Com formidável velocidade, as máquinas de guerra, diferentes dos aparelhos de Estado, transformam a vítima em instrumento de guerra (acionável, intercambiável e matável), até à sua exaustão final. Assim, categorias inteiras de “populações negadas”, inertes e precárias, são transformadas em ferramentas (úteis e vivas) de violência armada, colocadas, hoje, ao serviço daqueles que reivindicam o direito de matar, e da mesma forma, em “realidades”. “perdidos” que não deixam vestígios de sua passagem pelo mundo. Aqui está a forma inédita e concreta (...) de poder e a divisão das máquinas de guerra (gangues, milícias, grupos rebeldes e estruturas paramilitares), que, além de fazerem morrer e deixarem viver, produzem e reproduzem centenas de “vidas fungíveis”, quais Eles são usados, substituídos e eliminados de acordo com os interesses da violência. Daí a sua natureza “descartável”. Esta composição hermenêutica crítica, que utiliza fundamentalmente o pensamento de Butler, Deleuze, Guattari, Mbembe, Arendt, Agamben e Roxin, além de alguns depoimentos de ex-combatentes colombianos, que pintaram e narraram a guerra, trata de definir e caracterizar a noção “vida fungível” (inexistente na literatura, mas empiricamente verificável). Mental accounting is a concept associated with the work of Richard Thaler. According to Thaler, people think of value in relative rather than absolute terms. They derive pleasure not just from an object’s value, but also the quality of the deal – its transaction utility (Thaler, 1985). In addition, humans often fail to fully consider opportunity costs (tradeoffs) and are susceptible to the sunk cost fallacy. Why are people willing to spend more when they pay with a credit card (...) than cash (Prelec & Simester, 2001)? Why would more individuals spend $10 on a theater ticket if they had just lost a $10 bill than if they had to replace a lost ticket worth $10 (Kahneman & Tversky, 1984)? Why are people more likely to spend a small inheritance and invest a large one (Thaler, 1985)? According to the theory of mental accounting, people treat money differently, depending on factors such as the money’s origin and intended use, rather than thinking of it in terms of the “bottom line” as in formal accounting (Thaler, 1999). An important term underlying the theory is fungibility, the fact that all money is interchangable and has no labels. In mental accounting, people treat assets as less fungible than they really are. Even seasoned investors are susceptible to this bias when they view recent gains as disposable “house money” (Thaler & Johnson, 1990) that can be used in high-risk investments. In doing so, they make decisions on each mental account separately, losing out the big picture of the portfolio. (See also partitioning and pain of paying for ideas related to mental accounting.) . Background: The management of challenging behaviours in inpatient with intellectual disability and/or autism spectrum disorders can lead to an escalation of control measures. In these complex situations where patients have an intellectual disability/autism spectrum disorder accompanied by a psychiatric comorbidity, the experiences of caregivers related to the crisis management have rarely been studied. Purpose: This study examined the moral experiences of caregivers related to challenging behaviours’ management and alternatives to control measures. Research design: Using Charles Taylor’s hermeneutic framework, a 2-month (...) focused ethnography with a participatory approach was used. Participants and research context: Sixteen caregivers were interviewed in a Canadian mental health setting for adults with intellectual disability/autism spectrum disorder and psychiatric comorbidity. Ethical considerations: The research was conducted in compliance with the Declaration of Helsinki and local Research Ethics Board approval. Written informed consent was collected systematically from participants. Findings: By accounting for caregivers’ moral experiences, this study sheds light on a neglected dimension of the care relationship: the vulnerability of the caregiver. We highlight the main barriers and facilitators to alternatives to control measures. First, a caregiver’s vulnerability was characterised by the overall impact of challenging behaviours and the moral distress associated with the use of control measures and exclusion mechanisms of intellectual disability/autism spectrum disorder patients. Second, a strong ambiguity between care and control measures and a lack of inclusive approaches were identified as the two main barriers to challenging behaviour management. Third, the involvement, both professional and personal, of caregivers was deemed necessary to implement alternatives to control measures. Discussion: A conflict of values opposes two conceptions of autonomy: a rational autonomy, which is counterproductive to the reduction of control measures, versus a relational autonomy based on shared vulnerability. Conclusion: The recognition of caregiver’s vulnerability is a benchmark to create alternative approaches, which defuse the logic of control and promote an ethics of care within which caregivers’ self-concern can be understood as fostering mutual respect. Bartha and DesRoches (Synthese 199(3–4):8701–8740, 2021) and Steel and Bartha (Risk Analysis 43(2):260–268, 2023) argue that we should understand the precautionary principle as the injunction to maximise lexical utilities. They show that the lexical utility model has important pragmatic advantages. Moreover, the model has the theoretical advantage of satisfying all axioms of expected utility theory except continuity. In this paper I raise a trilemma for any attempt at modelling the precautionary principle with lexical utilities: it permits choice cycles (...) or leads to paralysis or implies that the smallest value difference that is possible in a context has extreme axiological implications. The lesson to be learned from the paradoxical St. Petersburg game and Pascal’s Mugging is that there are situations where expected utility maximizers will needlessly end up poor and on death’s door, and hence we should not be expected utility maximizers. Instead, when it comes to decision-making, for possibilities that have very small probabilities of occurring, we should discount those probabilities down to zero, regardless of the utilities associated with those possibilities.

