A. G. Baumgarten's foundation of aesthetics as a branch of philosophical reflection is itself deeply rooted in Leibnizian metaphysics. From this starting-point Baumgarten comes to a kind of monadological concept of the work of art, that gets now an inexhaustible and thruthrepresenting meaning. This truth of the work of art however cannot be recognized rationally, for it is impossible for human beings to be aware of a beautiful object's 'metaphysical truth', which can only be perceived by the senses (...) as - to quote Baumgarten - 'aesthetical truth'. Still it is possible, by rational and scientific hermeneutics, to transfer some aspects of aesthetical to logical truth. The interest in art is therefore at the same time an interest in the cognition of the metaphysical cosmic order, and Baumgarten's aesthetics similarly are the first foundation of philosophical hermeneutics of art. This article considers three objections Immanuel Kant raises against Alexander Baumgarten’s plan for a science of aesthetics at different points in his career. Although Kant’s objections appear to be contradictory, this article argues that the contradiction is the result of an anachronism in the composition of Kant’s Logic. When the contradiction is resolved, it becomes apparent that Kant’s main reason for rejecting Baumgarten’s aesthetics during the pre-critical period—the lack of a priori principles for a critique of taste—loses (...) its force after Kant develops a kind of critique that yields a priori principles and then discovers a priori principles of aesthetic judgment. Instead of withdrawing his objections, Kant finds different reasons to deny that aesthetics can be a science, based on the distinction between determining and reflective judgments. (shrink)

Although the first ‘pragmatist aesthetics’ was devised by John Dewey in his Art as Experience, Richard Shusterman has been the only scholar to use the notion of “pragmatist aesthetics” in his Pragmatist Aesthetics. In this paper, I show that Dewey already refuses the gap between the practices of the ‘artworld’ and that of everyday life. In Art as Experience, he criticizes the ‘museum conception’ of art to argue that some aesthetic experiences in our daily life (...) have the same essential structure as the experience of art. While Rorty has revised Dewey’s basic premises, Shusterman has rather restated them. Since the end of the 1980s, he has started developing his own philosophical project, named ‘somaesthetics’. Shusterman’s somaesthetics does not simply incorporate many Deweyan views, but also develops them further. Accepting a Deweyan framework, Shusterman rejects the sharp dualism of the so-called “lower and higher levels of art”. What is more, he considers philosophy as an art of the living, embracing in somaesthetics the ancient Greek and Asian traditions. (shrink)

Neither art nor philosophy was kind to beauty during the twentieth century. Much modern art disdains beauty, and many philosophers deeply suspect that beauty merely paints over or distracts us from horrors. Intellectuals consigned the passions of beauty to the margins, replacing them with the anemic and rarefied alternative, "aesthetic pleasure." In Only a Promise of Happiness, Alexander Nehamas reclaims beauty from its critics. He seeks to restore its place in art, to reestablish the connections among art, beauty, and (...) desire, and to show that the values of art, independently of their moral worth, are equally crucial to the rest of life.Nehamas makes his case with characteristic grace, sensitivity, and philosophical depth, supporting his arguments with searching studies of art and literature, high and low, from Thomas Mann's Death in Venice and Manet's Olympia to television. Throughout, the discussion of artworks is generously illustrated.Beauty, Nehamas concludes, may depend on appearance, but this does not make it superficial. The perception of beauty manifests a hope that life would be better if the object of beauty were part of it. This hope can shape and direct our lives for better or worse. We may discover misery in pursuit of beauty, or find that beauty offers no more than a tantalizing promise of happiness. But if beauty is always dangerous, it is also a pressing human concern that we must seek to understand, and not suppress. (shrink)

With the earliest known reference to angling with a fly dating from the Chou Dynasty, more than 2,300 years ago, it should come as no surprise that when asked to justify their passionate devotion to fly fishing, many anglers will refer to the rich and venerable literature the sport has generated. Ranging from Plutarch's references to Nile fishing in the Life of Antonius, to Pliny the Elder's Historia Naturalis, to the fifteenth century classic, Dame Julian Berner's The Treatyse of (...) Fysshynge wyth an Angle, to the sport's bible, the 17th century The Compleat Angler by Izaak Walton, to literary treatments in the work of authors such as John Donne, Gerard Manley Hopkins, William Butler Yeats, Ezra Pound and Ernest Hemingway, the wealth of literature devoted to fly fishing appears to be out of proportion to what is, ultimately, just a way of seducing an animal with a brain the size of a pea into inhaling a hook upon which some feathers, furs and tinsels have been lashed. What then, one may legitimately ask, is it about this sport that creates fanatical devotion on the part of its practitioners, who tend to regard it with such zeal and passion as is commonly reserved for art and religion? In particular, in Giorgio Agamben's theological-patristic reading of the oikos and the double theoretical movement of a politicization of the oikos and an economization of the political. In the background of a totalitarian concept of budgetary thinking. In Agamben's interpretation, the form of intimate household and domesticity itself becomes a threshold phenomenon - which this paper refers to as the oikos of alterity, indicating (...) a necessity of incorporating Oikos' figures in political life and its economization as well in political order. In a second opening coming from fin-de-siècle debates on cinematic distraction the paper shows the critical discourse of socio-cultural techniques of attention and media of modernity while facing the rise of the media of cinema and