Dans le Sermon 74 sur le Cantique des Cantiques, Bernard de Clairvaux fait part de son expérience, exprimée en termes de « visites du Verbe ». De son propre aveu, il vise le dévoilement d’une ontologie de la personne qui se réalise pleinement par l’expérience immédiate du Verbe. La construction de la théologie bernardine est reprise dans cet article à partir du mouvement alternatif entre expérience et expression. La capacité humaine de produire de nouvelles formes de langage ne s’épuise pas (...) dans la mise en œuvre de la langue. Pour mettre en exergue cette idée, les termes d’inoperosità (désœuvrement) et d’inappropriable, forgés par Giorgio Agamben, sont utilisés pour montrer dans quelle mesure le cistercien emploie l’art des paroles pour produire l’effet de son expérience personnelle avec Dieu. L’article tente ainsi de montrer que les mots bernardins entrent dans un mode de désœuvrement, afin de nous introduire dans la contemplation du Verbe en tant que forme de vie et transformation intérieure. This paper analyses the ways in which human knowledge of the golden jackal ( Canis aureus) is formed in the case of a rural community of the Romanian Danube Delta. We focus on the territory where humans and jackals overlap and, by using wildlife monitoring alongside interviews and participant observation with humans, we detail how villagers come to have a particularly negative view of this resident canid. Foregrounding the jackal's highly symbolic nature, we trace the development of the community's knowledge (...) of this animal via historical, ecological and geographical factors. Finally, we recommend ways in which our findings could be used in future management plans and draw out the implications for future rewilding practices. (shrink)

Romanian historiography generally states that in Communist Romania there was no intellectual capable of stimulating a “heresy” comparable to those in Yugoslavia, Hungary or Poland. This is almost true. While the Romanian Communist/Workers Party despised intellectuals, even if they were docile and obedient, in the upper echelons of the RCP/RWP one could hardly find true intellectuals. However, there were some cases that can challenge this narrative – Lucreţiu Pătrăşcanu, Grigore Preoteasa, Miron Constantinescu or Tudor Bugnariu. My paper will discuss (...) the case of Tudor Bugnariu, one of the intellectuals seduced by the communist project and ideology in interwar Romania, who later managed to occupy important offices within the RCP/RWP and the state structures. By analyzing the narratives of Tudor Bugnariu’s several autobiographical texts, my paper will examine and explain his becoming and the construction of his self-identity and of his “revolutionary” self. We present a manuscript of Paul Lorenzen that provides a proof of consistency for elementary number theory as an application of the construction of the free countably complete pseudocomplemented semilattice over a preordered set. This manuscript rests in the Oskar-Becker-Nachlass at the Philosophisches Archiv of Universität Konstanz, file OB 5-3b-5. It has probably been written between March and May 1944. We also compare this proof to Gentzen's and Novikov's, and provide a translation of the manuscript.

Argues that content-independent reasons are intentions. Relies on Grice's distinction between natural and non-natural meaning. Rejects previous accounts, and argues that his account can understand the force of such reasons appropriately, through the conept of enabling-conditions. ABSTRACT:Drawing a framework from strategic stakeholder theory and using 1999 to 2010 panel data from the United Kingdom’s (UK) non-life insurance industry, we examine the effect of reinsurance on the decisions to donate to charities, and the amount given. We find that reinsurance substitutes for charitable giving as it optimizes the interests of multiple stakeholders. We further note that corporate giving is directly related to the size and age of insurers, proportion of female directorships and insider ownership, but generally inhibited (...) by chief executive officer (CEO) bonus plans, dominant shareholders, and financial experts on the board. Interestingly, when reinsurance interacts with board-level variables we find that the donations decision is positively related to CEO bonus plans, and negatively linked with inside ownership and the proportion of female board members. In Unfit for the Future, Ingmar Persson and Julian Savulescu present a challenging argument in favour of biomedical moral enhancement. In light of the existential threats of climate change, insufficient moral capacities of the human species seem to require a cautiously shaped programme of biomedical moral enhancement. The story of the tragedy of the commons creates the impression that climate catastrophe is unavoidable and consequently gives strength to the argument. The present paper analyses to what extent a policy in favour (...) of biomedical moral enhancement can thereby be justified and puts special emphasis on the political context. By reconstructing the theoretical assumptions of the argument and by taking them seriously, it is revealed that the argument is self-defeating. The tragedy of the commons may make moral enhancement appear necessary, but when it comes to its implementation, a second-order collective action-problem emerges and impedes the execution of the idea. The paper examines several modifications of the argument and shows how it can be based on easier enforceability of BME. While this implies enforcement, it is not an obstacle for the justification of BME. Rather, enforceability might be the decisive advantage of BME over other means. To take account of the global character of climate change, the paper closes with an inquiry of possible justifications of enforced BME on a global level. The upshot of the entire line of argumentation is that Unfit for the Future cannot justify BME because it ignores the nature of the problem of climate protection and political prerequisites of any solution. The article analyses the common notion that the consumer society is a reflection of those principles in the market that also provide the ideas of democracy and liberal constitutionalism with legitimacy in the political realm. The inalienable right to self-development and self-determination makes the individual the starting and ending point of life, rendering all spheres of market and society a ‘republic of choice’. But if consumer society shares the essentials of liberal constitutionalism and the rational, processual nature of democratic representation, (...) then its ontology needs to be investigated for the same reason and in the same manner as legal and political philosophy dissects the legitimacy and validity of the parliamentary institutions of modern democracy. Just as in the political philosophy of the constitutional structure of the democratic state, the question of who is sovereign is key to understanding the ontology of consumer society. But rather than simply placing sovereignty into the hands of the independent, self-determined consumer, the earliest ontologists of the consumer society took recourse to medieval political theology and presented the consumer market as a new corpus mysticum. Thus, it is medieval political theology, not modern liberal thought, which provided for an ontologization of the consumer. This, in turn, directly pertains to the questions of the legitimacy of consumer society per se, of consumer decisions in particular and of their sources of legitimacy. (shrink)