Pain is often used as the paradigmatic example of a phenomenal kind with a phenomenal quality common and unique to its instantiations. Philosophers have intensely discussed the relation between the subjective feeling, which unites pains and distinguishes them from other experiences, and the phenomenal properties of sensory, affective, and evaluative character along which pains typically vary. At the center of this discussion is the question whether the phenomenal properties prove necessary and/or sufficient for pain. In the empirical literature, sensory, affective, (...) and evaluative properties have played a decisive role in the investigation of psychophysical correspondence and clinical diagnostics. This paper addresses the outlined philosophical and empirical issues from a new perspective by constructing a multidimensional phenomenal space for pain. First, the paper will construe the phenomenal properties of pains in terms of a property space whose structure reflects phenomenal similarities and dissimilarities by means of spatial distance. Second, philosophical debates on necessary and sufficient properties are reconsidered in terms of whether there is a phenomenal space formed of dimensions along which all and only pains vary. It is concluded that there is no space of this kind and, thus, that pain constitutes a primitive phenomenal kind that cannot be analyzed entirely in terms of its varying phenomenal properties. Third, the paper addresses the utility of continued reference to pain and its phenomenal properties in philosophical and scientific discourses. It is argued that numerous insights into the phenomenal structure of pain can be gained that have thus far received insufficient attention. (shrink)

Poor working conditions remain a serious problem in supplier facilities in developing countries. While previous research has explored this from the developed buyers’ side, we examine this phenomenon from the perspective of developing countries’ suppliers and subcontractors. Utilizing qualitative data from a major knitwear exporting cluster in India and a stakeholder management lens, we develop a framework that shows how the assumptions of conventional, buyer-driven voluntary governance break down in the dilution of buyer power and in the web of factors (...) rooted in suppliers’ traditions, beliefs, local demands and resource dependency. We reveal out how success in governing collaborative global supply chains often falls short within the subcontracting stage, where a stakeholder management mindset is elusive to most participants. We suggest that success in governing collaborative global supply chains is dependent on concepts of stakeholder utility and the presence of shared value that is often at odds with the realities of power, information asymmetry and compliance/reward systems inherent in the non-market coordination of global supply chains. Our findings offer important insights for delineating the concepts of value creation from CSR concepts and practices, and for modifying the basic assumptions of conventional supply chain governance. In a recent paper, Björn Lundgren and H. Orri Stefánsson (forthcoming) present three objections to normic de minimis expected utility theory (NDEUT) – a decision theoretic framework defended in Smith (2024). In this paper, I respond to these objections and outline some possible ways in which NDEUT might be modified or further developed. Like any de minimis framework, NDEUT employs a risk threshold to sort possibilities into those that must be considered when making a decision, and those that can (...) be legitimately ignored – the so-called ‘de minimis risks’. While this threshold would usually take the form of a probability value, in NDEUT the de minimis risks are identified instead on the basis of their abnormality. In the first section I will set up some of the formalism used in NDEUT and consider Lundgren and Stefánsson’s first objection – which is essentially formal in nature. In the second section I will delve further into the interpretation of NDEUT and consider the second and third objections, which turn on particular examples. (shrink)