internet can be described as transitions in attention economy. A third opening introduces in economic metaphors of attention analysed and their move from modern economic theory into biology and Cognitive Sciences. Finally, a recent metaphorologic shift from economic metaphors of attention to acoustic resonance and ecology metaphors of attention, starting with the >echo-logical< attention metaphor of Yves Citton, is hinted on. William James advocates strenuousness as the key to the moral life yet his hunger for extreme experiences sometimes leads him to risk sacrificing morality in their pursuit. This paradox is best represented by James’s fascination with soldiers and warfare as exemplars of the strenuous life. This essay examines the tension between strenuousness and morality in James’s ethical thought through the lens of his celebration of wildness. Wildness, I argue, names the hungry craving for meaning, lust for intense, novel, (...) and risky experiences, and contempt for the banality of American modernity. In response to Sarin Marchetti and Trygve Throntveit’s recent interpretations of James’s moral thought, I argue that a fuller account of a radical empiricist approach to ethics – its originality, its contributions, its shortcomings – demands a deeper engagement with James’s craving for wildness and its implications for grasping the aesthetic-affective registers of his social criticism and political thought. Alexander Altmann's acclaimed, wide-ranging biography of Moses Mendelssohn (1729-96) was first published in 1973, but its stature as the definitive biography remains unquestioned. In fact, there has been no subsequent attempt at an intellectual biography of this towering and unusual figure: no other Jew so deeply rooted in the Jewish tradition was at the same time so much a part of the intellectual life of the German Enlightenment in the second half of the eighteenth century. As such, Moses (...) Mendelssohn came to be recognized as the inaugurator of a new phase in Jewish history; all modern Jews today are in his debt. Altmann presents Moses Mendelssohn in strictly biographical terms. He does not attempt to assess his significance with the hindsight of historical perspective nor to trace his image in subsequent generations, but rather to observe his life from the period within which it was set. Altmann has written an absorbing and compelling narrative that makes a whole epoch come alive with great drama, for Mendelssohn's life was a kaleidoscope of the European intellectual scene, Jewish and non-Jewish. As both a prominent philosopher and a believing Jew, Mendelssohn became a spokesman for the Jews and Judaism; he was one of the rare figures who become the symbol of an era. Through Altmann's skilful use of hitherto unpublished archival material, the reader is introduced to the vast array of people-men of letters, artists, politicians, scientists, philosophers, and theologians-with whom Mendelssohn was in contact, and sometimes in conflict. What was Mendelssohn's Judaism like? To what extent did the disparate worlds of Judaism and modern Enlightenment jostle each other in his mind and to what degree could he harmonize them? These questions are not easily answered, and it is only in the aggregate of a multitude of accounts of experiences, reaction, and statements on his part that the answer is to be found. Alexander Altmann's analysis of this wealth of material is extraordinary in its discernment, subtlety, and clarity of expression. This masterly work will be of interest not only to those who are concerned with Jewish intellectual history but also to those interested in eighteenth-century cultural and social history, philosophy and theology, literary criticism, aesthetics, and the other areas of intellectual activity in ferment at that time. But of the dozen or more major meetings of this sort held across the country, the one held at the National Institutes of Heakh (NIH) in Bethesda, MD, June 2-4, 1991, was distinctive in several respects.1As (...) its name implies, "Human Genome Research in an Interdependent World" was a global look at the issues raised by gene mapping and sequencing. Unlike previous conferences, however, this meeting looked beyond a comparative analysis of clinical and domestic legal issues, and concentrated on topics that may require responses on a truly international level if they are to be successfully resolved.The meeting's organizers gathered an impressive group of more than seventy participants from fifteen countries, including the first significant contingent of Soviet and Japanese scientists, physicians, and philosophers at an ELSI meeting. In addition to talks by the heads of the genome projects in the Soviet Union, Japan, and the United States, the meeting was keynoted by Dr. James Wyngaarden, director general of the Human Genome Organization (HUGO), and I had the honor of serving as its general chairman.The goal of the meeting was to consider an array of issues that scientists, philosophers, and lawyers from around the world suggested might have international significance, with an eye to deciding three things: (1) Does the issue deserve further attention? (2) Is the issue best addressed in an international or domestic context? and (3) Do structures exist to which the issue can be referred for resolution? In the final sessions, the entire group debated proposed resolutions on the various topics and narrowed the list needing further, intensive exploration.To provide an international framework for this process, the conference [End Page 247] established a Global Steering Committee on Ethical and Social Issues in Genome Research, which will coordinate the efforts of several task forces charged with refining the tentative resolutions adopted by the conference participants on June 4. The task forces are expected to be able to complete work on some topics by the time of the steering committee's first meeting, which was described by one participant as a "check point," probably within the coming year; on other topics, the task forces will provide interim reports and arrange to continue their analysis. Several topics—less complex or more embryonic—were referred directly to the steering committee. On all issues, a major objective will be to ascertain what existing or newly