Would you want to be operated on by a surgeon trained at a medical school that did not evaluate its students? Would you want to fly in a plane designed by people convinced that the laws of physics are socially constructed? Would you want to be tried by a legal system indifferent to the distinction between fact and fiction? These questions may seem absurd, but these are theories being seriously advanced by radical multiculturalists that force us to ask them. These (...) scholars assert that such concepts as truth and merit are inextricably racist and sexist, that reason and objectivity are merely sophisticated masks for ideological bias, and that reality itself is nothing more than a socially constructed mechanism for preserving the power of the ruling elite. In Beyond All Reason, liberal legal scholars Daniel A. Farber and Suzanna Sherry mount the first systematic critique of radical multiculturalism as a form of legal scholarship. Beginning with an incisive overview of the origins and basic tenets of radical multiculturalism, the authors critically examine the work of Derrick Bell, Catherine MacKinnon, Patricia Williams, and Richard Delgado, and explore the alarming implications of their theories. Farber and Sherry push these theories to their logical conclusions and show that radical multiculturalism is destructive of the very goals it wishes to affirm. If, for example, the concept of advancement based on merit is fraudulent, as the multiculturalists claim, the disproportionate success of Jews and Asians in our culture becomes difficult to explain without opening the door to age-old anti-Semitic and racist stereotypes. If historical and scientific truths are entirely relative social constructs, then Holocaust denial becomes merely a matter of perspective, and Creationism has as much "validity" as evolution. The authors go on to show that rather than promoting more dialogue, the radical multiculturalist preferences for legal storytelling and identity politics over reasoned argument produces an insular set of positions that resist open debate. Indeed, radical multiculturalists cannot critically examine each others' ideas without incurring vehement accusations of racism and sexism, much less engage in fruitful discussion with a mainstream that does not share their assumptions. Here again, Farber and Sherry show that the end result of such thinking is not freedom but a kind of totalitarianism where dissent cannot be tolerated and only the naked will to power remains to settle differences. Sharply written and brilliantly argued, this book is itself a model of the kind of clarity, civility, and dispassionate critical thinking which the authors seek to preserve from the attacks of the radical multiculturalists. With far-reaching implications for such issues as government control of hate speech and pornography, affirmative action, legal reform, and the fate of all minorities, Beyond All Reason is a provocative contribution to one of the most important controversies of our time. Abstract:This article elaborates a normative Stakeholder Management Theory (SHMT) from a critical theory perspective. The paper argues that the normative theory elaborated by critical theorists such as Habermas exhibits important advantages over its rivals and that these advantages provide the basis for a theoretically more adequate version of SHMT. In the first section of the paper an account is given of normative theory from a critical theory perspective and its advantages over rival traditions. A key characteristic of the critical theory (...) approach is expressed as a distinction between three different normative realms, viz., legitimacy, morality, and ethics. In the second section, the outlines of a theory of stakeholder management are provided. First, three basic tasks of a theoretically adequate treatment of the normative analysis of stakeholder management are identified. This is followed by a discussion of how a critical theory approach to SHMT is able to fulfill these three tasks. (shrink)

In contemporary philosophy of mind and psychiatry, schizophrenic thought insertion is often used as a validating or invalidating counterexample in various theories about how we experience ourselves. Recent work has taken cases of thought insertion to provide an invalidating counterexample to the Humean denial of self-experience, arguing that deficiencies of agency in thought insertion suggest that we normally experience ourselves as the agent of our thoughts. In this paper, I argue that appealing to a breakdown in the sense of agency (...) to explain thought insertion is problematic, and that rather than following the prevailing binary approach which holds that certain features of consciousness go missing while others remain wholly intact, a better explanation involves construing thought insertion as a disturbing or disrupting of the subjectivity (for-me-ness) of experience. The result is that experiencing ourselves as the subject of our thoughts is where future research should be directed, given the robust persistence of this form of self-experience across psychopathological and non-psychopathological cases alike. Corporate governance reforms are occurring in countries around the globe. In developing countries, such reforms occur in a context that is primarily defined by previous attempts at promoting "development" and recent processes of economic globalization. This context has resulted in the adoption of reforms that move developing countries in the direction of an Anglo-American model of governance. The most basic questions that arise with respect to these governance reforms are what prospects they entail for traditional development goals and whether alternatives (...) should be considered. This paper offers a framework for addressing these basic questions by providing an account of: 1) previous development strategies and efforts; 2) the nature and causes of the reform processes; 3) the development potential of the reforms and concerns associated with them; 4) the (potential) responsibilities of corporate governance, including the (possible) responsibilities to promote development, and; 5) different approaches to promoting governance reforms with an eye to promoting development. In this paper I will compare both and explore some impacts of these differences in terms of the way that people of faith have responded to the COVID-19 pandemic, how people have been exposed to the virus through religious sites and festivals, and how religious institutions have responded to the COVID-19 pandemic.

