This study examines how different forms of media use predict attitudes toward the development of facial recognition technology (FRT) and applications of it by law enforcement to identify criminal suspects, identify potential terrorists, and monitor public protests. The theoretical framework builds on theories of cultivation and genre-specific viewing to develop hypotheses and research questions. The analyses draw on original data from two nationally representative surveys of the U.S. public conducted in 2020, amid a series of controversies and protests about policing (...) and racial justice. The results demonstrate that overall television viewing and crime media viewing predicted support for multiple uses of FRT, while Fox News viewing predicted support for using FRT to monitor protests. The findings advance our understanding of public opinion toward the technology and its implications for policing, protests, and social justice. (shrink)

Medicalization is the process by which conditions, for example, intellectual disability, hyperactivity in children, and posttraumatic stress disorder, become understood as medical disorders. During this process, the medical community often collectively assigns a label to a condition and consequently to those who would be said to have the disorder. We argue that there are at least two previously overlooked ways in which this linguistic practice may be wrongful, and sometimes, unjust: first, when the initial introduction of a medical label is (...) done without the participation of those individuals who are being labelled, and second, when attempts by those individuals to renegotiate the labels are thwarted or otherwise rendered ineffective. In both cases, we argue, individuals are unfairly excluded from a linguistic practice that would be valuable for them to participate in. Furthermore, we argue that their exclusion depends in part on the authority of the medical institution to ignore their demands for participation. In making this case, we will propose the more general claim that participating in the linguistic processes of determining and renegotiating the words that will be used to describe oneself is an exercise of linguistic agency, a capacity that has both instrumental and intrinsic value. Sleep and mental health are important aspects of human health that work concurrently. However, sleep and mental health disorders are often overlooked and undiagnosed in sport due to the negative stigma associated with them. Evidence suggests that athletes are disproportionately affected by mental health issues and sleep problems. Internal and external pressures contribute to psychological distress. Variable competition times, travel and stress are detrimental to sleep quality. Retirement from sport can deteriorate sleep and psychological wellbeing, particularly for those who retired (...) involuntarily and identify strongly with their athletic role. When untreated, these issues can manifest into a range of clinical disorders. This is concerning, not only for compromised athletic performance, but for general health and wellbeing beyond sport. Previous research has focussed on sleep and health independently among currently competing, or former, athletes. To date, no research has comprehensively assessed and compared sleep complaints and mental health issues between these two cohorts. Moreover, research has failed to obtain data across a variety of different competition levels, sports, and genders, leaving the current scope of the literature narrow. Comorbid conditions, ex-college athletes, and mental health has been the focus of existing literature post-retirement. Future research would benefit from employing both quantitative and qualitative methodologies to comprehensively assess the prevalence and severity of sleep and mental health disorders across current and retired athletes. Research outcomes would inform education strategies, safeguarding athletes from these issues by reducing negative stigmas associated with help-seeking in sport and ultimately increase self-guided treatment. Discussions about the nature of essence and about the inference problem for non-Humean theories of nomic modality have largely proceeded independently of each other. In this article I argue that the right conclusions to draw about the inference problem actually depend significantly on how best to understand the nature of essence. In particular, I argue that this conclusion holds for the version of the inference problem developed and defended by Alexander Bird. I argue that Bird’s own argument that this problem (...) is fatal for David Armstrong’s influential theory of the laws of nature but not for dispositional essentialism is seriously flawed. In place of this argument, I develop an argument that whether Bird’s inference problem raises serious difficulties for Armstrong’s theory depends on the answers to substantial questions about how best to understand essence. The key consequence is that considerations about the nature of essence have significant, underappreciated implications for Armstrong’s theory. (shrink)

According to a well-known argument, originally due to David Armstrong, powers theory is objectionable, as it leads to a ‘Meinongian’ ontology on which some entities are real but do not actually exist. I argue here that the right conclusion to draw from this argument has thus far not been identified and that doing so has significant implications for powers theory. Specifically, I argue that the key consequence of the argument is that it provides substantial grounds for trope powers theorists, (...) but not other powers theorists, to accept one version of the view that properties are powerful qualities. In particular, they have grounds to favour the view that powerful properties are properties with exclusively qualitative natures that ground modal facts. (shrink)

