In Mugido, a book of poems published in 2017, Marília Floôr Kosby adds a new chapter in this long and complicated history of the relationships between humans and oxen in Brazilian literature. Drawing from her personal and professional experience as an anthropologist and the daughter of a veterinarian that took care of farm animals in Rio Grande do Sul, Kosby reconstructs the existential space of small towns in the south of Brazil, where the food consumed in the big city is (...) produced. Embedded in this reality are the gender and class distinctions familiar elsewhere, but also a diversity of boundaries between species. With the poems of Mugido, together with the narrative that is scattered in small sections throughout the book, it is possible to reconstruct the systems of exploitation that can be seen from the perspective of those small towns: how the practices of manhood are molded by their relation with women, horses and cows; how practices of womanhood constitute themselves in relation with figures of masculinity, femininity and care towards animals; how this bundle of gender and species relations are connected to the food industry, that in its turn links small towns to the big city, in a large territorial distribution of positions and effects. Modern physics describes the mechanics of the Universe. We have discovered a new foundation for physics, which explains the components of the Universe with precision and depth. We quantify the existence of Aether, subatomic particles, and the force laws. Some aspects of the theory derive from the Standard Model, but much is unique. A key discovery from this new foundation is a mathematically correct Unified Force Theory. Three-legged animals do not exist today and such an animal is not found in the fossil record. Which constraints operate to result in the lack of a triped phenotype? Consideration of animal locomotion and robotic studies suggests that physical constraints would not prevent a triped from being functional or advantageous. As is reviewed here, the strongest constraint on the evolution of a triped is phylogenetic: namely, the early genetic adoption of a bilaterally symmetrical body plan occurring before the advent of (...) limbs. Presumably, this would greatly constrain any three-legged animal from ever evolving. Tripedalism is employed only by a few animals, but many use a tripod stance while engaged in a variety of activities. Because terms are often used interchangeably in the literature, a standardization of locomotion terminology is proposed. Understanding the constraints behind “forbidden” phenotypes forces us to confront gaps in our evolutionary understanding of which we may be unaware. (shrink)

The Reliquary of the Manger in the Church of São Roque in Lisbon was created in the early seventeenth century to house supposed fragments of the crib in Bethlehem, given to the Jesuits in Lisbon by Pope Clement VIII. The gilded and silvered bronze reliquary was paid for in part by a donation of c. 1615 from Donna Maria Rolim de Moura, wife of Luís da Gama, a great-grandson of Vasco da Gama. The size of the donation—specifically, the coin involved--has (...) been variously reported and this investigation argues for a correct value, as well as presenting its equivalence in modern currency. The argument is backed up by the discovery in Lisbon of an early seventeenth-century inventory which records the donation. (shrink)

This symposium on Monique Deveaux’s Poverty, Solidarity, and Poor-Led Social Movements includes commentaries by Sally Matthews, Renante D. Pilapil, Violetta Igneski, and Wouter Peeters, with a reply from Deveaux. The book makes the case that normative thinking about poverty should engage closely with the aims, insights, and actions of poor-led organizations and social movements. Challenging conventional framings of poverty by moral philosophers, Deveaux argues that chronic poverty is centrally about the subordination and dispossession of the poor – (...) not mere needs scarcity. To exclude people living in poverty from shaping antipoverty solutions is therefore to perpetuate their social-political domination and epistemic oppression. Deveaux’s book explains what a political reframing of poverty looks like from the vantage point of several poor-led organizations and social movements, using concrete examples from across the globe, and argues for political responsibility for solidarity with those movements. Political philosophers’ prescriptions for poverty alleviation have overlooked the importance of social movements led by, and for, the poor in the global South. I argue that these movements are normatively and politically significant for poverty reduction strategies and global justice generally. While often excluded from formal political processes, organized poor communities nonetheless lay the groundwork for more radical, pro-poor forms of change through their grassroots resistance and organizing. Poor-led social movements politicize poverty by insisting that, fundamentally, it is caused by (...) social relations of power that exploit and subordinate poor populations. These movements and their organizations also develop the collective capabilities of poor communities in ways that help them to contest the structures and processes that perpetuate their needs deprivation. I illustrate these contributions through a discussion of the Landless Rural Worker’s Movement in Brazil (the MST), a poor mobilization organization in Bangladesh (Nijera Kori), and the slum and pavement dweller movement in India. Global justice theorizing about poverty cannot just “add on” the contributions of such struggles to existing analyses of, and remedies for, poverty, however; rather, we will need to shift to a relational approach to poverty in order to see the vital importance of organized poor communities to transformative, poor-centered poverty reduction. When