Through a radical new reading of the Theological Political Treatise, Dimitris Vardoulakis argues that the major source of Spinoza’s materialism is the Epicurean tradition that re-emerges in modernity when manuscripts by Epicurus and Lucretius are rediscovered. This reconsideration of Spinoza’s political project, set within a historical context, lays the ground for an alternative genealogy of materialism. Central to this new reading of Spinoza are the theory of practical judgment (understood as the calculation of utility) and its implications for a (...) theory of democracy that is resolutely positioned against authority. This paper investigates the question of how subjective probability should relate to binary belief. We propose new distance minimization methods, and develop epistemic decision-theoretic accounts. Both approaches can be shown to get “close” to the truth: the first one by getting “close” to a given probability, and the second by getting expectedly “close” to the truth. More specifically, we study distance minimization with a refined notion of Bregman divergence and expected utility maximization with strict proper scores. Some propositions are more epistemically important than others. Further, how important a proposition is is often a contingent matter—some propositions count more in some worlds than in others. Epistemic Utility Theory cannot accommodate this fact, at least not in any standard way. For EUT to be successful, legitimate measures of epistemic utility must be proper, i.e., every probability function must assign itself maximum expected utility. Once we vary the importance of propositions across worlds, however, normal measures of (...) epistemic utility become improper. I argue there isn’t any good way out for EUT. (shrink)

Insofar as artificial intelligence is to be used to guide automated systems in their interactions with humans, the dominant view is probably that it would be appropriate to programme them to maximize (expected) utility. According to utilitarianism, which is a characteristically western conception of moral reason, machines should be programmed to do whatever they could in a given circumstance to produce in the long run the highest net balance of what is good for human beings minus what is bad (...) for them. In this essay, I appeal to values that are characteristically African––but that will resonate with those from a variety of moral-philosophical traditions, particularly in the Global South––to cast doubt on a utilitarian approach. Drawing on norms salient in sub-Saharan ethics, I provide four reasons for thinking it would be immoral for automated systems governed by artificial intelligence to maximize utility. In catchphrases, I argue that utilitarianism cannot make adequate sense of the ways that human dignity, group rights, family first, and (surprisingly) self-sacrifice should determine the behaviour of smart machines. The goal of this article is to show that instrumental rationality and utility that have been used in economics for many years does not work well. What is presented in the article is how significant the influence of utilitarianism has been on economics and why the economists get rid of humans’ goals and motivations. It is shown in the article that the human who decides in present is absolutely different from the human who decides over time. Many economists neglected (...) this problem because they wanted to have an effective and simple model. Becker’s economic method is presented as a dead end to which economics has been brought to. It is impossible to connect different selves of one human being by using the utility measure. The works of Schelling and J.S. Mill are used to explain this impossibility. The conclusion of this article is that instrumental rationality and utility have affected economics significantly. But, this simplified view on human nature is no longer valid. Hence, economics needs to think not only about the means but also about the human goals. Economics needs to rebuff relativism and show people how to achieve well-being. If we want to help people with their self-governance, we will have to choose reason over emotions. (shrink)

Mill's most famous departure from Bentham is his distinction between higher and lower pleasures. This article argues that quality and quantity are independent and irreducible properties of pleasures that may be traded off against each other higher pleasures’ lexically dominate lower ones, and that the distinction is compatible with hedonism. I show how this interpretation not only makes sense of Mill but allows him to respond to famous problems, such as Crisp's Haydn and the oyster and Nozick's experience machine.

Recently, Martin Smith defended a view he called the “normic de minimis expected utility theory”. The basic idea is to integrate a ‘normic’ version of the de minimis principle into an expected utility-based decision theoretical framework. According to the de minimis principle some risks are so small (falling below a threshold) that they can be ignored. While this threshold standardly is defined in terms of some probability, the normic conception of de minimis defines this threshold in terms of (...) abnormality. In this article, we present three independent arguments against the normic de minimis expected utility theory, focusing on its reliance on the de minimis principle. (shrink)

