Logic-based approaches to legal problem solving model the rule-governed nature of legal argumentation, justification, and other legal discourse but suffer from two key obstacles: the absence of efficient, scalable techniques for creating authoritative representations of legal texts as logical expressions; and the difficulty of evaluating legal terms and concepts in terms of the language of ordinary discourse. Data-centric techniques can be used to finesse the challenges of formalizing legal rules and matching legal predicates with the language of ordinary parlance by (...) exploiting knowledge latent in legal corpora. However, these techniques typically are opaque and unable to support the rule-governed discourse needed for persuasive argumentation and justification. Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. In the Philebus, Socrates argues that some anticipatory pleasures can be false. The main argument at 38b6-41a4 has perplexed readers, however, and scholars have developed several different ways to understand the falsity of false anticipatory pleasures. I argue that the anticipation argument should be read in conjunction with a later distinction in the Philebus between intense pleasures mixed with pain and pure pleasures free from pain. I suggest that anticipatory pleasures taken in intense pleasures are false because they misidentify an (...) intense pleasure as a genuine pleasure when in fact intense pleasures are inferior and non-genuine due to being mixed with pain. I contend that the example of a false anticipatory pleasure supports recognizing this kind of falsity, and that doing so helps to resolve several challenges that face existing interpretations. Internet is often said to open up new avenues for a more direct and deliberative democracy. In this article, the notion of ‘deliberation’ will be problematized and a typology of political web sites will be developed. Next, three case studies of Dutch discussion sites are used to test the claim that the organizational structure, aim, control of content and kind of interactivity of political web sites can explain the level and quality of participation. Except for its mostly extreme elitist participation, (...) the research presented here gives a rather ambiguous picture of e-democracy at work. Not only are we confronted with more paradoxes than clear-cut answers, the question is raised whether notions such as the ‘public sphere’ are not more of a hindrance than a help in making sense of politics on the Internet. Education is increasingly coming under the shadow of economics. In this article we engage in ideology critique by applying a critical realist analysis to conventional economic models and the teaching of students. Through a historical and philosophical interrogation, we argue that the current curriculum suffers from a diminutive understanding of human being. We argue that economics education has for a long time now worked with a highly abstracted and decontextualized idea of human being that has absented other dimensions of human (...) concerns. We examine the current English Advanced level economic curriculum and the revised curriculum which will be taught from September 2015. Using an understanding of the dynamics of structure and agency and that economics operates in open systems, we argue for retroduction as an appropriate methodology. (shrink)

This book focuses on material culture as a subject of philosophical inquiry and promotes the philosophical study of material culture by articulating some of the central and difficult issues raised by this topic and providing innovative solutions to them, most notably an account of improvised action and a non-intentionalist account of function in material culture. Preston argues that material culture essentially involves activities of production and use; she therefore adopts an action-theoretic foundation for a philosophy of material culture. Part 2 investigates a salient feature of material culture itself—its functionality. To address growing concerns about academic integrity, college students (n?=?758) at honor system and non-honor system institutions were presented with eight scenarios to determine the influence of an honor system on their perceptions of and responses to academic dishonesty. Main effects for honor code status emerged. Students from traditional honor system schools considered the behaviors to be more dishonest, and were more likely to respond that they would report the incident when compared to students attending modified and non-honor system institutions. Findings suggest traditional honor systems, with specific rules and regulations in place, are more effective at cultivating academic integrity among students; modified honor systems may not be as effective as previous research suggests. Inherent in providing healthcare for youth lie tensions among best interests, decision-making capacity, rights, and legal authority. Transgender youth experience barriers to needed gender-affirming care, often rooted in ethical and legal issues, such as healthcare provider concerns regarding youth capacity and rights to consent to hormone therapy. Even when decision-making capacity is present, youth may lack the legal authority to give consent. The aims of this paper are therefore to provide an empirical analysis of minor trans youth capacity to consent (...) to hormone therapy and to address the normative question of whether there is ethical justification for granting trans youth the authority to consent to this care. Through qualitative content analysis of interviews with trans youth, parents, and healthcare providers, we found that trans youth demonstrated the understandings and abilities characteristic of the capacity to consent to hormone therapy and that they did consent to hormone therapy with positive outcomes. Employing deontological and consequentialist reasoning and drawing on a foundation of empirical evidence, human rights, and best interests we conclude that granting trans youth with decisional capacity both the right and the legal authority to consent to hormone therapy via the informed consent model of care is ethically