Kant finished the Critique of Pure Reason in 1781, he was 56 years old and had already published more than 25 essays and monographs. In this precritical oeuvre the young Kant unabashedly answered some of the most difficult questions of theoretical physics, physical geography, cosmology, theology, and moral theory, advancing ambitious theories about the origin and history of the universe, the nature of space, the age of the earth and the stability of its rotation, the causes of earthquakes, winds, (...) and fire, the ultimate components of reality, the soundness of optimism, the legitimate domain of logic, the character of the beautiful and the sublime, the first principles of theology and morality, the possibility of proving God’s existence, and—tellingly, at the end—the connection between metaphysics and madness. Since this dizzying speculative array appears to be unified only by the young Kant’s “metaphysical exuberance”, his precritical thought is often dismissed as the work of an unfocused dilettante. Baruch Spinoza began his studies learning Hebrew and the Talmud, only to be excommunicated at the age of twenty-four for supposed heresy. Throughout his life, Spinoza was simultaneously accused of being an atheist and a God-intoxicated man. Bertrand Russell said that, compared to others, Spinoza is ethically supreme, 'the noblest and most lovable of the great philosophers'. This book is an exploration of (a) what Spinoza understood God to be, (b) how, for him, the infinite and eternal power of God (...) is expressed, and (c) how finite human beings can have a true idea of this greatest of all entities. Sherry Deveaux begins with an analytic discussion of these three questions, and an explication of three different views held by contemporary commentators on Spinoza. She then shows that the commonly held views about Spinoza are inconsistent with Spinoza's texts, especially his magnum opus, the Ethics. Next comes an analysis of topics in Spinoza that must be understood in order correctly to answer the three questions. For example, the notions of 'power' and 'true idea' are discussed, along with Spinoza's definition of the 'essence' of a thing, which is shown to be central to the discussion of Spinoza's God. Deveaux then claims that Spinoza defines God's essence as 'absolutely infinite and eternal power' and that, contrary to the commonly held view that God's essence is identical with the attributes (e.g., thought and extension), God's essence or "power" is expressed through the attributes. “Agent-centered” approaches to global poverty insist that effective arguments for poverty reduction must specify the concrete duties of particular duty-bearers. This article takes up a recent, influential, version of this view, Thomas Pogge’s human rights-based argument for global economic reforms to reduce chronic deprivation. While signaling a welcome shift from the diffuse allocation of responsibilities common to much philosophical writing on poverty, I argue that Pogge’s approach too readily assigns to powerful institutions in the global North the role of devising (...) and directing anti-poverty initiatives. In so doing, he overlooks the agency—actual and potential—of the poor themselves, as evidenced by poor-led political movements and poor-centered, participatory models of poverty reduction in development theory and practice. While agent-oriented approaches are right to focus our attention on structures that cause poverty, they ought not to assume that the powerful agents responsible for these are the only—or most appropriate—agents to lead the way to poverty reduction. Just as development organizations working in the global South have come to recognize that the participation of poor communities is critical to the success of development strategies, so should normative theorists writing about global injustice acknowledge the importance of the poor as active agents in poverty reduction efforts. This book, now open-access from OUP, develops a normative theory of political responsibility for solidarity with poor populations by engaging closely with empirical studies of poor-led social movements in the Global South. Monique Deveaux rejects familiar ethical framings of problems of poverty and inequality by arguing that normative thinking about antipoverty remedies needs to engage closely with the aims, insights, and actions of “pro-poor,” poor-led social movements. Defending the idea of a political responsibility for solidarity, nonpoor outsiders—individuals, institutions, and (...) states—can help to advance a transformative anti-poverty agenda only by supporting the efforts of these movements. I begin by distinguishing two notions of model, the notion of a truth-making structure and the notion of a mathematical model (in one specific sense). I then argue that although the models of the semantic view have often been taken to be both truth-making structures and mathematical models, this is in part due to a failure to distinguish between two ways of truth-making; in fact, the talk of truth-making is best excised from the view altogether. The result is a version (...) of the semantic view which is better supported by the direct evidence offered for it, better equipped to achieve its avowed aims, and, I think, closer to the intentions of the original proponents of the view in many ways, despite some of their own declarations to the contrary. The historical debate on representation in cognitive science and neuroscience construes representations as theoretical posits and discusses the degree to which we have reason to posit them. We reject the premise of that debate. We argue that experimental neuroscientists routinely observe and manipulate neural representations in their laboratory. Therefore, neural representations are as real as neurons, action potentials, or any other well-established entities in our ontology.

