Polazna točka izučavanja hrvatske ustavne demokracije donošenje je Ustava Republike Hrvatske od 22. prosinca 1990. godine. Oblik ustrojstva vlasti Ustava Republike Hrvatske određen je kao polupredsjednički sustav, a autori hrvatskog Ustava navode kao uzor Ustav Pete Republike. Uvoz francuskog ustavnog prava 1990. godine nije bio neutralan. Iz originalnog francuskog ustavnog teksta odstranjene su institucionalne prepreke, ustavne institucije za pružanje otpora volji predsjednika republike, a i ustavnopravni uvjeti za prednost predsjednika vlade u političkom sustavu u slučaju kohabitacije, nepodudarnosti parlamentarne i predsjedničke (...) većine. Tekst je nadograđen ustavnim normama nepoznatima originalu. Francuske je ustavne norme bilo potrebno instrumentalizirati, protumačiti i pravno prilagoditi poželjnom političkom cilju: uspostavi djelotvorne državne vlasti u kojoj se nadmoć predsjednika republike širi i na vladu i zakonodavnu vlast. Mit o polupredsjedničkom sustavu poslužio je i za usvajanje odredbi o ustrojstvu vlasti u Ustavu Hrvatske i prilikom izmjene tih odredbi Ustavnim promjenama iz 2000. godine. (shrink)

The starting point for studying the Croatian constitutional democracy is the adoption of the Constitution of the Republic of Croatia on 22 December 1990. The said Constitution defines the system of government as semi-presidential and its authors state as their model the Constitution of the Fifth Republic. However, the importing, in 1990, of French constitutional provisions was not neutral since the original French constitutional text was stripped of institutional obstacles, constitutional institutions for opposing the will of the President of the (...) Republic, constitutional-law conditions for the Prime Minister's primacy in the political system in case of co-habitation and discrepancies between the parliamentary and the presidential majority. The text was complemented by constitutional norms unknown to the original. French constitutional norms had to be put to good use, interpreted in line with and legally adapted to the desired political goal, i.e., the establishment of an effective state government in which the primacy of the President of the Republic would assert itself over both the Government and the legislature. The myth on the semi-presidential system was drawn on for both the adoption of the provisions regulating the organisation of government in the 1990 Constitution of the Republic of Croatia and their amendment in 2000. In _Caring_, Peta Bowden extends and challenges recent debates on feminist ethics. She takes issue with accounts of the ethics of care that focus on alleged principles of caring rather than analysing caring in practice. Caring, Bowden argues, must be understood by 'working through examples'. Following this approach, Bowden explores four main caring practices: mothering, friendship, nursing and citizenship. Her analysis of the differences and similarities in these practices - their varying degrees of intimacy and reciprocity, formality and informality, (...) vulnerability and choice - reveals the practical complexity of the ethics of care. _Caring_ recognizes that ethical practices constantly outrun the theories that attempt to explain them, and Bowden's unique approach provides major new insights into the nature of care without resorting to indiscriminate unitary models. The body conceived of as a machinic assemblage becomes a body that is multiple. Its function or meaning no longer depends on an interior truth or identity, but on the particular assemblages it forms with other bodies. In this paper I draw on the work of Deleuze and Guattari to explore what happens to the drug using body when it is rethought as a machinic assemblage. Following an exploration of how the body of the drug user is put together and (...) stratified as a subject, and a careful manoeuvre through the bleak conception of the ‘drugged body’ provided by Deleuze and Guattari, I begin to map out some ethical alternatives. I argue that a body should, ultimately, be valued for what it can do (rather than what is essentially ‘is’), and that assemblages should be assessed in relation to their enabling, or blocking, of a body’s potential to become other. Recent discussions concerning the ethics of nursing care have gained added impetus from articulations of die so‐called ‘ethic of carersquo; in moral philosophy. This paper addresses the question of recognizing and elaborating the ethics of nursing care by exploring the problems and the possibilities of diese intersecting discourses. In the first part of the paper it is argued that appropriation of ‘the ethic of care’ by nursing theorists as the central value of nursing, in contradistinction to other moral values such (...) as beneficence or justice, runs the risk of reinforcing the conventional approaches to ethics that ‘the ethic of care’ seeks to overturn. Central to ‘the ethic of care’ is the recognition that caring entails a focus on the particularities and context of the relationships in which it is expressed. Accordingly die application of a unitary concept of care to the context of nursing relations may seriously distort dieir diverse and complex‐specific ediical possibilities. The dynamic complexity of nursing ethics may be more adequately understood by working through an array of specific examples of nursing practice highlighting the differences and similarities between them and