David Miller’s defense of a state’s presumptive right to exclude non-refugee immigrants rests on two key distinctions. The first is that immigration controls are “preventative” and not “coercive.” In other words, when a state enforces its immigration policy it does not coerce noncitizens into doing something as much as it prevents them from doing a very specific thing (e.g., not entering or remaining within the state), while leaving other options open. Second, he makes a distinction between “denying” people their human (...) rights and “deterring” people from exercising their human rights. On this view, when those assigned to protect or fulfil human rights are also tasked with performing immigration enforcement duties, undocumented immigrants are not being denied their human rights, even when this deters them from exercising those rights. In this article, I argue that Miller’s two distinctions have an implication that he might not have foreseen. Specifically, I argue that these distinctions provide ideological cover for what has come to be known as “crimmigration” and that we have strong reasons for wanting our theory of immigration justice to reject this, even when doing so leaves open the possibility for an indirect open-borders argument. This essay argues that Latinx philosophers are not only already providing important and original contributions to standard open-borders debates, but also changing the very nature of the ethics of migration. In making this case, the essay is divided into two parts. The first summarizes some of the important and original contributions of Latinx philosophers to the standard open-borders debate. Among the highlights are Jorge M. Valadez’s “conditional legitimacy of states” argument; José-Antonio Orosco’s communitarian-based argument for a more liberalized (...) admissions policy; Javier S. Hidalgo’s claim that people have a moral right (and often an obligation) to disobey immigration laws; J. Angelo Corlett’s defense of immigration restrictions on grounds that such restrictions serve to protect Indigenous people’s sovereignty and rightful claims to territory; and Amy Reed-Sandoval’s freedom of movement argument based on the collective right of trans-border communities. The second section outlines four ways Latinx philosophers have pushed discussions within the ethics of migration beyond the standard open-borders debate. First, they have made persuasive arguments about why we ought to reject, or at least be suspicious of, approaches to migration justice that begin by assuming the legitimacy of states. Second, they argue that the issue of enforcement has been overlooked in standard open-borders debates. Third, they argue that philosophers must not avoid dealing with the social (as opposed to merely juridical) implications of labeling people “illegal” or “anchor babies.” Fourth, they show how current debates over the ethics of migration are too Euro- or Anglo-centric and therefore could benefit from the inclusion of non-European and non-Anglo voices. ABSTRACTThis paper argues that most prominent normative theories on immigration neglect a critical dimension of the migratory phenomenon, a neglect that blinds them to important rights that, under some circumstances, immigrants ought to have as a matter of justice. Specifically, the paper argues that these theories fail to appreciate that the children of immigrant families, regardless of whether they were born in their parents’ country or in the host country, should benefit from educational rights addressing needs that are particular to (...) their situation. These children may be forced to move between these two countries. This situation generates an obligation for both states to act jointly to provide educational opportunities so that these children are fully conversant with both cultures and in both languages. Put succinctly, then, we argue that since children of immigrant families lack any certainty of permanent residence in the host society owing to the threat of deportation and the precarity of their legal status, host and home societies bear the duty to offer an education that allows them to be functional in both societies. Medical migration appears to be an increasing global phenomenon, with complex contributing factors. Although it is acknowledged that such movements are inevitable, given the current globalized economy, the movement of health professionals from their country of training raises questions about equity of access and quality of care. Concerns arise if migration occurs from low- and middle-income countries to high-income countries. The actions of HICs receiving medical practitioners from LMICs are examined through the global justice theories of John Rawls (...) and Immanuel Kant. These theories were initially proposed by Pogge and Tan and, in this work, are extended to the issue of medical migration. Global justice theories propose that instead of looking at health needs and workforce issues within their national boundaries, HICs should be guided by principles of justice relevant to the needs of health systems on a global scale. Issues of individual justice are also considered within the framework of rights and social responsibilities of individual medical practitioners. Local and international policy changes are suggested based on both global justice theories and the ideals of individual justice. (shrink)