Can aversion from a political ideology lead to rapid, automatic rejection of said ideology? We tested this question in the Israeli political context using a spatial Stroop task to examine whether politically charged left-wing terms would elicit slower verbal latencies. In Study 1 (n = 85), participants were presented with left- and right-wing political terms presented either in a congruent or incongruent spatial location and were asked to verbally indicate only the location of the word. Study 2 (n = 128), (...) replicated this procedure with the Hebrew words for “left” and “right” and examined whether political awareness primes would amplify the effect. Results indicated a slowdown for left-wing related terms above and beyond a congruency effect that was exacerbated under political priming. The slowdown was particularly pronounced among centre-right-wing participants in Study 1, but significant across political orientations in Study 2. Two auxiliary studies rule out the possibility that phonemic features of the words, or spatial preferences could explain these effects. Overall, results support a taboo effect (i.e., implicit aversion) for left-wing political terms. (shrink)

We are in a position today to appreciate the ambiguity of technologies: that they are good, and bad, and neutral and present challenges in different ways. Reading U.S. national nanotechnology documents and histories of nanotechnology, one finds that rhetoric idealizing progress without serious consideration of negative side-effects remains unfortunately fixed within stories constructed about technology. Though we should be better aware of the potential for unintended consequences and negative social effects (and, if anything, we should expect these things), the narratives (...) about nanotechnology today still center on unlimited power over nature, much like technological narratives of eras past. David Nye, in America as Second Creation: Technology and Narratives of New Beginnings, explains how American narratives during the 19th century focused on technology as both transformative and stabilizing. In this time, it seemed as if nature was ready and waiting to be transformed and made useful for the new Americans. While negative effects are predicted and worried about by some elements, the overwhelming voice in discussions of nanotechnology come from the funding agencies, governments, and businesses that seek to profit from it. This article gives us reason to be more skeptical about the types of rhetoric used in this field. The rhetoric used in nanotechnology mimics that of earlier rhetorics of progress. By focusing specifically on narratives of progress within the United States, this article reveals the odd correspondence of rhetoric about nanotechnology with earlier American rhetoric on other technologies. This paper explores the influence of transpersonal thinking, including the mythological perspective of Joseph Campbell and the holotropic perspective of Stanislav Grof, on actor training using the neutral mask. An outline of training in the neutral mask is given, focusing on the approach of David Latham, as experienced by the author in his own training. Points of correspondence with the vision of Campbell and Grof, and their influence, are discriminated and discussed. These correspondences open up two areas of inquiry: (...) the transformative effect of the mask work when conducted in a transpersonally-oriented set, and the use of the neutral mask as an approach to the study of myth and archetype. Both are discussed, and some preliminary conclusions drawn based on experiences reported by student-actors and the author’s observations during his own research and his practice as actor and teacher. Re-contacting minors enrolled in research upon their reaching the age of majority or maturity to seek their autonomous consent to continue their participation is considered an ethical requirement. This issue has generally been studied in the context of minors who are actively involved in the research. However, what becomes of this issue when the minor has been withdrawn from the research or has been lost to follow-up? May researchers re-contact the minor at the age of majority or maturity under these (...) circumstances to seek the consent of the minor to re-join the research? In this paper, we explore the ethical permissibility of recontacting minors whose participation in research has ended, once they have reached the age of majority or maturity. In particular, we identify scenarios in which the participation of a minor in a research project may end and discuss factors that can help determine such an ethical permissibility. Finally, we discuss the practical and ethical challenges of re-contact and present re-consent models that may be used by researchers. (shrink)

Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. We present a one per cent measurement of the cosmic distance scale from the detections of the baryon acoustic oscillations in the clustering of galaxies from the Baryon Oscillation Spectroscopic Survey, which is part of the Sloan Digital Sky Survey III. Our results come from the Data Release 11 sample, containing nearly one million galaxies and covering approximately 8500 square degrees and the redshift range 0.2 < z < 0.7. We also compare these results with those from the publicly released (...) DR9 and DR10 samples. Assuming a concordance Λ cold dark matter cosmological model, the DR11 sample covers a volume of 13 Gpc3 and is the largest region of the Universe ever surveyed at this density. We measure the correlation function and power spectrum, including density-field reconstruction of the BAO feature. The acoustic features are detected at a significance of over 7σ in both the correlation function and power spectrum. Fitting for the position of the acoustic features measures the distance relative to the sound horizon at the drag epoch, rd, which has a value of rd,fid = 149.28 Mpc in our fiducial cosmology. We find DV = at z = 0.32 and DV = at z = 0.57. At 1.0 per cent, this latter measure is the most precise distance constraint ever obtained from a galaxy survey. Separating the clustering along and transverse to the line of sight yields measurements at z = 0.57 of DA = and H =. Our measurements of the distance scale are in good agreement with previous BAO measurements and with the predictions from cosmic microwave background data for a spatially flat CDM model with a cosmological constant. © 2014 The Author Published by Oxford University Press on behalf of the Royal Astronomical Society. Recent attempts by American theorists to produce a radical politics, characterized by the effort to translate the insights of Continental philosophy into a political register, remain trapped in that which they purport to transcend: the metaphysics of subjectivity. In their essential determinations, the works of William Connolly, Stephen White, Richard Ashley, etc. remain firmly anchored in a traditional liberal schema. The reason for this is that while these efforts have sought to de-center political identity by exposing its relational character (...) they have not re-thought 'rela tionality' itself. Our attempt to develop the more profound political impli cations of 'relationality' unfolds through a synthetic explication of Martin Heidegger's analysis of language, Jacques Derrida's logic of the gift, and Emmanuel Levinas' consideration of the Other. The emergent thematic of asymmetrical relationality reconfigures liberalism and provides for a rethinking of the structure of welfare. (shrink)

