There is a growing need to identify what really can converge classroom learning to the real-life practising of ethical principles. We examine if the effectiveness of ethics education can be improved through meditation-based mindfulness intervention. Our baseline experiment is a procedurally modified version of the anagram exercise (Ruedy and Schweitzer 2010) for measuring unethical behaviour. We introduce a brief meditation intervention to induce instant mindfulness. Our findings indicate substantive evidence confirming the positive effect of the state of mindfulness on ethical (...) behaviour. Subjects in the meditation group engage in more low-level cheating compared to the control group who cheated more severely. Gender and academic grade do not influence ethical behaviour. Mindfulness fosters composure, mental poise, and a conducive environment for upholding ethical values, as indicated by a lower incidence of cheating in our study. We propose to promote a learning environment with mindfulness intervention in educational programmes. (shrink)

Moral decision procedures such as principlism or casuistry require intuition at certain junctures, as when a principle seems indeterminate, or principles conflict, or we wonder which paradigm case is most relevantly similar to the instant case. However, intuitions are widely thought to lack epistemic justification, and many ethicists urge that such decision procedures dispense with intuition in favor of forms of reasoning that provide discursive justification. I argue that discursive justification does not eliminate or minimize the need for intuition, or (...) constrain our intuitions. However, this is not a problem, for intuitions can be justified in easy or obvious cases, and decision procedures should be understood as heuristic devices for reaching judgments about harder cases that approximate the justified intuitions we would have about cases under ideal conditions, where hard cases become easy. Similarly, the forms of reasoning which provide discursive justification help decision procedures perform this heuristic function not by avoiding intuition, but by making such heuristics more accurate. Nonetheless, it is possible to demand too much justification; many clinical ethicists lack the time and philosophical training to reach the more elaborate levels of discursive justification. We should keep moral decision procedures simple and user-friendly so that they will provide what justification can be achieved under clinical conditions, rather than trying to maximize our epistemic justification out of an overstated concern about intuition. This chapter examines some issues concerning the structure of time. It considers arguments for and against Temporal Finitism. Temporal Discretism is a kind of Finitism: any finitely extended interval is made up of only finitely many indivisible units of time. In the chapter, the authors assume for the sake of argument that Intervalism is true, that is, that some temporally extended intervals and processes are among the world's fundamental entities. The main argument for Intervalism is that it follows from the (...) metaphysical impossibility of certain infinitary scenarios involving super‐tasks. Strong Intervalism denies that instants are fundamental, while Moderate Intervalism, or Interval‐Boundary Dualism, embraces the fundamentality of both instants and intervals. Infinitary Intervalism is relative to the three competing theories of Aristotelian Temporal Finitism, Temporal Discretism, and Instantism. In the chapter, the authors also assume that all Intervalists are either Discretists or Aristotelian Finitists, and that all Instantists are Temporal Infinitists. (shrink)

The claim that the human cognitive system tends to allocate resources to the processing of available inputs according to their expected relevance is at the basis of relevance theory. The main thesis of this chapter is that this allocation can be achieved without computing expected relevance. When an input meets the input condition of a given modular procedure, it gives this procedure some initial level of activation. Input-activated procedures are in competition for the energy resources that would allow them to (...) follow their full course. What determines which of the procedures in competition get sufficient resources to trigger their full operation is the dynamics of their activation. This dynamics depend both on the prior degree of mobilisation of a modular procedure and on the activation that propagates from other active modules. It is quite conceivable also that the mobilisation of some procedures has inhibitory effects on some others. The relevance-theoretic claim is that, at every instant, this dynamics of activation provides rough physiological indicators of expected relevance. The flow of energy in the system is locally regulated by these indicators. As a result, those input-procedure combinations that have the greatest expected relevance are the more likely ones to receive sufficient energy to follow their course. (shrink)

