The common law's approach in the law of unjust enrichment is to enumerate specific «unjust factors» as permissible causes of action in claims for restitution. This approach has come under attack, inter alia, for being unnecessarily complicated. The claim is that the civilian approach, with its single ground of absence of legal cause for the transfer, is preferable since the operative unjust factor in any particular case is irrelevant to the restitutionary response. In defence of the common law's approach, this (...) article tenders four aspects of the restitutionary response which, it is claimed, are illuminated by reference to the nature, context, and effect of the operative unjust factor in any particular case. They are: (i) the availability of the defence of change of position; (ii) the justifiability of certain «bars» on rescission and the permissible mode of mutual restitution on rescission; (iii) the appropriate measure of enrichment where restitution is, or must be, effected in money; and (iv) two possible justifications for the controversial remedy of partial rescission. Employee counterproductive work behavior is costly to organizations and those who work within them. Evidence suggests that employees are motivated to engage in CWB because they believe that these behaviors will make them feel better in response to negative workplace events. However, research has yet to consider the situational and individual factors that shape the extent to which employees view CWB in such a manner. In order to provide insight into the decision-making process surrounding the use of CWB as a (...) coping strategy, this study leverages coping theory to examine the factors that contribute to employees’ beliefs that CWBs will be instrumental for emotion regulation aims in response to workplace stressors. In a repeated measures scenario-based study of 297 employees, we found that individuals’ perceived coping instrumentalities for CWBs are a function of the controllability and source of the stressor as well as a more stable learned response to stressful situations at work. Warming temperatures in the circumpolar north have led to new discussions around climate-driven frontiers for agriculture. In this paper, we situate northern food systems in Canada within the corporate food regime and settler colonialism, and contend that an expansion of the conventional, industrial agriculture paradigm into the Canadian North would have significant socio-cultural and ecological consequences. We propose agroecology as an alternative framework uniquely accordant with northern contexts. In particular, we suggest that there are elements of agroecology that are already (...) being practiced in northern Indigenous communities as part of traditional hunter-gatherer food systems. We present a framework for agroecology in the North and discuss its components of environmental stewardship, economies, knowledge, social dimensions and governance using examples from the Dehcho region, Northwest Territories, Canada. Finally, we discuss several challenges and cautions in creating policy around agroecology in the North and encourage community-based research in developing and testing this framework moving forward. Patients... are moved to higher and higher levels of care, finally becoming enmeshed in a tangle of tubes that extinguish their identity and needs as persons.” In this case the conflict created by the parental demand for the utilization (...) of technology, extracorporeal support in a neonate will be explored.I was consulted in the care of a newborn with a right–sided congenital diaphragmatic hernia (CDH). In this anomaly the diaphragm, the muscular partition that separates the abdomen and the thorax, forms incompletely, and the viscera migrate up into the chest compressing the developing lung, shifting the medistinum and heart and compressing the contralateral lung. The resulting lung maldevelopment is termed pulmonary hypoplasia. The maldevelopment of the lungs in CDH is variable with the most severe forms resulting in neonatal death. This congenital anomaly is associated with 55% survivability; the poor prognosis is due to the pulmonary hypoplasia. In addition to pulmonary hypoplasia, there is the association of pulmonary hypertension with CDH. Pulmonary hypertension is a condition where the vascular resistance in the lung is high with reduced blood flow within the lung. The physiologic consequence of pulmonary hypertension is hypoxemia, oxygen deficiency in the blood, and reduced oxygen delivery to all organs. Unlike severe pulmonary hypoplasia, pulmonary hypertension is reversible. When an infant with CDH is born and deteriorates due to respiratory failure it can be difficult to determine whether the respiratory failiure is due to pulmonary hypoplasia or pulmonary hypertension. Extracorporeal membrane oxygenation (ECMO) is indicated in the management of reversible respiratory and, or cardiac failure. In the case of neonates with CDH, ECMO addressess the reversible component of the respiratory failure, the pulmonary hypertension. The respiratory failure due to severe pulmonary hypoplasia is not reversible; ECMO is not indicated. There are established criteria to guide the determination of which