British equality law protections for sex and gender reassignment have grown fraught as activists tussle over legal and social categories of gender, gender transitioning, and sex. This article considers the future of gender-related equality protections in relation to ‘decertification’—an imagined reform that would detach sex and gender from legal personhood. One criticism of decertification is that de-formalising gender membership would undermine equality law protections. This article explores how gender-based equality law could operate in conditions of decertification, drawing on legal thoughtways (...) developed for two other protected characteristics in equality law—religion and belief, and disability—to explore the legal responses and imaginaries that these two grounds make available. Religious equality law focuses on beliefs, communities, and practices, deemed to be stable, multivarious, and subject to deep personal commitment. Disability equality law focuses on embodied disadvantage, approached as social, relational, and fluctuating. While these two equality frameworks have considerable limitations, they offer legal thoughtways for gender oriented to both its hierarchies and its expression, including as disavowal. (shrink)

Biobanks are essential tools for furthering a broad range of medical research areas. However, despite the plethora of national and international laws and guidelines which apply to them, the access and sharing policies of biobanks are only sparsely addressed by regulatory bodies. The ‘give and take’ process of biosample sharing is largely left up to biobank stakeholders themselves to oversee; it is therefore both in stakeholders' power, and in their interest, to ensure that sample accessibility is fair. This is an (...) important step in motivating researchers to collaborate and pool samples, and is crucial to fostering trust in the absence of universally accepted standard practices. To date, little attention has been paid to how fairness considerations affect scientific material sharing, and no empirical research has been carried out to determine the role that fairness plays in collaborative studies. In order to begin to gain understanding in this area, we interviewed 36 biobank stakeholders currently working in Switzerland, focusing on their perceptions of current and optimal fair sharing practices. Our findings reveal that fairness is an important feature of exchange situations for these stakeholders, and that they have well-formed notions about the practical elements of fair sample access, although ideas about the concept of fairness itself are vague. In order to support efforts to network biobanks, attention should be paid to this issue to reassure all involved that they are getting a fair share in their cooperative efforts. (shrink)

Why read the chapter of Rousseau’s Social Contract devoted to the Roman assemblies? Because that text relies on the best available historical sources at the time, especially Carlo Sigonio’s work, to examine a key issue in Rousseau’s political philosophy: the implementation of common interest. In other words, the chapter on the comitia raises the following question: how can the people take part in public life? How can popular action maintain a republican government instead of threatening it? To understand this question, (...) and why Roman history plays a crucial part in the argument of The Social Contract, it helps to remember that for Rousseau a Republic is a government that does not act on behalf of private interests. Res publica, the recent book by renowned historian Claudia Moatti, further highlights Rousseau’s representation of the Roman Republic. The article examines in particular the meaning of the expression “public thing”, a literal translation of res publica, which appears twice in Rousseau’s text, demonstrating an understanding of Roman history that seems quite close to Claudia Moatti’s. Like her, Rousseau seems to identify two distinct visions of the Republic: one based on citizens’ rights, the other focused on the defence of the state. Today, as these two definitions of the Republic both appear in public debate, Rousseau’s vision of Rome is all the more striking and topical. (shrink)

Henri Bergson, Vladimir Jankélévitch, Emmanuel Levinas ont en commun d'avoir marqué la philosophie européenne du XXe siècle. En plus de leurs oeuvres respectives, ils ont tous les trois entretenu des liens manifestes à la fois dans leurs textes et dans leurs biographies. De ce trio, on ne peut pas dire que Bergson, philosophe pourtant déjà installé dans le paysage intellectuel français, prenne la place privilégiée du maître. Ni Jankélévitch, ni Levinas n'ont été, à proprement parler, ses élèves, cependant une relation (...) étroite s'est instaurée entre eux, marquée non pas par une posture de déférence, mais par des préoccupations conceptuelles partagées ainsi qu'un travail engagé sur des questions communes. Les pensées de Jankélévitch et Levinas sont liées par un même franc retrait vis-à-vis de la majorité des courants philosophiques dominants à leur époque, notamment la vogue existentialiste. N'adhérant pas à cette tendance, Jankélévitch et Levinas se tournent vers Bergson pour saisir l'inactualité des questions posées par sa pensée ; plutôt que la restitution de ses thèses, leurs interactions reposent sur un véritable dialogue dans lequel chacun apporte une variation nouvelle. Ces trois philosophes seront finalement réunis par le partage de questions fondamentales, qui résistent à la compréhension et qui s'ouvrent au souci de l'expérience proprement humaine : métaphysique, morale, temps. This article argues that liberal arguments for human rights