Her notion of the proxy, which raises questions too about the binding force of the speech act through the identity and tactics of the speaker, is especially apt in describing exactly what Rosalind does. Understandably Rosalind's performative manqué may be a prelude to the perfected form. Another complication suggests itself if one is going to attend to niceties of language usage: given that for Austin a performative procedure is founded on conventions of language, shouldn't one also examine such linguistic forms historically? Reading is unreasonable. If, as Theodor Adorno has contended, to write poetry after Auschwitz is barbaric, then surely reading—whether (...) of poetry, philosophy, or newsprint—is doubly obscene ["Cultural Criticism" 34]. For Adorno, such barbarism means inattentiveness to barbaric historical truths; it is the misuse of rhetorical reflexivity for the perpetuation, rather than the critique, of social conditions. In other words: to write poetry after Auschwitz is to reproduce, and thereby implicitly condone, a contradictory society within which lyric verse and mass murder are coexistent. By extension, reading—as a pastime within the culture industry—appears to achieve nothing but the expression of such cultural reification. The success of Aristotle’s logic was due to the simple substantial ontology built by him. In that logic, the subject is characterized by an instant set of properties. The change of objects leads to the change of properties. The reduction of processes to substances causes a number of problems. The construction of procedural logic should be started with the construction of (...) the most abstract procedural ontology. The main difference of processes from substances is their extension. Each item, as a process, can be considered as a bundle of parallel processes. The relation the individual S has the property P is the main relation in the substantial ontology. In the procedural ontology, one of the main ones is the relation process R is a sub-process of the process Q. This relation is sufficient for the interpretation of the main syllogistic constants. As a result, we get Łukasiewicz syllogistic for reasoning about parallel processes. The extension of the processes allows us to talk about their parts. The second main relation of procedural ontology is the relation process P consists of two successive processes Q and R. If the processes Q and R are successive, it is natural to make use of the relation earlier-later. In procedural ontology, time does not emerge through external postulation but exists within it. In the ontology of processes, one can naturally define the concept of causality, which becomes a logical concept. However, the success of the procedural view of the outside world is only possible if the new ways of reasoning prove to be a more effective tool for intellectual cognitive activity than the existing ones. During a Barolo en primeur tasting session, a seasoned wine taster is assailed by a procedural unease which leads him to question the foundations on which his work rests. Sparked off by his reading of Michel Le Gris’ pamphlet Dionysos crucifié, the taster’s objections and perplexities are directed towards teasing out the rules and coordinates of a tasting aesthetic which has become tamed and domesticated, at the service of a narcissistic “tyranny of instant gratification”. Such an approach translates into (...) wines that are beaten into submission by interventionist winemakers, wines that derive from a tasting model that has been pre-emptively cleansed of tension or dissonance so as to exalt products that are easy, reassuring, docile to marketing logic, and increasingly similar. What sort of doubts, what interpretative friction can hope to reacquaint wine criticism with its true and original aims? What relations between the tongue that tastes and the tongue that speaks can respond to the needs of a new approach to wine appreciation, a ‘tasting different’? (shrink)

I propose to demonstrate the clinical plausibility of the ‘psychotherapy scene’ of the Bacchae, which is subjected here to a purely psychiatric analysis: all my interpretations and conjectures are based on clinical data and psychiatric theory only. Euripides' objective and rational treatment of the irrational, the accuracy of his descriptions of abnormal behaviour, which are compatible, down to the last detail, with descriptions found in modern psychiatric texts, and his capacity to present not simply a partial list of symptoms, but (...) a coherent clinical picture are taken for granted and will not be discussed further in the present context. The focus of my enquiry is exclusively the psychiatric plausibility of Euripides' description of the psychotherapeutic process.It goes without saying that, since ‘instant cures’ are impossible, Euripides condensed a normally fairly long procedure into a single scene, selectively high-lighting only what would be the crucial moments of a real psychotherapy. His summary of the psychotherapy is as satisfactory as that of a modern psychiatrist. In fact, Euripides' masterly selectivity actually facilitates the understanding of the psychodynamics of Agave's recovery. This enables me to comment on the Euripidean text in exactly the same way as I commented on the verbatim transcript of the psychotherapy of one of my Plains Indian patients. (shrink)

