A brief critical notice of Dan J Stein's new book _Problems of Living: Perspectives from Philosophy, Psychiatry, and Cognitive-Affective Science_.

Significant criticisms have been raised regarding the ethical and psychological basis of living wills. Various solutions to address these criticisms have been advanced, such as the use of surrogate decision makers alone or data science‐driven algorithms. These proposals share a fundamental weakness: they focus on resolving the problems of living wills, and, in the process, lose sight of the underlying ethical principle of advance care planning, autonomy. By suggesting that the same sweeping solutions, without opportunities for choice, (...) be applied to all, individual patients are treated as population‐level groups—as a theoretical patient who represents a population, not the specific patient crafting his or her individualized future care plans. Instead, advance care planning can be improved through a multimodal approach that both mitigates cognitive biases and allows for customization of the decision‐making process by allowing for the incorporation of a variety of methods of advance care planning. Today’s societies face the minorities that want recognition and respect for cultural differences. Kymlicka names it the challenge of multiculturalism. It is considered that identity and recognition problems have recently come to the fore because of a transformation in the perception of subject, truth, reason caused by postmodernism. Kymlicka claims that even if it is more difficult to live together today, it is not because of the so-called post-truth age. In his opinion, we have never reached absolute common grounds (...) before, either. So, it is not true that we cannot get common grounds by we do not believe metaphysical truths anymore. He already believes that a sense of justice does not count on the metaphysical truths, but it can be based on social identities and a sense of belonging. So, he thinks that an overlapping consensus is possible. However, I will defend a different perspective about pluralism and living together. I think that modus vivendi is an undeniable universal fact. For this reason, an overlapping consensus as a model of living together can only be possible domestically at the expense of a global modus vivendi. (shrink)

As the prevalence of dementia rises, it is increasingly important to determine how to best respect incapable individuals' autonomy during end‐of‐life decisions. Many philosophers advocate for the use of advance directives in these situations to allow capable individuals to outline preferences for their future incapable selves. In this paper, however, I consider whether advance directives lack moral authority in instances of dementia. First, I introduce several scholars who have argued that changes in peoplewith dementia's values throughout disease progression reduce the (...) validity of their advanced wishes. I then outline Karin Jongsma's rejection of this claim, which she calls the “losing and choosing” distinction. Jongsma argues that changes in people with dementia's values should not be respected, because they are unchosen and dictated by the disease. I critique her claim that the process of value change is morally relevant when determining which values we respect. I argue that if individuals with dementia are capable of valuing, their contemporary values should be respected, even when they conflict with past preferences outlined in an advance directive. As such, situations of value change diminish the moral authority of advance directives for individuals with dementia. (shrink)

