Research into moral decision-making has been dominated by sacrificial dilemmas where, in order to save several lives, it is necessary to sacrifice the life of another person. It is widely assumed that these dilemmas draw a sharp contrast between utilitarian and deontological approaches to morality, and thereby enable us to study the psychological and neural basis of utilitarian judgment. However, it has been previously shown that some sacrificial dilemmas fail to present a genuine contrast between utilitarian and deontological (...) options. Here, I raise deeper problems for this research paradigm. Even when sacrificial dilemmas present a contrast between utilitarian and deontological options at a philosophical level, it is misleading to interpret the responses of ordinary folk in these terms. What is currently classified as “utilitarian judgment” does not in fact share essential features of a genuine utilitarian outlook, and is better explained in terms of commonsensical moral notions. When subjects deliberate about such dilemmas, they are not deciding between opposing utilitarian and deontological solutions, but engaging in a richer process of weighing opposing moral reasons. Sacrificial dilemmas therefore tell us little about utilitarian decision-making. An alternative approach to studying proto-utilitarian tendencies in everyday moral thinking is proposed. (shrink)

Structural equation model trees are data-driven tools for finding variables that predict group differences in SEM parameters. SEM trees build upon the decision tree paradigm by growing tree structures that divide a data set recursively into homogeneous subsets. In past research, SEM trees have been estimated predominantly with the R package semtree. The original algorithm in the semtree package selects split variables among covariates by calculating a likelihood ratio for each possible split of each covariate. Obtaining these likelihood ratios (...) is computationally demanding. As a remedy, we propose to guide the construction of SEM trees by a family of score-based tests that have recently been popularized in psychometrics. These score-based tests monitor fluctuations in case-wise derivatives of the likelihood function to detect parameter differences between groups. Compared to the likelihood-ratio approach, score-based tests are computationally efficient because they do not require refitting the model for every possible split. In this paper, we introduce score-guided SEM trees, implement them in semtree, and evaluate their performance by means of a Monte Carlo simulation. (shrink)