minimalism, such as those of John Rawls and Michael Ignatieff, contain fundamental inconsistencies in their treatment of core rights to life and liberty. Insofar as their versions of minimalism foreground rights to physical security and basic freedom of movement, they cannot coherently exclude certain social and economic protections and liberties that directly support or are even partly constitutive of these rights. Nor do they have good grounds for putting the social and (...) private realms wholly beyond the purview of international law. “New” human rights that represent an expansion of civil rights in particular beyond the classic conception to encompass, for example, the right to freedom from sexual and gender-based violence, illustrate especially well the extent to which civil, social, and economic rights violations, and their remedies, are deeply interwoven. These emergent rights also directly challenge the dichotomy between public/political and private/social realms, and the corollary assumption that human rights violations occur mainly or exclusively in the former sphere. While the concerns that motivate arguments for human rights minimalism — considerations of pluralism and prudence — are legitimate, proponents would do best to reconsider the multiple roles that human rights in fact play, in spite of their essentially contested status. Gilbert et al. argue that the neuroethics literature discussing the putative effects of Deep Brain Stimulation on personality largely ignores the scientific evidence and presents distorted claims that personality change is induced by the DBS stimulation. This study contributes to the first-hand primary research on the topic exploring DBS clinicians’ views on post-DBS personality change among their patients and its underlying cause. Semi-structured interviews were conducted with sixteen clinicians from various disciplines working in Australian DBS practice for movement disorders and/or (...) psychiatric conditions. Thematic analysis of the interviews revealed five primary themes: 1) types, frequency and duration of personality change, 2) causes of personality change, 3) impact on patient and family, 4) communication, comprehension and awareness, and 5) management. Clinicians described a variety of personality changes in Parkinson’s disease following DBS including irritability, impulsivity and impaired decision-making. The frequency of personality change seen in patients varied amongst clinicians, but changes were overwhelmingly transient. Clinicians considered both DBS stimulation and additional factors as inducing personality change. For DBS patients with major depressive disorder, a restoration of pre-morbid personality was associated with alleviation of illness. Considerations for future research of personality change following DBS include selecting suitable tools for quantitative examination and developing a common language between the scientific and ethics communities. Clinical implications including recommendations for the informed consent process for patients and families and clinicians’ management of personality change are discussed. (shrink)

This paper assesses the claim that an agonistic model of democracy could foster greater accommodation of citizens' social, cultural and ethical differences than mainstream liberal theories. I address arguments in favor of agonistic conceptions of politics by a diverse group of democratic theorists, ranging from republican theorists - Hannah Arendt and Benjamin Barber - to postmodern democrats concerned with questions of identity and difference, such as William Connolly and Bonnie Honig. Neither Arendt's democratic agonism nor Barber's republican-inflected account of strong (...) democracy purports to include citizens' group-based cultural identities, and so cannot further the claim that agonistic politics is more inclusive of cultural and social differences. Postmodern agonistic democrats such as Connolly and Honig rely upon Arendt's account of the relationship between agonism and pluralism, and wrongly assume that her view of politics is compatible with formal respect and recognition for citizens' cultural group identities. While agonistic democracy helpfully directs us to attend to the importance of moral and political disagreement, I argue that the stronger claim that an agonistic model of democracy could more readily include culturally diverse citizens is simply unfounded. By contrast, recent liberal variants of agonistic democracy that conceive of legal and political institutions as tools for recognizing and mediating citizens' moral and cultural differences may suggest ways to deepen our democratic practices in plural societies. Flora Levin explores how and why music was so important to the ancient Greeks. She examines the distinctions that they drew between the theory of music as an art ruled by number and the theory wherein number is held to be ruled by the art of music. These perspectives generated more expansive theories, particularly the idea that the cosmos is a mirror-image of music's structural elements and, conversely, that music by virtue of its cosmic elements - time, motion, and (...) the continuum - is itself a mirror-image of the cosmos. These opposing perspectives gave rise to two opposing schools of thought, the Pythagorean and the Aristoxenian. Levin argues that the clash between these two schools could never be reconciled. Her book shows how the Greeks' appreciation of the profundity of music's interconnections with philosophy, mathematics, and logic led to groundbreaking intellectual achievements that no civilisation has ever matched. How should liberal democratic states respond to cultural practices and