Intentionality is one of the central problems of modern philosophy. How can a thought, action or belief be about something? Sachs draws on the work of Wilfrid Sellars, C. I. Lewis and Maurice Merleau-Ponty to build a new theory of intentionality that solves many of the problems faced by traditional conceptions. In doing so, he sheds new light on Sellars’s influential arguments concerning the ‘Myth of the Given’ and shows how we can build a productive discourse between American pragmatism, analytical (...) philosophy and European phenomenology. Christia (2015) argues that my criticism of Sellars -- that for Sellars, all intentionality is what I call "discursive intentionality" -- relies on a misunderstanding of Sellarsian intuitions (see Sachs 2014). Here I respond to Christias by pointing that that while is correct that Sellars has a distinction between full-blown linguistic intentionality and perceptual takings, Sellars's theory of perceptual takings cannot do justice to the figure/ground structure of embodied perception stressed by Merleau-Ponty.

From a young age Albie Sachs played a prominent part in the struggle for justice in South Africa. As a result he was detained in solitary confinement, tortured by sleep deprivation and eventually blown up by a car bomb which cost him his right arm and the sight of an eye. His experiences provoked an outpouring of creative thought on the role of law as a protector of human dignity in the modern world, and a lifelong commitment to seeing a (...) new era of justice established in South Africa. After playing an important role in drafting South Africa's post-apartheid Constitution, he was appointed by Nelson Mandela to be a member of the country's first Constitutional Court. Over the course of his fifteen year term on the Court he has grappled with the major issues confronting modern South Africa, and the challenges posed to the fledgling democracy as it sought to overcome the injustices of the apartheid regime. As his term on the Court approaches its end, Sachs here conveys in intimate fashion what it has been like to be a judge in these unique circumstances, how his extraordinary life has influenced his approach to the cases before him, and his views on the nature of justice and its achievement through law. The book provides unique access to an insider's perspective on modern South Africa, and a rare glimpse into the working of a judicial mind. By juxtaposing life experiences and extracts from judgments, Sachs enables the reader to see the complex and surprising ways in which legal culture transforms subjective experience into objectively reasoned decisions. With rare candour he tells of the difficulties he has when preparing a judgment, of how every judgment is a lie. Rejecting purely formal notions of the judicial role he shows how both reason and passion are required for law to work in the service of justice. (shrink)

This article reflects on how Agriculture and Human Values has approached women, gender, and agriculture over the years based on a content analysis of the journal. Overall, the journal has a long history of dealing with these issues with increasing interest over time. The predominant research themes in this area are women on farms; gender, agriculture, and environment; and gender, agriculture, and intersectionalities. Feminist political ecology constituted the major theoretical orientation of this scholarship. Two themes in gender scholarship that received (...) scant attention were masculinities and sexualities. Although many articles focused on women and gender over the years, little evidence exists that the findings from this research penetrated the main issues in the journal. Studies in which gender is not the central focus, such as those related to sustainability, work, and supply chains, would benefit from attention to feminist work in these areas. (shrink)

Today, sustainable relations with a broad range of key stakeholders are not only important from a normative business ethics perspective, but also from an entrepreneurial viewpoint to allow and support the long-term survival of a firm. We will argue that the traditional conception of a firm’s corporate social responsibility does not reflect this view and that a comprehensive and dynamic conception of a firm’s responsibilities is necessary to map the reality of business practice and to manage the challenges implied by (...) sustainability. We think that distributive justice, that is the way in which firms involve their stakeholders in their wealth creation and dissemination processes, provides a comprehensive understanding of corporate responsibilities. Concerning procedural justice, we will discuss how firms involve stakeholders in their strategic processes according to their contribution to wealth creation. In the course of the article, we will propose a framework along with three design principles that can be used for shaping dynamic and comprehensive corporate responsibilities, and which thereby allow a sustainable procedure for changing business and non-business environments. This book argues that contractarianism is well suited as a political morality and explores the implications of deploying it in this way. It promises to revive contractarianism as a viable political theory, breaking it free from its Rawlsian moorings while taking seriously the long-standing objections to it. It's natural to think that the state owes things to its people: physical security, public health and sanitation services, and a functioning judiciary, for example. But is there a theory--a political morality--that can explain (...) why this is so and who the state's people are? This new contractarianism deploys a reversed state of nature thought experiment as the starting point of political theorizing. From this starting point it develops a political morality: a theory of the common ground of the role moralities attached to the various roles within the state. Contractarianism, so understood, can provide a basis for already popular ideas in political theory--such as political and legal liberalism--and overturn conventional wisdom, for example that the state is obligated to secure justice and that animals should have no legal standing. Contractarianism, Role Obligations, and Political Morality will be of interest to scholars and advanced students working in moral and political philosophy. (shrink)