Or when is something so new and innovative that it can (...) no longer bear its original label? Either case signifies a level of discontinuity or rupture with the old ways of doing things. This is the fate of modern Islamic theology, which goes by the name kalām jadīd, New Theology.The discipline of Islamic philosophical or dialectical theology, ʿilm al-kalām, acquired its distinct methodology and themes in the first two centuries of Islam, becoming the defining intellectual voice of the Islamic worldview. Responding both to the developed theologies of Christianity and Zoroastrianism and other religions and philosophies, as well as responding to inner theological disputes, it combined comparative theology, philosophy of religion, and dogmatics. It developed its own indigenous rationalism, and integrated and adapted other philosophical ideas and methods, especially those of Aristotle and Neoplatonism. Islamicate civilization generated many native philosophers, like al-Kindī (d. 873) and al-Fārābī (d. 951), but it was Ibn Sīnā (Latin: Avicenna, d. 1037) who literally overturned metaphysical thought in such a radical way that theologians, including Jewish and Christian, speak of theology as before and after his influence.During the 750 years after the "Avicennian turn" many new philosophies have arisen, but none challenged the metaphysics of the Abrahamic theologies as much as Kant. Kalām can, similar to Christian Neo-Scholasticism, ignore the Kantian turn by restating their confidence in Peripatetic and Avicennian/Thomistic metaphysics, or it can integrate and adapt to it. The Muslim voices that have tried the latter are few but they have garnered more attention over the years. One of the biggest challenges of Kantian thought are towards retaining the classical proofs of God's existence, but also the possibility of speaking meaningfully of any type of metaphysical existence apart from empirical experience. The Ottoman theologian Muṣtafā Ṣabrī (d. 1954) emphasized that the Islamic ideas of prophethood and the unseen spiritual realm (ʿālam al-ghayb) would not fit the minimalistic metaphysics of Kant, as many Muslim modernists started to reject the idea of miracles, angels, and life after death. [End Page 1]Kalām jadīd, or (post-)Kantian kalām, has therefore the interesting challenge to either reconfigure Kantian metaphysics so that it can sustain traditional Islamic ideas to a certain degree, or the other way around. This challenge is not new as, although Peripatetic and Avicennian metaphysics provided the basis for proofs of God's existence, it also problematized Abrahamic theism, prophethood and resurrection of the body. This gives it a reasoning and stability which can be passed on over the centuries through certain core ideas and texts. Harvey sees this as the main problem explaining "why the kalām jadīd movement has been underwhelming." The Kantian turn upends the post-Avicennian foundationalism of kalam, forcing it to become an "open theology" that is "characterised by a receptiveness to diverse sources in its theological structure, prioritising meaning above systematic, foundationalist proof" (p. 5). The challenges for which a new theology has to be constructed are, according to Harvey, the developments in mathematics, logic, analytical philosophy, the phenomenological movement, and quantum mechanics (p. 2). In this dissertation I develop a general theory of coercion that allows one to distinguish cases of interpersonal coercion from cases of persuasion or manipulation, and cases of institutional coercion from cases of oppression. The general theory of coercion that I develop includes as one component a theory of second-order coercion. Second-order coercion takes place whenever one person intentionally impairs the formation of the second-order desires of another person, or constrains them after their formation, in a way that frustrates or (...) eliminates the possibility of the victim fulfilling certain of his or her first-order desires. The concept of second-order coercion is important because it suggests that a person's autonomy may be violated in ways that have not been previously recognized. In this dissertation I argue that the unique feature of all cases of coercion is that the alternatives available to the victim, with regard to the formation of his or her will, are intentionally constrained by another person in a way that violates the victim's autonomy. A general theory of coercion should be able to explain how institutions may be understood as coercive. I argue that if institutions are understood as social practices maintained for the purpose of achieving some end, then they may be properly understood as capable of coercion. ;This theory of coercion allows me to make two arguments concerning moral responsibility. First, I argue that current discussions of moral responsibility are inadequate because they fail to take seriously the claim that a person may be responsible, at least in part, for having the beliefs and desires that make a particular action a case of coercion. Second, I argue that discussions of moral responsibility are inadequate because they fail to recognize that an agent may not be responsible for the state of his or her will because he or she may have been coerced in a way that has not been previously recognized. This conceptual article draws on structuration theory and social identity theory to isolate firm-internal institutionalization processes as antecedents and drivers of corporate political strategizing. Path dependencies in corporate routines and actors' knowledgeability about these path dependencies are singled out as primary factors structuring strategic decision making within the firm. The concepts of path dependency and knowledgeability, respectively, refer to the institutional and cognitive dimension of corporate political strategizing. These two dimensions come together in actors' identities. Identities on their turn shape (...) managers' recognition of policy issues and the interpretation of issue salience relative to corporate interests. Thus, the article argues that institutional features of competitive environments precipitate in processes of identity building and preference formation and are reproduced through organizational routines and practices within the firm. Definitions I presented in a previous article as part of a semantic approach in epistemology assumed that the concept of derivability from standard logic held across all mathematical and scientific disciplines. The present article argues that this assumption is not true for quantum mechanics (QM) by showing that concepts of validity applicable to proofs in mathematics and in classical mechanics are inapplicable to proofs in QM. Because semantic epistemology must include this important theory, revision is necessary. The one I propose (...) also extends semantic epistemology beyond the ‘hard’ sciences. This article argues that because racial inequalities are embedded in American society, as well as in medicine, more evidence-based investigation of the effects and implications of affirmative action is needed. Residency training programs should also seek ways to recruit medical students from underrepresented groups and to create effective mentorship programs.