created structure or structures are capable of implementing the group's recommendations and then to monitor the issue to ensure that appropriate implementation is occurring.Issues to be Explored by Task ForcesInsurance and EmploymentWhile individuals may derive medically useful information from the expanded range of genetic tests that will flow from the HGP, they could also be harmed if test results become a basis for discrimination. An area of particular concern at the conference in Bethesda was whether genetic information should be used to decide eligibility for employment or the scope and cost of health and life insurance. The complexity of this issue is increased as barriers to worker migration fall (especially in Europe) and as more firms carry on business internationally. Under the human flourishing theory of property, owners have obligations, positive as well as negative, that they owe to members of the various communities to which they belong. But are the members of those communities limited to living persons, or do they include non-living persons as well, i.e., future persons and the dead? This Article argues that owners owe two sorts of obligation to non-living members of our generational communities, one general, the other specific. The general obligation is to provide (...) future generations with the basic material background conditions that are necessary for them to be able to carry out what I call life-transcending projects that their forebears have transmitted to them. The specific obligation is project-specific; that is, its purpose is to enable successive generational community members to whom particular life-transcending projects have been forwarded to be carried out in their way. The future generational members to whom the project is transferred must also be given whatever resources or goods are necessary to carry the project forward in its intended way. I argue further that each generational community owes its predecessors the obligation to accept life-transcending projects transmitted to them by their forebears and make reasonable efforts to carry those projects forward into the future. The obligation is based on the past generational community members’ dependency on their successors for the projects to continue into the future, a matter that is constitutive of the project creators’ flourishing. This obligation is defeasible, rather than absolute, however. (shrink)

Alexander Gottlieb Baumgarten is regarded as the founder of modern philosophical aesthetics in history of philosophy. Baumgarten associates aesthetics with sensible knowledge and its perfection where beauty appears as the perfection of sensible knowledge. In this context Baumgarten, as a representative of rationalist tradition, takes as a problem that sensible knowledge being accepted as intuition or lower knowledge. According to him, things are known through superior faculties as the object of logical knowledge, while sensible things are known (...) through inferior faculties as the object of science of sensible or aesthetics. Baumgarten’s point of view makes us face a duality in regard to cognitive faculties and ways of knowing: logic and aesthetics. In this paper I shall debate the thesis according to which in the Aristotelian treatise On Soul the sense of touch works as a kind of knot for the knowledge faculties and, implicitly, as a unity for the entire treatise: it has a primitive function in the feeding process, it also represents a starting point for both the faculty of motion and knowledge, then relates itself symmetrical to the sense of vision through the typology of the intermediaries and to the (...) intellect through the criterion of nonbeing, and finally reveals to the receiver a kind of truth that has no more the false as an alternative. On the other hand, the intellect recovers in its own faculty the sense of touch by recreating its functions in the connection between intellect and the indivisible intelligibles. Given these relations, the sense of touch represents the main connection of the treatise's large themes from the question of motion to that of knowledge and it is also literally (certain aristotelian remarksover the theme of earth being taken into consideration here) related to the living body. The Question of Hieronymus. Notes on the Literary Structure of the Treatise De divina omnipotentia by Peter Damianus. In the present study I intend to argue that there is a literary consistency of the central problem of Petrus Damianus’s treatise, De divina omnipotentia. This coherence is made up of analogies between the different levels of language. With this view in mind, I shall underline: the existence of a graduality of the message, the presence of some historical sources of the treatise (...) and the endurance of the author’s personal solution to the medieval issue of whether God can undo the past. In conclusion, my main point would be that this famous treatise is not only relevant to the history of logic, but also to literary history. (shrink)

As scholars anticipate the structural reconfigurations arising from the COVID-19 pandemic, resistance to pandemic measures remains a site of rich discussion. While previous researchers have studied anti-mask, anti-vaccine, and anti-lockdown action, here called anti-restriction movements, as a series of actions informed by individual characteristics like psychological profiles, political leanings, or gender, this paper emphasizes how anti-restriction actions evolved into social movements articulating the antagonisms between state and subject. This paper applies Jürgen Habermas’s theory of New Social Movements (NSMs) to theorize (...) anti-restriction movements as reactions to bureaucratic and economic regulation in cultural and private life. Habermas’s original theory assigned NSMs a radical potential in reinvigorating public political discourse and democratic processes which remains to be seen today. By contrasting the discourses of anti-restriction movements in Indigenous communities in Chiapas, Mexico and suburban communities in Orange County, California, this paper describes how profit-driven market algorithms steer social movements away from their radical potential towards sensationalism and misinformation. Not only do social media platforms “colonize” communication