Here I inquire into the status of the rules promulgated in the canonical pronouncements on human subjects research, such as the Declaration of Helsinki and the Belmont Report. The question is whether they are ethical rules or rules of policy. An ethical rule is supposed to accurately reflect the ethical fact (the fact that the action the rule prescribes is ethically obligatory), whereas rules of policy are implemented to achieve a goal. We should be skeptical, I argue, that the actions (...) prescribed by the rules are ethically obligatory, and consequently we should focus our attention on how to craft the rules so as to promote the legitimate goals of human subjects research. Unfortunately, this cannot be done without evidence about the likely effects of various candidate policies—evidence we currently lack. Therefore, we should take the rules as mere starting points, subject to revision as the evidence comes in. (shrink)

In his most recent work, McDowell argues that the oscillation between the Myth of the Given and coherentism can be avoided only by an ‘equipoise’ between the objective and the subjective. However, I argue that Adorno’s ‘cognitive utopia’ is a genuine 4th option distinct from equipoise and from the oscillation between the Myth of the Given and coherentism. McDowell’s inability to acknowledge the cognitive utopia is traced to his overly abstract conception of the disenchantment of nature, in contrast to Adorno’s (...) emphasis on the domination of nature. This difference is traced to their different interpretations of Hegel. (shrink)

Norman Daniels's new book, Just Health, brings together his decades of work on the problem of justice and health. It improves on earlier writings by discussing how we can meet health needs fairly when we cannot meet them all and by attending to the implications of the socioeconomic determinants of health. In this article I return to the core idea around which the entire theory is built: that the principle of equality of opportunity grounds a societal obligation to meet health (...) needs. I point, first, that nowhere does Daniels say just what version of that principle he accepts. I then proceed to construct a principle on his behalf, based on a faithful reading of Just Health. Once we actually nail down the principle, I argue, we will find that there are two problems: it is implausible in itself, and it fails to ground a societal obligation to meet health needs. (shrink)

I argue that Sellars’s distinction between signifying and picturing should be taken seriously by philosophers of mind, language, and cognition. I begin with interpretations of key Sellarsian texts in order to show that picturing is best understood as a theory of non-linguistic cognitive representations through which animals navigate their environments. This is distinct from the kind of discursive cognition that Sellars called ‘signifying’ and which is best understood in terms of socio-linguistic inferences. I argue that picturing is required because reflection (...) on signifying cannot adequately explain our need for cognitive friction. I then show how the idea of picturing is further developed by Paul Churchland, Ruth Garrett Millikan, and Huw Price. I finally turn to predictive processing as a theory of cognitive representation, and in particular Andy Clark’s ‘radical predictive processing’, to further characterize picturing. However, doing so has the cost of pushing picturing and signifying further apart than Sellars intended. (shrink)

Recent work on consequentialism has revealed it to be more flexible than previously thought. Consequentialists have shown how their theory can accommodate certain features with which it has long been considered incompatible, such as agent-centered constraints. This flexibility is usually thought to work in consequentialism’s favor. I want to cast doubt on this assumption. I begin by putting forward the strongest statement of consequentialism’s flexibility: the claim that, whatever set of intuitions the best nonconsequentialist theory accommodates, we can construct a (...) consequentialist theory that can do the same while still retaining whatever is compelling about consequentialism. I argue that if this is true then most likely the non-consequentialist theory with which we started will turn out to have that same compelling feature. So while this extreme flexibility, if indeed consequentialism has it (a question I leave to the side), makes consequentialism more appealing, it makes non-consequentialism more appealing too. A comparison of the political ideas of the 18th-century Vietnamese poet, encyclopedist, and government official Lê Quý Đôn and the younger Korean agronomist, philosopher and poet Chŏng Yag-yong as expressed in their commentaries on the Shu jing.

The most general expression of electromagnetic theory is examined in the light of (1) Faraday's interpretation of the field as a potentiality for the force of charged matter to act upon a test body, and (2) Einstein's view of the field equations as an example of a covariant expression of special relativity. Faraday's original interpretation, in which all physical variables must be expressible as nonsingular fields, implies a particular generalization of the standard forms of the conservation equations and leads to (...) a removal of the problem of the infinite self-energy of point sources. A further generalization of the mathematical expression of electromagnetism occurs when it is asserted that the form of the laws must be compatible with the symmetry requirements of the irreducible representations of the Poincaré group. This yields a factorization of the vector field equations, giving a set of two uncoupled two-component spinor equations. It is shown that the latter lead to twice as many conservation equations for electromagnetism, compared with the vector formalism, thus making extra predictions that are not made in the latter formalism. It is shown that the extra conservation equations reveal themselves only when incorporating the requirements of Faraday's interpretation of the field solutions. (shrink)

In our Introduction to the special issue on Hegel and Sellars, we explain why there needs to be a more detailed analysis of the similarities and differences between Hegel and Sellars. Sellars is usually regarded as closer to Kant than to Hegel, but this obscures the more Hegelian features of his theoretical and practical philosophy. We briefly describe each article in the special issue.