Kant's "perpetual peace" remains an utopia even today in the sense that the described perpetual world peace is still a long way to go from today's state of world politics. But Kant also tried to show that the utopian scenario is possible under realistic assumptions. Therefore this essay examines the question, if Kant's basic assumptions - such as for example the assumption that democracies are generally non aggressive (...) - are still valid in the light of the political experiences of the two centuries that have elapsed since the publication of the "perpetual peace" and how the realisation of Kant's utopia can best be promoted in today's situation. For thousands of years people have saved their loudest praise for individuals who made ?the ultimate sacrifice.' Recently, however, many people have begun to equate suicide terrorism with sacrificial heroism. These assertions benefit from a general lack of conceptual clarity regarding the nature of sacrificial heroism itself. Therefore, this paper aims to explore, describe, and define sacrificial heroism, arguing that it requires two primary things: the risk of something highly valued; and the attempt to achieve a directly (...) morally positive result. The paper then reviews four representative scenarios, including two types of suicide terrorism and two types of sacrificial heroism, in order to highlight several critical differences between those actions that deserve to be praised as supremely heroic and those which clearly do not. Therefore, the purpose of the article is to analyze the underlying political philosophy of Immanuel Kant's third Critique in the context of the aesthetic theories of his time. For more than sixty years, surgeons have used bioethical strategies to promote patient self‐determination, many of these now collectively described as “informed consent.” Yet the core framework—understanding, risks, benefits, and alternatives—fails to support patients in deliberation about treatment. We find that surgeons translate this framework into an overly complicated technical explanation of disease and treatment and an overly simplified narrative that surgery will “fix” the problem. They omit critical information about the goals and downsides of surgery and present untenable options (...) as a matter of patient choice. We propose a novel framework called “better conversations.” Herein, surgeons provide context about clinical norms, establish the goals of surgery, and comprehensively delineate the downsides of surgery to generate a deliberative space for patients to consider whether surgery is right for them. This paradigm shift meets the standards for informed consent, supports deliberation, and allows patients to anticipate and prepare for the experience of treatment. (shrink)

Susan Wolf argues that meaning arises when subjective attraction meets objective attractiveness. Whereas we can agree with her claim that the conception of meaning invokes an objective standard, we think it is questionable whether a radically subjective fulfillment is a real possibility. Several reasons are provided why this cannot be the case.

Environmental aesthetics has become a matter of concern to many different groups in recent years—to conservationists, to legislators, reluctantly to industrialists, and indeed to the public at large. This interest seems to have a clear purpose. It is regarded as an effort, belated and desperate, to save the resources and beauties of our natural world from the possibility of complete and irrecoverable exploitation, and from the disfigurement and loss that must follow. It is an attempt to change the atmosphere from (...) a toxic medium that is often impossible to escape back to one that is fresh and invigorating. An argument structure that covers both cases Gettier described in his 1963 paper reinforces the conclusion of my 2012 Logos & Episteme article that the justified true belief (JTB) conception of knowledge is inconsistent. The stronger argument makes possible identification of fundamental flaws in the standard approach of adding a fourth condition to JTB, so that a new kind of skepticism becomes inevitable unless conceptual change occurs.

This essay uses the seminal figure of Jawaharlal Nehru to interrogate the nature and representation of science in modern India. The problem posed by Nehruvian science—the conflict between science as both universal phenomenon and local effect—lies at the heart of current debates about what science means for the non-West. The problematic of Nehruvian science can be accessed through Nehru's own speeches and writings, but also through the wider project of science with which he identified—critiquing colonialism, forging India's place in the (...) modern world, marrying intellectual endeavor with practical nation building. The essay makes a case for looking at Nehruvian science as a way of structuring the problem of postcolonial science, particularly in relation to understanding the authority of science and its evaluation in terms of its capacity to deliver socioeconomic change. Body-related aspects are reflected in the alphabet in two different ways. On the one hand, features of the body are depicted in the early pictographs and ideographs. On the other hand, the structure of the human body determines the use of signs, with regard to both the perception and the production of signs. A perspective of information theory is outlined, and on this basis the origin and history of the Latin alphabet is discussed.