In the U.S., and elsewhere, populism has been democracy’s way of shaking elites up. We can view populism in part as a revolt of the losers, or perceived losers, of globalization. Yet elites have often paid too little heed to the domestic distributive impact of high immigration and globalized trade. Immigration and globalization are also spurring forms of nativism and demagoguery that threaten both democratic deliberation and undermine progressive political coalitions. The challenge now is to find the most reasonable – (...) or least unreasonable – responses to the new politics of resentment: ways that recognize that egalitarian liberalism and social democracy are national projects and preserve progressive political coalitions, while also acknowledging our interconnections, duties, and moral obligations to those beyond our borders. The contributors to this issue offer applied critical and normative perspectives on central, yet overlooked, ethical aspects of migration management with a certain cosmopolitan lance in some capacity. However, cosmopolitanism might mean different things for transnational migration. It can refer to “political cosmopolitanism” that provides the reasons for why there should be certain global institutions governing migration. It can also refer to “moral cosmopolitanism” that simply represents a moral concern for individual rights and interests first and foremost. (...) Cosmopolitanism can also work as a lens that is based on a scepticism towards using the nation-state as the ultimate unit or locus of analysis. These perspectives are not mutually exclusive, and the contributions in this special issue accommodate a form of cosmopolitan outlook or stance to some extent in their discussion on migration management practices. The topic of ethics and migration crises has two dimensions. First, there are questions in the ethics of representation. Media, pundits, and researchers frequently describe large-scale migration as a crisis with insufficient attention to the cogency of the crisis label or the ethical issues it raises. Second, migration crises give rise to duties not to deprive people of their rights to seek safety and asylum, to protect people deprived of their rights, and to aid migrants (...) in crisis situations. There are ways in which receiving countries are playing a role in causing migration crises through their foreign and economic policies and their attempts to restrict migration, and they instead have obligations to aid. In a recent paper, Mpofu, Sen Gupta, and Hays attempt to outline the obligations of recruiting high-income countries and would-be emigrant health workers to tackle the effects of mass exodus of health workers from underserved regions. They reconstruct Rawlsian and Kantian global justice approaches to argue for moral obligations of HICs and an individual justice approach to point to non-enforceable social responsibilities of HWs to assist their compatriots. This critical commentary demonstrates that the argumentation within their individual justice approach is (...) problematic on the basis of three reasons: their discussion under-theorizes and undervalues individual rights and more specifically the right to exit, their argumentation in the latter part, even if problematically, does rather point to moral obligations in lieu of social responsibilities of HWs, and they overlook many other important freedoms, interests, and values pertinent to the issue of retention. This book discusses the ethical dilemmas of migration in the era of globalization. Centered on the recent influx of large numbers of migrants and refugees to the United States and Europe and viewed through the lens of the 2016 World Humanitarian Summit and the United Nations Summit on Refugees and Migrants, this book focuses on the problems posed by globalized migration and analyzes proposed responses. Research Ethics, Volume 18, Issue 3, Page 226-240, July 2022. The ubiquitous use of social platforms across the globe makes them attractive options for investigating social phenomena including migration. However, the use of social media data raises several crucial ethical issues around the areas of informed consent, anonymity and profiling of individuals, which are particularly sensitive when looking at a population such as migrants, which is often considered as ‘vulnerable’. In this paper, we discuss how the opportunities and (...) challenges related to social media research in the context of migration impact on the development of large-scale scientific projects. Building on the EU-funded research project PERCEPTIONS, we explore the concrete challenges experienced in such projects regarding profiling, informed consent, bias, data sharing and ethical approval procedures, as well as the strategies used to mitigate them. We draw from lessons learned in this project to discuss implications and recommendations to researchers, funders and university ethics review panels. This paper contributes to the growing discussion on the ethical challenges associated with big social data research projects on migration by highlighting concrete aspects stakeholders should be looking for and questioning when involved in such large-scale scientific projects where collaboration, data sharing and transformation and practicalities are of importance. Racism, proposing ethnic inequalities, survives only because multiple acts of exclusion, inferiorisation and marginalisation are present daily, as well as attitudes that legitimate differences. These can be subtle attitudes and even denials. As long as racism is denied, there is no need for official measures against it, to combat discrimination or to develop moral campaigns.It