infant is a candidate for ECMO. Depending upon the ECMO center, the stringency can vary.In this case, the baby had significant respiratory failure with impairment in both oxygenation, hypoxia, and ventilation–the elimination of carbon dioxide, hypercapnea. The neonatologist spoke with the mother who stated that she wanted “everything done” including ECMO in the management [End Page 22] of her baby. When the neonatologist consulted me to put the baby on ECMO I expressed my concern that this infant had irreversible respiratory failure due to pulmonary hypoplasia. And simply from a technical aspect, I could not guarantee that ECMO would “work”. When an infant is “cannulated” for extracorporeal support, cannulas are inserted to allow for the drainage of blood into the ECMO circuit, the blood oxygenated and the carbon dioxide is cleared, and the blood is then returned to the infant. The majority of diaphragmatic hernias are on the left and when the CDH is on the right side, the right heart may be compressed by the viscera in the chest, and venous drainage into the ECMO circuit may be impaired. When this is encountered, the next step in the management algorithm is to fix the hernia–reduce and return the viscera within the chest to the abdomen and eliminate the visceral compression of the right heart. The neonatologist shared my concern and also reiterated that this baby’s mother wanted “everything done”. I had little uncertainty as to the etiology of the respiratory failure in this baby. In meeting the mother’s demands I then suggested that the hernia be repaired first, and if there was improvement in the hypoxia and hypercapnea, then give the baby the benefit of the doubt that there is a component of reversibility to the respiratory failure and then proceed with ECMO cannulation. The neonatologist agreed with this suggested plan.I then went to talk with the baby’s mother. I explained my concerns that based on the profound hypercapnea on the arterial blood gases that the baby’s respiratory failure was due to pulmonary hypoplasia and not reversible with extracorporeal support. For centuries, China’s farmers practiced agriculture in ways that sustained a high level of food production without depleting or deteriorating local resources. These were smallholder farmers, who came to be called peasants, or nongmin, in the early twentieth century. Narratives on the figure of the peasant have changed dramatically and often in the intervening years, expressing broader political debates, and suggesting the question, “what, then, is a Chinese peasant?” This paper attempts to answer that question in the context of reform (...) era China (post-1978). Using a critical discourse analysis of nongmin in contemporary political and popular discourse, the paper aims to further clarify politics on the figure of the peasant in China today, specifically in relation to state policy on rural and agricultural development. The central argument is that in addition to complex meanings and uses of nongmin, a Chinese peasant is also a social category used by political and economic elites to stand in for the ills of China’s agrifood system, and to promote a model of development that tries to separate the country’s current trajectory from its long agrarian history. In the context of state-led agroindustrialization aimed at developing a robust domestic agribusiness sector, both peasants as a social form and smallholding as an agricultural form are targets for capitalist transformation. Put another way, political discourses define peasants and small-scale farming as China’s agrifood “problems” for which further capitalist industrialization is posed as the only and inevitable “solution.” The paper concludes by arguing that changing China’s current trajectory away from the crises of industrial agriculture will require also changing the discursive frame: it is agroindustrialization that is the problem, for which nongmin and China’s tradition of smallholder farming are part of the solution. Understanding of the λ model has greatly increased in recent years as evidenced by most of the commentaries. Some commentators underscored the potential of the model to integrate aspects of different sensorimotor systems in the production of movement. Other commentators focused on not-yet-fully-developed parts of the model. A few persisted in misunderstanding some of its basic concepts, and on these grounds they reject it. In responding to commentaries we continue to elaborate on some fundamental points of the model, especially control (...) variables, the idea of movement production by shifting the positional frame of reference and the hypothesis of biomechanical correspondence in motor control. We also continue to develop our ideas on the intrinsic generation of the frame of reference associated with external space and utilized for the control of arm movement and locomotion. The dynamic principles underlying the model are discussed in light of the dynamical systems approach. (shrink)