Objective: Even when critically ill patients are almost certain to die from their illnesses, there is generally an element of prognostic uncertainty. Little is known about how physicians handle this uncertainty in conversations with surrogate decision makers. We sought to evaluate whether and how physicians discuss prognostic uncertainty with surrogate decision makers of patients who are highly likely, but not certain, to die. Design: We audiotaped and transcribed discussions between clinicians and surrogate decision makers at two major California teaching hospitals (...) from 2006 through 2008. Physicians completed a questionnaire addressing their prognostic estimates for patients' survival to hospital discharge. Participants: We included physicians and surrogates of 12 incapacitated, critically ill patients. Measurements: We analyzed transcripts of discussions in which physicians' estimates of patients' chances of hospital survival were 1% to 5%; we coded whether physicians disclosed the prognostic uncertainty and, if so, how they conveyed that death was highly likely but not certain. Results: Physicians' estimates of short-term survival were 1% to 5% for 12 of the 70 patients enrolled in the original study. In 8 of 12 cases, physicians conveyed prognostic uncertainty by using probabilistic language or by an explicit mention of uncertainty. In four cases, physicians made at least one statement that either implied or was ambiguous about whether death was certain. Conclusion: We observed variability in how physicians handle prognostic uncertainty in their discussions with surrogates of patients who are highly likely, but not certain, to die, including some circumstances in which physicians stated or implied that death was certain. English summary: Arnold presents the first systematic study of the early biblical and exegetical writings from Schelling's schooldays and years of study in Tubingen (1787-1795) and puts them in the context of the complex history of problems in the late Enlightenment. Apart from the general challenge of theology due to Kant's reception, debates on basic principles regarding authenticity and and the Bible's claim to divine authority had begun. Arnold shows that Schelling studied these controversies very closely and developed (...) them into his own hermeneutic methodology. Schelling's theory of interpreting the Scriptures, of the Christian religion and of the concept of faith, developed as a result of these studies, is also significant for understanding his later works on the history of philosophy and moral philosophy. 현대 사회는 탈진실의 시대라고 할 수 있다. 탈진실 현상은 올바르고 참된 진실을 추구하기보다는, 자신의 느낌과 감정을 더욱 중요하게 여기는 현상이라 할 수 있다. 즉, 우리는 누군가가 아무리 진실에 대해 과학적-객관적으로 해명한다고 하더라도, 자신이 지지하는 정치적 진영의 입장과 일치하지 않거나, 자신의 느낌과 감정에 반할 경우, 혹은 자신의 신념이나 이념과 상충할 경우, 얼마든지 진실을 외면할 준비가 되어 있는 시대를 살아가고 있다. 그렇다면 이러한 탈진실의 문제를 어떻게 해결할 수 있을 것인가? 탈진실 연구자들은 이에 대해 저널리즘 정신의 회복, 디지털 리터러시 교육 등 여러 가지 (...) 대안들을 제시한다. 그러나 이러한 대안들이 가능하기 위해서는 “비판적 사고의 회복”이 절실히 요구된다. 그러나 비판적 사고를 추구하는 일은 그 누구보다도 철학이 가장 잘 수행할 수 있는 영역이 아닌가? 따라서 이 글에서는 탈진실 문제와 그 극복가능성을 칸트철학의 관점에서 제시하고자 한다.BR 먼저 2장에서는 탈진실 문제가 제시되는 배경과 맥락을 추적할 것이다. 이어서 3장에서는 칸트의 「계몽이란 무엇인가?」를 중심으로 칸트의 계몽철학의 의미를 살펴볼 것이다. 왜냐하면 칸트의 계몽철학은 지성을 자유롭게 사용할 용기를 가지는 태도, 더 나아가 이성의 공적 사용을 강조함으로써 탈진실 문제의 극복가능성을 제시해 주기 때문이다. 마지막으로 4장에서는 칸트의『종교론』에서 제시된 근본악 이론을 살펴볼 것이다. 왜냐하면 근본악 이론은, 탈진실 문제의 근본적인 원인으로 지적되는 인지 편향의 문제와 직접적으로 연결되기 때문이다. 따라서 우리는 칸트가 근본악의 문제를 해결하는 이른바 “희망의 방식”을 통해, 인간에게 근절 불가능한 인지 편향으로 인해 비롯되는 탈진실 문제를 해결할 수 있는 가능성을 유비적으로 추론하며 반성해볼 수 있을 것이다. One of Noam Chomsky's earliest contributions is the idea that a theory of the unbounded construction of hierarchical structures should incorporate a computational system that generates the structures. This chapter focuses on the structure building system, what is sometimes called the computational system, as a source of explanation. In some sense it is the fundamental source of explanation in generative grammar, as it accounts for the central question of the unbounded hierarchical nature of the syntax of human language. This book continues the classical Newtonian theory in both its initial spirit and the spirit of general relativity. It throws a bridge between classical Newtonian theory of forces and some contemporary concepts of the atomic, nuclear and particle theories. This book takes the Skyrme theory of nuclear matter mainly from the point of view that it allows the initial analogy between the atomic edifice and the solar system in all details. Especially important is the detail that the atomic nucleus works (...) exactly like the Sun, and they can be described in the same way. Based on this unitary description, the authors go further on, in showing that the Skyrme theory is the only theory naturally suited for the explanation of structure of nuclear matter. Thus it should be actually a classical theory, inasmuch as it simply carries over into microcosmos the very Newtonian theory of forces extracted from the planetary Keplerian synthesis of celestial motions. By this the problem of structure of the nucleus becomes actually a problem of classical physics. (shrink)

