For example, a canon, Si aliquis, concerning contraception was included in the Church's universal law from the thirteenth century until 1917: " I£ anyone for the sake of fulfilling sexual desire or with premediated hatred does something to a man or to a woman, or gives something to drink, so that he cannot generate, or she cannot conceive, or offspring be born, let it be held as homicide." 2 This canon does not say that contraception is homicide ; the tradition made no such mistake. JOHNSTONE, C.Ss.R., pays particular attention to some of my early work in his recent article, " The Structures of Practical Reason: Traditional Theories and Contemporary Questions." 1 He plainly tries to present my views accurately. Still, Johnstone has overlooked some important things I said about the questions he considers. Moreover, in some cases he either misunderstands the (...) positions I tried to explain and defend or, at least, puts matters in ways likely to cause others to misunderstand those positions. They still seem sound to me, although no doubt open to refinement and development. Therefore, since Johnstone is.seriously trying to use my work to advance understanding of important questions, I offer these comments and clarifications to help keep open the way to a more adequate theory of practical reason. I. The first question Johnstone considers is: What is the specific truth of practical reason? To explore this question, he compares the theory of practical reason which I articulated with a " traditional" theory, exemplified by the work of Labourdette. E·arly in this comparison, in pointing out differences, Johnstone offers a summary and criticism: If I understand Grisez correctly, he seeks to develop a theory of practical reason such that practical reason, in itself, can be understood -must be understood-without reference to the will FP,2 1 Tkomist, 50 (1986), pp. 417-46. For practical reason precisely is reason directed to a work, which will not be done without an intervening act of an appetitive power corresponding to reason, and that power is the will. Hence, volition is included in the very concept of practical reason, and so it cannot be understood without reference to the will. But in the place Johnstone cites (FP, p. 193), I did not say that practical reason can be understood without reference to the wilL Rather, having argued that, because practical principles are self-evident truths, they do not presuppose a divine command, I said: "Nor is any operation of our own will presupposed by the first principles of practical reason." The argument for this is: The first operations of will are natural volitions of ends; these volitions presuppose knowledge directing to these ends; the directive knowledge is the principles of practical reason; therefore, the principles of practical reason do not presuppose any operation of our will.3 Moreover, I pointed out: "Of course we do make judgments concerning means in accordance with the orientation of our inNatural Law Forum, 10 (1965), pp. 168-201. The evolutionary theory of threat simulation during dreaming indicates that themes appropriate to ancestral survival concerns (threats) should be disproportionately represented in dreams. Our studies of typical dream themes in students and sleep-disordered patients indicate that threatening dreams involving chase and pursuit are indeed among the three most prevalent themes, thus supporting Revonsuo's theory. However, many of the most prevalent themes are of positive, not negative, events (e.g., sex, flying) and of current, not ancestral, threat scenarios (e.g., schoolwork). Previous research suggests that social anxiety symptoms are maintained and intensified by inflexible emotion regulation (ER). Therefore, we examined whether trait-level social anxiety moderates ER flexibility operationalised at both between-person (covariation between variability in emotional intensity and variability in strategy use across occasions) and within-person (associations between emotional intensity and strategy use on a given day) levels. In a sample of healthy college-aged adults (N = 185, Mage = 21.89), we examined overall and emotion-specific intensities (shame, guilt, anxiety, anger, sadness) (...) and regulatory strategies (i.e. experiential avoidance, expressive suppression, and rumination) in response to each day’s most emotionally intense event over 6 days. During the study period, we found a positive association between variability in emotional intensity and variability of experiential avoidance in individuals with lower, rather than higher, levels of trait social anxiety after controlling for key covariates (i.e. gender, personality traits, and stress exposure). However, we did not find evidence for the moderating role of trait social anxiety in ER flexibility assessed at within-person levels. Our findings highlight the need to delineate dynamic ER flexibility across everyday events. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:BOOK REVIEWS 155 Humanae Vitae: A Generation Later. By JANET SMITH. Washington, D.C.: The Catholic University of America Press, 1991. Pp. xvi + 425. $42.95 hardcover; $17.95 paper. This is an ambitious and important study. I will first offer an overview of the volume to indicate its scope and note some of its major features. I will then respond briefly to some of the major criticisms Smith makes of (...) the argument against contraception advanced by Germain Grisez, Joseph Boyle, John Finnis, and myself. The work contains 8 chapters and 4 appendices. Chapters 3 and 4, as Smith says, "provide an analysis of Humanae Vitae itself and thus constitute the heart of the hook" (p. xi). Since this is so I will first summarize briefly Chapters 1, 2, 5, 6, 7, and 8 and then center atten· tion on the two central chapters and the four appendices. Chapters 1 and 2 provide the context for Humanae Vitae. The first chapter is devoted largely to an account of the so-called " Minority " and "Majority" documents of the Papal Commission for the Study of Problems of the Family, Population, and Birth Rate, while the second seeks to summarize Catholic teaching on Christian marriage prior to the encyclical. This summary draws principally from Pius XI's Casti Connubii and from nn. 47-52 of Vatican II's Gaudium et Spes. Smith takes up in some detail the issue of the" primacy" of procreation, concluding that Gaudium et Spes " seems to sidestep " this issue which, in her judgment, is irrelevant to the question of contraception. She thinks that this central document of Vatican II sent " mixed signals " on the question of contraception, although she believes that several passages " can very plausibly he read to support the position that contraception is portrayed as a violation not only of the procreative good of marriage hut also of the values of conjugal love" (p. 66). Chapter 5 deals with a wide range of theological issues: the biblical foundations for the teaching found in Humanae Vitae, the relevance of the concept of munus for this teaching, the possibility of acting " in good conscience " in a way contrary to its teaching, and the infallibility of the teaching. Of special value is the extended discussion of the con· cept expressed by the Latin term munus. Smith examines the rich meaning of this term in several magisterial documents, including Gaudium et Spes as well as Humanae Vitae. While a munus implies duties, it is essentially a noble, honor-bringing "gift" or "reward," signifying a vocation and sublime honor. Paul VI, in developing the integral vision of marriage in his encyclical, uses this concept to show that God, in giving to spouses the munus of handing on new life, has conferred on them the honor of sharing with him in the work of bring· 156 BOOK REVIEWS ing new life into the world. Smith shows beautifully how the rich theological meaning of this term helps " illuminate and enrich " the teaching of the encyclical. Chapters 6 and 7 investigate the arguments presented by dissenting theologians after Humanae Vitae to justify their repudiation of its teaching. In Chapter 6 Smith considers the views of Charles Curran and Bernard Haering, while in Chapter 7 she examines the proportionalist approach to moral issues developed by Joseph Fuchs, Richard McCormick and others. She provides intelligent criticism both of Curran and Haering and of proportionalist thought, focusing on the repudiation of specific moral absolutes. In Chapter 8 Smith provides a very helpful summary of Pope John Paul II's understanding of the human person, human sexuality and marriage. In particular, she takes up his notion that in marriage and in the act proper rto it man and woman make a " gift " of themselves to one another. Simultaneously to choose to give themselves to each other in the marital act and to contracept is then seen to involve an inner contradiction, a falsification of the " language of the body " (pp. 230258 ). Smith also takes up some of the major criticisms levelled against John Paul II's thought, in particular Lisa Sowle Cahill's, which charges him with an overromantic view of love and a failure to recognize that... By AURELIO A.NSALDO. Roma: Pontificia Universita Lateranense, 1990. Pp. xiii+ 255. This unusually excellent and important doctoral dissertation was written in Rome at the Istituto Giovanni Paolo II per Studi su Matrimonio e Famiglia, a component of the Lateran University. The author currently teaches at the Ateneo Romano della (...) Santa Croce in Rome. The volume is of special importance for three reasons: (1) it provides a comprehensive, detailed, and accurate account of the moral theory developed by Germain Grisez and John Finnis over the past quarter century (Joseph Boyle has also made important contributions to this theory, and Ansaldo has noted these); (2) it defends Grisez and Finnis against many of the criticisms which have been unjustly leveled against their thought; and (3) it raises some critically import· ant issues by way of constructive criticism. In what follows I will briefly comment on the first and second features of Ansaldo's work and discuss more fully the third important component of his scholarly study. In the first part of his work (pp. 3-100), Ansaldo offers readers a splendid synthesis of the thought of Grisez and Finnis. He has carefully studied everything written by these authors from 1964 to 1988. He has included important material from Finnis that had escaped even my attention, and I have tried to study everything these authors have written. He has also succeeded in presenting their thought comprehensively and faithfully. He understands what they think, appreciates it, and