Deception is common in dementia care, although its moral legitimacy is questionable. This paper conceptually clarifies when does dementia care involve deception and argues that care ethics is an appropriate ethical framework to guide dementia care compared with the mainstream ethical theories that emphasize abilities. From a perspective of care ethics, this paper claims that morally defensible deception is context-specific, embodied as a caring process that needs to be identified through instant, creative and interactive care procedures. According to this argument, (...) it further analyses and concludes the moral rationality of deception in five common cases. While deception is morally justified in many situations, another concern is that it is usually not the last resort but a means of convenience. As the ability to interact, autonomy and dignity of persons with dementia (PWDs) are generally ignored; nurses need more training and education to master the essential procedures to ensure that the value of authenticity and autonomy is maintained and considered throughout dementia care. When world’s most famous taxidermist, Carl Akeley, died in 1926, many obituaries cited his consummate skill and innovative technique, often arguing that he had elevated taxidermy from a craft to an art. Such claims notwithstanding, taxidermy tends still to be considered as a craft. While scholars have studied the various ways in which taxidermy has been deployed within art practices – to critique gender, colonialism and concepts of mortality – late nineteenth- and early twentieth-century attempts to classify it as a (...) fine art failed. This critical and historical asymmetry frames the following article, which explores what it tells us about how art is conceived today. I argue that taxidermy ‘failed’ as a form of art not because its procedures were distasteful, nor because its practice lacked the skill and vision an art might require. Rather, taxidermy remains outside of art due to a confluence of historical shifts in art practice and theory in the late nineteenth century, particularly those associated with the rise of instant photography and the advent of the snapshot. In this context, the making and display of taxidermied specimens entailed tensions – between ideal and real, type and example, multiple and singular, index and object – that were and remain central to photography and art. But, unlike photography, around which art historians have developed a sophisticated discourse, taxidermy lacks a critical vocabulary. Importantly, I argue, the taxidermied animal’s status involves no author-function, thus throwing into question methods of production and display. And, in light of this, I delineate taxidermy’s ‘failure’ in order to elucidate some of the tacit exclusions enacted by art history, particularly with regard to works that simultaneously reveal and negate their own manufacture. What is implicit in a typically human perception of a material object? First, perceivability is a contingent property of its bearer, relative to perceiver and conditions. Typically, human perception is special in involving the use of concepts and an awareness of object‐structures. When we visually recognize a material object, an almost limitless array of properties and procedures are by implication condensed into an instant: one entertains multiple beliefs, and posits at a distance, multiple properties. Then the experiential integration of the (...) almost limitless visual evidence of a material object is dubbed ‘constituting the material object out of experience’. Central concepts in doing so are those of side, outside, surface, interior, and part. The most important of these experiential syntheses is the spatial, whose unit is the 3D‐seeing of object‐sides, a concept that depends upon those of 2D/3D and 2D/2D seeing. Two vitally important elements in this procedure are, first, the work of the understanding, second, an awareness of the objective physical situation of perceiver and object. (shrink)

