It explains the firm distinction made in Sāṃkhya and Yoga between an unchanging consciousness or Self (ātman/puruṣa) and an ever-changing realm of actions (karma) and substances (dravya) emanating from primordial matter (prakṛti) and expressed through her three modes (guṇa-s) of heaviness (tamas), passion (rajas), and lightness (sattva). This perspective differs radically from other Indian systems as well as from ancient Greek thought and the European Enlightenment tradition that gave way to analytical and continental philosophy.Sāṃkhya and Yoga proclaim that all manifestation arises from a pre-existent cause (sat-kārya-vāda). For instance, the book neglects the important reference to one’s chosen deity (iṣṭa-devatā, II:44) and leaves unexplored some decidedly theological, religious and devotional implications of the Yogasūtra.The author could have been more careful in explicating Jainism. Statements such as “all forms of action are morally dubious” and that “only death can bring liberation” (p. 60) repeat tropes often heard about Jain thought that echo Hindu and Buddhist critiques. This position overlooks the nuances contained in Umasvati’s Tattvārthasūtra that delineate the Jain 14-fold progression of ascent (guṇasthāna-s) wherein an individual attains a state of freedom while living in the human body at the 13th stage.This book sets the stage for further research into under-explored areas of the Yogasūtra. The rich celebration of the efficacy of ethical comportment in [End Page 1] the second chapter, though competently summarized in O’Brien-Kop’s chapter seven, calls out for further explication. The details regarding the body and the subtle body found in the third chapter of the Yogasūtra receive scant attention. One would hope that in future works the author will engage interlocutors such as Merleau-Ponty and Luce Irigaray on breath and embodiment. O’Brien-Kop’s chapter nine, “The Aesthetics of Freedom” calls into focus the centrality of the enlightenment process through which Buddhi, the bridge between conscious awareness and the material real, reverts increasingly toward sattva, the most refined and hence most liberating state of being. Brief mention is made here of the body’s perfectibility (p. 148). The discussion of metaphor at the end of the chapter invites a more extended conversation about light, jewels, and steadiness. This book advances conversations long in process about the nature and purpose of Yoga. The Yogasūtra was rediscovered in the 19th century and popularized by Swami Vivekananda, whose book Raja Yoga introduced the Yoga tradition to millions worldwide. Scholars such as Dasgupta, Eliade, Feuerstein, Larson, Barbara Stoler Miller, Rukmini, Whicher, Bryant and many others have helped bring rigor to the study of this important text, complementing the many popular translations by Swamis and teachers of modern postural Yoga.The book includes discussion questions at the end of each of the chapters. This chapter sketches a reading that confirms John Rawls's view that the stability argument of Part Three of Theory of Justice (TJ) was crucial for the success of TJ as a whole, that it was indeed flawed, and that fundamental ideas of Political Liberalism (PL) can be traced to the wide‐ranging consequences of recognizing the flaw in that argument. In Rawls's political liberalism, one can find at least two accounts of the way in which stability considerations enter into justificatory arguments (...) – one repairs the account in TJ and is similarly structured, while another pushes political liberalism in a more radical direction. The chapter briefly discusses how the thin theory of the good is employed in Rawls's stability analysis. It is not “the fact of pluralism” but the “fact of reasonable pluralism” that motivates Rawls's political turn; reasonable pluralism is the result of our best exercise of free practical reason. Gerald Graff argues that our schools and colleges make the intellectual life seem more opaque, narrowly specialized, and beyond normal learning capacities than it is or needs to be. Left clueless in the academic world, many students view the life of the mind as a secret society for which only an elite few qualify. Michael Moehler’s Minimal Morality is a wonderful and important book, from which I have learned a great deal. It reinvigorates rational choice moral theory in the process of confronting what I see as the most important issue in social and moral philosophy today: can those in a deeply morally divided society endorse a common moral framework to structure social cooperation? Is a rational moral order possible under conditions of deep and wide moral diversity? Minimal Morality’s answers are thoughtful and innovative. (...) I am not, however, entirely persuaded that Minimal Morality can fulfil its promise of grounding a cooperative order when ‘traditional’ modes moral justification cannot. (shrink)