Against the easy presupposition that such a thing as ‘democratic taxation’ not only exists but is also practicable, this paper points to the dilemma posed by what I call ‘quantifiable action.’ The essay develops an approach to theorizing the place of taxation in political theory that counters trends in fiscal sociology, political science, and liberal theory by highlighting how taxation presumably violates the requirement that self-government includes an absence of instrumental rationality on the part of democratic citizens. For this reason, (...) taxation presents a persistent problem for any concept of self-government, and may usefully be regarded as a technology of the self, conventional with democracy but at most ambiguous in its capability to be genuinely democratic, both theoretically and practically. This article examines the construction of the collective sexual reputation of fraternity little sisters and how fraternity little sisters interpret and resist it in an effort to maintain their individual sexual reputations. Further analysis shows how fraternity men contribute to the collective sexual reputation and control women in little sister organizations by sexually objectifying and commodifying them, by sending them purposefully vague and conflicting messages about (...) sexual expectations, and by sexually abusing them. In so doing, Hawhee also highlights the integral role of the musical (...) arts to rhetorical and athletic training. Throughout the book, Hawhee weaves together close readings of multiple texts (poetry, oratory, sculpture, painting, architecture) in order to illuminate the intricate “network of overlapping practices” that connect the bodies of rhetoric, athletes, and musicians in Ancient Greece. To this reader, the central strengths of the study are methodological as well as conceptual. In terms of method, Hawhee carefully and with studied finesse integrates close readings of visual, spatial, and verbal texts and practices. In the wrong hands, this type of endeavor can easily appear as the worst kind of pastiche. Not so in this case where Hawhee manages the textual interpretation with deft expertise. Conceptually, the central premise that rhetoric was a practice that was fully embodied and, most importantly, that embodiment was not in a hierarchical relation to reason, rationality, and the mind is provocative. Hawhee argues that the relations of mind-body in Ancient Greek culture were understood as a complex interlocking system that, when trained through physical practices emphasizing rhythm, repetition, and response (to/with an encounter), resulted in the possible transformation of the very nature of the self. [End Page 197]In the process of constructing the argument for the connections between rhetorical and athletic training and performance, Bodily Arts moves through three phases. The Introduction and first three chapters lay the theoretical groundwork for the second phase: the introduction of the concept of phusiopoieses in Chapter 4. Chapters 5–7 then discuss the actual rhetorical and athletic spaces, practices, and bodies of and in phusiopoiesis.The introduction opens with description of a first-century BC bronze statue of an “Antikythera Youth” (3). Hawhee uses the mystery surrounding the identity of the figure (deciphered largely through interpretations of the actions implied by the stature of the statue) to articulate the connections between the body of the rhetor and the body of the athlete as well as to introduce the importance of the body to Greek values of hexis (comportment) and aretē (virtuosity). The Introduction also presents three critical relations that serve both as conceptual departure points as well as hail the multiple audiences of the book: relations of body and mind, learning and performing, and classical studies and rhetorical studies. Hawhee’s perspective is quite straightforwardly that rhetoric is an art that required physical training and physical performance.Chapter 1, “Contesting Virtuosity: Agonism and the Production of Aretē,” connects the values of agon and aretē and argues that the “very logic for linking rhetoric and athletics” lies at the heart of this relation (22). Hawhee argues that agon and aretē are less about ends (victory and virtue) and more centrally concerned with embodied processes. Agon, through Hawhee’s reading of Hesiod’s Work and Days, is articulated as a mode of encounter that produces a particular, and possibly transformative, response. Aretē is the bodily performance of virtuosity. Central to this performance, according to Hawhee’s interpretation of the Olympic ethos through Pindar’s poetry, is the activity of questing. Aretē is demonstrated rather than simply won or attained. Following these definitions of agon and aretē, the chapter moves to illustrating the shared language of rhetoric and athletics in terms of these values. The resurgence of tuberculosis in the United States is due, in part, to the dismantling of large-scale treatment systems that were a critical part of the disease control effort for the better part of the twentieth century. As the number of cases grows, clinicians, politicians, public health officials and community advocates have grappled with the difficult problem of building systems to care for infected people that are consonant with current knowledge and beliefs about quality care. As an example, the United (...) Hospital Fund’s 1992 report, The Tuberculosis Revival: Individual and Societal