In Thinking like a Mall Steven Vogel argues that there is no authoritative nature independent of human standards to which one can appeal to correct damaging environmental practices. Human practices are the only basis for interpreting the environment and our ecologically destructive practices have made our environment into the degraded thing that it is. Revising these flawed practices requires becoming alienated from them; only then can we be responsible for them. Alienation is overcome by a democratic community who chooses the (...) practices that correct deficient ones and that we can recognise as expressions of ourselves and be at home in. This paper argues that there is a key step missing in this process, which is how we become alienated from our practices. It is only by appreciating the broader social and institutional horizon, ‘Ethical Life’, by which norms receive their authority and lose it, that we can understand alienation and the normative change necessary to correct it. Jurgen Habermas' construction of a critical social theory of society grounded in communicative reason is one of the very few real philosophical inventions of recent times that demands and repays extended engagement. In this elaborate and sympathetic study which places Habermas' project in the context of critical theory as a whole past and future, J. M. Bernstein argues that despite its undoubted achievements, it contributes to the very problems of ethical dislocation and meaninglessness it aims to diagnose and remedy. (...) Bernstein further argues that the precise character of the failures of Habermas' program demonstrate the necessity for a return to the first generation critical theory of Adorno. Reading across nearly the whole range of Habermas' corpus, Recovering Ethical Life traces the development of the theory of communicative reason from its inception in Knowledge and Human Interests through its elaboration in The Theory of Communicative Action and into its defense against postmodernism in The Philosophical Discourse of Modernity . This chapter argues that as the tradition of hermeneutic reflection develops, it should come to show more clearly this very real and original concern with ethical life. It is also the most promising way of thinking the questions of ethics in our times. The chapter remarks on this topic to Gadamer's work on the ethical sensibility of hermeneutics. But can the Good of the ethical life and the Justice of the political be reduced to measurement and calculation? If they are matters of measure, are they not also absolutely immeasurable? This article deals with the question of what type of ethics may be efficient to cope with actual problems in advanced societies, i.e. environmental problems, social conflicts, the usage of new technologies. The answer given is that it is not morality or ethical decisions that count but the customary (das Übliche). But the customary is a rather precarious resource. This is not only because it may turn out to be the particularistic orientation of social groups, like those of companies, (...) political parties, or even peer groups but also because it is eaten up by the progress of modernity. This is shown by comparison with the historical forerunner of the customary, namely what has been called ethical life (substantielle Sittlichkeit) by Hegel. (shrink)

In this essay, we aim to ground an alliance between Cynthia Willett’s theory of an ethics of eros and Hasana Sharp’s argument for a politics of renaturalization. Both approaches seek a vocabulary and practices for ethical life, which is not circumscribed by the requirement of rationality and is deeply attentive to relationships. The relations to which an ethics of eros and renaturalization must attend include social relations – the tender ministrations of mothers, lovers, and friends that sustain and (...) nourish (and sometimes threaten) each of us. Our lives, bodies, and minds, however, are also deeply involved with the nonhuman environment. Our existence depends on air, water, bacteria, shelter, and infinite other nonhuman beings. Our desires and needs include a habitable environment and even "biophilia." The increasing fragility of our ecosystems suggests that there is more need than ever for an ethics that goes not just beyond man – although that is certainly an ongoing project – but beyond the human. This essay is an attempt to ally our approaches in the feminist effort to produce a broad basis for ethics, allowing for a robust consideration of nonhuman nature. (shrink)