Darwinism, Democracy, and Race examines the development and defence of an argument that arose at the boundary between anthropology and evolutionary biology in twentieth-century America. In its fully articulated form, this argument simultaneously discredited scientific racism and defended free human agency in Darwinian terms. The volume is timely because it gives readers a key to assessing contemporary debates about the biology of race. By working across disciplinary lines, the book's focal figures--the anthropologist Franz Boas, the cultural anthropologist Alfred Kroeber, the (...) geneticist Theodosius Dobzhansky, and the physical anthropologist Sherwood Washburn--found increasingly persuasive ways of cutting between genetic determinist and social constructionist views of race by grounding Boas's racially egalitarian, culturally relativistic, and democratically pluralistic ethic in a distinctive version of the genetic theory of natural selection. Collaborators in making and defending this argument included Ashley Montagu, Stephen Jay Gould, and Richard Lewontin. In this article we evaluate the BankXX program from several perspectives. BankXX is a case-based legal argument program that retrieves cases and other legal knowledge pertinent to a legal argument through a combination of heuristic search and knowledge-based indexing. The program is described in detail in a companion article in Artificial Intelligence and Law 4: 1--71, 1996. Three perspectives are used to evaluate BankXX:(1) classical information retrieval measures of precision and recall applied against a hand-coded baseline; (2) knowledge-representation and case-based (...) reasoning, where the baseline is provided by the functionality of a well-known case-based argument program, HYPO (Ashley, 1990); and (3) search, in which the performance of BankXX run with various parameter settings, for instance, resource limits, is compared. In this article we report on an extensive series of experiments performed to evaluate the program. We also describe two additional experiments concerning(1) the program's search behavior; and (2) the use of a modified form of precision and recall based on case similarity. Finally we offer some general conclusions that might be drawn from these particular experiments. (shrink)

Anthony Ashley Cooper, the Third Earl of Shaftesbury, was the grandson of the First Earl of Shaftesbury. The First Earl, along with John Locke, was a leader and founder of the Whig movement in Britain. Locke was the First Earl's secretary and also the tutor of the Third Earl. Both the First and Third Earls were members of parliament and supporters of Whig causes. Although both the First and Third Earls were involved in politics, the Third Earl is better (...) known for intellectual pursuits. Indeed, the Third Earl is second only to Locke in terms of influence during the eighteenth century. Yet if one takes into account effects upon literature, the arts, and manners, as well as upon philosophical trends and theories, Shaftesbury might be even more influential. Even if we restrict ourselves to philosophy, Shaftesbury's ideas were admired by thinkers as different as Leibniz and Montesquieu—something which could obviously not be said about Locke. Within ethics, Shaftesbury influenced Francis Hutcheson, David Hume, Samuel Butler, and Adam Smith and is credited with founding the “moral sense” school of thought. (shrink)

One of the most significant disputes in early modern philosophy was between the moral rationalists and the moral sentimentalists. The moral rationalists — such as Ralph Cudworth, Samuel Clarke and John Balguy — held that morality originated in reason alone. The moral sentimentalists — such as Anthony Ashley Cooper, the third Earl of Shaftesbury, Francis Hutcheson and David Hume — held that morality originated at least partly in sentiment. In addition to arguments, the rationalists and sentimentalists developed rich (...) analogies. The most significant analogy the rationalists developed was between morality and mathematics. The most significant analogy the sentimentalists developed was between morality and beauty. These two analogies illustrate well the main ideas, underlying insights, and accounts of moral phenomenology the two positions have to offer. An examination of the two analogies will thus serve as a useful introduction to the debate between moral rationalism and moral sentimentalism as a whole. (shrink)