other ethical practices of care. Experience of a set of examples in this way will draw attention to the multiplicity, ambiguity, and particularity of the ethics of nursing while facilitating the ability to recognize how other practices may or may not be understood as examples of ediical nursing care. In the second part of the paper a beginning is made on this project by addressing the work of several different theorists of care who have examined different practices of nursing from the overlapping perspectives of nurses, patients and the socio‐historical construction of their relationships. This study considers one of the cognitive mechanisms underlying the development of second language vocabulary in children: The differentiation and sharpening of lexical representations. We propose that sharpening is triggered by an implicit comparison of similar representations, a process we call contrasting. We investigate whether integrating contrasting in a learning method in which children contrast orthographically and semantically similar L2 words facilitates learning of those words by sharpening their new lexical representations. In our study, 48 Dutch-speaking children learned unfamiliar orthographically (...) and semantically similar English words in a multiple-choice learning task. One half of the group learned the similar words by contrasting them, while the other half did not contrast them. Their word knowledge was measured immediately after learning as well as 1 week later. Contrasting was found to facilitate learning by leading to more precise lexical representations. However, only highly skilled readers benefitted from contrasting. Our findings offer novel insights into the development of L2 lexical representations from fuzzy to more precise, and have potential implications for education. (shrink)

The question of the transcendent, that which operates above and beyond the material stuff of the world, remains an enduring one for feminism, bound up as it is with the foundations of feminism's corporeal politics and the definition of its political subject. With the specificity of the situated and meaningful body grounding feminist politics, the universal and neutral status of the speaking subject has been diagnosed as masculine, and unable to properly account for sexed differences. On this basis, political community, (...) collectivity forged along the lines of a common identity, is considered important in the realization of feminist political goals, yet is also problematic in view of its reliance upon a universal category of identity through which to motivate for political change. Acknowledging these tensions, this paper revisits Luce Irigaray's essay “Divine Women” to suggest that in her rethinking of the divine as a shared horizon through which women can potentially achieve autonomy, the nature of the transcendent, the universal, and the identity of the feminine are also reconfigured in surprising ways. In a specific address to the dilemma of political community, Irigaray makes available a notion of the divine that is already differently inhabited. (shrink)

This paper argues that Pedro Tabenksy's Aristotelean understanding of true happiness overlooks the constitutive significance of the virtues and values of relationships of radical dependency. Tabensky's focus on the rational and contextual aspects of personhood as the locus for our social interdependence results in friendship relationships being taken as paradigmatic for social engagements. Through a sketch of some of the unique dimensions of the asymmetrical relations upon which our bodily functioning and personal identities inevitably depend, I show that this focus (...) risks perpetuating the lack of recognition of the value and significance of caring relations familiar to us in contemporary societies today. "Understanding Feminism" provides an accessible guide to one of the most important and contested movements in progressive modern thought. Presenting feminism as a dynamic, multi-faceted and adaptive movement that has evolved in response to the changing practical and theoretical problems faced by women, the authors take a problem-oriented approach that maps the complex strands of feminist thinking in relation to women's struggles for equal recognition and rights, and freedom from oppressive constraints of sex, self-expression and autonomy. Each chapter focuses on (...) a different cluster of concerns, demonstrating key moves in second-wave feminist thought, as well as some of the diversity in response-strategies that encompass both socio-economic and cultural-symbolic concerns. This approach not only shows how central feminist insights, theories and strategies emerge and re-emerge across different contexts, but makes clear that far from being 'over', feminism remains a vital response to the diverse issues that women find pressing and socially important. Recent work in clinical nursing ethics has been influenced by two main areas of insight associated with the challenge levelled by the women's movement to traditional thinking about morality and ethics. Broadly speaking these two realms have been distinguished as articulating ‘feminist’ socio‐political and ‘feminine’ ethic of care concerns. Often these two impulses are seen as pulling against each other, or worse, the ‘feminine’ emphasis on the ethics of care is seen as reinforcing the dynamics that elicit the ‘feminist’ concern. (...) In