The figure of form-of-life is a life lived as a ‘how’ or a mode of living, beyond every relation. Form-of-life is a form of impotent, destituent power that seeks to deactivate the biopolitics that continuously divides and separates life itself. Agamben’s work is remarkably silent on the question of reproductive rights. The pregnant woman’s life is regulated continuously by biopolitics, yet Agamben does not discuss this regulation. The woman’s relationship with her foetus is difficult to reconcile with Agamben’s philosophy (...) that seeks to think beyond every relation. In addition, the right to abortion is difficult to reconcile with form-of-life. It is not clear how a woman seeking an abortion is not exercising a sovereign decision to create bare life. I use the UK’s abortion laws as a way to interrogate Agamben’s figure of form-of-life, and to illustrate how, by not accounting for reproductive rights, Agamben’s thought remains incomplete. ‘You mean to say we’re not the only people in the world with the problem of a national park?’ This question was raised during a focus group discussion held with an indigenous community whose ancestral domain overlaps entirely with a national park in the Philippine Cordillera. The question encapsulates an experience shared across the Philippines, particularly in spaces where both the Indigenous Peoples’ Rights Act and the National Integrated Protected Areas System are implemented. This paper examines recent developments in indigenous (...) leaders’ participation in, and critique of, the implementation of these two laws and the development of environmental policies. It follows an emerging, multi-sectoral movement calling for the recognition of Indigenous Communities Conserved Areas and Territories (ICCAs), which has led to the crafting of a draft law. The ICCA bill is envisioned as a law that will resolve indigenous peoples’ problems with national parks, while meeting biodiversity conservation targets. The authors direct attention to how indigenous leaders campaigning for the ICCA bill are asserting their right to delineate space and make decisions in the contexts of policy-making and implementation. It is argued here that their articulations are registers of indigenous critique. Taking these critiques seriously has the potential to drive conservation policy-making past the stewardship stalemate, where conservation goals are pursued at the cost of indigenous peoples’ right to self-determination and indigenous peoples are expected to perform harmony with nature. Outlining the characteristics of “wicked” and “super‐wicked” problems, climate change is considered as a global super‐wicked problem that is primarily about the future. Being global‐ and future‐oriented makes climate change something we have to learn to live with but cannot expect to solve. Because the Institute on Religion in an Age of Science (IRAS) is a multidisciplinary society that yokes the natural and social sciences with values, it is in a position to explore strategies for living with climate (...) change—exemplified by the articles in this section. Finally, asking “who/what is in charge,” it is suggested that in a dynamically interrelated and evolving world no one is. It is important to distinguish between good that is already created and the creative interactions that give rise to new good. In order to live with climate change, our primary orientation should be to live with the creativity that has created and continues to create our life on Planet Earth—since we are not able to know what the future holds. The following essay compares and contrasts Martin Heidegger’s Being and Time with an earlier lecture course that he delivered in the Winter Semester of 1919/2020 entitled Basic Problems of Phenomenology. Heidegger says explicitly that the pre-phenomenal basis for his analysis in Being and Time is “entities” in their equipmental totality. He calls these the “preliminary theme” for his analysis of Dasein. While the analytic of Dasein is the first step in posing the question of Being, the pre-phenomenal basis for (...) the analytic of Dasein is, he says, “entitities” or “equipment”. I argue that this can lead to certain misunderstandings, especially when he talks about nature and human relationships. In Basic Problems, Heidegger’s focus is not on “entities” or “equipment” but rather on experiences. In this earlier work, he is trying to develop a language that can capture the intensity of lived-experience, suggesting an experiential vibrancy to Dasein that is implicit but not thematized in Being and Time. I aim to show that while Heidegger turns away from the term “life” in Being and Time, his understanding of Dasein can still draw on the intensity and immediacy of experience so prominent in this early lecture course. Taylor's book Sources of the Self faces the tasks of showing how persons are situated in moral traditions and how these can be used in moral arguments. ?Moral traditions? cover answers to questions of the meaning of life, of the good life and of justice. The first part of this paper deals with the relationship of persons with moral traditions. Do people have to make sense of their lives, do they have to distinguish between worthy and unworthy ways of (...) class='Hi'>living? It is argued that people have a strong need to answer these questions; life would be unbearable without biographical narratives; living without orientation towards the good is an existential impossibility. Taylor's theory is evaluative in the sense that his transcendental conditions of personhood are necessary because they fulfil a practical need. The second part of the paper examines the use of articulating moral traditions. It is claimed that they can be useful in practical discourse but that they presuppose the moral point of view. Moral traditions answer the question why people are worthy of respect, but not why we should ask that question. It is argued that a minimal version of the principle of equal respect is built into the structure of communication, so that we have no choice but to ask for the normative justification of relationships. The problem of synthesis in biology may have reference to the evolutionary origin of living organisms in past time, a process not directly observable but conceivably reconstructible in broad outline: thus to the biochemist this evolution may appear as the evolution of the special biological compounds, to the psychologist as the evolution of “mind”—or at least of types of behavior. Or the problem may refer to the synthesis of the individual animal or plant, a process of construction which typically (...) starts from a detached portion of a parent organism, such as an egg or seed; this is the problem of individual development or ontogeny and is not essentially different from the general problem of growth. But it is clear that the processes of phyletic evolution and of ontogeny must be considered together, since evolutionary history is in reality the history of a succession of individual organisms, each developing from its germ, i.e. of ontogenies; and the ontogenetic process, so faithfully repeated in each individual as it comes into existence, is itself a product of evolution, having originated in the remote past. The succession of individuals has undergone progressive diversification, culminating in the present condition. We may describe our problem, then, as the problem of the factors underlying the synthesis of a highly special process, that by which the diffusely distributed nonliving materials and energies of nature are brought together in a special kind of unification and transformed into a living organism. The problem of evil might better be called "the problem of problems." That there is "evil" in the world can be expressed most generally by saying that there are problems with the way things are, that at least something is not the way it should be. I shall propose that the various possible resolutions of the problem of evil correspond to varying approaches that people generally take to the problems in their lives. In this way, a connection (...) can be made between the problem of evil as discussed by professional philosophers - a problem concerning the consistency of beliefs - and the problem as often discussed by other writers - a problem concerning the proper response to the "evil" that we find around and within us. In the course of demonstrating the parallel between the philosophical and the practical problem, I shall elaborate on the contrasting points of view of exoteric and esoteric religion, and I shall conclude with an attempt to explain why the problem remains a problem. The duality of standpoints makes its appearance in political theory with particular prominence as the root of an old and persistent problem – the problem of utopianism. A political ideal, however attractive it may be to contemplate, is utopian if reasonable individuals cannot be motivated to live by it. But a political system that is completely tied down to individual motives may fail to embody any ideal at all. The danger of utopianism comes from the political tendency, in pursuit of (...) the ideal of moral equality, to put too much pressure on individual motives or even to attempt to transcend them entirely through an impersonal transformation of social individuals. A nonutopian solution requires a proper balance between these two elements, and that requires knowing what they are and how they interact. (shrink)