presents it accurately. In short, he does justice to their thought. In this respect his study is quite superior to another doctoral dissertation, Russell Hittinger's A Critique of the New Natural Law Theory. Hittinger's work has been severely criticized, and rightly so, not only by Grisez but by others (e.g., Robert George and William Marshner) ; it seriously misrepresents the work of Grisez and Finnis. A criticism of this sort cannot be levelled against Ansaldo's work; it provides an accurate and very scholarly account of their thought. In the second part of his study (pp. 103-229) Ansaldo offers a critical assessment of the work of Grisez and Finnis. Here he first shows that many of the criticisms leveled against their thought are unjust and unfounded, particularly those offered by such writers as Veatch, Rittinger, Flicken, Bourke, et al. These writers charge that Grisez and Finnis fail to show how moral principles are rooted in metaphysics and anthropology, that they completely separate ethics from metaphysics, natural law from human nature, etc. Ansaldo, by a patient and thorough BOOK REVIEWS 888 examination of their thought and the thought of St. Thomas, defends Grisez and Finnis from these misguided criticisms. He shows, first of all,,that Grisez and Finnis are correct (and fully in accord with St. Thomas) in holding that our krwwledge of the primary principles of natural law is not derived from our knowledge of metaphysics or of human nature. By referring to appropriate texts of Grisez and Finnis, Ansaldo shows conclusively that these authors explicitly recognize the intimate rela· tionship between ethics and metaphysics, between natural law and human nature. They fully and explicitly recognize that, were our na· ture other than it is, namely, the nature of human beings, the goods pedective of us would be other than what they actually are. When these goods are grasped by practical reason, they serve as starting points or principles of purposeful human action. Nonetheless, our practical krwwledge of these goods, is not epistemologically derived from or dependent upon prior knowledge, speculative in character, of human nature. In short, in contrast to their critics and in conformity with St. Thomas, Grisez and Finnis are correct in holding that our practical understanding of the primary principles of natural law is not dependent upon our prior understanding of metaphysics or human nature. At the same time they explicitly acknowledge and defend the truth that onto· logically ethics is grounded in metaphysics and anthropology. This first volume in a series entitled Founders of Modern Political and Social Thought, by John Finnis, Professor of Law and Legal Philosophy at Oxford, is the most comprehensive and detailed treatment in print of Aquinas’s political and ethical thought. Finnis is already well known for his 1980 book, Natural Law and Natural Rights, his Thomistic-inspired theory of “basic human goods” in Fundamentals of Ethics, and his attack on the morality of nuclear deterrence, written with Joseph Boyle and Germain (...) Grisez. The present work is an effort to understand and critique Aquinas’s political and ethical thought as philosophy rather than theology, to correct what Finnis considers “one-sided or wrong” beliefs about his thinking, and to see how well it stands up as “a critical theory” today. Thanks to modern technology, Finnis is able to draw upon the full sixty volumes of Aquinas’s works, over 8.5 million words, rather than restricting the discussion as earlier works have done, to the early Commentary on the Sentences, the two Summas, and his advice to the King of Cyprus. When William May first wrote Catholic Bioethics and the Gift of Human Life, his position was that to perform a craniotomy on a child to save the mother’s life constitutes a direct abortion and is not justifiable. In later editions, May rejected his earlier position in favor of one he originally argued against, most notably by Germain Grisez. The author maintains that the argu­ments surrounding craniotomies on the unborn are still of major relevance today, because they relate directly to (...) certain controversial techniques used to manage ectopic pregnancies. I discuss Eckhart’s and Aquinas’ conception of human-divine union with reference to what I call the problem of intrinsic goods, a problem concerning how to reconcile the pursuit of actions which are prima facie sought for their own sake (e.g. pursuing justice for the marginalized, listening to a work of music) with the pursuit of God as the ultimate end of every action. I introduce the problem with the help of Germain Grisez’s critique of Aquinas’ account of union with (...) God, and I suggest that Eckhart’s alternative conception of union may be understood as an attempt to resolve (or dissolve) the problem. (shrink)

In this paper, we elucidate an alternative conception of the “end of human life” that Germain Grisez considers but never develops. We then defend this conception against two key objections. We conclude by explaining a few ways that this alternative conception of the “end of human life” is particularly important both theologically (e.g., for interfaith discourse) and philosophically (e.g., for understanding the traditional Christian conception of human nature and, hence, of natural law).