Postema is critically concerned with whether Dworkin commits himself to individualistic and privatistic sense of interpretation and how Dworkin articulates the logical independency of pre-interpretive paradigm instances or social facts which form the object of interpretation and the end which is interpretively posited in the act of interpretation. Criticisms, for the most part, appear to be compatible with Dworkin's overall theory and may simply be additional explication of the character (...) of interpretation. "There is nothing in Dworkin's meta-theory of interpretation of social practices that requires attention to the interpretive activities of fellow participants. Herein lies the strong "protestantism" of Dworkin's theory. Not only is each participant encouraged to take up the interpretive enterprise...but each individual participant also has access to the truth, as it were, about what the practice is and requires, though private interpretation of the practice-text. While Dworkin seems to recognize that the practice is common, he counsels participants to live as if each had a private understanding of his own." In 2013, the first gun printed out of plastic by a 3D-printer was successfully fired in the US. This event caused a major media hype about the dangers of being able to print a gun. Law enforcement agencies worldwide were concerned about this development and the potentially huge security implications of these functional plastic guns. As a result, politicians called for a ban of these weapons and a control of 3D-printing technology. This paper reviews the security implications of 3D-printing technology (...) and 3D guns. It argues that current arms control and transfer policies are adequate to cover 3D-printed guns as well. However, while this analysis may hold up currently, progress in printing technology needs to be monitored to deal with future dangers pre-emptively. (shrink)

Theories of self-defence tend to invest heavily in ‘liability justifications’: if the Attacker is liable to have defensive violence deployed against him by the Defender, then he will not be wronged by such violence, and selfdefence becomes, as a result, morally unproblematic. This paper contends that liability justifications are overrated. The deeper contribution to an explanation of why defensive permissions exist is made by the Defender’s non-liability. Drawing on both canonical cases of self-defence, featuring Culpable Attackers, and more penumbral cases (...) of self-defence, involving Non-Responsible Threats, a case is assembled for the ‘Non-Liability First Account’ of self-defence. Viel­ leicht wird bald ein neuer Name für dieses erweiterte Forschungsgebiet erfor­ derlich sein; noch wesentlicher sind jedoch seine neuen Fragestellungen, Be­ griffe und Modelle. Anhand spezifischer Fallstudien aus der Physik soll in diesem Buch ge­ zeigt werden, in welcher Beziehung die traditionellen (...) The essays in this volume offer a reassessment of Jeremy Bentham's strikingly original legal philosophy. Early on, Bentham discovered his 'genius for legislation' - 'legislation' included not only lawmaking and code writing, but also political and social institution building and engineering of public spaces for effective control of the exercise of political power. In his general philosophical work, Bentham sought to articulate a public philosophy to guide and direct all of his 'legislative' efforts. 0Part I explores the philosophical foundations of (...) his public philosophy: his theory of meaning and framework for analysis and definition of key concepts, his theory of human affections and motivations, and his utilitarian theory of value. It is argued that, while concepts of pleasure and happiness play nominal roles in his theory of value, concepts of publicity, equality, and interests emerge as the dominant concepts of his public philosophy. Part II explores several dimensions of Bentham's jurisprudence, including his radically revised command model of law, his early reflections on justice and law in adjudication, his theories of judicial evidence, constitutional rights, the rule of law, and international law. The concluding essay demonstrates the centrality of the notion of publicity in his moral, legal and political thought. Emerging from this study is a positivist legal theory and a utilitarian moral-political philosophy that challenge in fundamental ways contemporary understandings of those doctrines. (shrink)