This essay is critical of some of the attempts made to solve problems of meaning in religious languages, but remains open-minded about them and accepts the Wittgensteinian invitation to look at their dissolution by way of the experiences of meaning and the aspects of language on which they rely. I have argued that there were and are no lasting problems with religious language per se and that the force and meaning of what is said in using religious language (...) over time and circumstance may vary even to the point of having to retrieve concepts feared lost. We may in addition give ourselves our own personal interpretations by which we want to live and discuss with those in our space of reasons where good conversation is ever an inexhaustible provision on the way to enlightened understanding. Furthermore, we are not merely passive recipients of the meanings and significance of the languages we know. Finally, much of the meaning of religious language comes with the experience of being struck again by what has always been loved and by new aspects of, or different ways of taking, what is presented. The problem of evil is the problem of reconciling the world's afflictions with the fundamental attributes and justice of God. Throughout their lives people encounter painful events originating from nature and other individuals. Furthermore, it is believed that God created everything, particularly in divine religions. Scholars and thinkers have debated for centuries why an omniscient, omnipotent, just, and compassionate God would create evil. The problem of evil is sometimes employed by atheists as evidence against religion, and at times as philosophical (...) proof for the absence of God. Nowadays, it exerts a profound impact on people's beliefs within social media platforms. This article aims to address doubts and objections surrounding the problem of evil. Numerous studies have been conducted on this current issue. The subject, which is basically examined as natural and moral evil in the philosophy of religion, has been examined under the titles such as justice and cruelty, goodness and evil, will and power in classical theology. In this study, the subject is examined in terms of the relationship between the subject of evil and its object, and attention is drawn to the role of man in the formation of evil. In this context, a general overview of the problem of evil is presented in the introduction. The second section delves into how the problem of evil is approached in philosophical and theological traditions, specifically examining the viewpoints of classical kalam schools. In the later parts of the study, the subject has been tried to be reinterpreted under different titles. Within this framework, it is suggested that some doubts and questions about the problem of evil arise from a lack of understanding of religion, while others stem from interpretations perceived as religious within the tradition. To propose a solution to the problem, the concept of God, known for its power and authority in classical times, should be reevaluated. In the context of Islam, God should be considered as an entity possessing complete knowledge, absolute will and power, and creating the universe for goodness, possesses justice and mercy and bestows numerous blessings upon humanity. This perspective finds ample support in the verses of the Qur'an. The problem of evil sometimes emerges from misconceiving the relationship between God and nature as equivalent to a God-human relationship. However, God designed the universe's order to support the emergence of life in nature and make it conducive to the lives of all living beings, particularly humans. Natural phenomena and events unfold by the laws set by Allah. Evils such as diseases, fires, earthquakes, floods, storms, volcanic eruptions, rain, and lightning are not events directly orchestrated by God to harm humans. The harm they cause is primarily a result of humans' negative interactions with nature. Precautions can mitigate these harms. Yet, humans who pollute air, water, and forests and build poorly located structures hastily attribute the resulting evils to God. A careful examination of the numerous blessings in nature underscores that the universe was created by God as a benevolent order. God created humanity to undergo tests within such a world, aiming for human happiness in both this world and the hereafter. Thus, the entirety of God's will be goodness. Evil, conversely, arises from humanity's exercise of free will and the potential to commit malevolent acts. Consequently, evil stems from human interactions with nature and fellow beings. Destiny is another frequently misconstrued aspect. It refers to the natural and moral laws established by Almighty Allah to govern the order of nature and human existence. Destiny presents a realm of possibilities and does not coerce anyone's actions. To address the problem of evil, the portrayal of God, whose sole intent is good, must be reconstructed. Additionally, concepts like testing, fate, death, and sustenance need to be reinterpreted in alignment with this conception. Furthermore, methods that facilitate the acquisition of accurate religious information through social media should be developed to suit contemporary requirements. (shrink)