Kant's formalism remains unreal if it cannot be concretized in a historical ethos. An ethos belongs—with texts, contexts, structures, processes, networks, etc.—to an economy of customs and opinions, which presupposes that participating individuals have been and are being initiated and acculturated to it. The analysis of education, transmission, and transition unveils the irreducible—noneconomic and non-textual— essence of addressing and interlocution, without which no culture could exist. Hegel's account of ethical life can be shown to contradict Aristotle's in two main ways: first, Hegel follows Kant in emancipating virtue/duty from the particularity associated with the content of motivational drives and with Aristotle's eudaimonia. Hegel thus rejects Aristotelian happiness as the final end of rational action and prioritizes duty. However, against Kant, Hegel unites abstract duty and determined drives within a speculative notion of ethical duty: rational agents find happiness in heeding duty's call. Second, Hegel (...) follows Kant in emancipating agency's subjective dimension from the all-encompassing determinacy of Aristotelian substance metaphysics. At the same time and against Kant, Hegel unifies agency's undetermined, subjective dimension with the determinacy of objective norms and habitual praxis: ethical praxis must be animated by undetermined subjectivity whilst being determined. The purpose of this essay is to look at the ethical concerns and sensibilities that emerge out of Hegel and Heidegger’s respective interpretations of Antigone. Curiously, both of them turn to this ancient Greek tragedy in order to lay out the foundations of ethical life and the complexities of such a life in the present historical moment. The argument here in the end is that both Hegel and Heidegger find the lesson of the radical singularity defining (...) ethical life to be a key to what one sees in Antigone. Both see this above all in the role of death in the tragedy. Both focus upon questions of mourning, burial, and of the dead body. My suggestion is that birth too needs to be understood as confronting us with the problem of our being in the singular, our being an idiom among other idioms. (shrink)

What does it take to be subjectively free in an objectively rational social order? In this book Andreja Novakovic offers a fresh interpretation of Hegel's account of ethical life by focusing on his concept of habit or 'second nature'. Novakovic addresses two central and difficult issues facing any interpretation of his Philosophy of Right: why Hegel thinks that it is is better to relate unreflectively to the laws of ethical life, and which forms of reflection, especially (...) critical reflection, remain available within ethical life. Her interpretation draws on numerous parts of Hegel's system, particularly on his 'Anthropology' and his Phenomenology of Spirit, and also explores connections between his account and those of other philosophers. This article critically examines two central concepts in normative theory—ethical life and morality—by comparing the pragmatist approach with that of Critical Theory. This is done by way of a close scrutiny of Axel Honneth’s reading of the pragmatist philosophers John Dewey and George H. Mead. This focus on Honneth’s use of pragmatism serves as a port of entry to provide a comparative analysis of pragmatism and Critical Theory’s approaches to normativity. As I intend to show, Honneth’s troubles with (...) making sense of the pragmatist approach to normativity are a litmus test of some persistent ambiguities at the heart of his understanding of normativity. I set the stage by reconstructing Honneth’s reading of Dewey and Mead. That will provide the background against which to set up a comparison between the pragmatist conception of normativity and that of Critical Theory, with a view to assessing their relative validity. I then relate Honneth’s reading of the pragmatists to his own philosophical project and to the important place occupied in it by the same dualism of ethical life and morality. (shrink)

Private law and ethical life In Das Recht der Freiheit Axel Honneth develops his concept of social freedom. In this article I discuss Honneth’s project and critique one of its crucial aspects: Honneth’s views on the disruptive role of legal freedom in our society and its dependent relation to the sphere of social freedom. I argue that in his attempt in Das Recht der Freiheit to reactualize Hegel’s discourse on the realization of freedom for our time, Honneth risks (...) mistranslating Hegel’s discourse of ‘right’ by denying the sphere of legal relations a constitutive role for true freedom, and that because of this Honneth’s own theory of social freedom suffers: it becomes less clear whether it can still offer helpful insights into the proper place of legal freedom in our society. According to the received view, Kant and Hegel espouse diametrically opposed views of moral motivation. Kant holds that to act morally is to act out of reflective recognition that a proposed intention ought to be made into a universal law. Action of true moral worth can never be motivated by an immediate inclination. Hegel, in contrast, holds that the natural inclination of an agent, who has been successfully acculturated within a just society, is moral action. The received interpretation is right, (...) but it misses a critical part of Hegel's view and it is to this idea that the entire dissertation is devoted. Hegel does not reject Kant's claim that a necessary condition of morality is autonomous action, which is not determined immediately by natural inclinations or acquired habits. He thinks that precisely such action is the origin of any actual, shared form of ethical life. It is in his idea of a founding act of ethical life that Hegel claims Kant's inheritance. ;The founding act of ethical life does not, however, meet Kant's criterion of moral action. Modeled, in the Phenomenology of Spirit, on Antigone's tragedy, the founding agent acts without being conscious of the universal ethical significance of the act; nor does the community the act transforms acknowledge its significance. The lawmaker and the community are necessarily blind to each other. This tragic, mutual blindness is a condition of the most extreme violence. ;Are there, in reality, any such acts? Modern political life has its founding moment, according to Hegel, in the French Revolution, the Reign of Terror and the Napoleonic Wars. The old world and its political structures and institutions has collapsed, leaving action doomed to go unacknowledged. The violence of the Revolution and its aftermath is the condition of the foundation of a new shape of life. Though to be condemned absolutely, it is the necessary condition of the foundation of modern states. The concluding claim of the Philosophy of Right is that war, more generally, is the collapse of the actual life of states and the call to found a new shape of ethical life. (shrink)