is important to be able to make proposals for long term perspectives, for fair and humane immigration policies, for the recognition of the rights of immigrants (...) and ethnic minorities within multicultural societies.It will be important to examine the impact of the new European dimension and of the European integration on anti-racist policies and on the link between racism and nationalism.Let us worry about the philosophies of exclusion or the religious fanaticisms, which are feeding fear, aggressivity and hatred. This paper examines how alternative forms of organising integration in resource-scarce environments expand across settings, by considering the role of local embeddedness and an ethic of care in enabling this expansion. It builds on theories of imitation in organization studies in combination with theories of ethics of care and bricolage applied to welfare and migration studies. The paper is informed by the case of Yalla Trappan, a work cooperative of immigrant women in the city of Malmö, Sweden, and (...) the attempts to diffuse this organization and its methods to other cities in the country. The findings indicate that the expansion of alternative forms of integration into resource-scarce contexts is enabled by simultaneous practices of imitation and bricolage, ingrained in an ethic of care. The article shows, first, how many important practices were developed by imitating accounts of the original ideas, through a broadcasting mode of imitation. Next, it explains why the local translation of these practices in resource-scarce contexts, consisting of ‘bricolage work’ based on material, market, institutional, human, and cultural elements, was necessary. The conclusion is that the expansion of novel forms of integration requires imitation, but of a kind that involves the bricolage of local translations. Such bricolage is always collective (which does not diminish the importance of individual agency), multi-spatial and not just local, and wrapped in an ethic of care, rather than in an economic logic. The article concludes by discussing the implications of these findings with the ethics of migration. (shrink)

ABSTRACTThe search for universal ethics among journalists has yet to receive general acceptance because previous attempts have sought a code of ethics to which all journalists around the globe could agree. Yet, starting with the universal principle of caring for others leads to seeing the feminist approach to ethics, namely the ethics of care and feminist discursive ethics, as a partial approach toward a universal ethic for journalists. Building on the work of Gilligan, Steiner, Buzzanell (...) and others, we argue that such an approach would have universal appeal. The implications of this for the training of journalists include getting journalists to recognizie the universality of caring for others and apply the 6 steps toward ethical public discourse. The migration crisis in Europe in 2015 provides an example of how this could lead to more compassion in the coverage of those who are most vulnerable in modern societies. (shrink)

Recruiting nurses from other countries is a long-standing practice. In recent years many countries in the developed world have more frequently recruited nurses from the developing world, causing an imbalance in the health services in often already impoverished countries. Despite guidelines and promises by developed countries that the practice should cease, it has largely failed to do so. A consortium of authors from countries that have experienced significant nurse poaching consider the ethical aspects behind this continuing practice.

Drawing on a conception of people as ‘ecological subjects’, creatures situated in specific social relations, locations, and material environments, I want to emphasize the importance of place and place‐making for basing, demonstrating, and forging future solidarity. Solidarity, as I will define it here, involves reaching out through moral imagination and responsive action across social and/or geographic distance and asymmetry to assist other people who are vulnerable, and to advance justice. Contained in the practice of solidarity are two core ‘enacted commitments’, (...) first, to engaging our moral imaginations and recognizing others in need and, second, to responsive action. Recognizing the suffering of displacement and responding through place‐making should follow from even the most simplistic understanding of people as ‘implaced’. Recognition, furthermore, that places are created and sustained, transformed, or neglected in ways that foster or perpetuate inequities, including health inequities, generates responsibilities concerning place‐making. Place‐based interventions, on either count, should be principal and, indeed, prioritized ways of showing solidarity for the vulnerable and promoting justice. Where solidaristic relations do not prevail, place‐making can catalyze and nurture them, and over time advance justice. On the moral landscapes of bioethics, the terrain where care and health are or should be at the center of attention, an ethic of place and place‐making for those who have been displaced – patients, the elderly, urban populations, and asylum‐seekers, for instance – expresses and has rich potential for nurturing bonds of solidarity. This case study examines the ethical dimensions of isolation for patients diagnosed with tuberculosis in Australia. It seeks to explore the issues of resource allocation, liberty, and public safety for wider consideration and discussion.