On September 27, 2016 people across the world looked down at their buzzing phones to see the AP Alert: “Baby born with DNA from 3 people, first from new technique.” It was an announcement met with confusion by many, but one that polarized the scientific community almost instantly. Some celebrated the birth as an advancement that could help women with a family history of mitochondrial diseases prevent the transmission of the disease to future generations; others held it unethical, citing medical (...) tourism and consequences for the future of the therapy. The child in question was actually born a few months earlier on April 6, 2016, but the research was published a few months later in the October edition of Fertility and Sterility. The mother carries DNA that could have given the baby Leigh Syndrome, a severe neurological disorder characterized by psychomotor regression that typically results in death between ages two and three.[1] Also known as subacute necrotizing encephalomyelopathy, Leigh Syndrome is caused by genetic mutations in mitochondrial DNA, which causes defective oxidative phosphorylation. Because people with this condition cannot re-form ATP, “demyleniation, gliosis, necrosis, spongiosis, or capillary proliferation”[2] can occur, thereby producing bilateral lesions across the central nervous system. The 36-year-old mother previously had four miscarriages and successfully birthed two children, both of whom survived less than six years due to the syndrome. For religious reasons, the mother opted for Spindle Nuclear Transfer instead of Pronuclear Transfer,[3] which many religious organizations oppose because it entails the destruction of fertilized eggs.[4] In Pronuclear Transfer, both the parent and donor egg are fertilized. The parent’s nuclear material is then removed from the egg containing mutated mitochondria and inserted into the fertilized donor egg—from which the original nuclear material has been removed and destroyed. Spindle Nuclear Transfer, on the other hand, removes the mother’s nuclear material from the egg with unhealthy mitochondria, then implants it into a donor’s egg. The newly created egg is then fertilized with the father’s sperm. This Spindle Nuclear Transfer was performed in Mexico by a team of doctors led by Dr. John Zhang, the founder of the New Hope Fertility Center in New York City. In their report, the doctors outline that five oocytes were successfully reconstituted, four of which developed into blastocysts. Only one was euploid: containing 46 XY chromosomes. Researchers then biopsied that blastocyst and found that the transmission rate of maternal mtDNA was, “5.10 ± 1.11% and the heteroplasmy level for 8993T>G was 5.73%.”[5] This indicates that at the blastocyst stage, around five percent of the mitochondria are from the original maternal egg with the mutation for Leigh Syndrome. After birth, they biopsied different tissues and found that they had an average of less than 1.60 ± 0.92% of transmitted mtDNA from the original maternal egg. The baby is reportedly doing well and the team of doctors concluded that “[h]uman oocytes reconstituted by SNT are capable of producing a healthy live birth. SNT may provide a novel treatment option in minimizing pathogenic mtDNA transmission from mothers to their babies."[6] Even when considered theoretically, Spindle Nuclear Transfer is controversial. Many doctors believe that the risks at this stage of research are too great. Dr. Trevor Stammers, a bioethicist at St. Mary’s University in London, points out: “We do not yet have a clear picture of the interaction between nuclear DNA and mitochondria.”[7] Others hold that faulty mitochondrial DNA can still be transferred during the procedure. Still more argue this technology could create problems because of germline modification.[8] Dr. Paul Knoepfler, a cell biologist at the UC Davis School of Medicine, explains: “Since this is uncharted territory and the children born from this technology would have heritable genetic changes, there are also significant unknown risks to future generations.”[9] However, proponents counter these arguments. They say the benefits outweigh the risks, as “mitochondrial replacement techniques [like Spindle Nuclear Transfer] would eliminate maternal transmission of mitochondrial disease… allowing a woman with a family history of mitochondrial diseases to ensure her children would not be affected.”[10] Additionally, experts say that no symptoms will occur if less than 20% of the transferred mitochondrial DNA is faulty.[11] And while opponents see potential germline modification as a problem, advocates answer that this could stop a family history of mitochondrial disease, which they deem a more serious concern. In this case specifically, however, there are more issues at hand. While the team of doctors did eliminate the possibility of germline modification by selecting a male embryo, there are other ethical concerns. Some argue that this case could be described as “medical tourism.” While New Hope Medical Clinic does maintain a branch in Mexico, Dr. Zhang stated that Mexico has “no rules.”[12] It is a country with underdeveloped regulations, making it difficult to confirm that doctors adhere to widely-held medical and ethical standards. Furthermore, while it is highly unlikely that the child will develop Leigh’s Syndrome, Dr. Dietrich Egli of the New York Stem Cell Foundation says the 5% mitochondrial transfer rate indicates that the technique “was not carried out well.”[13] He points to studies of embryos where the rate of mtDNA transfer was almost ten times lower. Spindle Nuclear Transfer is currently legal in the UK,[14] and many are hoping to see it legalized in the US, although Congress currently prohibits the FDA from considering applications that would entail trials in people.[15] While Dr. Zhang’s work is arguably revolutionary, many wonder if the manner in which this study was performed—in Mexico and with a high mitochondrial transfer rate—will impact the technology’s future in the US. Last week, Dr. Zhang presented the report to scientists gathered in Salt Lake City, saying that while science isn’t a race, it is “in a sense, a race for the family to find a cure, to find hope.”[16] Only time will tell if this study set back other families racing and hoping for a cure. In modern conditions payment systems have an important role in the economy, as they must provide effective economic means of payments. Accordingly, the development of payment systems in Ukraine appears as a relevant theoretical and practical problem. In the article the theoretical basis and features of payment systems in Ukraine were researched. Preconditions of systemically important payment systems development been analyzed, which are performed by the key principles of their organization and functioning. Realization of principles of systemically important payment systems (...) in Ukraine was investigated. The key principles of operation and functioning and their implementation in retail payment systems were determining, such as providing competitive services, security payments from outside interference, territorial and temporal availability, profitability of participation in the payment system, consumer protection, instant calculation of account balance, instant currency conversion and minimize currency risk. Recommendations for improving the procedures for conversion of currencies in the international card payment systems were provided in order to reduce currency risks for end-users and issuing banks, such as introducing restrictions on the period of submission for payment of international trade, as well prohibit use of trade-service enterprises for currency conversion their own exchange rates. The necessity of legislative regulation of the size of interchange fee in card payment systems to create more favorable conditions for the spread of retail electronic payment was determined as well as removal of legal restrictions on the issuance and use of electronic money and foreign exchange restrictions in order to create the conditions for international payment systems based on electronic money to enter the Ukrainian payment market. The claim that the human cognitive system tends to allocate resources to the processing of available inputs according to their expected relevance is at the basis of relevance theory. The main thesis of this chapter is that this allocation can be achieved without computing expected relevance. When an input meets the input condition of a given modular procedure, it gives this procedure some initial level of activation. Input-activated procedures are in competition for the energy resources that would allow them to (...) follow their full course. What determines which of the procedures in competition get sufficient resources to trigger their full operation is the dynamics of their activation. This dynamics depend both on the prior degree of mobilisation of a modular procedure and on the activation that propagates from other active modules. It is quite conceivable also that the mobilisation of some procedures has inhibitory effects on some others. The relevance-theoretic claim is that, at every instant, this dynamics of activation provides rough physiological indicators of expected relevance. The flow of energy in the system is locally regulated by these indicators. As a result, those input-procedure combinations that have the greatest expected relevance are the more likely ones to receive sufficient energy to follow their course. (shrink)