justified. However, we can also place it within wider public discourse employing theistic conceptions (...) of AI. Building on anthropological fieldwork into the ‘entanglements of AI and Religion’, this article will explore how ‘blessed by the algorithm’ tweets are indicative of the impact of theistic AI narratives: modes of thinking about AI in an implicitly religious way. This thinking also represents continuities that push back against the secularisation thesis and other grand narratives of disenchantment that claim secularity occurs because of technological and intellectual progress. In this book, Ronald Giere seeks to resolve the opposition between objectivism and constructivism by suggesting a third way, perspectival realism, according to which both sides are partly right. To prove his case, Giere reconstructs some of the acknowledged puzzle pieces in the philosophy of science (theory, observation, etc.). To my mind, of most interest is the piece Giere calls “representional model.” Constituting the basis of every science, it functions as a template that governs data collection as well as theory (...) development. Throughout the book, Giere illustrates his various propositions with examples taken from the natural sciences. I contend that the propositions are just as relevant for the social sciences and present some examples in order to indicate this. Especially, the concept of model is useful both for a better understanding of social science and for increasing its cumulativity. (shrink)

For a Better Worldliness is not only a statement of Abraham Kuyper's and Dietrich Bonhoeffer's theological concept and historical practice of discipleship. It is also--and perhaps more importantly--a call to engage in the fullness of the Christian life here and now. While this book goes to great efforts to establish sound historical and theological insights specifically in regards to Kuyper and Bonhoeffer, there is a strong underlying current that these particular insights deeply matter to the life of discipleship in the (...) world today. History shows us that discipleship is not a singular journey; because of Jesus Christ it is not a description of one set path with one set of guidelines. A disciple can be a prime minister who unabashedly and successfully campaigned on his Calvinistic principles, just as he can be a participant in a coup d'état launched against a tyrant, leading to the disciple's own imprisonment and death. This paper proposes a model ofratio decidendi as a justification structure consisting of a series of reasoning steps, some of which relate abstract predicates to other abstract predicates and some of which relate abstract predicates to specific facts. This model satisfies an important set of characteristics ofratio decidendi identified from the jurisprudential literature. In particular, the model shows how the theory under which a case is decided controls its precedential effect. A paradigm case of demanding involves making utterances designed to influence addressees to accede.1 It would be incoherent to say, "I demand that you do x, but I am not saying that you ought to do x," or "I demand that you do x, although I am fully aware that you cannot do x." The extraordinary nature of demanding may be gleaned from anomalous utterances such as "employees may demand time off by notifying scheduling managers at least one month in (...) advance" and "faculty members may demand an extension of the tenure clock in writing to the provost." It is argued that the Achilles heel of contemporary sociology-and great parts of social science-is a) weak theory development, and b) absence of a meta-theory providing a common platform and a shared goal for its practitioners, fostering cumulativity. A meta-theory called causal realism (a variant of critical realism) is suggested for these purposes. The main tenets and key concepts of realism, such as causality and explanation, mechanism, stratified reality, are presented. This book represents emerging alternative perspectives to the "constructivist" orthodoxy that currently dominates the field of science and technology studies. Various contributions from distinguished Americans and Europeans in the field, provide arguments and evidence that it is not enough simply to say that science is "socially situated." Controversial Science focuses on important political, ethical, and broadly normative considerations that have yet to be given their due, but which point to a more realistic and critical perspective on science policy.

Intellectualists about know-how tend to deny that knowing how to ϕ requires the corresponding ability to ϕ. So, it’s supposed to be an attractive feature of intellectualism that it can explain cases of knowing how without ability, while anti-intellectualism—roughly, the view that knowing how is a kind of ability—cannot. I show that intellectualism fails to explain the very cases that are supposed to showcase this feature of the view. Despite appearances, this does not amount to an objection to intellectualism per (...) se, but to the intellectualist’s rejection of ability entailment. It turns out that all parties to the debate about know-how should accept that knowing how entails ability. The upshot is that the central question of the debate should not be whether knowing how entails ability, but whether ability suffices for knowing how, as anti-intellectualists sometimes claim. Historical and Theological Reflections, Matthew Levering writes "to make the case" that there is "good reason" to believe in the bodily resurrection of Jesus (1). In this (...) self-described work of "theological apologetics" (211), Levering argues from a threefold foundation for the credibility of Jesus's resurrection: (1) "the New Testament evidence," considered from the perspective of historical investigation; (2) the "sheer strangeness" of the apostolic claim that [End Page 1347] Jesus was "resurrected" and not just resuscitated or exalted into heaven as an immortal soul; (3) and the intrinsic credibility of the "supreme love" revealed through his death and resurrection (2–4). As this threefold foundation makes clear, Levering draws together