Obligations in a Time of AIDS, discussed policies to guarantee adequate treatment that protects patients’ civil rights, needs for special facilities for care of TB patients, and the special problems faced by infected prisoners. The United States has pursued policies of urban upheaval that have undermined social organization, dispersed people, particularly African Americans, and increased rates of disease and disorder. Healthcare institutions have been, and can be, a part of this problem or a part of the solution. This essay addresses two tools that healthcare providers can use to repair the urban ecosystem—perspective and solidarity. Perspective addresses both our ability to envision solutions and our ability to see in the space in which we move. (...) Solidarity is our ability to appreciate our fellowship with other people, a mindset that is at the heart of medical practice. A hypothesis about sensorimotor integration (the λ model) is described and applied to movement control and kinesthesia. The central idea is that the nervous system organizes positional frames of reference for the sensorimotor apparatus and produces active movements by shifting the frames in terms of spatial coordinates. Kinematic and electromyographic patterns are not programmed, but emerge from the dynamic interaction among the system s components, including external forces within the designated frame of reference. Motoneuronal threshold properties and proprioceptive inputs to (...) motoneurons may be cardinal components of the physiological mechanism that produces positional frames of reference. The hypothesis that intentional movements are produced by shifting the frame of reference is extended to multi-muscle and multi-degrees-of-freedom systems with a solution of the redundancy problem that allows the control of a joint alone or in combination with other joints to produce any desired limb configuration and movement trajectory. The model also implies that for each motor behavior, the nervous system uses a strategy that minimizes the number of changeable control variables and keeps the parameters of these changes invariant. Examples are provided of simulated kinematic and electromyographic signals from single- and multi-joint arm movements produced by suggested patterns of control variables. Empirical support is provided and additional tests of the model are suggested. The model is contrasted with others based on the ideas of programming of motoneuronal activity, muscle forces, stiffness, or movement kinematics. (shrink)

This article examines gay men’s efforts to break into the exclusive traditional fraternity institution by adopting the hegemonic model on their own terms. The authors examined to what extent members of a national gay fraternity, Delta Lambda Phi challenged or modified the entrenched fraternity culture that was hostile to homosexuals and whether they resisted or reproduced hegemonic masculinity in their efforts to redefine the meaning of college fraternities. This research examines gay fraternities in relation to two dimensions of hegemonic masculinity. (...) The authors explore how members of gay fraternities negotiated their stigmatized status among other men—that is, within the internal dimension of hegemonic masculinity. They explore the external dimension of hegemonic masculinity by analyzing how gay brothers, as men, related to all women. Recent theoretical work has argued that moral psychology can be understood through the lens of “resource rational contractualism.” The view posits that the best way of making a decision that affects other people is to get everyone together to negotiate under idealized conditions. The outcome of that negotiation is an arrangement (or “contract”) that would lead to mutual benefit. However, this ideal is seldom (if ever) practical given the resource demands (time, information, computational processing power) that are required. Instead, the (...) theory proposes that moral psychology is organized around a series of resource-rational approximations of the contractualist ideal, efficiently trading off between more resource-intensive, accurate mechanisms and less. This paper presents empirical evidence and a cognitive model that test a central claim of this view: when the stakes of the situation are high, then more resource-intensive processes are engaged over more approximate ones. We present subjects with a case that can be judged using virtual bargaining—a resource-intensive process that involves simulating what two people would agree to—or by simply following a standard rule. We find that about a third of our participants use the resource-rational approach, flexibly switching to virtual bargaining in high-stakes situations, but deploying the simple rule when stakes are low. A third of the participants are best modeled as consistently using the strict rule-based approach and the remaining third as consistently using virtual bargaining. A model positing the reverse resource-rational hypothesis (that participants use more resource-intensive mechanisms in lower stakes situations) fails to capture the data. (shrink)