on the national level, but western countries’ control of social media platforms “digitally colonizes” peripheral countries by redirecting subaltern social movements with the hybridized discourses of imperial nations. First of all, we would like to gratefully thank all commentators for the attention and effort they have put into reading and responding to our review paper [this issue] and for useful observations that suggest novel applications for our framework. We understand and accept that some of our claims might appear controversial and raise skepticism, because the overall neural framework we have proposed is difficult to frame in established categories, given its strong multidisciplinary character. To make an example, Elsevier is (...) publishing the British Neuroscience Association (BNA) 2017 Special Issue Collection. However, our paper could not fully fit in any of their Special Issues—attention, motivation, behavior; sensory and motor systems; novel treatments and translational neuroscience; genetics and epigenetics; learning and memory; neurodegenerative disorders and ageing; developmental neuroscience; neuronal, glial and cellular mechanisms; neuroendocrine and autonomic nervous systems; psychiatry and mental health; methods and techniques. Perhaps because our paper was mathematically, physically, biologically (neuroscientifically), and phenomenologically motivated from the start? Nevertheless, venturing in novel, fresh, testable proposals is badly needed in contemporary neuroscience, so to break into “the utter darkness of the inner mechanism of psychic acts… during the production of the concomitant phenomena of perception and thought, namely, feelings, consciousness and volition”—as Cajal had already observed in his opus magnus ‘Textura’. But as he soberly confessed: “This ideal is still very distant” (Ramon y Cajal, 1899-1904, p. 1,141). In the pursuit of that very ideal, neuroscience and psychology have had, and continue to have, a plethora of movements and schools of thought: behaviorism, cognitivism, neural Darwinism, social constructivism, Bayesian optimization...In our paper, we propose to go a step further, via the notion of topodynamics, towards “projectionism.” In what follows, trying to elucidate the main features of this Emperor’s new clothing, we proceed with the responses to the comments received. The Alba Iulia Battyaneum Library, subsidiary of the National Library of Romania, was visited in the summer of 2014 by the authors with the intent to explore the commentaries on Peter Lombard’s Sentences which are preserved in the renowned collection of this library. The Western history of aesthetics is characterised by tension between theory and practice. Musicians listen, play, and then listen more profoundly in order to play differently, adapt the body, and sense the environment. They become deeply involved in the sensorial qualities of music practice. Artistic practice refers to the original meaning of aesthetics - the senses. Whereas Baumgarten and Goethe explored the relationship between sensibility and reason, sensation and thinking, later philosophers of aesthetics deemed the sensorial to (...) be confused and unreliable and instead prioritised a cognitive or objective approach. Written by authors from the fields of philosophy, composition, performance, and artistic practice, 'Sensorial Aesthetics in Music Practices' repositions aesthetics as a domain of the sensible and explores the interaction between artists, life, and environment. The article discusses the development of modern society. In the author’s opinion, the prediction of society development is not possible due to the spontaneity of social processes. The contemporary social development is characterized by transition values: strategic instability, permanent crisis, decay of morality, degradation of the ecological environment, increase of international terrorism, danger of nuclear war, etc. Each epoch, including an epoch of uncertainty, gives rise to its own mechanisms for regulating world development, which are based on the historical memory (...) of mankind, on the acknowledgment of the value of peaceful coexistence and the acceptance of human life as the highest value. Preventing war is the main value of world development. The crucial decisions of country’s further development are dictated by the security of the state. The author demonstrates that in our time the ideal of progress evolves from the concept of accelerated innovation changes into the ideal of sustainable development, which presumes the formation of new values as a condition for the transition to new strategies of civilizational development. The current system of economic growth has its own value foundation – a consumer society. The preservation of a consumer society or the transition to alternative development scenarios largely depend on the achievements of the social sciences and humanities. The future will come without our will, but are we ready to accept this alien and unpredictable future? That is why we cannot passively await the future. This Collision uses an encounter with Cathy Choi’s B1206 , coupled with theories of aesthetic empathy, to articulate how hijacking as an aesthetic concept might work. The aesthetic faculty of empathy conceives of the aesthetic experience as “feeling into” a given work. This concept furnishes a useful framework for thinking about aesthetic hijacking, as “feeling into” something implies the displacement of the work or its viewer. Hijacking, then, could foreground that displacement by emphasizing spatial uncertainty. Furthermore, hijacking could be an (...) inversion of the process of “feeling into” a given work, indicating a process whereby the work forces its way into the viewer and the space s/he inhabits. Der Jenenser Philosoph Heinrich Köhler versucht in seinen Exercitationes Juris Naturalis, eiusque cumprimis cogentis, methodo systematica propositi eine rationalistische Begründung des Naturrechts auf der Basis der Metaphysik von Gottfried Wilhelm Leibniz. Die Rekonstruktion dieser metaphysischen Begründung, die mit dem Aufweiß der Erkennbarkeit des obersten Prinzips des Naturrechts rein aus der Vernunft zusammenfällt, ist Gegenstand der vorliegenden Studie. Ausgehend von der Identifikation jenes Erkenntnisgrundes