In Justice for People on the Move, Gillian Brock develops a promising, original account of migration justice. In her view, states have a robust (though conditional) right to self-determination, which includes a reasonably strong right to regulate migration. However, in order for these rights to be justified, three legitimacy requirements must be met. Most obviously, states must respect the human rights of their own citizens and the international state system itself must be legitimate. This latter condition also requires (...) states to do their part in sustaining a justified state system, which includes helping to alleviate “legitimacy gaps,” including significant human rights violations in other states. Brock uses this framework to address several pressing migration-related policy issues, including Muslim bans, the deportation of unauthorized migrants, temporary labor migration, and refugee protection. However, one topic is notably absent from her analysis: climate-related displacement. Some theorists insist that climate change migrants should not be considered refugees because they do not fit the standard definition of a refugee. In particular, climate migrants were displaced by droughts, floods, storms, or sea level rise rather than by war or persecution, and many are able to remain in their homes at present but will be forced to relocate at some point in the future. This paper explores the implications of Brock’s theory of migration justice for climate migration. I suggest that although her approach to refugee protection may initially appear to exclude climate migrants, her understanding of right to self-determination yields strong obligations to assist them. I take this to be a strength of her framework, which makes an important, albeit indirect, contribution to current debates on climate change migration. (shrink)

Citizenship is no longer an exclusive relationship. Many people today are citizens of multiple countries, whether by birth, naturalization, or even through monetary means, with schemes fast-tracking citizenship applications from foreigners making large investments in the state. Moral problems surround each of those ways of acquiring a second citizenship, while retaining one's original citizenship. Multiple citizenship can also have morally problematic consequences for the coherence of collective decisions, for the constitution of the demos, and for global inequality. The phenomenon of (...) multiple citizenship and its ramifications remains understudied, despite its magnitude and political importance. In this innovative book, Ana Tanasoca explores these issues and shows how they could be avoided by unbundling the rights that currently come with citizenship and allocating them separately. Who is to be included in a political community and on what terms? William A. Barbieri Jr. seeks answers to these questions in this exploration of the controversial concept of citizenship rights—a concept directly related to the nature of democracy, equality, and cultural identity. Through an examination of the case of Germany’s settled “guestworkers” and their families, _Ethics of Citizenship_ investigates the pressing problem of political membership in a world marked by increased migration, rising nationalist sentiment, and the ongoing (...) reorganization of states through both peaceful and violent means. Although some of Germany’s foreign workers have gradually attained a degree of social and economic legitimacy, Barbieri explains how they remain effectively excluded from true German citizenship. Describing how this exclusion has occurred and assessing current attitudes toward political membership in Germany, he argues for a just and democratic policy toward the tax-paying, migrant worker minority, one that would combine the extension of the individual rights of citizenship with the establishment of certain group rights. Through a dissection of ongoing public “membership debates” over issues such as suffrage, dual citizenship, and immigration and refugee policy, Barbieri identifies a range of competing responses to the question of who “belongs” in Germany. After critiquing these views, he proposes an alternative ethic of membership rooted in an account of domination and human rights that seeks to balance individual and group rights within the context of a commitment to democracy and equal citizenship. Indispensable for scholars of German studies, _Ethics of Citizenship_ also raises questions that will attract moral philosophers, constitutional scholars, and those interested in the continuing, global problems associated with migration. Many ethical concerns surrounding human genetics studies remain unresolved. We report here the situation in Cameroon.Objectives: To describe the profile of human genetic studies that used Cameroonian DNA samples, with specific focus on i) the research centres that were involved, ii) authorship, iii) population studied, iv) research topics and v) ethics disclosure, with the aim of raising ethical issues that emerged from these studies.Method: Bibliometric Studies; we conducted a PubMed-based systematic review of all the studies on human genetics that (...) used Cameroonian DNA samples from 1989 to 2009.Results and Discussion: Fifty articles were identified, involving predominantly research centres from Europe (64%) and America (32%). Only 7 (14%) Cameroonian institutions and 14 (28%) Cameroonian authors were associated with these publications.At least 52% of publications were devoted to population genetics (variation/migration patterns) amongst 30 Cameroonian ethnic groups. Very few studies concerned public health related genetic issues and only 5 (10%) references were found for hemoglobinopathies like sickle cell anaemia. Almost all DNA samples are ‘banked’ outside of the African continent.Capacity building, rights to the genetic information and benefits to the individuals, communities and populations who contribute to these studies are addressed.Conclusions: 1) Our data suggests the need for a wider debate towards building capacity and addressing ethical issues related to human genomic research in