The NCCB Committee has received a series of statements of clarification of policy from U.S. government officials. Essentially these statements declare that it is not U.S. strategic policy to target the Soviet civilian population as such or to use nuclear weapons deliberately for the purpose of destroying civilian population centers. Stephen Brock's book provides both a magisterial and (...) a definitive answer to this question.Like fine wine, this book has been fermenting and maturing for almost thirty years. Originally a doctoral dissertation, this recently published work has been rewritten, and to a certain extent, reworked by the author with respect to some of its content.Without disregard for nuances, the first chapter introduces the reader to four different groups of Aquinas's interpreters. The first two groups question the full legal character of the natural law in its dependence to the eternal law. The third one questions its naturalness. The fourth group, instead, upholds both the divine origin of the natural law's full legality in its dependence on the eternal law, as well as its natural character.Brock places Dom Odo Lottin, Wolfgang Kluxen, Germain Grisez, and John Finnis in the first group. This work reviews and critically evaluates contemporary American Catholic moral theological reflections, both non-magisterial and magisterial, from 1975 to the present. It also considers relevant reflections from papal and papally related literature, and from the older tradition. It examines the following: criteria used in distinguishing between "ordinary" and "extraordinary" means, e.g., benefit and burden; miscellaneous elements employed in regard to these means, e.g., treatment and care; definitions given for these means. Based on the results of the foregoing, it proposes original (...) working definitions of these two main types of means. ;This work confirms the need, already recognized by some moral theologians, for a broad foundational criterion on which to base contemporary definitions of and distinctions between "ordinary" and "extraordinary" means. Pp. 371. $39.95 (cloth). As the editor of this volume, Robert P. George points out in his foreword that this hook is yet another manifestation of the renewed and growing interest in natural law theory. But why this recent increased interest in natural law theory? What purpose is this theory supposed to (...) serve, or in what way do its proponents see it as an improvement on existing theories? First of all, it must be noted, as the variety of essays in this volume makes abundantly clear, that natural law theory, as it is presently conceived, most certainly does not represent anything like a unified, single theory of tightly knit principles and conclusions. In the present volume one can easily see a half-dozen or more different approaches to natural law theory. So different in tone and spirit are some of the essays that one can easily wonder if they have enough in common even to classify them as " family resemblances." But if they all in their different ways do indeed evidence, as the editor claims, an increased awareness of and interest in natural law theory, the question immediately arises, why this increased interest? What problems do the advocates of these theories hope to solve by them or what questions do they think their theories will better address than the theories currently in place? First of all, one may make a division which places the theories, however divers~ among themselves, into two general groups. The first of these groups wishes natural law theory to function as a general approach to morality. For this group natural law does the work of a moral theory. In this group I would place the essays of Joseph Boyle, Robert George, Russell Bittinger, John Finnis, and Hadley Arkes (probably). The second group uses natural law theory as a way of determining the connection between moral law and positive law or legal theory. The essays of Jeffrey Stout, Neil MacCormick, Jeremy Waldron, Michael Moore, Lloyd Weinreb, Joseph Raz, and Ernest Weinrib fall into this second category. In all there are twelve essays in this volume. Space will not permit me to give a detailed analysis and critique of each. At most I can only indicate very briefly some of their more salient features. The book is divided into four parts, the first of which is titled "Natural Law, Practical Reasoning and Morality." In the very illuminating first essay of this section, "Natural Law and the Ethics of Traditions," Joseph Boyle undertakes to clarify the question of the relation of natural law theory to tradition. Certain approaches to moral theory currently popular BOOK REVIEWS 147 which are called virtues ethics, of which Alasdair Macintyre would he an example, claim that natural law theory is tradition-dependent. If Macintyre and other virtues ethicists are correct, then since natural law theory is culture-hound, and since the culture in which it was horn and flourished, medieval culture, has irretrievably retreated into the pages of history, then natural law theory is equally dead, of interest, if at all, only in an antiquarian way. Boyle carefully points out that there is more than one sense of being tradition-dependent. It is true that natural law theory is tradition-dependent in the sense that it did indeed come into existence in a particular historic epoch and that its language and thought do indeed express the period of its flourishing, i.e. the medieval period. But