Mediation services arise in contexts where the notions of community cohesion, relationship integrity and social order are valued over their opposites (disorder, dissent, conflict etc). Yet it is not at all clear whether and how the mediation of conflict works to re-establish harmony or consensus. Indeed it is not at all clear that mediation is always effective or just. It has even been suggested that some conflicts (e.g. work-place, commercial and sexual assault) are either not resolved or not resolved justly (...) by mediation. On the other hand, advocates maintain that mediation can bring resolution and repair to ongoing relationships, promote community harmony, and empower people to be self-determining in the construction and maintenance of their resolutions. Whether mediation is adjudged positively or not, all mediation is instantiated in, indeed performed through, talk. In this paper I examine mediations from an Australian mediation program, and use Conversation Analysis to expose the practical methods by which mediators achieve consensus between disputants. I then examine a case in which mediation has failed to produce the sought-after consensus, and explore one way of understanding the failure of mediation in that case. (shrink)

In mainstream analytic epistemology, Reformed theology has made its presence prominently felt in Reformed epistemology, the view of religious belief according to which religious beliefs can be properly basic and warranted when formed by the proper functioning of the sensus divinitatis, an inborn capacity or faculty for belief in God that can be prompted to generate certain religious beliefs when presented with things (e.g., certain majestic aspects of creation). A major competitor to Reformed epistemology is Wittgensteinian quasi-fideism, a position drawn (...) from the epistemology of Wittgenstein’s On Certainty, according to which some foundational religious commitments are not properly basic beliefs but some kind of apodictic, unshakeable certainties that form part of the structure of one’s rationality and worldview. I argue that the Reformed tradition has contained elements of quasi-fideism at least as far back as Calvin’s account of faith from the Institutes of the Christian Religion, book 3, chapter 2. This book contains twelve essays that work together to trace a variety of theories of emotion, intellect, and will, specifically connected to the possibility of moral decision and action, that run (...) from the late ancient period to the early modern period. Though some essays are more history than philosophy, the collection nevertheless balances out and brings to the reader an in-depth study of what the editors rightly describe as a neglected field of research. Contributors are: Calvin Normore, Simo Knuuttila, Risto Saarinen, Mikko Yrjonsuuri, John Boler, Vesa Hirvonen, Henrik Lagerlund, Lorenzo Casini, Peter King, Deborah Brown, and Lilli Alanen.It is clear from the editors' introduction that the idea behind the collection is the piecing together of a complex patchwork of theories, showing how they form a single, coherent intellectual history from Boethius to Descartes. Time will tell whether the story told holds up. Several of the essays bring to light previously ignored philosophers of the medieval and scholastic periods who are seen as important players in the history being worked out. And, several essays (Brown's and Alanen's, e.g.) forward new and interesting—though arguably controversial—takes on philosophers well known to many (in their cases, Descartes). So, there is much worth looking at here.There are a few philosophical landmines. For example, in places authors seem unconcerned about potential problems arising from the way in which a view is stated. For instance, in explaining how a human being wills, the view that the willing is done via a faculty inherent in the soul is developed. This, of course, is all well and good. But, the author goes on to say, "If whatever the will wills is attained..." (18), which makes the will the subject of willing, not the human being. The will is also said to have passions, and the rational part of the soul an appetitive faculty (ibid.). So, is it that human beings do not will and do not have passions, but the wills will and have passions? Doesn't such a 'theory' simply push back what it is that needs to be explained? For, how does the will will? Does it have a faculty that wills, and so on? The trouble is that the reader is not sure whether the landmine is inherent in the view being discussed, an artifact of the text, or something invented by an author in the exegesis itself. And so, it is not recommended to those coming, for example, to the topics of rational choice, free will, or weakness of will for the first time. The present essay contends that progressive readings of Smith ignore the influence of theological concepts and religious ideas on his work, notably three distinct strands: first, seventeenth- and eighteenth-century natural theology; second, Jansenist Augustinianism; third, Stoic arguments of theodicy. Taken together, these theological elements help explain why Smith’s moral philosophy and political economy intensifies the secular early modern and Enlightenment idea that the Fall brought about ‘radical evil’ and a ‘fatherless world’ in need of permanent divine intervention. As (...) such, Smith views the market as divine regulation of human sinfulness and an instrument to serve God’s providential plan. Indeed, the ‘invisible hand of the market’ represents a nominalist realm where human cooperation intersects with divine providence, blending private self-interest with the public commonweal. I will also argue that Smith’s conception of a morally neutral market is ultimately incompatible with creedal Christianity, in particular orthodox catholic Christian ideas of the common good in which all can share and the practice of charity for those most in need who have been abandoned by state bureaucracy and the marketplace. The main reason is that Smith, not unlike Calvin, tends to divorce human contract from divine gift by dividing the theo-logic of gratuitous reciprocal giving from the economic logic of contract – a dualism that bears an uncanny resemblance with Suárez’s Baroque scholasticism of which Smith’s friend David Hume was rightly critical. In particular, the Reformation and Counter-Reformation theology of Calvin, Luther and Suárez sunders ‘pure nature’ from the supernatural and develops a ‘two ends’ account of human nature, according to which human