In this chapter, I consider the relation of the three major spheres of ethical life that Hegel distinguishes – family, civil society, and the state – and analyse their contribution to the constitution of the "second nature" of objective spirit. Family and civil society are both analyzed by Hegel as ways of taking up and transforming our given nature such that a second ethical nature can be produced. Where the family helps bring forth such a second nature (...) by means of “education” (Erziehung), civil society does so by means of “cultural formation” (Bildung). As I show in sections (I) and (II), these processes are characterised by Hegel as steps of an actualization of freedom insofar they liberate us from our given nature without suppressing it and bring forth a second nature that gives freedom the consistency of living reality. However, while these processes constitute forms of liberation, they are at the same time forms of social subjection, involving discipline and normalization, the subjection to the will of another, and the adaption to the given necessities of the social world. Therefore, the completion of the process of liberation seems to require a third sphere that allows individuals to relate, collectively and politically, to the second nature thus produced. In order for the second nature of spirit to be a self-constitutive actualization of freedom, ethical life thus requires a specific political dimension that I turn to in section (III). While this political process is only possible on the basis of the republican infrastructures of family and civil society, it at the same time calls these infrastructures into question. Although Hegel himself does not develop this dimension properly, his conception of second nature points towards the desideratum of a politics of second nature. I will close the discussion of this political dimension in section (IV) by pointing out the general and diagnostic dimensions that such a politics of second nature can help us elaborate. (shrink)

Judge Wilhelm’s ethical critique of the aesthetic life, in Either/Or, is usually thought to be devastating. But it is rare for interpreters to consider whether the Judge’s characterization of the aesthetic life-view does justice to Aesthete A’s writings, let alone whether A could give a retort to the ethicist. This paper argues that much of the Judge’s criticism misses its mark. Part of the criticism is better directed at Johannes the Seducer, who cannot necessarily be identified with (...) A. Furthermore, A portrays in his essay on tragedy a life centred on unselfish love and attachment to family, albeit without what the Judge calls ‘repentance’. It is not ethics but the Judge’s distinctly Protestant religiosity that is missing from A’s view. The Judge accuses A of lacking faith, as though this were a character flaw in A, or something he could correct through an act of will. But in fact, I argue, faith is based on an immediate feeling, and cannot be acquired. Without religious faith, A tries to find other sources of meaning in life. The question whether life is worth living is what guides A in his inquiries into aesthetic value, yet that question itself is not aesthetic but ethical. (shrink)