The paper of Klaus Leisinger is a comprehensive description and reflection on the role and responsibilities of key stakeholders to complex and urgent issues, and suggests novel approaches such as stakeholder collaborations for Global Health. Most corporations have, until recently, focused on a small set of stakeholders in regard to creating corporate value. Increasingly, however, corporations are facing broad ranging and complex issues. To deal with them, they realize that their present business model might be too narrow. To improve the (...) quality of life of poor patients in low-income countries, a broader set of stakeholders needs to be included in new and innovative ways. (shrink)

This essay is about the timing of research consent, a process that involves participants being given information about, among other things, upcoming research interventions and then being invited to waive their claims against those interventions being undertaken. The standard practice, as regards timing, is as follows: participants are invited to waive all their claims at a single moment in time, and that point in time immediately follows the information-provision. I argue that there we’re not justified in keeping to this practice. (...) What we ought to do is disaggregate the claim-waiving part of the process and move it later, such that the participant is invited to waive her claim against the undertaking of any given intervention only the immediate moment before that intervention is to be undertaken. This article explores methodological problems of qualitative research templates, that is, the Eisenhardt and the Gioia case study approaches, which are relevant for the business and society scholarship and outlines a reflexive historical research methodology that has the potential to face these challenges. Building on Hans-Georg Gadamer’s philosophical hermeneutics, we draw critical attention to qualitative B&S research and frame the methodological problems identified as the normative challenges of qualitative research, that is, to productively deal with both the researchers’ norms and (...) the research subjects’ norms. We then introduce the reflexive historical case study, a distinct research strategy to face normative challenges based on philosophical hermeneutics and the interpretive tradition of studying organizations. This research approach aims at theory elaboration while its mode of enquiry is reflexive. By explicating three of its key characteristics and using a case example to illustrate our approach, we demonstrate how B&S scholars can benefit from the “temporal filter” of the historical lens and from reflexive concerns about the nature of theory and empirical material. To tap the potential of historical research, we finally envision a research program for studying issues and debates associated with B&S scholarship. (shrink)

Abstract McDowell's contributions to epistemology and philosophy of mind turn centrally on his defense of the Aristotelian concept of a ?rational animal?. I argue here that a clarification of how McDowell uses this concept can make more explicit his distance from Davidson regarding the nature of the minds of non-rational animals. Close examination of his responses to Davidson and to Dennett shows that McDowell is implicitly committed to avoiding the following ?false trichotomy?: that animals are not bearers of semantic content (...) at all, that they are bearers of content in the same sense we are, and that they are bearer of "as if" content. Avoiding the false trichotomy requires that we understand non-rational animals as having concepts but not as making judgments. Furthermore, we need to supplement McDowell's distinction between the logical spaces of reasons and of the realm of law with what Finkelstein calls ?the logical space of animate life?. Though McDowell has taken some recent steps to embrace a view like this, I urge a more demanding conception than what McDowell has thus far suggested. (shrink)

This paper investigates whether moral status talk gets us anywhere in our search for answers to questions in the ethics of marginal cases. I consider the usefulness of moral status talk first on the assumption that an individual's possession of moral status is not a further fact about that individual, and then on the assumption that it is. Finally, I offer an expressivistic interpretation of moral status talk. In each case, I argue that such talk conveys nothing that cannot be (...) conveyed more clearly in other words. My conclusion is that we should stop using moral status and its cognates. (shrink)

On study and teaching of aesthetics in Vietnam.

The first part of this paper examines conditions in accord with Einstein's criterion of regularity on the field solutions everywhere that would correspond to the existence of a black hole star, following from solutions of his (nonvacuum) field equations. ‘Black hole’ is defined here as a star whose matter is so condensed as to correspond to a complete family of spatially closed geodesics. The condition imposed is that the angular momentum of a test body in each of the closed geodesics (...) is a constant of the motion. The second part of the paper examines the implications in the problem of the condensed star of a generalized (factorized) version of the metrical field equations, discovered earlier by the author. It is found that in general relativity stars should naturally pulsate, and in its succeeding cycles the gravitational radius of the star is attenuated by a factor exp(−0.349T), where T is the pulsation period. Conditions are discussed for the possibility that the (relatively) regular emissions of radiation from a pulsar may be dynamically rooted in a (smaller) part of the pulsation cycle when the star is out of the black hole state (less dense → open geodesics)—when radiation would be emitted to the outside world—and the (greater) part of the cycle when it is in the black hole state (more dense → closed geodesics)—when radiation would not be emitted. Meillassoux's criticism of correlationism and the alternative he proposes are compared with Sellars's rationalistic pragmatism. I argue that Meillssoux's rejection of the principle of sufficient reason undermines the intelligibility of science itself, contra Meillassou'x own intentions. Sellars shows how to accept what is true about 'weak' correlationism within a materialistic metaphysics that upholds the PSR.

Aristotle's Physics is one of the least studied "great books"--physics has come to mean something entirely different than Aristotle's inquiry into nature, and stereotyped Medieval interpretations have buried the original text. Sach's translation is really the only one that I know of that attempts to take the reader back to the text itself. -- Leon Cass, University of Chicago.
