The 21st century is steeped in claims to interconnection, technological innovation, and new affective intensities amid challenges to the primacy and centrality of 'the human'. Flashpoint epistemology attends to the lived difficulties that arise in teaching, policymaking, curriculum and research among continuous practices of differentiation, and for which there is no pre-existing template for judgment, resolution or action. Flashpoint Epistemology Volume 1 examines contemporary collisions and reworkings of cultural-political issues in education through arts and humanities-based approaches. How and whether lines (...) are (re)drawn in educational practice - and via who-what - between justice, morality, religion, ethics, subjectivities, intersectionality, the sublime and the senses are a particular focus. The volume offers innovative relational approaches and new narrativization strategies, examining the aporia experienced when operating in educational domains of inevitable, recurring, difficult, fortuitous and/or unforeseen flashpoints. The chapters will engage researchers seeking new approaches to education's complexities, nested discourses, and ever-moving horizons of enactment. Considerando este contexto, o objetivo deste artigo é examinar a relação que Arendt (...) parece estabelecer entre a verdade, como o lugar da memória, e o mundo, buscando compreender, assim, a relevância e a possível “função” desempenhada pela verdade factual no que diz respeito à política. Background: In Ontario, Canada, patients who lack decision-making capacity and have no family or friends to act as substitute decision-makers currently rely on the Office of the Public Guardian and Trustee to consent to long-term care (nursing home) placement, but they have no legal representative for other placement decisions. Objectives: We highlight the current gap in legislation for difficult transition cases involving unrepresented patients and provide a novel framework for who ought to assist with making these decisions and how these (...) decisions ought to be made. Research design: This paper considers models advanced by Volpe and Steinman with regard to who ought to make placement decisions for unrepresented patients, as well as current ethical models for analyzing how these decisions should be made. Participants and research context: We describe an anonymized healthcare transition case to illustrate the fact that there is no legally recognized decision-maker for placement destinations other than long-term care facilities and to show how this impacts all stakeholders. Ethical considerations: The case provided is an anonymized vignette representing a typical transition case involving an unrepresented patient. Findings: As a result of a gap in provincial legislation, healthcare providers usually determine the appropriate placement destination without a clear framework to guide the process and this can cause significant moral distress. Discussion: We argue for a team decision-making approach in the short term, and a legislative change in the long-term, to respect the patient voice, evaluate benefit and risk, enhance collaboration between healthcare providers and patients, and promote social justice. We believe that our approach, which draws upon the strengths of interprofessional teams, will be of interest to all who are concerned with the welfare and ethical treatment of the patients for whom they care. Conclusions: One of the main strengths of our recommendation is that it provides all members of the healthcare team (including nurses, social workers, therapists, and others) an increased opportunity to advocate on behalf of unrepresented patients. Strategies to increase influenza vaccination rates have typically targeted healthcare professionals and individuals in various high-risk groups such as the elderly. We argue that they should focus on increasing vaccination rates in children. Because children suffer higher influenza incidence rates than any other demographic group, and are major drivers of seasonal influenza epidemics, we argue that influenza vaccination strategies that serve to increase uptake rates in children are likely to be more effective in reducing influenza-related morbidity and mortality than those (...) targeting HCPs or the elderly. This is true even though influenza-related morbidity and mortality amongst children are low, except in the very young. Further, we argue that there are no decisive reasons to suppose that children-focused strategies are less ethically acceptable than elderly or HCP-focused strategies. (shrink)