mit der Natur des Menschen zeigt sich vermittels einer Analyse der von Köhler in Anschlag gebrachten Methode, daß (...) diese Begründung unter Ausschluß bloßer empirischer Erkenntnis auf einen metaphysisch fundierten teleologischen Begriff der menschlichen Natur führt. Der verpflichtende Charakter des Naturrechtsprinzips erwächst demnach daraus, daß seine Achtung dem Menschen eine artgemäße Existenz aller erst ermöglicht. Vor diesem Hintergrund erweist sich auch die Schwäche einer solchen Theorie bei der Beurteilung einzelner Handlungen als moralisch, auf die Alexander Gottlieb Baumgarten in seinem Ius Naturae indirekt und kritisch aufmerksam macht. In his Exercitationes Juris Naturalis, eiusque cumprimis cogentis, methodo systematica propositi , the Jena philosopher Heinrich Köhler attempts to provide a rational foundation for natural law based on Gottfried Wilhelm Leibniz's metaphysics. This paper examines a reconstruction of this metaphysical foundation, which coincides with demonstrating that pure reason can recognize the supreme principle of natural law. Assuming that this recognition can be identified with human nature, an analysis of Köhler's methodology shows that if mere empirical recognition is excluded his foundation leads to a metaphysically based teleological concept of human nature. The principle of natural law imposes obligations because only through respecting it can a human being live in a manner adequate for his species. Against this background, the weakness of this type of theory for determining whether an act is moral becomes apparent, which Alexander Gottlieb Baumgarten indirectly and critically notes in his Ius Naturae. Should arts education have a more significant place in our schools? An emphatic "Yes" comes from the editors and other contributors to this provocative volume. They build their case by drawing upon recent developments in cognitive theory and, in particular, upon contemporary thought regarding aesthetic knowing. They contend that aesthetic knowing constitutes a "special mode of cognition" and they see aesthetic learning as vital to intellectual growth and development. They argue that the arts should "constitute a foundational school subject." An (...) opening chapter reviews past practices in education in the arts, thus providing a needed historical context within which current thinking about aesthetic learning can be viewed. The following chapters elaborate on the idea and value of aesthetic knowing from various perspectives to buttress the case for its importance in education. Developmental issues are explored to deepen understanding of the nature of aesthetic growth. Studies reveal that children's art products have not changed over the years. But how has a cognitive perspective changed the way in which child art is interpreted? Can phases in general aesthetic development be identified? Or are such phases specific to each art form? What pedagogical issues arise in education in the arts? How are conceptual learnings important to the development of aesthetic understanding? Does the study of fine arts enrich the quality of life and shape human personality in positive ways. Given the long history of arts education as a peripheral matter in schools, is it now possible to envision a greater recognition of what study of the arts can accomplish by a proper focus on aesthetic knowing? These are some of the questions addressed in a volume that provides stimulating reading not only for arts educators but for all who are genuinely concerned about education. (shrink)

To resurrect the mind that has built of its own fabric a mansion so vast that its chambers (...) have room for every fact of experience and every theory of science will always provide a happy and appropriate memorial to one whose main business in life was the disinterested speculation idolized by the Greeks as the worthiest employment to which the human spirit can devote its powers. My own share in this labour of love is small and limited in scope; I want to fill in one corner of the picture of Alexander's philosophical system, drawn by Professor Muirhead in the last number of Philosophy , by describing in some detail what he thought about Art and Beauty in their most important aspects and relations. This article analyzes a type of experiment, very popular in 18th-century natural philosophy, which has apparently not led to insights into nature but which was aesthetically especially attractive. These experiments--"mimetic experiments"--allow us to trace a connection between aesthetic appreciation in science and in art contemporaneous with the science. I use this case as a problem for McAllister's theory of aesthetic induction according to which aesthetic standards in science tend to be associated with empirical success and propose an alternative mechanism that (...) is able to account for the natural philosophers' predilection for unsuccessful but beautiful experiments. Schopenhauer is widely held to accommodate no positive aesthetic pleasure. While this may be the case in his mature oeuvre overall, where he insists on the negative character of all gratification, I reconstruct two early accounts of such pleasure in his manuscripts, both of which are a direct result of Schopenhauer’s engagement with Kant’s first and third Critiques. To do so, I analyze his so-called metaphysics of the ‘better consciousness’ and his transition from it to the metaphysics of will (roughly (...) 