In a quantum universe with a strong arrow of time, we postulate a low-entropy boundary condition to account for the temporal asymmetry. In this paper, I show that the Past Hypothesis also contains enough information to simplify the quantum ontology and define a unique initial condition in such a world. First, I introduce Density Matrix Realism, the thesis that the quantum universe is described by a fundamental density matrix that represents something objective. This stands in sharp contrast to Wave Function (...) Realism, the thesis that the quantum universe is described by a wave function that represents something objective. Second, I suggest that the Past Hypothesis is sufficient to determine a unique and simple density matrix. This is achieved by what I call the Initial Projection Hypothesis: the initial density matrix of the universe is the normalized projection onto the special low-dimensional Hilbert space. Third, because the initial quantum state is unique and simple, we have a strong case for the \emph{Nomological Thesis}: the initial quantum state of the universe is on a par with laws of nature. This new package of ideas has several interesting implications, including on the harmony between statistical mechanics and quantum mechanics, the dynamic unity of the universe and the subsystems, and the alleged conflict between Humean supervenience and quantum entanglement. If there are fundamental laws of nature, can they fail to be exact? In this paper, I consider the possibility that some fundamental laws are vague. I call this phenomenon 'fundamental nomic vagueness.' I characterize fundamental nomic vagueness as the existence of borderline lawful worlds and the presence of several other accompanying features. Under certain assumptions, such vagueness prevents the fundamental physical theory from being completely expressible in the mathematical language. Moreover, I suggest that such vagueness can be regarded as (...) 'vagueness in the world.' For a case study, we turn to the Past Hypothesis, a postulate that (partially) explains the direction of time in our world. We have reasons to take it seriously as a candidate fundamental law of nature. Yet it is vague: it admits borderline (nomologically) possible worlds. An exact version would lead to an untraceable arbitrariness absent in any other fundamental laws. However, the dilemma between fundamental nomic vagueness and untraceable arbitrariness is dissolved in a new quantum theory of time's arrow. (shrink)

If the Past Hypothesis underlies the arrows of time, what is the status of the Past Hypothesis? In this paper, I examine the role of the Past Hypothesis in the Boltzmannian account and defend the view that the Past Hypothesis is a candidate fundamental law of nature. Such a view is known to be compatible with Humeanism about laws, but as I argue it is also supported by a minimal non-Humean "governing'' view. Some worries arise from the non-dynamical and time-dependent (...) character of the Past Hypothesis as a boundary condition, the intrinsic vagueness in its specification, and the nature of the initial probability distribution. I show that these worries do not have much force, and in any case they become less relevant in a new quantum framework for analyzing time's arrows---the Wentaculus. Hence, the view that the Past Hypothesis is a candidate fundamental law should be more widely accepted than it is now. (shrink)

This mixed methods study investigates whether technology mediated collaborative practices during a professional development (PD) session led to growth in the collective efficacy of 21 special education teachers at an independent 1-12 school in Southeastern Virginia. This school specializes in individualized instruction for students with learning differences not limited to Autism Spectrum Disorder, Attention Deficit Hyperactivity Disorder, Specific Learning Disability, and their comorbidities. Teacher collective efficacy, which subsumes cohesive perceptions of classroom learning and behavior management, has been shown as strongly (...) related to student achievement and healthy school culture. Mastery experiences with specific tasks related to teaching and learning can spur collective efficacy. Cutting-edge technologies (Vibe and Newline collaborative all-in-one hardware and software interfaces) were used to engage teachers in an interdisciplinary vision boarding activity to outline academic, social, and technological goals within and across subject areas. Teachers also engaged in a behavior management reflection exercise. Pre- and post-survey analysis was conducted using a paired samples t-test, showing overall growth in collective efficacy after the brief PD session. Regression analyses revealed that technology savvy teachers grew most in collective efficacy. Network analysis of vision board output and a descriptive analysis of the behavior management surveys showed that teachers became united in interdisciplinary goals for learning, and in strategies for behavior management through conversational practices. The mathematical structure of realist quantum theories has given rise to a debate about how our ordinary 3-dimensional space is related to the 3N-dimensional configuration space on which the wave function is defined. Which of the two spaces is our (more) fundamental physical space? I review the debate between 3N-Fundamentalists and 3D-Fundamentalists and evaluate it based on three criteria. I argue that when we consider which view leads to a deeper understanding of the physical world, especially given the deeper topological (...) explanation from the unordered configurations to the Symmetrization Postulate, we have strong reasons in favor of 3D-Fundamentalism. I conclude that our evidence favors the view that our fundamental physical space in a quantum world is 3-dimensional rather than 3N-dimensional. I outline lines of future research where the evidential balance can be restored or reversed. Finally, I draw lessons from this case study to the debate about theoretical equivalence. (shrink)