In the book The Stolen Bible: From Tool of Imperialism to African Icon (2016) the author provided a detailed analysis of Robert Moffat’s translation practice. In this article the author takes that analysis further, using the theoretical framework provided by Nathan Esala in this PhD thesis and forthcoming book, namely ‘translation as invasion’. Esala traces the colonial history of Africa-based translation practice, theorising the practice as ‘translation as invasion’. This article draws on Esala’s theorising in re-analysing Moffat’s translation practice among (...) the BaTlhaping. The article then goes on to argue for forms of decolonial ‘re-translation’, focussing on two forms of decolonial translation, Contextual Bible Study (CBS) as translation (as advocated by Esala) and Julius Nyerere’s use of indigenous Tanzanian poetics for translating the gospels. The article uses Michel Foucault’s notion of ‘heterotopic space’ and Sithembiso Zwane’s notions of ‘invigorated space’ and ‘invented space’ to theorise CBS and Nyerere’s poetics as forms of decolonial space for African-led re-translation, with potential implications for African community-based participatory development. Contribution: The article demonstrates how translation as a form of colonial invasion is practised by the missionary Robert Moffat, and how such forms of translation are being resisted through indigenous African reception of the Bible through re-translation practices. Parmenides didn't mention reference as such, but if he had he would have undoubtedly agreed with the philosophers who nowadays hold what is called "the axiom of existence": that one can only refer to what exists. The sources of possible support for this view are examined and rejected. Primary support for the axiom is given by two sorts of argument; one concerning quantification, the other summarizing a standard Parmenidean puzzle. Weaknesses in both are exposed. Finally, the relations between the axiom (...) and connected claims about predication and truth are probed, and an attempt is made to determine the limits of the mutual support these claims give one another. In his classic work The Mind and its Place in Nature published in 1925 at the height of the development of quantum mechanics but several years after the chemists Lewis and Langmuir had already laid the foundations of the modern theory of valence with the introduction of the covalent bond, the analytic philosopher C. D. Broad argued for the emancipation of chemistry from the crass physicalism that led physicists then and later—with support from a rabblement of philosophers who knew as (...) much about chemistry as etymologists—to believe that chemistry reduced to physics. Here Broad’s thesis is recast in terms more familiar to chemists. In the hard sell of particle physics, several prominent figures in chemistry—Hoffmann, Primas, and Pauling—have had their views interpreted to imply that they were sympathetic to greedy reductionism when in fact they were not. Indeed, being chemists without physicists as alter egos, they could not but side with Broad’s contention that chemistry, as a science that deals primarily in emergent phenomena which are beyond the purview of physicalism, owes no acquiescence to particle physics and its ethereal wares. Historically, among the most widely used expediencies in chemistry and materials science are additivity or mixture rules and their cohort transferability, all of which are devised and used under the mantle of naive reductionism. Here it is argued that while the transfer of functional groups between molecules works empirically to an extent, it is strictly outlawed by the no-cloning theorem of quantum mechanics. Several illustrative examples related to chemistry’s irreducibility to physics are presented and discussed. The failure of naive reductionism exhibited by the deep-inelastic scattering of leptons by A > 2 nuclei is traced to the same flawed reasoning that was the original basis of Moffitt’s ‘atoms in molecules’ hypothesis, the neglect of context, nuclei in the case of high-energy physics and molecules in the case of chemistry. A non-exhaustive list of other contexts from physics, chemistry, and molecular biology evidencing similar departures from the ideal of additivity or reductionism is provided for the perusal of philosophers. Had the call by the mathematician J. T. Schwartz for developments in mathematical linguistics possessed of a less single, less literal, and less simple-minded nature been met, perhaps it might have persuaded scientists to abandon their regressive fixation with unphysical reductionism and to adapt to new methodologies that engender a more nuanced handling of ubiquitous emergent phenomena as they arise in Nature than is the case today. The increased interest in exorcisms and demonology should be moderated by a proper understanding of the relationship between psychology and spirituality. There is an important link between psychological aberrations and possession, but too often and too quickly, a person’s mental health is dismissed or overlooked in favor of a diagnosis of demonic possession. The Church’s ritual of exorcism can be properly used only after psychological discernment, episcopal approval, and personal assent. Most priests are not prepared for the role of exorcist (...) and should spend their time more effectively addressing pastoral needs. The belief in demons is part of biblical witness and Catholic history. At the same time, we must avoid any tendency toward redemption by exorcism. (shrink)