sub-Saharan Africa and specifically in Cameroon; 2) National ethical guidelines and regulations concerning the collection, use and storage of human DNA are urgently needed in Cameroon. Although the notion of universal human rights allows for the idea that states (and supranational organizations such as the European Union) can, or even should, control and impose restrictions on migration, both notions clearly do not sit well together. The ensuing tension manifests itself in our ambivalent attitude towards migration, but also affects the border guards who have to implement national and supranational policies on migration. Little has been written on the ethics that has to guide (...) these border guards in their work. Juxtaposing the ethics of border guarding against the ethics of the somewhat related military profession, this article attempts to (a) describe border guarding as a comparatively rule-guided profession; (b) outline the aim and basis of the ethics education that prepares border guards for their work; and (c) propose a research agenda for the future that should further our understanding of (a) and (b), but also help us improve the moral education of border guards. International migration is increasing not only in absolute terms but also as a percentage of the global population. In 2019, international migrants made up 3.5 per cent of the global population, compared to 2.8 per cent in the year 2000. Over the past two decades, a philosophical literature has emerged to investigate what justice requires with respect to these vast migrant flows. My article criticizes much of this philosophical work. Building on the work of Charles Mills (2015), I argue (...) that the terms in which many Anglo-American philosophers presently debate migration justice neglect and even obscure consideration of the ways in which current migration flows may be shaped by Euro-American colonialism and neo-colonialism. Such exclusions produce systematic biases in much of our philosophical literature. To develop less biased understandings of migration justice, I propose that Anglo-American philosophers should revise our methods and our conceptual frameworks to enable exploring the possible extent and ethical implications of colonial and neo-colonial influence. This is one part of the much larger task of decolonizing our political philosophy. (shrink)

This article argues for reading the Algerian-French sociologist Abdelmalek Sayad (1933–1998) as a political theorist of migration. Various contributions have recently called to move away from the court-like assessment of claims by host states and foreigners and to engage more frankly with empirical work more attentive to concrete experiences and power relations. I contend that Sayad’s sociological work constitutes a substantial empirical and normative resource for ethical and political theory of migration, pointing to the persistence of ‘state thought’ (...) and presenting original normative perspectives on emigration, inclusion in democracy, naturalization or postcolonial relationships. Such a reading of Sayad from a political theory perspective would then constitute a prime example of the cross-fertilization of empirical and normative approaches. (shrink)

This article considers the question of the value and limits of the concept of discrimination for the ethics of migration by drawing attention to the need for a conceptualization of discrimination that can encompass forms of group-based disadvantage that are enabled and reproduced by the three central norms of our contemporary regime of global migration governance: the state’s right to unilateral control over its border regime, birthright citizenship and rights of (re)entry to one’s own state, and the (...) individual right to leave a state. I sketch an historical account of the forging and yoking together of these norms as bound up with the history of European imperialism and argue that they function to enable the reproduction of the advantage of states of the Global North. I illustrate this argument by reference to the example of the transnational migration of medical professionals from sub-Saharan Africa and argue that this may amount to structural discrimination against the human right to health of the populations of these states of emigration before considering two responses to this condition: ‘no recruitment’ and ‘no disadvantage’. In this essay I explore how travel and border-crossing for abortion care constitutes a challenge to methodological nationalism, which serves to obscure such experiences from view. Drawing up field research conducted at two abortion clinics in Albuquerque, New Mexico, I also explore some implications of regarding pregnant people who travel for abortion care as a type of migrant, even if they are U.S. citizens and legal residents. This book proposes a cosmopolitan ethics that calls for analyzing how economic and political structures limit opportunities for different groups, distinguished by gender, race, and class. The author explores the implications of criticisms from the social sciences of methodological nationalism for normative theories of mobility. These criticisms lend support to a cosmopolitan social science that rejects a principled distinction between international mobility and mobility within states and cities. Using the tools of normative political theory, this book explores the political relationship between exiles and the communities from which they have fled. It makes two central claims. First, exiles have rights and responsibilities in their homelands and are morally required and permitted to play particular roles in the homeland. Second, in playing these roles, exile politics can perform two corrective functions: it can repair defective political institutions at home and it can compensate for institutional shortcomings in the global domain. In short, exiles engage in a ‘politics from below’ and ‘away’ that produces alternative sites of power and can mitigate the several failings of an international system of states in an unequal world. This normative exploration of exile politics has a few implications. It counters