ABSTRACT This article aims to initiate a discussion of the concept of perjury in Derrida’s later writing by engaging with some of his 1997–99 seminars on Le parjure et le pardon and placing them in relation to a number of works he published around the same time. It shows how, on Derrida’s account, perjury is not secondary to or parasitic upon truthful expression but an inexpungeable animating condition of the truth. It draws out the ethical and legal implications of (...) this claim and suggests that it is integral to understanding what is sometimes presented as Derrida’s “ethical turn.” Finally, in a more critical moment, it suggests taking issue with Derrida’s characterization of the ethical life as a staccato series of isolated, discrete, even incommensurable situations or encounters, and proposes to supplement his emphasis on the ethics of the other with an equally robust ethics of the self. Background: Older, frail patients with multimorbidity are at an especially high risk for disease severity and death from COVID-19. The social restrictions proved challenging for the residents, their relatives, and the care staff. While these restrictions clearly impacted daily life in Norwegian nursing homes, knowledge about how the pandemic influenced nursing practice is sparse. Aim: The aim of the study was to illuminate ethical difficult situations experienced by Norwegian nurses working in nursing homes during the COVID-19 pandemic. Research (...) design and participants: The research design involved semistructured individual interviews conducted with 15 nurses working in 8 nursing homes in 3 health regions in Norway, within both urban and rural areas. Ethical considerations: Oral and written information about the study was provided before the participants gave their written consent. The transcribed interviews were de-identified. The study was approved by the Norwegian Centre for Research Data. Findings: Four ethical difficult situations were identified: (a) turning the nursing home into a prison; (b) using medication to maintain peace and order; (c) being left alone with the responsibility; and (d) s. impact on decision-making. Conclusions: The nurses’ ethical challenges were intertwined with external factors, such as national and local guidelines, and the nurses’ own internalized factors, which were connected to their subjective professionality. This duality inflicted emotional distress and gave nurses few opportunities to perform nursing in a professionally sound and safe manner. (shrink)

The ethical theory discoverable in Hegel’s writings assigns, on Dean Moyar’s reading, an important role to the idea of conscience. Hegel’s discussion of conscience presents a theory of practical reasoning which requires that one be able to nest the particular purposes that motivate one’s actions in the objective purposes that have normative status insofar as they prevail in the institutions of modern ethical life. Those norms are legitimized by the fact that the institutions in question, most especially (...) the state, predicate themselves on their recognition of the rights of the particular individual. Individuals are not simply passive in relation to ethical, institutional norms. Individual moral deliberation plays a key role in the ethical development of society. Nonetheless, the norms that the state requires the individual to recognize do seem to be, in the last analysis, beyond appeal. Hegel makes, and Moyar presents, a powerful case for this position. Nonetheless, pacifist arguments present this position with a serious challenge. (shrink)

The question of the ethical life is arguably one of the most compelling, and urgent, questions of our time. As Peter Singer, among others, has pointed out, almost 10 million children die each year due to poverty, some of whom would not die if the amount of aid that we now offer increases significantly. As Singer has also pointed out, the exploitation of human beings and other animals is a major ethical and practical concern. There can be (...) little reasonable doubt that pain and suffering abound, in the world today, due to many causes such as poverty, disease, environmental degradation and destruction and anthropocentrism among others, just as there can be little reasonable doubt that some of the pain and suffering is preventable. So, what does it mean to live ethically today? Does it mean taking the point of view of the universe, as Sidgwick put it, memorably, rather than a narrow anthropocentric or speciesist view? Does it mean living in accordance with duties or obligations, or in light of recognised virtues, or with the minimisation of pain and suffering primarily in mind? Does it entail a consideration of the interests of other species and a rejection of the principle of the sanctity of human life? Does it mean not eating animals when other healthy alternatives are available, especially when those animals have been treated in ways that are inconsistent with their interests, whatever they may be? Does it mean taking active steps to reduce poverty on our part on a day to day basis? Is ethics exhausted in some sense today? And if we could reach some consensus on these questions, what difference would the ethical life make? Some argue that speciesism and the exploitation of human beings and other animals might diminish; that pain and suffering, especially gratuitous pain and suffering, would decrease, or at the very least, not increase; or that we will become more aware of the limitations of things such as "the traditional ethic of the sanctity of life", as Singer calls it. Some argue that the ethical life is closely related to a life of relationships, reflection and deliberation, all of which deepen our understanding and enrich us personally. Others argue that the ethical life is closely related to our search for a meaningful life - that the ethical life can help us to find meaning in a world in which "meaning", defined broadly, can seem elusive, enigmatic or unsubstantial. These and related issues and questions are explored in this collection, which illustrates the relevance, vitality and dynamism of ethics today. (shrink)

Institutions have ethical lives and characters just as their individual members do. Health care organizations must look critically at how professed institutional values can best be realized in day‐to‐day interactions within the institution and with the wider community.