The English Franciscan philosopher and theologian, Adam of Wodeham (d. 1358), was a disciple and friend of William of Ockham; he was also a student of Walther Chatton. Nevertheless, he was an independent thinker who did not hesitate to criticize his former teachers - Ockham sporadically and benevolently, Chatton, frequently and aggressively. Since W odeham developed his own doctrinal position by a thorough critical examination of current opinions, the first part of this introduc tion briefly outlines the positions of the (...) chief figures in the English controversy over indivisibles. The second part of the introduction pre sents a summary of Wodeham's views in the Tractatus de indivisibilibus, lists the contents of the treatise, and considers the question of its date and its chronological position in the context of Wodeham's other works. In the third part, the editorial procedures used here are set forth. 1. THE INDIVISIBILIST CONTROVERSY In the literature of the 13th and 14th centuries, the term 'indivisible' refers to a simple, un extended entity. Consequently, these indivisibles are not physical atoms but either mathematical points, temporal instants or indivisibles of motion, usually called mutata esse. I THOMAS BRADWARDINE (d. 1349), roughly contemporary with Wodeham, classified the positions it was possible to take regarding indivisibles. He described his own view as the common view, that of "Aristotle, A verroes, and most of the moderns," according to which a "continuum was not composed of atoms (athomis) but of parts divisible without end. The measurement of one or more observables can be considered to yield sample points which are in general fuzzy sets. Operationally these fuzzy sample points are the outcomes of calibration procedures undertaken to ensure the internal consistency of a scheme of measurement. By introducing generalized probability measures on σ-semifields of fuzzy events, one can view a quantum mechanical state as an ensemble of probability measures which specify the likelihood of occurrence of any specific fuzzy sample point at some instant. In this paper, we connected Zeno’s paradoxes and motions with the viscous friction force \. For the progressive version of the dichotomy paradox, if the body speed is constant, the sequences of positions and instants are infinite, but the series of distances and time variations converge to finite values. However, when the body moves with force \, the series of time variations becomes infinite. In this case, the body crosses infinite points, approximating to a final position forever, as the progressive (...) version of the dichotomy paradox describes. The same procedures with constant speed and motion with force \ result in different spatial sequences and the same series for the regressive version of the dichotomy paradox. Nonetheless, the regressive version of the dichotomy paradox does not describe a body that approximates a final position forever. Finally, for the Achilles paradox, we find the positional and temporal sequences of the man and the tortoise at constant speeds. Analogously to the progressive version of the dichotomy paradox, the positional and temporal sequences are infinite, but the spatial and temporal series converge to finite values. If Achilles and the tortoise are identical points that move with force \, and the turtle’s position in function of time presents a temporal advantage, the man and the animal will cross successive infinite places forever, and the quick hero will never overtake the slow reptile, as the paradox described. During the last years the demand for regionally and culturally harmonised machine design is increasingly on the agenda. The problem of localising products like machine tools instantly poses the question for new procedures that allow including the regional and cultural adaptations into the design processes of machine tool companies. How to transform the general insight into the necessity of culture- and region-adapted technologies and how to embed it into a design procedure comprising applicable design attributes is the crucial problem addressed. In the intellectual confusion prevailing since the demise of Marxism and “marxism”, the attempt is made to define democracy as a matter of pure procedure, explicitly avoiding and condemning any reference to substantive objectives. It can easily be shown, however, that the idea of a purely procedural “democracy” is incoherent and self-contradictory. No legal system whatsoever and no government can exist in the absence of substantive conditions which cannot be left to chance or to the workings of the “market” (...) but must be posited as objectives of political activity. The confusion results from a deficient understanding of what makes a society and an empty idea of “freedom”. The objective of politics is not happiness, an affair to be left to the individuals, but it certainly is liberty understood as participation in the governance of the polity; it is also the pursuit of the common good, defined as the sum of the prerequisites and facilitations of individual autonomy depending on collective action, and as the realization of commonly agreed collective goals. Fundamental questions in value sensitive design include whether and how high-tech products/artefacts could embody values and ethical ideals, and how plural and incommensurable values of ethical and social importance could be chosen rationally and objectively at a collective level. By using a humanitarian cargo drone study as a starting point, this paper tackles the challenges that VSD’s lack of commitment to a specific ethical theory generates in practical applications. Besides, it highlights how mainstream ethical approaches usually related to VSD are (...) incapable of solving main ethical dilemmas raised by technological design for well-being in democratic settings. Accordingly, it is argued that VSD’s ethical-democratic import would substantially be enhanced by the espousal of a procedural ethics stance and the deliberative approach to value and welfare entailed by Amartya Sen’s capability approach. Differently from rival ethical–political theories, its normative and meta-ethical foundations better handle human diversity, value-goal pluralism, conflicting vested interests as well as the epistemic-moral disagreements typical of contemporary complex democracies. Particularly, Sen’s capability approach procedural-deliberative tenets result in an “objective-impartial” choice procedure selecting a “hierarchy” of plural incommensurable values and rational goals thus, suitable to validate an applied science such as welfare-oriented technological design in concrete social environments. Conclusions suggest that refining VSD with a capability-based procedural approach to ethics fosters the concern for democracy and social justice while preserving vital scientific-technical standards. Major advantages are at an applied level to delivering ethically and socially justified, but yet highly functional technologies and high-tech products/artefacts. (shrink)