1811–14). The first account turns out to be an almost literal adoption of Kant’s theory of aesthetic experience as revealing the supersensible character of nature and the cognizing subject. Likewise, Schopenhauer’s second account is a version of the CJ theory of the free interplay of cognitive faculties. These accounts have been underappreciated in Schopenhauer scholarship, but recognizing their importance for the development of his philosophy is essential for gaining a fuller picture of his aesthetics. Alexander Gottlieb Baumgarten grenzt sich in seinem Ius Naturae, das einen knappen Kommentar zu den Exercitationes Iuris Naturalis Heinrich Köhlers darstellt, nach über zwanzigjähriger Auseinandersetzung mit dieser Vorlage entschieden von einer der zentralen Thesen Köhlers ab. Baumgarten löst nämlich dessen Identifikation der Stimmen der Vernunft, des Gewissens, der Natur und Gottes in der Moral auf und zeigt, daß im Gegenteil göttlicher und irdischer Bereich vollständig disjunkt sind.Dies folgt aus der Einsicht in die prinzipielle Ungewißheit eines jeden möglichen moralischen Urteils, (...) das von Menschen gefällt werden kann. Baumgarten begreift solche Urteile als Akte der Zurechnung, die wiederum syllogistische Schlüsse darstellen. Die Gewißheit eines moralischen Urteils hängt demnach von der Gewißheit der Prämissen ab, aus denen es gewonnen wurde. Nun entwickelt Baumgarten hinsichtlich der verschiedenen möglichen Typen moralisch relevanter Handlungen und jeweils in Anschlag zu bringender Gesetze eine differenzierte Theorie zurechnender Instanzen, die er „Foren“ nennt und nach dem Grad der Gewißheit der durch sie möglichen Schlüsse hierarchisiert sind. Dabei zeigt sich, daß keiner jener Zurechnungsschlüsse vollständige Gewißheit beanspruchen kann, auch nicht derjenige, bei der das eigene Gewissen eine eigene Vorstellung unter ein rein aus der Vernunft erkennbares Gesetz bringt. Moralische Urteile über einzelne Handlungen können demzufolge nach Baumgarten immer nur mehr oder weniger wahrscheinlich sein.In his Ius Naturae, which is a short commentary on Heinrich Köhler's Exercitationes Iuris Naturalis, Alexander Gottlieb Baumgarten departs significantly from one of Köhler's central theses after spending more than twenty years dealing with this work. Baumgarten dissolves Köhler's identification of the voices of reason, of conscience, of nature, and of God into morality and illustrates, contrary to Köhler's position, that the realms of God and of the earth are completely disjunctive.Baumgarten's position follows from his realization that any possible moral judgment human beings reach is in principle uncertain. Baumgarten characterizes such judgments as acts of imputation, which represent syllogistic conclusions. The certainty of a moral judgment depends, according to Baumgarten, on the certainty of the premises from which it is drawn. Baumgarten develops a differentiated theory of imputing instances, which he calls "fora," depending on the variety of possible types of morally relevant actions and applicable laws. Baumgarten then places these instances in a hierarchy according to the degree of certainty of the conclusions they might reach. He then shows that none of these conclusions on imputation can claim complete certainty, not even one for which one's own conscience subsumes one's own imagination under a law that can be recognized purely from reason. Largely neglected today, the work of Karl Philipp Moritz was a highly influential source for Early German Romanticism. Moritz considered the form of myth as essential to the absolute nature of the divine subject. This defence was based upon his aesthetic theory, which held that beautiful art was “disinterested”, or complete in itself. For Moritz, Myth, like art, constitutes a totality providing an idiom free from restriction in the imitation of the divine. This examination offers a consideration of Moritz’s (...) class='Hi'>aesthetics and mythography, before turning briefly to consider his influence on the authors of Early German Romanticism. An understanding of the role of Moritz’s thought supports a number of recent claims that challenge the conventional reading of Romanticism. At the same time it allows us to see Romanticism’s unconventional realist theological programme, permitting us to overcome the problematic secularising readings of the movement. This article gives a synopsis of one of the fastest expanding in the last few decades interdisciplinary scientific fields keeping aesthetic problems and questions in its core, that of sensory studies, in order to sift out and systematize their interpretation of Kant’s aesthetics from his Critique of Pure Reason, Critique of Judgement and Anthropology from a Pragmatic Point of View. On that basis, six general conclusions are drawn on the interpretability and actuality of Kant’s transcendental aesthetics, analytics (...) of the beautiful and the sublime, division of the fine arts, and his later observation on the outer senses – through the lens of sensory studies. Alphonso Lingis is unabashed in his uses of we. He does not speak about a privileged we, an exemplary or hegemonic we, or "we." According to this American philosopher, the various ways critics qualify their references to first person plural (we, us, our) are unnecessary, if not unjustifiable. Their caution and skepticism about any direct use of we invariably lead one to focus on this important pronoun as if it were a rhetorical sleight of hand, an ironic twist, a sign of embarrassment or elitism. Worse, their gradual cynicism diminishes or derides the reality of those whose contact with others can only be articulated in terms of we or our. Thus readers, and students subject to these theoretical reservations, are tempted to circumvent any substantive meaning to first-person plural in their own reflections and research. Given the persuasive charms of these reservations, to admit a genuine or lived we involves the risk of being charged with superficiality, a lack of sophistication, nostalgia, or political naiveté. 1In the face of this risk, Lingis writes in first-person plural without apology. Seemingly oblivious to the ongoing controversies over any legitimate use of we—as if it connoted self-indulgence or self-delusion, Lingis depicts experiences and contacts that embody a substance to first-person plural. These contacts are presented directly and with little hesitation, as they often move one to awaken to daring, brazen, or unfamiliar individuals in their contexts and surroundings. To present them requires an air of innocence to the extent that the contacts appear as new to the writer as they are to the reader. [End Page 11]They encompass more than surprise and spectacle. They also initiate beliefs and emotions that embrace other truths: unfamiliar expressions of gods, strange forms of human commitments, eccentric relations humans have with the past and future, but also with animals, trees, and unseen spirits. These truths evoke the kinds of genuine goods and values that are better conceived not as potential instantiations or counterexamples to our generalizations and conventions, but rather