In some applications to human beings, the precautionary principle seems to raise specific ethical concerns. For instance, it has been used by a business owner in a court of justice to justify his refusal to hire applicants with a certain geographical origin for safety reasons. Or in public management, the precautionary principle has been used to exclude men who have sexual relations with men from donating blood on the basis of a higher HIV prevalence in this group. Does not the (...) precautionary principle here amount to justifying a form of discrimination? To help analyze what is at stake from a decision-theoretic viewpoint and to consider the possibility of ethical catastrophes, we offer a lexical utility model of the precautionary principle, which generalizes a previous model by Bartha and DesRoches (Synthese 199:8701–8740, 2021), Steel and Bartha (Risk Anal https://doi.org/10.1111/risa.13892, 2022). Traditional expected utility theory also comes out as a special case of the model. Our proposal opens new perspectives for considering ethical dilemmas within a precautionary approach. It is intended to serve as a guiding tool for management teams in socially responsible companies, public institutions, and government agencies. (shrink)

How should rational believers pursue the aim of truth? Epistemic utility theorists have argued that by combining the tools of decision theory with an epistemic form of value—gradational accuracy, proximity to the truth—we can justify various epistemological norms. I argue that deriving these results requires using decision rules that are different in important respects from those used in standard (practical) decision theory. If we use the more familiar decision rules, we can’t justify the epistemic coherence norms that epistemic (...) class='Hi'>utility theory had hoped to justify. In short, those of us who are attracted to the project of epistemic utility theory face a dilemma. If we choose “consequentialist” rules, then we can vindicate the idea that rational belief has the aim of accuracy—but at the cost of giving up attractive epistemic norms. (shrink)

The stressful nature of caring for an older adult with a chronic disease, such as Alzheimer’s disease, can create barriers between the caregiver-care recipient, as they try to navigate their continuously changing social relationship. Interpersonal synchrony, is an innovative approach that could help to sustain caregiving relationship dynamics by promoting feelings of connection and empathy through shared behavior and experiences. This review investigates the current literature on interpersonal synchrony from an interdisciplinary perspective by examining interpersonal synchrony through psychological, neural, and (...) hormonal measures across the adult lifespan. We then present a case for examining the degree to which interpersonal synchrony can be used to facilitate affiliation and well-being in the caregiver-care recipient relationship. We find that there is significant evidence in healthy adult populations that interpersonal synchrony can support affiliative feelings, prosocial behavior, and well-being. Characterizing the psychological, neural, and hormonal mechanisms of interpersonal synchrony is a first step towards laying the groundwork for the development of tools to support relational closeness and empathy in the caregiving context. Finally, we explore the strengths and limitations of using interpersonal synchrony to support relational well-being, and discuss possible avenues for future research. (shrink)