arrangements that run afoul of liberal norms and laws? This article argues for a reframing of the challenges posed by traditional or nonliberal cultural minorities. The author suggests that viewed from up close, such dilemmas are revealed to be primarily intracultural rather than intercultural conflicts, and reflect the political and practical interests of factions of communities much more than deep moral differences. Using the example of the reform of customary marriage (...) laws in post-apartheid South Africa, this article makes the case for a more pragmatic, politically focused approach to resolving conflicts of culture that it is argued is both more democratic and effective than alternatives recently advanced by liberals and deliberative democracy theorists. Boyer (bio)Organizers of the Human Genome Project (HGP) understood from the beginning that the scientific activities of mapping and sequencing the human genome would raise ethical, legal, and social issues that would require careful attention by scientists, health care professionals, government officials, and (...) the public. The establishment of the ELSI (ethical, legal, and social implications) programs at the National Human Genome Research Institute (NHGRI) and the Department of Energy (DOE) was thought to be vital to the success of the HGP in the United States. It also provided a novel approach to the simultaneous study of ethical, legal, and social issues and basic scientific issues. Eric Juengst, the first director of the ELSI program, described its origins in a previous issue of the Kennedy Institute of Ethics Journal (Juengst 1991). Now in its seventh year, the ELSI program has accomplished much. This article summarizes the evolution and goals of the ELSI program at NHGRI, outlines the program’s current research priorities with examples of activities within each priority area, and provides a look to the future, including the initiation of a strategic planning process.Evolution and Goals of the ELSI Research ProgramThe HGP’s “genomic” goals are unique: to map and sequence the entire human genome—some 3 billion base pairs that make up approximately 80–100,000 genes—and the genomes of related model organisms by the year 2005. This goal was particularly ambitious since, when it was proposed, the technologies for mapping and sequencing had yet to be developed. When the HGP was first established, its organizers also elaborated a set of ELSI goals, which they saw as vital to the success of the genome project. The original ELSI goals were: (1) to anticipate and address the implications of the HGP for individuals and society and (2) to examine the ELSI consequences of mapping and sequencing the human genome in order to stimulate public discussion. To meet these goals, the NHGRI created its ELSI research program in 1990. Along with mapping, sequencing, [End Page 291] and mammalian genetics, ELSI was one of four original branches in the NHGRI Division of Extramural Research that funded research in those areas. Although the individual “branches” no longer exist, the mechanisms for funding research remain much the same. While the overall goals of the program have not changed, the specific ways of achieving the goals have continued to evolve. The importance of the ELSI program lies not in the collection of a full set of data that will be valuable in and of itself, but in the value of using and interpreting this new set of information.Early on, the NHGRI described a set of somewhat more specific goals: (1) to develop a program to help understand the ethical, legal, and social implications of the human genome project and (2) to identify and define the major issues of concern and develop policy options to address them. These more specific goals have been largely met. As the most recent biennial NHGRI Progress Report notes, “a robust ELSI research and education program has been established, many of the most urgent ELSI issues have been identified, and many policy options to address these issues have been proposed” (NCHGR 1995, p. 21). Between 1990 and 1996, ELSI provided more than $32.5 million in funding through 128 research and education grants in more than 30 states and in Canada (Table 1). The ELSI research budget is unique in that when originally created, it was specifically tied to the amount of money provided for the overall NHGRI budget. The NHGRI originally devoted 3 percent of its extramural budget to fund ELSI projects, but in FY 1991, it increased the ELSI budget to 5 percent, a figure that remains today. Table 2 lists the expenditures for each fiscal year since 1990 and the cumulative expenditures to date. The ELSI research budget at NHGRI this year will be about $7 million. L’objectif de cet article est d’analyser les relations entre les mères ayant des enfants en situation de handicap ou présentant des difficultés développementales et les professionnelles au sein de crèches collectives dites inclusives. Dans le cadre d’une étude plus vaste, réalisée en France, portant sur le soutien des familles de jeunes enfants porteurs de handicap ou présentant des difficultés développementales, un entretien semi-directif a été réalisé auprès de neuf mères et de dix professionnelles pour analyser leurs relations. L’analyse qualitative de (...) données est réalisée selon l’approche de Braun et Clarke (2006). Les principaux résultats mettent en évidence, pour les mères, l’importance du partage d’informations, le soutien apporté par les professionnelles ainsi que leurs compétences. Les professionnelles, quant à elles, soulignent l’échange d’informations et leur rôle d’accompagnement dans l’acceptation du handicap de l’enfant ou dans le processus de parentalité.