an overwhelming focus, in both political philosophy and public discourse, on the consequences of forced migration for receiving societies—a focus that often treats exiles as passive actors. Recognizing the political agency of exiles reveals another side of the migration story, and allows for a more fulsome exploration of what political obligation and membership mean in an increasingly transnational world. Identifying exiles as important domestic and transnational actors also points to the ways third parties ought to enable the different roles exiles play in their communities of origin and in the international domain. And recognizing exile agency highlights the shortcomings of an international system of refugee protection that focuses on exiles’ humanitarian needs but denies them their political rights and agency. Methodological nationalism is the assumption that nation-states are the relevant units for analyzing social phenomena. Most of the social sciences recognized it as a source of bias, but not the ethics of immigration. Is this field biased by methodological nationalism—and if so, to what extent? This article takes nationalism as an implicit bias and provides a method to assess its depth. The method consists in comparing principles that ethicists commonly discuss when immigration is not at stake with principles advocated (...) in the ethics of immigration. To interpret the results, a distinction between mild and heavy bias is established. When a basic principle in ethics is underdiscussed or absent from the ethics of immigration, the field is ‘mildly biased’. When its negation is commonly advocated, the field is ‘heavily biased’. Here, the method is illustrated with two principles: equal opportunity and reparation. They are common in theories of distributive justice and of corrective justice, respectively. But in the ethics of immigration, scholars often argue for the opposite. Instead of equal opportunity, they implicitly support discrimination based on national origin; instead of sanctions or amnesty for the offenders, scholars plead amnesty for those who they otherwise regard as victims. These preliminary results suggest that the field is heavily biased: methodological nationalism seems to turn ethics into its opposite. (shrink)

When philosophers and political theorists turn their attention to migration, they often prioritize general normative commitments, giving only secondary concern to whether these commitments are reflected in policy. As a result, pressing issues affecting the status, rights, and life-chances of immigrants can get lost in abstract debates over the right of states to exclude individuals, or the rights of individuals to associate with whomever they like. Joseph Carens’s new book, The Ethics of Immigration, inverts this tendency by focusing (...) first on existing immigration control practices, examining their normative justifications, and then pushing them in the direction of justice. Sub-Saharan Africa like some other parts of the world is plagued by myriads of problems such as environmental degradation, climate change, illegal migration, human trafficking, terrorism, resources conflicts, bad and inept leadership, failing states, armed banditry, drug smuggling, youth restiveness, unemployment, etc. One of these problems, unemployment, has led to the devastation of many human lives and equally made some persons to live in degrading manner that affect environmental resources. Unemployment is not simply about statistics or numbers but about (...) actual human lives who are holders of rights and dignity. Unemployment can impede the exercise of human rights and prevent people from living meaningful lives. In spite of the region’s enormous natural resources and human capital unemployment remains drastically unabated. Why is this situation so? This situation is problematized here. Consequently, this paper critically and analytically examines this problem of unemployment in Sub-Saharan Africa in the light of an ethics of solidarity. The paper hermeneutically interprets the concepts involved in the study. The grave reasons for unemployment in the region will be examined with likely solutions. Besides these possible solutions, the paper sees the issue as also bordering on ethical realities. Many of the factors that causes employment borders on human behaviours and morality. There are ethical dimensions to the issue then. This is why the paper takes the vantage point of an ethics of solidarity to argue for an additional solution to the problem. This is equally the theoretical frame from which the problem of unemployment is examined. Living in solidarity makes individuals to easily collaborate and overcome societal problems like unemployment. The paper finds that unemployment is a pervasive problem in the sub-continent and is causing grave consequences for both human lives and the environment. The paper concludes that an ethics of solidarity can help in mitigating the problem of unemployment in the sub-continent. And that when this is done it will help to create a happier and peaceful sub-continent. (shrink)

Asylum is a contentious public and political issue and people seeking asylum are often targets of fear and hostility. This article presents an ethical challenge to churches aiming to support asylum seekers in the UK. Through an exploration of two contrasting strands in the biblical tradition relating to the ‘stranger’—one rooted in an ‘ecology of fear’ and another rooted in an ‘ecology of faith’—it argues that as well as practising positive encounters with newcomers, Christians need to understand and engage with (...) public hostility. Religious and Ethical Perspectives on Global Migration examines the complicated social ethics of migration in today's world. Editors Elizabeth W. Collier and Charles R. Strain bring the perspectives of an international group of scholars toward a theory of justice and ethical understanding for the nearly two hundred million migrants who have left their homes seeking asylum from political persecution, greater freedom and safety, economic opportunity, or reunion with family members.

