Advances in genetics and genomics have raised new questions in trout restoration and management, specifically about species identity and purity, which fish to value, and where these fish belong. This paper examines how this molecular turn in fisheries management is influencing wild and native trout policy in Colorado. Examples from two small Colorado watersheds, Bear Creek and Sand Creek, illustrate how framing trout as genetic bodies can guide managers to care for or kill trout populations in the interest of rectifying (...) decades of genetic disruption caused by human activity. While trout management has typically relied on human intervention, the turn to genetic science is prompting new classifications of lineage and taxa, altering long-standing conservation priorities, and reorienting the manipulation of biological processes such as reproduction and dispersal. As a result, other social and ecological factors may be pushed to the margins of management decisions. These changes warrant greater conversation about the consequences of molecular analyses and the values embedded in trout science and conservation more broadly. (shrink)

In this article I begin by discussing the persistent problem of relations between educational inequality and the attainment gap in schools. Because benefits accruing from an education are substantial, the ‘gap’ leads to large disparities in the quality of life many young people can expect to experience in the future. Curriculum knowledge has been a focus for debate in England in relation to educational equality for over 40 years. Given the contestation surrounding views about curriculum knowledge and equality I consider (...) the thinking of two philosophers, Jacques Derrida and Emmanuel Levinas, and their work on justice, to trouble the curriculum framework and discourse of knowledge promoted through the policy text of The Importance of Teaching: The Schools White Paper (2010) and later associated policy reforms to the General Certificate of Secondary Education (GCSE) curriculum in England. The Schools White Paper aims to make the curriculum more challenging to students by introducing tight controls in terms of the assessment framework and curriculum knowledge. I argue that, when considered through Derrida's perspective on language and meaning and Levinas' view on the ethical responsibility for the other, the reforms present obstacles to the search for a just curriculum. I look to the work of Sharon Todd and Paul Standish for a re-imagination of curriculum as or through relations in the light of Derrida's and Levinas' philosophies. (shrink)

Phenomenology provides a method for disability theorists to describe embodied subjectivity lacking within the social model of disability. Within the literature on body integrity identity disorder (BIID), dominant narratives of disability are influential, individual bodies are considered in isolation, and experiences of disabled people are omitted. Research on BIID tends to incorporate an individualist ontology. In this article, I argue that Merleau-Ponty's conceptualization of “being in the world,” which recognizes subjectivity as embodied and intersubjective, provides a better starting point for (...) research describing the experiences of those with BIID and amputees. Sometimes beliefs that are shared are treated as if they are knowledge in spite of a lack of evidence or even in the face of evidence to the contrary. Beliefs informed by prejudices and ignorance about people with disabilities are often treated as certain and reinforced by social practices. In this paper, I distinguish between knowledge claims and beliefs that are treated as if they are true. I use Wittgenstein’s account of the connection between epistemic and other social practices in (...) On Certainty to consider how it is possible to change beliefs about disability. I draw on Naomi Scheman’s “Forms of life: Mapping the Rough Ground” to consider political applications of Wittgenstein’s thought. I use a Wittgensteinian framework to critique Peter Singer’s claims regarding the lives of disabilities in Practical Ethics. I draw attention to the ways in which unjustified beliefs about disability can inform and be reified through social practices. Likewise, changes in social practices can dislodge common ableist beliefs about disability. (shrink)

One of the debates of recent moral philosophy concerns the question whether moral judgments express “internal” or “external” reasons. According to internalists, if someone knows or accepts a moral judgment then she must have a motive for acting on it. The motive is part of the content of the judgment: the reason why the action is right is a reason for doing it. According to externalists, this is not necessarily so: there could be a case in which I understand both (...) that and why it is right for me to do something, and yet have no motive for doing it. Since most of us believe that an action’s being right is a reason for doing it, internalism seems more plausible. It captures one element of our sense that moral judgments have normative force: they are motivating. But some philosophers believe that internalism, if correct, would also impose a restriction on moral reasons. If moral reasons are to motivate, they must spring from an agent’s personal desires and commitments. This is unappealing, for unless the desires and commitments that motivate moral conduct are universal and inescapable, it cannot be required of everyone. And this leaves out the other element of our sense that moral judgments have normative force: they are binding. Some internalists, however, have argued that the force of internalism cuts the other way. If moral reasons must motivate, and I show you that an action is morally right, I have ipso facto provided you with a motive for doing it. Moral reasons motivate because they are perceived as binding. A good person, according to these internalists, does the right thing because it is the right thing, or acts from the motive of duty. Sports medicine clinicians face conflicts of interest in providing medical care to athletes. Using a survey of college football players, this study evaluates whether athletes are aware of these conflicts of interest, whether these conflicts affect athlete trust in their health care providers, or whether conflicts or athletes' trust in stakeholders are associated with athletes' injury reporting behaviors.