This paper focuses on the inferential configuration of arguments, generally referred to as argument scheme. After outlining our approach, denominated Argumentum Model of Topics (AMT, see Rigotti and Greco Morasso 2006, 2009; Rigotti 2006, 2008, 2009), we compare it to other modern and contemporary approaches, to eventually illustrate some advantages offered by it. In spite of the evident connection with the tradition of topics, emerging also from AMT’s denomination, its involvement in the contemporary dialogue on argument schemes should not be (...) overlooked. The model builds in particular on the theoretical and methodological perspective of pragma-dialectics in its extended version, reconciling dialectic and rhetoric; nevertheless, it also takes into account numerous other contributions to the study of argument schemes. Aiming at a representation of argument schemes able to monitor the inferential cohesion and completeness of arguments, AMT focuses on two components of argument scheme that could be distinguished, readapting pragma-dialectical terms, as procedural and material respectively. The procedural component is based on the semantic-ontological structure, which generates the inferential connection from which the logical form of the argument is derived. The material component integrates into the argument scheme the implicit and explicit premises bound to the contextual common ground (Rigotti 2006). In this paper, the comparison of the AMT to other approaches focuses on the inferential configuration of arguments and not on the typologies of argument schemes and on the principles they are based on, which the authors intend to tackle in a further paper. Although it is an increasingly popular assumption that leader mindfulness may positively affect leader behaviors and, in turn, employee outcomes, to date, little empirical evidence supports this view. Against this backdrop, the present research seeks to develop and test a serial mediation model of leader mindfulness. Specifically, we propose that leader mindfulness enhances employee performance and that this relationship is explained by increased leader procedural justice enactment and, subsequently, reduced employees’ emotional exhaustion. We conducted three studies to test this (...) model. Study 1 involved employees from a wide range of organizations in the USA. Study 2 used a sample of leaders and employees from China and measured our model variables at three different points in time. Both studies provide consistent support for our hypotheses. Finally, Study 3 involved a laboratory experiment in which 62 senior executives were assigned to either a mindfulness induction or to a control condition. Again, results revealed a significant and positive link between leader mindfulness and leader procedural justice enactment. In sum, these findings expand our understanding of mindfulness to the domain of leadership, a key area of organizational research. Moreover, they complement prior studies by showing that mindfulness dynamics go beyond intrapersonal effects but also influence the attitudes and behaviors of others. We discuss our findings in light of their contributions to the mindfulness, ethics, and leadership literatures and point out implications for practice. (shrink)