And, further, that the pristine (...) wilderness is the only alternative to exploitation and abuse. So far, the moral landscape of the conservation movement has tended to be a landscape of extremes.... On the one hand we have the unspoiled wilderness, and on the other hand we have scenes of utter devastation—strip mines, clear-cuts, industrially polluted wastelands, and so on. We wish, say the conservationists, to have more of the one, and less of the other. To which, of course, one must say amen. But it must be a qualified amen, for the conservationist's program has been embarrassingly incomplete. Its picture of the world as either deserted landscape or desertified landscape has misrepresented both the world and humanity. If we are to have an accurate picture of the world, even in its present diseased condition, we must interpose between the unused landscape and the misused landscape a landscape that humans have used well. Wendell Berry (1995, 64) [End Page 109] Introduction If one wants to identify what has gone wrong with humans' relationship to the natural world, there is probably no better place to look than in Eric Katz's (1997) fine collection of essays, Nature as Subject: Human Obligation and Natural Community. 1 Many key insights for understanding our disastrous attitudes toward nature can be found in this compilation of twenty years of merciless criticism of anthropocentrism. Katz's articulation of the source of our moral obligations to nature is deeply on target: Nature is a subject owed moral concern fundamentally because of its independence from humanity and its autonomy from human domination and control.What cannot be found in Nature as Subject is a vision of a positive role for humanity in the natural world. My worry is that Katz's views about the value of nature and our obligations to it leave no room for such an account. I fear that Katz's conceptualization of how humans have wronged nature may entail that all human activity toward nature wrongs nature. This would undermine the possibility of envisioning an environmentally just future in which humans live in the natural world in a morally appropriate way. This is a serious problem, because environmental philosophy needs an ethic for the use of nature, as well as for its nonuse. We need a vision of a constructive human relationship with nature, in addition to a characterization of our past failures of relationship. The question I pose is whether Katz's ideas allow for an account of how humans can be flourishing members who contribute to natural community.This is a problem not just for Eric Katz, but for all of us who accept a broadly preservationist environmental philosophy. If one believes that natural value is fundamentally a function of nature's autonomy from humanity and that a major goal of environmentalism should be to preserve nature relatively uninfluenced by humans, one will have to work hard to explain what positive role humans might have in nature. The alternatives of either minimizing human influence on nature, or sacrificing natural value for human goods, fail to provide for such a positive role. Katz's conceptualization of these matters brings out this problem poignantly. After a brief characterization of the wealth of ideas in Nature as Subject, I will explore this difficulty in some detail. Noted scholar and humanist argues that we can find answers to important human questions without recourse to faith in a supernatural deity. What gives purpose to our existence? What happens to our mind and body when we die? What invests our lives with meaning and propels us to go on from day to day? These are some of the questions that have occupied humankind for centuries. Do solutions to these problems of life and death depend, as many believe, on (...) the existence and intervention of a supernatural creator god? In this contribution to the Prometheus Lecture Series, noted scholar and humanist Kurt Baier, one of the leading ethical theorists of the 20th century, contends that rational humanism is the best alternative to theism. In Problems of Life & Death: A Humanist Perspective, he offers a lively discussion of humanism and supernaturalism; problems of practical wisdom featuring death and the good; and traditional moral problems. Part one traces contemporary rational humanism to its roots in ancient Greece; its revival in the Christian renaissance; its development during the scientific revolution, the 18th century Enlightenment, the Darwinian theory of evolution, and its contemporary developments. Part two answers broad questions of practical wisdom from the rationalist point of view. The third part offers a rationalist conception of morality to replace "the will of God" as the impetus for human action. Baier then applies this moral stance to a number of contemporary moral problems including how to lead a rewarding life, homosexual behavior, birth control, and suicide. With fresh ideas, a carefully argued thesis, and convincing conclusions, Baier shows how the rational humanist can come to grips with some of the deepest problems of human existence, without assumptions based on religious faith. _Purpose._ The purpose of the article lies in studying the main socio-anthropological measurements of the problem of recognition represented primarily by the philosophy of recognition of Alex Honneth, which is actualized by the struggle of the Ukrainian people for their existence and national-cultural recognition. A consistent analysis of the communicative paradigm in contemporary philosophy led to the understanding of its transformation into the reality of the problem of recognition and the identification of the main forms of recognition in it, which (...) determine an individual’s perception of the social space as fair or unfair, where his dignity is disrespected. _Theoretical basis._ Turning to the works of Jurgen Habermas, Otfried Hoeffe, Ernst Tugendhat, Stefan Gosepath, and Thomas Rentsch made it possible to supplement the mainly procedural, theoretical-communicative way of philosophizing with a philosophical-anthropological, existential, contextual principle of awareness of recognition as a fundamental principle of justice and the understanding that the brutal, unjust destruction of the "living world" of a person and the state is synonymous with their physical destruction. The thesis of Francis Fukuyama about the relationship between the desire for recognition and human dignity inherent in human nature has acquired an important theoretical and methodological meaning. _Originality._ The article investigates the modern philosophical discourse of the problem of recognition in the socio-anthropological measurements, in the context of the relationship between recognition, the "living world" and justice, non-recognition, humiliation of human dignity, and injustice. And it was also found that the image of recognition represented by modern philosophical thought, as a horizon and condition of human existence, is based on the following components: justice, solidarity, dignity, and care. Exactly addressing the problem of recognition made it possible to answer the question about the anthropological-ontological, existential meaning of the desire of individuals, nations, and states for recognition and outline the ways of transforming recognition as a variant of "communicative utopia" into a real socio-cultural project. _Conclusions._ In contrast to justice, the theory of recognition comes from asymmetrical human relations, which, in the struggle for recognition, must become symmetrical. Although justice takes precedence over ethics of care and recognition, they are not actually in competition with each other, but belong to different but complementary dimensions of human existence. The perspective of philosophical understanding of the problem of recognition itself requires the deepening of its analysis with an existential-anthropological understanding rooted in a new, tragic life experience. Only under such conditions, it is possible to overcome the gap between often abstract philosophical reflections and real personal and social practices. (shrink)

