How should we understand the emotional rationality? This first part will explore two models of cognition and analogy strategies, test their intuition about the emotional desire. I distinguish between subjective and objective desire, then presents with a feeling from the "paradigm of drama" export semantics, here our emotional repertoire is acquired all the learned, and our emotions in the form of an object is fixed. It is pretty well in line with the general principles of rationality, especially the lowest reasonable (...) principles. Turned to the second part of this side of reasonable. I will inquire how emotional beliefs, desires, and behaviors contribute to the rationality. I will present a very general biological hypothesis: emotions by controlling highlights the characteristics of perception and reasoning, so that we remove the difficulties due in particular to lead to paralysis; they are being simulated by a simplified perception of information, thus limiting our practice and cognitive choice. How are we to understand emotional or axiological rationality? I pursue analogies with both the cognitive and the strategic models, testing them against intuitions about emotional desires. We distinguish two different classes of desires, the subjective and the objective, and propose that emotions have a semantics that derives from "paradigmatic scenarios", in terms of which our emotional repertoire is learned and the formal objects of our emotions fixed. This fits in well with emerging facts about how our emotional capacities develop, and it can also be squared with the general principles of rationality, particularly minimal rationality. In the second part, I return to the perspective of rationality. I ask how emotions contribute to the rationality of beliefs, desires, and behavior. I proffer a very general biological hypothesis: Emotions spare us the paralysis potentially induced by a particular predicament by controlling the salience of features of perception and reasoning; they temporarily mimic the informational encapsulation of perception and so circumscribe our practical and cognitive options. This article explores several philosophical questions raised by Rebecca Tuvel’s controversial article, “In Defense of Transracialism.” Drawing upon work on the concept of bad faith, including its form as “disciplinary decadence,” this discussion raises concerns of constructivity and its implications and differences in intersections of race and gender.

This paper uses Heidegger’s discussion of artifacts in Being and Time to motivate a phenomenological critique of Digital Rights Management regimes such as the one that allows DVDs to require one to watch commercials and copyright notices. In the first section, I briefly sketch traditional ethical approaches to intellectual property and indicate the gap that a phenomenological approach can fill. In section 2, following Heidegger’s discussion in Being and Time, I analyze DRM technologies as exemplary of the breakdown of things (...) as ready-to-hand; in particular, DRM is an example of what Heidegger calls "obstinacy." In section 3, I argue that this sort of concern generalizes beyond digital rights management due to its imbrication in ordinary, everyday experience. Finally, in section 4, I propose a framework for analyzing DRM in terms of our individuation from "the They," emphasizing how DRM undermines the functioning of "responsibility.". (shrink)

In this paper I critically examine recent developments in intellectual property law. In particular, from a point of view informed primarily by Marx and Foucault, I study (a) the rhetoric surrounding the Metallica lawsuit against Napster; (b) a pair of conflicting trademark cases surrounding the ownership of a word on the Internet; and (c) the software industry's move to win approval for “shrink-wrap” or “click here” licenses. I conclude that these developments indicate a new form of disciplinary power, where people (...) are individuated ex ante as consumers. Despite the celebrations of market cyberlibertarians, this move actually masks an increase in overt state power as the state apparatus is invoked to force individuals to agree to behave as disciplined consumers and accede to the system in the first place. Habermas and Rawls are two heavyweights of social and political philosophy, and they are undoubtedly the two most written about authors in this field. However, there has not been much informed and interesting work on the points of intersection between their projects, partly because their work comes from different traditions—roughly the European tradition of social and political theory and the Anglo-American analytic tradition of political philosophy. In this volume, contributors re-examine the Habermas-Rawls dispute with an eye toward the ways in (...) which the dispute can cast light on current controversies about political philosophy more broadly. Moreover, the volume will cover a number of other salient issues on which Habermas and Rawls have interesting and divergent views, such as the political role of religion and international justice. The relationship of consciousness to brain, which Schopenhauer grandly referred to as the "world knot," remains an unsolved problem within both philosophy and science. The central focus in what follows is the relevance of science---from psychoanalysis to neurophysiology and quantum physics-to the mind-brain puzzle. Many would argue that we have advanced little since the age of the Greek philosophers, and that the extraordinary accumulation of neuroscientific knowledge in this century has helped not at all. Increas- ingly, philosophers and scientists have (...) tended to go their separate ways in considering the issues, since they tend to differ in the questions that they ask, the data and ideas which are provided for consideration, their methods for answering these questions, and criteria for judging the acceptability of an answer. But it is our conviction that philosophers and scientists can usefully interchange, at least to the extent that they provide co~straints upon each other’s preferred strategies, and it may prove possible for more substantive progress to be made. Philosophers have said some rather naive things by ignoring the extraordinary advances in the neurosciences in the twentieth century. The skull is not filled with green cheese! On the other hand, the arrogance of many scientists toward philosophy and their faith in the scientific method is equally naive. This paper shows how the critical questions matching an argumentation scheme can be mod-eled in the Carneades argumentation system as three kinds of premises. Ordinary premises hold only if they are supported by sufficient arguments. Assumptions hold, by default, until they have been questioned. With exceptions the negation holds, by default, until the exception has been supported by sufficient arguments. By “sufficient arguments”, we mean arguments sufficient to satisfy the applicable proof standard.