In this critical notice I review the main ideas presented in Peyman Vahabzadeh's thought-provoking investigation into the genesis of new social movements, Articulated Experiences: Towards a Radical Phenomenology of Contemporary Social Movements. I examine two central features of Vahabzadeh's work: (i) its notion of ?ultimate referentiality;? and (ii) the centrality of the role accorded to language in Vahabzadeh's overall theory. I argue that in his stipulation that language is the most fundamental mediating factor in articulation and acts of identification, Vahabzadeh (...) implicitly characterizes language as precisely the sort of privileged essential universality that his theory seeks to avoid. The repercussions of this criticism are not only relevant to the thesis of Articulated Experiences, they are also relevant to the thesis Vahabzadeh defends in his contribution to the present volume. Although the use of stakeholder analysis to investigate corporate responsibilities has burgeoned over the past two decades, there has been relatively little workon howcorporate responsibilities may change for firms with operations in developing countries. This article argues, from a critical theory perspective, that two sets of factors tend to come together to increase the responsibilities of corporations active in developing countries to a full range of stakeholder groups: (a) the different (economic, political, and sociocultural) circumstances under which corporations have to (...) operate in developing countries and (b) several key normative principles, which typically do not come into play in the context of developed countries. Researchers in the psychological sciences have put forward the thesis that various sources of psychological, cognitive, and neuroscientific evidence demonstrate that being conscious of our mental states does not make any difference to our behaviour. In this paper, I argue that the evidence marshalled in support of this view — which I call psychological epiphenomenalism — is subject to major objections, relies on a superficial reading of the relevant literature, and fails to engage with the more precise ways in which (...) philosophers understand mental states to be conscious. I then appeal to work on implementation intentions to demonstrate that an intention's being 'access conscious' enhances its functional role, which makes it more likely that we will successfully carry out our intended behaviour. The result is that consciousness in at least one relevant sense is not epiphenomenal, with further work remaining to be done to show how other kinds of consciousness cause behaviour too. (shrink)

The value of a company’s ethical reputation has become a focal point for management researchers. We seek to join this conversation and extend the research centered on a firm’s ethical reputation. We accomplish this by shifting our focus away from its impact on external stakeholders to its impact on internal stakeholders. To this end, we rely on signaling theory to explain why a firm’s ethical reputation matters to its employees in an effort to bridge the macro–micro research gap. Across two (...) studies, we propose and demonstrate that a firm’s ethical reputation impacts employee subjective career success in form of career opportunities and work–life balance. Given our signaling theory framework, we also identify and explain when two industry-level characteristics operate as boundary conditions that distort a firm’s ethical reputation signaling properties. Specifically, the results demonstrate that a firm’s ethical reputation is positively related to employees’ perceptions of career opportunities and work–life balance. The results of our studies also demonstrate that the relatively high levels of industry competition and industry regulation weaken the positive impact of a firm’s ethical reputation on career opportunities and work–life balance. Theoretical and practical implications are discussed. (shrink)

Evolutionary theory tells us about our biological past; can it also guide us to a moral future? Paul Farber's compelling book describes a century-old philosophical hope held by many biologists, anthropologists, psychologists, and social thinkers: that universal ethical and social imperatives are built into human nature and can be discovered through knowledge of evolutionary theory. Farber describes three upsurges of enthusiasm for evolutionary ethics. The first came in the early years of mid-nineteenth century evolutionary theories; the second in (...) the 1920s and '30s, in the years after the cultural catastrophe of World War I; and the third arrived with the recent grand claims of sociobiology to offer a sound biological basis for a theory of human culture. Unlike many who have written on evolutionary ethics, Farber considers the responses made by philosophers over the years. He maintains that their devastating criticisms have been forgotten—thus the history of evolutionary ethics is essentially one of oft-repeated philosophical mistakes. Historians, scientists, social scientists, and anyone concerned about the elusive basis of selflessness, altruism, and morality will welcome Farber's enlightening book. (shrink)