International migration poses a dilemma for capitalist welfare states. This paper considers the ethical dimensions of that dilemma. It begins by addressing two questions associated with the provision of social rights for migrants: first, the extent to which differential forms of social citizenship may be associated with processes of civic stratification; second, the ambiguous nature of the economic, social and cultural rights components of the international human rights framework. It then proceeds to discuss, on the one hand, existing attempts (...) to classify or taxonomise different kinds of immigration/incorporation and welfare regime and, on the other, the different ways in which migrants may be socially constructed. Building on this analysis the paper develops an alternative taxonomy that is concerned with the different ethical premises from which the social rights of migrants may be constructed or justified. Heyer WASHINGTON, DC: GEORGETOWN UNIVERSITY PRESS, 2012. 198 PP. $29.95Heyer renders an important service to the discipline, which has not seen a book-length account of a Christian immigration ethic since Dana Wilbanks’s Recreating America (1996). In Kinship across Borders, Heyer provides a nuanced and comprehensive (...) theological ethical analysis of undocumented immigration and argues that “a Christian immigration ethic calls believers to promote structures and practices marked by kinship and justice” (4). To that end, she advances four distinct theses in as many chapters—interpretations of personhood, sin, family, and solidarity—each appropriating a specific resource from the Christian tradition in order to reorient immigration policies from a “paradigm centered on national interest, expediency, or economic efficiency” to one that is person centered (4). Her project challenges American Christians to reckon with their responsibility in advancing structures and furthering ideologies that sustain forced migrations, including economic refugees, in the Western Hemisphere.Chapter 1 relies on Margaret Farley’s “obligating features of person-hood”—namely, autonomy and relationality—to identify the prevailing immigration paradigm, which views immigrants as economic commodities, security threats, and/or foreigners to be assimilated (21). This paradigm reflects internalized ideologies and a series of external structures that weaken the personal agency of immigrants who, in significant ways, “are unable to [End Page 194] determine the direction their lives will take” (22). Chapter 2 turns to Catholic social encyclicals and liberation theology to develop a dialectical interpretation of personal and social sin. Heyer posits that though persons are responsible for their actions, they “remain subject to external [structural] influences” that limit the ways in which they may exercise their agency (46). She uses this idea not to accuse undocumented immigrants but rather to highlight the sinful ideological blinders that often limit American Christians’ capacity to act hospitably towards them. “Given the relationship between the United States and sending countries in geographic, economic, and political terms,” she writes, “US citizens may be willfully negligent of or indirectly responsible for the conditions that give rise to undocumented migration across their borders” (46).Chapters 3 and 4 provide robust accounts of cross-border kinship in the context of the family and globalization, with their rich visions of human relationships that break open the prevailing immigration paradigm. For example, though familismo among Latin American immigrants may lend itself to restrict women’s personal agency, it nevertheless offers an “extensive and malleable understanding of kinship networks, … [with] boundaries among members that remain fluid and transcend genetics,” thus broadening the relationships within which to flourish (82). To address global kinship, Heyer develops an account of institutional, incarnational, and conflictual solidarity that breaks free from the tendency to frame the immigration debate in the United States as a purely domestic issue that lacks meaningful global implications. Chapter 5 concludes the book by identifying implications for reorienting immigration policy and rhetoric as well as Christian ethics so that they better account for the immigrant experience by developing the necessary resources, including a more robust understanding of moral agency in the midst of marginalization.The argument is strongest in chapters 2 and 3, which develop a crisp critical analysis of the sources and insightful interpretations of often overlooked ones, including immigrants’ experiences. Furthermore, Heyer adeptly engages multiple US Hispanic theologians and Christian ethicists in ways that sharpen her argument throughout. The argument is weakest in chapter 5 because it does not fully integrate earlier insights on cross-border familial and global kinship while accounting for civic kinship.