This chapter focuses on sentimentalism – the view that morality is based on sentiment – in particular, the sentiment of sympathy. Sentimentalism was historically articulated in opposition to two positions: Hobbesian egoism, in which morality is based on self-interest; and Moral Rationalism, which held that morality is based on reason alone. The Sentimentalists challenged both views, arguing that there is more to what motivates human beings than simple self-interest and that reason alone is insufficient to motivate our actions, including our (...) moral actions. The philosophies of Anthony Ashley Cooper, the Third Earl of Shaftesbury, Francis Hutcheson, David Hume, and Adam Smith are considered. This game3 was designed to investigate protocols and strategies for resourcebounded disputation. The rules presented here correspond very closely to the problem of controlling search in an actual program. The computer program on which the game is based is LMNOP. It is a LISP system designed to produce arguments and counterarguments from a set of statutory rules and a corpus of precedents, and applied to legal and quasi-legal reasoning. LMNOP was co-designed by a researcher in AI knowledge representation and by (...) a trained computer scientist who was an editor of Washington University Law Review at the time. LMNOP is based on the idea of a non-demonstrative or defeasible rule: i.e., a rule that admits exceptions. It adopts a representational convention that supposes there is an implicit preference of more specific rules over less specific rules. In fact, it automatically adjudicates between competing arguments when one argument meets the broader criterion of being more specific than another. The convention is based on an idea origianlly presented by David Poole [85], and is embedded in a system of determining which arguments are ultimately warranted, which originally appeared in the literatures of epistemology and ethics, by Pollock [87]. This system evolves from work by the first author since 1987; the full statement of the theory is in [92]. Prakken [92] is one example of the idea’s application to the legal domain. The dissertation traces the development of what I call “the problem of partiality” through the work of certain key figures in the British Moralist tradition: John Locke, Catharine Trotter Cockburn, Anthony Ashley Cooper (the Third Earl of Shaftesbury), Francis Hutcheson, John Gay, David Hume, Joseph Butler, and Adam Smith. On the one hand, we are committed to impartiality as a constitutive norm of moral judgment and conduct. On the other hand, we are committed to the idea that it (...) is permissible, or even obligatory, to expend disproportionate resources promoting the good of our loved ones over the good of strangers. However, these two commitments conflict with one another. This problem challenges us to provide an account of the scope and limits of reasonable partiality that does justice to both commitments. I argue that confronting this tension is a central project of early modern ethics. I offer a rereading of the British Moralist tradition, centered on debates about partiality, and thereby shift discussion of the tradition away from concerns about meta-ethics and moral epistemology, to issues of practical ethics. The topic of partiality remains central in contemporary ethics, as is evident in ongoing debates about the place of empathy in moral judgment, and the role of love in shaping our moral commitments. Though the aim of the dissertation is not to settle questions about the scope and limits of reasonable partiality, the focus here remains fixed on how the concept of partiality was problematized in our ethical thought, and how it informs our discussions in normative ethics and moral psychology. Alongside building a bridge between early modern scholarship and recent work in ethics, the dissertation casts light on two understudied figures in the British Moralist tradition – Cockburn and Gay – who contributed greatly to debates about partiality. By examining their contributions, I reconsider their place in the history of modern ethics and therefore provide a more contextualized account of philosophical thought in the period. (shrink)