Los descubrimientos de las neurociencias permiten intervenir en el cerebro humano para mejorar su estado o sus capacidades sin indicación médica. Este fenómeno es conocido como “Neuroenhancement” y está sujeto a un amplio debate ético. Como “Neuroenhancement” es un fenómeno evolutivo, el debate de aspectos éticos está necesariamente orientado al futuro y depende de la información sobre el posible desarrollo de la tecnología y sus consecuencias para la sociedad. Sin embargo, hay que establecer límites para la formulación de previsiones especulativas (...) en argumentos éticos y justificaciones políticas. Propongo distinguir argumentos con tres propósitos distintos: la formación de intuiciones éticas, el reflejo sobre el futuro de la sociedad y justificación de normativas y políticas. Para cada uno de ellos necesitamos estándares adecuados. Es tarea de la filosofía política desarrollar un estándar para los argumentos justificadores.: Neuroscientific findings allow interventions in the human brain to improve its function or modify mental states even without medical indication. This procedure, termed as neuroenhancement, is subject to a broad ethical debate. As neuroenhancement is an evolving phenomenon, the debate is necessarily future-oriented and highly dependent on information about future developments. It remains an open question to what degree uncertain forecasting or even speculation should be considered in the ethical debate and policy-making. I propose to distinguish between arguments with three different purposes: intuition-forming, self-reflecting and justifying arguments. Adequate standards are required for all kinds of future-oriented arguments. The development of these standards for justifying arguments is a task for political philosophy. (shrink)

Mathematical cognition has become an interesting case study for wider theories of cognition. Menary :1–20, 2015) argues that arithmetical cognition not only shows that internalist theories of cognition are wrong, but that it also shows that the Hypothesis of Extended Cognition is right. I examine this argument in more detail, to see if arithmetical cognition can support such conclusions. Specifically, I look at how the use of numerals extends our arithmetical abilities from quantity-related innate systems to systems that can deal (...) with exact numbers of arbitrary size. I then argue that the system underlying our grasp of small numbers is an unhelpful case study for Menary; it doesn’t support an argument for externalism over internalism. The system for large numbers, on the other hand, clearly displays important interactions between public numeral systems and our cognitive processes. I argue that the large number system supports an argument against internalist theories of arithmetical cognition, but that one cannot conclude that the Hypothesis of Extended Cognition is correct. In other words, the large number case doesn’t decide between the Hypothesis of Extended Cognition and the Hypothesis of EMbedded Cognition. (shrink)