Universal human rights and particular cultural identities, which are relativistic by nature, seem to stand in conflict with each other. It is commonly suggested that the relativistic natures of cultural identities undermine universal human rights and that human rights might compromise particular cultural identities in a globalised world. This article examines this supposed clash and suggests that it is possible to frame a human rights approach in such a way that it becomes the starting point and constraining framework for all (...) non-deficient cultural identities. In other words, it is possible to depict human rights in a culturally sensitive way so that universal human rights can meet the demands of a moderate version of meta-ethical relativism which acknowledges a small universal core of objectively true or false moral statements and avers that, beyond that small core, all other moral statements are neither objectively true nor false. This paper first elaborates ‘Art’ and the aesthetic as these concepts emerged in the eighteenth century, and uncovers the conflict between the resulting ideal of ‘art for art’s sake’ and the increasing use ‘art therapy’ for personal and social purposes. Taking this conflict to be a reason for the rejection of ‘Art’, it considers two accounts of ‘the end of Art’, one by Arthur Danto and the other by Nicholas Wolterstorff. The paper argues that both accounts fall short of adequately (...) recognizing the presence of the aesthetic in everyday life, and that once we do acknowledge the properly aesthetic character of ‘Design’, a way of thinking is opened up that can make better sense of art therapy. Scientists should, above all else, value the truth. To do this effectively, scientists should separate their identities from the data they produce. It will be easier to make replications mainstream if scientists are rewarded based on their stance toward the truth – such as when a scientist reacts positively to a failure to replicate – as opposed to a particular finding.

We argue that cognitive empathy and other instances of mental state attribution are a byproduct of self-awareness. Evidence is brought to bear on this proposition from comparative psychology, early child development, neuropsychology, and abnormal behavior.

There is persistent heterodoxy in the physics literature concerning the proper treatment of those quantons that are unstable against decay. Following a brief litany of this heterodoxy, I develop some of the consequences of assuming that such quantons can exist, undecayed and isolated, at definite times and that their treatment can be carried out within a standard quantum theoretic state space. This assumption requires hyperplane dependence for the unstable quanton states and leads to clarification of some recent results concerning deviations (...) from relativistic time dilation of decay lifetimes. In the course of the discussion I make some observations on the relationship of unstable quantons to quantum fields. (shrink)

I argue against a general time observable in quantum mechanics except for quantum gravity theory. Then I argue in support of case specific arrival time and dwell time observables with a cautionary note concerning the broad approach to POVM observables because of the wild proliferation available.

Although the emotional and motivational characteristics of dreaming have figured prominently in folk and psychoanalytic conceptions of dream production, emotions have rarely been systematically studied, and motivation, never. Because emotions during sleep lack the somatic components of waking emotions, and they change as the sleeper awakens, their properties are difficult to assess. Recent evidence of limbic system activation during REM sleep suggests a basis in brain architecture for the interaction of motivational and cognitive properties in dreaming. Motivational and emotional content (...) in REM and NREM laboratory mentation reports from 25 participants were compared. Motivational and emotional content was significantly greater in REM than NREM sleep, even after controlling for the greater word count of REM reports. (shrink)

An examination of tool marks and other evidence of manufacturing techniques on two astrolabes of identical pattern made by Hartman of Nuremberg in 1537 shows that all of the parts have been laid out with scribers and filed to final dimensions. All parts except the rings of the maters, which are castings, are made of sheet brass. The only machine tool employed was a small lathe with longitudinal feed, which was used to turn the diameters of the pins. Corresponding dimensions (...) of the two astrolabes differ by less than 0·2 mm on average, but parts are not interchangeable between the instruments. There is evidence that this pattern of astrolabe was made in batches with division of labour in Harman's shop. This paper is an introductory study intended to show methods of examination that reveal manufacturing techniques. (shrink)

Philosophy in the 19th century experienced a ‘turn from idealism,’ when idealist philosophies were largely abandoned for materialist ones. Scientific naturalism is now considered by many analytic philosophers to be the new orthodoxy, largely in part due to the success of the scientific method. The New Atheists, such as Daniel Dennett and Richard Dawkins, claim it is Darwin in particular who deserves much of the credit for repudiating the traditional Mind-first world view. Some, like Alvin Plantinga and Michael Behe, maintain (...) the opposite, that evolution casts doubt on naturalism and supports theism. This dissertation seeks to determine just what exactly the logical implications of evolutionary theory are. Is evolution incompatible with theism? Does the acceptance of evolution necessarily entail naturalism and preclude theism? Is it possible, as naturalism maintains, that everything can be reduced to physical processes, or are there too many recalcitrant phenomena that defy reduction? Answering these involves a detailed analysis of the concepts, ‘evolution,’ ‘naturalism,’ and ‘theism.’ Just what exactly does accepting evolutionary theory entail? How is it different from Darwinism? Is evolution guided or unguided? What is naturalism? There are many different types of metaphysical naturalists: eliminative materialists, physicalists, and emergent property dualists. What is the relationship between metaphysical naturalism and methodological naturalism? Theism affirms a creator God who sustains all being, who is transcendent and yet immanent. So if theism posits a God who is active in the world, does this mean that scientific investigation may at times have to admit supernatural explanations when natural ones fail? My general conclusion is a type of mitigated skepticism – that given evolution, neither naturalism nor theism logically follows. As to whether evolution is guided or unguided, the only correct position is ‘undetermined.’ In this instance metaphysical positions may fill in the gaps in knowledge by projection, but cannot fulfill the necessary and sufficient conditions required for knowledge. Metaphysical naturalism and theism are worldviews that an individual adopts as the most overall coherent explanation of the wide variety of experiences, intuitions, and reflections on their life. Whether evolution offers evidence for one and against the other is often based upon one’s prior metaphysical assumptions, since all facts are theory laden. The underdetermination of theory allows for multiple theories to cover the same phenomena, with each offering an epistemically adequate explanation. However, numerous recalcitrant anomalies which defy scientific explanation and reduction present problems for the strict naturalist. While neither naturalism nor theism can be determined to be objectively true, one can offer reasons for choosing one or the other on the basis of overall coherence. (shrink)