In contrast to the conventional fund management industry with a profit-oriented logic based on risk and return, ethical and faith-based funds should follow the religious principles of their investment-style philosophy. Islamic funds should obey the theological teachings of the primary sources of Islam, the Quran and Sunnah, as stakeholders expect these religious teachings to influence the investment decisions of fund managers. In practice, Islamic fund managers use Accounting and Auditing Organization for Islamic Financial Institutions ’s screening criteria, based on secondary (...) sources of Islam, which allow investments that are only partially halal to be included in their portfolios. This study finds that a more religious logic in screening practices, although impairing diversification, does not necessarily harm performance. Thus, Islamic investment funds, and the wider ethical fund management industry, should, and could, adopt stricter screening criteria that match their investment mandates and bring more ethical business practices to the industry. I shall hear address the question of whether or not feminist philosophers should accept Kantian markers for the boundary between the aesthetic and nonaesthetic realms. I shall look at the way gender operates at the point in Kant's philosophy at which the aesthetic and ethical attitudes intersect: in the experience of the sublime. As we shall see, the later developments within the Kantian system mean that women fit comfortably neither side of the aesthetic/ethical divide and, indeed, fall outside personhood altogether.

Research examining consumer responses to the provision of nutritional information as part of restaurant menus has produced mixed results. In light of pending legislation requiring the provision of nutritional information, the authors examine the how corporate social responsibility impacts consumer service evaluation of restaurants. Findings from three studies demonstrate that the relationship between consumer attitudes toward the disclosure of nutrition information and their subsequent evaluation of the food provider is impacted by CSR-related initiatives. Studies one and two find that consumer (...) evaluations are enhanced when the firm has an existing reputation for CSR and when the firm includes healthy product options as part of the introduction of the nutritional information. Study 3 finds these effects are particularly strong with fast-food restaurants. Overall, the findings suggest that, for some firms, the introduction of the legislation provides an opportunity to strengthen relationships with customers and gain advantage over some competitors. In this paper, I explore the claim that phenomenological accounts grounded in the lived experiences of those most tangibly impacted by social norms related to ability can provide crucial correctives and supplements to the existing philosophical literature on disability. After situating discussions of the body within disability theory and debates over the impairment/disability distinction in philosophy of disability more specifically, I argue that extant models are inadequate for theorizing subjective experiences of living as a disabled person. I then develop an (...) account of the relationship between impairment/disability by drawing upon critical phenomenological approaches to embodiment. In conclusion, I turn to the methodological and metaphilosophical issue of how to conduct ethical inquiry concerning disability. I examine some of the ways that ableist assumptions can inform curiosity, provide examples of disabled people’s accounts of experiencing derivatizing curiosity, and offer suggestions for practices of curiosity that not only avoid epistemic harms, but are actively anti-ableist. Although many women experience harmful behaviors that fit the legal definition of sexual harassment, very few ever label their experiences as such. I explore how psychological ambivalence expressed as sadomasochism may account for some of this gap. Following Lynn Chancer, I argue that certain structural circumstances characteristic of highly stratified bureaucratic organizations may promote these psychological responses. After discussing two illustrations of this dynamic, I draw out the implications for sexual harassment theory and policy.