On Shapiro’s view, any viable legal theory must successfully respond to his Possibility Puzzle and Humean Challenge. Moreover, he argues that Hartian legal theory fails in this respect. Here, I take issue with his characterization of these challenges and the Hartian response to them. I argue that he equivocates with respect to a number of the key terms and relations that inform his Possibility Puzzle, and I argue that if we disambiguate its terms consistently and plausibly, we will see that (...) its putative challenge to Hartian legal theory is illusory. I also argue that once we adequately characterize Hartian legal theory, it easily meets the Humean Challenge. If correct, these arguments undermine Shapiro’s larger project of defending his planning theory of law, for a key pillar supporting his theory is that it meets challenges that rival theories cannot. I also consider his planning theory directly, and I argue that it compares unfavourably to the Hartian approach in a crucial respect. It obscures the Hartian insight that customary practice is an ineliminable and fundamental feature of legal systems. Thus, I conclude that though Shapiro’s Legality brings to the fore many of the key issues in contemporary analytic jurisprudence and does so in an insightful and provocative way, it does not succeed in its ultimate ambition of improving upon and supplanting Hartian legal theory. This study defends the legitimacy of the Enlightenment project by way of its different realizations in the philosophies of Immanuel Kant and Friedrich Heinrich Jacobi. Today, Enlightenment as a cosmopolitan project with a global claim is often considered synonymous with Western chauvinism. The assertion of a universally binding reason is all too obviously inconsistent with the much-cited recognition of cultural differences. In contrast, it is the conviction brought forward in this book that an adequately understood Enlightenment is an unconditional right (...) of every person taking an active interest in a self-determined way of life. Only the realization of this conception of Enlightenment can provide the required space for the reciprocal recognition of human differences to freely unfold. (shrink)

With the widespread use of artificial intelligence, it becomes crucial to provide information about these systems and how they are used. Governments aim to disclose their use of algorithms to establish legitimacy and the EU AI Act mandates forms of transparency for all high-risk and limited-risk systems. Yet, what should the standards for transparency be? What information is needed to show to a wide public that a certain system can be used legitimately and responsibly? I argue that process-based approaches fail (...) to satisfy, as knowledge about the development process is insufficient to predict the properties of the resulting system. Current outcome-based approaches [Mitchell et al., 2019; Loi et al., 2021] are also criticized for a lack of attention to the broader socio-technical system and failure to account for empirical results that show that people care about more than just the outcomes of a process [as reported by Meyerson et al. (Procedural justice and relational theory: Empirical, philosophical, and legal perspectives, Taylor & Francis, 2021)]. Instead, I propose value-based transparency, on which the information we need to provide is what values have been considered in the design and how successful these have been realized in the final system. This can handle the objections to other frameworks, matches with current best practices on the design of responsible AI and provides the public with information on the crucial aspects of a system’s design. Before engaging with the already intensive and still increasing personal branding activities in many fields of practice, a scholarly approach would call for a more specific definition of the concept of personal branding processes and the resulting human brands. A multi-step analysis of the growing body of literature on personal branding is employed, integrating a framework that covers six key research streams of personal branding, (1) terminology and definition, (2) underlying theories, (3) classes and categories, (4) benefits, (5) antecedents, and (...) (6) key ingredients and applications, complemented by challenges the domain of personal branding has to cope with. The analysis shows that personal branding is an interdisciplinary concern, which is still in its infancy and in which universally valid personal branding frameworks or even theories cannot be identified yet. Personal branding appears as a source for new academic impulses, as it may sensitize scholars to opportunities for intensifying collaboration with practitioners and with other academic domains to enrich and disseminate knowledge in their fields. Starting from the hypothesis that the predominant church, religion and belief in Romania (i.e. the Romanian Orthodox Church, the Orthodox religion and the Orthodox belief) are paradigms that help understand politics, we will highlight in the present article three major aspects of the political phenomenon in post-communist Romania: de-symbolizing the democratic function, institutionalizing “democratism” and manifesting integralism in the public space. Our analysis is based on a communicational approach which postulates the conceptual oppositions as a fundament of understanding. The interpretation (...) of these oppositions has lead us to discovering a series of coherent actions, behaviors, facts, etc., but also a series of incoherent, at some point irrational situations in the relation between the religious and the political spheres. The importance of this article lies in the fact that, once highlighted, these structures allow us to take into consideration the possibility of analyzing the meaning of the relation between the religious and the political spheres. What is the contribution of pragmatism to the sociology of morality? I answer to the points raised by the essays in this symposium on Moral Entanglements: Conserving Birds in Britain and Germany by outlining what the work of John Dewey adds to recent discussions on the question how values change over time and how individuals develop moral commitments.