this paper I suggest how an expanded understanding of an ethic of care in clinical settings can provide resources for dealing with both concerns. A discussion of the way institutional relations can ride rough‐shod over the ‘feminist’ insights of ethical care, in the second part of the paper, provides evidence for my conclusion that ethical nursing care depends on recognizing that both areas of insight are imperative for its success. On Surface and Place is a rich and poetic exploration of surfaces which foregrounds their significance in our understanding and experience of place. Adopting weaving as its overarching metaphor, it departs from Gottfried Semper's discussion of correspondences between architecture and textiles, and emerges from the reading of photographs, a swatch of Harris Tweed and curtain wall façade juxtaposed. In juxtaposing the fabric of the city with the weave of Harris Tweed the book charts an original course across a range of (...) connected ideas and questions, combining many different themes, writers and disciplines. It presents integrated and innovative rethinkings on a number of fundamental relationships, including correlations between body and building, word and image, and between the rural and the metropolitan, and the hand-crafted and the mass-reproduced. In doing so, it seeks to foreground the very interrelationship of surface and place, as it makes a claim for the relational nature of the world in which we live. (shrink)

The Australian moratorium on human clinical trials of xenotransplantation was lifted in December 2009. This decision follows public consultations on whether xenotransplantation should or should not proceed in Australia, which occurred in 2002 and 2004. However, the public consultation, in its design and process, did not facilitate meaningful public engagement and involvement, thus marginalising the public and devaluing their social experiences and diverse knowledges. This brief article questions what constitutes adequate public consultation, and suggests that consensus conferences or citizen juries (...) should be explored as a mechanism for meaningful public engagement for future public consultation exercises in Australia. This article argues that political performance reveals the significance of the emotions, emotional feelings, affect and mood in relation to the censorship of democratic expression. Belarus Free Theatre performers spoke about fear as they gave personal accounts of imprisonment and undertook extreme physical action on aerial ropes, creating performances that evoked both emotionally felt responses and bodily affect. The aesthetic mood effect in these performances shifted from amusing audiences with the absurdity of political censorship to alarming them with the terror (...) of political persecution. Antonio Damasio points out that although aspects of the emotions merge in everyday life, ideas or impressions need to be separated out from the physiology of emotional feeling in their study. While the turn to affect emphasizes convergence and, importantly, recognizes human sensitivity to nonhuman energies, an impersonal energetic field can be distinguished from the personal and the psychological. This analysis of theatrical performance reveals the ways in which it presents social ideas of the emotions and aesthetic moods, as well as elicits the affect of bodily sensation and invites the emotionally felt responses of audience members. In this round table response, we discuss some of the problems inherent in insisting on specific consent for an activity that needs to happen rapidly as part of a package of care. The Human Tissue Authority (the UK regulator for human tissue and organs) consider that specific consent is mandatory to assess which antibiotics are appropriate on the neonatal unit, but this insistence may actually limit the autonomy which consent aims to promote. While genetic testing to determine which child will (...) react adversely to particular antibiotics has been available clinically for several years, the research proposed here is to assess whether improving the speed of testing allows decisions to be made before treatment starts. Insisting on specific consent before this activity can take place is likely to delay appropriate care in some cases. On admission to the neonatal unit, the unwell infant is routinely subjected to a range of investigations and treatments. A person with parental responsibility will usually be asked to provide consent to undertake treatments for children who do not have capacity to give consent themselves.1 For the acutely unwell child, consent will usually be sought for a package of care: the urgent nature of neonatal medicine often requires clinicians to make many decisions without explicit consent. Doctors must always act in a child’s best interests: their decisions need to protect the health and well-being of a child and hold the child’s welfare paramount in accordance with the Children Act (1989) and General Medical Council (GMC) guidelines.1 2 Thus, for example, ventilation might be initiated, sedation provided, antibiotics commenced or diagnostic investigations requested without separate consent conversations or …. In the 1970s and 1980s a strong opposition and anxiety towards biological and naturalizing knowledges was the norm in feminist discourse. In the past decades the certainties of that ‘anti-biologism’ have been challenged, in part