This paper presents a novel Hegelian view of the relationship between aesthetics and democratic politics. My account avoids the drawbacks associated with approaches that reconceive all of the political in aesthetic terms or reduce the aesthetic to art. Instead, I maintain that the aesthetic is best understood as a distinct relationship of individual freedom. My argument proceeds by highlighting shortcomings of Honneth’s account of democratic Sittlichkeit and then addressing these impasses by integrating aesthetic freedom into the picture. The first two (...) steps of my argument concern the fact that the form of life outlined by Honneth aspires to be a form of free life, yet his account of democratic Sittlichkeit gives rise to two dimensions of unfreedom. The first problem of unfreedom pertains to the scope of freedom. The relationships of freedom incorporated into Honneth’s account fail to turn given social roles into the subject matter of a sufficiently unrestricted practice of freedom. The second problem of freedom concerns conformism. In a final step, I complete my argument that Honneth’s account is unsatisfactory and incomplete by showing that aesthetic freedom is socially valid and thus ought to form part of our accounts of democratic ethical life. Andrew Sayer undertakes a fundamental critique of social science's difficulties in acknowledging that people's relation to the world is one of concern. As sentient beings, capable of flourishing and suffering, and particularly vulnerable to how others treat us, our view of the world is substantially evaluative. Yet modernist ways of thinking encourage the common but extraordinary belief that values are beyond reason, and merely subjective or matters of convention, with little or nothing to do with the kind of beings people (...) are, the quality of their social relations, their material circumstances or well-being. The author shows how social theory and philosophy need to change to reflect the complexity of everyday ethical concerns and the importance people attach to dignity. He argues for a robustly critical social science that explains and evaluates social life from the standpoint of human flourishing. (shrink)