Peter Railton argues that normative realism is justified because the non-moral goodness of an individual has explanatory uses. After having equated moral rightness with a kind of impersonal social rationality, he argues that rightness, so defined, helps to explain various social phenomena. If he is right, then moral realism would be justified, too. Railton’s argument fails, however, on both counts. Several crucial steps in his reasoning are unsupported and are likely to be false. The explanations he proposes may be dismissed (...) in favor of better explanations that do not use any normative or moral terms. Some of us may share RaiIton’s moral standards. There is no reason, however, to embrace his metaethical position as welI. His arguments do not support either normative or moral facts. (shrink)

This book is an attempt to provide a philosophical answer to the simple question, "What is the law?" as well as address the various debates this question has spawned. Along the way, it develops a unique position within analytic jurisprudence by carefully distinguishing between a theory of the nature of a legal system and a theory of the nature of legal content. Finally, it applies the framework established in the first part of the book to two substantive areas within legal (...) theory: legal reasoning and international legal systems. The result is a unique introduction to the philosophy of law, one that presents and tests a theory of analytic jurisprudence, while it introduces students and others to this sub-field of philosophy. It explains and clarifies for students the views of the most significant scholars in the philosophy of law—those of H.L.A. Hart, Hans Kelsen, Joseph Raz, Ronald Dworkin, and John Finnis—and offers a critique of each. This approach should appeal to all types of philosophers--students and scholars alike--who are wary of wading into the field of legal theory as well as philosophers of law who wouldn’t find useful or interesting a mere survey of the field. We elucidate the conditions under which any hypothesis is explanatorily relevant by analyzing several tests of explanatory relevance and explanations based on those tests. A new causal criterion of explanatory relevance is developed and defended. We show how the causal criterion succeeds in establishing, at the very least, a very strong presumption against moral facts.

We investigate how social comparison processes in leader treatment quality impact group members’ self-worth, affect, and behavior. Evidences from the field and the laboratory suggest that employees who are treated kinder and more considerate than their fellow group members experience more self-worth and positive affect. Moreover, the greater positive self-implications of preferentially treated group members motivate them more strongly to comply with norms and to engage in tasks that benefit the group. These findings suggest that leaders face an ethical trade-off (...) between satisfying the moral standard of treating everybody equally well and satisfying individual group members’ desire to be treated better than others. We show that the same conclusion holds under the assumption of Woodin’s $(\ast )$ -axiom. We further show that there are universes where $\mathsf {BPFA}$ holds and $\text {NS}_{\omega _1}$ is $\Pi _1(\{\omega _1\})$ -definable. Lastly we show that if the canonical inner model with one Woodin cardinal (...) $M_1$ exists, there is a generic extension of $M_1$ in which $\text {NS}_{\omega _1}$ is saturated and $\Pi _1(\{ \omega _1\} )$ -definable, and $\mathsf {MA_{\omega _1}}$ holds. This contribution studies the Egyptian phonetic change between “Ꜣ” and “ḥ,” a question so far dealt with only marginally. Therefore, the phonetic change is considered here for the first time from a broader perspective. An important role has likely been played by the fact that both sounds belong to the laryngals. This phonetic change is also known from other Hamito–Semitic languages—particularly Akkadian and Punic. Furthermore, the phenomenon continued in Coptic. The investigation adduces two different types of material. First, the phonetic (...) change is documented in eleven examples of writings of single words. In this way, a solid foundation is laid for the following procedure. Second, seventeen examples of plays on words are examined which confirm the influence of the phonetic change. These examples demonstrate that the phonetic change occurred in both directions. (shrink)

The phonetic change between b and w is analyzed in a new way. The phenomenon can be considered as firmly established in current research and the list of examples is here enriched by further material. The objects of investigation consist of writings of single words, as well as plays on words.

This chapter discusses Wittgenstein's early account of intentionality in his Tractatus Logico‐Philosophicus as a sophisticated attempt to avoid Sellars's dilemma for relationist theories of thought. Wittgenstein suggests that a picture also includes a “pictorial relationship” to what it depicts. This pictorial relationship “consists of the correlations of the picture's elements with things”. While the picture theory goes a long way towards providing a general account of intentionality in terms of linguistic representation and does so in a way that prima facie (...) avoids both horns of Sellars's dilemma for relationist theories of thought, on closer scrutiny, the early Wittgenstein does not seem to be entirely successful at meeting either of these explanatory goals. The idea of a pictorial relationship between thought and language on the one hand and states of affairs on the other is an essential element of the Tractarian explanation of how thought and language reach “right out to reality”. Dem Scheiternden bleibt zumindest der Nachruhm: Hat er nicht die Zukunft herausgefordert und sich nicht passiv in sein Schicksal ergeben? Eingegangene Risiken werden jedoch erst im nachträglichen Erzählen zum Wagnis. Was die einen als Wagnis preisen, mag von anderen als Fehler, Übermut, Hybris, ja Verbrechen gesehen werden.