Philosophical Virtues and Psychological Strengths brings Catholic philosophical and theological moral thought into direct dialogue with the psychological sciences and aims to establish the basis for developing a common framework of understanding. This volumes thirteen essays illustrate philosophical psychology in a realist mode; the authors have been guided by Pope John Paul II's encyclical letter Fides et ratio and by the virtue theory of St Thomas Aquinas. In these pages, they identify those elements of the Catholic tradition that remain indispensable (...) for sustaining a credible dialogue between Christian doctrine and secular psychology. The carefully selected contributors have established a common language that enables philosophers, theologians, and psychologists to share a profound understanding of the human person. For the Theologian, the interest is both the normative philosophical reflections that steady the interdisciplinary dialogue and the psychological findings that enhance the tradition at the level of understanding human weakness and growth. According to the powerful qualities view, properties are both powerful and qualitative. Indeed, on this view the powerfulness of a property is identical to its qualitativity. Proponents claim that this view provides an attractive alternative to both the view that properties are pure powers and the view that they are pure qualities. It remains unclear, however, whether the claimed identity between powerfulness and qualitativity can be made coherent in a way that allows the powerful qualities view to constitute this sort (...) of alternative. I argue here that this can be done, given a particular conception of both the qualitativity and powerfulness of properties. On this conception, a property is qualitative just in the sense that its essence is fixed independently of any distinct properties, and it is powerful just if its essence grounds its dispositional role. In lieu of an abstract, here is a brief excerpt of the content:164 BOOK REVIEWS the " causes and remedies " of homosexuality (this entails a guarded challenge to the notion of " constitutional " homosexuality) and a special outreach to people with AIDS; a long endnote undertakes to defend the thesis that AIDS can sometmies he, at least in a qualified sense, divine punishment for sexual sin (p. 110 n. 4). Ashley's essay concludes with an apology for any (...) unintended offense resulting from imprecise or otherwise infelicitous expressions of his position; and he suggests that such lapses on the part of the CDF letter itself were " inevitable in a document that had to he brief and directly to the point in order to clear up the ambiguities with which this complex question has been obscured" (p. 109). My personal assessment is that Ashley has succeeded much better than CDF in minimizing such problems; he might have been even more successful had he not been so intent on downplaying or excusing the letter's undeniable faults in this regard. Of course, Ashley is here engaging in debate with the Vatican's critics; were he instead directly addressing CDF, his approach might well have been different. Even in the present context, however, as a better gesture toward gay and lesbian people wounded by the letter's simplistic and harsh prescriptions, it would have been well for Ashley to repeat the observation he once addressed to U.S. and Canadian bishops assembled in Dallas for a sexuality workshop (Feb. 2-6, 1981): "Overfacile solutions to the tragic dilemmas of life which people are experiencing make the Church appear smug and silly." The debate over this issue will continue, as indeed it must. The participants in this hook, notwithstanding problems on either side, have contributed significantly to the ongoing conversation and have set a high standard which we must hope will he emulated by all who carry the conversation forward. Edmund Santurri has written an important book about a central issue in moral theory and a fundamental problem in the moral life. On occasion, one feels on the horns of a dilemma. Whatever course of action might he taken, it appears as if wrong will he done in the process of doing right. Thus, we want to keep promises, but if we keep BOOK REVIEWS 165 this promise, we will cause or allow some great harm to come to an· other person. How ought this sort of dilemma to he understood? Santurri argues that there are within the traditions of moral philosophy and theology two ways of construing the problem. One can say either that moral dilemmas of the sort Santurri discusses are the re· sult of deficient knowledge and so in principle resolvable, or that they stem from the structure of the moral universe itself and are in consequence not resolvable. It is Santurri's contention that Christian ethics must hold to the former position and defend the view that in all dilemmatic contexts there is a way to dispel moral perplexity through more adequate moral knowledge. In order to establish this thesis he undertakes a review of typical philosophical and theological literature that addresses the problem he has identified. Santurri's review of the philosophical literature, though on occasion unnecessarily dense, is always competent and generally thorough. Among others, he reviews the work of David Lyons, Bernard Williams, and Thomas Nagel. His conclusion is that philosophical argument can establish neither of the two possible views of moral dilemma as superior to the other. Arguments designed to establish both points of view prove inconclusive in the end because they beg more fundamental ques· tions concerning the content, nature, and function of morality itself. Thus, Santurri argues that moral perplexity cannot he interpreted adequately apart from a discussion of " certain fundamental questions of moral ontology " (p. 4), and he quite successfully shows that these questions are passed over or inadequately treated in the philosophical literature. A recent, seemingly appealing version of the powerful qualities view defines properties’ qualitativity via an essentialist claim and their powerfulness via a grounding claim. Roughly, this approach holds that properties are qualities because they have qualitative essences, while they are powerful because their instances or essences ground causal-modal facts. I argue that this theory should be replaced with one that defines the powerfulness of qualities in terms of both a grounding claim and a ‘meta-grounding’ claim. Many philosophers have suggested that claims of need play a special normative role in ethical thought and talk. But what do such claims mean? What does this special role amount to? Progress on these questions can be made by attending to a puzzle concerning some linguistic differences between two types of 'need' sentence: one where 'need' occurs as a verb, and where it occurs as a noun. I argue that the resources developed to solve the puzzle advance our understanding of (...) the metaphysics of need, the meaning of 'need' sentences, and the function of claims of need in ethical discourse. It is often taken for granted that our desires can contribute to what it is rational for us to do. This paper examines an account of desire—the ‘guise of the good’— that promises an explanation of this datum. I argue that extant guise-of-the-good accounts fail to provide an adequate explanation of how a class of desires—basic desires—contributes to practical rationality. I develop an alternative guise-of-the-good account on which basic desires attune us to our reasons for action in virtue of their (...) biological function.