as compelling additions to our own senses of reality and truth.In writing about we or us, however, Lingis also raises some critical stakes. While conversant with most of the influential figures and themes discussed under the postmodern rubric, Lingis extends their central ideas to new levels and fields of inquiry. For the last 30 years there have been debates in philosophy about the concept of rationality. In anglo-american circles they have been primary characterized as discussions about “justified beliefs.” By contrast, the debate in Germany among discourse-theorists (Habermas, Apel) has been linked to the problem of justification of communicative speech-acts (within the concept of the entire communicative situation). Herbert Schnädelbach has modified the discours-theoretical account. His concept can be regarded along a number of dimensions. He has developed a linguistic analysis (...) of the validity claims made in various speech-act situations (following Paul Taylor). In Schnädelbach’s view, normative characterizations of speech acts can be used descriptively, too. Furthermore, the hierarchy of justifications ends on the level of rational choice.My starting point here is: there is a fundamental distinction between justifications in everyday-life and a theoretical level of justification (discoursive justifications). Thus, I discuss the hierarchy of justifications developed by Schnädelbach.Furthermore, I evaluate Schnädelbach’s concept in a semantic perspective. I will show that Schnädelbach’s pragmatical account requires a semantic analysis. Without recourse to such analysis, we cannot understand the universe of normative language. (shrink)

This article examines a key question emerging from the strong program in cultural sociology — can art provide a window into social life? An examination of Giacometti's Standing Woman shows that art attempts to express cultural structures via immersion into and through the material surfaces of aesthetic form. Through an analysis of the iconic significance of family photos, furniture and celebrities, the article goes on to suggest that such iconic experience remains at the basis of contemporary social life. ALTHOUGH the content of Alexander Gottlieb Baumgarten's Aesthetica seems to be familiar in German philosophical circles, it is relatively unknown outside Germany. Most of us are aware that it was Baumgarten who coined the name "aesthetics" for the new philosophical discipline his Aesthetica was intended to establish; but as for the content of that work, our acquaintance is likely to be indirect, through two remarks of Kant. Explaining his own use of "Transcendental Aesthetic" in the Critique of (...) Pure Reason, Kant criticizes Baumgarten's "abortive attempt... to bring the critical treatment of the beautiful under rational principles and so to raise its rules to the rank of a science". In the Critique of Judgment, it is generally assumed to be Baumgarten Kant has in mind when, arguing that judgments of beauty are not cognitive or "logical" judgments, he criticizes the view that beauty is perfection known confusedly or indistinctly. Combining Kant's remark with Leibniz's view that beauty is--or, more precisely, flows from--perfection, we might conclude that Baumgarten simply lowered beauty from the level of distinct to that of confused concepts and tried to deduce its rules from the concept of perfection. If this was indeed Baumgarten's project, we might well ask to be excused from pursuing the subject further. (shrink)

This paper defends the Principle of Sufficient Reason, taking Baumgarten as its guide. The primary aim is not to vindicate the principle, but rather to explore the kinds of resources Baumgarten originally thought sufficient to justify the PSR against its early opponents. The paper also considers Baumgarten’s possible responses to Kant’s pre-Critical objections to the proof of the PSR. The paper finds that Baumgarten possesses reasonable responses to all these objections. While the paper notes that in the absence of a (...) response to Kant’s Critical discussion of the PSR, this result does not vindicate the principle, it shows how this discussion provides a deeper understanding of what, according to Baumgarten, the PSR really assumes and intends, and prepares the way for a more responsible discussion of Kant’s critical objections to Baumgarten’s supposed proof. Austrian economics emphasizes a priori components of social scientific theory. Most emphatically, Ludwig Mises and Murray Rothbard champion praxeology, a methodology often criticized as extremely aprioristic. Among the numerous justifications and interpretations of praxeology to be found in the primary and secondary literature, conventionalism avoids the charge of extreme apriorism by construing the fundamental axiom of praxeology as analytic instead of synthetic. This paper (1) explicates the tentative structure of the fundamental axiom, (2) clarifies some aspects of a conventionalist defense (...) of praxeology, and (3) appraises conventionalist praxeology according to Rothbardian criteria. While Rothbard provides an essentialist justification of praxeology and embraces extreme apriorism, a mildly aprioristic conventionalist defense of praxeology fares better on Rothbard’s own criteria and is much more compatible with other contemporary methodological positions and economic theories. Are there any disjunctive properties—features of things such as being either red or round, or Nelson Goodman’s infamous example of being grue? As esoteric as the question may seem at first, central issues about the metaphysics of properties hinge upon its answer, such as whether reductive views about special science properties can handle the phenomenon of multiple realizability. A familiar argument for a negative answer is that disjunctive properties fail to guarantee that their instances are similar in some genuine respect. (...) In this paper, I respond to a novel, sophisticated version of this argument developed in recent work by Paul Audi. Along the way, I develop two new accounts of what it is for a property to be disjunctive—which rely on important recent work on the nature of essence and analysis—and clarify what one is committed to in believing that there are any disjunctive properties at all. Modern