because of a new recognition of the role of contingency in both biological determination and biological science. What seems to have survived the shift is a set of normative assumptions concerning the role of determinacy and contingency (or being-born and becoming) in the political implications of (...) ontological claims: an assumed political valorization of contingency. This article challenges those assumptions. It draws attention to the embrace of contingency and processuality on the part of supremacist biopolitical discourse, and suggests the need to think again about the politics of contingency and becoming (in constructivist as well as biologistic discourses). Focusing on the issue of racism and supremacist-specification, the article takes a genealogical look at ‘second-wave’ feminist anti-biologism. Monique Wittig’s materialist feminist attack on naturalizing ideology and ‘the myth of woman’ provides the (ideal-typical) historical example. The article draws attention to curious absences in Wittig’s (and Rosalind Rosenberg’s) anti-biologistic statements concerning early 20th-century biologistic feminism: the absence of a critique of eugenics, racism and supremacism. Arguably the condemnation of biology as a conservative ‘ideology of the status quo’ created masks for biopolitical ontology, obscuring the progressive, dynamic, processual character of biologism and of modern racism. While dislodging some powers of biologistic discourse, feminist anti-biologism might also have played a part in facilitating the revitalization of biopolitical racism within the constructivist culturalist rubric. The aim of the article is not to critique ‘second-wave’ feminism from the perspective of contemporary scholarship, but to help generate new ways of thinking and feeling about the role of ontology, contingency and temporality in the present politics of classification. BackgroundReiki is an energy healing technique or biofield therapy in which an attuned therapist places their hands on or near the client’s body and sends energy to the client to activate the body’s ability to heal itself and restore balance. It was developed in Japan at the end of the 19th century by Mikao Usui of Kyoto. Given the enormous international socioeconomic burden of mental health, inexpensive, safe, and evidenced-based treatments would be welcomed. Reiki is safe, inexpensive, and preliminary research (...) suggests it may assist in treating a wide variety of illnesses. Given that Reiki is a biofield therapy, growing in use, and not yet accepted by the dominant biomedical paradigm, it is important to establish its effectiveness over placebo. This study aimed to examine Reiki’s effectiveness over placebo in treating symptoms of mental health and to explore parameters for its effectiveness.MethodA systematic review of randomized placebo-controlled trials examining Reiki’s effectiveness in treating symptoms of mental health in adults was conducted through a systematic search of PubMed, PsycINFO, MEDLINE, CINAHL, Web of Science, Scopus, Embase, and ProQuest. Fourteen studies met the inclusion criteria, and risk of bias was assessed using Cochrane’s Revised ROB 2 assessment tool. This was followed by a grading of recommendations, assessment, development and evaluations assessment.ResultsThe evidence to date suggests that Reiki consistently demonstrates a greater therapeutic effect over placebo for some symptoms of mental health. The GRADE level of evidence is high for clinically relevant levels of stress and depression, moderate to high for clinically relevant levels of anxiety, low to moderate for normal levels of stress, and low to moderate for burnout, and low for normal levels of depression and anxiety.ConclusionThe results suggest that, Reiki may be more effective in treating some areas of mental health, than placebo, particularly if symptoms are clinically relevant. To date, there are a small number of studies in each area, therefore findings are inconclusive and, more RCTs controlling for placebo in Reiki research are needed. Most included studies were also assessed as having a risk of bias of some concern. Human sleeping arrangements have evolved over time and differ across cultures. The majority of adults share their bed at one time or another with a partner or child, and many also sleep with pets. In fact, around half of dog and cat owners report sharing a bed or bedroom with their pet. However, interspecies co-sleeping has been trivialized in the literature relative to interpersonal or human-human co-sleeping, receiving little attention from an interdisciplinary psychological perspective. In this paper, we provide a (...) historical outline of the “civilizing process” that has led to current sociocultural conceptions of sleep as an individual, private function crucial for the functioning of society and the health of individuals. We identify similar historical processes at work in the formation of contemporary constructions of socially normative sleeping arrangements for humans and animals. Importantly, since previous examinations of co-sleeping practices have anthropocentrically framed this topic, the result is an incomplete understanding of co-sleeping practices. By using dogs as an exemplar of human-animal co-sleeping, and comparing human-canine sleeping with adult-child co-sleeping, we determine that both forms of co-sleeping share common factors for establishment and