beings have a natural end separate from their supernatural finality. So instead of participating in the divine oikonomia of asymmetrical gift-exchange, human society and the economy operate autonomously and are ordered towards a purely natural end. Smith conceptualises the market mechanism as both a fundamental precondition for interpersonal relationality and at the same time separate from the sociality it engenders. Smith’s anthropology hovers half-way between Machiavelli and Mandeville’s homo œconomicus in search for maximal profit, on the one hand, and the diametrically opposed conception of man as a gift-exchanging animal striving for mutual social recognition, on the other hand. By viewing market exchange as separate from the private virtues of benevolence, justice and prudence, he introduces a split between the exercise of moral virtues and the operation of commercial society. Such a divide is wholly foreign to the project of an overarching civil compact in the writings of Smith’s contemporary Antonio Genovesi and other members of the Italian schools of civic humanism and civil economy. In consequence, Smith’s œuvre marks a decisive shift from civil to political economy. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:BLACK-ON-BLACK VIOLENCE: THE INTRAMEDIATION OF DESIRE AND THE SEARCH FOR A SCAPEGOAT Fred Smith Emory University René Girard's mimetic hypothesis provides a means of interpreting texts in terms of a systematic understanding ofcultural formations such as ritual, prohibition, and myth. It is based on an anthropology which accepts that most cultural texts are generated by an agency that does not appear explicitly or thematically within the texts themselves. (...) That generative agency is the scapegoat mechanism which I will discuss extensively in this essay as it concerns black-on-black violence in American society. With some modification, Girard's ideas account for the effects of the pathogenic educational environment to which black boys are exposed and which results in such violence. What we are witnessing in black-on-black violence may be understood in part as the consequence ofscapegoating which is driven by interdividual dynamics of desire analyzed in Girard's observations of mimetic behavior among humans. Mimetic desire is the starting point ofGirard's theory. Desire is mimetic in the sense that it imitates the desire of another. One's desire copies the other's desire for an object. Such desire is potentially violent because it can and often does lead to the rivalry of desires for the very same object. When mimetic desire is acquisitive, it produces violence at its most fundamental level. It is not that all mimetic desires "produce" violence, only acquisitive desire that becomes rivalrous or conflictual. I. The Triangle of Desire "Mimetic" comes from the same root as "mime" and "imitate." An acquisitive mimetic desire in Girard's theory involves the "desire to have" which imitates another person's desire for the possession or enjoyment ofan Fred Smith33 object. The object of desire may be a person or a thing; it can be a nonmaterial or metaphysical object like prestige, honor or "face" (pride). It is another who serves as the model for desiring a particular object. The greater the model's desire for the object, the greater the mimetic desire it inspires. The results are jealousy and covetousness over the possessions, positions or prestige, desired or enjoyed by the model of our desires. Desire is imitative because it is attracted to the object(s) belonging to another; furthermore, it is activated by the desire ofthe other, who may be a single person or an entire group. This imitative process requires that the subject have access to, or be able to appropriate and dispose of, the model's objects or possessions. Thus desire is triangular in its structure, being comprised ofthe subject, the other as model of desire, and the model's objects. Distance between the subject and model is an important factor in this structure. It does not necessarily denote physical space, for it can also function in terms ofpsychosocial space (i.e., race, socioeconomic position, cultural standing, etc.) (Redekop 7). Not only individuals, but society as a whole can serve as the model of desire. One also learns what is desirable from the aggregate of others that is society (Hamerton-Kelly 3). Acquisitive mimetic desire necessitates the ability of individuals to see themselves in the position ofthe model of desire. Ifthey are not able to see themselves in the place ofthe model, then the potential for the development of mimetic desire is minimal. This is why there is greater rivalry and jealously among slaves than between slave and master; among workers, rivalry is greater than between bosses and workers among siblings it is greater than between parents and children. This is the primary reason why violence is intraracial rather than interracial. II. Internal Mediation of Desire Mimetic desire is often reciprocal. Two people can be models ofdesire for each other, each one imitating the desire of the other for a common object. Acquisitive mimetic desire not only involves a desire to have, but includes the desire to be like, or even to be the other. This is why mimetic desire often evolves into love/hate relationships. In lieu of an abstract, here is a brief excerpt of the content:Elizabeth Hanson-Smith AUGUSTINE'S CONFESSIONS: THE CONCRETE REFERENT The chief problem facing critics who would consider the Confessions as both a literary work and a philosophical treatise remains the connection between the first nine books, the autobiography, and the last four, the metaphysical speculations on time, eternity, epistemology, and theology. A persistent desire to justify the work as an aesthetic whole has led critics on a search for thematic (...) and structural unity; they have been more successful in the former endeavor than in the latter. The interpretation of the work's plot as a peregrinatio animae, a pilgrimage of the soul, is now generally accepted as definitive; but attempts to find structural unity within that broad outline have not progressed beyond Marrou's characterization of the work as a "musical composition."1 His analogy to music has not been anchored to any concrete structural features of the Confessions and does not illuminate the connections between its content and its form. I shall attempt to prove that a unified structural model for the development of the soul in the Confessions does indeed exist and is outlined in Augustine's earlier