In recent years, philosophy has witnessed the birth and development of a new research program that has provoked both enthusiasm and strong criticism: Experimental Philosophy. In this contribution, I will briefly examine the new field of experimental philosophy, its purposes and methodologies. I will then summarize some of the objections that have been raised against this research program, and the arguments with which experimental philosophers have used to counter these objections pointing to the usefulness of their studies for philosophy in (...) general. I will then focus on a specific subject that has drawn the attention of experimental philosophers: the problem of free will, its compatibility with determinism, and the related issue of the role of intentionality in action generation. Free will is one of the most ancient and debated problems in philosophy, and also one of the issues on which experimental philosophy methods can be most fruitfully applied, the concepts of free will and of moral responsibility being pervasive in everyday life and grounded in common sense. The problem of evil is a metaphysical problem bound up with the conditions of human existence. The radical evil of fascism and communism, according to Józef Tischner, opens up the possibility that we live in the time of a modern Manichaeism, understood as having two faces: nihilism and pessimism. The possibility of thinking of such a modem form of Manichaeism necessarily calls for a new inquiry into the question of evil. For Tischner, evil, like good, is not an object, but (...) something in which man participates, and for this reason it cannot be objectified and defined. One can only ask how it appears. (shrink)

The article discusses the ethical problems that arise when implementing the processes of digitization and robotization in medicine, and focuses on the relationship between the doctor and the patient. The purpose of this article is to identify the limits of the transformative impact of these processes on the medical profession. The possibilities and disadvantages of telemedicine are considered, and the role of artificial intelligence in modern medical practice is analyzed. A comparative characteristic of the traditional paternalistic model of the (...) doctor’s attitude to the patient and the modern engineering model replacing it is given. The study identified risks of computerization for doctors and patients, which may include the lack of direct contact between the doctor and the patient, the inability to “physical examination,” the uncertainty of liability for medical errors, as well as problems of maintaining the confidentiality of personal data of patients. The dominance of a technical-type model can lead to depersonalization of the patient and replacement of most doctors with artificial intelligence systems and robots. Since modern medicine belongs to two categories – “human territory,” which implies taking care of a person as the main task, and “machine territory,” which is associated with the automation of many processes, the article raises a natural question about the place of a doctor in the modern world. The analysis made it possible to draw some conclusions. With the widespread introduction of artificial intelligence and robotic systems into medicine, the relationship between doctor and patient is being transformed. Diagnostics, treatment and medical manipulations will increasingly be assigned to machines, which will free doctors from the impossible task of collecting a huge array of medical data and free up time to communicate with patients. Intelligent machines and robotic systems will outperform doctors in diagnosing diseases and performing precise surgeries, but they will never replace doctors in caring for patients. Based on the philosophy of Martin Heidegger the article presents the possibility of actualizing Heidegger’s main question about the meaning of Being in the context of the analysis of so-called “a priori perfect.” During the development of fundamental ontology in the second half of the 1920s, Heidegger ponders the approach to Being in the history of philosophy and identifies such a feature of Being as a priori, a kind of antecedence of Being in relation to being. Although tradition invariably understands (...) Being in this way, in it, according to Heidegger, the question is no longer raised either about the sense of such antecedence, or about the temporal basis of this sense, and therefore a priori as the essential character of Being is left in total oblivion. We suggest that it is the problematization of apriority in its temporal origin that can contribute to resolving Heidegger’s fundamental philosophical question of time as the transcendental horizon of any concept of Being that precedes being. In this precedence there is a cherished temporal moment, the comprehension of which allows us to develop the “basic question of metaphysics” about the relationship of Being and time in a more concrete way than Heidegger’s four main themes of the question of Being: the ontological difference; the basic articulation of Being ); the truth-character of Being; the possible modifications of Being and the unity of Being’s variety. Revealing a priori question as the central question of all Heideggers thinking before the “Turn” we attempt to update this question and justify the need for its renewal on the basis of a fundamental ontology. With this task we relate the question of the essence of philosophy in general in its existential-temporal concept since philosophy appears as a temporality-based possible of the questioning return to the “earlier”: to the essential structures of being, knowledge, Being, Dasein. Our analysis is based on the following decisions: Being in relation to being is always pre-understood as “earlier,” and in this understanding a temporal definition operates, hence the main question of fundamental ontology about the relation of Being and time can be developed or at least clarified through the problem of meaning of a priori. The question of the meaning of the “earlier” and of the temporal basis for understanding Being as “earlier,” a priori, is concretized into the question of the conditions for the possibility of any ontology, including the fundamental ontology, which raises the question of the earlier in relation to Being and therefore “lives” in the light of the understanding of the “earlier” as such. This reflexive foundation of the fundamental ontology from itself is a necessary stage on the way of developing its project, if we remember that the main “duty” of the philosopher is to clarify “our inner nature” for the sake of opening the boundaries and conditions of the possibility of philosophy. The conclusion is that the possibilities of fundamental ontology in making sense of Being, time, and philosophy in general are far from exhausted, but await the questions that actualize them and new readings that allow to see the hidden richness of Heidegger’s thought. In relation to the question of the art of living, this chapter articulates the opposite of Richard Rorty’s liberal ironist: the egotist. In the first section, I articulate what egotism is and who egotists are. My aim is to nominate the egotist as a useful counter-figure to the liberal ironist. In the second section, I talk about irony. I emphasize the radicalism and relevance of Rorty’s conception of irony with the help of recent literature. In the third section, I (...) argue that the power of irony is crucial to fight egotism. I show how Rorty mobilizes irony by way of self-creation and solidarity to combat the problem of egotism. In the fourth section, I summarize my argument and suggest how an ironic life prevents nihilism. (shrink)