maintenance, and often result in similar benefits and drawbacks. We propose that human-animal and adult-child co-sleeping should be approached as legitimate and socially relevant forms of co-sleeping, and we recommend that co-sleeping be approached broadly as a social practice involving relations with humans and other animals. Because our proposition is speculative and derived from canine-centric data, we recommend ongoing theoretical refinement grounded in empirical research addressing co-sleeping between humans and multiple animal species. BackgroundDuring the arrival of the COVID-19 pandemic, various professional ethical guidance was issued to (and for) health and social care professionals in England and Wales. Guidance can help to inform and support such professionals and their patients, clients and service users, but a plethora of guidance risked information overload, confusion, and inconsistency. MethodsDuring the early months of the pandemic, we undertook a rapid review, asking: what are the principles adopted by professional ethical guidance in England and Wales for dealing with (...) COVID-19? We undertook thematic content analysis of the 29 documents that met our inclusion criteria.ResultsThe 29 documents captured 13 overlapping principles: respect, fairness, minimising harm, reciprocity, proportionality, flexibility, working together, inclusiveness, communication, transparency, reasonableness, responsibility, and accountability.ConclusionsWe intend this attempt to collate and outline the prominent principles to be helpful, particularly, for healthcare practice during the COVID-19 pandemic and, hopefully, for future pandemic planning. We also offer some reflections on the guidance and the principles therein. After describing the principles, we reflect on some of the similarities and differences in the guidance, and the challenges associated not only with the specific guidance reviewed, but also with the nature and import of “professional ethical guidance”. The risk posed by anthropogenic climate change is generally accepted, and the challenge we face to reduce greenhouse gas (GHG) emissions to a tolerable limit cannot be underestimated. Reducing GHG emissions can be achieved either by producing less GHG to begin with or by emitting less GHG into the atmosphere. One carbon mitigation technology with large potential for capturing carbon dioxide at the point source of emissions is carbon capture and storage (CCS). However, the merits of CCS have been questioned, (...) both on practical and ethical grounds. While the practical concerns have already received substantial attention, the ethical concerns still demand further consideration. This article aims to respond to this deficit by reviewing the critical ethical challenges raised by CCS as a possible tool in a climate mitigation strategy and argues that the urgency stemming from climate change underpins many of the concerns raised by CCS. In early 2020, as the first of many COVID lockdowns began across Australia, a collective of feminist and queer performance scholars and artists embarked on the research project Staging Australian Women’s Lives: Theatre, Feminism and Socially Engaged Art. Our aim was to document contributions of womxn theatre makers, while conducting a feminist analysis of strategies used to deal with gender inequality and oppression, on stage and off. While pivoting to the digital and the virtual, we recognised a need to support (...) womxn theatre makers whose lives and livelihoods are thrown into further precarity by the pandemic. This paper speaks to our commitment to bringing together critical theory, arts practices and everyday life in ethical forms and encounters that make visible, recognise and express care for one another and for the work. The mobile internet provides new and easier ways for people to organise themselves, raise issues, take action, and interact with their city. However, lack of information or motivation often prevents citizens from regularly contributing to the common good. In this paper, we present DoGood, a mobile app that aims at motivating citizens to join civic activities in their local community. Our study asks to what extent gamification can motivate users to participate in civic activities. The term civic activity is not (...) yet well defined, so we collect activities citizens consider to be civic to work towards a broadly accepted definition of the term. The DoGood app uses gamified elements that we studied to gauge their role in encouraging citizens to submit and promote their civic activities as well as to join the activities of others. DoGood was implemented and deployed to citizens in a five-week-long user study. The app succeeded in motivating most of its users to do more civic activities, and its gamified elements were well received. (shrink)

This article documents the response of cooperative institutions that were required to adhere to new capital adequacy regulations traditionally geared for profit-maximising organisations. Using data from the Australian credit union industry, we demonstrate that the cooperative philosophy and internal corporate governance structure of cooperatives will lead management to increase capital adequacy ratios through the application of accounting window dressing techniques. This is opposite to the intended purpose of template regulation aimed at efficiently increasing operating margins and lowering risk.