In Decision Space: Multidimensional Utility Analysis, first published in 2001, Paul Weirich increases the power and versatility of utility analysis and in the process advances decision theory. Combining traditional and novel methods of option evaluation into one systematic method of analysis, multidimensional utility analysis is a valuable tool. It provides formulations of important decision principles, such as the principle to maximize expected utility; enriches decision theory in solving recalcitrant decision problems; and provides in particular for the (...) cases in which an expert must make a decision for a group of people. The multiple dimensions of this analysis create a decision space broad enough to accommodate all factors affecting an option's utility. This article extends the Humean example of evolutionary stakeholder theory introduced in Kline and McDermott (2019). In that article, it was established that the Cost of Service Regulation (COSR) rules created by regulatory commissions, courts, and legislation was an example of evolutionary stakeholder theory. Ultimately, the Supreme Court decision in the Hope Natural Gas case established that it was not the method, but the result reach that was important. If the result reach balanced the interests of stakeholders then the outcome (...) was just and reasonable. Kline and McDermott (2019) also established that the COSR process was rather robust in terms of stakeholder participation. The purpose of this article is to extend the analysis to examine one of the most turbulent periods in COSR's history: the Post‐OPEC oil crisis of the 1970s–1980s. The effects of this period called into question the efficacy of the COSR process and led, as evolutionary stakeholder theory predicts, to a series of engagements by stakeholders to modify the rules of the process to achieve a better balance in the publics' interest. While adjudicatory in nature, the COSR process enabled cooperative solutions to redress the imbalances created by the OPEC oil shocks, improvements in information gathering, processing and decision‐making were all products of the evolutionary stakeholder process that regulators engaged in with stakeholders. In earlier work, I have expressed scepticism about privacy-based criticisms of bulk collection for counter-terrorism ( Sorell 2018 ). But even if these criticisms are accepted, is bulk collection nonetheless legitimate on balance – because of its operational utility for the security services, and the overriding importance of the purposes that the security services serve? David Anderson’s report of the Bulk Powers review in the United Kingdom suggests as much, provided bulk collection complies with strong legal safeguards ( Anderson (...) 2016 ). I think it is hard to mount a uniformly compelling operational utility argument, because purposes other than counter-terrorism are pursued by the security services with the help of bulk collection. For example, the Intelligence Services Act 1994, section 1(2) says that apart from the interests of national security and the prevention and detection of serious crime, the Secret Intelligence Service may act “in the interests of the economic well-being of the United Kingdom.”The phrase “interests of the economic well-being of the United Kingdom” is opento a disturbingly wide range of interpretations, and it is doubtful that these interests justify bulk collection even when relevant “economic interests” are confined to those “also relevant to the interests of national security”, as required by the Investigatory Powers Act (2016) section 204 (3a). A mixture preorder is a preorder on a mixture space (such as a convex set) that is compatible with the mixing operation. In decision theoretic terms, it satisfies the central expected utility axiom of strong independence. We consider when a mixture preorder has a multi-representation that consists of real-valued, mixture-preserving functions. If it does, it must satisfy the mixture continuity axiom of Herstein and Milnor (1953). Mixture continuity is sufficient for a mixture-preserving multi-representation when the dimension of the mixture (...) space is countable, but not when it is uncountable. Our strongest positive result is that mixture continuity is sufficient in conjunction with a novel axiom we call countable domination, which constrains the order complexity of the mixture preorder in terms of its Archimedean structure. We also consider what happens when the mixture space is given its natural weak topology. Continuity (having closed upper and lower sets) and closedness (having a closed graph) are stronger than mixture continuity. We show that continuity is necessary but not sufficient for a mixture preorder to have a mixture-preserving multi-representation. Closedness is also necessary; we leave it as an open question whether it is sufficient. We end with results concerning the existence of mixture-preserving multi-representations that consist entirely of strictly increasing functions, and a uniqueness result. (shrink)

In this paper, I investigate the betting behavior of a decision-maker who can influence the likelihood of the events upon which she is betting. In decision theory, this is best known as a situation of moral hazard. Focusing on a particularly simple case, I sketch the first systematic analysis of moral hazard in the canonical Savage framework. From the results of this analysis, I draw two philosophical conclusions. First, from an observational and a descriptive point of view, there need to (...) be no incompatibility between moral hazard and the Savage framework. This qualifies the incompatibility view, that is ubiquitous in decision theory. Second, in general, moral hazard is not sufficient to overcome the challenges posed by state-dependent utility to the behavioral identification of beliefs. This qualifies the sufficiency view, that is influential in decision theory. These two philosophical conclusions are the main contributions of my paper. (shrink)