In a quantum universe with a strong arrow of time, it is standard to postulate that the initial wave function started in a particular macrostate---the special low-entropy macrostate selected by the Past Hypothesis. Moreover, there is an additional postulate about statistical mechanical probabilities according to which the initial wave function is a ''typical'' choice in the macrostate. Together, they support a probabilistic version of the Second Law of Thermodynamics: typical initial wave functions will increase in entropy. Hence, there are two (...) sources of randomness in such a universe: the quantum-mechanical probabilities of the Born rule and the statistical mechanical probabilities of the Statistical Postulate. I propose a new way to understand time's arrow in a quantum universe. It is based on what I call the Thermodynamic Theories of Quantum Mechanics. According to this perspective, there is a natural choice for the initial quantum state of the universe, which is given by not a wave function but by a density matrix. The density matrix plays a microscopic role: it appears in the fundamental dynamical equations of those theories. The density matrix also plays a macroscopic / thermodynamic role: it is exactly the projection operator onto the Past Hypothesis subspace. Thus, given an initial subspace, we obtain a unique choice of the initial density matrix. I call this property "the conditional uniqueness" of the initial quantum state. The conditional uniqueness provides a new and general strategy to eliminate statistical mechanical probabilities in the fundamental physical theories, by which we can reduce the two sources of randomness to only the quantum mechanical one. I also explore the idea of an absolutely unique initial quantum state, in a way that might realize Penrose's idea of a strongly deterministic universe. (shrink)

This handbook provides an overview of the research on the changing nature of work and workers by marshalling interdisciplinary research to summarize the empirical evidence and provide documentation of what has actually changed. Connections are explored between the changing nature of work and macro-level trends in technological change, income inequality, global labor markets, labor unions, organizational forms, and skill polarization, among others. This edited volume also reviews evidence for changes in workers, including generational change, that has accumulated across domains. Based (...) on documented changes in work and worker behavior, the handbook derives implications for a range of management functions, such as selection, performance management, leadership, workplace ethics, and employee well-being. This study highlights a range of perspectives offered by 11 international teachers, participating in a cultural immersion experience, as they reflect on how they saw democracy manifested at their school internships. Teachers from six different countries studied and taught in a rural community in the Southern United States, where a medium-sized research university hosted the teachers as part of a federally-funded program during an academic semester. As a part of a larger qualitative research study analyzing the international teachers’ perception of (...) American schooling, data from intercultural sessions, individual interviews, and assigned reaction papers highlighted multiple contradictions between the teachers’ interpretation of democratic ideals and democratic education as they saw manifested in American schools. These narratives highlight the complex forces that shape individuals’ perceptions of democracy as played out in the everyday life of a cultural immersion experience. The researchers suggest that these transnational perspectives can serve as a mechanism allowing Western educators to listen to the “Other” as they interrogate taken-for-granted assumptions about American schooling. Narratives primarily highlight inconsistencies between the goals of citizenship education and the way in which citizenship is promoted or neglected in K-12 classrooms. (shrink)