this, Boyle is careful to point out, does not mean that its validity and meaning were exhausted with the end of that culture. Rather the tradition is a living tradition so that its rich resources can continue to be exploited as that tradition is enlarged by its application to present day moral problems. Boyle's conclusion then is that in some senses natural law is indeed dependent on an ancient and medieval tradition, hut not so totally dependent that it has lost all validity for contemporary moral theory. New York: Free Press, 1992. xxi +616 pp. $24.95. Last summer in Paris, sitting at one of the sidewalk tables that line the Boulevard S. Germain, a young Jesuit priest just finishing his doc· toral studies narrated some of the horror stories associated these days with " the joh market." (...) Having suffered through my own variation on that theme, I could only share with him the results of my own experi· ence. This novelty in the Jesuit stance provides Peter McDonough with a major theme in his narrative, for he describes the change in the So· ciety " from a rule-governed hierarchy to a role-driven network " (p. 459). He locates this transition in what he calls " the American century," roughly from 1900 to 1965. McDonough's study, an exciting and profitable read, traces the shift from Aquinas to the Age of Aquarius. Especially for an extern (i.e. a non-Jesuit), he has taken on a formidable challenge. Generally well received by the Jesuits, Men Astutely Trained tells how American Catholicism moved from an immigrant church to an upwardly mobile society. In the shifting loyalties, aggravated by the Second Vatican Council, Jesuits and their institutions felt the crunch. Since this innovation, loosely identified with " the democratization of culture," has precipitated the Society of Jesus "into the most serious crisis in its history " (p. xiv), McDonough must do a counterpoint he· tween the inner life and its external expressions. So the saga gains both breadth and depth. Without denigrating the accomplishment, at once earnest and literate, I want to take issue with the hook. As one of my colleagues taught me many years ago, we cannot stimulate discourse if everybody is con· tinually agreeing. First then, I want to comment on the flawed methodology. Next, I will say something about its thesis and conclude with a few reflections on "modernity." For Jesuits of my generation, the work of Malinowski proved normative. The anthropologist spent ten years among the natives who in· habited the Trobriand Islands in Melanesia. It apparently took that long for him to understand the stories and symbols, their myths and rituals. When he put his encyclopedia together, he could describe their institutions and social structures. In short, he worked from the inside out. McDonough, on the other hand, works from the outside in. In my 711 712 BOOK REVIEWS opinion, this represents a major failing in methodology. Two consequences flow from this deficiency. The author is never able to relate the works of the Society to the principal texts of the Society. The Spiritual Exercises, for example, does not rate even a mention. The Constitutions merits a fleeting reference on p. 160. St. Ignatius himself does not appear. Divorced as he is from the principal experience of Jesuits, our author cannot provide an adequate understanding for any of their priorities. This awareness makes his claim to present "the inside of the Society of Jesus" (p. 462) somewhat pretentious. Because he does not have the interior life in focus, many of the readings strike me as unnecessarily cluttered. He has yet to recognize the validity of John Stuart Mill's principle, "No man's synthesis can be greater than his analysis." While he has not left out three-fourths the data, perhaps he has neglected one-half. Secondly, he does not acknowledge Jesuits principally as churchmen. Instead, he makes us look like an acephalous torso. The church-con· nection reveals a major dimension to understanding the Society's coherence and institutions. It does not occur to the author that Jesuit priests are also bound to the universal discipline of the Church as found, for example, in the Codex Juris Canonici (1917). According to the Pio-Benedictine Code, all priests (and not just Jesuits) are expected to recite the breviary, to stay away from politics, and to avoid all "spectacles" including baseball games. Moreover, it is not entirely true to say that Jesuits acted independently of local bishops. My own reading of the literature on dissent inclines me to concur with the substance of this judgment. Broad historical, cultural, and theological contexts have inevitably been neglected as the (...) issues raised by public dissent have come to be narrowly conceived in terms of academic policy and ecclesisastical law and discipline. The objective of this paper is to explore the larger theological context of the topic of public dissent and in particular to consider Neuhruus' judgment that the "present Roman Catholic preoccupation with church authority is... theologically debased because it fixes attention not upon the truth claims derived from God's self-revelation but upon who is authorized to set the rules for addressing such truths, if indeed they are truths." 