Intergenerational transfers are a core feature of the practice of private philanthropy. A substantial portion of the resources committed to charitable causes comes from transfers (either during life or at death) that continue to pay out after death. Indeed, much of the power of the charitable foundation lies in its ability to extend the life of an enterprise beyond the mortal existence of its initiating agents. Despite their prevalence, whether and in what way the instruments of intergenerational philanthropy can be (...) justified is controversial. Many have argued that these instruments unfairly privilege the interests of the dead at the expense of the living and unborn. More recently, others have argued that intergenerational charitable transfers comport with the demands of distributive justice and are therefore legitimate. This paper contends that both of these perspectives fail to see the problem for what it is. Intergenerational charitable transfers may indeed promote justice in certain respects, but they do so at the cost of imposing the judgments of the dead onto the living. Respecting the wishes of the past conflicts with an interest in “generational sovereignty.” The paper concludes that properly accounting for this interest in generational sovereignty doesn’t require the abolition of intergenerational philanthropy. But it does tell in favor of a different regulatory orientation than most legal systems currently adopt. (shrink)

Argument about euthanasia in Australia intensified following the world's first legal euthanasia death of Bob Dent under the Northern Territory's short-lived Rights of the Terminally Ill Act 1995. This paper takes stock of the implacably opposed positions on euthanasia following Bob Dent's death, which provides a focus for the controversy, and identifies the key doctrines which separate adversaries in the euthanasia debate and their associated incommensurable intuitions.

As the foundation of our rationality, logic has traditionally been considered fixed, stable and constant. This conception of the discipline has been challenged recently by the plurality of logics and in this book, Pavel Arazim extends the debate to offer a new view of logic as dynamic and without a definite, specific shape. The Problem of Plurality of Logics examines the origins of our standard view of logic alongside Kant's theories, the holistic view, the issue of logic's pragmatic significance and (...) Robert Brandom's logical expressivism. Arazim then draws on proof-theoretical approaches to present a convincing argument for a dynamic version of logical inferentialism, which opens space for a new freedom to modify our own logic. He explores the scope, possibilities and limits of this freedom in order to highlight the future paths logic could take, as a motivation for further research. Marking a departure from logical monism and also from the recent doctrine of logical pluralism in its various forms, this book addresses current debates concerning the expressive role of logic and contributes to a lively area of discussion in analytic philosophy. In this paper, I shall focus on the relation between habitual body and memory in Hegel’sPhilosophy of Subjective Spiritand Merleau-Ponty’sPhenomenology of Perception. Both Hegel and Merleau-Ponty defend a view of the self that is centred on the role of habituality as embodied activity situated in a context. However, both philosophers avoid committing to what Edward Casey has defined habitual body memory, i.e., an active immanence of the past in the body that informs present bodily actions in an efficacious, orienting and (...) regular manner. I shall explore the reasons why neither Hegel nor Merleau-Ponty develops an explicit account of habitual body memory. This will shed light not only on Hegel’s account of lived experience, but also on Hegel and Merleau-Ponty’s common concern with the habitual body. (shrink)

