overall moral theology, especially as it appears in Foundations of Christian Faith. In particular, the article seeks to demonstrate that Rahner’s view of the vulnerability of human dignity serves as a synthetic moral principle unifying his conceptions of (...) freedom, the supernatural existential, the categorical, and the fundamental option. This article concludes by suggesting how Rahner’s conception of dignity may be helpful for the development of a comprehensive definition of dignity within the Catholic Social Thought Tradition. Without denying the importance of a range of independent epistemic and metaphysical considerations, I argue that there is an irreducibly theological dimension to the emergence of Kant's transcendental idealism. Creative tasks carried out by the divine mind in the pre‐critical works become assigned to the human noumenal mind, which is conceived of as the source of space, time and causation. Kant makes this shift in order to protect the possibility of transcendental freedom. I show that Kant has significant theological difficulties (...) ascribing such transcendental freedom to creatures in relation to God, and that he intends transcendental idealism to be a solution to these difficulties. I explain how this provides Kant with a powerful motivation and reason for denying the so‐called “neglected alternative”, and conclude by suggesting that the nature of any theological response to Kant will depend upon some fundamental options about how to conceive of the relationship between the creator and creation. John Paul II’s encyclical Veritatis Splendor lists several objections to the theological concept of fundamental option. This article summarizes that concept, primarily as presented by Josef Fuchs. It then locates the concept, as Fuchs did, in the overarching theological anthropology of Karl Rahner, which is discussed at length. The objections of the encyclical are then engaged. In some cases, it is shown, the encyclical misunderstands fundamental option. In other cases, its rejection of the idea seems to (...) entail rejection also of traditional Catholic doctrines. All this leads to concluding reflections in which fundamental option is evaluated in terms of its cogency, adequacy, usefulness, and necessity for a contemporary Christian anthropology. (shrink)

Until 1977, Monsignor Romero was a traditional Catholic bishop trained in traditional Roman theology with a penchant for order and non-involvement in ‘politics’. He was also a product of the 1968 Medellin Conference which fashioned a pastoral model for the Latin American church: ‘A fundamental option for the poor’ on the thrust of the Second Vatican Council (1962–1965). This article seeks to present Oscar Romero within a historical context and proposes him as a servant–leader model for African church (...) leaders, especially Catholic bishops. (shrink)

Only rarely does Descartes deal with specifically political questions, and then when he does so, it is only by denial, to justify his refusal to “become involved” in politics. All the texts show that this attitude of rejecting politics is not dictated primarily by prudence, the rule in this century of intolerance, but by a concern for philosophical consistency. This denial, as we will be attempting to establish, seems conditioned by fundamental options of Cartesian philosophy. For the moment we (...) will only examine the theoretical effects of this refusal to write about politics other than by denial; such effects seem to us to consist in the exclusion of politics outside the realm of knowledge and its problematic inclusion into that of morality. And although it has been possible to speak of a “political Descartes”, it is completely against his stated intentions. This Descartes would be political in spite of himself. In fact, such an approach can only consist in a political interpretation of this denial, in a political reading of the texts that reject, or more often pass over in silence, politics as such. Although a reading of this kind can be at best a hazardous one, we will not attempt to challenge its legitimacy, for it is certainly possible to affirm that the work of Descartes is ridden and wrought by the question of politics (just as all philosophical thought, in one way or another, must of necessity confront political reality), but it is not without importance to begin by noting that it is never touched upon other than indirectly, obliquely, through the use of theoretical devices whose finality is not political.