This article explores the reasons some pregnant women enter maternity homes with the plan to place their babies for adoption. The authors discuss changes in maternity homes over the twentieth century and report on findings from a survey of currently licensed homes in Texas. Next, the authors discuss the findings from fieldwork and in-depth interviews with residents of two maternity homes. They identify three major reasons why birth mothers enter maternity homes: the desire to escape abusive or stressful family lives, (...) the desire to avoid the stigma of placing a child for adoption, and the desire to provide their children, and in some cases themselves, with a stable and loving family life. The authors contend that entering a maternity home with the intention of placing their babies for adoption represents an effort on the part of birth mothers to reconfigure their own, often impoverished family lives. Part-time work schedules are a popular option for many women struggling to reconcile the competing demands of employment and motherhood. They are controversial among feminists because they are associated with job penalties that promote gender inequality. Previous research on this topic has focused on issues confronting women workers in professional and managerial jobs. In this article, we compare and contrast the experiences of women in professional and secondary part-time jobs, drawing on 60 in-depth interviews with mothers working in such “good” (...) and “bad” jobs. We find that mothers at the top and at the bottom of the employment hierarchy face unique disadvantages from their part-time employment to which they respond in different ways. Yet in both instances, mothers assume responsibility for their “choices,” which absolves organizations of blame for exploitation and discrimination against part-time workers. Since 1977, when the _Harvard Educational Review_ published Carol Gilligan's now-classic article "In a Different Voice," in which she argued so persuasively (...) that women and girls must be understood on their own terms, researchers have been discovering, uncovering, and recovering women's ways of knowing, being, thinking, teaching, and learning. _Minding Women_ charts the wealth of thought and writing related to women and girls and education that this process of discovery has produced. _Minding Women_ begins with a "Classics" section—articles that call attention to the lack of research on girls and women and describe the effect this has had on knowledge and society. The contributors then discuss feminist pedagogy, and how it has changed and been refined over time. Girls and young women are the focus of the next section. Too often their voices and viewpoints are excluded from these discussions, so some of their own writings are included here. The book then explores women's educational history, showcasing some of the rich work in this area over the past twenty years. Identity issues are addressed in the final section, acknowledging that substantial differences exist among groups of women and girls on how they experience the world and their roles, prospects, and lives. Conscience is the psychological faculty by which we aware of and respond to the moral character of our own actions. It is most commonly thought of as the source of pains we suffer as a result of doing what we believe is wrong --- the pains of guilt, or “pangs of conscience.” It may also be seen, more controversially, as the source of our knowledge of what is right and wrong, or as a motive for moral conduct. Thus a person (...) who is motivated to act on principle is said to act “conscientiously.” These terms come from the Latin “conscientia,” a direct translation of the Greek “syneidesis.” This ranges in meaning from being aware of something to “knowing something in common with” someone. Knowing something in common with someone can mean sharing his secret, and this puts you in a position to serve as a witness against him. Thus the term came to have a judicial use, to describe one who could bear witness. In certain contexts, “syneidesis” came to mean a state of knowing in common with oneself, and so of bearing witness against oneself. Although these terms appear in Stoic and Epicurean works, conscience did not receive extensive philosophical treatment until the Medieval period, when treatises on conscience became standard. Medieval philosophers distinguished two aspects of conscience, “conscientia” and “synderesis.” Roughly, “synderesis” refers to the ineradicable and infallible basis of conscience in human nature, while “conscientia” refers to the more particular judgments we make about our actions. There are various ways of specifying the two ideas further. In Thomas Aquinas’s account, which became standard, synderesis grasps the basic moral principles which are the first premises of practical reasoning, while conscientia is the conclusion, the act of judging that one ought to perform a particular action. In this paper I argue that the ground of this disagreement is different than philosophers have traditionally supposed. On the surface, the disagreement appears to be a matter of substantive moral judgment: Hume admires the sort of person who rushes to the aid of another from motives of sympathy or humanity, while Kant thinks that a person who helps with the thought that it is his duty is the better character. While a moral disagreement of this kind certainly follows from (...) their views, I will argue that the source of the disagreement lies elsewhere, namely in their different conceptions of action and motivation. This difference leads in turn to a surprisingly deep difference in their conception of our relation to other people, and of what it means to interact with other people. It is his conception of human interaction that leads Hume to think that benevolence is natural while there is something artificial about our motives to act justly and to keep our promises. For Kant, on the other hand, no form of adult human motivation is “natural” in Hume’s sense – all adult human motivation involves the agent’s use of nonnatural concepts such as law or reason. But Kant’s theory of interaction grounds another sense in which it is just as “natural” to be motivated to keep our promises and agreements as it is to be motivated to help each other out when we are in need. This paper takes a novel approach to studying the existence and stability of Nash equilibria in N-firm Cournot–Bertrand oligopolies. First, we show that such games can be monotonically embedded into a game of strategic heterogeneity, so that each firm best responds to the choices of all other firms in a monotonic way. We then show that this monotonicity can be exploited to derive conditions which guarantee the existence of a unique, dominance solvable Nash equilibrium which is stable under all adaptive (...) dynamics. These conditions constitute a strict improvement over existing results in the literature. Finally, we examine the effect on these conditions resulting from additional firms entering the market. My first personal encounter with John Rawls was nearly thirthy years ago, in the early spring of 1974. I say “personal encounter” because of course, by then, we had all been reading A Theory of Justice, even undergraduate philosophy majors at the University of Illinois. I was a senior that year, and applying for graduate school. Jack was chair, and so it fell to his lot to telephone the students who had been accepted by Harvard, to tell us the good (...) news and ask if we had any questions. But in those days Jack stuttered, and he was worried that his stutter might make him difficult to understand over the phone. I mention that, because it explains how it came about that one day the telephone in my dorm room rang, and I answered it, only to hear the world’s greatest living moral philosopher say “This is John Rawls. This paper examines the ethical conundrum between a hospital's ethos of relieving distress, investigation and treatment, and its concurrent duties under English law to administer tests of decision-making capacity and safeguarding protection where it believes the patient may lack this capacity. Delirium, characterised by a precipitous decline in mental functioning exhibiting the shared symptomology of recoverable depressive disorders and terminal dementia, is not uncommon after emergency admission of elderly patients into acute medical hospital wards. The use of functional capacity testing (...) as a benchmark for decision-making capacity for post-discharge residence has been criticised as outdated, conceptually floored, subjective, lacking central guidance, transparent process, and accountability. A study of patient experience demonstrates the potential for hospital misuse of capacity testing, the failure of functional testing to differentiate decision making capacity from the disability of partial cognitive impairment, and how hospital capacity processes can interact and amplify patient pathology thereby decreasing recovery prospects. Prioritisation of mental capacity obligations above thorough investigation of emergent mental pathology and relief of patient anguish, results in extended detention in medical wards lacking bespoke facilities. Further understanding of patient experience is needed to inform policy with interventions tailored to avoid harm and increase wellbeing. (shrink)