It can be intuitively understood that sets and their elements in mathematics reflect the atomistic way of thinking in physics: Sets correspond to physical properties, and their elements correspond to particles that have these properties. At the same time, quantum statistics and quantum field theory strongly support the view that quantum particles are not individuals. Some of the problems faced in modern physics may be caused by such discrepancy between set theory and physical theory. The question then arises: Is it (...) possible to reconstruct the concept of set as a collection of objects that model quantum particles rather than as a mere collection of individuals? David Deutsch has argued that identical entities can be diverse in their attributes, and that this nature, what he calls fungibility, must lie at the heart of quantum physics. In line with this idea, a set theory with fungible elements is established, and the collection of such sets is shown to be endowed with an ortholattice structure, which is better known as quantum logic. In my dissertation, I analyze, interpret, and defend John Stuart Mill's proof of the principle of utility in the fourth chapter of his Utilitarianism. My purpose is not to glorify utilitarianism, in a full sweep, as the best normative ethical theory, or even to vindicate, on a more specific level, Mill's universalistic ethical hedonism as the best form of utilitarianism. I am concerned only with Mill's utilitarianism, and primarily with his proof of the principle of utility. My overarching (...) purpose guiding the entire work is to show that Mill proceeds intelligibly and systematically in pursuing a well-defined project in the fourth chapter of Utilitarianism, and that he successfully defends what he sets out to establish in his proof of the principle of utility. To this end, I devote the bulk of my efforts to studying and responding to traditionally popular and persistently enduring objections to the proof that are handed down from one generation to the next in the philosophical community as a standard companion to Utilitarianism. The primary objections to which I respond at length are the charges that Mill commits the naturalistic fallacy, the fallacy of equivocation, and the fallacy of composition in his proof. Secondary literature on the subject consists of journal articles and book chapters that treat one or another but not all of these problems. My research has convinced me that, although these commentaries are generally quite good, they are mutually incompatible, and they are neither severally nor jointly sufficient to produce the kind of comprehensive defense that would do justice to Mill's proof of the principle of utility. This kind of comprehensive defense is what I intend to contribute to secondary literature on the subject. Specifically, my ultimate contribution to secondary literature is an interpretation of Mill's proof of the principle of utility in its entirety, absolved of the three fallacies commonly attributed to the proof, yet faithful to the text at all points. The majority consensus in the empirical literature is that probability weighting functions are typically inverse-S shaped, that is, people tend to overweight small and underweight large probabilities. A separate stream of literature has reported event-splitting effects and shown that they can explain violations of expected utility. This leads to the questions whether the observed shape of weighting functions is a mere consequence of the coalesced presentation and, more generally, whether preference elicitation should rely on presenting lotteries in a canonical (...) split form instead of the commonly used coalesced form. We analyze data from a binary choice experiment where all lottery pairs are presented in both split and coalesced forms. Our results show that the presentation in a split form leads to a better fit of expected utility theory and to probability weighting functions that are closer to linear. We thus provide some evidence that the extent of probability weighting is not an ingrained feature, but rather a result of processing difficulties. (shrink)

Investigators and institutional review boards should integrate plans about the appropriate disclosure of individual genetic results when designing research studies. The ethical principles of beneficence, respect, reciprocity, and justice provide justification for routinely offering certain results to research participants. We propose a result-evaluation approach that assesses the expected information and the context of the study in order to decide whether results should be offered. According to this approach, the analytic validity and the clinical utility of a specific result determine (...) whether it should be offered routinely. Different results may therefore require different decisions even within the same study. We argue that the threshold of clinical utility for disclosing a result in a research study should be lower than the threshold used for clinical use of the same result. The personal meaning of a result provides additional criteria for evaluation. Finally, the context of the study allows for a more nuanced analysis by addressing the investigators' capabilities for appropriate disclosure, participants' alternative access to the result, and their relationship with the investigators. This analysis shows that the same result may require different decisions in different contexts. (shrink)

Utilitarianism is a “consequentialist” doctrine: that actions are right or wrong in proportion as they produce good or bad consequences. Mill’s version is also a “hedonistic” doctrine. Consequences are good insofar as they have more happiness or less unhappiness; bad, as they have more unhap- piness or less happiness; and by happiness and unhappiness, Mill means pleasure and pain. In English, the words “happiness” and “unhappiness” do not have the same connotations as “pleasure” and “pain.” “Happiness” implies feeling good about (...) one’s life as well as feeling good. “Happiness” is found in relationships with friends and loved ones and in a sense of accomplishment. “Pleasure” seems to be something that is momentary and more sensational. But according to Mill’s psy- chology, a happy life consists in many pleasures and few pains. The happiness of relationships with friends and loved ones is reducible to the joys and satisfactions in the moments of one’s life that arise from these relationships. The happiness of a sense of accomplishment consists of the pleasurable states of consciousness that arise from a sense of accomplishment. The happiness of self-respect and the unhap- piness of self-disrespect consist of the pleasurable and painful states of conscious- ness that these involve. This reduction of happiness and unhappiness to pleasures and pains is a controversial element in Mill’s philosophy. I leave it to the reader to think about that reduction. In recent years, several authors have called to ground descriptive and normative decision theory on neuro-psychological measures of utility. In this paper, I combine insights from the best available neuro-psychological findings, leading philosophical conceptions of welfare and contemporary decision theory to rebut these prominent calls. I argue for two claims of general interest to philosophers, choice modellers and policy makers. First, severe conceptual, epistemic and evidential problems plague ongoing attempts to develop accurate and reliable neuro-psychological measures of utility. (...)