Despite the prevailing discourses on the importance of top management ethical leadership, related theoretical and empirical developments are lacking. Drawing on institutional theory, we propose that top management ethical leadership contributes to organizational outcomes by promoting firm-level ethical and procedural justice climates. This theoretical framework was empirically tested using multi-source data obtained from 4,468 employees of 147 Korean companies from various industries. The firm-level analysis shows that top management ethical leadership significantly predicts ethical climate, which then results in (...) class='Hi'>procedural justice climate that fully mediates the effects of top management ethical leadership on two organizational outcomes, namely, firm-level organizational citizenship behavior and firm financial performance. The present study provides a plausible theoretical account and empirical validation of a mechanism through which top management ethical leadership enhances organizational performance. (shrink)

According to a standard view in psychology and neuroscience, there are multiple memory systems in the brain. Philosophers and scientists of memory rely on the idea that there are multiple memory systems in the brain to infer that procedural memory is not a cognitive form of memory. As a result, memory is considered to be a disunified capacity. In this article, I evaluate two criteria used by Michaelian to demarcate between cognitive and non-cognitive memory systems: appeal to stored content (...) and retrieval flexibility. By considering several empirical cases I argue that the criteria offered ultimately fail to distinguish between memory systems. The procedural memory system is neither contentless nor inflexible. Many people in the developing world access essential health services either partially or primarily through programs run by international non-governmental organizations (INGOs). Given that such programs are typically designed and run by Westerners, and funded by Western countries and their citizens, it is not surprising that such programs are regarded by many as vehicles for Western cultural imperialism. In this chapter, I consider this phenomenon as it emerges in the context of development and humanitarian aid programs, particularly those delivering medical (...) treatment, nutrition and access to clean water. I argue that in order to avoid contributing to cultural imperialism, INGOs have a duty to ensure that they do not offer services in a way that requires their beneficiaries to choose between accessing essential health services and violating or otherwise undermining traditional norms and practices which have significance for their beneficiaries. Following Onora O'Neill, I argue that offers requiring such a choice are effectively “unrefuseable” and so coercive. INGOs therefore, must avoid making such offers, and can accomplish this by means of an iterated process of reciprocal negotiation under conditions of equality, in which both the INGOs’ and the beneficiaries’ deep values and concerns play a role. In essence, I claim that employing such a process is a requirement of procedural justice, given the non-ideal conditions in which INGOs must operate. (shrink)

Clinical psychology is characterized by persistent disagreement about fundamental aspects of the discipline ranging from what mental disorders are to what constitutes effective treatment. Attempts to address the problem of epistemic disagreement have been frequently based on establishing the correct answer by fiat without identifying and addressing the sources of the disagreement. We argue that this strategy has not worked very well and the result is frequently ongoing and intractable disagreement, with each side in an argument convinced they are correct. (...) In this paper, we outline an epistemic disagreement procedural model intended to assist researchers and clinicians in the field of clinical psychology to identify, explore, and develop inquiry strategies that capitalize on situations where competing knowledge claims are made. The result is a flexible conceptual framework committed to a defensible epistemic pluralism, fallibilism, and contextualism, across the various research tasks constituting the field of clinical psychology. This paper describes a generative theory of bugs. It claims that all bugs of a procedural skill can be derived by a highly constrained form of problem solving acting on incomplete procedures. These procedures are characterized by formal deletion operations that model incomplete learning and forgetting. The problem solver and the deletion operator have been constrained to make it impossible to derive “star‐bugs”—algorithms that are so absurd that expert diagnosticians agree that the alogorithm will never be observed as a (...) bug. Hence, the theory not only generates the observed bugs, it fails to generate star‐bugs.The theory has been tested on an extensive data base of bugs for multidigit subtraction that was collected with the aid of the diagnostic systems buggy and debuggy. In addition to predicting bug occurrence, by adoption of additional hypotheses, the theory also makes predictions about the frequency and stability of bugs, as well as the occurrence of certain latencies in processing time during testing. Arguments are given that the theory can be applied to domains other than subtraction and that it can be extended to provide a theory of procedural learning that accounts for bug acquisition. Lastly, particular care has been taken to make the theory principled so that it can not be tailored to fit any possible data. (shrink)

Despite pervasive variation in the content of laws, legal theorists and anthropologists have argued that laws share certain abstract features and even speculated that law may be a human universal. In the present report, we evaluate this thesis through an experiment administered in 11 different countries. Are there cross‐cultural principles of law? In a between‐subjects design, participants (N = 3,054) were asked whether there could be laws that violate certain procedural principles (e.g., laws applied retrospectively or unintelligible laws), and (...) also whether there are any such laws. Confirming our preregistered prediction, people reported that such laws cannot exist, but also (paradoxically) that there are such laws. These results document cross‐culturally and –linguistically robust beliefs about the concept of law which defy people's grasp of how legal systems function in practice. (shrink)