discursive work, the De quantitate animae.2 The seven degrees or steps (gradus) of the soul's ascent to God, as sketched in the De quantitate, are deliberately fleshed out and translated into a mimetic, narrative version in the Confessions. Placing the two works side by side gives us a unique opportunity to examine a typically medieval literary form, the educative journey, in its relationship to its philosophical premises. Such a study reveals the inner formal unity of the literary work and, further, provides us with significant evidence for a re-examination of Augustine's Neo-Platonism, his supposed dualism, and his influence on later works, both literary and philosophical. In the Confessions we see one of the earliest Christian blendings of several models: first, the educative journey, the archetypal pattern familiar from the Odyssey, the Aeneid, and even The Golden Ass of Apuleius. Augustine's version, like later medieval cosmologies, also 176 Elizabeth Hanson-Smith1 77 includes a vision of the cosmic order and its relationship to human order, elements of significance in pagan philosophical works such as the Timaeus and the Dream of Scipio. But Augustine's journey also depends upon the Judeo-Christian conception of history as a series of figurae or types of the Messiah: the protagonist of the Christian educative journey joins thefigurae of the Biblical past. Christ's incarnation as Mansoul and his life on earth are the pattern of universal history from Fall to Apocalypse; Christ's life becomes a figurative pattern for the actions of Everyman.3 The Confessions is one of the earliest Christian works to apply this pattern in a narrative context. Augustine was also preoccupied with the Hexaemeron, the six days of creation and the seventh of rest. He views the exegesis of Genesis as an explanation of all subsequent life; the Ages of Man recapitulate the days of creation, as do the sacraments and the seven steps in the ascent of the soul. Thus, to the figurative pattern of Christ's "pilgrimage" from creating Logos to Incarnate God and finally to judge at the Second Coming, Augustine applies the schematic seven-fold ascent found in the De quantitate: the soul passes through the ascending steps of animation, sense, art, religion, tranquillity, initiation, and contemplation—each of which is figured by or patterned on a stage in Christ's life, as represented by the sacraments, and each of which, further, reflects a segment of universal history. The seven steps are not simply the movement of the individual soul, but the progress of Mansoul on its journey to Apocalypse. The stylistic differences between the two works—one an exposition written as Socratic dialogue, the other a metaphorical personal narrative —will no doubt give rise to differing interpretations; but one may, I think, object to certain details I suggest while still agreeing that the De quantitate provides the structuring model. A series of lectures organized in part by the Society for Applied Philosophy and entitled ‘Philosophy and Practice’ is presumably aimed at displaying the practical implications of philosophical doctrines and/or applying philosophical skills to practical questions. The topic of this paper, the role of interests in science, certainly meets the first condition. For as will be argued there are a number of theses concerning the role of interests in science which have considerable implications for how one should see the scientific (...) enterprise in general and in particular for how one assesses the claim that science ought to be accorded its priviliged position in virtue of its results and/or methods And in view of the respect and resources accorded to science what could be of greater practical interest? It remains the case, however, that my interest may seem the inverse of that of the organizers of this series. For in looking at the role of interest in science, one is examining, so to speak, the extent to which the sphere of the practical determines what goes on in science. One is exploring ways in which the non-scientific impinges on the scientific. While my primary focus will be on the physical sciences, it will be argued that there is a significant difference between them and the social sciences; a difference which renders the social sciences intrinsically liable to penetration from outside. As will be seen, some of the particular arguments for this conclusion make pressing the question: what about philosophy? The answer, it will be concluded, is that philosophy is insulated from external influences to a considerable extent. In that lies both its importance and an explanation as to why much of it has little practical application. (shrink)

The author responds to critics of Awaiting the King, addressing especially questions about Augustinian liberalism and the church’s complicity in, and responsibility for, disordered liturgies, raising fundamental questions about the relationship between church and world.

Usury is a concept often associated more with religiously based financial ethics, whether Christian or Islamic, than with the secular world of contemporary finance. The problem is compounded by a tendency to interpret riba, prohibited within Islam, as both usury and interest, without adequately distinguishing these concepts. This paper argues that in Christian tradition usury has always evoked the notion of money demanded in excess of what is owed on a loan, disrupting a relationship of equality between people, whereas interest (...) was seen as referring to just compensation to the lender. Although it is often claimed that hostility towards ‘usury’ has been in retreat in the West since the protestant Reformation, we would argue that the crucial break came not with Calvin, but with Jeremy Bentham, whose critique of the arguments of Adam Smith, upholding the reasonableness of the laws against usury, led to the abolition of the usury laws in England in 1854. There has to be a role for law, whether Islamic or secular, in regulating financial relationships. We argue that by retrieving the necessary distinction between demanding usury as illegitimate predatory lending and interest as legitimate compensation, we can discover common ground behind the driving principles of financial ethics within both Islamic and Christian tradition that may still be of relevance today. By re-examining past ethical discussions of the distinction between usury and just compensation, we argue that the world’s religious traditions can make significant contributions to contemporary debate.