This article contributes empirical findings and sociological theoretical perspectives to discussions of the role of community lay health workers, including in improving the health of individuals and communities. We focus on the role of the Health Trainer (HT), at its inception described as one of the most innovative developments in UK Public Health policy. As lay health workers, HTs are tasked with reducing health inequalities in disadvantaged communities by supporting clients to engage in healthier lifestyles. HTs are currently sociologically under-researched, (...) particularly in relation to occupational identity work, and the boundary work undertaken inter-occupationally with other health workers. To address this research lacuna, a qualitative study was undertaken with 25 HTs based in the Midlands region of the UK. In theorising our findings, we employ a novel combination of symbolic interactionist conceptualisation of 1) identity work, and of 2) boundary work. The article advances knowledge in the field of health and exercise by investigating and theorising how HTs construct, work at, manage, and communicate about professional/occupational boundaries, in order to provide personalised support to their clients in achieving and sustaining healthy behaviour change within the constraints of clients’ lifeworlds. As the rising costs of lifestyle-related diseases place increasing strain on public healthcare systems, the individual’s role in disease may be proposed as a healthcare rationing criterion. Literature thus far has largely focused on retrospective responsibility in healthcare. The concept of prospective responsibility, in the form of a lifestyle contract, warrants further investigation. The responsibilisation in healthcare debate also needs to take into account innovative developments in mobile health technology, such as wearable biometric devices and mobile apps, which may change (...) how we hold others accountable for their lifestyles. Little is known about public attitudes towards lifestyle contracts and the use of mobile health technology to hold people responsible in the context of healthcare. This paper has two components. Firstly, it details empirical findings from a survey of 81 members of the United Kingdom general public on public attitudes towards individual responsibility and rationing healthcare, prospective and retrospective responsibility, and the acceptability of lifestyle contracts in the context of mobile health technology. Secondly, we draw on the empirical findings and propose a model of prospective intention-based lifestyle contracts, which is both more aligned with public intuitions and less ethically objectionable than more traditional, retrospective models of responsibility in healthcare. Although Hannah Arendt is considered one of the major contributors to social and political thought in the twentieth century, this is the first general anthology ...

I defend the normativity of meaning against recent objections by arguing for a new interpretation of the ‘ought’ relevant to meaning. Both critics and defenders of the normativity thesis have understood statements about how an expression ought to be used as either prescriptive or semantic. I propose an alternative view of the ‘ought’ as conveying the primitively normative attitudes speakers must adopt towards their uses if they are to use the expression with understanding.

A unique selection of the most significant interviews given by Hannah Arendt, including the last she gave before her death in 1975. Some are published here in English for the first time. Arendt was one of the most important thinkers of her time, famous for her idea of "the banality of evil" which continues to provoke debate. Porém, este mesmo domínio parece estar conceptualmente vedado à intervenção da IA, por a interpretação jurídica consistir numa atividade puramente mental e não podendo a IA fazer mais do que imitar processos mentais. Será (...) isto verdade? Neste ensaio, defende-se que, embora o processo pelo qual os novos sistemas de IA (Inteligência Artificial generativa) não seja idêntico (nem, sequer, proximamente semelhante) ao processo mental pelo qual os juristas humanos fazem interpretação jurídica, o resultado é (pode ser) efetivamente idêntico. In Portugal, research productivity is nowadays essential for the positive assessment of academics, research units and study programmes. Academic inbreeding has been highlighted in the literature as one of the factors influencing research productivity. This paper tests the hypothesis that inbreeding is detrimental for research productivity, measured through the number of publications listed in Scopus. The study resorts to a database provided by the national Agency for Assessment and Accreditation of Higher Education, which comprises all academics teaching in all Portuguese (...) institutions in the academic year 2015/2016. The sample selected for the analysis contains all academics with a PhD in Sociology. The study uses a special regression model for the analysis: the negative binomial logit hurdle. This was necessary given the large amount of academics with no publications or citations in Scopus, which were the dependent variables to assess research performance. The analysis provides separate results for the probability of inbred academics of having no papers/citations, and for the probability of producing more papers/citations than the non-inbred. Findings suggest that academic inbreeding, defined at the institutional level, has no negative effect on research productivity, contrary to what was expected. However, when defined at the national level, academic inbreeding is detrimental for the recognition and the impact of research: academics with a foreign PhD are more likely to have citations compared to academics who obtained their PhD in Portugal. A tendency was also noted that inbreeding might be more detrimental to research productivity in faculties of Economics than in Social Sciences and Humanities. (shrink)

Regarding the selection of the legislative representatives, the elective system is the system that most democratic organizations have adopted. It has become so present nowadays that we take for granted the identification between elective system and representative democracy. But is this identification a correct one? I argue that it is not, since the meaning of 'representative democracy' has no reference to specific mode of selection of the representatives. And, since democracy and other methods of selection are compatible, it should adopted (...) the best one. The criteria of competence for the exercise of the political power ought to be the adopted method of selection, for it is the best one. I too argue that, in the context of division of labor into public and private labor, this is precisely what public representation aims: to leave to the experts the exercise of public labor. (shrink)