This paper argues that a number of medical professionals, medical authorities, governments and the World Health Organization, have acted unethically during the COVID-19 epidemic and pandemic by advising members of the public not to wear masks to protect their own health and the health of those around them. Although by April 2020 most authorities have changed their advice to recommend or even compel citizens to wear face coverings and masks when in public, we need to examine the question of failed (...) moral responsibility and the accountability for this erroneous advice. In this widely hailed and long out of print classic of twentieth century philosophic commentary, Professor Farber explains the origin, development, and function of phenomenology with a view towards its significance for philosophy in general. The book offers a general account of Husserl and the background of his philosophy. The early chapters are devoted to his mathematical-philosophical and psychological studies. The refutation of psychologism is present in detail, together with the critical reaction to it. The development of his logical (...) theories in the light of contemporary literature at the close of the 19th century is next considered. The main content of the six Logical Investigations follows, which contribute to the phenomenological elucidation of experience and knowledge. The phenomenological philosophy of logic as developed in Husserl's later writings is then introduced, followed by a discussion of the phenomenological method and its proper function. Farber makes clear his preference for phenomenology as a purely descriptive method and his opposition to have it serve as a last stronghold of metaphysics. Indispensable as groundwork for descriptive philosophical study, this book will deeply interest not only serious students of philosophy and psychology, but also those who are concerned with the philosophical aspects of mathematics, social and natural sciences, law and psychiatry. There has been tremendous growth in the sales of certified fair trade products since the introduction of the first of these goods in the Netherlands in 1988. Many would argue that this rapid growth has been due in large part to the increasing involvement of corporations. Still, participation by corporations in fair trade has not been welcomed by all. The basic point of contention is that, while corporate participation has the potential to rapidly extend the market for fair trade goods, (...) it threatens key aspects of what many see as the original vision of fair trade – most notably a primary concern for the plight of small producers and the goal of developing an alternative approach to trade and development – and may even be undermining its long-term survival. The primary purpose of this article is to explore the normative issues involved in corporate participation in fair trade. In order to do that, however, it first provides a positive analysis of how corporations are actually involved in fair trade. In order to achieve both of these ends, the article draws upon global value chain analysis. (shrink)