The Problem of Too Many Thinkers is the result, implied by several “permissive” ontologies, that we spatiotemporally overlap with a number of intrinsically person-like entities. The problem, as usually formulated, leaves open a much-neglected question: do we literally share our mental lives, i.e. each of our mental states, with these person-like entities, or do we instead enjoy mental lives that are qualitatively indistinguishable but numerically distinct from theirs? The latter option raises the worry that there is an additional Problem of (...) Too Many Mental Tokens. This paper argues that there is indeed such a problem, at least in fission cases. In the course of articulating this problem, we will make a number of surprising discoveries about the relationship between personal persistence and the metaphysics of mental entities. We will also see that the Problem of Too Many Mental Tokens has significant epistemological and ethical implications, which will haunt us even once we have addressed the Problem of Too Many Thinkers. The Problem of Application investigates the multiple viewpoints in defining a critical aesthetic in applied arts practice. Amongst organisations, participants, and facilitators there are varying wants and needs in any creative project with an educational agenda. The product of arts based health initiatives often seek to inform and educate, whereby an aesthetic standard may seem contrary to this participatory approach. This research maintains that an aesthetic approach is a lively portion of the collaborative dialogue, which requires interrogation and consideration for (...) a successful outcome. Through the analysis of a participatory arts project completed in West Africa addressing youth issues and HIV/AIDS, The Problem of Application seeks to uncover the multiple facets surrounding the defining of aesthetics in applied practice. The project entitled Youth Visions: Transforming our Futures Together worked with students aged 17–21 to develop an outdoor mural and a live performance inspired by the traditions of local festivals. With an anthropological approach to aesthetic criticism, Youth Visions revealed the multiple layers that define our focus of appreciation. (shrink)

We live in strange, frustrating and paradoxical times. Like other trends on the left, Marxism is immobilised by theoretical confusion and practical ineffectiveness just when a relentless state-led war against the working class is nearing the end of its second decade, the greatest transfer of wealth from the poor to the rich in human history has reasserted the centrality of class with a vengeance, the international capitalist financial system teeters on the edge of collapse, whole countries are bankrupt, and hundreds (...) of millions of people are undergoing absolute immiseration and devastating attacks on their standard of living. The gap between what the objective situation demands and what the Left has to offer is so profound that public affairs has become little more than a debate between a powerful right and an eviscerated ‘centre’ – all this at a time of unprecedented crisis and opportunity. Indeed, we do not even seem to know what to talk about. Reminders of how theoretical blind alleys and historic openings have often gone hand in hand may help us orient ourselves to broad trends, but they only underline how essential it is that we begin addressing the profoundly important questions of contemporary life. Until we do, we should not be surprised that people put their trust in angels, consult soothsayers, and are not interested in what we have to say. (shrink)

This important work is a wonderful attempt at making the perennial problems of philosophers come alive with meaning for those who are just beginning their journey into the turbulent depths of philosophical reasoning. The attraction of philosophy is its thoughtful yet intensely critical exploration of the fundamental beliefs, concepts, and ideas that shape our understanding and influence our lives. Successful efforts to make such concerns intelligible, let alone captivating or compelling for the uninitiated reader, are extremely rare. Yet Dr. (...) Mackenzie has accomplished this feat through his extraordinary ability to untangle the complexities of ancient and contemporary problems while demonstrating the beauty of philosophical exploration. So often one hears that philosophy is too complicated for beginners to grasp, that contemporary readers are ill-prepared for the rigorous demands that analyses and syntheses of theoretical ideas require. Irrespective of such claims, it is to Dr. Mackenzie's credit that The Problems of Philosophers brings home to receptive minds, both young and old, some of the basic metaphysical questions that have captivated, puzzled, and perplexed intellectuals for centuries. In each case Dr. Mackenzie unravels difficult problems in an engaging style that sustains both the reader's interest and enthusiasm for each new topic encountered. As the text moves from the Pre-Socratics and Plato to critical thinking, informal fallacies, and on to Descartes, readers will emerge with sharpened skills and a keener understanding of method. In The Art of Living, Alexander Nehamas argues that Michel de Montaigne, Friedrich Nietzsche, and Michel Foucault undertook a particularist art of living—a unique project of self‐construction. In so doing, argues Nehamas, they based their lives on the life of Socrates, that quintessentially ironic character. To this list of self‐fashioning philosophers, I add Fernando Pessoa, the twentieth‐century Portuguese writer. I argue that Pessoa, via the writings of his heteronyms, also took Socrates as the model for constructing a self. (...) Moreover, Pessoa employed all three kinds of irony that Nehamas argues is present in Plato’s writing, and did so not just to investigate the nature of the self, but to question its very existence. This is Pessoa’s formulation of the problem of the self. But Pessoa also borrowed from Nietzsche’s views on multiplicity, redeploying them in order to fabricate multiple selves. Pessoa’s solution to the problem of the self thus consists in the heteronymic device, which acts as a deus ex machina, unifying the disparate fictional voices and establishing Pessoa as a new, authentic self. Accordingly, Pessoa borrows from both Platonism and anti‐Platonism, distinguishing himself from both, so as to contrive—and simultaneously exemplify—an original art of living. (shrink)