D. dissertation submitted to the Department of Philosophy at Harvard University in July 1988, grew out of an interest in the foundations of twentieth-century analytic philosophy. Believing that the idea of the primacy of judgment was an important one for understanding more recent issues in analytic philosophy, the author started to think about its historical antecedents. By examining Kant’s _Critique of Judgement_, Ginsborg explores the notion of a judgment of taste, as (...) a judgment which has intersubjective validity without being objectively valid, and therefore bear’s directly on the notion of the primacy of judgment as an aspect of Kant's account of objectivity. This new translation is an extremely welcome addition to the continuing Cambridge Edition of Kant’s works. English-speaking readers of the third Critique have long been hampered by the lack of an adequate translation of this important and difficult work. James Creed Meredith’s much-reprinted translation has charm and elegance, but it is often too loose to be useful for scholarly purposes. Moreover it does not include the first version of Kant’s introduction, the so-called “First Introduction,” which is now recognized as indispensable (...) for an understanding of the work. Werner Pluhar’s more recent translation, which does include the First Introduction, is highly accurate when it confines itself to rendering Kant’s German. However, it is often more of a reconstruction than a translation, containing so many interpretative interpolations that it is often difficult to separate out Kant’s original text from the translator’s contributions. Paul Guyer and Eric Matthews have provided a translation that compares to or exceeds Pluhar’s in its literal approach to the German, but that confines all interpretative material to footnotes and endnotes, so that the text itself, with all its unclarities and ambiguities, lies open to view. In addition, Guyer, as editor of the volume, has provided a great deal of valuable supplementary material. This includes an introduction with an outline of the work and details of the history of its composition and publication, and a wealth of endnotes offering clarifications of the text, background information, and, most strikingly, many references to related passages in Kant’s voluminous writings, particularly in connection with Kant’s earlier writings related to aesthetics. The edition also records differences among the first three editions of the work, and—of particular interest—erasures from and additions to Kant’s manuscript of the First Introduction. Although the introduction and endnotes reflect interpretative views that are sometimes disputable, this supplementary material makes the present edition into a valuable resource even for those able to read the text in German. Rights of Women attracted much UK media attention in late 2014 by bringing a judicial review that challenged the reduced provisions for family law legal aid available for victims of domestic violence: R v The Lord Chancellor and Secretary of State for Justice [2015] EWHC 35. In June 2015, within Rights of Women’s 40th anniversary year, Hannah Camplin interviewed the organisation’s Director Emma Scott about the decision to bring the judicial review, the advantages and challenges of the judicial review (...) process, and the experience of strategic litigation within the context of Rights of Women’s long history of campaigning for women’s rights. What emerged is a portrait of a feminist organisation in 2015, and, in a fast changing political and financial landscape, the dual importance of collaborative working and the need for flexibility in service provision and campaigning tools. Philosophy is one of the least inclusive disciplines in the humanities and this situation is changing only very slowly. In this article I consider how one of the women of the Wartime Quartet, Iris Murdoch, can help to challenge this situation. Taking my cue from feminist and philosophical practices, I focus on Murdoch's experience of being a woman and a philosopher and on the role experience plays in her philosophical writing. I argue that her thinking is best characterised with the (...) notion of common sense orsensus communis. This term recognises her understanding of philosophy as based in experience and as a shared effort ‘to make sense of our life’, as Mary Midgley puts it. (shrink)

The case study presented in this article is an analysis of Portuguese literary manuscripts which deal with religious Jewish controversies during the Middle Ages (13th to the 15th centuries). These documents came down to us through the subsequent centuries and are available in the Libraries of Portugal. The article is intended to make known variegated documents of religious controversies over three centuries, while, at the same time, we shall draft a brief presentation of their authors, except for anonymous works. In (...) the second part, we shall proceed with a definition of this particlar literary genre as well as analyze the characteristics and also the common features of the different works. In the end, we shall investigaate the discourses, motivations, and the different authors who have influenced the writing of these medieval controversies. (shrink)

In this paper, we review Keith Lehrer’s account of the basing relation, with particular attention to the two cases he offered in support of his theory, Raco (Lehrer, Theory of knowledge, 1990; Theory of knowledge, (2nd ed.), 2000) and the earlier case of the superstitious lawyer (Lehrer, The Journal of Philosophy, 68, 311–313, 1971). We show that Lehrer’s examples succeed in making his case that beliefs need not be based on the evidence, in order to be justified. These cases show (...) that it is the justification (rather than the belief) that must be based in the evidence. We compare Lehrer’s account of basing with some alternative accounts that have been offered, and show why Lehrer’s own account is more plausible. (shrink)

Feminist Theory After Deleuze addresses the encounter between one of the 20th century's most important philosophers, Gilles Deleuze, and one of its most significant political and intellectual movements, feminism. Feminist theory is a broad, contradictory, and still evolving school of thought. Tracing the many aesthetic, philosophical, and technological parallels between cinema and astronomy, Hannah Goodwin demonstrates how filmmakers have used cosmic imagery and themes to respond to the twentieth century's moments of existential dread. As our outlook on the future continues to change, Stardust illuminates the promise of cinema to bear witness to humanity's fragile existence within the vast expanse of the universe.