Perceived discrimination has consistently been shown to be associated with diminished mental health, but the psychological processes underlying this link are less well understood. The present series of four studies assessed the role of a history traumatic events in generating a proliferation of discrimination stressors and threat appraisals, which in turn predict psychological distress (depressive and posttraumatic stress symptoms) (mediation model), or whether prior traumatic events sensitize group members, such that when they encounter discrimination, the link to stress-related symptoms is (...) heightened (moderation model). Each of the studies assessed a different marginalized group in Canada, including Indigenous peoples, Blacks, Jews, and a diverse sample of women. Participants completed measures assessing history of traumatic events, perceived explicit and ambiguous discrimination, discrimination threat appraisals, and symptoms of depression and posttraumatic stress. The four populations varied in their experiences, with Indigenous peoples encountering the highest levels of trauma, discrimination, and psychological distress symptoms. A mediated model was evident among Indigenous peoples and women, possibly reflecting the role of systemic processes that engender discrimination when traumatic events are experienced. There was evidence for a moderating role of a history of traumatic events on the relations between discrimination and depressive symptoms among Jewish and Black participants. Although the hypothesized synergistic effects of traumatic experiences were noted when assessing the relation between perceived discrimination and depressive symptoms among Jews, the presence of trauma blunted these relations among Blacks. The results suggest that trauma-informed approaches to addressing stress-related processes and psychological outcomes need to consider the unique social context of members of various socially marginalized groups. In this short survey article, I discuss Bell’s theorem and some strategies that attempt to avoid the conclusion of non-locality. I focus on two that intersect with the philosophy of probability: (1) quantum probabilities and (2) superdeterminism. The issues they raised not only apply to a wide class of no-go theorems about quantum mechanics but are also of general philosophical interest.

In this paper, I characterize and elaborate on the “Wentaculus” theory, a new approach to time’s arrow in a quantum universe that offers a unified solution to the problems of what gives rise to the arrow of time and what the ontology of quantum mechanics is.

The cerebellum probably obeys the rules of sensorimotor integration common in the nervous system. One such a rule is formulated: the nervous system organizes spatial frames of reference for the sensorimotor apparatus and produces voluntary movements by shifting their origin points. We give examples of spatial frames of reference for different single- and multi-joint movements including locomotion and also illustrate that the process of motor development and learning may depend critically on the formation of appropriate frames of reference and the (...) organism's ability to manage them. We suggest that a solution to the problem of sensorimotor integration may not be trivial and may actually change the mental and experimental paradigms used in the understanding of the cerebellum and other brain structures, [HOUK et al.; SIMPSON et al.; SMITH; TIIACH]. Physical laws are strikingly simple, yet there is no a priori reason for them to be so. I propose that nomic realists—Humeans and non-Humeans—should recognize simplicity as a fundamental epistemic guide for discovering and evaluating candidate physical laws. This proposal helps resolve several longstanding problems of nomic realism and simplicity. A key consequence is that the presumed epistemic advantage of Humeanism over non-Humeanism dissolves, undermining a prominent epistemological argument for Humeanism. Problems in moral philosophy and philosophy of religion can take on new forms in light of contemporary physical theories. Here we discuss how the problem of evil is transformed by the Everettian "Many-Worlds" theory of quantum mechanics. We first present an Everettian version of the problem and contrast it to the problem in single-universe physical theories such as Newtonian mechanics and Bohmian mechanics. We argue that, pace Turner (2016) and Zimmerman (2017), the Everettian problem of evil is no more extreme (...) than the Bohmian one. The existence and multiplicity of (morally) terrible branches in the Everettian multiverse in contrast to the mere possibility of them in the Bohmian universe does not entail there is "more evil" in the former than in the latter. Low probability in the Bohmian case and low branch weight in the Everettian case should modulate how we respond to them in exactly the same way. We suggest that the same applies to the divine decision of creating an Everettian multiverse. For an empirically adequate Everettian quantum mechanics that justifies the Born rule, there is no special problem of evil. In order for there to be a special Everettian problem of evil, the Everettian interpretation must already have been exposed to decisive refutation. In the process, we hope to show how attention to the details of physical and metaphysical theories can and should impact the way we think about problems in moral philosophy and philosophy of religion. The basic concepts of motor control formulated in our target article were derived from specific experiments, a fact which is disregarded in Dalenoort's comments. A purely academic approach to motor control may not result in a clearer understanding of control concepts.