This article is aimed at introducing a French discourse analysis model, e.g. the ‘star model’, initiated by the LAA team led by Robert Vion in Aix-en-Provence, to English-speaking researchers. It will be argued that language activity is multi-dimensional and can be traced at various heterogeneous levels of speech productions belonging to macro as well as micro orders. Speakers achieve different varieties of positioning which result in negotiating an interactional space within a pre-given situation. The model is precisely designed to offer (...) a unified and comprehensive view of such heterogeneous phenomena in constant interconnection. In this study, we also intend to illustrate our approach through the analysis of two different corpora. Speakers’ strategies under extreme conditions will be analysed; the various sequences used were taken from a special corpus which we were asked to study as part of a national research programme. In order to illustrate interactional space shifts, we will also use the transcript of a meeting which took place between a patient and a medical investigator in a hospital in Marseilles. (shrink)

ABSTRACT This exploratory study assessed links among children’s moral concern and their ideas about the rights and protection of companion, farm, wild animals and ecosystems. Sixty-one children responded to three interview questions that were coded as either anthropocentric or biocentric in orientation. Results revealed unique links among children’s moral concern and their ideas about the rights and protection of different types of animals and ecosystems. Biocentric moral concern was associated with two protection strategies: 1) advocacy to protect companion animals and (...) ecosystems, and 2) the need for peer support to help protect wild animals. Overall, results revealed the nuanced diversity of children’s moral concern and ideas about the rights and protection of all types of animals and ecosystems. Implications for moral education programs include a balanced approach to foster compassion, environmental awareness, and social justice among youth. (shrink)

The question of education for democratic ‘empowerment and liberation’, and how this might guide pedagogic practice is seldom raised and extremely challenging for social work education today. This chapter takes up the proposition that social work, through its educational practices, ‘can’ deliver on its promise of ‘democratic practice’ if democracy is understood as a process and not a predefined product. We argue that such a process and its embodiment in institutions cannot exist without the formation of radically democratic subjects, people (...) (including social workers) capable of questioning dominant social forms and of creating new forms and practices. Accordingly, this chapter explores the educational implications for social work of the work of the revolutionary theorist, Cornelius Castoriadis (1921–1997). Castoriadis’ philosophy accords a crucial role to democratic pedagogy (paideía) as an essential form of praxis in the creation of a radically democratic, egalitarian and sustainable society. In particular, we examine his idea (against (neo)liberal individualisation) that ‘autonomy’ is simultaneously an individual and social project that begins in, and is always dependent upon, individual and collective self-reflection. This argument is illustrated by examples from the authors’ classroom experiences of teaching both critical reflection and critical social theory to social work students in Australian universities, on the premise that both are indispensable in social work education as a democratic practice for ‘empowerment and liberation’. The chapter outlines a brief discussion of Castoriadis, his main ideas and the pedagogic dimensions of his philosophy before bringing the latter to bear on the authors’ teaching experiences. Disturbances of perception of subjective time have been described in schizophrenia but have not been experimentally studied until now. We investigated how patients with schizophrenia estimate the subjective temporal distance of past personal events, i.e. how these events are perceived as subjectively close or distant in time. Twenty-five patients with schizophrenia and 25 control participants recalled 24 autobiographical memories from four different life periods. They estimated the subjective TD and rated the amount of detail of each memory. Results showed that (...) patients with schizophrenia had a distorted perception of subjective TD. Their memories were significantly less detailed than those of controls and, unlike control participants, the amount of memory detail was not significantly correlated with subjective TD. Poor access to memory detail may account for distortions of perception of subjective time in patients with schizophrenia. (shrink)