I point out some unclarities in Allison's interpretation of Kant's aesthetic theory, specifically in his account of the free play of the faculties. I argue that there is a tension between Allison's commitment to the intentionality of the pleasure involved in a judgment of beauty, and his view that the pleasure is distinct from the judgment, and I claim that the tension should be resolved by rejecting the latter view. I conclude by addressing Allison's objection that my own view fails (...) to accommodate judgments of non-beauty or ugliness. (shrink)

The study examines the employment experience of workers with intellectual disability in the hotel sector in Australia. Through a qualitative case study, we interviewed managers and WWID, and held focus groups with supervisors and colleagues at three hotels. We have used the theoretical framework of corporate social responsibility to investigate HR practices that create an ethical climate which promote authentic work experiences for WWID. The study found that participative work practices provide evidence of how WWID fit in at the workplace. (...) When workers are confronted with work-related anxieties, the pragmatic nature of existential authenticity becomes a reality. Our findings reveal that managing workers ethically can lead to more authentic work experiences. In turn, this may promote social inclusion of WWID and improve their reported well-being. (shrink)

Each of the books that Hannah Arendt published in her lifetime was unique, and to this day each continues to provoke fresh thought and interpretations. This was never more true than for Eichmann in Jerusalem, her account of the trial of Adolf Eichmann, where she first used the phrase “the banality of evil.” Her consternation over how a man who was neither a monster nor a demon could nevertheless be an agent of the most extreme evil evoked derision, outrage, (...) and misunderstanding. The firestorm of controversy prompted Arendt to readdress fundamental questions and concerns about the nature of evil and the making of moral choices. Responsibility and Judgment gathers together unpublished writings from the last decade of Arendt’s life, as she struggled to explicate the meaning of Eichmann in Jerusalem. At the heart of this book is a profound ethical investigation, “Some Questions of Moral Philosophy”; in it Arendt confronts the inadequacy of traditional moral “truths” as standards to judge what we are capable of doing, and she examines anew our ability to distinguish good from evil and right from wrong. We see how Arendt comes to understand that alongside the radical evil she had addressed in earlier analyses of totalitarianism, there exists a more pernicious evil, independent of political ideology, whose execution is limitless when the perpetrator feels no remorse and can forget his acts as soon as they are committed. Responsibility and Judgment is an essential work for understanding Arendt’s conception of morality; it is also an indispensable investigation into some of the most troubling and important issues of our time. Judith Butler’s recent work is exemplary of the trend in contemporary theory to consider ethics. Her deliberation over ethical questions, and the place of ethics in intellectual work, has undeniably intensified since September 11. This article will demonstrate, however, that this is a rendering explicit of what has always been implicit in her work. Rather than perceiving the ethical dimension of Butler’s writings in her increasing interest in thinkers such as Emmanuel Levinas and Hannah Arendt, I contend that it (...) is in her sustained interest in Hegel, and specifically in Hegelian recognition, that her work can be read as engaged with ethical concerns. This article highlights the growing critical concern with the prevalence of recognition in ethical theory and questions the possibility of theorising ethics outside of the recognition-paradigm. The genome editing technology CRISPR is described as a technological game-changer because of its flexibility and precision, and as an ethical game-changer due to its ability to engineer traits in living organisms without crossing species, avoiding a significant objection to genetically modified organisms (GMOs). In salmon farming, applications of CRISPR in breeding hold the promise of handling environmental and fish welfare challenges yet require social acceptance. Adopting an empirical bioethics framework, this stakeholder interview study shows that respecting species borders is (...) important, but not decisive, for acceptance among Norwegian stakeholders. The main objections are based on moral reflections about technology use and outcomes. These reflections combine principles and pragmatic deliberations of moral costs and benefits, suggesting that CRISPR applications with environmentally and ethically significant benefits can be socially acceptable. This indicates that the game-changing potential of CRISPR relies on the characteristics of the editing and the context in which the application takes place. (shrink)