The matching law accounts for both addictive behavior and the usefulness of a person's evaluating choices in overall categories. To explain why overall bookkeeping, once learned, does not easily win out over local bookkeeping, another implication of matching is needed: intertemporal bargaining. The role of melioration, though probably important for new addiction is separate.

道敎의 內丹理論을 집성한 인물을 꼽으면, 단연 張伯端일 것이다. 그는 {悟眞篇}과 {靑華秘文} 및 {金丹四百字} 등 3편의 저술을 남긴 것으로 알려져 있으며, 연구자들은 이것을 토대로 연구를 진행하고 있다. 그러나 과연 이 모두가 그의 저술인지에 대해서는 의문을 가지고 있으면서도 정확한 분석을 가하지 않은 채로 잠정적으로 인정하고 있거나, 단순하게 믿고 있는 정도일 뿐이다. 철학적 태도에서 정확성과 엄밀성은 필수적이다. 일차적 자료에 대한 철저한 검증이 없는 연구는 그야말로 사상누각에 불과하다. 본고에서는 도교 내단사상의 연구에 있어 가장 큰 비중을 차지한다고 할 수 있는 장백단의 저술에 대한 치밀한 분석을 (...) 가하여, 앞으로 그에 대한 철학적 분석의 명백한 기초를 확립하려는데 목적이 있다. 장백단은 80세가 넘은 나이에 도를 얻고서 아주 늦은 나이에 그 秘訣을 기록으로 남기고 제자에게 丹法을 전하였다. 그리고 그는 살아서가 아니라 죽은 다음 일정한 세월이 지난 후에 위상이 높아졌다. 내단도교에서 중요한 비중을 갖게 된 그의 위치로 인하여 그의 저술에 대한 관심이 고조되었고, 따라서 그의 이름에 의탁한 책들이 유포되었다고 보인다. 본 연구에서는 眞僞에 대해서 확정하지 못하고 있는 장백단의 저술에 대해서, ‘悟眞篇’에 「自序」⋅「七言四韻 16首」⋅「七言絶句 64首」⋅「五言律詩 1首」⋅「西江月 12首」 및 「後序」를 배당하고, ‘悟眞外篇’을 {悟眞篇拾遺}라고 하여 「禪宗歌頌詩曲雜言 32首」를 넣어야 할 것으로 판단하였다. 그리고 ‘悟眞篇 外’라고 하여 {金丹四百字}와 {靑華秘文}, 그리고 「西江月」 1수와 七言絶句 5首, 「讀周易參同契」⋅「贈白龍洞劉道人歌」⋅「石橋歌」를 포함시키면 적절하다고 보았다. 그리고 몇 가지의 論據를 제시하여 {금단사백자}나 {청화비문}은 장백단의 저술일 가능성이 매우 희박하여 후인들의 僞作일 것이라는 사실을 논증하였다. George Berkeley is, with John Locke and David Hume, one of the three major figures in the British empiricist school of philosophy. He has been the centre of much attention recently and his philosophical profile has gradually changed. In the 20th century he was almost exclusively known for his denial of the existence of matter, but today it is no longer reasonable to confine an account of Berkeley to the challenging philosophical inventions that he published when he was a young (...) fellow at Trinity College in Dublin. This is a welcome trend. It shows Berkeley as a contributor not only to epistemology, metaphysics and moral and social philosophy, but also to a wide range of subjects including mathematics, philosophy of science, empirical psychology, political economy and monetary policy. The present collection aims at meeting this new trend by presenting a broad and comprehensive picture of Berkeley's works in their historical context. The contributors are some of the finest international experts in the field. The editors hope that this collection will show George Berkeley as he was: a wide-ranging, widely influential and courageous philosophical innovator. In April 2018, Japan’s first law regulating clinical research went into effect. The law aimed to strengthen regulations on research integrity and conflicts of interest, which had been limited under existing administrative guidelines; the law also provided stipulations for legal penalties. The scope of the new regulations, however, is limited entirely to studies that evaluate unapproved drugs or the off-label use of approved drugs, and those that receive funding from companies. On the other hand, the law’s application brings numerous complications, (...) including the establishment of new review committees, troublesome procedures for transitioning studies that are currently underway, and ambiguities about the scope of what constitutes best efforts. Thus, the change has led to substantial strain and confusion in the field. This paper offers an overview of the law and its background, and discusses its future prospects from the practical standpoint of managing ethics committees and providing research ethics support in the field. One of the central figures of philosophy of language- John Langshaw Austin, attributes principles of causation to the mere pragmatic language. Conversely, Kant tried to construct a “free human act” which is independent from any physical determination except its innate motivations via his well-known the phenomenal / noumenal distinction. That kind of Kantian metaphysical ground which addresses to the noumenal field, he obviously tries to establish this behavioral causation again by denying Austinian style pragmatic propositions or illocutionary acts. I claimed (...) that sort of duality between Austin and Kant, creates an epistemological problem with how propositions and actions relate. From a Kantian position, it (indetermination) is overlooked by Austin's propositional doctrine, without being grounded on any universal principle, but only with propositions that embraced by speech act theory. Jean-Luc Nancy takes the concept of "essence" in order to indicate its drawbacks on the singularity of being. The concept of essence is not a universal and necessary origin, but contingent and historical meanings for Nancy. This historicity in meaning leads Nancy to question the concept of the individual and the rules of the social/public sphere allocated through individuality. Nancy's argument on the ontological environment of finite beings aims to highlight those beings are mixed singular, not belonging to a universal (...) unit. This allows us to discover that being is singular and also singular-plural to the extent that it is with the other. Thus, essential historical concepts invalidate individual or social organizations at this point. Nancy calls this “finitude” which is the only transcendental concept that makes possible the “being with” (Mitsein). It is possible to think that finitude is the only property to make a community of singularities rather than ready-made concepts of social sciences. I argue that this position is methodological for an alternative socio-ontology. (shrink)