Over the last one hundred and fifty years, the extraction and processing of non-renewable resources has provided the basis for the three industrial revolutions that have led to the modern economies of the developed world. In the process, the nature of resource extraction firms has also changed dramatically, from small-scale operations exploiting easily accessible deposits to large, vertically integrated, capital intensive transnational corporations characterized by oligopolistic competition. In the last ten to fifteen years, coinciding with processes of economic globalization, another (...) major change has been occurring as resource extraction industries have been shifting their operations from developed to developing countries. This shift has greatly impacted the populations of these countries and raises a variety of ethical issues. This article investigates the nature of these changes and the ethical issues that arise, focusing in particular on the development impact of the activities of these industries and the potential adequacy of different policy approaches to regulating them. But where do we turn to find a theoretical framework for the study of humor—one that will help to clarify the role that humor (...) plays in the arts and that will help us as well to understand differences in the way individual perceivers respond to humor in art?A superiority theory of humor emerged in classical times and more or less held the stage through the seventeenth century; now, however, though an occasional attempt to revive it is still made,1 superiority theory is usually regarded as far too narrow in scope to be useful as a general account of humor. What are commonly referred to as "release" (or, occasionally, "relief") theories— and associated with Spencer and Freud—were for a time very influential, but are somewhat narrow too in their own way, and furthermore, as Noël Carroll puts it, "have the liability of presupposing hydraulic views of the mind that are highly dubious."2 Incongruity theory, which has been around in one form or another since at least the eighteenth century, dominates contemporary humor theory but is still widely regarded as not quite there yet. And so humor remains somewhat mysterious and elusive. Or not even that. It may be that most people, even teachers in the arts, bypass theory entirely and simply accept humor as a given: an unanalyzable fact of human life. I've sometimes wondered if it may be that we don't want to understand humor, either because we're afraid that this understanding will spoil the game or, just possibly, because we sense that, as a consequence of it, we may discover things about ourselves that we would prefer not to know.Is a well-founded, broadly inclusive theoretical framework for the study and teaching of humor in the arts achievable? I want to propose that it is if [End Page 67] we take incongruity theory a few steps further, integrating an analysis of the humorous situation (that is, what we perceive: the caricature, the witty dialogue, the bit of stage business) with an analysis of what goes on in the perceiver (the humor experience itself).A General Theory of HumorIncongruity theory, though clearly the front-runner these days, continues to be problematic, making too much sense for us to discard it, but not quite enough sense to get us where we need to go. Thus, Carroll concludes his recent overview of this theoretical tradition: "Though promising, the Incongruity Theory of Humor remains a project in need of further research."3 Reading this we may find ourselves wondering, just as we might about some writer or performer who's been on the scene for a good long time, how much longer this centuries-old theoretical approach gets to remain "promising."What have been the major problems associated with incongruity theory? For one thing, it doesn't tell us much about the affective dimension of humor.4 Neither does it satisfactorily explain differences in the way individual perceivers respond. The major weakness of incongruity theory, however, has been a failure to account adequately for all of those instances of incongruity that are not funny: for example, brainteasers, logic problems, and puzzles. One way of dealing with this problem has been to keep adding on exclusionary clauses until the category has been pared down satisfactorily. In other words, humor is based on incongruity, provided that we exclude situations that inspire fear, or are disgusting, or are perceived instrumentally, or are regarded primarily as a puzzle, and so on. But, of course, this is patchwork. There are positive views towards use of science and technology in all Asian countries, and positive views towards use of enhancement in China, India and Thailand. After considering of the widespread use of cosmetic surgery and other body enhancements in Asian countries, and the generally positive views towards letting individuals make choices about improvement of themselves, the paper concludes that we can expect other enhancements to also be adopted rapidly in Asia. There will be future ethical dilemmas emerging from this (...) with concepts of preservation of nature, flow with nature, and definitions of human-ness, along with concepts of harmony and social justice. Matti Häyry’s new book Rationality and the Genetic Challenge discusses the ethics of human genetic modification and the bioethical rationalities that inform the different ethical conclusions authors have advanced. It is aimed at correcting the belief that “only one rationality exists or one morality exists; that those that disagree [with them] are unreasonable or evil.” Häyry argues that there are multiple rationalities, and that even though ethical issues may have solutions within individual rationalities, disagreements that have their root in separate (...) rational approaches cannot be universally solved by intellectual arguments. In debates about the ethics of using new biotechnologies to genetically modify human beings, the normal state is one of fundamental disagreement over almost all of the anticipated uses to which the technology could be put. Häyry’s point is that such a state of affairs is not necessarily due to a lack of reason because there are many, equally valid, ways of being reasonable. (shrink)

The philosophical contemplation of “first philosophy” is as old as Western philosophy itself, and yet “first philosophy” is often eschewed in contemporary philosophical thought. This is because attempts at arriving at a first philosophy have often been steeped in metaphysical thinking that aims at non-finite foundations as the constitutive ground of human reality. However, in our contemporary world in which metaphysical postulates render themselves increasingly outmoded and immaterial, can we still speak of first philosophy today? This is to ask whether (...) or not it may be possible to formulate a first philosophy based on strictly finite principles. This article seeks to demonstrate that the concept of finite “existence” can be read as first philosophy in the contemporary thought of Jean-Luc Nancy (1940–2021). Firstly, a conceptual analysis on the concepts of “being” and “existence” will be carried out with the express purpose of trying to ascertain the meaningful difference between these two concepts in Nancy’s thought, if indeed such a difference exists at all. From this conceptual analysis, it will be demonstrated that Nancy consistently and effectively elevates the concept of finite existence to philosophical primacy above that of non-finite being and, as a result, brings to light the possibility of (re)thinking existence as first philosophy in Nancy’s thought.