This first book-length study into the influence of Emmanuel Levinas on the thought and philosophy of Giorgio Agamben, Law, Relationality and the Ethical Life demonstrates how Agamben's immanent thought can be read as presenting a compelling, albeit flawed, alternative to Levinas's ethics of the Other. The publication of the English translation of The Use of Bodies in 2016 ended Giorgio Agamben's 20-year multi-volume Homo Sacer study. Over this time, Agamben's thought has greatly influenced scholarship in law, the wider (...) humanities, and social sciences. This book places Agamben's figure of form-of-life in relation to Levinasian understandings of alterity, relationality, and the law. Considering how Agamben and Levinas craft their respective forms of embodied existence - that is, a fully formed human which can live an ethical life - the book considers Agamben's attempt to move beyond Levinasian ethics through the liminal figures of the foetus and the patient in a persistent vegetative state. These figures, which Agamben uses as examples of bare life, call into question the limits of Agamben's non-relational use and form of existence. As such, it is argued, they reveal the limitations of Agamben's own ethics, whilst suggesting that his 'abandoned' project can and must be taken further. He uses common language and examples while remaining rigorous and fully explaining the common ethical theories.He opens with a chapter debunking thirteen misconceptions about ethics, such as "Ethics Is 'Nothing but Words,'" "Ethics Is Just a Matter of Opinion," and "Ethics Is Separate from Religion." This chapter should set the tone for a class that doesn't allow sloppy thinking or the reduction of ethics to feelings. The chapter concludes by defining ethics as common sense, meaning "the ability to find shared meaning in the words we use together to make sense of our lives" (51).The second chapter examines four ways of ethical thinking: truth, thinking in terms of the facts of the situation; consequences, thinking in terms of the results of an action; fairness, thinking in terms of equality and consistency; and character, thinking in terms of people's motivations, character traits, or both. He then uses practical problems to illustrate how, by using these four ways of ethical thinking, a conversation working toward an agreed-on action can take place. Ethics is no longer a shouting match but a way of appreciating different points of view and coming to a reasoned conclusion.The following chapters explore these four ways of ethical thinking. Chapter 3, "Truth," on its own would be an excellent text for any course that has "critical thinking" as a learning outcome. He covers moral responsibility, bias, self-deception, and power with succinct but powerful illustrations from life. He then moves on to discernment, which includes a discussion of good reading, evaluating sources of information, and evaluating arguments, including examples of the most common fallacies. His examples are from diverse sources such as Mark Twain's Life on the Mississippi, E. M. Forster's A Passage to India, the Bible, Francis Bacon, and situations in ordinary life. This gives richness to the text and presents these concepts in an accessible and interesting way.The next three chapters, "Consequences," "Fairness," and "Character," cover the main features of utilitarianism, deontological ethics, and virtue ethics [End Page 191] in good detail, with summaries about major figures associated with these theories: Jeremy Bentham, John Stuart Mill, Epictetus, Immanuel Kant, Aristotle, and St. Thomas Aquinas. These give the students biographical information as well as the significance of each thinker's work, explaining the key features, strengths, and weaknesses of their theories. The chapter on character has a very helpful discussion of the cardinal and theological virtues. Each chapter has suggestions for further reading.The appendix covers how to use this four-way method in group decision-making and in writing case studies or issues analyses, helpfully including an example of each. This book is written by a gifted teacher who draws students into his subject, shows them its relevance, and helps them develop the confidence and skills they need to take their part in the ethical conversations that will occur throughout their lives. Ethical leadership is the best response in the crisis state of postmodern man. Ethical leadership is a construct that leads to personal transfiguration, organizational effectiveness, improved interpersonal communication, and the achievement of a joint platform for professional action. Its development has also a beneficial effect as it brings ethics back to the core of public action, to the front line of organizational life and personal development. Whether it follows a religious model or a model resulting from laicized (...) religious values, leadership construing is based on a personal development process that follows an initiating structure in the world of values and their practice in personal ethical action. This is doubled by an ethics institutionalization process in which the organization itself becomes a structure of ethical and effective communication both inside and outside. An authentic leadership supposes positing the leader in the center of an ethical edifice in which achieving public good is done through instruments of personal development, ethics management and managerial ethics, ethical responsibility and sustainability, human condition improvement, spiritual transfiguration and authenticity. Added to this is the leader’s personal effort of involvement in the organization. For many of the ancient Greek philosophers, the ethical life was understood to be closely tied up with important notions like rational integrity, self-control, self-sufficiency, and so on. Because of this, feeling or passion (pathos), and in particular, pleasure, was viewed with suspicion. There was a general insistence on drawing up a sharp contrast between a life of virtue on the one hand and one of pleasure on the other. While virtue was regarded as rational and as (...) integral to advancing one’s well-being or happiness and safeguarding one’s autonomy, pleasure was viewed as largely irrational and as something that usually undermines a life of reason, self-control and self-sufficiency. I want to try to show that the hedonist Aristippus of Cyrene, a student and contemporary of Socrates, was unique in not drawing up such a sharp contrast. Aristippus, I argue, might be seen to be challenging the conception of passion and pleasure connected to loss of self-control and hubristic behavior. Not only do I try to show that pleasure according to Aristippus is much more comprehensive or inclusive than it is usually taken to be, but that a certain kind of control and self-possession actually play an important part in his conception of pleasure and in his hedonism as a whole. When ethical decisions have to be taken in critical, complex medical situations, they often involve decisions that set the course for or against life-sustaining treatments. Therefore the decisions have far-reaching consequences for the patients, their relatives, and often for the clinical staff. Although the rich psychology literature provides evidence that reasoning may be affected by undesired influences that may undermine the quality of the decision outcome, not much attention has been given to this phenomenon in health care or (...) ethics consultation. In this paper, we aim to contribute to the sensitization of the problem of systematic reasoning biases by showing how exemplary individual and group biases can affect the quality of decision-making on an individual and group level. We are addressing clinical ethicists as well as clinicians who guide complex decision-making processes of ethical significance. Knowledge regarding exemplary group psychological biases (e.g. conformity bias), and individual biases (e.g. stereotypes), will be taken from the disciplines of social psychology and cognitive decision science and considered in the field of ethical decision-making. Finally we discuss the influence of intuitive versus analytical (systematical) reasoning on the validity of ethical decision-making. (shrink)