The French existentialist philosopher, Simone de Beauvoir, long ago signalled the potentially empowering force of outdoor exercise and recreation for women, drawing on feminist phenomenological perspectives. Feminist phenomenological research in sport and exercise, however, remains relatively scarce, and this article contributes to a small, developing research corpus by employing a feminist phenomenological theoretical framework to analyse lived experiences of running in ‘public’ space. As feminist theorists have argued, such space is gendered and contested, and women’s mobility remains constrained by fears (...) of harassment and violent attack. Running also generates intense pleasure, however, and embodied empowerment. Drawing on findings from two separate but linked automethodological running research projects, here I explore salient and overlapping themes cohering around lived experience of pleasure and danger in both urban and rural spaces. Rorty occasionally invokes “hermeneutics” as a term for his philosophical point of view, either explaining pragmatism in terms of hermeneutics or vice versa. However, compared to hermeneutical thinkers like Gadamer or Vattimo, this pragmatic hermeneutics is far more pragmatic than it is hermeneutic, and eventually Rorty drops the effort to enlist hermeneutics among the allies and avatars of pragmatism. What is at stake in the confrontation between pragmatism and hermeneutics is nothing other than the point and value of philosophy. Hermeneutical (...) ontology may be post-metaphysical but is it probably not post-philosophical in the sense that Rorty anticipates for his new pragmatism. -/- . (shrink)

Averroes, considered to be the greatest Aristotelian commentator in the Middle Ages, has written three different types of commentary on almost all the works of this great philosopher: short, middle and long. These commentaries have been translated into Latin and Hebrew in the early period, and profoundly influenced both Medieval Europe and Jewish thought for centuries. The effect of Averroes in the West was to spread the whole of Europe under the name of Latin Averroism. This paper articulates an egalitarian conception of judicial humility and justifies its value on the grounds that it importantly advances the legal and political ideal of fraternity. This account of the content and value of the virtue of humility stands in sharp contrast with the dominant view of judicial humility as deference or judicial restraint. The paper concludes by discussing some ways in which the account of humility and of its value provided in the paper furthers our understanding of the (...) judicial virtues and of the political implications of giving virtue a role in adjudication.