We live in an age of distraction. Contemporary analyses of culture, politics, techno-science, and psychology insist on this. They often suggest remedies for it, or ways to capitalize on it. Yet they almost never investigate the meaning and history of distraction itself. This book corrects this lack of attention. It inquires into the effects of distraction, defined not as the opposite of attention, but as truly discontinuous intellect. Human being has to be reconceived, according to this argument, not as quintessentially (...) thought-bearing, but as subject to repeated, causeless blackouts of mind. _The Problem of Distraction_ presents the first genealogy of the concept from Aristotle to the largely forgotten, early twentieth-century efforts by Kafka, Heidegger, and Benjamin to revolutionize the humanities by means of distraction. Further, the book makes the case that our present troubles cannot be solved by recovering or enhancing attention. Not-always-thinking beings are beset by radical breaks in their experience, but in this way they are also receptive to what has not and cannot yet be called experience. (shrink)

The natural sciences seek to explain all natural phenomena, including human beings. This lofty objective encompasses the scientific project in all its glory, within which brain science constitutes an integral part. Essentially, however, neuroscientists not only seek to achieve a greater understanding of how the human brain works but rather, and perhaps mainly, aspire to understand human consciousness, that is, the subjective experience. According to this approach, consciousness is merely brain activity, and thus any progress in the study of the (...) brain represents an advance in the study of consciousness. Yet, despite the many and impressive neuroscientific achievements, when it comes to understanding human consciousness, this discipline cannot deliver the goods. This ongoing failure, so it will be suggested, arouses uncanny anxiety, largely because consciousness is the only phenomenon in which we have complete confidence. The present article suggests that in order to advance our understanding of the subjective experience, we must focus on how the body is thrown into the world in the here-and-now. (shrink)

This is evident in the lives of theists. Evil isolates humans from God. Evil is also one such experience that is personal and existential. Evil brings along a lot of meaninglessness. The employment of foreign workers is one of the most crucial problems today in the domain of work relations. Absorbing workersfrom abroad poses serious questions concerning the moral obligations of the employers as well as the government authorities in the migrantreceiving country. Unfortunately, the moral dilemmas of foreign labor have been largely neglected by business ethics researchers. This paper develops a conceptual framework based on the multinational corporation (MNC) ethical research to help examine the moral obligations of employers and (...) states toward foreign workers, as opposed to citizens. The main argument is that domestic employers, who have the power to affect crucial aspects in the lives of migrant workers, incur obligations to these people and bear moral responsibility for their subsistence. As regards the host country in a universal social order based on the existence of nation-states, the employment of foreign workers poses a genuine ethical dilemma between two valid moral duties: the duty to improve the welfare of nationals and the duty to promote the interests of everyone, regardless of their nationality. No word in English is shorter than the word I.' And yet no word is more important in philosophy. When Descartes said I think therefore I am' he produced something that was both about himself and a universal formula. The word I' is called an indexical' because its meaning always depends on who says it. Other examples of indexicals are you,' here,' this' and now.' John Perry discusses how these kinds of words work, and why they express important philosophical thoughts. (...) He shows that indexicals pose a challenge to traditional assumptions about language and thought. Over the years a number of these papers, now included in this book, have sparked lively debates and have been influential in philosophy, linguistics and other areas of cognitive science. With seven new papers, including the previously unpublished What Are Indexicals?,' the present volume expands on an earlier version of this book published in the early nineties. Miranda Fricker identifies a wrong she calls ‘hermeneutical injustice’. A culture’s hermeneutical resources are the shared meanings its members use to understand their experience, and communicate this understanding to others. Cultures tend to be composed of different social groups that are organised hierarchically. As a consequence of these uneven power relations, the culture’s shared meanings often reflect the lives of its more powerful members, and fail to properly capture the experiences of the less powerful. This may result in members of (...) less powerful groups being harmed. Such disadvantage constitutes, for Fricker, hermeneutical injustice. In this paper, I discuss a problem for Fricker, which arises when we consider what is required to remedy a hermeneutical wrong. Fricker characterizes hermeneutical injustice as involving a lack of concepts, on the part of the disadvantaged group, to capture some important aspect of their experience. But what has not been properly appreciated in the literature to date, is that it is really competing views of the world that are at stake. Moreover, Fricker’s account seemingly implies that the disadvantaged group’s understanding of the world should be treated as authoritative, and taken up by the wider culture. The worry is that in some cases, the disadvantaged group’s view of the world is not one that we think should be accepted. Having presented this problem, I will then show that it bears some similarities to another debate: the dispute over feminist critiques of alien cultural practices. I will then argue that lessons drawn from the latter can help overcome the problem of authority in Fricker’s case. (shrink)