neurotechnologies are rapidly infringing on conventional notions of human dignity and they are challenging what it means to be human. This article is a survey analysis of the future of the digital age, reflecting primarily on the effects of neurotechnology that violate universal human rights to dignity, self-determination, and privacy. In particular, this article focuses on neuromarketing to critically assess potentially negative social ramifications of under-regulated neurotechnological application. Possible solutions are critically evaluated, including the human rights claim to the (...) ‘right to mental privacy’ and the suggestion of a new human right based on spiritual jurisdiction, where the human psyche is a legal space in a substantive legal setting. The German Act on Autonomous Driving constitutes the first national framework on level four autonomous vehicles and has received attention from policy makers, AI ethics scholars and legal experts in autonomous driving. Owing to Germany’s role as a global hub for car manufacturing, the following paper sheds light on the act’s position within the ethical discourse and how it reconfigures the balance between legislation and ethical frameworks. Specifically, in this paper, we highlight areas that need to be more worked out (...) in the future either through ethical conventions, corporate measures or legal measures and examine how the law can be incorporated into the existing discourse on the regulation of technologies. Based on this examination, we derive implications for future discourse and elaborate on companies’ responsibilities in developing autonomous driving technologies in an ethical sense. (shrink)

Kidney markets are prohibited in principle because they are assumed to undermine the seller’s dignity. Considering the trade-off between saving more lives by introducing regulated kidney markets and preserving the seller’s dignity, we argue that it is advisable to demand that citizens restrain their own moral judgements and not interfere with the judgements of those who are willing to sell a kidney. We also argue that it is advisable not only to limit the political implications of the moral argument of (...) dignity concerns toward a market-based solution but also to re-evaluate the dignity argument itself. First, if the dignity argument is to be given normative force, it must also consider the dignity violation of the potential transplant recipient. Second, there seems to be no compelling notion of dignity that demonstrates why it is morally permissible to donate but not to sell a kidney. (shrink)

This essay fills in some historical, conceptual, and pedagogical gaps that appear in the most visible and recent professional efforts to “revive” Philosophy as a Way of Life (PWOL). I present “American Philosophy and Self-Culture” as an advanced undergraduate seminar that broadens who counts in and what counts as philosophy by immersing us in the lives, writings, and practices of seven representative U.S.-American philosophers of self-culture, community-building, and world-changing: Benjamin Franklin (1706–1790), Frederick Douglass (1818–1895), William Ellery Channing (1780–1842), Henry (...) David Thoreau (1817–1862), Margaret Fuller (1810-1850), Henry Bugbee (1915–1999), and Gloria Anzaldúa (1942–2004). Students enter the class with preconceptions about who philosophers are, what they do, how they write, and the languages in which they write. Students walk out with new senses of self, place, and language that emerge through new ways of seeing, doing, and writing philosophy. (shrink)

John Rawls argues that it is possible to describe a suitably defined initial situation from which to form reliable judgements about justice. In this initial situation, rational persons are deprived of information that is . It is rational, Rawls argues, for persons choosing principles of justice from this standpoint to be guided by the maximin rule. Critics, however, argue that (i) the maximin rule is not the appropriate decision rule for Rawls's choice position; (ii) the maximin argument relies upon an (...) imprecise account of the satisfactory minimum to be secured under the maximin rule; or that (iii) Rawls relies upon unrealistic assumptions about diminishing marginal value. These critics, I will suggest, argue from a number of assumptions that are confused or false. The satisfactory minimum that choosers in the original position seek to achieve is not a minimum level of primary goods, nor is the satisfactory minimum sought under the maximin rule supplied by the difference principle. I will argue that the maximin argument is more robust than has generally been recognized and that this argument performs a number of important functions in clarifying the nature and implications of Rawls's argument for justice as fairness. The growing support for voluntary active euthanasia is evident in the recently approved Dutch Law on Termination of Life on Request. Indeed, the debate over legalized VAE has increased in European countries, the United States, and many other nations over the last several years. The proponents of VAE argue that when a patient judges that the burdens of living outweigh the benefits, euthanasia can be justified. If some adults suffer to such an extent that VAE is justified, then one (...) may conclude that some children suffer to this extent as well. In an attempt to alleviate the suffering of extremely ill neonates, the University Medical Center Groningen developed a protocol for neonatal euthanasia. In this article, I first present the ethical justifications for VAE and discuss how these arguments relate to euthanizing ill neonates. I then argue that, even if one accepts the justification for VAE in adults, neonatal euthanasia cannot be supported, primarily because physicians and parents can never accurately assess the suffering of children. I argue that without the testament of the patient herself as to the nature and magnitude of her suffering, physicians can never accurately weigh the benefits and burdens of a child’s life, and therefore any such system would condemn to death some children whose suffering is not unbearable. I conclude that because the primary duty of physicians is to never harm their patients, neonatal euthanasia cannot be supported. (shrink)