1 A Perspective on the Current Debate The attitude of " dissent " as such would normally be expected to occupy only a subordinate place in accounts of the nature of theological thinking. Intellectual inquiries are usually undertaken with a view to affirmation and oonstruction rather than critique and dissent. Despite the volume of literature which it has spawned, the current debate in fact reflects this expectation. This dissertation had three purposes: present the system of natural law developed by Germain Grisez and John Finnis; display and examine their quarrel with that group of moralists they label "proportionalists;" adjudicate crucial areas of conflict to advance a person-centered fundamental morality. ;Chapter One presented the Grisez-Finnis system. It noted: their emphasis on intentionality, as opposed to metaphysical anthropology, as the ground of their theory of practical reason--morality; and their identification of objective principles for grounding moral absolutes. ;Chapter Two (...) detailed their critique of the "proportionalists," including Richard McCormick S.J. These are charged with: violating value incommensurability by trying to determine rightness by simple weighing; neglecting the way willing shapes an agent's basic dispositions--moral character, particularly in intending means; and, emphasizing emotional attitude as constituting moral character instead of recognizing attitude--character as one's "volitional self-disposition," to be ordered and constrained by rational principles. ;Chapter Three presented proportionalist responses to the critique. While some incompleteness and vagueness was observed, the fundamental charges of Grisez and Finnis seemed to be unconfirmed. ;Chapter Four further examined two crucial disputed areas: the possibilities of justifying actions by ordering values; the way intention--action impacts on moral character. Use was made of tools provided by the theorists already considered, with additional insights from: other natural law theorists, e.g. H. Veatch; R. Sokolowski's phenomenological perspective; and some elements of a nuanced noncognitivism. A person-centered point of view was established as key to valuing and justifying. ;I concluded that a person-centered morality did offer a higher good in light of which basic goods could be ordered, opening some possibility of "Doing Evil to Achieve Good", i.e. using harmful means for a proportionately good end. Personal moral goodness was identified in terms of one's basic commitments--basic volitional and emotionl self-dispositions. Background Journal editors are responsible for what they publish and therefore have a duty to correct the record if published work is found to be unreliable. One method for such correction is retraction of an article. Anecdotal evidence suggested a lack of consistency in journal policies and practices regarding retraction. In order to develop guidelines, we reviewed retractions in Medline to discover how and why articles were retracted. Methods We retrieved all available Medline retractions from 2005 to 2008 and a (...) one-in-three random selection of those from 1988 to 2004. This yielded 312 retractions (from a total of 870). Details of the retraction including the reason for retraction were recorded by two investigators. Results Medline retractions have increased sharply since 1980 and currently represent 0.02% of included articles. Retractions were issued by authors (63%), editors (21%), journals (6%), publishers (2%) and institutions (1%). Reasons for retraction included honest error or non-replicable findings (40%), research misconduct (28%), redundant publication (17%) and unstated/unclear (5%). Some of the stated reasons might have been addressed by corrections. Conclusions Journals' retraction practices are not uniform. Some retractions fail to state the reason, and therefore fail to distinguish error from misconduct. We have used our findings to inform guidelines on retractions. (shrink)

Just how is obscure. The logic of discovery is elusive; and it is harder to explain how we have come to see matters rightly than to recognize that we do, in fact, see them rightly. What counts as a theory, moreover, calls for explication as much as does a theory's emergence. (...) When we have in mind a theory that shapes our social vision, there is a progression from a central set of propositions, keyed to a range of paradigm cases and seen as a logical structure, to a " way of thinking " widely enough embraced to have political significance, at least for a given oommunity. In this essay I want to explore some fundamental questions raised by Germain Grisez's theory of natural law ethics.1 These questions are chiefly conceptual. But neither they nor Grisez's theory should be seen in a vacuum. Rather, I would begin by suggesting that the importance of his work, its emergence in some Catholic circles, is linked with two specific moral and political problems. And why should abortion so engage Catholic thinkers, some of whom had felt a distance from explicitly Catholic positions, that Grisez's work should become pivotal? Answers to such questions must be tentative, but they include the following considerations. In a brief period, no more than a decade, legal abortion in the West became entrenched social policy.8 It was a policy, too, supported by dominant intellectual forces. But the new policy, defended in terms of individual freedom and a right to privacy, struck many Catholicsand non-Catholics-as vicious and tragic. It was vicious in that it made expendable the weakest and most vulnerable human beings. Human rights somehow became restricted to the strong and self-sufficient. The policy was tragic in its