This edited volume demonstrates that a virtue-centered approach to the ethical life is a consistent feature of William James’s moral reasoning from the 1880s until his death. Yet, little else remains constant within his writings on these subjects, and this inconstancy furthers interest in his work over a century later.

There is more to Hegel's position than fear of a potentially destructive modern freedom. The most striking thing about the Philosophy of Right is that in it the whole distinction between tradition and modern freedom is overcome. We find a view of things in which the freedom of individuals and the given institutional order come together as one. This does not mean that Hegel ignored the difference or distinction between the two sides; he had learned from Plato and a long (...) tradition to see in the self-conscious or subjective freedom of individuals a threat to the political and legal order. But he took up this traditional distinction between freedom and authority and tried to work out the relation between them at various stages of conflict and reconciliation. The result was a very strong affirmation of the modern world and of the connection in it between religion and history, church and state, politics and economics, and so on. I want in this essay to explore the justification for this positive affirmation of modern freedom. Section I looks at Hegel's position in light of the concluding passages of the Philosophy of Right on war and the endlessness of conflict within the historical realm. Here I claim that for Hegel the potentially destructive freedom of modern society does not really lie outside the ethical life of the state. I argue that the seemingly endless freedom of modern society is a necessary element, though only an element, of his philosophical and theological exposition of the state. Section II summarizes my view of how ethical life and modern freedom are related to one another in Hegel's thought. Commentators have not explained his insistence that the two can be both antagonistic and radically one. (shrink)

In this essay, I take on the problem of how to explain the socio-historical dimension of practical reason in Hegel. In contrast to many contemporary socio-historical readings of Hegel, I claim that a logical concept of spirit frames Hegel’s account of the historical process through which human beings have come to know their practical agency as actualized in institutional relations of mutual recognition. On my reading, Hegel conceptualizes each shape in the ‘Spirit’ chapter of his Phenomenology of Spirit as syllogistically (...) working out, practically and institutionally, how to mediate the demands of individual self-determination with the universal laws and customs of the community. At the same time, logical form doesn’t determine historical development, because the content of individuality, universality, and their mediation is earned only through historical experience. In English law there is a strong (though rebuttable) presumption that life should be maintained. This article contends that this presumption means that it is always unlawful to withdraw life-sustaining treatment from patients in permanent vegetative state (PVS) and minimally conscious state (MCS), and that the reasons for this being the correct legal analysis mean also that such withdrawal will always be ethically unacceptable. There are two reasons for this conclusion. First, the medical uncertainties inherent in the definition (...) and diagnosis of PVS/MCS are such that, as a matter of medical fact, it can never be established, with the degree of certainty necessary to rebut the presumption, that it is not in the patient’s best interest to remain alive. And second (and more controversially and repercussively), that even if permanent unconsciousness can be unequivocally demonstrated, the presumption is not rebutted. This is because there is plainly more to human existence than consciousness (or consciousness the markers of which can ever be demonstrated by medical investigations). It can never be said that the identity of the patient whose best interests are at stake evaporates (so eliminating the legal or ethical subject) when that person ceases to be conscious. Nor can it be said that the best interests of an unconscious person do not mandate continued biological existence. We simply cannot know. That uncertainty is legally conclusive, and (subject to resource allocation questions and views about the relevance of family wishes and the previously expressed wishes of the patient) should be ethically conclusive.