Obtaining informed consent from patients prior to a medical or surgical procedure is a fundamental part of safe and ethical clinical practice. Currently, it is routine for a significant part of the consent process to be delegated to members of the clinical team not performing the procedure (eg, junior doctors). However, it is common for consent-taking delegates to lack sufficient time and clinical knowledge to adequately promote patient autonomy and informed decision-making. Such problems might be addressed in a number of (...) ways. One possible solution to this clinical dilemma is through the use of conversational artificial intelligence using large language models (LLMs). There is considerable interest in the potential benefits of such models in medicine. For delegated procedural consent, LLM could improve patients’ access to the relevant procedural information and therefore enhance informed decision-making.In this paper, we first outline a hypothetical example of delegation of consent to LLMs prior to surgery. We then discuss existing clinical guidelines for consent delegation and some of the ways in which current practice may fail to meet the ethical purposes of informed consent. We outline and discuss the ethical implications of delegating consent to LLMs in medicine concluding that at least in certain clinical situations, the benefits of LLMs potentially far outweigh those of current practices. Page has performed an important service by dispelling several myths and misconceptions concerning the localist approach. The localist position and computational model presented in the target article, however, are overly restrictive and do not address the representation of complex conceptual items such as events, situations, actions, and plans. Working toward the representation of such items leads to a more sophisticated and articulated view of the localist approach.

The overall aim of this thesis is to assess the legitimacy of constitutional laws and bills of rights within the framework of procedural epistemic democracy. The thesis is divided into three sections. In the first section, I discuss the relevance of an epistemic argument for democracy under the circumstances of politics: I provide an account of reasonable disagreement and explain how usual approaches to the authority of decision-making procedures fail to take it seriously. In the second part of the (...) thesis, I provide an account of the epistemic features of democracy and of the requirements of democratic legitimacy. I develop a revised pragmatist argument for democracy which relies on three presumptive aims of decision-making: justice, sustainability and concord. In the third and last section, I first argue for the desirability of constitutionalism. I then explain why constitutionalism, as it is usually understood, is incompatible with my procedural epistemic account of democratic legitimacy. In the last chapter, I offer a two-pronged solution to the apparent incompatibility of constitutionalism and epistemic democracy. I first argue for the appropriateness of political constitutionalism, as opposed to legal constitutionalism, in understanding the relationship between rights and democracy. I then provide an account of rights protection and judicial review compatible with epistemic democratic legitimacy. Finally, I use the notion of pragmatic encroachment to explain how constitutional laws can achieve normative supremacy through the increased epistemic credentials of the procedure. (shrink)

The ability to extract patterns from sensory input across time and space is thought to underlie the development and acquisition of language and literacy skills, particularly the subdomains marked by the learning of probabilistic knowledge. Thus, impairments in procedural learning are hypothesized to underlie neurodevelopmental disorders, such as dyslexia and developmental language disorder. In the present meta‐analysis, comprising 2396 participants from 39 independent studies, the continuous relationship between language, literacy, and procedural learning on the Serial Reaction Time task (...) (SRTT) was assessed across children and adults with typical development (TD), dyslexia, and Developmental Language Disorder (DLD). Despite a significant, but very small, relationship between procedural learning and overall language and literacy measures, this pattern was not observed at the group‐level when examining TD, dyslexic, and DLD groups separately. Based on the procedural/declarative model, a positive relationship was expected between procedural learning and language and literacy measures for the typically developing group; however, no such relationship was observed. This was also the case for the disordered groups (ps >.05). Also counter to expectations, the magnitude of the relationship between procedural learning and grammar and phonology did not differ between TD and DLD (ps >.05), nor between the TD and dyslexic group on reading, spelling, and phonology (ps >.05). While lending little support to the procedural/declarative model, we consider that these results may be the consequence of poor psychometric properties of the SRTT as a measure of procedural learning. A recent study has established that thinkers reliably engage in epistemic appraisals of concepts of natural categories. Here, five studies are reported which investigated the effects of different manipulations of category learning context on appraisal of the concepts learnt. It was predicted that dimensions of concept appraisal could be affected by manipulating either procedural factors or declarative factors. While known effects of these manipulations on metacognitive judgements such as category learning judgements and confidence at test were replicated, procedural (...) factors had no reliable effects on the dimensions of concept appraisal. Effects of declarative manipulations on some forms of concept appraisal were observed. (shrink)