The purpose of this study was to explore whether the performance of the green innovation brought positive effect to the competitive advantage. This study found that the performances of the green product innovation and green process innovation were positively correlated to the corporate competitive advantage. Therefore, the result meant that the investment in the green product innovation and green process innovation was helpful to the businesses. Background: High ethical sensitivity positively affects the quality of nursing care; nevertheless, Chinese nurses’ ethical sensitivity and the factors influencing it have not been described. Research objectives: The purpose of this study was to describe ethical sensitivity and to explore factors influencing it among Chinese-registered nurses, to help nursing administrators improve nurses’ ethical sensitivity, build harmony between nurses and patients, and promote the patients’ health. Research design: This was a descriptive, cross-sectional study. Participants and research context: We recruited 500 nurses (...) from several departments in three tertiary hospitals. The Chinese Moral Sensitivity Questionnaire–Revised version and the Jefferson Scale of Empathy-Health Professionals were used to assess the nurses’ ethical sensitivity and empathy ability, respectively. Fifteen sociodemographic variables were included in the questionnaires. Ethical considerations: Informed consent was obtained from the participants regarding participation and data storage and handling. This program has been examined and supported by the research center of medical ethics and professional ethics of Guilin Medical University. The Approval No. was 2016RWYB04. The whole research process is conducted strictly according to ethical requirements. Results: The valid response rate was 84.40% ( n = 422). The total score of Chinese Moral Sensitivity Questionnaire–Revised was 35.82 ± 8.17. The subscale scores of moral responsibility and strength and sense of moral burden were 21.50 ± 4.91 and 14.33 ± 3.98, respectively. Significant differences were found among age groups, gender, years of working, category of profession, and quality of family communication regarding nurses’ ethical sensitivity ( p < 0.05). Regression analysis showed that the main factors influencing nurses’ ethical sensitivity were gender, years of working, quality of family communication, career satisfaction, and empathic ability. Discussion: Our findings suggest that Chinese nurses’ ethical sensitivity in tertiary hospitals in Guilin is at a medium level. Conclusion: The director of nursing schools and hospitals in China should pay attention to nurses’ ethical sensitivity and should intensify education and training to improve nurses’ ethical sensitivity. Further studies should focus on interventions aimed at improving Chinese nurses’ ethical sensitivity. (shrink)

The relationship between gender and ethics has been extensively researched. However, previous studies have assumed that the gender–ethics association is constant; hence, scholars have seldom investigated factors potentially affecting the gender–ethics association. Thus, using managers as the research target, this study examined the relationship between gender and ethics and analyzed the moderating effect of cultural values on the gender–ethics association. The results showed that, compared with female managers, their male counterparts are more willing to justify business-related unethical behaviors such as (...) bribery and tax evasion, and that the gender difference in ethics becomes more pronounced under the cultural dimensions of collectivism, humane orientation, performance orientation, and gender egalitarianism. This research examines business and psychology students’ attitude toward unethical behavior (measured at Time 1) and their propensity to engage in unethical behavior (measured at Time 1 and at Time 2, 4 weeks later) using a 15-item Unethical Behavior measure with five Factors: Abuse Resources, Not Whistle Blowing, Theft, Corruption, and Deception. Results suggested that male students had stronger unethical attitudes and had higher propensity to engage in unethical behavior than female students. Attitude at Time 1 predicted Propensity at Time (...) 1 accurately for all five factors (concurrent validity): If students consider it to be unethical, then, they are less likely to engage in that unethical behavior. Attitude at Time 1 predicted only Factor Abuse Resources for Propensity at Time 2. Propensity at Time 1 was significantly related to Propensity at Time 2. Attitude at Time 1, Propensity at Time 1, and Propensity at Time 2 had achieved configural and metric measurement invariance across major (business vs. psychology). Thus, researchers may have confidence in using these measures in future research. (shrink)