both "historical and theological reasons for believing that Jesus' Resurrection happened" (4).In chapter 1, Levering contends that, while "faith does not stand or fall upon the results of historical research, those who insist that the truth of Jesus' Resurrection has nothing to do with the domain of historical investigation are mistaken" (30). To this end, he offers a survey of three figures: (1) the Belgian Dominican theologian Edward Schillebeeckx; (2) the American Protestant biblical scholar Dale C. Allison Jr.; and (3) the Anglican bishop and biblical theologian N. T. Wright. Levering exposes the serious flaws of contemporary attempts to reduce the resurrection claims of early Christians to hallucinations or visions of someone who has recently died. In particular, Levering finds compelling Wright's argument that the bodily resurrection of Jesus provides "the best historical explanation" of the early Christian claim that what first-century Jews expected to happen to everyone at the end of time had in fact happened to only one person—Jesus of Nazareth—in the middle of time. From a strictly historical point of view, claims that the disciples were merely moved by grace to a new experience Jesus being "alive" or that they simply experienced hallucinatory visions of Jesus after his death fail to explain the "radical change of eschatology" that took place in the early Church (56).In chapter 2, Levering explores the question of whether "the Church's mediation is truly effective in enabling us to share in the apostolic communion with the risen Jesus" (63). At the same time, Levering insists that eyewitness memory is only one "mode of historical remembrance" utilized by the Church; in addition, Jesus also "willed that the historical remembrance of his Resurrection be an ecclesial reality" (90)—that is, a liturgical act of "remembrance" that takes place above all in the Eucharistic liturgy.In chapter 3, Levering aims to shed light on "the role of the Old Testament in aiding the discernment of the historical credibility of Jesus's Resurrection" (91). On receiver-based teleosemantic theories of representation, the chemical states of the circadian clocks in animal, plant and cyanobacterial cells constitute signals of future states of affairs, often the rising and setting of the sun. This signalling is much more rigid than sophisticated representational systems like human language, but it is not simple on all dimensions. In most organisms the clock regulates many different circadian rhythms. The process of entrainment ensures that the mapping between chemical states of the clock and the (...) daily light-dark cycle is adjusted to deal with seasonal changes. In regulating anticipatory behaviour, the states of the clock look forward both to the time the behaviour is supposed to happen and the later time when the anticipated circumstances are supposed to arise. The case of the circadian clock shows that purely indicative signals can arise in very basic biological systems and brings into sharp relief the trade-offs involved in characterizing representational systems. On receiver-based teleosemantic theories, future-directed signals are not restricted to complex multicellular organisms but are ubiquitous in the biological world. (shrink)

ABSTRACT: In this essay I provide one methodology that yields the level of analysis of an alleged knowledge-claim under investigation via its relations to varying gradations of scepticism. Each proposed knowledge-claim possesses a specified relationship with: (i) a globally sceptical argument; (ii) the least sceptical but successful argument that casts it into doubt; and (iii) the most sceptical yet unsuccessful argument, which is conceivably hypothesized to repudiate it but fails to do so. Yielding this specified set of relations, by means (...) of proceeding from global scepticism to (ii) and (iii), increases the chances of identifying the highest evaluative relevancy of the levels of analysis and observation of an alleged knowledge-claim. I argue that the failure to analyse and derive a difference between (i) and (ii) with respect to an alleged knowledge-claim signifies that the claim is grounded within the theoretical framework itself, that the claim lacks specification with regard to content that is analysable via that framework, and the claim is dubious insofar as alternative theoretic frameworks may present greater relevancy to levels of observation. Increased productivity may have negative impacts on farm animal welfare in modern animal production systems. Efficiency gains in production are primarily thought to be due to the intensification of production, and this has been associated with an increased incidence of production diseases, which can negatively impact upon FAW. While there is a considerable body of research into consumer attitudes towards FAW, the extent to which this relates specifically to a reduction in production diseases in intensive systems, and whether the increased (...) incidence of diseases represents a barrier to consumer acceptance of their increased use, requires further investigation. Therefore a systematic review of public attitudes towards FAW was conducted, with a specific focus on production diseases in intensive systems. Four databases were searched to identify relevant studies. A screening process, using a set of pre-determined inclusion criteria, identified 80 studies, with the strength of evidence and uncertainty assessed for each. A thematic analysis led to the identification of 6 overarching themes constructed from 15 subthemes. The results demonstrate that the public are concerned about FAW in modern production systems. Concern varied in relation to age, gender, education and familiarity with farming. Naturalness and humane treatment were central to what was considered good welfare. An evidence gap was highlighted in relation to attitudes towards specific production diseases, with no studies specifically addressing this. However, the prophylactic use of antibiotics was identified as a concern. A number of dissonance strategies were adopted by consumers to enable guilt free meat consumption. (shrink)