denial of human community. We are not, however much radical individualism supposes, merely a collection of separate egos. l/Ve are, rather, a community tied to a past and pledged to a future, so pledged, in part, by the children we bear and nurture.4 For in hearing and nurturing children we carry on the love of parents who have done as much for us; and we carry ourselves into a future where we hope our own love will be thus extended. However, he reflects that the most underdeveloped feature of proportionalism is its value theory by which we are enabled to know how to (...) resolve conflict situations.2 Richard McCormick, among others, has attempted to meet this deficiency by ·adopting John Finnis' notion of associated basic goods. In this essay, I will show how such an ·approach fails to remain true to the basic aims of proportionalism. Nor should this come as a surprise, since Finnis is himself indebted to one of McCormick's archopponents, Germain Grisez. Moreover, I will attempt to outline the elements involved in a non-hierarchfoal theory of value which I will argue to be the only adequate alternative to McCormick 's attempted solution. Deontologists argue that certain acts are right or wrong regardless of the ·consequences. Proportionalists, however, are opposed to such notions as an " intrinsically evil " act or an "absolute" duty, since they recognize the existence of moral dilemmas. A moral dilemma arises whenever there is a situation in which pre-moral values •are in conflcit, i.e., whatever choice one makes will result in the omission or harm of one or other of the values at stake. McCormick's initial description of the requirements of proportionate reason [s ias follows: "a) a v1alue at least equal to that sacrificed is at 1 stake; b) there is no less harmful way of protecting ithe value here and now; c) the manner of its protection here and now will not undermine it in the long run." 8 McCormick argues that it simply will not do to claim that the ontic evil permitted or caused in a conflict situation is always only indirectly intended.4 For, in many instances, this simply is not true. Moreover, he would argue that to intend an end is not necess1arily to desire it as deontologists suppose. What justifies the ontic evil resulting from such actions, then, is solely the proportionate reason for which it is allowed or caused. There are some obvious criticisms that have been hurled at this proportionalist proposal for resolving conflict situations: I) that it leaves itself open to the practical, if not theoretical, difficulty of weighing different values;!2) that it results in the possibility of many resolutions that could go counter to our normal moral intuitions; 8) that there exists an inherent fallibility in the calcul,ation of long-range consequences; and 4) that this uncertainty might easliy promote an undesirable attitude of skeptical relativism. It is perhaps the onslaught of these and other criticisms which prompted McCormick to adopt Finnis' theory of associated basic goods. Background: Breaches of publication ethics such as plagiarism, data fabrication and redundant publication are recognised as forms of research misconduct that can undermine the scientific literature. We surveyed journal editors to determine their views about a range of publication ethics issues. Methods: Questionnaire sent to 524 editors-in-chief of Wiley-Blackwell science journals asking about the severity and frequency of 16 ethical issues at their journals, their confidence in handling such issues, and their awareness and use of guidelines. Results: Responses were obtained (...) from 231 editors (44%), of whom 48% edited healthcare journals. The general level of concern about the 16 issues was low, with mean severity scores of <1 (on a scale of 0–3) for all but one. The issue of greatest concern (mean score 1.19) was redundant publication. Most editors felt confident in handling the issues, with <15% feeling “not at all confident” for all but one of the issues (gift authorship, 22% not confident). Most editors believed such problems occurred less than once a year and >20% of the editors stated that 12 of the 16 items never occurred at their journal. However, 13%–47% did not know the frequency of the problems. Awareness and use of guidelines was generally low. Most editors were unaware of all except other journals’ instructions. Conclusions: Most editors of science journals seem not very concerned about publication ethics and believe that misconduct occurs only rarely in their journals. Institutional investors are increasingly becoming active owners through voting their shares and engaging in dialogue with investee companies to improve corporate environmental, social and corporate governance (ESG) performance. This article applies a model of stakeholder salience to the shareholder context, analysing the attributes of power, legitimacy and urgency, to determine the factors that are likely to enhance shareholder salience. This paper is a contribution to the study of equality-free logic, that is, first-order logic without equality. We mainly devote ourselves to the study of algebraic characterizations of its relation of elementary equivalence by providing some Keisler-Shelah type ultrapower theorems and an Ehrenfeucht-Fraïssé type theorem. We also give characterizations of elementary classes in equality-free logic. As a by-product we characterize the sentences that are logically equivalent to an equality-free one.
